The U.S. Environmental Protection Agency (EPA) data indicates that the aggregate FE of vehicles produced for the U.S. market has improved by over 20% from model year (MY) 2005 to 2013. This steep climb in FE includes changes in vehicle choice, improvements in engine and transmission technology, and reducing aerodynamic drag, rolling resistance, and parasitic losses. The powertrain related improvements focus on optimizing in-use efficiency of the transmission and engine as a system, and may make use of what is termed downsizing and/or downspeeding. This study explores quantifying recent improvements in powertrain efficiency, viewed separately from other vehicle alterations and attributes (noting that most vehicle changes are not completely independent). A methodology is outlined to estimate powertrain efficiency for the U.S city and highway cycle tests using data from the EPA vehicle database. Comparisons of common conventional gasoline powertrains for similar MY 2005 and 2013 vehicles are presented, along with results for late-model hybrid electric vehicles, the Nissan Leaf, Chevy Volt and other selected vehicles.

    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    This report examines ozone, often called smog, which is a respiratory irritant, and long-term exposure may cause permanent lung damage. Attempts by EPA to reduce gasoline vapors, a major contributor to ozone, by requiring refiners to lower the volatility (evaporation rate) of gasoline sold during the summer months when most high ozone levels occur and auto manufacturers to install vapor recovery equipment (onboard controls) on motor vehicles. Beginning in 1989 (Phase I), the maximum volatility of gasoline sold during the summer would fall to 10.5 pounds per square inch and beginning in 1992 (Phase II), the maximum volatility would fall to 9.0 pounds per square inch. EPA has not yet acted on Phase II reductions because it disagrees with the Department of Transportation on the dangers of adding onboard controls to vehicles. DOT believes the onboard controls may pose an increased risk of fire during crashes. In this report's view, the Stage II controls are a practical and feasible way to control refueling vapors and that onboard controls may well surpass the effectiveness of Phase II controls and therefore should not be abandoned as a way to reduce gasoline vapors.

    This report focuses on the National Renewable Energy Laboratory's (NREL) fiscal year (FY) 2012 effort that used the NREL Optimal Vehicle Acquisition (NOVA) analysis to identify optimal vehicle acquisition recommendations for eleven diverse federal agencies. Results of the study show that by following a vehicle acquisition plan that maximizes the reduction in greenhouse gas (GHG) emissions, significant progress is also made toward the mandated complementary goals of acquiring alternative fuel vehicles, petroleum use reduction, and alternative fuel use increase.

    This paper reports that the relaxation of prohibitions on the use of propane as a motor fuel has spurred sizeable business activity in carburetion and higher demand for LPG throughout Mexico and particularly in Mexico City. However, a number of unforeseen problems have developed that required tough, immediate solutions. After the alternative fuels project began at city hall in Mexico City, publicity spread nationwide, reportedly spurring conversion activity in many other cities. That led to additional demand for fuel of a magnitude that few people had anticipated. In order to assume control of the situation, the national oil company, Pemex, established an official LPG Motor Fuel Department on June 1. Operating in conjunction with the Ministry of Industry, the new department has been busy registering every major propane-powered fleet in the country. Most important, the rate of conversion work must now be pegged to the availability of fuel. It is believed that conversion activity has become more evenly paced since the new Pemex agency took over.over.

    This paper reviews calculation tools available for quantifying the greenhouse gas emissions associated with different types of public transit service, and their usefulness in helping a transit agency to reduce its carbon footprint through informed vehicle and fuel procurement decisions. Available calculators fall into two categories: registry/inventory based calculators most suitable for standardized voluntary reporting, carbon trading, and regulatory compliance; and multi-modal life cycle analysis calculators that seek comprehensive coverage of all direct and indirect emissions. Despite significant progress in calculator development, no single calculator as yet contains all of the information needed by transit agencies to develop a truly comprehensive, life cycle analysis-based accounting of the emissions produced by its vehicle fleet operations, and for a wide range of vehicle/fuel technology options.

    Annex XIII on 'Fuel Cell Vehicles' of the Implementing Agreement Hybrid and Electric Vehicles of the International Energy Agency has been operating since 2006, complementing the ongoing activities on battery and hybrid electric vehicles within this group. This paper provides an overview of the Annex XIII final report for 2010, compiling an up-to-date, neutral, and comprehensive assessment of current trends in fuel cell vehicle technology and related policy. The technological description includes trends in system configuration as well as a review of the most relevant components including the fuel cell stack, batteries, and hydrogen storage. Results from fuel cell vehicle demonstration projects around the world and an overview of the successful implementation of fuel cells in specific transport niche markets will also be discussed. The final section of this report provides a detailed description of national research, development, and demonstration (RD&D) efforts worldwide.

