The goal of the EAP is to provide a conduit through which the individual can resolve personal and workplace problems. The HSS EAP Manager aids the DOE contracting organizations to maintain a healthy and productive workforce.

    This report is a summary of the data submitted by DOE and DOE contractors for 1979 for 104,986 employees, representing 81% of all DOE and DOE contractor employees. Of all employees monitored, 47.6% received a dose equivalent that was less than measurable, 50.8% a measurable exposure less than 1 rem, and 1.6% an exposure greater than 1 rem. Only three DOE contractor employees at three separate facilities received whole-body dose equivalents greater than 5 rem during 1979. The two reported cases of internal depositions were both less than the annual dose-equivalent standard and resulted from accidental exposures. (PSB)

    U.S. Department of Energy (DOE) employees and contractors frequently work with Indian tribes or nations as part of their jobs. The purpose of this guide is to help DOE employees and contractors initiate contact with tribes and build effective relationships. DOE maintains a unique government-to government relationship with tribal nations. This guide presents an overview of the history of the relationship between the tribes and the Federal government, as well as the laws and Executive Orders that define that relationship. The guide discusses the Federal government’s trust responsibility to the tribes, tribal treaty rights, and the Department of Energy’s American Indian policy. The guide also discusses important cultural differences that could lead to communication problems if not understood and provides examples of potential cultural misunderstandings. In particular the guide discusses tribal environmental beliefs that shape tribal responses to DOE actions. The guide also provides pointers on tribal etiquette during meetings and cultural ceremonies and when visiting tribal reservations. Appendix 1 gives examples of the tribal nations with whom DOE currently has Memoranda of Understanding. While this guide provides an introduction and overview of tribal relations for DOE staff and contractors, DOE has also designated Tribal Issues Points of Contacts at each of its facilities. A list of these Points of Contact for all DOE facilities is provided in Appendix 2. DOE staff and contractors should consult with the appropriate tribal representatives at their site before initiating contact with a tribal nation, because many tribes have rules and procedures that must be complied with before DOE staff or contractors may go on tribal lands or conduct interviews with tribal members.     The DOE Office of Enforcement and Investigation (EH Enforcement) invoked a 120-day suspension of PAAA enforcement actions for issues associated with contractor Internal Dose Evaluation Programs (IDEP). Prior to initiation of the suspension, EH Enforcement had identified deficiencies in DOEcontractor implemented bioassay programs at numerous sites within the DOE complex. The commonality of the IDEP deficiencies at the various sites, as well as the possibility of the existence of similar deficiencies at other DOE sites, led EH Enforcement to the conclusion that a suspension of enforcement actions would be appropriate to provide DOE-contractors an opportunity to review their own IDEPs to determine whether similar or other program deficiencies existed, and, if so, to take appropriate corrective action. Contractors were alerted to review their IDEP during the 120-day suspension period. If program deficiencies were identified, and if they met the Noncompliance Tracking System (NTS) criteria, these issues were to be reported into the NTS, along with proposed corrective actions and the anticipated target completion dates. EH Enforcement did not plan to take enforcement action against the contractor for identified IDEP problems if bioassay program deficiencies were identified and reported and if corrective actions, as identified by the contractor, were implemented. However, failure of the contractor to implement proposed corrective actions would permit EH Enforcement to re-open PAAA enforcement action for any of these issues in the future.

Federal legislation and DOE Orders require sites to develop waste minimization/pollution prevention programs. In response to these requirements, the Kansas City Plant developed a pollution prevention tool called a pollution prevention opportunity assessment (PPOA). Pilot assessments resulted in the development of a graded approach to reduce the amount of effort required for activities that utilized nonhazardous and/or low-volume waste streams. The project`s objectives in FY95 were to validate DOE`s PPOA Graded Approach methodology, provide PPOA training and technical assistance to interested DOE personnel and DOE contractors, enhance the methodology with energy analysis and tools for environmental restoration activities, implement a DOE-wide PPOA database, and provide support to DOE EM-334 in the completion of a report which estimates the future potential for pollution prevention and waste minimization in the DOE complex.

