    A preliminary exploration is given of the legal and economic considerations surrounding the formation and operation of some form of utility-sponsored collective buying arrangement for heliostats. Particular attention is focused on considerations of federal antitrust law surrounding collective buying and other joint operations by electric utilities. Attention is also given to considerations suggested by the economic theory of monopsony (markets with a single buyer) and oligopsony (markets with a small number of buyers). The advantages and disadvantages of such arrangements are examined from the viewpoints of the buyer and the seller. (LEW)

  20. Review and analysis of the adequacy of the legal and institutional framework for geothermal development in Washington State

    The legal and institutional framework within which geothermal energy must develop has its origin in the early 1970s. In 1970, the Federal Geothermal Steam Act was passed into law and in 1974 the Washington State Geothermal Act was passed. The legal and institutional framework thus established by the state and federal governments differed substantially in format, content, and direction. In many instances, the legal and institutional framework established left as many questions unanswered as answered, and in some cases, the framework has proven to be more of an obstacle to development than an aid. From an examination of how the state and federal governments have addressed the varying needs of geothermal development and how the courts have interpreted some of their decisions, it is clear that in order to ensure that the legal and institutional framework is adequate to serve the needs of geothermal development, it must address, at a minimum, the following topics: (1) providing developers with access and a priority right to carry out exploration and development activities; (2) characterization of the resource so as to minimize conflicts with other natural resources; (3) establishing ownership; and (4) giving careful consideration to such lease terms as rentals and royalties, lease renewals, and diligence requirements. In addition, the framework must address groundwater law and its implications for geothermal development and how geothermal development will be considered in terms of establishing utility law. At the local level, it is imperative that geothermal be given careful consideration when decisions on resource management, zoning, and regulation are made. Local governments also have the power to establish programs which can provide substantial incentives for geothermal development and, by so doing, ensure that geothermal energy contributes to economic stability and growth.

    In two particular respects (briefly investigated in this study from a lawyer`s perspective), electric utilities appear uniquely well-positioned to contribute to the National Information Infrastructure (NII). First of all, utilities have legal powers derived from their charters and operating authorities, confirmed in their rights-of-way, to carry out activities and functions necessary for delivering electric service. These activities and functions include building telecommunications facilities and undertaking information services that have become essential to managing electricity demand and supply. The economic value of the efficiencies made possible by telecommunications and information could be substantial. How great remains to be established, but by many estimates electric utility applications could fund a significant share of the capital costs of building the NII. Though utilities` legal powers to pursue such efficiencies through telecommunications and information appear beyond dispute, it is likely that the effort to do so will produce substantial excess capacity. Who will benefit from this excess capacity is a potentially contentious political question that demands early resolution. Will this windfall go to the utility, the customer, or no one (because of political paralysis), or will there be some equitable and practical split? A second aspect of inquiry here points to another contemporary issue of very great societal importance that could very well become the platform on which the first question can be resolved fortuitously-how to achieve universal telecommunications service. In the effort to fashion the NII that will now continue, ways and means to maximize the unique potential contribution of electric utilities to meeting important social and economic needs--in particular, universal service--merit priority attention.

    This report describes legal, regulatory, and institutional considerations likely to shape the development and deployment of distributed resources. It is based on research co-sponsored by the National Renewable Energy Laboratory (NREL) and four investor-owned utilities (Central & South West Services, Cinergy Corp., Florida Power Corporation, and San Diego Gas & Electric Company). The research was performed between August 1995 and March 1996 by a team of four consulting firms experienced in energy and utility law, regulation, and economics. It is the survey phase of a project known as the Distributed Resources Institutional Analysis Project.

    The detonation of a radiological dispersal device (RDD) could produce significant social and economic damage, the extent of which would depend largely on how quickly and effectively cleanup levels were established and on public acceptance of those levels. This paper shows that current radiological cleanup laws and regulations, models for converting dose or risk goals to cleanup concentrations, and existing site-specific criteria were not designed specifically for RDD cleanups but, absent changes, would apply by default. The goals and approaches of these legal and methodological structures often conflict; using them in response to terrorism could undermine public confidence, cause delays, and produce unnecessary costs or unacceptable cleanups. RDD cleanups would involve immediate priorities not envisioned in the existing radiological cleanup framework, such as balancing radiation risks with the health, economic, and other societal impacts associated with access to the infrastructure necessary to sustain society (e.g., hospitals, bridges, utilities). To minimize the achievement of terrorism goals, the elements of an RDD cleanup response -- including updating existing legal/regulatory structures to clarify federal authority, goals, and methods for developing RDD cleanup criteria -- must be in place soon; given the complexity of the issues and the potential societal impact, this effort should be expedited.