    What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    In response to the Fuel Economy and Greenhouse Gas (GHG) emissions standards, automobile manufacturers will need to adopt new technologies to improve the fuel economy of their vehicles and to reduce the overall GHG emissions of their fleets. The U.S. Environmental Protection Agency (EPA) has developed the Optimization Model for reducing GHGs from Automobiles (OMEGA) to estimate the costs and benefits of meeting GHG emission standards through different technology packages. However, the model does not simulate the impact that increased technology costs will have on vehicle sales or on consumer surplus. As the model documentation states, “While OMEGA incorporates functions which generally minimize the cost of meeting a specified carbon dioxide (CO2) target, it is not an economic simulation model which adjusts vehicle sales in response to the cost of the technology added to each vehicle.” Changes in the mix of vehicles sold, caused by the costs and benefits of added fuel economy technologies, could make it easier or more difficult for manufacturers to meet fuel economy and emissions standards, and impacts on consumer surplus could raise the costs or augment the benefits of the standards. Because the OMEGA model does not presently estimate such impacts, the EPA is investigating the feasibility of developing an adjunct to the OMEGA model to make such estimates. This project is an effort to develop and test a candidate model. The project statement of work spells out the key functional requirements for the new model.

The National Highway Transportation Safety Administration (NHTSA) has been relying on technology data from a 2001 National Academy of Sciences (NAS) study (NAS 2001) on corporate average fuel economy (CAFE) standards, but the technology parameters were updated in the new proposed rulemaking (EPA and NHTSA 2009) to set CAFE and greenhouse gas standards for the 2011 to 2016 period. The update is based largely on an Environmental Protection Agency (EPA) analysis of technology attributes augmented by NHTSA data and contractor staff assessments. These technology cost and performance data were documented in the Draft Joint Technical Support Document (TSD) issued by EPA and NHTSA in September 2009 (EPA/NHTSA 2009). For these tasks, the Energy and Environmental Analysis (EEA) division of ICF International (ICF) examined each technology and technology package in the Draft TSD and assessed their costs and performance potential based on U.S. Department of Energy (DOE) program assessments.     The www.fueleconomy.gov website offers information such as window label fuel economy for city, highway, and combined driving for all U.S.-legal light-duty vehicles from 1984 to the present. The site is jointly maintained by the U.S. Department of Energy and the U.S. Environmental Protection Agency (EPA), and also offers a considerable amount of consumer information and advice pertaining to vehicle fuel economy and energy related issues. Included with advice pertaining to driving styles and habits is information concerning the trend that as highway cruising speed is increased, fuel economy will degrade. An effort was undertaken to quantify this conventional wisdom through analysis of dynamometer testing results for 74 vehicles at steady state speeds from 50 to 80 mph. Using this experimental data, several simple models were developed to predict individual vehicle fuel economy and its rate of change over the 50-80 mph speed range interval. The models presented require a minimal number of vehicle attributes. The simplest model requires only the EPA window label highway mpg value (based on the EPA specified estimation method for 2008 and beyond). The most complex of these simple model uses vehicle coast-down test coefficients (from testing prescribed by SAE Standard J2263) known as the vehicle Target Coefficients, and the raw fuel economy result from the federal highway test. Statistical comparisons of these models and discussions of their expected usefulness and limitations are offered.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

    In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate. Renewables include ethanol and its ether derivatives such as ethyl tertiary butyl ether (ETBE).     Response surface methodology (RSM) techniques were applied to develop a predictive model of electric vehicle (EV) energy consumption over the Environmental Protection Agency's (EPA) standardized drive cycles. The model is based on measurements from a synthetic composite drive cycle. The synthetic drive cycle is a minimized statistical composite of the standardized urban (UDDS), highway (HWFET), and US06 cycles. The composite synthetic drive cycle is 20 minutes in length thereby reducing testing time of the three standard EPA cycles by over 55%. Vehicle speed and acceleration were used as model inputs for a third order least squared regression model predicting vehicle battery power output as a function of the drive cycle. The approach reduced three cycles and 46 minutes of drive time to a single test of 20 minutes. Application of response surface modeling to the synthetic drive cycle is shown to predict energy consumption of the three EPA cycles within 2.6% of the actual measured values. Additionally, the response model may be used to predict energy consumption of any cycle within the speed/acceleration envelope of the synthetic cycle. This technique results in reducing test time, which additionally provides a model that may be used to expand the analysis and understanding of the vehicle under consideration.

