    Mountain coal mining in the Central Appalachians faces increased challenge under the Clean Water Act (CWA). These challenges have included the US Environmental Protection Agency's (EPA) increased involvement in permitting under Section 404 of the CWA; active opposition by environmental groups to Section 404 permits; and proposed federal legislation to reduce the availability of these permits. These recent challenges culminated in a June 11, 2009, Memorandum of Understanding (MoU) between the PEA, the Department of Interior (DoI) and the Army Corps of Engineers (Corps) that will limit the use of general permits for mountaintop coal mining and increase the scrutiny applied to individual permits, while also providing a coordinated approach for reviewing the backlog of pending permit application. By entering into the MoU, the federal agencies aim to reduce the environmental impacts of mountaintop coal mining while increasing certainty and transparency for permit applications. Challenges to Section 404 permitting for mountaintop coal mining are dynamic and new developments occur almost daily. This article provides a snapshot of the current climate.

    For a number of years, concerns have been raised about the length of time and the complexity involved in obtaining required permits in order to develop the geothermal resource at the Geysers. Perhaps the most important factor is jurisdiction. At the Geysers, all three levels of government - local, state, and federal - exercise significant authority over various aspects of geothermal development. In addition, several agencies within each governmental level play an active role in the permitting process. The present study is concerned primarily with the local permitting process, and the ways in which this process could be expedited. This report begins by looking at the local role in the overall permitting process, and then reviews the findings and conclusions that have been reached in other studies of the problem. This is followed by a case study evaluation of recent permitting experience in the four Geysers-Calistoga KGRA counties, and the report concludes by outlining several approaches to expediting the local permitting process.

    This is the second technical report, covering the period from April 1, 2003 through September 30, 2003. This project brings together three parts of the oil exploration, development, and permitting process to form the foundation for a more fully integrated information technology infrastructure for the State of Alaska. The geo-technical component is a shared effort between the State Department of Administration and the US Department of Energy. The Alaska Oil and Gas Conservation Commission is rapidly converting high volumes of paper documents and geo-technical information to formats suitable for search and retrieval over the Internet. The permitting component is under the lead of the DNR Office of Project Management and Permitting. A web-based system will enable the public and other review participants to track permit status, submit and view comments, and obtain important project information on-line. By automating several functions of the current manual process, permit applications will be completed more quickly and accurately, and agencies will be able to complete reviews with fewer delays. Structural changes are taking place in terms of organization, statutory authority, and regulatory requirements. Geographic Information Systems are a central component to the organization of information, and the delivery of on-line services. Progress has been made to deploy the foundation system for the shared GIS based on open GIS protocols to the extent feasible. Alaska has nearly one-quarter of the nation's supply of crude oil, at least five billion barrels of proven reserves. The American Association of Petroleum Geologists report that the 1995 National Assessment identified the North Slope as having 7.4 billion barrels of technically recoverable oil and over 63 trillion cubic feet of natural gas. From these reserves, Alaska produces roughly one-fifth of the nation's daily crude oil production, or approximately one million barrels per day from over 1,800 active wells.

    The objective of this project is to eliminate three closely inter-related barriers to oil production in Alaska through the use of a geographic information system (GIS) and other information technology strategies. These barriers involve identification of oil development potential from existing wells, planning projects to efficiently avoid conflicts with other interests, and gaining state approvals for exploration and development projects. Each barrier is the result of either current labor-intensive methods or poorly accessible information. This project brings together three parts of the oil exploration, development, and permitting process to form the foundation for a more fully integrated information technology infrastructure for the State of Alaska. This web-based system will enable the public and other review participants to track permit status, submit and view comments, and obtain important project information online. By automating several functions of the current manual process, permit applications will be completed more quickly and accurately, and agencies will be able to complete reviews with fewer delays. The application will include an on-line diagnostic Coastal Project Questionnaire to determine the suite of permits required for a specific project. The application will also automatically create distribution lists based on the location and type of project, populate document templates for project review start-ups, public notices and findings, allow submission of e-comments, and post project status information on the Internet.     This is the final technical report for Project 15446, covering the grant period of October 2002 through March 2006. This project connects three parts of the oil exploration, development, and permitting process to form the foundation for an advanced information technology infrastructure to better support resource development and resource conservation. Alaska has nearly one-quarter of the nation's supply of crude oil, at least five billion barrels of proven reserves. The American Association of Petroleum Geologists report that the 1995 National Assessment identified the North Slope as having 7.4 billion barrels of technically recoverable oil and over 63 trillion cubic feet of natural gas. From these reserves, Alaska produces roughly one-fifth of the nation's daily crude oil production, or approximately one million barrels per day from over 1,800 active wells. The broad goal of this grant is to increase domestic production from Alaska's known producing fields through the implementation of preferred upstream management practices. (PUMP). Internet publication of extensive and detailed geotechnical data is the first task, improving the permitting process is the second task, and building an advanced geographical information system to offer continuing support and public access of the first two goals is the third task. Excellent progress has been made on all three tasks; the technical objectives as defined by the approved grant sub-tasks have been met. The end date for the grant was March 31, 2006.