    This document updates and expands the report with a similar title issued in October 1980. This document examines a number of legal and regulatory issues that potentially can affect implementation of the aquifer thermal energy storage (ATES) concept. This concept involves the storage of thermal energy in an underground aquifer until a later date when it can be effectively utilized. Either heat energy or chill can be stored. Potential end uses of the energy include district space heating and cooling, industrial process applications, and use in agriculture or aquaculture. Issues are examined in four categories: regulatory requirements, property rights, potential liability, and issues related to heat or chill delivery.

    An examination of the economic and legal issues of electric utility relationships with coal suppliers begins with a description of the coal industry and coal's use of power generation. The author analyzes the major economic problems and two legal institutions that are used or could be used to regulate the economic problems. He concludes that neither legal institution is adequate because public utility solutions focus almost exclusively on the cost inflation problem and antitrust solutions have too many common law loopholes. Of the approaches available in the public utility solution, the cost of service approach alone addresses all of the economic problems. However, cost of service also creates a new and more complex set of rate hearings for coal. 1 figure.

    The first phase of the Hualapai Tribal Utility Development Project (Project) studied the feasibility of establishing a tribally operated utility to provide electric service to tribal customers at Grand Canyon West (see objective 1 below). The project was successful in completing the analysis of the energy production from the solar power systems at Grand Canyon West and developing a financial model, based on rates to be charged to Grand Canyon West customers connected to the solar systems, that would provide sufficient revenue for a Tribal Utility Authority to operate and maintain those systems. The objective to establish a central power grid over which the TUA would have authority and responsibility had to be modified because the construction schedule of GCW facilities, specifically the new air terminal, did not match up with the construction schedule for the solar power system. Therefore, two distributed systems were constructed instead of one central system with a high voltage distribution network. The Hualapai Tribal Council has not taken the action necessary to establish the Tribal Utility Authority that could be responsible for the electric service at GCW. The creation of a Tribal Utility Authority (TUA) was the subject of the second objective of the project. The second phase of the project examined the feasibility and strategy for establishing a tribal utility to serve the remainder of the Hualapai Reservation and the feasibility of including wind energy from a tribal wind generator in the energy resource portfolio of the tribal utility (see objective 2 below). It is currently unknown when the Tribal Council will consider the implementation of the results of the study. Objective 1 - Develop the basic organizational structure and operational strategy for a tribally controlled utility to operate at the Tribeā€™s tourism enterprise district, Grand Canyon West. Coordinate the development of the Tribal Utility structure with the development of the Grand Canyon West Power Project construction of the power infrastructure at Grand Canyon West. Develop the maintenance and operations capacity necessary to support utility operations. Develop rates for customers on the Grand Canyon West ā€œmini-gridā€ sufficient for the tribal utility to be self-sustaining. Establish an implementation strategy for tribal utility service at Grand Canyon West Objective 2 - Develop a strategy for tribal utility takeover of electric service on the Reservation. Perform a cost analysis of Reservation electrical service. Develop an implementation strategy for tribal takeover of Reservation electrical service. Examine options and costs associated with integration of the Tribeā€™s wind resources.

The paper in Part I examines definitional questions, assesses in Part II the ability of courts and quasi-courts to evaluate risks associated with the product, examines in Part III the utility of common law remedies for injuries or associated with or arising from LPG, analyzes in Part IV the statutory regulation of LPG, concentrating particularly on the Dangerous Goods (Class 2 - Gases) Regulations 1980, discusses in Part V recent planning case-law concerning LPG development, and concludes that some reform is necessary to produce a more-coherent and precise regulatory regime that takes into account both the needs of developers and those affected by the development of LPG.

Some are establishing subsidiaries to participate in join venture deals with independents. Others are competing by offering lucrative discount or deferral rates to important industrial and commercial customers considering cogeneration. And now, a third approach is beginning to shape up- the disaggregation of generation assets into a separate generation company, or genco. This article briefly discusses these three and also devotes brief sections to functional segmentation and The regulatory arena.

