  1. The preparation for and survival of an EPA Title IV and Title V facility audit

    As part of the 1990 Clean Air Act Amendments, major facilities are required to obtain federally enforceable operating permits (Title V). In a separate permitting action, the electric utilities with units generating more then 25 megawatts are required to obtain permits for NO{sub x} and SO{sub x}, the emissions which contribute to acid rain (Title IV). The Title IV permit is included as part of the Title V permit. This paper will use an actual audit experience at a coal fired generation facility as a case study for the preparation for and outcome of an EPA Title IV Level 3 audit. The paper will document the procedures for preparation, the audit process, and the outcome. The audit is part of the EPA's process for review of the record keeping and instrument calibration methods outlined in Title IV. Both types of permits have many different record keeping and monitoring requirements as well as separate reporting requirements which are submitted to both federal; state and local regulatory agencies for review and evaluation. Title IV units include very specific instrument calibration/audit requirements, and Title V has compliance testing and monitoring requirements. Alliant Power was notified in August 1998 of the intent of EPA Region VII to conduct a Level 3 audit at the Lansing Generation Station. The US EPA and the State of Iowa intended to review all Title IV record keeping (Level 1), continuous emission monitoring calibrations and linearity testing (Level 2) and observe the annual Relative Accuracy Testing Audit performed by an outside contractor. In addition, during this facility site visit, the compliance with Title V permit requirements was also audited.

    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    This paper provides an overview of regulatory issues under Title III of the Clean Air Act Amendments that could affect electric utilities. Title III contains provisions relating to hazardous air pollutants (HAPs) and provides special treatment for electric utilities. Generally, this discussion documents that if utility toxic emissions are regulated, one of the chief difficulties confronting utilities will be the lack of coordination between Title III and other titles of the Act. The paper concludes that if the US Environmental Protection Agency (EPA) determines that regulation of utility HAPs is warranted under Title III, savings can be realized from flexible compliance treatment.

    Integrating title IV acid rain and title V operating permits in an efficient manner poses numerous challenges. Federal rules and policy memos about these programs often conflict or lead to actions that are difficult to implement at best. Both permitting programs are complex and controversial, but the title IV permitting rules are particularly difficult to use and understand. Clear lines of jurisdiction for various aspects of the acid rain program are lacking in some cases, and regulators have been slow to recognize and solve these problems. There are numerous issues that have arisen during the initial stages of developing permits for title IV affected sources. Some have or are being resolved; others remain as potential impediments to efficient permitting. Utah and other western states have been working with the utility industry and US Environmental Protection Agency (EPA) to resolve these and other issues and some problems have been resolved. However, some state and industry officials feel that EPA should take the lead to conduct a series title IV implementation workshops in partnership with states and the utilities. This paper describes solutions to some common implementation problems and identifies challenges that remain to be solved.

    Title 5 of the 1990 Clean Air Act Amendments (CAAA) establishes a massive new operating permit program, which will be administered by state agencies in accordance with federal guidelines. Formal requirements regarding operating-permits were promulgated by the US Environmental Protection Agency (EPA) on July 21, 1992 (40 CFR 70). The Title 5 program will require many chemical manufacturing facilities to apply for and obtain operating permits that address air emissions from the entire facility. A major impact of the Title 5 program is that facilities will now be required to implement measures to routinely demonstrate that they are operating in compliance with the terms of the permit. Otherwise, facilities will be considered out of compliance. Once the new permits are in place, the burden will be on the facility to prove routine compliance to prevent any enforcement action. According to EPA, the new permits are not intended to impose any new regulatory requirements on a facility. Rather, they will serve as an enforcement tool.

    The US Environmental Protection Agency (EPA) Conservation Verification Protocols (CVPs) are a set of step-by-step procedures for impact monitoring and evaluation of electric utility demand-side management (DSM) programs. The EPA developed these protocols as part of its mission to implement the Acid Rain Program authorized by Title IV of the Clean Air Amendments of 1990. This report provides an overview of the CVPs and how they can be used by electric utilities in DSM program monitoring and evaluation. Both the CVPs Monitoring Path and Stipulated Path procedures are summarized and reviewed. Several examples are provided to illustrate how to calculate DSM program energy savings using the CVPSs.

    The Environmental Protection Agency's (EPA) Region 5 Chicago Regional Laboratory (CRL) developed a method titled Analysis of Diisopropyl Methylphosphonate, Ethyl Hydrogen Dimethylamidophosphate, Isopropyl Methylphosphonic Acid, Methylphosphonic Acid, and Pinacolyl Methylphosphonic Acid in Water by Multiple Reaction Monitoring Liquid Chromatography/Tandem Mass Spectrometry: EPA Version MS999. This draft standard operating procedure (SOP) was distributed to multiple EPA laboratories and to Lawrence Livermore National Laboratory, which was tasked to serve as a reference laboratory for EPA's Environmental Reference Laboratory Network (ERLN) and to develop and validate analytical procedures. The primary objective of this study was to validate and verify the analytical procedures described in EPA Method MS999 for analysis of the listed phosphonic acids and surrogates in aqueous samples. The gathered data from this validation study will be used to: (1) demonstrate analytical method performance; (2) generate quality control acceptance criteria; and (3) revise the SOP to provide a validated method that would be available for use during a homeland security event. The data contained in this report will be compiled, by EPA CRL, with data generated by other EPA Regional laboratories so that performance metrics of EPA Method MS999 can be determined.

