The new definition means MMS will reduce its royalty rate to 12.5% from 16% on fields in 200-400 m of water. It currently collects a 16% royalty on production in less than 400 m of water and 12.5% on production in water deeper than 400 m.

    Against the backdrop of more than 20 years of increasingly stringent environmental regulation, ever-expanding exploration and development moratoria on the Outer Continental Shelf (OCS), and reductions in producer tax incentives, oil and natural gas exploration companies active in deep waters of the Gulf of Mexico recently won a significant legislative victory. On Nov. 28, 1995, President Clinton signed into law S.395, the Alaska Power Administration Sale Act. Title 3 of S.395 embodies the Outer Continental Shelf Deep Water Royalty Relief Act. This landmark legislation provides substantial incentives for oil and natural gas production in the gulf of Mexico by temporarily eliminating royalties on certain deepwater leases. It is the first direct incentive for oil and gas production enacted at the federal level in many years. This paper reviews the elements used to arrive at this successful legislation including the congressional leadership. It describes debates, cabinet level discussions, and use of parlimentary procedures.

    This paper reports that Canadian petroleum companies have welcomed a revamp of Alberta's royalty structure but say it falls short of what is needed to revitalize activity in the province. The changes will give producers a cut in royalties of at least $170 million (Canadian)/year, offer incentives for new drilling, and index royalty levels to prices. The new royalty plan also will reward companies that funnel more capital into increased exploration programs. The industry association the new royalty rates tied to prices could increase royalties if prices rise above $26 (Canadian)/bbl for oil and $1.70 (Canadian)/Mcf for natural gas. The effects of this decision was to derail the government's attempt to make royalty oil produced from Outer Continental Shelf leases and onshore sites available to the same refiners.     The Secretary of the Interior has used his authority to reduce royalty rates on eight Federal coal leases - amounting to $12 million in reduced Federal revenues. Requests for royalty rate reductions were precipitated by recent legislative enactments and a 2-year departmental experiment that raised royalty rates on coal leases to significantly higher levels. Because the Secretary is authorized to readjust the royalty rates on 438 leases by 1990 more requests for royalty reductions are likely in the future. The Interior Department has not clearly defined its policy and procedures on royalty rate reductions. The approval process is inconsistent, and accounting and auditing expertise needed to evaluate reduction requests have not been used adequately. GAO recommends that Interior develop a more clearly defined policy and accompanying regulations on royalty rate reductions, determine when audits of applicants' financial statements are needed, and better use existing financial expertise in its evaluations of reduction requests.

    In the natural gas business, the word ``royalty`` usually brings to mind the fee producers pay on each unit of gas they produce from wells drilled on acreage leased from the government. This production-oriented word now is taking on added meaning and quickly becoming part of the gas utility lexicon. If organizations representing appliance-sales and service companies have their way, the local gas company will soon be paying an annual royalty to its customers as compensation for what these groups allege is the ``free`` use of the utility name and reputation -- also known as its ``good will`` -- by its unregulated business units that sell, install and repair appliances. This royalty would be returned to gas customers through an equivalent reduction in a utility`s base rate -- the revenue it requires each year to cover expenses and provide a return on its investment. Resolution of the issue is pending in three state: State courts in New York and Minnesota are reviewing regulatory orders instituting the royalty, and regulators in Maryland are debating the question. Legal aspects of these pending regulations are discussed.

    The Department of Interior receives a royalty from oil production on federal lands. Interior can take the royalty as a cash payment or a portion of the oil itself, which it can then sell to small and independent refiners who are determined to be in need of crude oil supplies. Sales of this so-called royalty oil have been held about every 3 years since 1970. In early 1985, Interior announced its intention to terminate the program because of its declining importance and proposed legislation to that effect. While GAO sees no compelling need to legislatively restrict Interior's ability to hold future royalty oil sales now or in the future, it has identified several ways to improve the program's effectiveness. This report examines Interior's basis for the most recent sales and the current status and need for the royalty oil program and discusses ways in which its administration might be improved if future sales are held.

