Title: Can you afford to perform an environmental audit? Update 1999

A struggle has emerged in recent years between the United States Environmental Protection Agency and the states over the appropriateness of providing privileges for the results of environmental compliance audits. This paper summarizes the state audit privilege statutes, EPA's final audit policy statement, and the common law privileges that may help protect the results of voluntary environmental audits from discovery. This sixth annual update also focuses on recent developments relating to EPA's authority to overfile enforcement actions and the impact of overfiling on environmental audit and self-disclosure issues
