    Snohomish County Public Utilities District (the District or Snohomish PUD) provides electricity to about 325,000 customers in Snohomish County, Washington. The District has an incentive programs to encourage commercial customers to improve energy efficiency: the District partially reimburses the cost of approved retrofits if they provide a level of energy performance improvement that is specified by contract. In 2013 the District contracted with Lawrence Berkeley National Laboratory to provide a third-party review of the Monitoring and Verification (M&V) practices the District uses to evaluate whether companies are meeting their contractual obligations. This work helps LBNL understand the challenges faced by real-world practitioners of M&V of energy savings, and builds on a body of related work such as Price et al. (2013). The District selected a typical project for which they had already performed an evaluation. The present report includes the District's original evaluation as well as LBNL's review of their approach. The review is based on the document itself; on investigation of the load data and outdoor air temperature data from the building evaluated in the document; and on phone discussions with Bill Harris of the Snohomish County Public Utilities District. We will call the building studied in the document the subject building, the original Snohomish PUD report will be referred to as the Evaluation, and this discussion by LBNL is called the Review.

    Supported by funds from this award, the District thoroughly explored the feasibility of a hydrothermal geothermal development within its service territory. The District successfully planned and drilled six exploratory geothermal wells and added significantly to the knowledge of the geology of the area. The Straight Creek Fault region, which was the sole location that showed significant potential for hydrothermal development in the District's service territory, was determined not to be feasible for development. The District subsequently expanded its search for geothermal development locations to include all of Washington State. Mount Baker has been identified as the area of the state with the greatest potential for geothermal development. Having gathered additional information about the Mount Baker region with support from this award, the District is actively pursuing exploration and development in the area.

    This article is about What is and What ought to be as we look to the institution of public utility commission regulation at the turn of the century. To signal my own view at the outset, I find the prospects somewhat worrisome in light of the nature and direction of much of the response to real and imaginary changes in the regulated sectors. I surely do not call for standing in place, but I strongly believe we should leave the place standing. The following items are discernable trends that will shape the PUC at the turn-of-the century: (1) dichotomy of customers into core and noncore groups, (2) unbundling and new service offerings with a menu of prices, (3) relaxed regulation and increased reliance on market solutions instead of command and control, (4) increased use of market-based pricing and incentive ratemaking, (5) large users seeking lowest-cost generation and supply services, (6) shift from old regulatory bargains regarding exclusive territorial franchises and assured recovery of costs and investments, (7) utility diversification, (8) increasing business risk for utilities, amd (9) uncertainty as to continued utility attention to social goals and a changing obligation to serve. For each of these, the author focuses on: (1) changing missions and roles of the PUC, (2) the strategies for achieving them, and (3) the implementation requirements that operationalize the strategies.

With this shift in emphasis from regulation to free markets, the antitrust laws take on new importance for these industries. In the absence of direct regulator control, those laws are society`s primary method of insuring the markets necessary to make competition an effective device for protecting the public interest. This study provides an overview of the antitrust laws, briefly describes the applicable theoretical underpinnings, and then turns to areas where public utility activity may pose special problems or conflicts with prevailing antitrust policy.

    Despite the recent restructuring, unbundling, competition, and incentive regulation that has complicated the utility business, estimating the fair rate of return on equity (ROE) remains an important part of public utility base rate cases. For the past two decades, the two most popular methods that regulatory commissions have used for estimating the cost of equity capital for regulated utilities have been the dividend discount method (known as the Discounted Cash Flow model of DCF) and the Capital Asset Pricing Model (or CAPM). Both models use common stock price behavior to draw inferences about the cost of equity. The DCF combines a stock's dividend yield and its predicted dividend growth rate. The CAPM relates changes in a stock's price to changes in the overall market for security prices. These methods have come into question, however, as utilities have increasingly diversified into unregulated activities. When a utility's regulated activities account for 95 to 99 percent of its revenues, there is little practical need to question that its company-specific cost-of-equity capital is overwhelmingly dominated by its regulated activities. But as this percentage continues to decrease, a company's specific cost of equity, as calculated by the DCF or CAPM, is influenced to a larger degree by its unregulated subsidiaries. Two general remedies are available to resolve the problem of setting the fair ROE when the company has substantial holdings in unregulated subsidiaries. One is to abandon (either partially or fully) the practice of using company-specific market information and use a proxy group of comparable utilities instead. The other is to continue using company-specific data, but to adjust the resulting estimates to account for the utility's diversification activity.

    The Department of Energy is conducting a program to determine radiological conditions at sites formerly used by the Army Corps of Engineers' Manhattan Engineer District and the Atomic Energy Commission in the early years of nuclear energy development. Also included in the program are sites used in the Los Alamos plutonium development program and the Trinity atomic bomb test site. Materials, equipment, buildings, and land became contaminated, primarily with naturally occurring radioactive nuclides. They were later decontaminated in accordance with the standards and survey methods in use at that time. Since then, however, radiological criteria, and proposed guidelines for release of such sites for unrestricted use have become more stringent as research on the effects of low-level radiation has progressed. In addition, records documenting some of these decontamination efforts cannot be found, and the final radiological conditions of the sites could not be adequately determined from the records. As a result, the Formerly Utilized Sites Program was initiated in 1974 to identify these formerly used sites and to reevaluate their radiological status. This report covers efforts through June 1980 to determine the radiological status of sites for which the existing conditions could not be clearly defined. Principal contractor facilities and associated properties have already been identified and activities are continuing to identify additional sites. Any new sites located will probably be subcontractor facilities and areas used for disposal of contractor waste or equipment; however, only limited information regarding this equipment and material has been collected to date. As additional information becomes available, supplemental reports will be published.