    What the EPA, working jointly with the states, hopes to accomplish over the next ten years in order to integrate and coordinate all the groundwater programs within the agency is discussed. Although many other EPA programs such as Superfund, Clean Air Act, and Wetlands Management are often highlighted in the media, EPA does not down rate the importance of groundwater protection. Indeed as a resource, it is one of the most important commodities. Groundwater is the basis for life in this country. Recharge rates are no where near what the withdrawal rates are in many areas of the country. Twenty-five percent of all the potable water comes from groundwater. Groundwater supplies 50 percent of the needs for all the US population. If you include strictly rural areas, it supplies 95 percent of all the use. Something that most people who are not groundwater hydrologists would not think about is the fact that groundwater is a recharge mechanism that provides over 30 percent of the flow in streams and major rivers.

    The Title I groundwater standards for inactive uranium mill tailings sites, which were promulgated on January 5, 1983, by the US Environmental Protection Agency (EPA) for the Uranium Mill Tailings Remedial Action (UMTRA) Project, were remanded to the EPA on September 3, 1985, by the US Tenth Circuit Court of Appeals. The Court instructed the EPA to compile general groundwater standards for all sites. On September 24, 1987, the EPA published proposed standards in response to the remand. This Summary Report includes an evaluation of the potential effects of the proposed EPA groundwater standards on the UMTRA Project as well as a discussion of the DOE`s position on the proposed standards. This report is accompanied by a detailed Technical Report and Appendices which provide supporting information and analyses. This Summary Report results from a study undertaken to: determine the impact of the proposed standards on the UMTRA Project; and recommend provisions for the implementation of the final standards that will minimize adverse impact to the conduct of the UMTRA Project while ensuring protection of human health and the environment. Specifically, the following were considered: the flexibility of the proposed standards; interpretations of the proposed standards; the extent of aquifer restoration that may be required to implement the proposed standards at each site; the costs of aquifer restoration; and design changes necessary to meet the standards.

  11. Title I implementation: Status report on nonattainment areas

    Key provisions of Title I of the Clean Air Act Amendments of 1990 (CAAA) focus on bringing cities and other areas into attainment of the National Ambient Air Quality Standards for ozone, carbon monoxide (CO), and fine particulates (PM-10). The CAAA`s new classification scheme for pollutant nonattainment areas is based on the relative severity of pollution in these areas and determines the stringency of control measures and the dates by which attainment of the standards will be required. The US Environmental Protection Agency`s (EPA`s) final rule on air quality designations and classifications, published in late 1991, shows that ozone pollution remains a persistent problem; the number of counties that fail to meet the ozone standard has sharply increased since 1987. In contrast, incidence of PM-10 pollution has decreased; many counties have achieved the PM-10 standard since 1987. Nationwide, the number of CO nonattainment areas has increased, though not dramatically. Many of the new Title I requirements focus on the role of nitrogen oxides (NO{sub x}) in the formation of ground-level ozone. In ozone nonattainment areas and ozone transport regions, Title I generally requires major sources of NO{sub x} to have the same control measures as those that apply to major sources of volatile organic compounds (VOCs). This requirement compels state regulators to adopt an integrated VOC/NO{sub x} control strategy. The NO{sub x} emission standards proposed by state regulators are considerably more stringent than those given in federal guidelines. Both the EPA and the states plan to allow the use of multifacility emissions averaging in state NO{sub x} control strategies, thereby providing industry flexibility. Proposed federal Economic Incentive Program (EIP) rules would also allow sources in states with approved EIPs to use mobile source emission reduction credits to meet certain stationary source emission reduction requirements.

  12. What every designated representative should know about Title IV and Title V enforcement provisions

    Title IV of the Clean Air Act not only created a regulatory program unlike any other under the Clean Air Act, but also established a unique position--the designated representative--as an integral part of the program. The designated representative is required to meet certain basic obligations under Title IV, and a panoply of enforcement mechanisms are available to EPA in the event of noncompliance with these obligations. Also, because a designated representative may take on responsibilities under the permit provisions of Title V of the Clean Air Act, the designated representative can also be subject to an enforcement action for failure to comply with certain Title V permit requirements. This paper considers the basic definition of the designated representative under EPA`s Title IV and Title V regulations, identifies the responsibilities assigned to the designated representative, and then analyzes the enforcement mechanisms that may be applied to the designated representative if a regulatory responsibility has not been satisfied.

