  9. Working with Indian Tribal Nations. A guide for DOE employees

    U.S. Department of Energy (DOE) employees and contractors frequently work with Indian tribes or nations as part of their jobs. The purpose of this guide is to help DOE employees and contractors initiate contact with tribes and build effective relationships. DOE maintains a unique government-to government relationship with tribal nations. This guide presents an overview of the history of the relationship between the tribes and the Federal government, as well as the laws and Executive Orders that define that relationship. The guide discusses the Federal government’s trust responsibility to the tribes, tribal treaty rights, and the Department of Energy’s American Indian policy. The guide also discusses important cultural differences that could lead to communication problems if not understood and provides examples of potential cultural misunderstandings. In particular the guide discusses tribal environmental beliefs that shape tribal responses to DOE actions. The guide also provides pointers on tribal etiquette during meetings and cultural ceremonies and when visiting tribal reservations. Appendix 1 gives examples of the tribal nations with whom DOE currently has Memoranda of Understanding. While this guide provides an introduction and overview of tribal relations for DOE staff and contractors, DOE has also designated Tribal Issues Points of Contacts at each of its facilities. A list of these Points of Contact for all DOE facilities is provided in Appendix 2. DOE staff and contractors should consult with the appropriate tribal representatives at their site before initiating contact with a tribal nation, because many tribes have rules and procedures that must be complied with before DOE staff or contractors may go on tribal lands or conduct interviews with tribal members. Appendix 3 is the complete DOE American Indian Policy. Appendices 4-6 are Executive Orders that govern the relationship of all federal agencies with tribal nations. DOE employees and staff are

    This report is based on the proceedings of the U.S. DOE Roundtable and Workshop on Advanced Steel Technologies Workshop hosted by Oak Ridge National Laboratory (ORNL) in cooperation with the U.S. Department of Energy s (DOE s) Advanced Manufacturing Office (AMO) on held on June 23, 2015. Representatives from industry, government, and academia met at the offices of the National Renewable Energy Laboratory in Washington, DC, to share information on emerging steel technologies, issues impacting technology investment and deployment, gaps in research and development (R&D), and opportunities for greater energy efficiency. The results of the workshop are summarized in this report. They reflect a snapshot of the perspectives and ideas generated by the individuals who attended and not all-inclusive of the steel industry and stakeholder community.

    The Anchorage, Alaska Roundtable on Tribal Energy Policy convened at 10:00 a.m., Thursday April 15th, at the downtown Anchorage Hilton. The meeting was held by the Department of Energy (DOE) Office of Indian Energy Policy and Programs (Office of Indian Energy). Tracey LeBeau, Director of the Office of Indian Energy, and Pilar Thomas, Deputy Director-Policy of the Office of Indian Energy, represented DOE. Approximately twenty-seven people attended the meeting, including representatives of three native Alaskan villages, four Alaskan tribal corporations representing more than 40 tribal governments, as well as representatives from tribal associations and conferences. Interested state, federal, and non-profit representatives also were present. A full list of attendees is at the end of this summary. The meeting was facilitated by the Udall Foundation’s U.S. Institute for Environmental Conflict Resolution (U.S. Institute).

    My interest in energy planning on the Navajo Nation stemmed from the desire to improve energy resource development in my own community. The legacy of environmental and health impacts from uranium and coal mining motivated me to find ways of developing energy resources in a manner more consistent with cultural values and the visions of the Navajo Nation. While I have developed many valuable technical analysis skills and tools in my Ph.D. program, most of the knowledge about Indian energy issues requires significant on-the-ground engagement with communities and their leaders. As a Tribal Energy Program intern, I have developed important connections in the area of tribal energy working with tribal leaders and my fellow interns.