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions

    A major driving force for change in light-duty vehicle design and technology is the National Highway Traffic Safety Administration (NHTSA) and the U.S. Environmental Protection Agency (EPA) joint final rules concerning Corporate Average Fuel Economy (CAFE) and greenhouse gas (GHG) emissions for model years (MY) 2016 through 2025 passenger cars and light trucks. The chief goal of this current study is to compare the already rapid pace of fuel economy improvement and technological change over the previous decade to the needed rate of change to meet regulations over the next decade. EPA and NHTSA comparisons of the MY 2004 US light-duty vehicle fleet to the MY 2014 fleet shows improved fuel economy (FE) of approximately 28% using the same FE estimating method mandated for CAFE regulations. Future predictions by EPA and NHTSA concerning ensemble fleet fuel economy are examined as an indicator of needed vehicle rate-of-change. A set of 40 same-model vehicle pairs for MY 2005 and MY 2015 is compared to examine changes in energy use and related technological change over the 10 year period. Powertrain improvements measured as increased vehicle efficiency, and vehicle mass-glider improvements measured as decreased tractive work requirements are quantified. The focus is first on conventional gasoline powertrain vehicles which currently dominate the market, with hybrids also examined due to their high potential importance for CAFE compliance. Most hybrid vehicles with significant sales in 2014 were represented in the study. Results show 10 years of progress for the studied vehicle set includes lowered tractive effort of about 5.6% and improved powertrain efficiency of about 16.5%. Further analysis shows that this high rate of past progress must increase by about 50% in order to meet the 2025 CAFE standards.     The US Environmental Protection Agency is proposing a regulation for the protection of the public and radioactive contamination at sites that are to be cleaned up and released for public use. The rule will apply to sites under the control of Federal agencies, and will impose limits on radiation doses to individuals living or working on a site following cleanup; it will thereby provide site owners and managers with uniform, consistent cleanup criteria for planning and carrying out remediation. This paper presents an overview of EPA`s approach to assessing some of the beneficial and adverse effects associated with various possible values for the annual dose limit. In particular, it discusses the method developed to determine how the choice of cleanup criterion affects (1) the time-integrated potential numbers of non-fatal and fatal radiogenic cancers averted among future populations, (2) the occurrence of radiogenic cancers among remediation workers and the public caused by the cleanup process itself, and (3) the volumes of contaminated soil that may require remediation. The analytic methods described here were used to provide input data and assumptions for the Regulatory Impact Analysis (RIA) that supports the proposed regulation; the RIA also considered non-radiological benefits and costs (i.e., public health, economic, and ecological) of the standards. 56 refs., 4 figs., 6 tabs.

    The Ozone Transport Commission`s (OTC) Nitrogen Oxides (NO{sub x}) Budget Program will implement the emissions reduction goal of the 1994 Memorandum of Understanding between its twelve member states and the District of Columbia. The program will achieve its significant NO{sub x} reductions from electric utilities and industrial boilers using a {open_quotes}cap-and-trade{close_quotes} approach modeled after the US Environmental Protection Agency`s sulfur dioxide emissions trading under the Acid Rain Program. The similarity of the two programs has led to the development of an important partnership between the OTC states and EPA`s Acid Rain Division, Over the past two years, Acid Rain Program staff have shared their technical expertise and assisted extensively in the development of the program`s rules. Leveraging the investment EPA made in the systems used to run the Acid Rain Program, the OTC states have asked the Acid Rain Division to administer the data systems for them, and together are working to expand its existing Emissions Tracking System and to modify a clone of the sulfur dioxide Allowance Tracking System, to fulfill the unique requirements of the NO{sub x} Budget Program. This partnership is an important example of the new type of cooperation and sharing of expertise and resources that should develop between EPA and states as they launch multi-state programs to address regional pollution problems that defy a single-state solution.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

This report covers the exhaust emissions testing of 15 light-duty vehicles with 27 E0 through E20 test fuels, and 4 light-duty flexible fuel vehicles (FFVs) on an E85 fuel, as part of the EPAct Gasoline Light-Duty Exhaust Fuel Effects Test Program. This program will also be referred to as the EPAct/V2/E-89 Program based on the designations used for it by the EPA, NREL, and CRC, respectively.     On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