    This paper provides an overview and analysis of the impact of Title 3 of the Superfund Amendments and Reauthorization Act of 1986 (SARA Title 3) on improving community participation and risk communication and facilitating decisions leading to enhanced emergency preparedness for timely response to accidental hazardous chemical releases. The US Army's Chemical Stockpile Disposal Program (CSDP) and attendant Chemical Stockpile Emergency Preparedness Program (CSEPP) are case studies. In addition to reviewing progress in SARA Title 3 implementation in the 10 states directly affected by these programs, interviews were conducted with regional Environmental Protection Agency (EPA) and Federal Emergency Management Agency (FEMA) representatives responsible for overseeing staffing and fiscal decisions that enable this law to take effect. These interviews also permit derivation of a broad federal perspective on Title 3's success (or lack thereof) in heightening public awareness of chemical hazards and improving local political competence in addressing chemical hazards warning, notification, communication, and procurement and equipment acquisition issues. We conclude that SARA Title 3 has significantly transformed the process of chemical and other technological hazards management by forcing greater cooperation between federal agencies (particularly EPA, FEMA, and, in some instances, the Occupational Health and Safety Administration, or OSHA) and states in planning and conducting emergency exercises. The process of emergency planning is becoming increasingly decentralized. However, we also conclude that Local Emergency Planning Committees (LEPCs) and State Emergency Response Commissions (SERCs)--institutions established under Title 3--are faced with several challenges in order to ensure viable risk communication and achievement of enhanced preparedness in local communities nationwide. 36 refs., 3 tabs.

    Since the passage of the federal Clean Air Act Amendments in 1990 and EPA's promulgation of the Title V Operating Permit regulations in 1992, Texas' state environmental agency, The Texas Natural Resource Conservation Commission (TNRCC), has worked to implement its program in a way that balances its staff resources in reviewing applications and issuing operating permits. This paper is the fifth in a series (see AWMA papers 94-MP7.01; 95-RA125A.02; 96-RA117.01; and 98-TA34.02). It describes the how the TNRCC is planning to handle the many large petrochemical and refining sources in the state and meet its EPA commitment to have all federal operating permits issued by July 25, 2001.

    Key provisions of Title I of the Clean Air Act Amendments of 1990 (CAAA) focus on bringing cities and other areas into attainment of the National Ambient Air Quality Standards for ozone, carbon monoxide (CO), and fine particulates (PM-10). The CAAA's new classification scheme for pollutant nonattainment areas is based on the relative severity of pollution in these areas and determines the stringency of control measures and the dates by which attainment of the standards will be required. The US Environmental Protection Agency's (EPA's) final rule on air quality designations and classifications, published in late 1991, shows that ozone pollution remains a persistent problem; the number of counties that fail to meet the ozone standard has sharply increased since 1987. In contrast, incidence of PM-10 pollution has decreased; many counties have achieved the PM-10 standard since 1987. Nationwide, the number of CO nonattainment areas has increased, though not dramatically. Many of the new Title I requirements focus on the role of nitrogen oxides (NO[sub x]) in the formation of ground-level ozone. In ozone nonattainment areas and ozone transport regions, Title I generally requires major sources of NO[sub x] to have the same control measures as those that apply to major sources of volatile organic compounds (VOCs). This requirement compels state regulators to adopt an integrated VOC/NO[sub x] control strategy. The NO[sub x] emission standards proposed by state regulators are considerably more stringent than those given in federal guidelines. Both the EPA and the states plan to allow the use of multifacility emissions averaging in state NO[sub x] control strategies, thereby providing industry flexibility. Proposed federal Economic Incentive Program (EIP) rules would also allow sources in states with approved EIPs to use mobile source emission reduction credits to meet certain stationary source emission reduction requirements.

    Today's rapidly developing and changing technologies and industrial practices frequently carry with them the increased generation of wastes and materials which, if improperly managed, may threaten public health and the environment. The US Environmental Protection Agency is charged with the mission of protecting public health and the environment from the hazards posed by these wastes and materials. As part of its effort to achieve this mandate, it has recently adopted a Pollution Prevention Program. Among other things, the program encourages the development and adoption of processing technologies and products that will lead to reducing the aggregate generation rates for pollutants entering the environment. This paper will address EPA's efforts under its Pollution Prevention Program. The paper will address regulatory and non-regulatory action EPA has taken pursuant to the Resource Conservation and Recovery Act (RCRA), the Emergency Planning and Community Right-to-Know Act, the Pollution Prevention Act of 1990, and other Federal statutes. In addition, the paper will present case studies in pollution prevention.

    In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate. Renewables include ethanol and its ether derivatives such as ethyl tertiary butyl ether (ETBE). The RFG rule is a final rule, while the Renewable Oxygenate Requirement (ROR) rule is a proposed rule yet to be finalized and subject to revision. Included in this paper are brief reviews of Ashland petroleum Company`s ethanol usage, oxygenated fuel and reformulated gasoline blending economics, and some comments on the EPA proposed renewable oxygenate requirement.