    The goal of the 6th International Meshing Roundtable is to bring together researchers and developers from industry, academia, and government labs in a stimulating, open environment for the exchange of technical information related to the meshing process. In the pas~ the Roundtable has enjoyed significant participation born each of these groups from a wide variety of countries. The Roundtable will consist of technical presentations from contributed papers and abstracts, two invited speakers, and two invited panels of experts discussing topics related to the development and use of automatic mesh generation tools. In addition, this year we will feature a "Bring Your Best Mesh" competition and poster session to encourage discussion and participation from a wide variety of mesh generation tool users. The schedule and evening social events are designed to provide numerous opportunities for informal dialog. A proceedings will be published by Sandia National Laboratories and distributed at the Roundtable. In addition, papers of exceptionally high quaIity will be submitted to a special issue of the International Journal of Computational Geometry and Applications. Papers and one page abstracts were sought that present original results on the meshing process.     The Schatz Energy Research Center (SERC) assisted the Yurok Tribe in investigating the feasibility of creating a permanent energy services program for the Tribe. The original purpose of the DOE grant that funded this project was to determine the feasibility of creating a full-blown Yurok Tribal electric utility to buy and sell electric power and own and maintain all electric power infrastructure on the Reservation. The original project consultant found this opportunity to be infeasible for the Tribe. When SERC took over as project consultant, we took a different approach. We explored opportunities for the Tribe to develop its own renewable energy resources for use on the Reservation and/or off-Reservation sales as a means of generating revenue for the Tribe. We also looked at ways the Tribe can provide energy services to its members and how to fund such efforts. We identified opportunities for the development of renewable energy resources and energy services on the Yurok Reservation that fall into five basic categories: • Demand-side management – This refers to efforts to reduce energy use through energy efficiency and conservation measures. • Off-grid, facility and household scale renewable energy systems – These systems can provide electricity to individual homes and Tribal facilities in areas of the Reservation that do not currently have access to the electric utility grid. • Village scale, micro-grid renewable energy systems - These are larger scale systems that can provide electricity to interconnected groups of homes and Tribal facilities in areas of the Reservation that do not have access to the conventional electric grid. This will require the development of miniature electric grids to serve these interconnected facilities. • Medium to large scale renewable energy development for sale to the grid – In areas where viable renewable energy resources exist and there is access to the conventional electric utility grid, these resources can be

    Computation in its many forms is the engine that fuels our modern civilization. Modern computation—based on the von Neumann architecture—has allowed, until now, the development of continuous improvements, as predicted by Moore’s law. However, computation using current architectures and materials will inevitably—within the next 10 years—reach a limit because of fundamental scientific reasons. DOE convened a roundtable of experts in neuromorphic computing systems, materials science, and computer science in Washington on October 29-30, 2015 to address the following basic questions: Can brain-like (“neuromorphic”) computing devices based on new material concepts and systems be developed to dramatically outperform conventional CMOS based technology? If so, what are the basic research challenges for materials sicence and computing? The overarching answer that emerged was: The development of novel functional materials and devices incorporated into unique architectures will allow a revolutionary technological leap toward the implementation of a fully “neuromorphic” computer. To address this challenge, the following issues were considered: The main differences between neuromorphic and conventional computing as related to: signaling models, timing/clock, non-volatile memory, architecture, fault tolerance, integrated memory and compute, noise tolerance, analog vs. digital, and in situ learning New neuromorphic architectures needed to: produce lower energy consumption, potential novel nanostructured materials, and enhanced computation Device and materials properties needed to implement functions such as: hysteresis, stability, and fault tolerance Comparisons of different implementations: spin torque, memristors, resistive switching, phase change, and optical schemes for enhanced breakthroughs in performance, cost, fault tolerance, and/or manufacturability.

    The first phase of the Hualapai Tribal Utility Development Project (Project) studied the feasibility of establishing a tribally operated utility to provide electric service to tribal customers at Grand Canyon West (see objective 1 below). The project was successful in completing the analysis of the energy production from the solar power systems at Grand Canyon West and developing a financial model, based on rates to be charged to Grand Canyon West customers connected to the solar systems, that would provide sufficient revenue for a Tribal Utility Authority to operate and maintain those systems. The objective to establish a central power grid over which the TUA would have authority and responsibility had to be modified because the construction schedule of GCW facilities, specifically the new air terminal, did not match up with the construction schedule for the solar power system. Therefore, two distributed systems were constructed instead of one central system with a high voltage distribution network. The Hualapai Tribal Council has not taken the action necessary to establish the Tribal Utility Authority that could be responsible for the electric service at GCW. The creation of a Tribal Utility Authority (TUA) was the subject of the second objective of the project. The second phase of the project examined the feasibility and strategy for establishing a tribal utility to serve the remainder of the Hualapai Reservation and the feasibility of including wind energy from a tribal wind generator in the energy resource portfolio of the tribal utility (see objective 2 below). It is currently unknown when the Tribal Council will consider the implementation of the results of the study. Objective 1 - Develop the basic organizational structure and operational strategy for a tribally controlled utility to operate at the Tribe’s tourism enterprise district, Grand Canyon West. Coordinate the development of the Tribal Utility structure with the development of the Grand Canyon