    Permitting is a major component of the geothermal development process. Better coordination across government agencies could reduce uncertainty of the process and the actual time of permitting. This presentation highlights various forms of coordinating permit offices at the state and federal level in the western United States, discusses inefficiencies and mitigation techniques for permitting natural resource projects, analyzes whether various approaches are easily adaptable to utility-scale geothermal development, and addresses advantages and challenges for coordinating permit offices. Key successful strategies identified include: 1. Flexibility in implementing the approach (i.e. less statutory requirements for the approach); 2. Less dependence on a final environmental review for information sharing and permit coordination; 3. State and federal partnerships developed through memorandum of understanding to define roles and share data and/or developer information. A few of the most helpful techniques include: 1. A central point of contact for the developer to ask questions surrounding the project; 2. Pre-application meetings to assist the developer in identifying all of the permits, regulatory approvals, and associated information or data required; 3. A permit schedule or timeline to set expectations for the developer and agencies; 4. Consolidating the public notice, comment, and hearing period into fewer hearings held concurrently.

  15. Offshore Wind Energy Permitting: A Survey of U.S. Project Developers

    The U.S. Department of Energy (DOE) has adopted a goal to generate 20% of the nation’s electricity from wind power by 2030. Achieving this “20% Wind Scenario” in 2030 requires acceleration of the current rate of wind project development. Offshore wind resources contribute substantially to the nation’s wind resource, yet to date no offshore wind turbines have been installed in the U.S. Progress developing offshore wind projects has been slowed by technological challenges, uncertainties about impacts to the marine environment, siting and permitting challenges, and viewshed concerns. To address challenges associated with siting and permitting, Pacific Northwest National Laboratory (PNNL) surveyed offshore wind project developers about siting and project development processes, their experience with the environmental permitting process, and the role of coastal and marine spatial planning (CMSP) in development of the offshore wind industry. Based on the responses to survey questions, we identify several priority recommendations to support offshore wind development. Recommendations also include considerations for developing supporting industries in the U.S. and how to use Coastal and Marine Spatial Planning (CMSP) to appropriately consider ocean energy among existing ocean uses. In this report, we summarize findings, discuss the implications, and suggest actions to improve the permitting and siting process.

    This paper describes detection and diagnostic techniques for partial discharges in GIS. Partial-discharge current waveforms of SF[sub 6] gas and external noise characteristics of actual substations were investigated, and a measuring system having sensors in GIS and employing frequency range of VHF band was developed. By this system, detecting very small partial discharges of several 10 pC level has become possible. Also, a neural network system, focusing attention as a method for recognizing patterns, was applied for determining causes for partial discharge in GIS, and its applicability has been proved.

    A series of isothermal physics measurements were performed as part of an acceptance testing program for the Fast Flux Test Facility (FFTF). A HEX-Z partially-homogenized benchmark model of the FFTF fully-loaded core configuration was developed for evaluation of these measurements. Evaluated measurements include the critical eigenvalue of the fully-loaded core, two neutron spectra, 32 reactivity effects measurements, an isothermal temperature coefficient, and low-energy gamma and electron spectra. Dominant uncertainties in the critical configuration include the placement of radial shielding around the core, reactor core assembly pitch, composition of the stainless steel components, plutonium content in the fuel pellets, and boron content in the absorber pellets. Calculations of criticality, reactivity effects measurements, and the isothermal temperature coefficient using MCNP5 and ENDF/B-VII.0 cross sections with the benchmark model are in good agreement with the benchmark experiment measurements. There is only some correlation between calculated and measured spectral measurements; homogenization of many of the core components may have impacted computational assessment of these measurements. This benchmark evaluation has been added to the IRPhEP Handbook.