    A study of emergency preparedness capabilities at DOE facilities was initiated following the incident at the Three Mile Island (TMI) Nuclear Power Station. It was designed to parallel but expand on a study on emergency preparedness instrumentation that was conducted in 1970 by Pacific Northwest Laboratory. The 1970 survey findings led to the publication of four reports on performance criteria for radiological emergency instrumentation. Three of these reports - BNWL-1635 (Selby et al. 1972), BNWL-1742 (Anderson et al. 1974) and BNWL-1857 (Andersen et al. 1976) - addressed the criteria for emergency instrumentation at reactors, mixed oxide fuel fabrication plants, and fuel reprocessing plants, respectively. The fourth report, BNWL-1991 (Bramson et al. 1976), addressed evaluation testing and calibration methodology for these instruments. This report is presented in three parts. Part One is a review of the BNWL documents to determine whether they are applicable to state-of-the-art instrument capabilities. The Appendix to Part One provides a comparison between the instrument performance criteria established in BNWL-1991 to applicable American National Standards Institute (ANSI) standards for portable survey and contamination meters, installed radiation and area monitors, effluent monitors, calibration techniques, criticality detection systems, alarm systems, and direct reading dosimeters. Part Two compares the 1970 survey results with the 1980 survey results to identify trends in emergency preparedness. Part Three is a discussion of the results of the 1980 emergency preparedness survey and the supporting data for each of the 15 modules. 8 references. (ACR)

    We found that DOE headquarters and some field offices have been unable to meet DOE goals to reinvestigate security clearances. Clearance reinvestigation are an important element of DOE's security program because they are aimed at identifying employees whose lifestyles raise questions about their eligibility for a clearance. DOE's failure to perform timely reinvestigation has contributed to having cleared employees in its work force who may not be suitable for a clearance because they have serious drug, alcohol, or other problems. DOE needs to develop a plan to ensure that all required reinvestigations are performed on time. Planning should start with a review of the appropriateness of the number and level of active clearances, since these factors largely determine the reinvestigation workload. The plan should then provide for the resources necessary to meet requirements.

    Environmental monitoring at a low-level waste disposal facility (LLWDF) should, (1) demonstrate compliance with environmental laws; (2) detect any spatial or temporal environmental changes; and (3) provide information on the potential or actual exposure of humans and/or the environment to disposed waste and/or waste by-products. Under the DOE Order system the LLWDF site manager has more freedom of implementation for a monitoring program than either the semi-prescriptive NRC, or the prescriptive EPA hazardous waste programs. This paper will attempt to compare and contrast environmental monitoring under the different systems (DOE, NRC, and EPA), and determine if the DOE might benefit from a more prescriptive system.

    This volume contains the proceedings of the fourth Contractor-Grantee Workshop for the Department of Energy (DOE) Human Genome Program. Of the 204 abstracts in this book, some 200 describe the genome research of DOE-funded grantees and contractors located at the multidisciplinary centers at Lawrence Berkeley Laboratory, Lawrence Livermore National Laboratory, and Los Alamos National Laboratory; other DOE-supported laboratories; and more than 54 universities, research organizations, and companies in the United States and abroad. Included are 16 abstracts from ongoing projects in the Ethical, Legal, and Social Issues (ELSI) component, an area that continues to attract considerable attention from a wide variety of interested parties. Three abstracts summarize work in the new Microbial Genome Initiative launched this year by the Office of Health and Environmental Research (OHER) to provide genome sequence and mapping data on industrially important microorganisms and those that live under extreme conditions. Many of the projects will be discussed at plenary sessions held throughout the workshop, and all are represented in the poster sessions.

    Changes in the oil and gas industry have been dramatic in recent years. Operators have consolidated field office facilities and downsized staffing at many of their remaining facilities. As a result, operators are turning to independent Contractors as a method of controlling both peak personnel demands and selected production functions. With these changes in the business environment, the role of the specialized contractor has been greatly expanded. Emergency response can no longer be considered a secondary issue. Every contractor, small or large, must be equally prepared for an emergency. This paper is a presentation of the actual learning experiences of one oilfield contractor confronted with the ask of emergency preparedness, more specifically a small contractor. Oilfield service contractors commonly employ field personnel who work for extended periods of time without direct supervision. These employees may singularly or collectively float between sites or anchor one site. Operating sites might be localized or spread over a vast geographical area. Because of the uniqueness of their situation, direct supervision is minimal and the employees will shoulder greater responsibilities and authority. The contractor must evaluate operating conditions and develop an approach which will achieve the optimum results.