    Today theft of service has become a serious problem for the gas utilities (one utility estimated it to be 10% of its net profit) and many companies have established special departments or units to deal with it. Major factors contributing to gas theft are (1) the price escalation after the 1973-74 oil embargo, (2) high unemployment, (3) poor economic conditions, (4) a general decline in respect for utilities and the law, (5) minimal risk to offenders (customers feel that nothing will happen to them if they get caught), (6) relatively low skill required to illegally restore utility service, and (7) the attitude of getting something for nothing. Some preventive methods now being recommended include the following: (1) the use of computers to scan consumption patterns, (2) unannounced meter readings, and (3) tips from hotline tape recordings and from meter readers, departments, and neighboring utilities.

The first obstacle which any developer must confront in Michigan is obtaining the authority to utilize the river bed, banks, and flowing water at a proposed dam site. This involves a determination of ownership of the stream banks and bed, and the manner of obtaining either their title or use; and existing constraints with regard to the use of the water.     This paper examines the legal issues involved with employer monitoring of employee e-mail. In addition to identifying pertinent legal issues, the paper provides guidelines that will help the Pacific Northwest National Laboratory (PNNL) establish a program for monitoring outgoing e-mail to insure compliance with company policies, particularly those regarding protection of trade secrets and proprietary information, and to comply with the Department of Energy`s (DOE) procedures for protecting Export Controlled Information (ECI). Electronic communication has allowed companies to enhance efficiency, responsiveness and effectiveness. E-mail allows employees to transmit all types of data to other individuals inside and outside of their companies. The ease with which information can be transmitted by e-mail has placed trade secrets, proprietary information, and other sensitive data at risk from inadvertent disclosure by employees. As employers attempt to protect their interests through measures such as monitoring e-mail, they may expose themselves to liability under federal and state laws for violating employee privacy. Business use of e-mail has proliferated so rapidly that the federal and state legal systems have not been able to adequately address the issues arising out of its use in the workplace.

    This guide deals primarily with the economics of electric utilities, although certain legal and organizational aspects of utilities are discussed. Each of the seven chapters addresses a particular facet of public-utility ratemaking. Chapter One contains a discussion of the evolution of the public-utility concept, as well as the legal and economic justification for public utilities. The second chapter sets forth an analytical economic model which provides the basis for the next four chapters. These chapters contain a detailed examination of total operating costs, the rate base, the rate of return, and the rate structure. The final chapter discusses a number of current issues regarding electric utilities, mainly factors related to fuel-adjustment costs, advertising, taxes, construction work in progress, and lifeline rates. Some of the examples used in the Guide are from particular states, such as Illinois and California. These examples are used to illustrate specific points. Consumers in other states can generalize them to their states and not change the meaning or significance of the points. 27 references, 8 tables.

    The objectives identified in requesting and utilizing this funding has been met. The goal was to establish a formal, multi-jurisdictional organization to: (1) ensure the policy objectives of the participating jurisdictions are addressed through increased tradability of the Renewable Energy Credits (RECs) from M-RETS and to eliminate the possibility that a single jurisdiction will be the sole arbiter of the operation of the system; (2) facilitate the establishment of REC standards including the attributes related to, the creation, trading, and interaction with other trading and tracking systems; and (3) have a centralized and established organization that will be responsible for the contracting and governance responsibilities of a multi-jurisdictional tracking system. The M-RETS Inc. Board ensures that the system remains policy neutral; that the attributes of generation are tracked in a way that allows the system users to easily identify and trade relevant RECs; that the system can add jurisdictions as needed or desired; and that the tracking system operate in such a way to allow for the greatest access possible for those participating in other tracking or trading systems by allowing those systems to negotiate with a single M-RETS entity for the import and export of RECs. M-RETS as an organizational body participates and often leads the discussions related to the standardization of RECs and increasing the tradability of M-RETS RECs. M-RETS is a founding member of the Environmental Trading Network of North America (ETNNA) and continues to take a leadership role in the development of processes to facilitate trading among tracking systems and to standardize REC definitions. The Board of Directors of M-RETS, Inc., the non-profit corporation, continues to hold telephone/internet Board meetings. Legal counsel continues working with the board and APX management on a new agreement with APX. The board expects to have an agreement and corresponding fee structure in place by January 2011. The Board has recently approved exports to three other tracking systems and is in discussions about imports to the system.     The purpose of DOE Handbook, Establishing Nuclear Facility Drill Programs, is to provide DOE contractor organizations with guidance for development or modification of drill programs that both train on and evaluate facility training and procedures dealing with a variety of abnormal and emergency operating situations likely to occur at a facility. The handbook focuses on conducting drills as part of a training and qualification program (typically within a single facility), and is not intended to included responses of personnel beyond the site boundary, e.g. Local or State Emergency Management, Law Enforcement, etc. Each facility is expected to develop its own facility specific scenarios, and should not limit them to equipment failures but should include personnel injuries and other likely events. A well-developed and consistently administered drill program can effectively provide training and evaluation of facility operating personnel in controlling abnormal and emergency operating situations. To ensure the drills are meeting their intended purpose they should have evaluation criteria for evaluating the knowledge and skills of the facility operating personnel. Training and evaluation of staff skills and knowledge such as component and system interrelationship, reasoning and judgment, team interactions, and communications can be accomplished with drills. The appendices to this Handbook contain both models and additional guidance for establishing drill programs at the Department`s nuclear facilities.