  5. Development of a hydrogen generator for fuel cells based on the partial oxidation of methane

    As well known, the most acknowledged process for generation of hydrogen for fuel cells is based upon the steam reforming of methane or natural gas (SRM). The reaction is endothermic ({Delta}H{sub 298}= 206 kJ/mole) and high H{sub 2}O/CH{sub 4} ratios are required in order to limit coke formation at T higher than 1000 K. Moreover, it is a common practice that the process`s fuel economy is highly sensitive to proper heat fluxes and reactor design (tubular type) and to operational conditions. Efficient heat recovery can be accomplished only on large scale units (> 40,000 Nm{sup 3}/h), far from the range of interest of {open_quotes}on-site{close_quotes} fuel cells. Even if, to fit the needs of the fuel cell technology, medium sized external reforming units (50-200 Nm{sup 3} H{sub 2}/h) have been developed and/or planned for integration with both the first and the second generation fuel cells, amelioration in their heat recovery and efficiency is at the expense of an increased sophistication and therefore at higher per unit costs. In all cases, SRM requires an extra {open_quotes}fuel{close_quotes} supply (to substain the endothermicity of the reaction) in addition to stoichiometric requirements ({open_quotes}feed{close_quotes} gas). A valid alternative could be a process based on catalytic partial oxidation of CH{sub 4} (CSPOM), since the process is mildly exothermic ({Delta}H{sub 298}= -35.6 kJ/mole) and therefore not energy intensive. Consequently, great interest is expected from conversion of methane into syngas, if an autothermal, low energy intensive, compact and reliable process could be developed.

    Underground carbon storage may become one of the solutions to address global warming. However, to have an impact, carbon storage must be done at a much larger scale than current CO{sub 2} injection operations for enhanced oil recovery. It must also include injection into saline aquifers. An important characteristic of CO{sub 2} is its strong buoyancy--storage must be guaranteed to be sufficiently permanent to satisfy the very reason that CO{sub 2} is injected. This long-term aspect (hundreds to thousands of years) is not currently captured in legislation, even if the U.S. has a relatively well-developed regulatory framework to handle carbon storage, especially in the operational short term. This report proposes a hierarchical approach to permitting in which the State/Federal Government is responsible for developing regional assessments, ranking potential sites (''General Permit'') and lessening the applicant's burden if the general area of the chosen site has been ranked more favorably. The general permit would involve determining in the regional sense structural (closed structures), stratigraphic (heterogeneity), and petrophysical (flow parameters such as residual saturation) controls on the long-term fate of geologically sequestered CO{sub 2}. The state-sponsored regional studies and the subsequent local study performed by the applicant will address the long-term risk of the particular site. It is felt that a performance-based approach rather than a prescriptive approach is the most appropriate framework in which to address public concerns. However, operational issues for each well (equivalent to the current underground injection control-UIC-program) could follow regulations currently in place. Area ranking will include an understanding of trapping modes.     Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

    As part of the West Coast Regional Carbon Sequestration Partnership (WESTCARB), Terralog Technologies USA, Inc., reviewed current state and federal regulations related to carbon dioxide capture and storage within geologic formations and enhanced carbon uptake in terrestrial ecosystems. We have evaluated and summarized the current and possible future permitting requirements for the six states that comprise the West Coast Regional Partnership. Four options exist for CO{sub 2} injection into appropriate geologic formations, including storage in: (1) oil and gas reservoirs, (2) saline formations, (3) unmineable coal beds, and (4) salt caverns. Terrestrial CO{sub 2} sequestration involves improved carbon conservation management (e.g. reduction of deforestation), carbon substitution (e.g., substitution for fossil fuel-based products, energy conservation through urban forestry, biomass for energy generation), and improved carbon storage management (e.g., expanding the storage of carbon in forest ecosystems). The primary terrestrial options for the West Coast Region include: (1) reforestation of under-producing lands (including streamside forest restoration), (2) improved forest management, (3) forest protection and conservation, and (4) fuel treatments for the reduction of risk of uncharacteristically severe fires (potentially with associated biomass energy generation). The permits and/or contracts required for any land-use changes/disturbances and biomass energy generation that may occur as part of WESTCARB's activities have been summarized for each state.

    Major sources as defined in Title V of the Clean Air Act Amendments of 1990 that are required to submit an operating permit application will need to: Evaluate their compliance status; Determine a strategic method of presenting the general and specific conditions of their Model Operating Permit (MOP); Maintain compliance with air quality regulations. A MOP is prepared to assist permitting agencies and affected facilities in the development of operating permits for a specific source category. This paper includes a brief discussion of example permit conditions that may be applicable to various types of Title V sources. A MOP for a generic natural gas processing plant is provided as an example. The MOP should include a general description of the production process and identify emission sources. The two primary elements that comprise a MOP are: Provisions of all existing state and/or local air permits; Identification of general and specific conditions for the Title V permit. The general provisions will include overall compliance with all Clean Air Act Titles. The specific provisions include monitoring, record keeping, and reporting. Although Title V MOPs are prepared on a case-by-case basis, this paper will provide a general guideline of the requirements for preparation of a MOP. Regulatory agencies have indicated that a MOP included in the Title V application will assist in preparation of the final permit provisions, minimize delays in securing a permit, and provide support during the public notification process.