    The Department of Energy (Department) uses contractors to operate its facilities and compensates contractor employees based on their skills, complexity of jobs, and work performance. Thirty-one of the Department`s major contractors reported a total payroll of $4.3 billion and $4.4 billion during 1994 and 1995, respectively. The 31 contractors also reported awarding salary increases of $18 million for 1994 and $200 million for 1995. The purpose of the audit was to review the process used to determine and approve the amount of salary increases for contractor employees. The specific audit objective was to determine whether salary increases received by contractor employees were in accordance with Departmental policies and procedures. The Department of Energy Acquisition Regulation (DEAR) requires that contractor salary actions be within specific limitations, supportable, and approved prior to incurrence of costs. In addition, the Secretary of Energy imposed a 1 year salary freeze on the merit portion of management and operating contractor employee salaries for each contractor`s Fiscal Year 1994 compensation year. However, a fund for promotions and adjustments was approved but limited to 0.5 percent of payroll for the year. A review of eight major contractors showed that six complied with the Department`s policies on salary increases. The other two gave salary increases that were not always in accordance with Departmental policies. This resulted in both contractors not fully complying with the pay freeze in 1994 and exceeding their salary increase fund budgets in 1995. If these two contractors had implemented Department and contract requirements and contracting officers had properly performed their contract administrative responsibilities concerning salary increase funds, both contractors would have frozen salary increases and would not have exceeded their annual budgets.

    This plan has been developed by Westinghouse Hanford Company (WHC), and its subcontractors ICF Kaiser Hanford (ICF KH) and BCS Richland, Inc. (BCSR), at the direction of the US Department of Energy (DOE), Richland Operations Office (RL). WHC and its subcontractors are hereafter referred to as the Maintenance and Operations (M and O) Contractor. The plan identifies actions involving the M and O Contractor that are critical to (1) prepare for a smooth transition to the Project Hanford Management Contractor (PHMC), and (2) support and assist the PHMC and RL in achieving transition as planned, with no or minimal impact to ongoing baseline activities. The plan is structured around two primary phases. The first is the pre-award phase, which started in mid-February 1996 and is currently scheduled to be completed on June 1, 1996, at which time the contract is currently planned to be awarded. The second is the follow-on four-month post-award phase from June 1, 1996, until October 1, 1996. Considering the magnitude and complexity of the scope of work being transitioned, completion in four months will require significant effort by all parties. To better ensure success, the M and O Contractor has developed a pre-award phase that is intended to maximize readiness for transition. Priority is given to preparation for facility assessments and processing of personnel, as these areas are determined to be on the critical path for transition. In addition, the M and O Contractor will put emphasis during the pre-award phase to close out open items prior to contract award, to include grievances, employee concerns, audit findings, compliance issues, etc.

    The operator of the Energy Department's Savannah River weapons plant has at least 1,800 more employees than it needs, and could save $400 million over a five-year period by cutting its staff accordingly, a DOE inspector general study says. Most of the boat - 1,206 employees - was attributed to excessive numbers of managers, with the inspector general concluding that Westinghouse Savannah River Co. had roughly twice as many layers of management than two other DOE weapons contractors. The study also concluded that Westinghouse in fiscal year 1992 significantly understated its actual staffing levels in reports to DOE, failing to disclose 1,765 full-time employees or the equivalent hours worked. Through such underreporting Westinghouse was able to [open quotes]circumvent staffing ceilings established by the department,[close quotes] the study added. Overall, DOE Inspector General John Layton said Westinghouse's staff levels substantially exceeded those needed for efficient operation of the South Carolina nuclear weapons facility. Layton based his analysis on efficiency standards attained by other DOE weapons plant contractors, such as Martin Marietta Energy Systems at DOE's Oak Ridge, Tenn., plant and EG G Rocky Flats, as well as widely utilized worker performance requirements used by the Navy and private sector companies that perform work similar to that done at Savannah River.