  6. Negotiating Title V and non-Title V permits

    The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

    Under Title V, facilities are required to determine the compliance status of each air emission source with all applicable requirements. In addition, facilities are required to determine the methods that will be used to demonstrate on-going compliance with these requirements. Under Title V, it is no longer the responsibility of the regulator to determine whether a facility is in compliance; it is the facility`s responsibility to continuously prove they are in compliance. The CAM rule, as drafted, will implement the Enhanced Monitoring (EM) and periodic monitoring requirements of the 1990 Clean Air Act Amendments (CAAA). CAM will require facilities subject to Title V to develop CAM plans for specific emission units at the facility. CAM plans will include the methods that will be used to provide reasonable assurance of continuous compliance with applicable requirements. In addition, the EPA is also proposing to finalize portions of the 1993 EM rule that would allow the use of ACE to determine compliance with emission limits. Reference test methods are the only means currently available to determine compliance with emission limits. The EPA has indicated that, under the ACE rule, even data obtained via CAM will be considered credible evidence in determining the compliance status of a facility. CAM and Title V will require sources to submit large amounts of data to the regulatory agency. The data, upon submittal, are public record and can be used to indicate non-compliance under the ACE rule. Therefore, the burden shift associated with CAM and Title V, in conjunction with the use of ACE, will significantly increase the potential liability of industry. This paper discusses the implications Title V, CAM, and the ACE rule will have on industry as well as the possible effects the regulations will have on enforcement in the future. The paper will provide the perspectives of both plant managers and legal counsel.

  11. Air permitting at military installations: Applying the EPA guidance for CAA major source determinations at DOD facilities

    On August 2, 1996, the Environmental Protection Agency issued guidance to its regional offices concerning Clean Air Act major source determinations for military installations. Congress traditionally targeted permitting efforts at major sources of air pollution to focus controls on the larger emitters. Many regulations depend on whether a source is major or not. The Title I New Source Review (NSR) program, the Title III Air Toxics program, and the Title V Operating Permits program all use major source as a differentiating point for regulations. The Prevention of Significant Deterioration rules (1980) are the basis of the definition used by NSR, Title V, and Air Toxics. The rules define major source as an emissions source or sources under common control, grouped by Standard Industrial Classification (SIC) code, and located on continuous or adjacent property. In addition, support facilities are grouped with another facility if >50% of the output of the support facility directly supplies the source. EPA Region III made a major source determination for Virginia at Fort Belvoir, grouping all pollutant emitting activities within the fenceline together. Prior to this determination, permit authorities had the discretion to determine the grouping of functions within the fenceline. Military Installations contain a diverse group of activities such as industrial operations, training ranges, dry cleaners, housing areas, and food establishments. The responsibility and control are also diverse and can be controlled by military, contractor, and leased services. This paper will provide methods which facilities and their contractors can use when negotiating permits with their permitting authority. The principal methods are to use separate control to separate Military Services or leased activities, and to use functionally distinct groupings other than SIC 97 (National Security) to classify activities at military installations.

    The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions

    The Waste Isolation Pilot Plant (WIPP) is a research and development facility for the demonstration of the permanent isolation of transuranic radioactive wastes in a geologic formation. The facility was constructed in southeastern New Mexico in a manner intended to meet criteria established by the scientific and regulatory community for the safe, long-term disposal of transuranic wastes. The US Department of Energy (DOE) is preparing an application to demonstrate compliance with the requirements outlined in Title 40, Part 191 of the Code of Federal Regulations (CFR) for the permanent disposal of transuranic wastes. As mandated by the Waste Isolation Pilot Plant (WIPP) Land Withdrawal Act of 1992, the US Environmental Protection Agency (EPA) must evaluate this compliance application and provide a determination regarding compliance with the requirements within one year of receiving a complete application. Because the WIPP is a very complex program, the DOE has planned to submit the application as a draft in two parts. This strategy will allow for the DOE and the EPA to begin technical discussions on critical WIPP issues before the one-year compliance determination period begins. This report is the first of these two draft submittals.

    The US Environmental Protection Agency is proposing a regulation for the protection of the public and radioactive contamination at sites that are to be cleaned up and released for public use. The rule will apply to sites under the control of Federal agencies, and will impose limits on radiation doses to individuals living or working on a site following cleanup; it will thereby provide site owners and managers with uniform, consistent cleanup criteria for planning and carrying out remediation. This paper presents an overview of EPA`s approach to assessing some of the beneficial and adverse effects associated with various possible values for the annual dose limit. In particular, it discusses the method developed to determine how the choice of cleanup criterion affects (1) the time-integrated potential numbers of non-fatal and fatal radiogenic cancers averted among future populations, (2) the occurrence of radiogenic cancers among remediation workers and the public caused by the cleanup process itself, and (3) the volumes of contaminated soil that may require remediation. The analytic methods described here were used to provide input data and assumptions for the Regulatory Impact Analysis (RIA) that supports the proposed regulation; the RIA also considered non-radiological benefits and costs (i.e., public health, economic, and ecological) of the standards. 56 refs., 4 figs., 6 tabs.