    "The soft costs of solar—costs not associated with hardware—remain stubbornly high. Among the biggest soft costs are those associated with inefficiencies in local permitting and inspection. A study by the National Renewable Energy Laboratory and Lawrence Berkeley National Laboratory estimates that these costs add an average of $0.22/W per residential installation. This project helps reduce non-hardware/balance of system (BOS) costs by creating and maintaining a free and available site of permitting requirements and solar system verification software that installers can use to reduce time, capital, and resource investments in tracking permitting requirements. Software tools to identify best permitting practices can enable government stakeholders to optimize their permitting process and remove superfluous costs and requirements. Like ""a Wikipedia for solar permitting"", users can add, edit, delete, and update information for a given jurisdiction.     The Clean Air Act Amendments of 1990, which amended the Federal Clean Air Act of 1977, required that the US Environmental Protection Agency develop a national Air Operating Permit Program, which in turn would require each state to develop an Air Operating Permit Program to identify all sources of ``regulated`` pollutants. Regulated pollutants include ``criteria`` pollutants (oxides of nitrogen, sulfur oxides, total suspended particulates, carbon monoxide, particulate matter greater than 10 micron, lead) plus 189 other ``Hazardous`` Air Pollutants. The Hanford Site, owned by the US Government and operated by the US Department of Energy, Richland Operations Office, is located in southcentral Washington State and covers 560 square miles of semi-arid shrub and grasslands located just north of the confluence of the Snake and Yakima Rivers with the Columbia River. This land, with restricted public access, provides a buffer for the smaller areas historically used for the production of nuclear materials, waste storage, and waste disposal. About 6 percent of the land area has been disturbed and is actively used. The Hanford Site Air Operating Permit Application consists of more than 1,100 sources and in excess of 300 emission points. Before January 1995, the maintenance and operations contractor and the environmental restoration contractor for the US Department of Energy completed an air emission inventory on the Hanford Site. The inventory has been entered into a database so that the sources and emission points can be tracked and updated information readily can be retrieved. The Hanford Site Air Operating Permit Application contains information current as of April 19, 1995.

    We push the limits of the direct use of partially pure entangled states to perform quantum teleportation by presenting several protocols in many different scenarios that achieve the optimal efficiency possible. We review and put in a single formalism the three major strategies known to date that allow one to use partially entangled states for direct quantum teleportation (no distillation strategies permitted) and compare their efficiencies in real world implementations. We show how one can improve the efficiency of many direct teleportation protocols by combining these techniques. We then develop new teleportation protocols employing multipartite partially entangled states. The three techniques are also used here in order to achieve the highest efficiency possible. Finally, we prove the upper bound for the optimal success rate for protocols based on partially entangled Bell states and show that some of the protocols here developed achieve such a bound. -- Highlights: Optimal direct teleportation protocols using directly partially entangled states. We put in a single formalism all strategies of direct teleportation. We extend these techniques for multipartite partially entangle states. We give upper bounds for the optimal efficiency of these protocols.

    In accordance with the Southern States Energy Board (SSEB) proposal, as incorporated into NETL/DE-FC26-97FT34199, the objective of this agreement is to streamline the environmental technology permitting process site-to-site, state-to-state, and industry-to-industry to achieve remediation and waste processing faster, better and cheaper. SSEB is working with member Governors, legislators and regulators to build consensus on streamlining the permitting process for new and innovative technologies for addressing the legacy of environmental problems from 50 years of weapons research, development and production. This report reviews mechanisms whereby industry consortiums and the Department of Energy (DOE) have been working with State regulators and other officials in technology deployment decisions within the DOE complex. The historic development of relationships with State regulators is reviewed and the current nature of the relationships examined. The report contains observations from internal DOE reviews as well as recommendations from the General Accounting Office (GAO) and other external organizations. The report discusses reorganization initiatives leading up to a DOE Top-to-Bottom review of the Environmental Management (EM) Program and highlights points of consideration for maintaining effective linkages with State regulators. It notes how the proposed changes will place new demands upon the National Energy Technology Laboratory (NETL) and how NETL can leverage its resources by refocusing existing EM efforts specifically to states that have DOE facilities within their borders (host-states). Finally, the report discusses how SSEB's Permitting Leadership in the United States (PLUS) program can provide the foundation for elements of NETL's technical assistance program that are delivered to regulators and other decision- makers in host-states.     This bill would direct the Secretary of Energy to compile a list of affected states which are determined to be states in which disputes, uncertainty, or litigation exist or potentially exists regarding the ownership of coalbed methane; in which the development of significant deposits of coalbed methane may be impeded by such disputes; in which statutory or regulatory procedures permitting and encouraging development of coalbed methane prior to final resolution of disputes are not in place; and in which extensive development of coalbed methane does not exist. Colorado, Montana, New Mexico, Wyoming, Utah, Virginia, and Alabama are excluded from such a list since they currently have development of coalbed methane. Until the Secretary of Energy publishes a different list, the affected states are West Virginia, Pennsylvania, Kentucky, Ohio, Tennessee, Indiana, and Illinois, effective on the date of enactment of this bill.

