Public participation issues in Title V permit authorization

Authorization of a State to operate the Title V Clean Air Act permit program requires public involvement in the permitting process, including the right to judicial review by a person who participated in the administrative process. The citizen suit provision affords qualified citizen enforcement opportunities. This paper will examine the impacts on State permit programs of (1) State standing requirements that are more restrictive than the Clean Air Act and (2) State audit privilege and immunity statutes.
