    The five acts, i.e. Power Plant and Industrial Fuel Act, Public Utilities Regulatory Policies Act, Natural Gas Policy Act, Energy Tax Act of 1978, and the National Energy Conservation Policy Act, which comprise the National Energy Act (NEA) were signed into law on November 9, 1978. The goal of the five acts is to reduce national dependency on foreign oil. Major portions of the NEA rely on state agencies for implementation. This report examines the statutory authority of those agencies to carry out the NEA mandates: Legislative measures to improve state response to the NEA are also described.

The audience includes, for example, water managers, policy makers, scientists, practitioners in the field, and the interested public.     The implementation of the Surface Mining Reclamation and Control Act of 1977 has been criticized as sporadic, lackluster, and dependent upon the political proclivities of primacy states. This dissertation explores the effect of national-level and state-level variables on implementation patterns in Colorado, Wyoming, and Virginia. Surveys and personal interviews, combined with longitudinal analyses of implementation performances of the Office of Surface Mining and individual state agencies, provide the heart of the research data. The research findings suggest the importance of considering state variables when explaining implementation performance. Moreover, support for both national and state variables as important determinants of the implementation process are provided by the research results.

    The Department of Energy's Office of Energy Efficiency and Renewable Energy (EERE) provides grants to states, territories, and the District of Columbia to support their energy priorities through the State Energy Program (SEP). The SEP provides Federal financial assistance to carry out energy efficiency and renewable energy projects that meet each state's unique energy needs while also addressing national goals such as energy security. Federal funding is based on a grant formula that takes into account population and energy consumption. The SEP emphasizes the state's role as the decision maker and administrator for the program. The American Recovery and Reinvestment Act of 2009 (Recovery Act) expanded the SEP, authorizing $3.1 billion in grants. Based on existing grant formulas and after reviewing state-level plans, EERE made awards to states. The State of Florida's Energy Office (Florida) was allocated $126 million - a 90-fold increase over Florida's average annual SEP grant of $1.4 million. Per the Recovery Act, this funding must be obligated by September 30, 2010, and spent by April 30, 2012. As of March 10, 2010, Florida had expended $13.2 million of the SEP Recovery Act funds. Florida planned to use its grant funds to undertake activities that would preserve and create jobs; save energy; increase renewable energy sources; and, reduce greenhouse gas emissions. To accomplish Recovery Act objectives, states could either fund new or expand existing projects. As a condition of the awards, EERE required states to develop and implement sound internal controls over the use of Recovery Act funds. Based on the significant increase in funding from the Recovery Act, we initiated this review to determine whether Florida had internal controls in place to provide assurance that the goals of the SEP and Recovery Act will be met and accomplished efficiently and effectively.     The implementation of the Surface Mining Control and Reclamation Act (SMCRA) of 1977 in coal producing states is guided by a partial preemption policy approach that establishes a balance between federal and state decision-making authority. The usefulness of this approach is assessed by analyzing state enforcement actions in relation the institutional capacity of states to shoulder regulatory responsibilities and the propensity of the federal Office of Surface Mining (OSM) to oversee state enforcement actions and, if necessary, to undertake corrective action. The authors results indicated that state administration of SMCRA was constrained by the lack of effective federal oversight but was largely unaffected by interstate differences in political, economic, or administrative characteristics.

    The Clean Air Act Amendments of 1990 represents a bold step in application of environmental regulation. By setting up a national free market in sulfur dioxide emission allowances, Congress has adopted the position that environmental protection and good economics are not necessarily in opposition. In fact, by carefully crafting legislation these two goals may work in aide of each other. Title IV is intended to achieve a significant reduction in the incidence of acid rain at minimal cost for the nation as a whole. On the other hand, states have traditionally had the greater responsibility for direct regulation of electric utility operations. A national free market in pollution is not welcomed by many state regulatory agencies. Some states are concerned about losing in-state markets for coal; others are unwilling to {open_quotes}import{close_quotes} pollution through the purchase of allowances. A number of states have reacted by passing regulations which limit utilities` choices in developing compliance plans. The Illinois Coal Act, for example, specifically requires two of the largest Illinois coal-fired power plants to install scrubbers and prohibits any plant from reducing its use of Illinois-mined coal by more than 10 percent per year. In December of 1993 the U.S. District Court for the Northern District of Illinois ruled, in the case of Alliance for Clean Coal v. Craig, that the Illinois Coal Act violates the Commerce Clause of the U.S. Constitution and permanently enjoined the Illinois Commerce Commission from enforcing it. The state appealed that decision but in January of 1995 the U.S. Court of Appeals for the Seventh Circuit upheld the District Court`s opinion. This paper will show that the argument that should be of particular interest from an economics perspective. Finally, the paper will attempt to draw conclusions regarding how state regulators may legitimately integrate the trading of emission allowances into their current regulatory schemes.

