Until the 1990 Clean Air Act Amendments, CAA citizen suits have been few in number, due at least in part to differences in compliance reporting and the availability of civil penalties. However the Amendments dramatically changed this situation by making proof of non-compliance far easier and enabling private plaintiffs to seek civil penalty relief. This article discusses in detail the following topics: impact of the 1990 Amendments on citizen suits; recent decisions on standing in citizen suit litigation; attorneys` fees.
