    To assist in its these responsibilities in the area of electric power, EIA has prepared this report, Financial Impacts of Nonutility Power Purchases on Investor-Owned Electric Utilities. The primary purpose of this report is to provide an overview of the issues surrounding the financial impacts of nonutility generation contracts (since the passage of the Public Utility Regulatory Policies Act of 1978) on investor-owned utilities. The existing concern in this area is manifest in the provisions of Section 712 of the Energy Policy Act of 1992, which required State regulatory commissions to evaluate various aspects of long-term power purchase contracts, including their impact on investor-owned utilities` cost of capital and rates charged to customers. The EIA does not take positions on policy questions. The EIA`s responsibility is to provide timely, high quality information and to perform objective, credible analyses in support of the deliberations by both public and private decision-makers. Accordingly, this report does not purport to represent the policy positions of the US Department of Energy or the Administration.

  7. Revenue and earnings performance masked continuing investor-owned utility problems

    The 1982 increase in revenues and net income for the top 100 electric utilities is misleading because the figure is distorted by the allowance for funds used during construction (AFUDC), which overstates the real dollar strength of most investor-owned utilities. A random sampling of profit and loss statements shows that companies heavily involved in plant construction can have AFUDC over 100% of net income. The average is 50% of utility earnings, while cash dividends run 75% of earnings. The problem is short-term, however, and will diminish as construction is completed. A summary of utility performance presents earnings growth statistics, sales data and comparisons, financial statistics, and income statistics and comparisons. A summary financial table lists the 100 utilities in alphabetical order. 7 tables. (DCK)

    The US Nuclear Regulatory Commission (NRC) periodically surveys the Federal Energy Regulatory Commission (FERC) and state regulatory commissions that regulate utility owners of nuclear power plants. The NRC is interested in identifying states that have established economic or performance incentive programs applicable to nuclear power plants, how the programs are being implemented, and in determining the financial impact of the programs on the utilities. The NRC interest stems from the fact that such programs have the potential to adversely affect the safety of nuclear power plants. The current report is an update of NUREG/CR-5975, Incentive Regulation of Investor-Owned Nuclear Power Plants by Public Utility Regulators, published in January 1993. The information in this report was obtained from interviews conducted with each state regulatory agency that administers an incentive program and each utility that owns at least 10% of an affected nuclear power plant. The agreements, orders, and settlements that form the basis for each incentive program were reviewed as required. The interviews and supporting documentation form the basis for the individual state reports describing the structure and financial impact of each incentive program.

    The market for utility securities generally tends to be fairly static. Innovative financing techniques are rarely used because of the marketability of utility securities stemming from the companies' generally strong financial credit and the monopoly markets most utilities serve. To many people, utility securities are considered the pillars of the financial world, and innovation is not needed. Further, plain vanilla utility issues are easily understood by investors, as well as by regulators and customers. Over the past several years, however, a new utility bond product has crept into the world of utility securities - insured secondary utility bonds. These insured bonds may possibly be used as an alternative financing technique for newly issued debt. Individual investors often tend to rely on insurance as a tool for reducing credit risk and are willing to take the lower yields as a tradeoff. Insured utility bonds are created by brokerage firms through the acqusition of a portion of an outstanding utility bond issue and subsequent solicitation of the insurance companies for bids. The insurance company then agrees to insure that portion of the issue until maturity for a fee, and the brokerage firm sells those bonds to their customers as a AAA-insured bond. Issuers are encouraged to explore the retail market as a financing alternative. They may find a most cost-effective means of raising capital.

    This scoping study describes the underlying data resources and an analysis tool for a demand response assessment specifically tailored toward the needs of the Modern Grid Initiatives Demonstration Field Test in Phase II in Morgantown, WV. To develop demand response strategies as part of more general distribution automation, automated islanding and feeder reconfiguration schemes, an assessment of the demand response resource potential is required. This report provides the data for the resource assessment for residential customers and describes a tool that allows the analyst to estimate demand response in kW for each hour of the day, by end-use, season, day type (weekday versus weekend) with specific saturation rates of residential appliances valid for the Morgantown, WV area.

    We explain the relationship between Majorana neutrinos, which are their own antiparticles, and Majorana neutrino masses. We point out that Majorana masses would make the neutrinos very distinctive particles, and explain why many theorists strongly suspect that neutrinos do have Majorana masses. The promising approach to confirming this suspicion is to seek neutrinoless double beta decay. We introduce a toy model that illustrates why this decay requires nonzero neutrino masses, even when there are both right-handed and left-handed weak currents.

