Risk based RCRA closure of a hazardous waste storage pad at a federal facility

The closure of Resource Conservation and Recovery Act (RCRA) regulated Treatment, Storage and Disposal (TSD) facilities can be an arduous and expensive endeavor. However, risk based closure policies recently established by the state of Ohio Environmental Protection Agency can reduce the length of time needed and lower the costs associated with closure actions if they meet certain criteria. Risk based closures have been a part of the Superfund program under the Comprehensive Environmental Response, Compensation, and Liabilities Act (CERCLA) from early on, but have not been included in the RCRA regulations until recently. This paper will discuss the closure of a storage pad, permitted as an RCRA interim part B facility, located at a federally owned installation. The property is transferring to private industry concurrently with the closure of the site and development of a risk based closure under the relatively new Ohio EPA closure guidance. The paper will outline the criteria the closure action met in qualifying for the state`s policy and outline the advantages of this approach. The history of the RCRA closure Project will be discussed and the impact of related property dispositions actions have on the closure will be outlined.