Generator (Tables 3 through 11) and nongenerator (Tables 12 through 20) summaries are presented in this publication. Five years of summary financial data are provided (Tables 5 through 11 and 14 through 20). Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided in Appendix C. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, operating revenue, and electric energy account data. The primary source of publicly owned financial data is the Form EIA-412, ``Annual Report of Public Electric Utilities.`` Public electric utilities file this survey on a fiscal year basis, in conformance with their recordkeeping practices. The EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents. The review indicated that financial indicators differ most according to whether or not a publicly owned electric utility generates electricity.     Under DE-FOA-0000085 High Penetration Solar Deployment, the U. S. Department of Energy funded agreements with SMUD and Navigant Consulting, SunPower, GridPoint, the National Renewable Energy Laboratory, and the California Energy Commission for this pilot demonstration project. Funding was $5,962,409.00. Cost share of $500,000 was also provided by the California Energy Commission. The project has strategic implications for SMUD, other utilities and the PV and energy-storage industries in business and resource planning, technology deployment and asset management. These implications include: -At this point, no dominant business models have emerged and the industry is open for new ideas. -Demonstrated two business models for using distributed PV and energy storage, and brainstormed several dozen more, each with different pros and cons for SMUD, its customers and the industry. -Energy storage can be used to manage high penetrations of PV and mitigate potential issues such as reverse power flow, voltage control violations, power quality issues, increased wear and tear on utility equipment, and system wide power supply issues. - Smart meters are another tool utilities can use to manage high penetrations of PV. The necessary equipment and protocols exist, and the next step is to determine how to integrate the functionality with utility programs and what level of utility control is required. - Time-of-use rates for the residential customers who hosted energy storage systems did not cause a significant change in energy usage patterns. However, the rates we used were not optimized for PV and energy storage. Opportunities exist for utilities to develop new structures.

    This report describes the results of an analysis to determine the economic and operational value of battery storage to wind and photovoltaic (PV) generation technologies to the Sacramento Municipal Utility District (SMUD) system. The analysis approach consisted of performing a benefit-cost economic assessment using established SMUD financial parameters, system expansion plans, and current system operating procedures. This report presents the results of the analysis. Section 2 describes expected wind and PV plant performance. Section 3 describes expected benefits to SMUD associated with employing battery storage. Section 4 presents preliminary benefit-cost results for battery storage added at the Solano wind plant and the Hedge PV plant. Section 5 presents conclusions and recommendations resulting from this analysis. The results of this analysis should be reviewed subject to the following caveat. The assumptions and data used in developing these results were based on reports available from and interaction with appropriate SMUD operating, planning, and design personnel in 1994 and early 1995 and are compatible with financial assumptions and system expansion plans as of that time. Assumptions and SMUD expansion plans have changed since then. In particular, SMUD did not install the additional 45 MW of wind that was planned for 1996. Current SMUD expansion plans and assumptions should be obtained from appropriate SMUD personnel.

    The South Dakota Public Utilities Commission is authorized by statute to regulate gas and electric utilities. The Commission consists of three elected commissioners each of whom serves for a six year term. The Commissioners are elected by district and each must, at the time of election, be a resident of the district from which he has been elected. Each Commissioner must reside in the state capital and devote his entire time to the duties of his office. The Commission is part of the Department of Commerce and Consumer Protection. Municipal power to regulate privately owned electric and gas public utilities was terminated in 1975. A municipally-owned electric utility has the authority to regulate the sale, use, and rates of electric power and energy which it provides. The Commission has no authority to regulate steam, heat, and refrigeration systems; that power resides in cities. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    The authority to regulate public utilities in Mississippi is vested generally in the Public Service Commission, composed of three members elected for four year terms from separate districts of the state. Within the purview of its powers, the authority of the Commission supersedes that of local governments. It is empowered to amend municipal franchises that contain provisions conflicting with its exclusive jurisdiction over the rates and standards of service of public utilities. Local governments play a role in regulating public utilities only through the exercise of their zoning and franchising powers. They may also operate their own utilities which are totally exempt from Commission control, unless they provide services more than one mile beyond their corporate boundaries. Other than a procedure in which certain provisions in municipal franchises may be subject to modification by the Commission, there is no process by which the decisions of local government respecting utilities are reviewed by the Commission. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    Titles I and III of the Public Utility Regulatory Policies Act of 1978 (PURPA) establish retail regulatory policies for electric and natural gas utilities, respectively, aimed at achieving three purposes: conservation of energy supplied by electric and gas utilities; efficiency in the use of facilities and resources by these utilities; equitable rates to electricity and natural gas consumers. PURPA also continues the pilot utility implementation program, authorized under Title II of the Energy Conservation and Production ACT (ECPA), to encourage adoption of cost-based rates and efficient energy-management practices. The purpose of this report is twofold: (1) to summarize and analyze the progress that state regulatory authorities and certain nonregulated utilities have made in their consideration of the PURPA standards; and (2) to summarize the Department of Energy (DOE) activities relating to PURPA and ECPA. The report provides a broad overview and assessment of the status of electric and gas regulation nationwide, and thus helps provide the basis for congressional and DOE actions targeted on the utility industry to address pressing national energy problems.