    The Public Utilities Regulatory Policies Act (PURPA) of 1979 requires that electrical utilities interconnect with qualifying facilities and purchase electricity at a rate based upon their full avoided costs (i.e., costs of providing both capacity and energy). Qualifying facilities (QF) include solar or geothermal electric units, hydropower, municipal solid waste or biomass-fired power plants, and cogeneration projects that satisfy maximum size, fuel use, ownership, location, and/or efficiency criteria. In Washington State, neither standard power purchase prices based upon a proxy ''avoided plant'', standard contracts, or a standard offer process have been used. Instead, a variety of power purchase contracts have been negotiated by developers of qualifying facilities with investor-owned utilities, public utility districts, and municipally-owned and operated utilities. With a hydro-based system, benefits associated with resource acquisition are determined in large part by how compatible the resource is with a utility's existing generation mix. Power purchase rates are negotiated and vary according to firm energy production, guarantees, ability to schedule maintenance or downtime, rights of refusal, power plant purchase options, project start date and length of contract; front-loading or levelization provisions; and the ability of the project to provide ''demonstrated'' capacity. Legislation was also enacted which allows PURPA to work effectively. Initial laws established ownership rights and provided irrigation districts, PUDs, and municipalities with expanded enabling powers. Financial processes were streamlined and, in some cases, simplified. Finally, laws were passed which are designed to ensure that development proceeds in an environmentally acceptable manner. In retrospect, PURPA has worked well within Washington. In the state of Washington, 20 small-scale hydroelectric projects with a combined generating capacity of 77 MW, 3 solid waste-to-energy facilities with 55 MW of electrical output, 4 cogeneration projects with 34.5 MW of generating capability, and 4 wastewater treatment facility digester gas-to-energy projects with 5 MW of electrical production have come on-line (or are in the final stages of construction) since the passage of PURPA. These numbers represent only a small portion of Washington's untapped and underutilized cogeneration and renewable resource generating potentials. [DJE-2005

    The legal and institutional obstacles to the development of small-scale hydroelectric energy at the state level are discussed. The Federal government also exercises extensive regulatory authority in the area, and the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC is examined. The first step the small scale hydroelectric developer must take is that of acquiring title to the real property comprising the development site. The real estate parcel must include the requisite interest in the land adjacent to the watercourse, access to the underlying streambed and where needed, the land necessary for an upstream impoundment area. Land acquisition may be effectuated by purchase, lease, or grant by the state. In addition to these methods, New York permits the use of the eminent domain power of the state for public utilities under certain circumstances.

    The purpose of the Utility Applications Program is to provide information and assistance to interested utilities on central station energy storage systems. Compressed air and underground pumped hydroelectric energy storage are the primary technical focus. Smaller utilities are the primary targets of this program, as they may not have resources to track and utilize new energy conservation developments. The program, initiated during this year-long period, consists of a series of tasks integrating and supporting energy storage implementation. Program management and technical coordination activities monitor the wide range of research ongoing both under government support and in industry and provide a locus for dissemination of results. Recently completed DOE demonstration studies provide the central data base and the DOE CAES and UPH Technology Program activities provide another major resource. In addition a UPH preliminary feasibility study in coorination with Central Vermont Public Servie (CVPS), a Northeast utility, was carried out. The major program activity this period was a comprehensive technology assessment and environmental siting study, performed in coordination with the Soyland Power Cooperative in Decatur, Illinois. The reports from this work established solid siting precedents for CAES application in the US and jointly assisted the utility in assembling the required baseline information for ongoing technical and financial development of the first US compressed air energy storage facility.