    The Permit Application Checklist is intended to be used as a best management practice when establishing local government requirements for residential and commercial solar photovoltaic (PV) system permits. Local governments may modify this checklist to accommodate their local ordinances, code requirements, and permit procedures.

    The handbook consists of eight chapters addressing permitting and licensing requirements under the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended by the Superfund Amendments and Reauthorization Act of 1986 (CERCLA/SARA), the Atomic Energy Act (AEA), the Clean Air Act (CAA), the Clean Water Act (CWA), the Federal Insectide, Fungicide, and Rodenticide Act (FIFRA), the Safe Drinking Water Act (SDWA), and the Toxic Substances Control Act (TSCA). Each chapter consists of: (1) an introduction to the statute and permitting requirements; (2) a diagram illustrating the relationship between permitting requirements under the statute being discussed and permitting requirements from other environmental statutes which may have to be addressed when applying for a particular permit (e.g., when applying for a RCRA permit, permits and permit applications under the CWA, CAA, SDWA, etc. would have to be listed in the RCRA permit application); and, (3) a compilation of the permitting requirements for the regulatory program resulting from the statute. In addition, the Handbook contains a permitting keyword index and a listing of hotline telephone numbers for each of the statutes.

  5. Partially integrated exhaust manifold

    A partially integrated manifold assembly is disclosed which improves performance, reduces cost and provides efficient packaging of engine components. The partially integrated manifold assembly includes a first leg extending from a first port and terminating at a mounting flange for an exhaust gas control valve. Multiple additional legs (depending on the total number of cylinders) are integrally formed with the cylinder head assembly and extend from the ports of the associated cylinder and terminate at an exit port flange. These additional legs are longer than the first leg such that the exit port flange is spaced apart from the mounting flange. This configuration provides increased packaging space adjacent the first leg for any valving that may be required to control the direction and destination of exhaust flow in recirculation to an EGR valve or downstream to a catalytic converter.

    The Regulatory and Permitting Information Desktop (RAPID) Toolkit combines the former Geothermal Regulatory Roadmap, National Environmental Policy Act (NEPA) Database, and other resources into a Web-based tool that gives the regulatory and utility-scale geothermal developer communities rapid and easy access to permitting information. RAPID currently comprises five tools - Permitting Atlas, Regulatory Roadmap, Resource Library, NEPA Database, and Best Practices. A beta release of an additional tool, the Permitting Wizard, is scheduled for late 2014. Because of the huge amount of information involved, RAPID was developed in a wiki platform to allow industry and regulatory agencies to maintain the content in the future so that it continues to provide relevant and accurate information to users. In 2014, the content was expanded to include regulatory requirements for utility-scale solar and bulk transmission development projects. Going forward, development of the RAPID Toolkit will focus on expanding the capabilities of current tools, developing additional tools, including additional technologies, and continuing to increase stakeholder involvement.

    The major environmental laws that apply to the West Valley Demonstration Project (WVDP) are the: Resource Conservation and Recovery Act (RCRA), Clean Air Act (CAA), Clean Water Act (CWA), Safe Drinking Water Act (SDWA), Toxic Substances Control Act (TSCA), National Environmental Policy Act (NEPA), and Emergency Planning and Community Right-To-Know Act (EPCRA). Regulations developed in accordance with these laws are administered by the New York State Department of Environmental Conservation (NYSDEC) and the U.S. Environmental Protection Agency (EPA) through state and federal programs, and regulatory requirements such as permitting. The Environmental Permits & Reports (EP&R) Group of the Environmental Affairs (EA) Department has the primary responsibility for developing a site-wide permitting program for the WVDP and obtaining the necessary permits. This report discusses the permits and the permitting process associated with the Vitrification Facility (VF).

The vertices have inner walls which are approximately perpendicular to the mirror surface and make planar contacts with the outer surfaces of the outer shells.     A two-part catalyst comprising a dehydrogenation portion and an oxide-ion conducting portion. The dehydrogenation portion is a group VIII metal and the oxide-ion conducting portion is selected from a ceramic oxide crystallizing in the fluorite or perovskite structure. There is also disclosed a method of forming a hydrogen rich gas from a source of hydrocarbon fuel in which the hydrocarbon fuel contacts a two-part catalyst comprising a dehydrogenation portion and an oxide-ion conducting portion at a temperature not less than about 400.degree. C. for a time sufficient to generate the hydrogen rich gas while maintaining CO content less than about 5 volume percent. There is also disclosed a method of forming partially oxidized hydrocarbons from ethanes in which ethane gas contacts a two-part catalyst comprising a dehydrogenation portion and an oxide-ion conducting portion for a time and at a temperature sufficient to form an oxide.