    The Western Area Power Administration is about to impose integrated resource planning requirements on its 612 public-power customers as part of its Energy Planning and Management Program (EPAM) and consistent with the Energy Policy Act of 1992. EPAM will affect public utilities over a 15-state region stretching from Minnesota to California, Montana to Texas. In this study, an assessment is made of the environmental impacts of the IRP requirements. Environmental impacts are calculated based on modeled changes in electric power generation and capacity additions.

    The Formerly Utilized Sites Remedial Action Program (FUSRAP) has addressed sites across the nation for almost 4 decades. Multiple stake holder pressures, multiple regulations, and process changes occur over such long time periods. These result in many challenges to the FUSRAP project teams. Initial FUSRAP work was not performed under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Records of Decision (ROD). The ROD identifies the remedy decision and ultimately the criteria to be used to release a site. Early FUSRAP projects used DOE Orders or the Uranium Mill Tailings Radiation Control Act (UMTRCA) standards. Under current RODs, regulations may differ, resulting in different cleanup criteria than that used in prior Vicinity Property (VP) remediation. The USACE, in preparation for closeout of Sites, conducts reviews to evaluate whether prior actions were sufficient to meet the cleanup criteria specified in the current ROD. On the basis of these reviews, USACE has conducted additional sampling, determined that prior actions were sufficient, or conducted additional remediation consistent with the selected remedy in the ROD. As the public pressures, regulations, and processes that the FUSRAP encounters continue to change, the program itself continues to evolve. Assessment of VPs at FUSRAP sites is a necessary step in the life cycle of our site management. (authors)

    The US Nuclear Regulatory Commission (NRC) periodically surveys the Federal Energy Regulatory Commission (FERC) and state regulatory commissions that regulate utility owners of nuclear power plants. The NRC is interested in identifying states that have established economic or performance incentive programs applicable to nuclear power plants, how the programs are being implemented, and in determining the financial impact of the programs on the utilities. The NRC interest stems from the fact that such programs have the potential to adversely affect the safety of nuclear power plants. The current report is an update of NUREG/CR-5975, Incentive Regulation of Investor-Owned Nuclear Power Plants by Public Utility Regulators, published in January 1993. The information in this report was obtained from interviews conducted with each state regulatory agency that administers an incentive program and each utility that owns at least 10% of an affected nuclear power plant. The agreements, orders, and settlements that form the basis for each incentive program were reviewed as required. The interviews and supporting documentation form the basis for the individual state reports describing the structure and financial impact of each incentive program.

    Large blackouts, such as the August 14-15, 2003 blackout in the northeasternUnited States and Canada, focus attention on the importance of reliable electric service. As public and private efforts are undertaken to improve reliability and prevent power interruptions, it is appropriate to assess their effectiveness. Measures of reliability, such as the frequency and duration of power interruptions, have been reported by electric utilities to state public utility commissions for many years. This study examines current state and utility practices for collecting and reporting electricity reliability information and discusses challenges that arise in assessing reliability because of differences among these practices. The study is based primarily on reliability information for 2006 reported by 123 utilities to 37 state public utility commissions.

NREL has responded to this request by developing a high-level survey of renewable electricity effects, quantification alternatives, and considerations for selection of analytic methods. This report addresses economic effects and health and environmental effects, and provides an overview of related analytic tools. Economic effects include jobs, earnings, gross state product, and electricity rate and fuel price hedging.   4. Expanding Geothermal Resource Utilization through Directed Research, Education, and Public Outreach

    The Great Basin Center for Geothermal Energy (GBCGE or the Center) was established at the University of Nevada, Reno (UNR) in May 2000 to promote research and utilization of geothermal resources. The Center received funding through this grant to promote increased geothermal development in the Great Basin, with most of the funding used for peerreviewed research. Funding to the Center and work under the contract were initiated in March 2002, with supplemental funding in subsequent years. The Center monitored the research projects that were competitively awarded in a series of proposal calls between 2002 and 2007. Peer-reviewed research promoted identification and utilization of geothermal resources in Nevada. Projects used geology, geochemistry, geophysics, remote sensing, and the synthesis of multi-disciplinary information to produce new models of geothermal systems in the Western U.S. and worldwide. Funds were also used to support graduate student research and training. Part of the grant was used to support public outreach activities, including webpages, online maps and data resources, and informational workshops for stakeholders.

    Numerous authors have discussed the massive changes in the new regulatory environment and the necessary impact of these changes on the roles, responsibilities, structure, function, and mission of the public utility commission. In fact, when public utility commissioners gathered in Denver for the NRRI/NARUC Commissioners Summit in April 1995, {open_quotes}they made it clear that they embraced change as necessary to effective commission functioning in new regulatory environments and made it clear that they were prepared to direct that change.{close_quotes} The Commissioners identified the following trends of change: (1) Dichotomy of customers in core and noncore groupings. (2) Unbundling and new service offerings. (3) Deregulation of certain services and markets. (4) Increased use of market-based pricing and incentive ratemaking. (5) Large users seeking lowest-cost service providers. (6) Shift from old regulatory compact [of] territorial exclusivity and assured recovery. (7) Changing obligation to serve. (8) Utility diversification into other businesses and use of holding company structures. (9) Increased business risk for utilities. (10) Uncertainty as to continued attention to social goals. In response to these changes, they identified five clusters of core missions for public utility commissions: (1) Protection of those customers who would not reap the full benefits of competition. (2) Support of competition balanced with an interest in fair and effective competition. (3) The provision of timely and clear decisions to utility managers and allowing utilities the flexibility to adapt to new conditions. (4) Preserving the commitment to social goals compatible with the competitive market. (5) Addressing the impact of new corporate structures, jurisdictional changes, necessary change in regulatory methods, and customer protection in the new environment.