    Renewable energy certificates (RECs) are tradable instruments that convey the attributes of a renewable energy generator and the right to make certain claims about energy purchases. RECs first appeared in US markets in the late 1990s and are particularly important in states that accept or require them as evidence of compliance with renewables portfolio standards (RPS). The emergence of RECs as a tradable commodity has made utilities, generators, and regulators increasingly aware of the need to specify who owns the RECs in energy transactions. In voluntary transactions, most agree that the question of REC ownership can and should be negotiated privately between the buyer and the seller, and should be clearly established by contract. Claims about purchasing or using renewable energy should only be made if REC ownership can be documented. In many other cases, however, renewable energy transactions are either mandated or encouraged through state or federal policy. Because of the recent appearance of RECs, legislation and regulation mandating the purchase of renewable energy has sometimes been silent on the disposition of the RECs associated with that generation. Furthermore, some renewable energy contracts pre-date the existence of RECs, and therefore do not address REC ownership. In both of these instances, the issue of REC ownership must often be answered by legislative or regulatory authorities. The resulting uncertainty in REC ownership has hindered the development of robust REC markets and has, in some cases, led to contention between buyers and sellers of renewable generation. This article, which is based on a longer Berkeley Lab report, reviews federal and state efforts to clarify the ownership of RECs from Qualifying Facilities (QFs) that sell their generation under the Public Utility Regulatory Policies Act (PURPA) of 1978.     This report contains the energy use data for Wisconsin's 32 largest state-owned government facilities. These facilities account for the majority of both fuels consumed in Wisconsin state buildings and total state-owned gross square footage. Figures for each agency reflect buildings owned but not necessarily occupied by that agency. Information is presented for each of the sixteen years from and including the base year, fiscal 1972--1973 (chosen because it was the last year before the oil embargo).     Taxation affects the cash flows generated by financial investments, and, under some conditions, it also affects the degree of risk investors are willing to bear. This study investigates the effects of the Internal Revenue Code Section 465 on risk-taking by financial investors in oil and gas drilling programs. Section 465 added new rules limiting loss deductions from certain activities, explicitly including oil and gas drilling. Prior research reached varying conclusions analytically, but most research concurs that investor risk-taking is reduced when a tax structure reduces loss-offsetting, i.e., reduces the deductibility of investment losses against other income. Section 465 does that under certain circumstances, so it presents an opportunity to empirically reexamine the question. This study presents null hypotheses that state that the percentage of limited-partner investment in drilling programs with different drilling objectives and deal term structures (and different levels of risk) was unchanged between the time periods before and after the enactment of Section 465. The study concludes that the loss deduction limitations of I.R.C. Section 465 did play a role in the reduction of risk-taking by limited partners in oil and gas drilling programs.

The objective of the publication is to provide Federal and State governments, industry, and the general public with current and historical data that can be used for policymaking and decisionmaking purposes related to publicly owned electric utility issues. Generator and nongenerator summaries are presented in this publication. Four years of summary financial data are provided. Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, and operating revenue, and electric energy account data. The primary source of publicly owned financial data is the Form EIA-412, {open_quotes}Annual Report of Public Electric Utilities.{close_quotes} Public electric utilities file this survey on a fiscal year, rather than a calendar year basis, in conformance with their recordkeeping practices. In previous editions of this publication, data were aggregated by the two most commonly reported fiscal years, June 30 and December 31. This omitted approximately 20 percent of the respondents who operate on fiscal years ending in other months. Accordingly, the EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents.

The objective of the publication is to provide Federal and State governments, industry, and the general public with current and historical data that can be used for policymaking and decision making purposes related to publicly owned electric utility issues. Generator and nongenerator summaries are presented in this publication. Five years of summary financial data are provided. Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, and operating revenue, and electric energy account data. 2 figs., 32 tabs.

This study is intended to support top-level planning for the disposition of the Department of Energy`s spent nuclear fuel inventory.

    Fully aware of the nation's need to develop high-risk and long-term research in eastern oil-shale and low-grade oil-shale utilization in general, the US DOE/METC initiated an eastern oil-shale characterization program. In less than 3 months, METC produced shale oil from a selected eastern-US oil shale with a Fischer assay of 8.0 gallons/ton. In view of the relatively low oil yield from this particular oil shale, efforts were directed to determine the process conditions which give the highest oil yield. A 2-inch-diameter electrically heated fluidized-bed retort was constructed, and Celina oil shale from Tennessee was selected to be used as a representative eastern oil shale. After more than 50 runs, the retorting data were analyzed and reviewed and the best oil-yield operating condition was determined. In addition, while conducting the oil-shale retorting experiments, a number of technical problems were identified, addressed, and overcome. Owing to the inherent high rates of heat and mass transfers inside the fluidized bed, the fluidized-bed combustor and retorting appear to be a desirable process technology for an effective and efficient means for oil-shale utilization. The fluidized-bed operation is a time-tested, process-proven, high-throughput, solid-processing operation which may contribute to the efficient utilization of oil-shale energy.