    Water resource management requires collaborative solutions that cross institutional and political boundaries. This work describes the development and use of a computer-based tool for assessing the impact of additional water allocation from the Gila River and the San Francisco River prescribed in the 2004 Arizona Water Settlements Act. Between 2005 and 2010, Sandia National Laboratories engaged concerned citizens, local water stakeholders, and key federal and state agencies to collaboratively create the Gila-San Francisco Decision Support Tool. Based on principles of system dynamics, the tool is founded on a hydrologic balance of surface water, groundwater, and their associated coupling between water resources and demands. The tool is fitted with a user interface to facilitate sensitivity studies of various water supply and demand scenarios. The model also projects the consumptive use of water in the region as well as the potential CUFA (Consumptive Use and Forbearance Agreement which stipulates when and where Arizona Water Settlements Act diversions can be made) diversion over a 26-year horizon. Scenarios are selected to enhance our understanding of the potential human impacts on the rivers ecological health in New Mexico; in particular, different case studies thematic to water conservation, water rights, and minimum flow are tested using the model. The impact on potential CUFA diversions, agricultural consumptive use, and surface water availability are assessed relative to the changes imposed in the scenarios. While it has been difficult to gage the acceptance level from the stakeholders, the technical information that the model provides are valuable for facilitating dialogues in the context of the new settlement.

The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    It is emphasized that parties contracting for oil and gas leases are always free to allocate the costs of compression, transportation and processing in their agreements, thereby avoiding many potential problems. However, it must be recognized that all too often lease agreements fail to apportion expenses that may be incurred after the discovery of oil or gas. In the likely event that the West Virginia courts are faced with this issue, they would be wise to adopt the implied duty to market theory, thereby, putting the onus on the lessee to either provide up front in the lease for the apportionment of costs after the discovery of the gas, or in those instances where the lease is silent as to who will incur the cost, to place the burden on the lessee to cover those costs. Regarding transportation costs, even in jurisdictions such as Oklahoma, where the lessee is obligated to develop the gas he has found so that it will bring the highest possible market value, the lessee is not required to provide for pipeline facilities beyond the lease premises. Kansas courts have also held that the lessee has a general duty to see that the gas is marketed, but that it is not required to pay the lessor`s share of transportation charges form the well to some distant place. Thus, in West Virginia when a gas lease is silent as what costs a lessee may properly deduct from a lessor`s royalty payment, the lessee should bear the costs under the implied duty to market theory if those costs do not involve enhancing the product or transporting it to some place of sale off the leased premises.

    This manual provides general guidance for Department of Energy (DOE) officials for complying with Sect. 402 of the Clean Water Act (CWA) of 1977 and amendments. Section 402 authorizes the US Environmental Protection Agency (EPA) or states with EPA approved programs to issue National Pollutant Discharge Elimination System (NPDES) permits for the direct discharge of waste from a point source into waters of the United States. Although the nature of a project dictates the exact information requirements, every project has similar information requirements on the environmental setting, type of discharge(s), characterization of effluent, and description of operations and wastewater treatment. Additional information requirements for projects with ocean discharges, thermal discharges, and cooling water intakes are discussed. Guidance is provided in this manual on general methods for collecting, analyzing, and presenting information for an NPDES permit application. The NPDES program interacts with many sections of the CWA; therefore, background material on pertinent areas such as effluent limitations, water quality standards, toxic substances, and nonpoint source pollutants is included in this manual. Modifications, variances, and extensions applicable to NPDES permits are also discussed.

    In August 1985 the Environmental Engineering Committee of the Science Advisory Board was asked by the Office of Water Regulations and Standards (OWRS) to review technical documents supporting development of EPA regulations for the disposal/reuse of sewage sludge under Section 405(d) of the Clean Water Act. The Committee was also asked by the Office of Marine and Estuarine Protection (OMEP) to review technical documents supporting revisions of the EPA ocean dumping regulations. The Committee chose to review the two sets of documents together, since they both dealt with a common subject, and since they shared, in some respects, a common methodology. The report, however, covers only the review of the OWRS documents, which consist of a set of risk-assessment methodologies (1,2,3,4) for four sludge disposal/reuse options (landfilling, land application/distribution and marketing, incineration, and ocean disposal). The reviews of the OMEP documents are covered in separate Committee reports. The Committee's principal findings are outlined.