    The Ozone Transport Commission`s (OTC) Nitrogen Oxides (NO{sub x}) Budget Program will implement the emissions reduction goal of the 1994 Memorandum of Understanding between its twelve member states and the District of Columbia. The program will achieve its significant NO{sub x} reductions from electric utilities and industrial boilers using a {open_quotes}cap-and-trade{close_quotes} approach modeled after the US Environmental Protection Agency`s sulfur dioxide emissions trading under the Acid Rain Program. The similarity of the two programs has led to the development of an important partnership between the OTC states and EPA`s Acid Rain Division, Over the past two years, Acid Rain Program staff have shared their technical expertise and assisted extensively in the development of the program`s rules. Leveraging the investment EPA made in the systems used to run the Acid Rain Program, the OTC states have asked the Acid Rain Division to administer the data systems for them, and together are working to expand its existing Emissions Tracking System and to modify a clone of the sulfur dioxide Allowance Tracking System, to fulfill the unique requirements of the NO{sub x} Budget Program. This partnership is an important example of the new type of cooperation and sharing of expertise and resources that should develop between EPA and states as they launch multi-state programs to address regional pollution problems that defy a single-state solution.

    In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

    Criminal investigators from the Environmental Protection Agency (EPA) and its field offices testified at a hearing on whether EPA has sufficient authority to investigate criminal violations, particularly in the area of illegal disposal of hazardous materials. They reported on the agency's progress in staffing a unit with authority comparable to that of Customs and the FBI. The Justice Department opposed deputizing EPA investigators, but the committee found that investigators in the 22 states surveyed operate with law-enforcement powers.     The quantitative procedures associated with noncancer risk assessment include reference dose (RfD), benchmark dose, and severity modeling. The RfD, which is part of the EPA risk assessment guidelines, is an estimation of a level that is likely to be without any health risk to sensitive individuals. The RfD requires two major judgments: the first is choice of a critical effect(s) and its No Observed Adverse Effect Level (NOAEL); the second judgment is choice of an uncertainty factor. This paper discusses major assumptions and limitations of the RfD model.

    Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

    As the nature and extent of radiological contamination becomes better documented and more public, radioanalytical laboratories are faced with a constantly expanding variety of new and difficult analytical requirements. Concurrent with those requirements is the responsibility to provide customers, regulatory officials, or the public with defensible data produced in an environment of verifiable, controlled quality. To meet that need, a quality assurance accreditation program for radioassay laboratories has been proposed by the American National Standards Institute (ANSI). The standard will provide the organizational framework and functional requirements needed to assure the quality of laboratory outputs. Under the proposed program, the U.S. Environmental Protection Agency`s (EPA`s) Laboratory Intercomparison Program plays a key role as a reference laboratory. The current and proposed roles of the EPA Intercomparison Program are discussed, as are the functional relationships between EPA, the accreditating organization, and the service and monitoring laboratories.

    The U.S. Environmental Protection Agency (EPA) built a successful water conservation program and reduced potable water use through a series of initiatives at EPA laboratories. The projects highlighted in this case study demonstrate EPA's ability to reduce water use in laboratory and medical equipment by implementing vacuum pump and steam sterilizer replacements and retrofits. Due to the success of the initial vacuum pump and steam sterilizer projects described here, EPA is implementing similar projects at several laboratories throughout the nation.

    This report presents the results of a review of the US Environmental Protection Agency (EPA) Record of Decision System (RODS) database search conducted to identify Superfund landfill sites where a Record of Decision (ROD) has been prepared by EPA, the States or the US Army Corps of Engineers describing the selected remedy at the site. ROD abstracts from the database were reviewed to identify site information including site type, contaminants of concern, components of the selected remedy, and cleanup goals. Only RODs from landfill sites were evaluated so that the results of the analysis can be used to support the remedy selection process for the Sanitary Landfill at the Savannah River Site (SRS).

    The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

    This Record of Decision (ROD) Amendment documents the U.S. Environmental Protection Agency`s (EPA`s) selection of a modified remedy for the Renora, Inc. site. The initial ROD for the Renora site included the excavation and off-site disposal of soils contaminated with polychlorinated biphenyls, (PCBs) and biodegradation of PAH-contaminated soils. The first phase of the remedy, involving the PCB-contaminated soils, has been completed. Therefore, the remedy will be modified to include the removal of surface soils contaminated with PAHs.

    The Clean Air Act Amendments of 1990 (CAAA), Title III, present a need for stationary source sampling and analytical methods for the list of 189 toxic air pollutants. The US Environmental Protection Agency (EPA) has used VOST and SemiVOST sampling and analytical methods for a wide variety of volatile and semivolatile organic compounds in the past, but these methodologies have been completely validated for only a few of the organic compounds. The applicability of VOST and SemiVOST techniques to the halogenated organic compounds listed in Title III of the Clean Air Act Amendments of 1990 has been evaluated under laboratory conditions for chromatographic separation, mass spectrometric response, sorbent recovery and analytical method detection limit. Dynamic spiking techniques for the sampling trains (both gaseous and liquid dynamic spiking) were also evaluated in the laboratory. In the study, the VOST and SemiVOST methods were evaluated in the field at a fossil fuel power plant. The source was selected to provide actual stationary source emissions with the compounds of interest present in trace amounts or not present. The paper presents the results of the field validation of the VOST and SemiVOST sampling and analytical methods.