The primary source of publicly owned financial data is the Form EIA-412, ``Annual Report of Public Electric Utilities.`` Public electric utilities file this survey on a fiscal year basis, in conformance with their recordkeeping practices. The EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents. The review indicated that financial indicators differ most according to whether or not a publicly owned electric utility generates electricity. Therefore, the main body of the report provides summary information in generator/nongenerator classifications. 2 figs., 101 tabs.

    This paper will discuss some of the unique aspects of a build/own/operate cogeneration project for an oil refinery in which Foster Wheeler is involved. The organization is constructing a 90 MW plant that will supply 55 MW and 160,000 lb/hr of 600 psi, 700F steam to the Tosco Corporation's 130,000 bd Avon Oil Refinery in Martinez, California. (The refinery is located about 45 miles northeast of San Francisco.) Surplus power production will be sold to the local utility, Pacific Gas and Electric Co. (PG and E). Many of the aspects of this project took on a different perspective, since the contractor would build, own and operate the plant.

    This report examines the tradeoffs among financing methods for businesses installing onsite photovoltaics (PV). We present case studies of PV financing strategies used by two large commercial retailers that have deployed substantial U.S. PV capacity: IKEA, which owns its PV, and Staples, which purchases power generated from onsite PV systems through power purchase agreements (PPAs). We also analyze the financial considerations that influence any company's choice of PV financing strategy. Our goal in this report is to clarify the financial and institutional costs and benefits of financing strategies and to inform other companies that are considering launching or expanding similar PV programs.

Because of the variety of the DOE SNF, the National Spent Nuclear Fuel Program has designated nine representative fuel groups for disposal criticality analyses based on fuel matrix, primary fissile isotope, and enrichment.     Spacecraft contamination has long been a subject of study in the rarefied gas dynamics community. Professor Mikhail Ivanov coined the term a spacecraft's 'own ambient environment' to describe the effects of natural and satellite driven processes on the conditions encountered by a spacecraft in orbit. Outgassing, thruster firings, and gas and liquid dumps all contribute to the spacecraft's contamination environment. Rarefied gas dynamic modeling techniques, such as Direct Simulation Monte Carlo, are well suited to investigate these spacebased environments. However, many advances were necessary to fully characterize the extent of this problem. A better understanding of modeling flows over large pressure ranges, for example hybrid continuum and rarefied numerical schemes, were required. Two-phase flow modeling under rarefied conditions was necessary. And the ability to model plasma flows for a new era of propulsion systems was also required. Through the work of Professor Ivanov and his team, we now have a better understanding of processes that create a spacecraft's own ambient environment and are able to better characterize these environments. Advances in numerical simulation have also spurred on the development of experimental facilities to study these effects. The relationship between numerical results and experimental advances will be explored in this manuscript.

    Renewable energy certificates (RECs) represent the bundle of information that describes the characteristics of renewable electricity generation, and may be (and increasingly are) sold separately from the underlying electricity itself. RECs are a relatively new phenomenon, emerging as a tradable commodity in voluntary markets in the late 1990s, and gaining strength as a means of compliance with various state policy requirements affecting renewable generation in the early 2000s (Holt and Bird 2005). Twenty states and Washington, D.C. now have mandatory renewables portfolio standard (RPS) obligations, and most of these may be satisfied by owning and retiring RECs. Many states also have fuel source and emissions disclosure requirements, for which RECs are useful. Even where state policy does not allow unbundled and fully tradable RECs to meet these requirements, RECs may still be used as an accounting and verification tool (REC tracking systems are in place or under development in many regions of the U.S.). These applications, plus REC trading activity in support of voluntary green claims, give rise to potential ''double counting'' to the extent that the purchaser of the RECs and the purchaser of the underlying electricity both make claims to the renewable energy attributes of the facility in question (Hamrin and Wingate 2003). When renewable electricity is sold and purchased, an important question therefore arises: ''Who owns the RECs created by the generation of renewable energy?'' In voluntary transactions, most agree that the question of REC ownership can and should be negotiated between the buyer and the seller privately, and should be clearly established by contract. Claims about purchasing renewable energy should only be made if REC ownership can be documented.     The paper examines the issue, What are the advantages, disadvantages, and other considerations for using the MPC concept as part of the strategy for interim storage and disposal of DOE-owned SNF? The paper is based in part on the results of an evaluation made for the DOE National Spent Fuel Program by the Waste Form Barrier/Canister Team, which is composed of knowledgeable DOE and DOE-contractor personnel. The paper reviews the MPC and DOE SNF status, provides criteria and other considerations applicable to the issue, and presents an evaluation, conclusions, and recommendations. The primary conclusion is that while most of DOE SNF is not currently sufficiently characterized to be sealed into an MPC, the advantages of standardized packages in handling, reduced radiation exposure, and improved human factors should be considered in DOE SNF program planning. While the design of MPCs for DOE SNF are likely premature at this time, the use of canisters should be considered which are consistent with interim storage options and the MPC design envelope.