  2. Permitting plan for the high-level waste interim storage

    This document addresses the environmental permitting requirements for the transportation and interim storage of solidified high-level waste (HLW) produced during Phase 1 of the Hanford Site privatization effort. Solidified HLW consists of canisters containing vitrified HLW (glass) and containers that hold cesium separated during low-level waste pretreatment. The glass canisters and cesium containers will be transported to the Canister Storage Building (CSB) in a U.S. Department of Energy (DOE)-provided transportation cask via diesel-powered tractor trailer. Tri-Party Agreement (TPA) Milestone M-90 establishes a new major milestone, and associated interim milestones and target dates, governing acquisition and/or modification of facilities necessary for: (1) interim storage of Tank Waste Remediation Systems (TWRS) immobilized HLW (IHLW) and other canistered high-level waste forms; and (2) interim storage and disposal of TWRS immobilized low-activity tank waste (ILAW). An environmental requirements checklist and narrative was developed to identify the permitting path forward for the HLW interim storage (HLWIS) project (See Appendix B). This permitting plan will follow the permitting logic developed in that checklist.

    Title 5 of the 1990 Clean Air Act Amendments (CAAA) establishes a massive new operating permit program, which will be administered by state agencies in accordance with federal guidelines. Formal requirements regarding operating-permits were promulgated by the US Environmental Protection Agency (EPA) on July 21, 1992 (40 CFR 70). The Title 5 program will require many chemical manufacturing facilities to apply for and obtain operating permits that address air emissions from the entire facility. A major impact of the Title 5 program is that facilities will now be required to implement measures to routinely demonstrate that they are operating in compliance with the terms of the permit. Otherwise, facilities will be considered out of compliance. Once the new permits are in place, the burden will be on the facility to prove routine compliance to prevent any enforcement action. According to EPA, the new permits are not intended to impose any new regulatory requirements on a facility. Rather, they will serve as an enforcement tool.

    Titles IV and V of the Clean Air Act Amendments of 1990 (Act or CAA) created two new stationary source permitting programs, one specific to acid rain (Title IV), and a second for operating permits in general (Title V). The Phase 2 portion of the acid rain program was designed to be implemented through the Title V operating permit program, thereby subjecting all Phase 2 acid rain sources to the requirements of Title V. Permits issued pursuant to Phase 2 of the acid rain program will be viewed as a self-contained portion of the Title V operating permit and will be governed by regulations promulgated under both Title IV and Title V. The requirements imposed by Title IV may not always be consistent with the broader operating permit program requirements of Title V, and when inconsistency occurs, the acid rain requirements will take precedence. This nonalignment will perhaps be most apparent during two stages of initial permitting: (1) the transition period following Title V program approval when permit application, issuance, and effective dates differ between the two programs, and (2) at the point when acid rain permits must be reopened to incorporate Phase 2 NO{sub x} requirements. This paper explores strategies for streamlining implementation of the two programs with particular focus on these two coordination issues.

    Not-normally-manned platforms are not a new development. However, their use in harsher environments has until recently, been limited. Development of reliable communications networks capable of handling the large amounts of data required for process control in real time with distributed control systems (DCSs) has been a key factor in making the concept viable for harsher, more remote environments. The article below examines the transparent communications network and DCS installed on Pickerill field, offshore UK, by Fisher-Rosemount Systems and its operational parameters. Pickerill field, some 50 mi off the Lincolnshire coast, comprises two small unmanned platforms producing gas under remote control from Arco`s operations base at Great Yarmouth about 60 mi south. Reliable communication is required both with the two platforms offshore and with Conoco`s gas processing operators at Theddlethorpe. Fundamental to project success was the ability of the process control system to provide entirely secure and transparent communication with equipment offshore and thus enable operators at Great Yarmouth to interact with the process as if it were local to their control center.

    The magnitude and complexity of permit processes raises a question as to their impact on the rate and scope of industrial development activity. One particular area where this issue is of concern is in new energy extraction and development activities. The initiation of new energy projects has been a national priority for several years. But, energy projects, because of their potential for creating land disturbances, are subject to many environmental and other regulations. Because of this, the permitting required of energy resource developers is extensive. Within the energy field, a major portion of development activities occurs on federal lands. This is particularly true in the Rocky Mountain states and Alaska where the principal landholder is the federal government. The permitting requirements for federal lands' development differ from those for private lands. This report assesses the impact of permitting processes for energy resource development on federal lands. The permitting processes covered include all of the major environmental, land-use, and safety permits required by agencies of federal and state governments. The lands covered include all federal lands, with emphasis on eight states with major development activities.