    The Department of Energy's (Department) Office of Energy Efficiency and Renewable Energy (EERE) provides grants to states, territories and the District of Columbia (states) to support their energy priorities through the State Energy Program (SEP). Federal funding is based on a grant formula that considers the population and energy consumption in each state, and amounted to $25 million for Fiscal Year (FY) 2009. The American Recovery and Reinvestment Act of 2009 (Recovery Act) expanded the SEP by authorizing an additional $3.1 billion to states using the existing grant formula. EERE made grant awards to states after reviewing plans that summarize the activities states will undertake to achieve SEP Recovery Act objectives, including preserving and creating jobs; saving energy; increasing renewable energy sources; and, reducing greenhouse gas emissions. EERE program guidance emphasizes that states are responsible for administering SEP within each state, and requires each state to implement internal controls over the use of Recovery Act funds. The State of Louisiana received $71.6 million in SEP Recovery Act funds; a 164-fold increase over its FY 2009 SEP grant of $437,000. As part of the Office of Inspector General's strategy for reviewing the Department's implementation of the Recovery Act, we initiated this review to determine whether the Louisiana State Energy Office had internal controls in place to efficiently and effectively administer Recovery Act funds provided for its SEP program. Louisiana developed a strategy for SEP Recovery Act funding that focused on improving energy efficiency in state buildings, housing and small businesses; increasing Energy Star appliance rebates; and, expanding the use of alternative fuels and renewable energy. Due to a statewide hiring freeze, Louisiana outsourced management of the majority of its projects ($63.3 million) to one general contractor.     The federal Surface Mining Control and Reclamation Act of 1977 not only established national performance standards and permitting procedures for the coal industry, but also provided for state primacy. The principle of state primacy is both simple and intuitively appealing. Because states do not have adequate resources to develop effective regulatory programs, the federal government would set up comprehensive procedures and criteria to guide the states in preparing their own plans. The obvious advantage of state primacy is that it provides for flexibility in implementation. Ultimately, state primacy is an experiment in cooperative federalism, a sharing of authority and responsibility between the states and the federal government to insure both the general welfare and sensitivity to local conditions. The history of surface mining regulation is instructive because it points out the pitfalls and promise of cooperative federalism as well as the critical role of the courts in making state primacy work.

    This memo explores the assumptions in Mark P. Mills' report titled 'The Internet Begins with Coal' that relate to current electricity use 'associated with the Internet'. We find that Mills has significantly overestimated electricity use, in some cases by more than an order of magnitude. We adjust his estimates to reflect measured data and more accurate assumptions, which reduces Mills' overall estimate of total Internet-related electricity use by about a factor of eight.

    The identification of potential sites for a nuclear waste repository through screening procedures in the salt states is a well-established, deliberate process. This screening process has made it possible to carry out detailed studies of many of the most promising potential sites, and general studies of all the sites, in anticipation of the siting guidelines specified in the Nuclear Waste Policy Act. The screening work completed prior to the passage of the Act allowed the Secretary of Energy to identify seven salt sites as potentially acceptable under the provisions of Section 116(a) of the Act. These sites were formally identified by letters from Secretary Hodel to the states of Texas, Utah, Mississippi, and Louisiana on February 2, 1983. The potentially acceptable salt sites were in Deaf Smith and Swisher Counties in Texas; Davis and Lavender Canyons in the Gibson Dome location in Utah; Richton and Cypress Creek Domes in Mississippi; and Vacherie Dome in Louisiana. Further screening will include comparison of each potentially acceptable site against disqualification factors and selection of a preferred site in each of the three geohydrologic settings from those remaining, in accordance with the siting guidelines. These steps will be documented in statutory Environmental Assessments prepared for each site to be nominated for detailed characterization. 9 references.