    The Government-University-Industry Research Roundtable was created just over a decade ago to provide a unique forum for dialogue among top government, university, and industry leaders of the national science and technology enterprise. The purpose is to facilitate personal working relationships and exchange of ideas about issues, problems, and promising opportunities that are facing those charged with developing and deploying science and technology resources. The open dialogue and informal exchange of ideas preclude a process of making formal recommendations or offering specific advice. Instead, the Roundtable seeks to stimulate new approaches by dissemination of its discussions, and pro-active contacts with organizations that may want to build on the idea base it establishes. After introductory material on the structure and operation of the Roundtable, accomplishments on current projects are described.     The major accomplishment of the past year in the Roundtable`s continuing work on issues of concern to the academic enterprise is the preparation of two documents - Science and Technology in the Academic Enterprise: Status, Trends, and Issues and Perspectives on Financing Academic Research Facilities: A Resource for Policy Formulation. The significance of these two publications is that they both organize a large amount of complex and often controversial material in a way that is useful for further discussions and, in some cases, action by the government and higher education communities. The test for the Roundtable now is whether it can stimulate these follow-on activities. The model in this regard is the Federal Demonstration Project, where the Roundtable stimulated specific government-university joint actions in streamlining research grant administration. All of these activities are described below in greater detail.

    The project helped tribal leaders, staff and community members on the Grand Portage, Leech Lake, and White Earth Reservations better understand their community's energy usage, assess local resources that might be utilized to reduce energy consumption and begin to formulate appropriate development strategies. The principal guiding interest was to assess energy usage and the potential for wind resource development on each of the three reservations. Key tribal staff became familiar with wind energy technology and assessment methodologies that will be of continued use as each tribe moves forward with development projects. The findings were that wind resources are available at each reservation with varying degrees of potential for development. At White Earth moderate to excellent resources are present at White Earth village and along the U.S. 59 corridor sufficient to be tapped to serve several scattered tribal complexes. At Grand Portage a former community television repeater tower site provides a viable elevated location for a wind turbine to serve the tribal community settlement. At Leech Lake, while most constrained by tree cover, a site adjacent to a casino holds promise for the newer taller wind turbines now coming to market at ever-increasing taller rotor heights. The project developed considerable data of importance regarding the potential for wind development on and near each reservation.

    The Government-University-Industry Research Roundtable was created just over a decade ago to provide a unique forum for dialogue among top government, university, and industry leaders in the national science and technology enterprise. The purpose is to facilitate personal working relationships and exchange of ideas about issues, problems, and promising opportunities facing those charged with developing and deploying science and technology resources. In 1996, Council meetings focused on the following: (1) the impact of information technology on the structure of research and educational organizations; (2) ways to improve communication between the science and engineering community and the public; and (3) new approaches both to measuring the results of research investments, and to communicating those metrics to non-technical decision-makers and to the public. Significant milestones were also achieved in four major projects, representing, impart, follow-up activity from previous Council Meeting discussions: (1) facilitating the Federal Demonstration Partnership, designed to maximize the efficiency of the federal research support system; (2) compiling results of a regional workshop on experiences in industry-university collaborative organization; (3) publishing the results of a study comparing the cost structures for research performed in the industrial, academic, and government laboratory sector; and (4) catalyzing, and participating in, a series of campus-based convocations on stresses being experienced in the research university environment.

    Effective government-to-government interactions with tribal nations and maintaining stakeholder relations with members of tribes are increasingly important to the U.S. Department of Energy (DOE) Office of Legacy Management (LM). As of October 2011, LM was responsible for long-term surveillance and maintenance of 87 sites and facilities in the continental U.S. and Puerto Rico, including some sites on tribal lands. The sites on tribal lands can affect natural resources that are managed or used by tribes, or the sites can potentially affect areas of cultural significance to tribal nations in Alaska, Arizona, Colorado, New Mexico, Utah, Washington, and Wyoming. Tribes are separate sovereign governments recognized in the U.S. Constitution and are significant stakeholders for LM sites. The tribes are individual nations with diverse histories, cultures, customs, religions, and laws. LM has regular communication with the affected tribes to inform members of issues, to allow the tribe to participate in decision making, to provide technical reviews, and to ensure tribal concerns are addressed. Four LM sites are in the Navajo Nation. Three of those sites contain uranium mill tailings disposal cells regulated under long-term surveillance and maintenance programs that require monitoring and annual inspections. The fourth site was remediated but still has a groundwater plume that LM is responsible for. DOE and LM have worked with the Navajo Nation for almost 30 years on technical issues and to ensure tribal concerns are addressed. (authors)