  16. Economic and regulatory aspects of cogeneration: the implementation of Section 210 of the Public Utility Regulatory Policies Act of 1978

    In February of 1980 the Federal Energy Regulatory Commission (FERC) promulgated a set of rules that were to commence the implementation process of Section 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). Of particular interest to economists are the pricing provisions in the rules that pertain to integrating dispersed sources of electric power generation into conventional electric utility systems. The full avoided cost pricing provision couples a utility mandate to purchase power from qualified dispersed facilities (cogenerators, wind power, small hydro facilities, etc., hereafter denoted QFs) with the requirement that the price the utility pays for such purchases be equal to the full extent of the cost it avoids by not generating the power itself. The simultaneous purchase and sale billing scheme requires a utility to purchase the gross power output of a QF at the full avoided cost rate and simultaneously sell back to the QF its power requirement on the applicable retail tariff. Theoretical investigation of these two provisions reveals that, properly defined, they are consistent with improving economic signals with respect to electricity generation.

The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies.     The report concludes that, to effectively deal with our national energy problems, gas rate structures should be designed to reflect the costs which the nation avoids if gas is efficiently used and substituted for oil. Current pipeline and distribution company rate structures generally do not meet this test. Although gas is a substitute for oil in many applications, and conserved gas can reduce oil imports, gas rate structures often fail to convey to consumers the fact that, from a national perspective, gas is as valuable as oil. The provisions of the Natural Gas Policy Act of 1978 (NGPA) take a strong first step in correcting these problems. But, as clearly recognized in both NGPA and PURPA, these provisions need to be supplemented by updating pipeline and distribution company rate designs to address the problems of the 1980's - rather than the problems of the 1950's. In this regard, NGPA mandates incremental pricing, which raises the average price of gas to certain industrial users only. The Department of Energy (DOE) study suggests an alternate approach: pipeline and distribution rate structures that reflect in their tailblocks, for all customer classes, the economic costs of gas usage. Such rates would convey to all users the costs incurred by the nation as a consequence of their decisions to use or conserve gas. Such rate structures should promote the three purposes of PURPA - end-use conservation, efficient use of utility resources, and equitable rates - to a greater extent than do traditional accounting cost rate designs, which reflect decisions made in the distant past.

    The authority to regulate public utilities is vested generally in the Public Service Commission of Indiana. The Commission is comprised of three members appointed by the governor. Commissioners are appointed for four-year terms. They must be free from any employment or pecuniary interest in any public utility. Indiana courts have stated that the Commission was created and vested with regulatory authority over public utilities in order to relieve these utilities from local regulation. Local governments do, however, have specific statutory authority to determine, by contract or ordinance, the quality and character of service to be provided by public utilities within the municipality. Local governments may also regulate the use of streets and other public property by public utilities. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    In examining the workings of the Public Utility Holding Company Act (PUHCA) and considering its possible repeal, it is best to go back to the original purposes of PUHCA and analyze whether those purposes are still relevant and, if so, whether the 1935 Act accomplished its goal. Indeed, one might ask, {open_quotes}Are the abuses which gave rise to PUHCA back in the 1930`s now eradicated such that outright repeal is warranted?{close_quotes} One is reminded of that old quote from Santayana, {open_quotes}Those who cannot remember the past are condemned to repeat it.{close_quotes} There is not a more appropriate time to heed that saying than now. To lay the foundation, we need to step back in time and place ourselves in the shoes of the policy makers at the time that PUHCA was debated.

    Owned and operated by large public electric utilities, district steam systems flourished in most northern US cities in the first half of this century. Following World War II, however, district steam systems became minor and, in some cases, unprofitable portions of the utilities' operations. Consequently, public utilities ceased promoting district steam to existing and potential customers, leading to the decline of their use. In recent years, district steam systems have been revitalized by independent enterprises that have the commitment and expertise to make these systems once again reliable and cost-effective energy sources. This paper reports on one such system, The St. Louis Steam Loop. The St. Louis steam loop consists of 22 miles of insulated underground steam piping encompassing a 400-square block area in the city's downtown business district. The loop is supplied with steam by the Ashley Plant, which was built in 1904 for the St. Louis World's Fair. Due to the rising cost of oil, which has been used to fuel the Ashley Plant since 1972, and the subsequent loss of customers, many people considered the steam system a dinosaur in the jet age. In 1982, Trigen-St. Louis Energy Corporation purchased the steam system and embarked on an aggressive campaign to upgrade all aspects of the system, including valves, piping, and meters. In 1999, Trigen-St. Louis will install an ISMW state-of-the-art combustion turbine cogenerator to provide 95% of the steam to the steam loop. A primary reason for the St. Louis Steam Loop's longevity is that it has reliably supplied steam to many downtown buildings for the better part of the 20th century.