    The Yucca Mountain Site Characterization Project (YMP) of the US DOE is tasked with designing, constructing, and operating an Exploratory Studies Facility (ESF) at Yucca Mountain, Nevada. The purpose of the YMP is to provide detailed characterization of the Yucca Mountain site for the potential mined geologic repository for permanent disposal of high-level radioactive waste. Detailed characterization of properties of the site are to be conducted through a wide variety of short-term and long-term in-situ tests. Testing methods require the installation of a large number of test instruments and sensors with a variety of functions. These instruments produce analog and digital data that must be collected, processed, stored, and evaluated in an attempt to predict performance of the repository. The Integrated Data and Control System (IDCS) is envisioned as a distributed data acquisition that electronically acquires and stores data from these test instruments. IDCS designers are responsible for designing and overseeing the procurement of the system, IDCS Operation and Maintenance operates and maintains the installed system, and the IDCS Data Manager is responsible for distribution of IDCS data to participants. This report is a compilation of trip reports, interoffice memos, and other memos relevant to Computer Applications Group, Inc., work on this project.

    Implementation of the Federal Facility Compliance Act (FFCAct) required total cooperation among the Department of Energy (DOE), the involved States and interested stakeholders. Although the effort was time consuming, tedious and (at times) trying, the results obtained [Site Treatment Plans (STP)] were an unprecedented success. Through long-range planning, attention to details and organization of effort, a coordinated, cohesive, focused team was developed that included the DOE Headquarters, the Environmental Protection Agency (EPA), 40 DOE sites, 20 states and multiple interested stakeholders. The efforts of the FFCAct team resulted in the preparation of 37 STPs which outline the methods, locations and schedules for the treatment and disposal of DOE`s mixed wastes. The Plans provided a strong foundation upon which consent orders were prepared and approved. The FFCAct approach also resulted in the development of working relationships that will prove not only useful but vital to the planning and implementation necessary to the successful clean-up and disposal DOE`s mixed wastes.

    The Clean Air Act Amendments of 1990 imposed the requirement for a comprehensive set of state air pollution permit programs on a nationwide basis for the first time. Prior to the passage of this law, there were about thirty-five state permit programs, and they were not subject to Federal supervision. During the debate in the House of Representives it was stated that the purpose of the permit program was to clarify and make more enforceable a source`s pollution control requirements. In addition, the Congress wanted to encourage public involvement in the process so that interested citizens will be able to review and help enforce a source`s obligations under the Act.

    the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation

    This report summarizes a study and corresponding model development conducted in support of the United States Pacific Command (USPACOM) as part of the Federal Energy Management Program (FEMP) American Reinvestment and Recovery Act (ARRA). This research was aimed at developing a mathematical programming framework and accompanying optimization methodology in order to simultaneously evaluate energy efficiency (EE) and renewable energy (RE) opportunities. Once developed, this research then demonstrated this methodology at a USPACOM installation - Camp H.M. Smith, Hawaii. We believe this is the first time such an integrated, joint EE and RE optimization methodology has been constructed and demonstrated.

    Title IV (acid rain) of the Clean Air Act Amendments of 1990 is imposing new limitations on the emission of sulfur dioxide (SO{sub 2}) and nitrogen oxides (N{sub x}) from electric power plants. The act requires utilities to develop compliance plans to reduce these emissions, and indications are that these plans will dramatically alter traditional operating procedures. A key provision of the SO{sub 2} control program deaned in Title IV is the creation of a system of emission allowances, with utilities having the option of complying by adjusting system emissions and allowance holdings. A compilation of SO{sub 2} compliance activities by the 110 utility plants affected by Phase I is summarized in this report. These compliance plans are presented in a tabular form, correlated with age, capacity, and power pool data. A large number of the Phase I units (46%) have chosen to blend or switch to lower sulfur coals. This choice primarily is in response to (1) prices of low-sulfur coal and (2) the need to maintain SO{sub 2} control flexibility because of uncertain future environmental regulations (e.g., air toxics, carbon dioxide) and compliance prices. The report also discusses the responses of state legislatures and public utility commissions to the compliance requirements in Title IV. Most states have taken negligible action regarding the regulatory treatment of allowances and compliance activities. To protect mine employment, states producing high-sulfur coal have enacted regulations encouraging continued use of that coal, but for the most part, this response has had little effect on utility compliance choices.