ARIES-ACT1 features an advanced SiC blanket with LiPb as coolant and breeder, a helium cooled steel structural ring and tungsten divertors, a thin-walled, helium cooled vacuum vessel, and a room temperature water-cooled shield outside the vacuum vessel. The water heat transfer system is designed to remove heat by natural circulation during a LOFA. The MELCOR model uses time-dependent decay heats for each component determined by 1-D modeling. The MELCOR model shows that, despite periodic boiling of the water coolant, that structures are kept adequately cool by the passive safety system.

    A double acting bit holder that permits bits held in it to be resharpened during cutting action to increase energy efficiency by reducing the amount of small chips produced. The holder consist of: a stationary base portion capable of being fixed to a cutter head of an excavation machine and having an integral extension therefrom with a bore hole therethrough to accommodate a pin shaft; a movable portion coextensive with the base having a pin shaft integrally extending therefrom that is insertable in the bore hole of the base member to permit the moveable portion to rotate about the axis of the pin shaft; a recess in the movable portion of the holder to accommodate a shank of a bit; and a biased spring disposed in adjoining openings in the base and moveable portions of the holder to permit the moveable portion to pivot around the pin shaft during cutting action of a bit fixed in a turret to allow front, mid and back positions of the bit during cutting to lessen creation of small chip amounts and resharpen the bit during excavation use.

    Astroparticle Physics and Underground experiments searching for rare nuclear events, need high purity materials to act as detectors or detector shielding. Water has the advantage of being cheap, dense and easily available. Most of all, water can be purified to the goal of obatining a high level of radiopurity. Water Purification can be achieved by means of a combination of processes, including filtration, reverse osmosis, deionization and gas stripping. The Water Purification System for the Borexino experiment, will be described together with its main performances.

    A fast-acting valve actuator utilizes a spring driven pneumatically loaded piston to drive a valve gate. Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.

The video describes how the Department of Energy and its contractors turned a nearly $2 billion investment of American Recovery and Reinvestment Act funding in 2009 into nearly $4 billion worth of environmental cleanup work over the past two years. At the same time, Hanford workers have reduced the cleanup footprint of the Hanford Site by more than half (586 square miles to 241 sq. mi. through August -- 59 percent).

    The model offshore wind power legislation focused on two aspects: compensation for use of ocean space and environmental assessment. In particular, the model legislation recommends the adoption of a rent and royalty scheme that is premised on high rent and low royalties in order to stimulate qualified bids from developers who are motivated to begin production as early as possible and to discourage sham bidding. The model legislation also includes a provision that sets royalties at a lower rate in the early years of project operation, and that provides states with the discretion to waive or defer rent and/or royalties for a period of time to meet the goals and objectives of energy independence, job creation, reduced emissions of conventional pollutants and greenhouse gases and increased state requirements for electricity from renewable sources. The environmental impact assessment (EIA) is structured to provide a systematic and interdisciplinary evaluation of the potential positive and negative life-cycle effects of a proposed offshore wind project on the physical, biological, cultural and socio-economic attributes of the project.

A pump, positioned with the monitoring well, pumps groundwater through the transportation system into the expandable container, which expands in direct proportion with volume of groundwater introduced, usually three or four well volumes, yet prevents the groundwater from coming into contact with the oxygen in the air. After this quantity of groundwater has been removed from the well, a sample is taken from a sampling port, after which the groundwater in the expandable container can be returned to the monitoring well through the return system. The purge water management system prevents the purge water from coming in contact with the outside environment, especially oxygen, which might cause the constituents of the groundwater to oxidize. Therefore, by introducing the purge water back into the monitoring well, the necessity of dealing with the purge water as a hazardous waste under the Resource Conservation and Recovery Act is eliminated.