    The Tennessee Public Service Commission has been designated by the legislature as the agency primarily responsible for the regulation of public utilities and carriers. The Commission is comprised of three members elected by the voters of the state. Each member of the Commission serves a six-year term. The Commission is given broad supervisory control over public utilities in the public utilities statute. Included under its authority is the power to determine whether a privilege or franchise granted to a public utility by a municipality is necessary and proper for the public convenience. No privilege or franchise is valid until it has been approved by the Commission. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    The authority to regulate public utilities is vested generally in the Louisiana Public Service Commission, composed of five members elected by the general electorate and elected for six-year terms. The Commission is charged with regulating all public utilities and has such other regulatory authority as provided by law. The Commission, however, has no power to regulate a public utility owned, operated, or regulated on the effective data of this constitution (1921) by the governing authority of one or more political subdivisions unless the Commission is authorized to regulate these utilities by the electorate of the political subdivision involved. An additional statutory provision excludes all municipally-owned public utilities from Commission regulation. New Orleans has retained the regulatory authority which it held as of the effective date of the Louisiana Constitution. Therefore, the Commission exercises no regulatory powers over investor or municipally-owned utilities in New Orleans. A municipality is empowered to own and operate a revenue-producing public utility within or without its boundaries and it may sell and distribute the commodity or service of the public utility within or without its corporate limits and may establish rates, rules, and regulations with respect to the sale and distribution. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    The authority to regulate public utilities in Missouri is vested in the Public Service Commission. The Commission is composed of five members who are appointed by the governor with the advice and consent of the senate. Commissioners are appointed for a term of six years. Commissioners must be free from any employment or pecuniary interests incompatible with the duties of the Commission. The Commission is charged with the general supervision of public utilities. The Public Service Commission Law passed in 1913, makes no provision for the regulation of public utilities by municipalities. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    The authority to regulate public utilities is vested generally in the Illinois Commerce Commission, comprised of five members appointed by the governor with the advice and consent of the senate and appointed for five year terms. They must be free from any employment or pecuniary interests in any business subject to regulation by the Commission. Local governments may exercise a large degree of regulatory authority over public utilities providing services within a municipality. The question of whether a municipality will exercise regulatory control over local public utilities must be put to the voters of the city. If the proposition is approved by a majority of the voters, the municipality may regulate services and rates and exercise most of the regulatory functions otherwise assigned to the Commission. If any public utility is dissatisfied with any action of a municipality, the utility is entitled to apply to the Commission for review of the action. On review, the Commission may take any determination which it deems just and reasonable. In addition, municipally-owned utilities are excluded specifically from the definition of public utility. These utilities are not within the jurisdiction of the Commission and are regulated locally.     The Alabama legislature has created the Public Service Commission which has general supervisory powers over utilities. The PSC consists of a president and two associates, who are elected to four-year terms. The PSC has no jurisdiction over municipal utilities and, as a result, local governments retain the power to regulate the operation of their municipally-owned utilities. Municipalities also retain their police power over streets and highways within their territory.     The Public Utilities Commission (PUCO) is a body created by the Ohio State legislature to administer the provisions of the Ohio Public Utilities Act. It is composed of three commissioners appointed by the governor with the advice and consent of the senate. Once appointed, a commissioner serves for a six-year period. The PUCO is vested with the power and jurisdiction to supervise and regulate public utilities and railroads... . The term public utility includes every corporation, company, co-partnership, person or association, their lessees, trustees, or receivers, as defined in the Ohio Code. Among the various services enumerated in the Code under the definition of public utility are an electric light company; a gas company; a pipeline company transporting gas, oil or coal; a waterworks company; a heating or cooling company. The power to regulate public utilities is shared by the PUCO and municipal governments. The municipal regulatory authority is derived from the Ohio Constitution, statutory provisions, and municipal franchising authority.     Under the Public Utilities Act of 1965, utilities in North Carolina are regulated by the State's Utility Commission. The Commission consists of seven members who are appointed by the governor, subject to confirmation by the General Assembly sitting in joint session. The Commissioners serve eight year terms and the governor designates one of the commissioners as chairman. The Commission has an office of the executive director, who is appointed to a six year term by the governor subject to confirmaion by the General Assembly. The executive director heads the Commission's public staff. The public staff's duties include reviewing, investigating, and making recommendations on utility rates and services and intervention on behalf of the public in proceedings affecting consumer rates and generating plant certification. The Commission has the same power to regulate the operation of privately-owned public utilities within municipalities as it has to control those ouside. The only power over privately-owned utilities reserved to the municipalities is the power to grant franchises. A municipality may maintain its own utility systems, and such systems are not subject to the control and jurisdiction of the Commission.     The authority to regulate public utilities in Texas is generally vested in the Public Utilities Commission. The Commission is comprised of three members appointed by the governor, with the advice of at least two-thirds of the senate, for a six-year term. Prior to the passage of the Texas Public Utility Regulatory Act (PURA) in 1975, the power to regulate public utilities was vested almost exclusively in municipalities. Under PURA, municipalities retain exclusive original jurisdiction over all electric, water, and sewer utilities within the municipality. PURA provides that all regulations pertaining to public utilities promulgated by local regulatory agencies remain in effect unless they are superceded by Commission rules. The municipality's governing body is required to exercise its regulatory authority under rules and standards consistent with those promulgated by the Commission. The Commission has exclusive appellate jurisdiction to review orders and ordinances of regulatory municipalities.     The Constitution of the State of California grants to the Legislature control over persons and private corporations that own or operate a line, plant, or system for the production, generation, or transmission of heat, light, water, or power to be furnished either directly or indirectly to or for the public. The Constitution establishes the Public Utilities Commission and grants certain specific powers to the PUC, including the power to fix rates, establish rules and prescribe a uniform system of accounts. The Constitution also recognizes that the Legislature has plenary power to confer additional authority and jurisdiction upon the PUC. The Constitution prohibits regulation by a city, county, or other municipal body of matters over which the Legislature has granted regulatory power to the PUC. This provision does not, however, impair the right of any city to grant franchises for public utilities. The California legislature has enacted the California Public Utilities Code and has designated the PUC as the agency to implement the regulatory provisions of the Code. The Public Utilities Commission consists of five members appointed by the governor and approved by the senate, a majority of the membership concurring, for staggered 6-year terms. Certain limited powers over the conduct of public utilities may still be exercised by municipalities.     Until April 1, 1979, the Public Service Commission had been vested with exclusive jurisdiction over the regulation of rates and service of utilities. As of that date two new agencies, the Energy Regulatory Commission (ERC) and the Utility Regulatory Commission (URC), have replaced the Public Service Commission. The ERC consists of three full-time members appointed by the governor for four year terms and is responsible for enforcing the provisions of the Kentucky statutes relating to electric and gas utilities. The three-member URC is responsible for enforcing the provisions relating to non-energy utilities such as telephone, sewer, and water utilities. The statutes vest all regulatory authority over public utilities in either the ERC or the URC. Local governments retain only the power to grant local franchises. However, it should be noted, that any utility owned or operated by a political subdivision of the state is exempt from regulation. Thus, local government has complete authority over utilities which are self-owned.     The Public Utilities Regulatory Policies Act (PURPA) of 1979 requires that electrical utilities interconnect with qualifying facilities and purchase electricity at a rate based upon their full avoided costs (i.e., costs of providing both capacity and energy). Qualifying facilities (QF) include solar or geothermal electric units, hydropower, municipal solid waste or biomass-fired power plants, and cogeneration projects that satisfy maximum size, fuel use, ownership, location, and/or efficiency criteria. In Washington State, neither standard power purchase prices based upon a proxy ''avoided plant'', standard contracts, or a standard offer process have been used. Instead, a variety of power purchase contracts have been negotiated by developers of qualifying facilities with investor-owned utilities, public utility districts, and municipally-owned and operated utilities. With a hydro-based system, benefits associated with resource acquisition are determined in large part by how compatible the resource is with a utility's existing generation mix. Power purchase rates are negotiated and vary according to firm energy production, guarantees, ability to schedule maintenance or downtime, rights of refusal, power plant purchase options, project start date and length of contract; front-loading or levelization provisions; and the ability of the project to provide ''demonstrated'' capacity. Legislation was also enacted which allows PURPA to work effectively. Initial laws established ownership rights and provided irrigation districts, PUDs, and municipalities with expanded enabling powers. Financial processes were streamlined and, in some cases, simplified. Finally, laws were passed which are designed to ensure that development proceeds in an environmentally acceptable manner. In retrospect, PURPA has worked well within Washington. In the state of Washington, 20 small-scale hydroelectric projects with a combined generating capacity of 77 MW, 3 solid waste-to-energy facilities