    The social and legal framework within which bioremediation technologies must be researched, developed, and deployed in the US are discussed in this report. Discussions focus on policies, laws and regulations, intellectual property, technology transfer, and stakeholder concerns. These discussions are intended to help program managers, scientists and engineers understand the social and legal framework within which they work, and be cognizant of relevant issues that must be navigated during bioremediation technology research, development, and deployment activities. While this report focuses on the legal and social environment within which the DOE operates, the laws, regulations and social processes could apply to DoD and other sites nationwide. This report identifies specific issues related to bioremediation technologies, including those involving the use of plants; native, naturally occurring microbes; non-native, naturally occurring microbes; genetically engineered organisms; and microbial products (e.g., enzymes, surfactants, chelating compounds). It considers issues that fall within the following general categories: US biotechnology policy and the regulation of field releases of organisms; US environmental laws and waste cleanup regulations; intellectual property and patenting issues; technology transfer procedures for commercializing technology developed through government-funded research; stakeholder concerns about bioremediation proposals; and methods for assuring public involvement in technology development and deployment.

    The Schatz Energy Research Center (SERC) assisted the Yurok Tribe in investigating the feasibility of creating a permanent energy services program for the Tribe. The original purpose of the DOE grant that funded this project was to determine the feasibility of creating a full-blown Yurok Tribal electric utility to buy and sell electric power and own and maintain all electric power infrastructure on the Reservation. The original project consultant found this opportunity to be infeasible for the Tribe. When SERC took over as project consultant, we took a different approach. We explored opportunities for the Tribe to develop its own renewable energy resources for use on the Reservation and/or off-Reservation sales as a means of generating revenue for the Tribe. We also looked at ways the Tribe can provide energy services to its members and how to fund such efforts. We identified opportunities for the development of renewable energy resources and energy services on the Yurok Reservation that fall into five basic categories: ā€¢ Demand-side management ā€“ This refers to efforts to reduce energy use through energy efficiency and conservation measures. ā€¢ Off-grid, facility and household scale renewable energy systems ā€“ These systems can provide electricity to individual homes and Tribal facilities in areas of the Reservation that do not currently have access to the electric utility grid. ā€¢ Village scale, micro-grid renewable energy systems - These are larger scale systems that can provide electricity to interconnected groups of homes and Tribal facilities in areas of the Reservation that do not have access to the conventional electric grid. This will require the development of miniature electric grids to serve these interconnected facilities. ā€¢ Medium to large scale renewable energy development for sale to the grid ā€“ In areas where viable renewable energy resources exist and there is access to the conventional electric utility grid, these resources can be developed and sold to the wholesale electricity market. ā€¢ Facility scale, net metered renewable energy systems ā€“ These are renewable energy systems that provide power to individual households or facilities that are connected to conventional electric utility grid.

    Natural resource damages liability is a major development in environmental law. Government authorities are increasingly seeking damage claims for injury to natural resources, invoking the natural resource damages (NRD) provisions of the federal Superfund statute and the Oil Pollution Act. The number of Claims asserted is increasing, and the amounts sought range to hundreds of millions of dollars, with some claims exceeding $1 billion. Some assert that the federal NRD program is an awakening sleeping giant that could threaten to rival the Superfund cleanup program in cost and the potential for imposing far-reaching liabilities on a wide range of businesses as well as the federal government. Lawyers, economists, and other experts on NRD have become fully engaged in comprehensive analyses of the legal, economic and policy issues presented by NRD claims, including a full review of the NRD litigating record. Many critics find that existing NRD law and practice is flawed; produces excessive liability claims, skewed incentives and economic waste; and urgently needs reform. Changes have been recommended to improve the law and refocus the NRD program on achieving cost-effective restoration of injured natural resources. These analytical endeavors are especially timely because Congress is currently considering significant changes in NRD law. This overview will provide a brief background summary of the NRD program and highlight some of the central legal and scientific issues facing government policy makers and litigants in NRD cases.