    The Technical Assistance Contractor (TAC) for the Uranium Mill Tailings Remedial Action (UMTRA) Project comprises Jacobs Engineering Group Inc. (JEG) as the prime contractor and three teaming partner subcontractors: Roy F. Weston, Inc. (RFW), AGRA Earth and Environmental, Inc. (AGRA), and Geraghty and Miller, Inc. (G and M). The TAC contract`s scope is to provide technical, analytical, environmental, engineering, design, inspection, and management support services to the US Department of Energy (DOE) for both Surface and Ground Water Projects. The TAC team supports the DOE in completing surface remedial action and initiating ground water remediation work for start-up, characterization, compliance planning, design, construction oversight, and remedial operations. The TAC provides the DOE UMTRA Project Team with a dedicated management, scientific, and technical resource base in Albuquerque, New Mexico, which is supplemented by corporate resources. A carefully developed and maintained staff of technical experts is available to assess, analyze, develop, and execute cost-effective solutions to the demanding technical and institutional problems presented by the UMTRA Project.

    The DOE Occupational Radiation Exposure Report, 1992-1994 reports occupational radiation exposures incurred by individuals at US Department of Energy (DOE) facilities from 1992 through 1994. This report includes occupational radiation exposure information for all DOE employees, contractors, subcontractors, and visitors. This information is analyzed and trended over time to provide a measure of the DOE`s performance in protecting its workers from radiation. Occupational radiation exposure at DOE has been decreasing over the past 5 years. In particular, doses in the higher dose ranges are decreasing, including the number of doses in excess of the DOE limits and doses in excess of the 2 rem Administrative Control Level (ACL). This is an indication of greater attention being given to protecting these individuals from radiation in the workplace.

    The primary purpose of this guide is to help the DOE locate and make available information relating to the 1957 Rocky Flats fire. The records are arranged into six categories: administrative and general; facilities and equipment; production and materials handling; waste management; workplace and environmental monitoring; and employee occupational exposure and health. A brief explanation of each category follows. The administrative and general section pertains to the administration of individual contractor organizations and DOE divisions at Rocky Flats. It also contains records which encompass several different subject areas and therefore can not be placed in a single category. The facilities and equipment category relates to the routine construction and maintenance of plant buildings as well as the purchase and installation of equipment. The production and materials handling records relate primarily to the inventory and production of nuclear materials and weapons components. The waste management records series found under this heading relate to the storage, handling, treatment, and disposal of radioactive, chemical or mixed materials produced or used at Rocky Flats. The records consist mostly of waste sampling and shipment records. The workplace and environmental monitoring records series found in this section pertain to monitoring of the workplace. The section also includes records that document efforts to monitor the environment outside of buildings, either onsite or offsite. Records in this category consist of sampling data and environmental impact reports. The employee occupational exposure and health section pertains to documentation relating to the health and occupational exposures of employees and visitors at Rocky Flats. Records series consist generally of dosimeter data, radiation exposure records, and medical records. Many of the records contain personal data pertaining to individual employees and may therefore be Privacy Act systems and records.

    The Fuels Technology Contractors Review Meeting was held November 16-18, 1993, at the Morgantown Energy Technology Center (METC) in Morgantown, West Virginia. This meeting was sponsored and hosted by METC, the Office of Fossil Energy, U.S. Department of Energy (DOE). METC periodically provides an opportunity to bring together all of the R&D participants in a DOE-sponsored contractors review meeting to present key results of their research and to provide technology transfer to the active research community and to the interested public. This meeting was previously called the Natural Gas Technology Contractors Review Meeting. This year it was expanded to include DOE-sponsored research on oil shale and tar sands and so was retitled the Fuels Technology Contractors Review Meeting. Current research activities include efforts in both natural gas and liquid fuels. The natural gas portion of the meeting included discussions of results summarizing work being conducted in fracture systems, both natural and induced; drilling, completion, and stimulation research; resource characterization; delivery and storage; gas to liquids research; and environmental issues. The meeting also included project and technology summaries on research in oil shale, tar sands, and mild coal gasification, and summaries of work in natural-gas fuel cells and natural-gas turbines. The format included oral and poster session presentations. Individual papers have been processed separately for inclusion in the Energy Science and Technology database.