    The Idaho state legislature has created the Idaho Public Utilities Commission and has given the Commission the power and jurisdiction to supervise and regulate every public utility in the state. The Commission is comprised of three members appointed by the governor with the approval of the senate. Commissioners serve full time and are appointed for six year terms. No more than two of the members may be from the same political party. Title 61 of the Idaho Code, which establishes the Commission and delineates its powers, vests all regulatory responsibility in the Commission to the exclusion of local government. However, as an incident to their franchising power, municipalities may impose reasonable regulations on the use of their streets. The Idaho Supreme Court holds that the transfer of regulatory power over public utilities to the Commission did not diminish the powers and duties of municipalities to control and maintain their streets and alleys. Limited statutory authority also exists giving municipalities the power to regulate the fares, rates, rentals, or charges made for the service rendered under any franchise granted in such city, except such as are subject to regulation by the Public Utilities Commission. With the exception of this limited power, the Commission is the sole agency having regulatory power over Idaho public utilities.     The authority to regulate public utilities is vested generally in the New York Public Service Commission. The Commission is composed of five members appointed by the governor with the advice and consent of the senate. Commissioners are appointed for six-year terms. Commissioners may not have any pecuniary or financial interest in any public utility. Local governing bodies are authorized to exercise such power, jurisdiction and authority in enforcing the laws of the state and the orders, rules, and regulations of the commission as may be prescribed by statute or by the commission with respect to public utilities. A Commission spokesman confirmed that no statutes have been passed pursuant to this provision and the Commission has not ceded any of its regulatory powers to local governments. With the exception of the granting of franchises and permits to use public ways, local governments exercise no regulatory powers over public utilities. Specifically, the practicality of using hot water from the Washington Public Power Supply System's WNP-1 reactor, which is currently under construction on the Hanford Reservation, just north of the City of Richland is established. World-wide experience with district heating systems and the advantages of using these systems are described. The GEOCITY computer model used to calculate district heating costs is described and the assumptions upon which the costs are based are presented. District heating costs for the city of Richland, process heating costs for the Lamb-Weston potato processing plant, district heating costs for the Horn Rapids triangle area, and process heating costs for the 300 and 3000 areas are discussed. An economic analysis is discussed and institutional restraints are summarized. (MCW)

