In recent years, a struggle has been emerging between the United States Environmental Protection Agency and the states over the appropriateness of providing statutory audit privileges for the results of environmental compliance audits. This paper summarizes the state audit privilege statutes, EPA`s final audit policy statement, and the common law privileges that may help protect the results of voluntary environmental audits from discovery. This fifth annual update also focuses on the interplay between compliance audits and the responsible corporate officer doctrine, as well as the effect of EPA`s Credible Evidence Rule on a company`s decision to audit.