    An attempt has been made to define the extent to which metabolic flux in central plant metabolism is reflected by changes in the transcriptome and metabolome, based on an analysis of in vitro cultured immature embryos of two oilseed rape (Brassica napus) accessions which contrast for seed lipid accumulation. Metabolic flux analysis (MFA) was used to constrain a flux balance metabolic model which included 671 biochemical and transport reactions within the central metabolism. This highly confident flux information was eventually used for comparative analysis of flux vs. transcript (metabolite). Metabolite profiling succeeded in identifying 79 intermediates within the central metabolism,more » some of which differed quantitatively between the two accessions and displayed a significant shift corresponding to flux. An RNA-Seq based transcriptome analysis revealed a large number of genes which were differentially transcribed in the two accessions, including some enzymes/proteins active in major metabolic pathways. With a few exceptions, differential activity in the major pathways (glycolysis, TCA cycle, amino acid, and fatty acid synthesis) was not reflected in contrasting abundances of the relevant transcripts. The conclusion was that transcript abundance on its own cannot be used to infer metabolic activity/fluxes in central plant metabolism.     Reducing health inequities and improving the health of communities require an informed public that is aware of the social determinants of health and how policies and programs have an impact on the health of their communities. People Assessing Their Health (PATH) is a process that uses community-driven health impact assessment to build the capacity of people to become active participants in the decisions that affect the well-being of their community. The PATH process is both a health promotion and a community development approach that builds people's ability to bring critical analysis to a situation and to engage in effective social action to bring about desired change. Because it increases analytical skills and provides communities with their own unique tool to assess the potential impact of projects, programs or policies on the health and well-being of their community it is an empowering process. PATH was originally used in three communities in northeastern Nova Scotia, Canada in 1996 when the Canadian health care system was being restructured to a more decentralized system. Since then it has been used in other communities in Nova Scotia and India. This paper will describe the PATH process and the use of the community health impact assessment as well as the methodology used in the PATH process. The lessons learned from PATH's experiences of building capacity among the community in Canada and India will be presented.

    The authors provide the degraded criticality information that supports the disposal of spent nuclear fuel (SNF) from the US Department of Energy's (DOE's) Fast Flux Test facility (FFTF) in the potential Monitored Geologic Repository (MGR) at Yucca Mountain. FFTF is one of more than 250 forms of DOE-owned SNF. Because of the variety of the SNF, the National Spent Nuclear Fuel Program has designated nine representative fuel groups for disposal criticality analyses based on fuel matrix, primary fissile isotope, and enrichment. The FFTF fuel is a mixture of uranium and plutonium oxides and is representative of the mixed-oxide fuel (MOX) group. The analyses were performed according to the disposal criticality analysis methodology that was documented in the topical report submitted to the US nuclear Regulatory Commission (YMP/TR-004Q). The methodology includes analyzing the geochemical and physical processes that can breach the waste package and degrade the waste forms. This paper summarizes the results of geochemistry degradation analysis and the criticality calculations using the degradation products.

    Because state-owned oil and gas companies dominate Oil and Gas Journal's list of largest non-US producers, data aren't fully comparable with those of the OGJ300. Many state companies report only production and reserves, with little or no financial data. Companies on the OGJ100, therefore, cannot be ranked by assets or revenues. Instead, they are listed by regions, based on location of corporate headquarters. There was no change in makeup of the top 20 holders of crude oil reserves. These companies' reserves totaled 872.3 billion bbl in 1993. The top 20 non-US companies now control 87.3 % of total world crude oil reserves, according to OGJ estimates. This is up marginally from 87.2 % of total world oil reserves in 1992. The top 20 had 87.7 % of total world reserves in 1991 and 85.5 % in 1990. The table lists company name, total assets, revenues, net income, capital and exploratory expenditures, worldwide oil production, gas production, oil and gas reserves worldwide.