    The authority to regulate the operations of public utilities in New Jersey is generally vested in the Board of Public Utilities. The Board is subsumed within the Department of Energy for administrative purposes, but functions largely independently of supervision or control by that agency. The Board is composed of three members who serve for six-year terms. They are appointed by the governor with the advice and consent of the senate. Within the purview of its powers, the authority of the Board supersedes that of local governments. The Board, for example, may grant exemptions from local zoning provisions, and has approving authority over privileges or franchises granted by municipalities to public utilities. The Board, however, cannot override the refusal of a municipality to grant consent to the initiation of operations by a public utility. The Department is under the supervision and control of a commission consisting of three members appointed by the governor for terms of four years. No more than two of the commissioners may be members of the same political party. Commissioners must be freee from any employment or financial interests which are incompatible with the duties of the Department. The Department is responsible for regulating public utilities. The Department is specifically granted general supervisory authority over all gas and electric companies. One of the members is designated by the governor to act as chairman and serves in that capacity at the pleasure of the governor. Commissioners must be free from employment or pecuniary interests which are incompatible with the duties of the Commission. Within the purview of its powers, the authority of the Commission supercedes that of local governments. Local governments play a role in regulating public utilities only through the exercise of their zoning and franchising powers. In addition, municipally-owned utilities are totally exempt from Commission control. No specific procedure is provided by which the decisions of local governments regarding utilities may be reviewed by the Commission.     Chillers can be driven with cogenerated thermal energy, thereby offering the potential to increase utilization of cogeneration throughout the year. However, cogeneration decreases electric output compared to condensing power generation in power plants using a steam cycle (steam turbine or gas turbine combined cycle plants). The foregone electric production increases with increasing temperature of heat recovery. Given a range of conditions for key variables (such as cogeneration utilization, chiller utilization, cost of fuel, value of electricity, value of heat and temperature of heat recovered), how do technology alternatives for combining district cooling with cogeneration compare? This paper summarizes key findings from a report recently published by the International Energy Agency which examines the energy efficiency and economics of alternatives for combining cogeneration technology options (gas turbine simple cycle, diesel engine, steam turbine, gas turbine combined cycle) with chiller options (electric centrifugal, steam turbine centrifugal one-stage steam absorption, two-stage steam absorption, hot water absorption).

    On Jan. 27, the US Supreme Court refused to review a recent federal circuit court decision allowing a California public utility to enter into energy-related contractor activities; this may set a precedent for future related cases, according to an attorney for the contractor plaintiffs. The Supreme Court's refusal lets stand the 9th Federal Circuit Court of Appeals decision on Grason Electric Co. et al. vs. the Sacramento Municipal Utility District (SMUD). That decision allows SMUD - a public utility - to engage in energy-related businesses such as the installation of energy management systems and lighting retrofits, according to the attorney. The plaintiffs in the case, 13 electrical contractors in the Sacramento area, originally brought the case against SMUD on antitrust grounds because, they alleged, the utility was encroaching upon their businesses.

    The Washinton State Constitution grants authority to the legislature to regulate railroads and other common carriers as well as telegraph and telephone companies in the state. No section of the constitution expressly provides for the regulation of electric, gas, water, or heating utilities. The authority to regulate public utilities is vested generally in the Utilities and Transportation Commission, formerly designated at the Public Service Commission. The Commission is composed of three members appointed by the governor, with the consent of the senate. The term of office for commissioners is six years. Recently enacted legislation provides for the implementation of tax incentives to encourage the development of cogeneration facilities in the state. This plan is to be administered by the Department of Revenue in conjunction with the Energy Office. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    Full realization of the potential of what might be considered “low-grade” geothermal resources will require that we examine many more uses for the heat than traditional electricity generation. To demonstrate that geothermal energy truly has the potential to be a national energy source we will be designing, assessing, and evaluating innovative uses for geothermal-produced water such as hybrid biomass-geothermal cogeneration of electricity and district heating and efficiency improvements to the use of cellulosic biomass in addition to utilization of geothermal in district heating for community redevelopment projects. The objectives of this project were: 1) to perform a techno-economic analysis of the integration and utilization potential of low-temperature geothermal sources. Innovative uses of low-enthalpy geothermal water were designed and examined for their ability to offset fossil fuels and decrease CO2 emissions. 2) To perform process optimizations and economic analyses of processes that can utilize low-temperature geothermal fluids. These processes included electricity generation using biomass and district heating systems. 3) To scale up and generalize the results of three case study locations to develop a regionalized model of the utilization of low-temperature geothermal resources. A national-level, GIS-based, low-temperature geothermal resource supply model was developed and used to develop a series of national supply curves. We performed an in-depth analysis of the low-temperature geothermal resources that dominate the eastern half of the United States. The final products of this study include 17 publications, an updated version of the cost estimation software GEOPHIRES, and direct-use supply curves for low-temperature utilization of geothermal resources. The supply curves for direct use geothermal include utilization from known hydrothermal, undiscovered hydrothermal, and near-hydrothermal EGS resources and presented these results at the Stanford

    COMPLEAT takes its name, as an acronym, from Community-Oriented Model for Planning Least-Cost Energy Alternatives and Technologies. It is an electric utility planning model designed for use principally by publicly owned electric utilities and agencies serving such utilities. As a model, COMPLEAT is significantly more full-featured and complex than called out in APPA's original plan and proposal to DOE. The additional complexity grew out of a series of discussions early in the development schedule, in which it became clear to APPA staff and advisors that the simplicity characterizing the original plan, while highly desirable in terms of utility applications, was not achievable if practical utility problems were to be addressed. The project teams settled on Energy 20/20, an existing model developed by Dr. George Backus of Policy Assessment Associates, as the best candidate for the kinds of modifications and extensions that would be required. The remainder of the project effort was devoted to designing specific input data files, output files, and user screens and to writing and testing the compute programs that would properly implement the desired features around Energy 20/20 as a core program. This report presents in outline form, the features and user interface of COMPLEAT.