    The goal of the US Department of Energy (DOE) is to conduct its radiological operations to ensure the health and safety of all DOE employees including contractors and subcontractors. The DOE strives to maintain radiation exposures to its workers below administrative control levels and DOE limits and to further reduce these exposures and releases to levels that are ``As Low As Reasonably Achievable`` (ALARA). The DOE Occupational Radiation Exposure Report, 1996 provides summary and analysis of the occupational radiation exposure received by individuals associated with DOE activities. The DOE mission includes stewardship of the nuclear weapons stockpile and the associated facilities, environmental restoration of DOE and precursor agency sites, and energy research. Collective exposure at DOE has declined by 80% over the past decade due to a cessation in opportunities for exposure during the transition in DOE mission from weapons production to cleanup, deactivation and decommissioning, and changes in reporting requirements and dose calculation methodology. In 1996, the collective dose decreased by 10% from the 1995 value due to decreased doses at five of the seven highest-dose DOE sites. For 1996, these sites attributed the reduction in collective dose to the completion of several decontamination and decommissioning projects, reduced spent fuel storage activities, and effective ALARA practices. This report is intended to be a valuable tool for managers in their management of radiological safety programs and commitment of resources.

    The Price-Anderson Act provides indemnification to DOE contractors who manage and conduct nuclear activities in the DOE complex. The government acts as an insurer for these contractors against any findings of liability from the nuclear activities of the contractor within the scope of its contract. 10 CFR Part 820 establishes the legal framework for implementing DOE`s Nuclear Safety Enforcement Program. Integration with other DOE organizations and programs would assure that the enforcement process properly considers the actual or potential safety significance of a violation when determining an appropriate enforcement sanction. Achieving a proactive contractor compliance assurance rather than a heavy enforcement hand, will require a foundation of cooperation and teamwork across DOE organizations. This handbook identifies the areas of interface for the DOE Enforcement Program and provides guidance on roles and responsibilities for the key DOE organizational areas. It complements DOE-HDBK-1087-95 and 1089-95.

    Fifty-four of DOE`s major contractors reported expending $44.3 million in liability insurance costs for the last 3 years of operation. Purpose of this audit was to evaluate how DOE implemented its policy to assume the risk of losses for its contractors rather than to insure them commercially. Contractors are required to use self-insurance if combined annual premiums for commercial insurance exceed $10,000. Review of 18 major contractors showed that DOE was not consistently following its policy and that contractors using commercial insurance incurred higher costs. Required approvals were not always obtained prior to purchasing certain other types of liability insurance. It is recommended that DOE`s policies requiring self-insurance be fully implemented; that requests for approval for commercial insurance when annual premiums exceeded $10,000 be fully justified; and that the commercial insurance policies specifically define the liability coverage prior to approval and payment. It is also recommended that the contracts include clauses limiting reimbursements for insurance expenditures to actual losses and administrative costs.

DOE promulgated the requirements and guidance to control or eliminate the hazards posed by S/CIs, which can lead to unexpected equipment failures and undue risks to the DOE mission, the environment, and personnel. This Guide is a compendium of information contained in the referenced DOE directives and other documents concerning S/CI controls. It incorporates, updates, and supersedes earlier guidance issued in Plan for the Suspect/Counterfeit Products Issue in the Department of Energy, dated October 1993, [4] and in memoranda issued by Defense Programs (DP) [12-16] and other DOE program offices. This guidance was developed to strengthen the procurement process, identify and eliminate S/CIs, and improve the reporting of S/CIs. The information in this Guide, when implemented by DOE and its contractors, will satisfy the S/CI requirements contained in the referenced DOE directives.

Executive Order (EO) 13496, Notification of Employee Rights under Federal Labor Laws, dated January 30,2009, requires contractors and subcontractors to post a notice that informs employees of their rights under Federal labor laws, including the National Labor Relations Act. This Act encourages collective bargaining and protects the exercise by workers of their freedom to associate, to self organize and to designate representatives of their own choosing for the purpose of negotiating the terms and conditions of their employment.

    Section 1.3 of the Operational Procedures for Enforcement, published in June 1998, provides the opportunity for the Office of Price-Anderson Enforcement (OE) to periodically issue clarifying guidance regarding the processes used in its enforcement activities. Such guidance is typically issued in the form of an Enforcement Guidance Supplement (EGS). As part of the investigation of potential nuclear safety noncompliances, OE routinely reviews the contractor's investigation of the noncompliance, the associated causal analysis, and the corrective actions developed by the contractor to resolve the noncompliance and prevent recurrence. A high percentage of enforcement actions undertaken by OE feature recurrent events or deficiencies, indicating weaknesses associated with contractor processes to develop and implement effective corrective actions. In response, OE has developed this EGS to disseminate information regarding observed deficiencies as a potential lessons -learned for the DOE contractor community. Attachment A provides enforcement case examples highlighting performance deficiencies specific to this subject area.