    Approval of annual grant applications to states and Indian tribes is proposed in accordance with Title IV of the Surface Mining Control and Reclamation Act of 1977 (SMCRA). The grants are financed through assessments for abandoned coal mine reclamation. Fund collections are to continue through 1992. Granting of all available funds would provide the maximum possible amount of money and promote the highest level of reclamation of mined areas. Health and safety hazards associated with unreclaimed mines would be lessened, and habitat for fish, wildlife, and vegetation would be enhanced significantly. Mining reclamation projects would require evacuation of residents in affected areas. Reclamation activities would create dust and sediments, degrading air quality and surface flows. Endangered bat species dwelling in mine openings would be displaced or destroyed due to mine closures.

    The growing severity of our societal response to environmental misconduct is reflected, in part, by the criminalization of environmental wrongs by both state and Federal governments. Indeed, the recently enacted Clean Air Act Amendments of 1990 continue this trend, giving the Environmental Protection Agency, via the Department of Justice, significant new criminal enforcement tools. The importance attached to law enforcement of environmental laws is a relatively recent phenomenon and took a significant upswing in 1982 when the department of Justice created what is today the Environmental Crimes Section in what is now the Environment and Natural Resources Division, which section has grown steadily and now has over 25 attorneys who prosecute or assist in the prosecution of environmental crimes in the U.S.

    The Georgia General Assembly passed the Shore Assistance Act in 1979 in order to fill a regulatory gap in the state's management of its coastal resources. A review of its legislative history, purposes, applications, and effects in terms of the sand sharing system of sand dunes, beaches, sandbars, and shoals concludes that the Act is poorly drafted. In its application on the oceanfront, it betrays its intent and protects the oceanfront owner. It has failed to satisfy the requirements of the public trust in the tidal foreshore. Amendments to clarify its understanding of the functions and values of the sand-sharing system should also conform with the state's duties under the public trust. 139 references.

    Public law reflects a United States national commitment to the rapid development of Ocean Thermal Energy Conversion (OTEC) as an alternate energy source. OTEC plants extract the stored solar energy from the world's tropical seas and in so doing pose a potential for altering the character of the ambient noise there. The sources of noise from an OTEC plant are analyzed in the context of four configurations, two of which were built and tested, and two which are concepts for future full-scale moored facilities. The analysis indicates that the noise resulting from the interaction of turbulence with the sea-water pumps is expected to dominate in the frequency range 10 Hz to 1 kHZ. Measured radiated noise data from the OTEC-I research plant, located near the island of Hawaii, are compared with the analysis. The measured data diverge from the predicted levels at frequencies above about 60 Hz because of dominant non-OTEC noise sources on this platform. However, at low frequency, the measured broadband noise is comparable to that predicted.

    Departing from previous policy, in August 1993 the USEPA`s Water Office recommended that the agency regulate a proposed electric power plant`s cooling pond as a water of the US. At issue was a proposal by Florida Power corp. to build a new electric power plant in Polk County, Florida. A 2,600 acre cooling pond to collect heated and discharged water was included in the proposal. Region 4 USEPA staff asked USEPA Headquarters in Washington, DC to decide whether the pond was exempt from the CWA or a water of the US. The pond could be a habitat for migratory birds according to a memo prepared by Region 4 staff. The USEPA Water Office used the presence of migratory birds to claim a nexus to interstate commerce and therefore concluded that the pond should be regulated under the CWA. Electric power industry proponents have argued that an overly expansive definition of waters of the US may result in any new power plant being required to construct cooling towers. Cooling towers are said to be a more expensive and wasteful method to cool heated water. Region 4 ultimately recanted its earlier position after considerable discussions with various other Environmental Protection Agency offices and, no doubt industry pressure. Florida Power Corp. was not required to obtain an NPDES permit for the cooling pond. The lesson of Florida Power Corp. is that the regulatory environment for utilities can be uncertain under the Clean Water Act even in the face of a relatively straightforward exemption from regulation.