    The U.S. Department of Energy (DOE) Office of Energy Efficiency and Renewable Energy and the U.S. Environmental Protection Agency (EPA) jointly maintain a fuel economy website (www.fueleconomy.gov), which helps fulfill their responsibility under the Energy Policy Act of 1992 to provide accurate fuel economy information [in miles per gallon (mpg)] to consumers. The site provides information on EPA fuel economy ratings for passenger cars and light trucks from 1985 to the present and other relevant information related to energy use such as alternative fuels and driving and vehicle maintenance tips. In recent years, fluctuations in the price of crude oil and corresponding fluctuations in the price of gasoline and diesel fuels have renewed interest in vehicle fuel economy in the United States. (User sessions on the fuel economy website exceeded 20 million in 2008 compared to less than 5 million in 2004 and less than 1 million in 2001.) As a result of this renewed interest and the age of some of the references cited in the tips section of the website, DOE authorized the Oak Ridge National Laboratory (ORNL) Fuels, Engines, and Emissions Research Center (FEERC) to initiate studies to validate and improve these tips. This report documents a study aimed specifically at the effect of engine air filter condition on fuel economy. The goal of this study was to explore the effects of a clogged air filter on the fuel economy of vehicles operating over prescribed test cycles. Three newer vehicles (a 2007 Buick Lucerne, a 2006 Dodge Charger, and a 2003 Toyota Camry) and an older carbureted vehicle were tested. Results show that clogging the air filter has no significant effect on the fuel economy of the newer vehicles (all fuel injected with closed-loop control and one equipped with MDS).     Air quality administrators across the nation are coming under greater pressure to find new strategies for further reducing automotive generated non-methane hydrocarbon (NMHC) and nitrogen oxide (NOx) emissions. The US Environmental Protection Agency (EPA) has established stringent emission reduction requirements for ozone non-attainment areas that have driven the vehicle industry to engineer vehicles meeting dramatically tightened standards. This paper describes an interim method for including alternative-fueled vehicles (AFVs) in the mix of strategies to achieve local and regional improvements in ozone air quality. This method could be used until EPA can develop the Mobile series of emissions estimation models to include AFVs and until such time that detailed work on AFV emissions totals by air quality planners and emissions inventory builders is warranted. The paper first describes the challenges confronting almost every effort to include AFVs in targeted emissions reduction programs, but points out that within these challenges resides an opportunity. Next, it discusses some basic relationships in the formation of ambient ozone from precursor emissions. It then describes several of the salient provisions of EPA`s new voluntary emissions initiative, which is called the Voluntary Mobile Source Emissions Reduction Program (VMEP). Recent emissions test data comparing gaseous-fuel light-duty AFVs with their gasoline-fueled counterparts is examined to estimate percent emissions reductions achievable with CNG and LPG vehicles. Examples of calculated MOBILE5b emission rates that would be used for summer ozone season planning purposes by an individual Air Quality Control Region (AQCR) are provided. A method is suggested for employing these data to compute appropriate voluntary emission reduction credits where such (lighter) AFVs would be acquired.     A major driving force for change in light-duty vehicle design and technology is the National Highway Traffic Safety Administration (NHTSA) and the U.S. Environmental Protection Agency (EPA) joint final rules concerning Corporate Average Fuel Economy (CAFE) and greenhouse gas (GHG) emissions for model years (MY) 2016 through 2025 passenger cars and light trucks. The chief goal of this current study is to compare the already rapid pace of fuel economy improvement and technological change over the previous decade to the needed rate of change to meet regulations over the next decade. EPA and NHTSA comparisons of the MY 2004 USmore » light-duty vehicle fleet to the MY 2014 fleet shows improved fuel economy (FE) of approximately 28% using the same FE estimating method mandated for CAFE regulations. Future predictions by EPA and NHTSA concerning ensemble fleet fuel economy are examined as an indicator of needed vehicle rate-of-change. A set of 40 same-model vehicle pairs for MY 2005 and MY 2015 is compared to examine changes in energy use and related technological change over the 10 year period. Powertrain improvements measured as increased vehicle efficiency, and vehicle mass-glider improvements measured as decreased tractive work requirements are quantified. The focus is first on conventional gasoline powertrain vehicles which currently dominate the market, with hybrids also examined due to their high potential importance for CAFE compliance. Most hybrid vehicles with significant sales in 2014 were represented in the study. Results show 10 years of progress for the studied vehicle set includes lowered tractive effort of about 5.6% and improved powertrain efficiency of about 16.5%. Further analysis shows that this high rate of past progress must increase by about 50% in order to meet the 2025 CAFE standards.   15. Fuel Economy and Emissions of a Vehicle Equipped with an Aftermarket Flexible-Fuel Conversion Kit

