Abstract

The EC Council Directive of 1988 on the limitation of emissions of certain pollutants into the air from large combustion plants is to be transfered into legislation by the individual member states of the European Economic Community. In this paper, we compare the legislatory activities of the member states translating the EC Council Directive into national legislation as well as the practical aspects of regulations issued up to now for large combustion plants. The rules for confining emissions of new plants and the programs for confining emissions of existing plants are described in detail. Substantial differences exist between regulations in the individual member states, particularly when the rules for emission measurements are considered which are to be performed in the monitoring of new plants. The legislatory activities in a particular member state can be appreciated only by considering the total system of all regulations of this state in a comprehensive context. The paper also includes a discussion of the probable tendencies in the European Communities relating to further developments of the Council Directive, e.g. the tendencies of tightening emission standards are presented. [Deutsch] Die 1988 inkraftgetretene Grossfeuerungsanlagen-Richtlinie der EG ist von den einzelnen Mitgliedstaaten der EG in das jeweilige nationale Recht umzusetzen. Die gesetzgeberischen Aktivitaeten zur Umsetzung der EG-Richtlinie in den einzelnen Mitgliedstaaten sowie die materiell inhaltlichen Aspekte der bisher erlassenen Regelungen fuer Grossfeuerungsanlagen werden verglichen. Die Vorschriften zur Begrenzung des Auswurfs bei Neuanlagen sowie die Programme zur Begrenzung der Emissionen bei Altanlagen werden detailliert beschrieben. Dabei ergeben sich erhebliche Unterschiede zwischen den einzelnen Mitgliedstaaten; insbesondere auch bei den Vorschriften ueber die Emissionsmessungen im Rahmen der Ueberwachung von Neuanlagen. Eine Wuerdigung der Umsetzungsaktivitaeten des jeweiligen Mitgliedstaates ist jeweils nur sinnvoll durchfuehrbar, indem das Gesamtsystem aller Regelungen des jeweiligen Mitgliedstaates im Zusammenhang betrachtet wird. Die absehbaren Tendenzen in der EG im Hinblick auf die Weiterentwicklung der Grossfeuerungsanlagen-Richtlinie, wie z.B. eine Verschaerfung der Emissionsgrenzwerte werden dargestellt.