    This Energy & Environmental Research Center (EERC) Year 2 Biomass Utilization Final Technical Report summarizes multiple projects in biopower or bioenergy, transportation biofuels, and bioproducts. A prototype of a novel advanced power system, termed the high-temperature air furnace (HITAF), was tested for performance while converting biomass and coal blends to energy. Three biomass fuels--wood residue or hog fuel, corn stover, and switchgrass--and Wyoming subbituminous coal were acquired for combustion tests in the 3-million-Btu/hr system. Blend levels were 20% biomass--80% coal on a heat basis. Hog fuel was prepared for the upcoming combustion test by air-drying and processing through a hammer mill and screen. A K-Tron biomass feeder capable of operating in both gravimetric and volumetric modes was selected as the HITAF feed system. Two oxide dispersion-strengthened (ODS) alloys that would be used in the HITAF high-temperature heat exchanger were tested for slag corrosion rates. An alumina layer formed on one particular alloy, which was more corrosion-resistant than a chromia layer that formed on the other alloy. Research activities were completed in the development of an atmospheric pressure, fluidized-bed pyrolysis-type system called the controlled spontaneous reactor (CSR), which is used to process and condition biomass. Tree trimmings were physically and chemically altered by the CSR process, resulting in a fuel that was very suitable for feeding into a coal combustion or gasification system with little or no feed system modifications required. Experimental procedures were successful for producing hydrogen from biomass using the bacteria Thermotoga, a deep-ocean thermal vent organism. Analytical procedures for hydrogen were evaluated, a gas chromatography (GC) method was derived for measuring hydrogen yields, and adaptation culturing and protocols for mutagenesis were initiated to better develop strains that can use biomass cellulose. Fly ash derived from cofiring coal with waste paper, sunflower hulls, and wood waste showed a broad spectrum of chemical and physical characteristics, according to American Society for Testing and Materials (ASTM) C618 procedures. Higher-than-normal levels of magnesium, sodium, and potassium oxide were observed for the biomass-coal fly ash, which may impact utilization in cement replacement in concrete under ASTM requirements. Other niche markets for biomass-derived fly ash were explored. Research was conducted to develop/optimize a catalytic partial oxidation-based concept for a simple, low-cost fuel processor (reformer). Work progressed to evaluate the effects of temperature and denaturant on ethanol catalytic partial oxidation. A catalyst was isolated that had a yield of 24 mole percent, with catalyst coking limited to less than 15% over a period of 2 hours. In biodiesel research, conversion of vegetable oils to biodiesel using an alternative alkaline catalyst was demonstrated without the need for subsequent water washing. In work related to biorefinery technologies, a continuous-flow reactor was used to react ethanol with lactic acid prepared from an ammonium lactate concentrate produced in fermentations conducted at the EERC. Good yields of ester were obtained even though the concentration of lactic acid in the feed was low with respect to the amount of water present. Esterification gave lower yields of ester, owing to the lowered lactic acid content of the feed. All lactic acid fermentation from amylose hydrolysate test trials was completed. Management activities included a decision to extend several projects to December 31, 2003, because of delays in receiving biomass feedstocks for testing and acquisition of commercial matching funds. In strategic studies, methods for producing acetate esters for high-value fibers, fuel additives, solvents, and chemical intermediates were discussed with several commercial entities. Commercial industries have an interest in efficient biomass gasification designs but are waiting for economic incentives. Utility, biorefinery, pulp and paper, or other industries are interested in lignin as a potential fuel or feedstock but need more information on properties.

Vertical axis wind turbines for education and research have been acquired, instrumented and installed on the roof top of a building on the Calumet campus and at West Lafayette (Kepner Lab). Computational Fluid Dynamics (CFD) calculations have been performed to simulate these urban wind environments. Also, modal dynamic testing of the West Lafayette VAWT has been performed and a novel horizontal axis design initiated. The 50-meter meteorological tower data obtained at the Purdue Beck Agricultural Research Center have been analyzed and the Purdue Reconfigurable Micro Wind Farm established and simulations directed at the investigation of wind farm configurations initiated. The virtual wind turbine and wind turbine farm simulation in the Visualization Lab has been initiated.

    Since 1972 Niagara Mohawk Power Co. has established a utility corridor, installing 503 miles of buried gas mains and electric cables in a common trench. Their guidelines for common trenching included (1) the developer's responsibility for providing a subdivision map showing the location of each sidewalk, lot, and roadway, (2) an easement strip paralleling the front lot (street) line that is to be cleared and graded by the developer before construction is started, (3) an electric planning department to prepare detailed construction drawings, coordinate plans with other utilities, determine the responsibility for trenching and backfilling, and determine that all the necessary easements have been secured, and (4) construction specifications varying the width and depth of the trench with the number and type of utilties occupying the joint trench. Advantages of the common trench program comprise reduced exposure to digups, communication and concern for each utility's facility, water and sewer construction installed before the common trench, and cost sharing that would reduce each facility's construction and restoration costs.