    Title III, Section 112(r) of the Clean Air Act (CAA) Amendments of 1990 requires the Environmental Protection Agency (EPA) to promulgate regulations to prevent accidental releases of regulated substances and to reduce the severity of those releases that do occur. The final EPA rule for Risk Management Programs under Section 112(r)(7) of the CAA, promulgated June 20, 1996, applies to all stationary sources with processes that contain more than a threshold quantity of any of 139 regulated substances listed under 40 CFR 68.130. All affected sources will be required to prepare a risk management plan which must be submitted to EPA and be made available to state and local governments and to the public. This paper will provide details of initiatives underway at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of the Prevention of Accidental Release Rule. The ORR encompasses three DOE Facilities: the Y-12 Plant, Oak Ridge National Laboratory (ORNL), and the K-25 Site. The Y-12 Plant manufactures component parts for the national nuclear weapons program; the ORNL is responsible for research and development activities including nuclear engineering, engineering technologies, and the environmental sciences; and the K-25 Site conducts a variety of research and development activities and is the home of a mixed waste incinerator. ORR activities underway and soon to be undertaken toward implementation of the Prevention of Accidental Release Rule include: compilation of inventories of regulated substances at all processes at each of the three ORR Facilities for determination of affected processes and facilities; plans for inventory reduction to levels below threshold quantities, where necessary and feasible; determination of the overlap of processes subject to the OSHA PSM Standard and determination of parallel requirements; preparation of Risk Management Plans and Programs for affected processes and facilities including detailed requirements

    The U.S. Environmental Protection Agency (EPA) Superfund program's six Preliminary Remediation Goal (PRG) and Dose Compliance Concentration (DCC) internet based calculators for risk and dose assessment at Superfund sites are being revised to reflect better science, revisions to existing exposure scenarios and new scenarios, and changes to match up more closely with the EPA chemical regional screening level calculator. A revised version of the 1999 guidance document that provides an overview for the Superfund risk assessment process at radioactively contaminated sites, 'Radiation Risk Assessment At CERCLA Sites: Q and A', is being completed that will reflect Superfund recommended guidance and other technical documents issued over the past 13 years. EPA is also issuing a series of fact sheets in the document 'Superfund Radiation Risk Assessment: A Community Tool-kit'.     On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

    This report summarizes research performed at Sandia National Laboratories (SNL) in collaboration with the Environmental Protection Agency (EPA) to assess microarray quality on arrays from two platforms of interest to the EPA. Custom microarrays from two novel, commercially produced array platforms were imaged with SNL's unique hyperspectral imaging technology and multivariate data analysis was performed to investigate sources of emission on the arrays. No extraneous sources of emission were evident in any of the array areas scanned. This led to the conclusions that either of these array platforms could produce high quality, reliable microarray data for the EPA toxicology programs. Hyperspectral imaging results are presented and recommendations for microarray analyses using these platforms are detailed within the report.

    The U.S. Environmental Protection Agency (EPA) built a successful water conservation program and reduced potable water use through a series of initiatives at EPA laboratories. The projects highlighted in this case study demonstrate EPA’s ability to reduce water use in laboratory and medical equipment by implementing vacuum pump and steam sterilizer replacements and retrofits. Due to the success of the initial vacuum pump and steam sterilizer projects described here, EPA is implementing similar projects at several laboratories throughout the nation.

  11. Effect of Title V air permitting on pipeline operations

    Pursuant to the passage of the Clean Air Act Amendments of 1990, the US Environmental Protection Agency has promulgated what are known as Title V permitting requirements for major sources of air pollutants, including pipeline operations. In contrast to most existing air permitting programs, the new Title V regulations will require periodic certification of compliance with applicable air regulations. In the same way that water dischargers report their own discharge violations to regulatory agencies pursuant to the NPDES permitting system, Title V permittees must implement an acceptable monitoring program and similarly report violations of permit conditions or applicable air regulations. Only those facilities whose potential emissions are less than or can be controlled to be less than certain regulatory limits will be exempt from standard Title V permitting. If a facility`s throughput or the concentration levels of certain volatile toxic levels in a particular crude or natural gas were to exceed corresponding regulatory limits, then the facility could be in violation. If an operator were to expand a field, then the changes in the gathering system and emission levels could constitute a violation. Constraints on operations can be avoided by careful strategizing of an operator`s Title V permit application.

    EPA on Nov. 16, 1990, issued stormwater discharge regulations associated with industrial activity'' under the authority of CWA's National Pollutant Discharge Elimination System (NPDES). Those regulations established NPDES permit application requirements for industrial and certain municipal separate stormwater discharge systems. Three permit application options were made available for industrial stormwater discharges -- filing an individual application, becoming a participant in a group application or filing a notice of intent to be covered under a general permit and its requirements. The Agency of Nov. 19 proposed a draft general permit for group applications. Industrial dischargers choosing the group option previously were required to file in two parts. Part 1 was due by Sept. 30, 1991, and Part 2 was due by Oct. 1, 1992. The proposed permit would apply to industrial facilities, including certain Indian lands, in selected areas of EPA Regions I, II, III, IV, VI, VIII, IX and X. The permit would cover industrial stormwater discharges to US waters, and would include discharges transmitted through large, medium-sized and other municipal separate storm sewer systems.