    In order to determine the overall fuel economy of a plug-in hybrid electric vehicle (PHEV), the amount of operation in charge depleting (CD) versus charge sustaining modes must be determined. Mode of operation is predominantly dependent on customer usage of the vehicle and is therefore highly variable. The utility factor (UF) concept was developed to quantify the distance a group of vehicles has traveled or may travel in CD mode. SAE J2841 presents a UF calculation method based on data collected from travel surveys of conventional vehicles. UF estimates have been used in a variety of areas, including the calculation of window sticker fuel economy, policy decisions, and vehicle design determination. The EV Project, a plug-in electric vehicle charging infrastructure demonstration being conducted across the United States, provides the opportunity to determine the real-world UF of a large group of privately owned Chevrolet Volt extended range electric vehicles. Using data collected from Volts enrolled in The EV Project, this paper compares the real-world UF of two groups of Chevrolet Volts to estimated UF's based on J2841. The actual observed fleet utility factors (FUF) for the MY2011/2012 and MY2013 Volt groups studied were observed to be 72% and 74%, respectively. Using the EPA CD ranges, the method prescribed by J2841 estimates a FUF of 65% and 68% for the MY2011/2012 and MY2013 Volt groups, respectively. Volt drivers achieved higher percentages of distance traveled in EV mode for two reasons. First, they had fewer long-distance travel days than drivers in the national travel survey referenced by J2841. Second, they charged more frequently than the J2841 assumption of once per day - drivers of Volts in this study averaged over 1.4 charging events per day. Although actual CD range varied widely as driving conditions varied, the average CD ranges for the two Volt groups studied matched the EPA CD range estimates, so CD range variation did not affect FUF results.

    There are more than 250 forms of U.S. Department of Energy (DOE)-owned spent nuclear fuel (SNF). Due to the variety of the spent nuclear fuel, the National Spent Nuclear Fuel Program has designated nine representative fuel groups for disposal criticality analyses based on fuel matrix, primary fissile isotope, and enrichment (DOE 2000b, Section 6.6.8). The Melt and Dilute (MD) SNF has been designated as the representative fuel for the high-enriched U-Al fuel group. The MD SNF consists of homogeneous cylindrical ingots with 16.5 in. (419.1 mm) maximum diameter. Two general ingot compositions are considered in the criticality and geochemistry analyses. The first composition consists of 8.2 to 18.2 wt% uranium, enriched at less than 20 wt% U-235 and 0.5 wt% gadolinium, with the balance of the ingot being aluminum. The second composition is identical to the first for uranium and gadolinium, but in this case 2.5 wt% of the ingot is hafnium, with the balance of the ingot being aluminum. The results of the analyses performed will be used to develop waste acceptance criteria. The items that are important to criticality control are identified based on the analysis needs and result sensitivities. Prior to acceptance of fuel from the high-enriched U-Al fuel group for disposal, the important items for the fuel types that are being considered for disposal under the high-enriched U-Al fuel group must be demonstrated to satisfy the conditions determined in this report. The analyses have been performed by following the disposal criticality analysis methodology, which was documented in the ''Disposal Criticality Analysis Methodology Topical Report'' (YMP 2000) submitted to the U.S. Nuclear Regulatory Commission. The methodology includes analyzing the geochemical and physical processes that can breach the waste package and degrade the waste forms and other internal components, as well as the structural, thermal, and shielding analyses, and intact and degraded component criticality

  7. Final Technical Report. Sault Tribe Building Efficiency Audits of Tribally-Owned Governmental Buildings and Residential Tribal Housing