    The U.S. Environmental Protection Agency (EPA) grants Certificates of Conformity for alternative fuel conversion systems and also offers other forms of premarket registration of conversion kits for use in vehicles more than two model years old. Use of alternative fuels such as ethanol, natural gas, and propane are encouraged by the Energy Policy Act of 1992. Several original equipment manufacturers (OEMs) produce emissions-certified vehicles capable of using alternative fuels, and several alternative fuel conversion system manufacturers produce EPA-approved conversion systems for a variety of alternative fuels and vehicle types. To date, only one manufacturer (Flex Fuel U.S.) has received EPA certifications for ethanol fuel (E85) conversion kits. This report details an independent evaluation of a vehicle with a legal installation of a Flex Fuel U.S. conversion kit. A 2006 Dodge Charger was baseline tested with ethanol-free certification gasoline (E0) and E20 (gasoline with 20 vol % ethanol), converted to flex-fuel operation via installation of a Flex Box Smart Kit from Flex Fuel U.S., and retested with E0, E20, E50, and E81. Test cycles included the Federal Test Procedure (FTP or city cycle), the highway fuel economy test (HFET), and the US06 test (aggressive driving test). Averaged test results show that the vehicle was emissions compliant on E0 in the OEM condition (before conversion) and compliant on all test fuels after conversion. Average nitrogen oxide (NOx) emissions exceeded the Tier 2/Bin 5 intermediate life NO{sub X} standard with E20 fuel in the OEM condition due to two of three test results exceeding this standard [note that E20 is not a legal fuel for non-flexible-fuel vehicles (non-FFVs)]. In addition, one E0 test result before conversion and one E20 test result after conversion exceeded the NOX standard, although the average result in these two cases was below the standard.     This research project evaluates fuel consumption results of two Class 8 tractor-trailer combinations platooned together compared to their standalone fuel consumption. A series of ten modified SAE Type II J1321 fuel consumption track tests were performed to document fuel consumption of two platooned vehicles and a control vehicle at varying steady-state speeds, following distances, and gross vehicle weights (GVWs). The steady-state speeds ranged from 55 mph to 70 mph, the following distances ranged from a 20-ft following distance to a 75-ft following distance, and the GVWs were 65K lbs and 80K lbs. All tractors involved had U.S. Environmental Protection Agency (EPA) SmartWay-compliant aerodynamics packages installed, and the trailers were equipped with side skirts. Effects of vehicle speed, following distance, and GVW on fuel consumption were observed and analyzed. The platooning demonstration system used in this study consisted of radar systems, Dedicated Short-Range Communication (DSRC) vehicle-to-vehicle (V2V) communications, vehicle braking and torque control interface, cameras and driver displays. The lead tractor consistently demonstrated an improvement in average fuel consumption reduction as following distance decreased, with results showing 2.7% to 5.3% fuel savings at a GVW of 65k. The trailing vehicle achieved fuel consumption savings ranging from 2.8% to 9.7%; tests during which the engine cooling fan did not operate achieved savings of 8.4% to 9.7%. 'Team' fuel savings, considering the platooned vehicles as one, ranged from 3.7% to 6.4%, with the best combined result being for 55 mph, 30-ft following distance, and 65k GVW.

    As the nature and extent of radiological contamination becomes better documented and more public, radioanalytical laboratories are faced with a constantly expanding variety of new and difficult analytical requirements. Concurrent with those requirements is the responsibility to provide customers, regulatory officials, or the public with defensible data produced in an environment of verifiable, controlled quality. To meet that need, a quality assurance accreditation program for radioassay laboratories has been proposed by the American National Standards Institute (ANSI). The standard will provide the organizational framework and functional requirements needed to assure the quality of laboratory outputs. Under the proposed program, the U.S. Environmental Protection Agency`s (EPA`s) Laboratory Intercomparison Program plays a key role as a reference laboratory. The current and proposed roles of the EPA Intercomparison Program are discussed, as are the functional relationships between EPA, the accreditating organization, and the service and monitoring laboratories.

    With the coming liberalization of trade and industry within the European Community (EC) and a more centrally-coordinated EC external trade policy, it is timely to ask if in the 1990s there will be any significant changes in the commercial relations between the EC and non-EC companies trading in nuclear fuel. The key vehicle for implementing any change of policy would probably be the European Atomic Energy Community (EURATOM) Supply Agency in Brussels, which is charged under the EURATOM Treaty with overseeing the equitable supply of nuclear fuel to and among EC companies. The EURATOM Supply Agency (the Agency) is a signatory to almost all EC-company contracts for transactions that occur on the territory of the Community, which includes Belgium, Denmark, France, the Federal Republic of Germany (FRG), Great Britain, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, and Spain. During the 1980s, the Supply Agency has rarely tried to influence the commercial decisions of EC member companies. The nuclear fuel industry has largely perceived the Agency as an administrative office that registers contracts and maintains relations with some outside governments, particularly Australia, Canada, and the USA. However, in 1988 the Agency began to have a more direct commercial impact when it reviewed the practice-previously conducted routinely by the EURATOM Safeguards Directorate in Luxembourg at the request of EC-member companies-of swapping safeguards obligations on equivalent quantities of uranium at different locations (flag swapping). The Agency`s actions inhibiting flag swaps, as well as a related de facto policy restricting material swaps of Southern African uranium, caused it to be viewed as obstructive by some EC companies. During 1989 the discussion about flag swaps and swaps involving South African and Namibian uranium has subsided, and a far-reaching discussion has arisen about EC trade policy in general.