    Wind Generation Feasibility Warm Springs Power and Water Enterprises (WSPWE) is a corporate entity owned by the Confederated Tribes of the Warm Springs Reservation, located in central Oregon. The organization is responsible for managing electrical power generation facilities on tribal lands and, as part of its charter, has the responsibility to evaluate and develop renewable energy resources for the Confederated Tribes of Warm Springs. WSPWE recently completed a multi-year-year wind resource assessment of tribal lands, beginning with the installation of wind monitoring towers on the Mutton Mountains site in 2003, and collection of on-site wind data is ongoing. The study identified the Mutton Mountain site on the northeastern edge of the reservation as a site with sufficient wind resources to support a commercial power project estimated to generate over 226,000 MWh per year. Initial estimates indicate that the first phase of the project would be approximately 79.5 MW of installed capacity. This Phase 2 study expands and builds on the previously conducted Phase 1 Wind Resource Assessment, dated June 30, 2007. In order to fully assess the economic benefits that may accrue to the Tribes through wind energy development at Mutton Mountain, a planning-level opinion of probable cost was performed to define the costs associated with key design and construction aspects of the proposed project. This report defines the Mutton Mountain project costs and economics in sufficient detail to allow the Tribes to either build the project themselves or contract with a developer under the most favorable terms possible for the Tribes.

    The Tribe is working to reduce energy consumption and expense in Tribally-owned governmental buildings and low income housing sites. In 2009, the Tribe applied to the U. S. Department of Energy for funding to conduct energy audits of Tribally-owned governmental buildings. Findings from the energy audits would define the extent and types of energy efficiency improvements needed, establish a basis for energy priorities, strategies and action plans, and provide a benchmark for measuring improvements from energy efficiency implementations. In 2010, the DOE awarded a grant in the amount of $95,238 to the Tribe to fund the energy audits of nine governmental buildings and to pay for travel expenses associated with attendance and participation at the DOE annual program reviews. In 2011, the Tribe applied for and was awarded a DOE grant in the amount of $75,509 to conduct energy audits of the remaining 30 Tribally-owned governmental buildings. Repeating mobilization steps performed during the first DOE energy audits grant, the Tribe initiated the second round of governmental building energy audits by completing energy auditor procurement. The selected energy auditor successfully passed DOE debarment and Sault Tribe background clearances. The energy audits contract was awarded to U. P. Engineers and Architects, Inc. of Sault Ste. Marie, Michigan. The Tribe continued mobilizing for the energy audits by providing the energy auditor with one year of electric, gas and water utility invoice copies per building, as well as supplemental building information, such as operating hours. The Tribe also contacted building occupants to coordinate scheduling for the on-site energy audit inspections and arranged for facilities management personnel to guide the energy auditor through the buildings and answer questions regarding building systems.

    Background: The Rosebud Sioux Tribe (RST) is located in south central South Dakota near the Nebraska border. The nearest community of size is Valentine, Nebraska. The RST is a recipient of several Department of Energy grants, written by Distributed Generation Systems, Inc. (Disgen), for the purposes of assessing the feasibility of its wind resource and subsequently to fund the development of the project. Disgen, as the contracting entity to the RST for this project, has completed all the pre-construction activities, with the exception of the power purchase agreement and interconnection agreement, to commence financing and construction of the project. The focus of this financing is to maximize the economic benefits to the RST while achieving commercially reasonable rates of return and fees for the other parties involved. Each of the development activities required and its status is discussed below. Land Resource: The Owl Feather War Bonnet 30 MW Wind Project is located on RST Tribal Trust Land of approximately 680 acres adjacent to the community of St. Francis, South Dakota. The RST Tribal Council has voted on several occasions for the development of this land for wind energy purposes, as has the District of St. Francis. Actual footprint of wind farm will be approx. 50 acres. Wind Resource Assessment: The wind data has been collected from the site since May 1, 2001 and continues to be collected and analyzed. The latest projections indicate a net capacity factor of 42% at a hub height of 80 meters. The data has been collected utilizing an NRG 9300 Data logger System with instrumentation installed at 30, 40 and 65 meters on an existing KINI radio tower. The long-term annual average wind speed at 65-meters above ground level is 18.2 mph (8.1 mps) and 18.7 mph (8.4 mps) at 80-meters agl. The wind resource is excellent and supports project financing.