    The Tribe is working to reduce energy consumption and expense in Tribally-owned governmental buildings and low income housing sites. In 2009, the Tribe applied to the U. S. Department of Energy for funding to conduct energy audits of Tribally-owned governmental buildings. Findings from the energy audits would define the extent and types of energy efficiency improvements needed, establish a basis for energy priorities, strategies and action plans, and provide a benchmark for measuring improvements from energy efficiency implementations. In 2010, the DOE awarded a grant in the amount of $95,238 to the Tribe to fund the energy audits of nine governmental buildings and to pay for travel expenses associated with attendance and participation at the DOE annual program reviews. In 2011, the Tribe applied for and was awarded a DOE grant in the amount of $75,509 to conduct energy audits of the remaining 30 Tribally-owned governmental buildings. Repeating mobilization steps performed during the first DOE energy audits grant, the Tribe initiated the second round of governmental building energy audits by completing energy auditor procurement. The selected energy auditor successfully passed DOE debarment and Sault Tribe background clearances. The energy audits contract was awarded to U. P. Engineers and Architects, Inc. of Sault Ste. Marie, Michigan. The Tribe continued mobilizing for the energy audits by providing the energy auditor with one year of electric, gas and water utility invoice copies per building, as well as supplemental building information, such as operating hours. The Tribe also contacted building occupants to coordinate scheduling for the on-site energy audit inspections and arranged for facilities management personnel to guide the energy auditor through the buildings and answer questions regarding building systems.

    Highlights: • Y-encoded proto-oncoprotein TSPY amplifies its expression level via a positive feedback loop. • TSPY binds to the chromatin/DNA at exon 1 of TSPY gene. • TSPY enhances the gene expression in a TSPY exon 1 sequence dependent manner. • The conserved SET/NAP-domain is essential for TSPY transactivation. • Insights on probable mechanisms on TSPY exacerbation on cancer development in men. - Abstract: The testis-specific protein Y-encoded (TSPY) is a repetitive gene located on the gonadoblastoma region of the Y chromosome, and has been considered to be the putative gene for this oncogenic locus on the male-only chromosome. It is expressed in spermatogonial cells and spermatocytes in normal human testis, but abundantly in gonadoblastoma, testicular germ cell tumors and a variety of somatic cancers, including melanoma, hepatocellular carcinoma and prostate cancer. Various studies suggest that TSPY accelerates cell proliferation and growth, and promotes tumorigenesis. In this report, we show that TSPY could bind directly to the chromatin/DNA at exon 1 of its own gene, and greatly enhance the transcriptional activities of the endogenous gene in the LNCaP prostate cancer cells. Domain mapping analyses of TSPY have localized the critical and sufficient domain to the SET/NAP-domain. These results suggest that TSPY could efficiently amplify its expression and oncogenic functions through a positive feedback loop, and contribute to the overall tumorigenic processes when it is expressed in various human cancers.

    There are more than 250 forms of US Department of Energy (DOE)-owned spent nuclear fuel (SNF). Due to the variety of the spent nuclear fuel, the National Spent Nuclear Fuel Program has designated nine representative fuel groups for disposal criticality analyses based on fuel matrix, primary fissile isotope, and enrichment. The Fort Saint Vrain reactor (FSVR) SNF has been designated as the representative fuel for the Th/U carbide fuel group. The FSVR SNF consists of small particles (spheres of the order of 0.5-mm diameter) of thorium carbide or thorium and high-enriched uranium carbide mixture, coated with multiple, thin layers of pyrolytic carbon and silicon carbide, which serve as miniature pressure vessels to contain fission products and the U/Th carbide matrix. The coated particles are bound in a carbonized matrix, which forms fuel rods or ''compacts'' that are loaded into large hexagonal graphite prisms. The graphite prisms (or blocks) are the physical forms that are handled in reactor loading and unloading operations, and which will be loaded into the DOE standardized SNF canisters. The results of the analyses performed will be used to develop waste acceptance criteria. The items that are important to criticality control are identified based on the analysis needs and result sensitivities. Prior to acceptance to fuel from the Th/U carbide fuel group for disposal, the important items for the fuel types that are being considered for disposal under the Th/U carbide fuel group must be demonstrated to satisfy the conditions determined in this report.

    This report presents information on the preliminary process knowledge to be used in characterizing all Department of Energy (DOE)-owned Spent Nuclear Fuel (SNF) types that potentially exhibit a Resource Conservation and Recovery Act (RCRA) characteristic. This report also includes the process knowledge, analyses, and rationale used to preliminarily exclude certain SNF types from RCRA regulation under 40 CFR {section}261.4(a)(4), ``Identification and Listing of Hazardous Waste,`` as special nuclear and byproduct material. The evaluations and analyses detailed herein have been undertaken as a proactive approach. In the event that DOE-owned SNF is determined to be a RCRA solid waste, this report provides general direction for each site regarding further characterization efforts. The intent of this report is also to define the path forward to be taken for further evaluation of specific SNF types and a recommended position to be negotiated and established with regional and state regulators throughout the DOE Complex regarding the RCRA-related policy issues.