    The U.S. Department of Energy (DOE) owns, operates, and manages the buildings and land areas on the Oak Ridge Reservation (ORR) in Oak Ridge, Tennessee. As land and buildings are declared excess or underutilized, it is the intent of DOE to either transfer the title of or lease suitable property to the Community Reuse Organization of East Tennessee (CROET) or other entities for public use. It is DOE's responsibility, in coordination with the U.S. Environmental Protection Agency (EPA), Region 4, and the Tennessee Department of Environment and Conservation (TDEC), to ensure that the land, facilities, and personal property that are to have the title transferred or are to be leased are suitable for public use. Release of personal property must also meet site requirements and be approved by the DOE contractor responsible for site radiological control. The terms title transfer and lease in this document have unique meanings. Title transfer will result in release of ownership without any restriction or further control by DOE. Under lease conditions, the government retains ownership of the property along with the responsibility to oversee property utilization. This includes involvement in the lessee's health, safety, and radiological control plans and conduct of site inspections. It may also entail lease restrictions, such as limiting access to certain areas or prohibiting digging, drilling, or disturbing material under surface coatings. Survey and sampling requirements are generally more rigorous for title transfer than for lease. Because of the accelerated clean up process, there is an increasing emphasis on title transfers of facilities and land. The purpose of this document is to describe the radiological survey and sampling protocols that are being used for assessing the radiological conditions and characteristics of building and land areas on the Oak Ridge Reservation that contain space potentially available for title transfer or lease.     To achieve a more stringent ambient-air ozone standard promulgated in 1997, the U.S. EPA has established summer NOx emissions limits for fossil-fired electric power generating units in the Ozone Transport Rulemaking region, consisting of 22 eastern and midwestern states and the District of Columbia. These jurisdictions are required to submit State Implementation Plans by September 1999 in response to EPA's rule, with compliance required by 2007. There are 1757 affected units in this region. In the present study, projected state-by-state growth rates for power production are used to estimate power production and NOx emissions by unit in the year 2007. NOx emissions reductions expected by January 1, 2000 due to Title IV compliance are estimated, leaving a substantial balance of emissions reductions to be achieved by post-combustion NOx control. Cost estimates are developed for achieving these remaining reductions.

    Implementation of a Clean Air Act Title V program at a large utility in Colorado involved the following activities: Generation of Operating Permit Applications; Identification of areas of non-compliance and self-reporting to the regulatory agency; Development and implementation of better record-keeping systems; Development and implementation of training programs; and, Development and implementation of a pilot program. This paper discusses in detail eight ``lessons learned`` from the experience gained during a one-year pilot program. (1) The whole process of record-keeping at the plant level had to be improved. Under Title V, regulators will go directly to a facility and ask to see documentation of compliance. Facility personnel must be prepared to show regulators the appropriate documentation. (2) Recordkeeping must be electronic. Trying to comply using manual record-keeping will generate too much paper. (3) By monitoring for a year as if Title V were in effect, deficiencies were identified early and corrected. In this way, the Utility was ready when their permit was issued. (4) One person at each facility was designated as the Title V representative, giving one focal point for the plant and one person responsible for the Title V information. (5) Training was conducted for everyone at the plant, from the receptionist to the manager. This was important for getting cooperation from plant personnel. More specific training was given to Title V representatives from all the plants. (6) A multi-disciplinary implementation team is necessary, consisting of personnel from legal, operations, environmental, etc., to ensure successful implementation. (7) Internal audits were conducted during the pilot program so that plants can self-report to the regulatory agency, thereby gaining regulatory relief from severe fines. (8) A Quality Assurance Manual/User`s Guide was prepared that pulls together all aspects of the program. This ensures consistency in implementation when personnel

    The U.S. Environmental Protection Agency's (EPA) Integrated Risk Information System (IRIS) Program develops assessments of health effects that may result from chronic exposure to chemicals in the environment. The IRIS database contains more than 540 assessments. When supported by available data, IRIS assessments provide quantitative analyses of carcinogenic effects. Since publication of EPA's 2005 Guidelines for Carcinogen Risk Assessment, IRIS cancer assessments have implemented new approaches recommended in these guidelines and expanded the use of complex scientific methods to perform quantitative dose-response assessments. Two case studies of the application of the mode of action framework from the 2005 Cancer Guidelines are presented in this paper. The first is a case study of 1,2,3-trichloropropane, as an example of a chemical with a mutagenic mode of carcinogenic action thus warranting the application of age-dependent adjustment factors for early-life exposure; the second is a case study of ethylene glycol monobutyl ether, as an example of a chemical with a carcinogenic action consistent with a nonlinear extrapolation approach. The use of physiologically based pharmacokinetic (PBPK) modeling to quantify interindividual variability and account for human parameter uncertainty as part of a quantitative cancer assessment is illustrated using a case study involving probabilistic PBPK modeling for dichloromethane. We also discuss statistical issues in assessing trends and model fit for tumor dose-response data, analysis of the combined risk from multiple types of tumors, and application of life-table methods for using human data to derive cancer risk estimates. These issues reflect the complexity and challenges faced in assessing the carcinogenic risks from exposure to environmental chemicals, and provide a view of the current trends in IRIS carcinogenicity risk assessment.