    An assessment of the utilities' forecasts of future electricity supply is presented. An analysis of the demand forecast is contained in a separate document. California Energy Demand 1978 to 2000: A preliminary Assessment (August 1979). An evaluation of the feasibility and implications of supply plans, formulated by the State's electric utilities, to meet their forecasted demand is presented. The report is a critique of the supply plans; therefore, it establishes the foundation for the examining alternatives. Utility resource plans and underlying supply planning assumptions were submitted between March and June 1978 for evaluation, but updated resource plans of July 1979 were used as the basis for the assessment. Supply plans were evaluated from utilities (PG and E, SCE, SDG and E, LADWP, Sacramento Municipal Utility District); cities (Burbank, Anaheim, Glendale, Pasadena, Riverside); Northern California Power Agency; Modesto Irrigation District; Turlock Irrigation District; Imperial Irrigation District; and Department of Water Resources.

    This Review of a Proposed Quartery Coal Publication contains findings and recommendations regarding the content of a new summary Energy Information Administration (EIA) coal and coke publication entitled The Quarterly Coal Review (QCR). It is divided into five sections: results of interviews with selected EIA data users; identification of major functions of the coal and coke industries; analysis of coal and coke data collection activities; evaluation of issues conerning data presentation including recommendations for the content of the proposed QCR; and comparison of the proposed QCR with other EIA publications. Major findings and recommendations are as follows: (1) User interviews indicate a definite need for a compehensive publication that would support analyses and examine economic, supply and demand trends in the coal industry; (2) the organization of the publication should reflect the natural order of activities of the coal and coke industries. Based on an analysis of the industries, these functions are: production, stocks, imports, exports, distribution, and consumption; (3) current EIA coal and coke surveys collect sufficient data to provide a summary of the coal and coke industries on a quarterly basis; (4) coal and coke data should be presented separately. Coke data could be presented as an appendix; (5) three geographic aggregations are recommended in the QCR. These are: US total, coal producing districts, and state; (6) coal consumption data should be consolidated into four major consumer categories: electric utilities, coke plants, other industrial, and residential commercial; (7) several EIA publications could be eliminated by the proposed QCR.

    The City of Long Beach recently incorporated an additional 61 natural gas vehicles (NGV) within its own fleet, bringing the City`s current NGV fleet to 171 NGVs. During January 1992, the City opened its first public access compressed natural gas (CNG) fueling station (86 CFM). This action served as the City`s first step toward developing the required CNG infrastructure to accommodate its growing NGV fleet, as well as those of participating commercial and private fleet owners. The City of Long Beach is committed to promoting NGVs within its own fleet, as well as encouraging NGV use by commercial and private fleet owners and resolving market development barriers. The NGV Business Plan provides recommendations for priority locations, station size and design, capital investment, partnership and pricing options. The NGV Business Plan also includes an econometric model to calculate CNG infrastructure cost recovery options, based on CNG market research within the City of Long Beach and Southern California area. Furthermore, the NGV Business Plan provides the City with a guide regarding CNG infrastructure investment, partnerships and private fueling programs. Although the NGV Business Plan was developed to address the prevailing CNG-related issues affecting the City of Long Beach, the methodology used within the NGV Business Plan and, more significantly, the accompanying econometric model will assist local governments, nation-wide, in the successful implementation of similar CNG infrastructures required for effective market penetration of NGVs.

    District energy systems are a major part of the energy use and delivery infrastructure of the United States. With nearly 6,000 operating systems currently in place, district energy represents approximately 800 billion BTU per hour of installed thermal production capacity, and provides over 1.1 quadrillion BTU of energy annually -- about 1.3% of all energy used in the US each year. Delivered through more that 20,000 miles of pipe, this energy is used to heat and cool almost 12 billion square feet of enclosed space in buildings that serve a diverse range of office, education, health care, military, industrial and residential needs. This Census is intended to provide a better understanding of the character and extent of district heating, cooling and cogeneration in the United States. It defines a district energy system as: Any system that provides thermal energy (steam, hot water, or chilled water) for space heating, space cooling, or process uses from a central plant, and that distributes the energy to two or more buildings through a network of pipes. If electricity is produced, the system is a cogenerating facility. The Census was conducted through surveys administered to the memberships of eleven national associations and agencies that collectively represent the great majority of the nation`s district energy system operators. Responses received from these surveys account for about 11% of all district systems in the United States. Data in this report is organized and presented within six user sectors selected to illustrate the significance of district energy in institutional, community and utility settings. Projections estimate the full extent of district energy systems in each sector.

    Over the next twenty years, the Earth`s rain forests may decrease by forty percent! This paper presents a revolutionary corporate entity for the protection of those forests, the biological diversity conservation district (biodistricts). The underlying cause of rain forest destruction is unfettered competition for limited resources. The competitors are many: farmers, business, local and national governments, the biotechnology and ecotourism industries, multinational companies, public utilities, and indigenous groups. To varying degrees, all compete within the marketplace. biodistricts will bring together two forces once thought to be antithetical: conservation an development. They will be set up in corporate form, owned and controlled by groups claiming access to the forest resources. Because the various groups will fight for the same resources habitats, ecosystems, and genetic diversity-each will prevent the others from destroying them. The district members will ensure that all businesses maintain sustainable development practices because the economic success of the district depends upon the area`s natural beauty and biological diversity. This paper analyzes the effects on the culture, politics, economy and conservation there. It will conclude that the comprehensive approach taken by biodistricts is the only method for solving the problem of rain forest destruction; that it is economically feasible, culturally viable, and ethically defensible. By March 1, 1995, the paper will represent not only the culmination of eighteen months of research, writing and interviews regarding biological diversity conservation, but also the impetus to push the thinking of environmentalists and business persons in a new direction, perhaps the only direction that will allow the nations of the world to protect their forests for the next twenty years and beyond.
