Abstract
A conceptual error is contained in the report LAL 92-23 in the following statement: ``However, for any given {nu} and {ital n}, it is easy to derive once and for all from the {ital a priori} distribution of {l_brace}{var_epsilon}{sub k}{sup {nu}}; k{le}{ital n}{r_brace} for the signal the cut value which provides the required exclusion confidence level.`` The restriction k{le}{ital n} should not be applied because it is incompatible with a unique {ital a priori} ordering of all the possible experiments. Such an ordering has to be done independently of the observed number of events {ital n}.