    The Clean Air Act was amended in 1990 and additional requirements were added to Title III {open_quotes}Air Toxics.{close_quotes} Title III identified one hundred eighty-nine hazardous air pollutants (HAPS) and Congress directed the EPA to study the effects of emissions of these HAPS on public health and the environment. EPA is to report to Congress in the fall of 1995 concerning their findings and make recommendations regarding fossil fuel fired combustion units. The outcome of the EPA recommendations will be of great interest to coal producers and users. Of the one hundred eighty-nine listed HAPS, eleven are trace metals found in coal. The producers and users may be required to analyze coal for these HAPS, to determine if selective mining and/or beneficiation can lower their occurrence, to determine their fate in the combustion process, etc. Indeed many coal companies have begun to study their reserves to aid the EPA investigation. Currently there are no EPA promulgated test methodologies for these elements in coal. Moreover, the American Society for Testing Materials (ASTM) does not provide standards for the analyses of all of the eleven HAPS either. In view of this lack of standardized analytical protocols the commercial laboratory is left with finding the best methods for meeting these analytical needs. This paper describes how Standard Laboratories, Inc. as a whole and particularly its Environmental Laboratory Division has met this need.

    Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    The EPA Draft Document on EMF and Cancers grew out of an earlier effort by EPA to track biological effects literature relative to radio-frequency (RF) exposure. Scope of the document was broadened to include extremely low frequency electric and magnetic fields prior to an announcement in 1986 that EPA would formally review the whole area of non-ionizing radiation. An extensive survey of the relevant bioeffects and epidemiologic literature was carried out, and writing on the document began in earnest on the document sometime in 1989. In its draft form, the document reviewed the literature on mechanisms of Interaction between electromagnetic fields and biological tissue, EMF epidemiologic studies, supporting evidence for carcinogenicity and research needs. In the early summer of 1990, a draft of the document was reviewed by some 22 individuals within the EPA and other government agencies. It was also sent out for external review to an additional 9 qualified scientists who had worked in the area and were familiar with EMF-related literature in epidemiology, biology, and physics. Many of the comments sent to EPA from this first review, prior to release of the draft for public comment, were strikingly similar to those resulting from the second (public) review process. Thus, it appears that much of the controversy that was later associated with the document could have been avoided had the authors been diligent in following the recommendations of the initial set of reviewers.

  11. An alternate compliance strategy for Title III regulations

    The EPA is attempting to incorporate pollution prevention into the Title III regulations and an example of their efforts is evident in the Hazardous Organic NESHAP (HON) rule. The HON rule includes provisions that partially encourage pollution prevention, but compliance for most facilities relies on implementation of reference control technologies (RCT). This paper proposes an Alternative Control Strategy (ACS) for the HON rule that incorporates pollution prevention and flexibility, while encouraging innovative technology. The ACS is defined by converting existing language in the HON rule into a performance based standard permitting regulated facilities to design compliance programs to meet the required hazardous air pollutant (HAP) emission reduction. The ACS meets all emission reduction and other requirements of the HON rule. The ACS was applied to an example facility and assessed using three evaluation methods. The ACS program reduced risk to the local community to a greater extent than the comparable RCT compliance program at a comparable total cost. The ACS concept is applicable to similar Title III and many other regulations, and provides a major step in the progression of moving regulations from the traditional end-of-pipe treatment philosophy to pollution prevention performance based standards. 5 refs., 3 tabs.

    The U.S. Environmental Protection Agency (EPA) is inviting participants to a stakeholder call to gather input and ideas about the Clean Energy Incentive Program (CEIP), a Clean Power Plan program designed to provide additional incentives for early investments in zero-emitting wind or solar power projects as well as in energy efficiency measures in low-income communities. This call will focus on hearing ideas and input from groups that have a general interest in CEIP projects, such as environmental justice groups, community groups, local governments, tribes, and environmental non-governmental organizations.

    This report describes the work performed by TRI/Environmental, Inc. (TRI) to determine the chemical compatibility of one geomembrane and one seamed geomembrane with four synthetically generated leachates. The objective was to determine the resistance of the geomembrane to changes caused by exposure to the leachates. Changes in physical and mechanical properties were measured after exposure to the leachates at 23 C and 50 C for 30, 60, 90 and 120 days. Exposures were performed in accordance with the exposure regimen specified in US Environmental Protection Agency (EPA) Method 9090A. Methods, results and discussion are provided. Test results are also provided in the Tables of Results which accompany this report.