    The purpose of this project was for Seeo to deliver the first ever large-scale or grid-scale prototype of a new class of advanced lithium-ion rechargeable batteries. The technology combines unprecedented energy density, lifetime, safety, and cost. The goal was to demonstrate Seeo’s entirely new class of lithium-based batteries based on Seeo’s proprietary nanostructured polymer electrolyte. This technology can enable the widespread deployment in Smart Grid applications and was demonstrated through the development and testing of a 10 kilowatt-hour (kWh) prototype battery system. This development effort, supported by the United States Department of Energy (DOE) enabled Seeo to pursue and validate the transformational performance advantages of its technology for use in grid-tied energy storage applications. The focus of this project and Seeo’s goal as demonstrated through the efforts made under this project is to address the utility market needs for energy storage systems applications, especially for residential and commercial customers tied to solar photovoltaic installations. In addition to grid energy storage opportunities Seeo’s technology has been tested with automotive drive cycles and is seen as equally applicable for battery packs for electric vehicles. The goals of the project were outlined and achieved through a series of specific tasks, which encompassed materials development, scaling up of cells, demonstrating the performance of the cells, designing, building and demonstrating a pack prototype, and providing an economic and environmental assessment. Nearly all of the tasks were achieved over the duration of the program, with only the full demonstration of the battery system and a complete economic and environmental analysis not able to be fully completed. A timeline over the duration of the program is shown in figure 1.

    Eight State of California data centers were equipped with an intelligent energy management system to evaluate the effectiveness, energy savings, dollar savings and benefits that arise when powerful artificial intelligence-based technology measures, monitors and actively controls cooling operations. Control software, wireless sensors and mesh networks were used at all sites. Most sites used variable frequency drives as well. The system dynamically adjusts temperature and airflow on the fly by analyzing real-time demands, thermal behavior and historical data collected on site. Taking into account the chaotic interrelationships of hundreds to thousands of variables in a data center, the system optimizes the temperature distribution across a facility while also intelligently balancing loads, outputs, and airflow. The overall project will provide a reduction in energy consumption of more than 2.3 million kWh each year, which translates to $240,000 saved and a reduction of 1.58 million pounds of carbon emissions. Across all sites, the cooling energy consumption was reduced by 41%. The average reduction in energy savings across all the sites that use VFDs is higher at 58%. Before this case study, all eight data centers ran the cooling fans at 100% capacity all of the time. Because of the new technology, cooling fans run at the optimum fan speed maintaining stable air equilibrium while also expending the least amount of electricity. With lower fan speeds, the life of the capital investment made on cooling equipment improves, and the cooling capacity of the data center increases. This case study depicts a rare technological feat: The same process and technology worked cost effectively in eight very different environments. The results show that savings were achieved in centers with diverse specifications for the sizes, ages and types of cooling equipment.     The bill describes mandatory and discretionary allocations of funds to a state or Indian reservation for the purpose of water reclamation. The stated objectives of the Surface Mining Control and Reclamation Act are amended to allow 50 percent of a state's mandatory allocation to be used for the construction of public water treatment plants and distribution facilities to take the place of water supplies that have been contaminated as a result of coal practices undertaken prior to August 3, 1977, regardless of whether the contamination has been exacerbated by coal mining practices since that date, when construction would be more economical than repair of existing facilities.

    SAMA is a multichannel, arbitrary waveform generator program for driving microelectromechanical systems (MEMS). It allows the user to piece together twelve available wave parts, thereby permitting the user to create practically any waveform, or upload a previously constructed signal. The waveforms (bundled together as a signal) may simultaneously be output through four different channels to actuate MEMS devices, and the number of output channels may be increased depending on the DAQ card or instrument utilized.more » Additionally, real-time changes may be made to the frequency and amplitude. The signal may be paused temporarily. The waveform may be saved to file for future uploading. Recent work for this version has focused on modifications that will allow loading previously generated arbitrary waveforms, independent channel waveform amplification, adding a pause function, separating the "modify waveform: and "end program" functions, and simplifying the user interface by adding test blocks with statements to help the user program and output the desired signals. The program was developed in an effort to alleviate some of the limitations of Micro Driver. For example, Micro Driver will not allow the user to select a segment of a sine wave, but rather the user is limited to choosing either a whole or half sine wave pattern. It therefore becomes quite difficult ot construct partial sine wave patterns out of a "ramp" waveparts for several reasons. First, one must determine on paper how many data points each ramp will cover, and what the slopes of these ramps will be. Second, from what was observed, Micro Driver has difficulty processing more than six distinct waveparts during sequencing. The program will allow the user to input the various waves into the desired sequence; however, it will not allow the user to compile them (by clicking "ok" and returning to the main screen). Third, should the user decide that they want to increase the amplitute of the output signal, they must go through each wavepart individually, recalculate slopes, and modify the ramps accordingly. This is certainly not a problem for single wavepart signals (i.e., the half-sine TRA signal), but for a ramp-created partial sine wave pattern, quick changes to the amplitude require quite a bit of thought and modification time. Finally, the five-ramp molded partial sine wave pattern is not a peace-wise smooth curve, which may or may not be a problem. Given the recent modifications that have been added to SAMS in this second version, Micro Driver may be replaced by this program.« less