    Electromagnetic design considerations for fast acting controllers in a power system is introduced and defined. A distinction is made in relation to the more commonly understood system control design necessary for damping electromechanical oscillations using stability programs and eigenanalysis. Electromagnetic eigenanalysis tools have limited availability and are consequently rarely used. Electromagnetic transients programs (emtp) on the other hand are widely used and a procedure for undertaking electromagnetic control design of fast acting controllers in a power system using emtp is presented.

  1. INEEL Source Water Assessment

    The Idaho National Engineering and Environmental Laboratory (INEEL) covers approximately 890 mi2 and includes 12 public water systems that must be evaluated for Source water protection purposes under the Safe Drinking Water Act. Because of its size and location, six watersheds and five aquifers could potentially affect the INEEL’s drinking water sources. Based on a preliminary evaluation of the available information, it was determined that the Big Lost River, Birch Creek, and Little Lost River Watersheds and the eastern Snake River Plain Aquifer needed to be assessed. These watersheds were delineated using the United States Geologic Survey’s Hydrological Unit scheme. Well capture zones were originally estimated using the RESSQC module of the Environmental Protection Agency’s Well Head Protection Area model, and the initial modeling assumptions and results were checked by running several scenarios using Modflow modeling. After a technical review, the resulting capture zones were expanded to account for the uncertainties associated with changing groundwater flow directions, a thick vadose zone, and other data uncertainties. Finally, all well capture zones at a given facility were merged to a single wellhead protection area at each facility. A contaminant source inventory was conducted, and the results were integrated with the well capture zones, watershed and aquifer information, and facility information using geographic information system technology to complete the INEEL’s Source Water Assessment. Of the INEEL’s 12 public water systems, three systems rated as low susceptibility (EBR-I, Main Gate, and Gun Range), and the remainder rated as moderate susceptibility. No INEEL public water system rated as high susceptibility. We are using this information to develop a source water management plan from which we will subsequently implement an INEEL-wide source water management program. The results are a very robust set of wellhead protection areas that will protect the INEEL’s public water systems yet not too conservative to inhibit the INEEL from carrying out its missions.

    The moisture content and temperature of hydrogen and oxygen gases is regulated throughout traverse of the gases in a fuel cell incorporating a solid polymer membrane. At least one of the gases traverses a first flow field adjacent the solid polymer membrane, where chemical reactions occur to generate an electrical current. A second flow field is located sequential with the first flow field and incorporates a membrane for effective water transport. A control fluid is then circulated adjacent the second membrane on the face opposite the fuel cell gas wherein moisture is either transported from the control fluid to humidify a fuel gas, e.g., hydrogen, or to the control fluid to prevent excess water buildup in the oxidizer gas, e.g., oxygen. Evaporation of water into the control gas and the control gas temperature act to control the fuel cell gas temperatures throughout the traverse of the fuel cell by the gases.

    This paper reports that chemists have found and characterized an anticancer antibiotic, dynemicin A, that may be the fouth of a series of antibiotics that act by metabolic rearrangement to a diradical. If true, diradical precursors may represent an antibiotic strategy that evolved widely in nature. And, there may be many more anticancer antibiotics awaiting discovery. Also, the unique internal trigger that seems to set off the dynemicin rearrangement gives chemists a new understanding of how these compounds work. If, indeed, the anthraquinone nucleus in dynemicin A binds by intercalation between strands of DNA as is now thought, chemists will learn more about how to deliver drugs to specific sites.

The 216-B-3 Pond System consists of a series of four earthen, unlined, interconnected ponds and the 216-B-3-3 Ditch that receive waste water from various 200 East Area operating facilities. These four ponds, collectively. Waste water (primarily cooling water, steam condensate, and sanitary water) from various 200 East Area facilities is discharged to the 216-B-3-3 Ditch. Water discharged to the 216-8-3-3 Ditch flows directly into the 216-B-3 Pond. In the past, waste water discharges to B Pond and the 216-B-3-3 Ditch contained mixed waste (radioactive waste and dangerous waste). The radioactive portion of mixed waste has been interpreted by the US Department of Energy (DOE) to be regulated under the Atomic Energy Act of 1954; the nonradioactive dangerous portion of mixed waste is regulated under RCRA. Mixed waste also may be considered a hazardous substance under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) when considering remediation of waste sites.