    The Environmental Protection Agency's (EPA) Region 5 Chicago Regional Laboratory (CRL) developed a method titled Analysis of Diisopropyl Methylphosphonate, Ethyl Hydrogen Dimethylamidophosphate, Isopropyl Methylphosphonic Acid, Methylphosphonic Acid, and Pinacolyl Methylphosphonic Acid in Water by Multiple Reaction Monitoring Liquid Chromatography/Tandem Mass Spectrometry: EPA Version MS999. This draft standard operating procedure (SOP) was distributed to multiple EPA laboratories and to Lawrence Livermore National Laboratory, which was tasked to serve as a reference laboratory for EPA's Environmental Reference Laboratory Network (ERLN) and to develop and validate analytical procedures. The primary objective of this study was to validate and verify the analytical procedures described in EPA Method MS999 for analysis of the listed phosphonic acids and surrogates in aqueous samples. The gathered data from this validation study will be used to: (1) demonstrate analytical method performance; (2) generate quality control acceptance criteria; and (3) revise the SOP to provide a validated method that would be available for use during a homeland security event. The data contained in this report will be compiled, by EPA CRL, with data generated by other EPA Regional laboratories so that performance metrics of EPA Method MS999 can be determined.

    This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. Only RODs from landfill sites were evaluated so that the results of the analysis can be used to support the remedy selection process for the Sanitary Landfill at the Savannah River Site (SRS).

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation. Both the CVPs Monitoring Path and Stipulated Path procedures are summarized and reviewed. Several examples are provided to illustrate how to calculate DSM program energy savings using the CVPSs.

    The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

    This Record of Decision (ROD) Amendment documents the U.S. Environmental Protection Agency`s (EPA`s) selection of a modified remedy for the Renora, Inc. site. The initial ROD for the Renora site included the excavation and off-site disposal of soils contaminated with polychlorinated biphenyls, (PCBs) and biodegradation of PAH-contaminated soils. The first phase of the remedy, involving the PCB-contaminated soils, has been completed. Therefore, the remedy will be modified to include the removal of surface soils contaminated with PAHs.

    The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'. The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits.     This report summarizes research performed at Sandia National Laboratories (SNL) in collaboration with the Environmental Protection Agency (EPA) to assess microarray quality on arrays from two platforms of interest to the EPA. Custom microarrays from two novel, commercially produced array platforms were imaged with SNL's unique hyperspectral imaging technology and multivariate data analysis was performed to investigate sources of emission on the arrays. No extraneous sources of emission were evident in any of the array areas scanned. This led to the conclusions that either of these array platforms could produce high quality, reliable microarray data for the EPA toxicology programs. Hyperspectral imaging results are presented and recommendations for microarray analyses using these platforms are detailed within the report.

    Quiet, clean, and efficient, electric vehicles (EVs) may someday become a practical mode of transportation for the general public. Electric vehicles can provide many advantages for the nation's environment and energy supply because they run on electricity, which can be produced from many sources of energy such as coal, natural gas, uranium, and hydropower. These vehicles offer fuel versatility to the transportation sector, which depends almost solely on oil for its energy needs. Electric vehicles are any mode of transportation operated by a motor that receives electricity from a battery or fuel cell. EVs come in all shapes and sizes and may be used for different tasks. Some EVs are small and simple, such as golf carts and electric wheel chairs. Others are larger and more complex, such as automobile and vans. Some EVs, such as fork lifts, are used in industries. In this fact sheet, we will discuss mostly automobiles and vans. There are also variations on electric vehicles, such as hybrid vehicles and solar-powered vehicles. Hybrid vehicles use electricity as their primary source of energy, however, they also use a backup source of energy, such as gasoline, methanol or ethanol. Solar-powered vehicles are electric vehicles that use photovoltaic cells (cells that convert solar energy to electricity) rather than utility-supplied electricity to recharge the batteries. This paper discusses these concepts.

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

EPA has historically mandated an emissions certification fuel specification that calls for ethanol-free fuel, except for the certification of flex-fuel vehicles. However, since the U.S. gasoline marketplace is now virtually saturated with E10, some organizations have suggested that inclusion of ethanol in emissions certification fuels would be appropriate. The test methodologies and calculations contained in the Code of Federal Regulations for gasoline-fueled vehicles have been developed with the presumption that the certification fuel does not contain ethanol; thus, a number of technical issues would require resolution before such a change could be accomplished. This report makes use of the considerable data gathered during the mid-level blends testing program to investigate one such issue: estimation of non-methane organic gas (NMOG) emissions. The data reported in this paper were gathered from over 600 cold-start Federal Test Procedure (FTP) tests conducted on 68 vehicles representing 21 models from model year 2000 to 2009. Most of the vehicles were certified to the Tier-2 emissions standard, but several older Tier-1 and national low emissions vehicle program (NLEV) vehicles were also included in the study. Exhaust speciation shows that ethanol, acetaldehyde, and formaldehyde dominate the oxygenated species emissions when ethanol is blended into the test fuel.     The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

    There are various kinds of autonomous vehicles (AV`s) which can operate with varying levels of autonomy. This paper is concerned with underwater, ground, and aerial vehicles operating in a fully autonomous (nonteleoperated) mode. Further, this paper deals with AV`s as a special kind of device, rather than full-scale manned vehicles operating unmanned. The distinction is one in which the AV is likely to be designed for autonomous operation rather than being adapted for it as would be the case for manned vehicles. The authors provide a survey of the technological progress that has been made in AV`s, the current research issues and approaches that are continuing that progress, and the applications which motivate this work. It should be noted that issues of control are pervasive regardless of the kind of AV being considered, but that there are special considerations in the design and operation of AV`s depending on whether the focus is on vehicles underwater, on the ground, or in the air. The authors have separated the discussion into sections treating each of these categories.