    The study describes the results of a survey of 547 local water supply systems serving some 31 million residents of urban areas in the states of Alabama, California, Florida, Oklahoma, Tennessee and Wyoming. While examining the legal and administrative aspects of drought management, the survey also included the assessment of the current status of drought preparedness and long-term drought protection among the responding water supply systems. The rate of legal or administrative problems encountered during drought response was surprisingly low, affecting only twenty percent of all implementing systems. The low incidence of difficulties counters a widespread assumption that the legal environment frequently restrains or constricts drought response efforts.

    The introduction of ergonomics is an ongoing effort in industrially developing countries and will ultimately require an organized, programmatic approach spanning several countries and organizations. Our preliminary efforts with our partner countries of Viet Nam, Thailand, and Nicaragua have demonstrated that a one-time course is just the first step in a series of necessary events to provide skills and create an infrastructure that will have lasting impact for the host country. To facilitate that any sort of training has a lasting impact, it is recommended that host countries establish a 'contract' with class participants and the guest instructors for at least one follow-up visit so instructors can see the progress and support the participants in current and future efforts. With repeated exchanges, the class participants can become the 'in country experts' and the next generation of ergonomic trainers. Additionally, providing participants with an easy to use hazard assessment tool and methods for evaluating the financial impact of the project (cost/benefit analysis) will assist increase the likelihood of success and establish a foundation for future projects. In the future, developing trade and regionally/culturally specific 'ergonomics toolkits' can help promote broader implementation, especially where training resources may be limited.

    Tucson Electric Power (TEP) developed, tested and verified the results of a new and appropriate method for accurately evaluating the capacity credit of time variant solar generating sources and reviewed new methods to appropriately and fairly evaluate the value of solar generation to electric utilities. The project also reviewed general integrated approaches for adequately compensating owners of solar generation for their benefits to utilities. However, given the limited funding support and time duration of this project combined with the significant differences between utilities regarding rate structures, solar resource availability and coincidence of solar generation with peak load periods, it is well beyond the scope of this project to develop specific rate, rebate, and interconnection approaches to capture utility benefits for all possible utilities. The project developed computer software based evaluation method models to compare solar generation production data measured in very short term time increments called Sample Intervals over a typical utility Dispatch Cycle during an Evaluation Period against utility system load data. Ten second resolution generation production data from the SGSSS and actual one minute resolution TEP system load data for 2006 and 2007, along with data from the Pennington Street Garage 60 kW DC capacity solar unit installed in downtown Tucson will be applied to the model for testing and verification of the evaluation method. Data was provided by other utilities, but critical time periods of data were missing making results derived from that data inaccurate. The algorithms are based on previous analysis and review of specific 2005 and 2006 SGSSS production data. The model was built, tested and verified by in house TEP personnel. For this phase of the project, TEP communicated with, shared solar production data with and collaborated on the development of solar generation valuation tools with other utilities, including Arizona Public Service, Salt River Project, Xcel and Nevada Power Company as well as the Arizona electric cooperatives. In the second phase of the project, three years of 10 second power output data of the SGSSS was used to evaluate the effectiveness of frequency domain analysis, normal statistical distribution analysis and finally maximum/minimum differential output analysis to test the applicability of these mathematic methods in accurately modeling the output variations produced by clouds passing over the SGSSS array.

    Building on the two previous trips to Central America last year, International Power Institute (IPI) and its partner Tennessee Valley Infrastructure Group (TVIG) have focused their attention this quarter on project sites in Honduras. TVIG's unit--an Integrated Infrastructure Platform or IIP--combines water and electricity production in a single integrated unit, thereby providing both products at a lower cost than could be attained for each one separately. Because of the unmet demand for clean drinking water and electricity in remote towns throughout the developing world, the need for such units is widespread. Previous visits to Honduras have resulted in strong in-country commercial interest, support in the form of memorandums of understanding by key government agencies, and identification of four prospective project sites for IIP installations. From March 5 to March 15 and with IPI support and participation, representatives from the TVIG, Tennessee Valley Authority (TVA), IPI, and market research firm International Business Initiatives (IBI) conducted an intensive survey of project opportunities in the four communities, to establish how IIPs might help these four communities enhance their economic development, A key aspect of the projects examined is the need to make them economically self-supporting so that they will be viable in the private sector. Summary of specific project site studies follow here, and feasibility studies for the four sites are included as attachments.