    The National Environmental Policy Act of 1969 (NEPA) sets forth national policy for the protection of the environment. The NEPA process is intended to help officials of the federal government make decisions that are based on an understanding of environmental consequences, and take actions that protect, restore, and enhance the environment. The California Environmental Quality Act of 1970 (CEQA) is similar to NEPA. The California legislature established CEQA to inform both state and local governmental decision-makers and the public about potential significant environmental effects of proposed activities, to identify ways to avoid or reduce environmental impacts, and to disclose to the public the reasons why a project is approved if significant environmental effects are involved. Lawrence Berkeley Laboratory (LBL), complies with the provisions of both NEPA and CEQA. This document defines the responsibilities and authorities for NEPA/CEQA compliance at LBL.

The valve has a valve head which seats in an opening in the cannister. The entire assembly is readily insertable into a process vessel which produces mercury as a product. As the mercury settles, it flows into the opening in the cannister displacing lighter material. When the valve is in a closed position, the pressure cannister is sealed except for the fluid inlet conduit and the fluid outlet conduit. Introduction of a lighter fluid into the cannister will act to displace a heavier fluid from the cannister via the fluid outlet conduit. The entire pump assembly penetrates only a top wall of the process vessel, and not the sides or the bottom wall of the process vessel. This insures a leak-proof environment and is especially suitable for processing of hazardous materials.

    Science Goals for the ARM Recovery Act Radars. In October 2008, an ARM workshop brought together approximately 30 climate research scientists to discuss the Atmospheric Radiation Measurement (ARM) Climate Research Facility's role in solving outstanding climate science issues. Through this discussion it was noted that one of ARM's primary contributions is to provide detailed information about cloud profiles and their impact on radiative fluxes. This work supports cloud parameterization development and improved understanding of cloud processes necessary for that development. A critical part of this work is measuring microphysical properties (cloud ice and liquid water content, cloud particle sizes, shapes, and distribution). ARM measurements and research have long included an emphasis on obtaining the best possible microphysical parameters with the available instrumentation. At the time of the workshop, this research was reaching the point where additional reduction in uncertainties in these critical parameters required new instrumentation for applications such as specifying radiative heating profiles, measuring vertical velocities, and studying the convective triggering and evolution of three-dimensional (3D) cloud fields. ARM was already operating a subset of the necessary instrumentation to make some progress on these problems; each of the ARM sites included (and still includes) a cloud radar (operating at 35 or 94 GHz), a cloud lidar, and balloon-borne temperature and humidity sensors. However, these measurements were inadequate for determining detailed microphysical properties in most cases. Additional instrumentation needed to improve retrievals of microphysical processes includes radars at two additional frequencies for a total of three at a single site (35 GHz, 94 GHz, and a precipitation radar) and a Doppler lidar. Evolving to a multi-frequency scanning radar is a medium-term goal to bridge our understanding of two-dimensional (2D) retrievals to the 3D cloud field. These additional microphysical measurements would allow detailed cloud properties to be derived even in the presence of light precipitation. It is important to couple these detailed measurements of cloud microphysics to vertical motion on the cloud scale to couple microphysics with meteorological processes. Vertically pointing Doppler radars provide the vertical motion of cloud particles but, to separate particle motion from air motion, a wind profiler is required. The American Recovery and Reinvestment Act provided the means to address these needs and implement a multi-frequency suite of radars, including scanning radars, at each of the ARM sites. In addition, Doppler lidars have been deployed at several sites. With these new measurement capabilities, ARM has the measurement capabilities to tackle the problems of improving microphysical profile descriptions and evaluating the relationship between our current narrow-field-of view, zenith perspective on clouds to a description of the full 3D cloud field and its temporal evolution.