    The Central Artery/Tunnel (CA/T) Project in Boston, Massachusetts involves the replacement of the existing I-93 interstate highway (Central Artery) and the extension of I-90 (Massachusetts Turnpike) to Logan International Airport. To date, approximately 95 environmental and related permits have been obtained for the CA/T Project. At least 200 permits from federal, state and local regulatory agencies will be acquired for the entire Project. The proposed action includes construction activities and permanent structures related to the crossing of three bodies of water: Charles River, Fort Point Channel, and Boston Inner Harbor. The Project also includes work in Massachusetts filled tidelands, relocation or construction of outfalls, disposition of construction dewatering and tunnel drainage fluids, and capping of an abandoned landfill. The number of permits, interrelationships between permits and interfaces with design and construction schedules have necessitated the development and implementation of a permit tracking system. The system tracks permit applications from preparation through public and agency review to permit issuance. The issues are discussed in detail: Phased development of the tracking system; Utilization of Project standard scheduling system software, Primavera Project Planner; How the information generated by the tracking system is used at the Project; Report format and production; Construction phase services and the multidiscipline, integrated Project schedule.

    This permit application documentation is for a State Waste Discharge Permit issued in accordance with requirements of Washington Administrative Code 173-216. The activity being permitted is a technology test using electrical resistance tomography. The electrical resistance tomography technology was developed at Lawrence Livermore National Laboratory and has been used at other waste sites to track underground contamination plumes. The electrical resistance tomography technology measures soil electrical resistance between two electrodes. If a fluid contaminated with electrolytes is introduced into the soil, the soil resistance is expected to drop. By using an array of measurement electrodes in several boreholes, the areal extent of contamination can be estimated. At the Hanford Site, the purpose of the testing is to determine if the electrical resistance tomography technology can be used in the vicinity of large underground metal tanks without the metal tank interfering with the test. It is anticipated that the electrical resistance tomography technology will provide a method for accurately detecting leaks from the bottom of underground tanks, such as the Hanford Site single-shell tanks.

    The present volume is the first of a series of three constituting the title study. It provides a brief but thorough description of six Oil Shale Retorting Processes, namely: Paraho, Tosco II, Oxidental Modified In-Situ, Rio Blanco, Union Oil, and Superior Oil. The processes are treated at Unit Operations level, including operations such as Mining, Crushing, Screening, Conveying, Hydrogenation (or Upgrading), Hydrogen Manufacturing Plant, Amine Treating, Low-Btu Gas Treating, Tail Gas Treating, Sulfur Recovery, Wastewater Treatment, Sour Waste Stripping, Refining, Spent Shale Disposal, etc. The present first volume of the study provides most process engineering information required in order for Control Requirements, at specific points of a given unit operations flowsheet, to be fully assessed. Flow sheets for unit operations presented in the present Volume I are only conceptual and qualitative. Some quantitative data on volumeric flow rates of specific flow streams are occasionally given. However, no systematic effort has been presently made to develop a numerical data base on process flow streams. This has been done in a much more systematic and thorough manner in another FMR study performed on behalf of DOE under title Source Terms for the Health and Environmental Effects Document (HEED) for Oil Shale - 1982. Additional original quantitative analysis has been performed by FMR towards developing material balances for specific oil shale feeds into specific retorting processes.

    Important new changes to the Hazardous Waste Facility Permit (HWFP) were implemented during 2007. The challenge was to implement these changes without impacting shipping schedules. Many of the changes required advanced preparation and coordination in order to transition to the new waste analysis paradigm, both at the generator sites and at the WIPP without interrupting the flow of waste to the disposal facility. Not only did aspects of waste characterization change, but also a new Permittees' confirmation program was created. Implementing the latter change required that new equipment and facilities be obtained, personnel hired, trained and qualified, and operating procedures written and approved without interruption to the contact-handled (CH) transuranic (TRU) waste shipping schedule. This was all accomplished successfully with no delayed or cancelled shipments. Looking forward to 2008 and beyond, proposed changes that will deal with waste in the DOE TRU waste complex is larger than the TRUPACT-IIs can handle. Size reduction of the waste would lead to unnecessary exposure risk and ultimately create more waste. The WIPP is working to have the Nuclear Regulatory Commission (NRC) certify the TRUPACT-III. The TRUPACT-III will be able to accommodate larger sized TRU mixed waste. Along with this new NRC-certified shipping cask, a new disposal container, the Standard Large Box, must be proposed in a permit modification. Containers for disposal of TRU mixed waste at the WIPP must meet the DOT 7A standards and be filtered. Additionally, as the TRUPACT-III/Standard Large Box loads and unloads from the end of the shipping cask, the proposed modification will add horizontal waste handling techniques to WIPP's vertical CH TRU waste handling operations. Another major focus will be the Hazardous Waste Facility Permit reapplication. The WIPP received its HWFP in October of 1999 for a term of ten years. The regulations and the HWFP require that a new permit application be

