Coal-slurry transportation systems and related water-rights and water-quality problems
Two successful pipelines not withstanding, considerable controversy remains over the extent to which state and Federal assistance is warranted for coal-slurry-pipeline transportation. Although the merits of slurry pipelines can be demonstrated by two successful operations, litigation is inevitable over water rights and availability, rights of way and the granting of eminent-domain power, and environmental impacts. The pipelines eliminate the noise and derailment problems of the railroads, but introduce water pollution with wastewater disposal and require large amounts of water in arid areas. Several cases of litigation are used to illustrate the uncertainties of how lawsuits will be resolved and how Congress and state legislatures will respond.