    As part of a project for the Defense Advanced Research Projects Agency, Sandia National Laboratories is developing and testing the feasibility of using of a cooperative team of robotic sentry vehicles to guard a perimeter and to perform surround and diversion tasks. This paper describes on-going activities in the development of these robotic sentry vehicles. To date, we have developed a robotic perimeter detection system which consists of eight ''Roving All Terrain Lunar Explorer Rover'' (RATLER{trademark}) vehicles, a laptop-based base-station, and several Miniature Intrusion Detection Sensors (MIDS). A radio frequency receiver on each of the RATLER vehicles alerts the sentry vehicles of alarms from the hidden MIDS. When an alarm is received, each vehicle decides whether it should investigate the alarm based on the proximity of itself and the other vehicles to the alarm. As one vehicle attends an alarm, the other vehicles adjust their position around the perimeter to better prepare for another alarm. We have also demonstrated the ability to drive multiple vehicles in formation via tele-operation or by waypoint GPS navigation. This is currently being extended to include mission planning capabilities. At the base-station, the operator can draw on an aerial map the goal regions to be surrounded and the repulsive regions to be avoided. A potential field path planner automatically generates a path from the vehicles' current position to the goal regions while avoiding the repulsive regions and the other vehicles. This path is previewed to the operator before the regions are downloaded to the vehicles. The same potential field path planner resides on the vehicle, except additional repulsive forces from on-board proximity sensors guide the vehicle away from unplanned obstacles.

    The Environmental Protection Agency of the State of Illinois (Illinois EPA) has programs in water, air, and land pollution and water supplies paralleling those of the US Environmental Protection Agency (EPA). The organization is part of a tripartite arrangement in which the Pollution Control Board is the judicial arm, the Department of Energy and Natural Resources is the research arm, and the Illinois EPA is the enforcement arm. Other state agencies are also concerned with various aspects of the environment and may do risk assessments for chemicals.     The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE's position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

  9. The process of consensus on EMF: SAB review of the EPA draft document on EMF and cancer

    The EPA Draft Document on EMF and Cancers grew out of an earlier effort by EPA to track biological effects literature relative to radio-frequency (RF) exposure. Scope of the document was broadened to include extremely low frequency electric and magnetic fields prior to an announcement in 1986 that EPA would formally review the whole area of non-ionizing radiation. An extensive survey of the relevant bioeffects and epidemiologic literature was carried out, and writing on the document began in earnest on the document sometime in 1989. In its draft form, the document reviewed the literature on mechanisms of Interaction between electromagnetic fields and biological tissue, EMF epidemiologic studies, supporting evidence for carcinogenicity and research needs. In the early summer of 1990, a draft of the document was reviewed by some 22 individuals within the EPA and other government agencies. It was also sent out for external review to an additional 9 qualified scientists who had worked in the area and were familiar with EMF-related literature in epidemiology, biology, and physics. Many of the comments sent to EPA from this first review, prior to release of the draft for public comment, were strikingly similar to those resulting from the second (public) review process. Thus, it appears that much of the controversy that was later associated with the document could have been avoided had the authors been diligent in following the recommendations of the initial set of reviewers.

    The U.S. Environmental Protection Agency (EPA) is inviting participants to a stakeholder call to gather input and ideas about the Clean Energy Incentive Program (CEIP), a Clean Power Plan program designed to provide additional incentives for early investments in zero-emitting wind or solar power projects as well as in energy efficiency measures in low-income communities. This call will focus on hearing ideas and input from groups that have a general interest in CEIP projects, such as environmental justice groups, community groups, local governments, tribes, and environmental non-governmental organizations.

    This report describes the work performed by TRI/Environmental, Inc. (TRI) to determine the chemical compatibility of one geomembrane and one seamed geomembrane with four synthetically generated leachates. The objective was to determine the resistance of the geomembrane to changes caused by exposure to the leachates. Changes in physical and mechanical properties were measured after exposure to the leachates at 23 C and 50 C for 30, 60, 90 and 120 days. Exposures were performed in accordance with the exposure regimen specified in US Environmental Protection Agency (EPA) Method 9090A. Methods, results and discussion are provided. Test results are also provided in the Tables of Results which accompany this report.