    Dependence on the wettability of graphene on the nature of the underlying substrate remains only partially understood. We systematically investigate the role of liquid-substrate interactions on the wettability of graphene by varying the area fraction of suspended graphene from 0 to 95% by means of nanotextured substrates. We find that completely suspended graphene exhibits the highest water contact angle (85° ± 5°) compared to partially suspended or supported graphene, regardless of the hydrophobicity (hydrophilicity) of the substrate. Moreover, 80% of the long-range water-substrate interactions are screened by the graphene monolayer, the wettability of which is primarily determined by short-range graphene-liquidmore » interactions. By its well-defined chemical and geometrical properties, supported graphene therefore provides a model system to elucidate the relative contribution of short and long range interactions to the macroscopic contact angle.« less

    For widespread use of fuel cells to power automobiles in the near future, it is necessary to convert gasoline or other transportation fuels to hydrogen on-board the vehicle. Partial oxidation reforming is particularly suited to this application as it eliminates the need for heat exchange at high temperatures. Such reformers offer rapid start and good dynamic performance. Lowering the temperature of the partial oxidation process, which requires the development of a suitable catalyst, can increase the reforming efficiency. Catalytic partial oxidation (or autothermal) reformers and non-catalytic partial oxidation reformers developed by various organizations are presently undergoing testing and demonstration. This paper summarizes the process chemistries as well as recent test data from several different reformers operating on gasoline, methanol, and other fuels.

    The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

    On October 24, 1992, President Bush signed into law the National Energy Policy Act of 1992. The bill is a sweeping, comprehensive overhaul of the Nation`s energy laws, the first in more than a decade. Among other provisions, the National Energy Policy Act reforms the licensing process for new nuclear power plants by adopting a new approach developed by the US Nuclear Regulatory Commission (NRC) in 1989, and upheld in court in 1992. The NRC 10 CFR Part 52 rule is a three-step process that guarantees public participation at each step. The steps are: early site permit approval; standard design certifications; and, combined construction/operating licenses for nuclear power reactors. Licensing reform increases an organization`s ability to respond to future baseload electricity generation needs with less financial risk for ratepayers and the organization. Costly delays can be avoided because design, safety and siting issues will be resolved before a company starts to build a plant. Specifically, early site permit approval allows for site suitability and acceptability issues to be addressed prior to an organization`s commitment to build a plant. Responsibility for site-specific activities, including communications and public participation, rests with those organizations selected to try out early site approval. This plan has been prepared to assist those companies (referred to as sponsoring organizations) in planning their communications and public involvement programs. It provides research findings, information and recommendations to be used by organizations as a resource and starting point in developing their own plans.

    The U.S. Nuclear Regulatory Commission (NRC) has received and is reviewing three applications for early site permits (ESPs). The ESP process allows early resolution of site-related issues affecting possible construction and operation of a new nuclear power plant. The nuclear industry views a successful and predictable ESP process as an important step in assessing whether to seek authorization to construct and operate a new generation of nuclear power reactors in the United States. Because consideration of ESP applications is a first-of-a-kind activity, a number of issues have emerged prior to and during the reviews of the first three applications. Issues have included the need for design information at the ESP stage, accident analyses, quality assurance, and seismic analyses. The NRC has been working to resolve identified issues to support a Commission decision on whether to issue an ESP approximately 33-37 months after receipt of each ESP application. (authors)

    The Economic Regulatory Administration (ERA) of the Department of Energy (DOE) is considering an application by Bradfield Electric, Inc. (Bradfield), and the Alaska Power Authority (APA) for a Presidential permit to construct, operate, maintain and connect a 69-kilovolt (kV) transmission line which would extend from the APA's Tyee Lake Hydroelectric Power Project located near Wrangell, Alaska, to a point on the US-Canadian international border just east of the South Fork Craig River. The DOE has reviewed an environmental assessment (EA) prepared by the US Forest Service (USFS) in connection with its issuance of a special use permit to construct the proposed line through the Tongass National Forest. Based on this EA, the USFS issued a decision notice and a finding of no significant impact (FONSI) for the proposed project on May 9, 1988. The DOE is adopting this EA as DOE/EA-0375 in partial satisfaction of its responsibilities under the National Environmental Policy Act of 1969 (NEPA) regarding the issuance of a Presidential permit.

    Now that most states have interim or full approval of the portions of their state implementation plans (SIPs) implementing Title V (40 CFR Part 70) of the Clean Air Act Amendments (CAAA), most sources which require a Title V permit have submitted or are well on the way to submitting a Title V operating permit application. Numerous hours have been spent preparing applications to ensure the administrative completeness of the application and operational flexibility for the facility. Although much time and effort has been spent on Title V permit applications, the operating permit itself is the final goal. This paper outlines the major Federal requirements for Title V permits as given in the CAAA at 40 CFR 70.6, Permit Content. These Federal requirements and how they will effect final Title V permits and facilities will be discussed. This paper will provide information concerning the Federal requirements for Title V permits and suggestions on how to negotiate a Title V permit to maximize operational flexibility and minimize enforcement liability.