    The Renewable Energy and Conservation Transition Act of 1985 (S. 1220) amends the 1954 Code by extending business energy tax credits for certain solar, geothermal, and other renewable energy property investments. A time scale for each type of property sets a range of cutoff dates to December 31, 1990 and specifies some qualifications, as in the geothermal section which requires that the equipment use geothermal energy at least half the time. Title II extends the business credit for projects which will extend beyond 1990, but which qualify for credits prior to that date. Title III extends residential credits for solar and wind equipment and for other investments involving renewable energy sources. The percentage covered by the credits decreases each year after 1985.

    A triple acting radial seal used as an interstage seal assembly in a gas turbine engine, where the seal assembly includes an interstage seal support extending from a stationary inner shroud of a vane ring, the interstage seal support includes a larger annular radial inward facing groove in which an outer annular floating seal assembly is secured for radial displacement, and the outer annular floating seal assembly includes a smaller annular radial inward facing groove in which an inner annular floating seal assembly is secured also for radial displacement. A compliant seal is secured to the inner annular floating seal assembly. The outer annular floating seal assembly encapsulates the inner annular floating seal assembly which is made from a very low alpha material in order to reduce thermal stress.

    A high-current, fast-acting switch is designed for utilization as a crowbar switch in a high-current circuit such as used to generate the magnetic confinement field of a plasma-confining and heat device, e.g., Pyrotron. The device particularly comprises a cylindrical housing containing two stationary, cylindrical contacts between which a movable contact is bridged to close the switch. The movable contact is actuated by a differential-pressure, airdriven piston assembly also within the housing. To absorb the acceleration (and the shock imparted to the device by the rapidly driven, movable contact), an adjustable air buffer assembly is provided, integrally connected to the movable contact and piston assembly. Various safety locks and circuit-synchronizing means are also provided to permit proper cooperation of the invention and the high-current circuit in which it is installed. (AEC)

    Jed D. Christensen of the Office of Surface Mining Reclamation and Enforcement, Department of the Interior, was the principal witness at a hearing on S. 643, which amends the Surface Mining Control and Reclamation Act of 1977. The amendment would allow states to set aside as much as 10% from the reclamation trust fund to apply to abandoned sites. Senators speaking in favor of the bill reported problems with obtaining home loans and insurance due to subsidence from abandoned sites. Christensen supported the bill in principle, but noted possible problems with handling interest and the actual transfer of the money. He also noted a possible breakdown in regulation with the current wording of the bill.     This report characterizes the U.S. Department of Energy s Weatherization Assistance Program (WAP) during the American Recovery and Reinvestment Act of 2009 (Recovery Act) period. This research was one component of the Recovery Act evaluation of WAP. The report presents the results of surveys administered to Grantees (i.e., state weatherization offices) and Subgrantees (i.e., local weatherization agencies). The report also documents the ramp up and ramp down of weatherization production and direct employment during the Recovery Act period and other challenges faced by the Grantees and Subgrantees during this period. Program operations during the Recovery Act (Program Year 2010) are compared to operations during the year previous to the Recovery Act (Program Year 2008).

    A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    The hearing was called to review Senate bill S.801 which would provide Federal eminent domain authority for coal slurry pipelines to facilitate the national distribution and utilization of coal. Obtaining rights-of-way for the pipelines, particularly across railroad lands, has been a major stumbling lock to construction in the US. Testimony was heard from 9 witnesses, representing the Building and Construction Trade Department of AFL-CIO, Snamprogetti USA, Association of American Railroads, Railway Labor Executives Association, Coal and Slurry Technology Association, American Mining Congress, Edison Electric Institute, and the state of Louisiana. An attorney at law also gave testimony.