    The THINK city Electric Vehicle (EV) Demonstration Program Project, initiated late 2001, has been successfully completed as of April 2005. US. Partners include Federal, State and Municipal agencies as well as commercial partners. Phase I, consisting of placement of the vehicles in demonstration programs, was completed in 2002. Phase II, the monitoring of these programs was completed in 2004. Phase III, the decommissioning and/or exporting of vehicles concluded in 2005. Phase I--the Program successfully assigned 192 EV's with customers (including Hertz) in the state of California, 109 in New York (including loaner and demo vehicles), 16 in Georgia, 7 to customers outside of the US and 52 in Ford's internal operations in Dearborn Michigan for a total of 376 vehicles. The Program was the largest operating Urban EV Demonstration Project in the United States. Phase II--the monitoring of the operational fleet was ongoing and completed in 2004, and all vehicles were returned throughout 2004 and 2005. The Department of Energy (DOE) was involved with the monitoring of the New York Power Authority/THINK Clean Commute Program units through partnership with Electric Transportation Engineering Corporation (ETEC), which filed separate reports to DOE. The remainder of the field fleet was monitored through Ford's internal operations. Vehicles were retired from lease operation throughout the program for various operator reasons. Some of the vehicles were involved in re-leasing operations. At the end of the program, 376 vehicles had been involved, 372 of which were available for customer use while 4 were engineering prototype and study vehicles. Phase III--decommissioning and/or export of vehicles. In accordance with the NHTSA requirement, City vehicles could not remain in the United States past their three-year allowed program timeframe. At the end of leases, City vehicles have been decommissioned and/or exported to KamKorp in Norway.

    As part of the 1990 Clean Air Act Amendments, major facilities are required to obtain federally enforceable operating permits (Title V). In a separate permitting action, the electric utilities with units generating more then 25 megawatts are required to obtain permits for NO{sub x} and SO{sub x}, the emissions which contribute to acid rain (Title IV). The Title IV permit is included as part of the Title V permit. This paper will use an actual audit experience at a coal fired generation facility as a case study for the preparation for and outcome of an EPA Title IV Level 3 audit. The paper will document the procedures for preparation, the audit process, and the outcome. The audit is part of the EPA's process for review of the record keeping and instrument calibration methods outlined in Title IV. Both types of permits have many different record keeping and monitoring requirements as well as separate reporting requirements which are submitted to both federal; state and local regulatory agencies for review and evaluation. Title IV units include very specific instrument calibration/audit requirements, and Title V has compliance testing and monitoring requirements. Alliant Power was notified in August 1998 of the intent of EPA Region VII to conduct a Level 3 audit at the Lansing Generation Station. The US EPA and the State of Iowa intended to review all Title IV record keeping (Level 1), continuous emission monitoring calibrations and linearity testing (Level 2) and observe the annual Relative Accuracy Testing Audit performed by an outside contractor. In addition, during this facility site visit, the compliance with Title V permit requirements was also audited.

    The Native American multimedia program was developed to facilitate the U.S. Environmental Protection Agency`s (EPA`s) partnership with tribes in the delivery of environmental programs on reservation lands and to enhance the EPA`s ability to carry out its trust responsibility to the tribes. By providing the means for each tribe to employ its own environmental specialist, the multimedia program helps provide the foundation necessary to build environmental infrastructure for the protection of Native American lands and people and for the development of more rigorous medium-specific programs. The multimedia program began in 1991 with two pilot projects on the Bad River Chippewa Reservation, Wisconsin, and the Wind River Reservation, Wyoming. Expanded in 1992, Region 5 awarded ten multimedia cooperative agreements. At the time, Region 5 made the commitment to fund all reservations within the region, and by end of fiscal year 1993, 24 agreements brought the program to all 29 tribes. This has been a monumental effort, possible only by coupling fiscal year 1993`s funding from the Office of Federal Activities ($599050) with the region`s own reprogramming efforts ($510000).

    ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    With the advent and encouragement of recent initiatives by EPA and state environmental regulators for the development and use by business entities of voluntary environmental compliance and audit programs has come an increased concern over the potential for criminal prosecution of individuals charged with the responsibility for ensuring environmental compliance. With the EPA avoiding the issue of whether audit findings will be used as evidence in a joint civil and criminal investigation (i.e., multi-media inspection), a sense of heightened concern has been prevalent in the regulated community. This paper will address the use of audit methodologies that incorporate law enforcement/criminal investigatory techniques as well as suggested attorney-client reporting structure that should be applied in auditing in order to prevent/mitigate the potential for criminal enforcement actions. The goals of the paper are to enable both corporate compliance managers and environmental auditors to be aware of the potential pitfalls and/or liabilities associated with compliance audit findings. Additionally, to educate auditors on when and how to take further steps, through the use of investigatory interviewing techniques, in order to develop answers to questionable data and/or confirm findings of the environmental audit to avoid civil and criminal penalties. The goals of an environment audit should be to avoid both civil and criminal prosecution through the advanced identification of liabilities and the subsequent development of protocols to achieve compliance. However, oftentimes the use of a pre-established {open_quotes}checklist.