    Battery testing procedures are important for understanding battery performance, including degradation over the life of the battery. Standards are important to provide clear rules and uniformity to an industry. The work described in this report addresses the need for standard battery testing procedures that reflect real-world applications of energy storage systems to provide regulation services to grid operators. This work was motivated by the need to develop Vehicle-to-Grid (V2G) testing procedures, or V2G drive cycles. Likewise, the stationary energy storage community is equally interested in standardized testing protocols that reflect real-world grid applications for providing regulation services. As the first of several steps toward standardizing battery testing cycles, this work focused on a statistical analysis of frequency regulation signals from the Pennsylvania-New Jersey-Maryland Interconnect with the goal to identify patterns in the regulation signal that would be representative of the entire signal as a typical regulation data set. Results from an extensive time-series analysis are discussed, and the results are explained from both the statistical and the battery-testing perspectives. The results then are interpreted in the context of defining a small set of V2G drive cycles for standardization, offering some recommendations for the next steps toward standardizing testing protocols.

A combination of the standard single-effect and a double-lift process has been identified as a new cycle that can use driving heat down to return temperatures of about 55 C (131 F) and permits temperature glides in generation of more than 30 K (54 F). Thus a larger cooling capacity can be produced from the same heat source compared to a single-effect chiller run with the same heat carrier supply temperature and mass flow. According to the estimated heat exchanger area, competitive machine costs for this new chiller can be expected. This single-effect/double-lift absorption chiller can be operated with waste heat from industrial processes, as well as with low-temperature heat (e.g., heat from solar collectors) as driving heat for air conditioning. The large temperature glide and the low return temperature especially fit the operating conditions in district heating networks during the summer. The cycle will be presented, followed by a discussion of suitable operating conditions.

    This report presents data and analyses related to Phase I implementation of the Clean Air Act Amendment by electric utilities. It describes the strategies used to comply with the Acid Rain Program in 1995, the effect of compliance on sulfur dioxide emissions levels, the cost of compliance, and the effects of the program on coal supply and demand. The first year of Phase I demonstrated that the market-based sulfur dioxide emissions control system could achieve significant reductions in emissions at lower than expected costs. Some utilities reduced aggregate emissions below legal requirements due to economic incentives; other utilities purchased additional allowances to avoid noncompliance. More than half of the utilities switched to or blended with lower sulfur coal, due to price reductions in the coal market which were partially due to the allowance trading program. 21 figs., 20 tabs.

    The market for Integrated Gasification Combined Cycle (IGCC) power plants is discussed and some of the experiments with an Integrated Gasification Combined Cycle Power Plant Project, Polk Unit {number_sign}1 are described. It was found that not only is the technology different from what most US utilities are accustomed to, but also that the non-technical issues or business issues, such as contracting, project management and contract administration also have different requirements. The non-technical or business issues that are vital to the successful commercialization of this technology are described. These business issues must be successfully addressed by both the utilities and the technology suppliers in order for integrated gasification combined cycle power plants to achieve commercial success.

    In this article we consider, under a Levy process model for the stock price, the utility optimization problem for an insider agent whose additional information is the final price of the stock blurred with an additional independent noise which vanishes as the final time approaches. Our main interest is establishing conditions under which the utility of the insider is finite. Mathematically, the problem entails the study of a 'progressive' enlargement of filtration with respect to random measures. We study the jump structure of the process which leads to the conclusion that in most cases the utility of the insider is finite and his optimal portfolio is bounded. This can be explained financially by the high risks involved in models with jumps.

    The rapid growth of the small wind turbine (SWT) market is attracting numerous entrants. Small wind turbine purchasers now have many options, but often lack information (such as third-party certification) to select a quality turbine. Most SWTs do not have third-party certification due to the expense and difficulty of the certification process. Until recently, the only SWT certification bodies were in Europe. In North America, testing has been limited to a small number of U.S. Department of Energy (DOE) subsidized tests conducted at the National Renewable Energy Laboratory's (NREL) National Wind Technology Center (NWTC) under the ongoing Independent Testing Project. During the past few years, DOE, the National Renewable Energy Laboratory (NREL), and some states have worked with the North American SWT industry to create a SWT certification infrastructure. The goal is to increase the number of certified turbines and gain greater consumer confidence in SWT technology. The American Wind Energy Association (AWEA) released the AWEA Small Wind Turbine Performance and Safety Standard, AWEA Standard 9.1 - 2009, in December 2009. The Small Wind Certification Council (SWCC) and Intertek, North American SWT certification bodies, began accepting applications for certification to the AWEA standard in 2010. To reduce certification testing costs, DOE and NREL are providing financial and technical assistance for an initial round of tests at four SWT test sites, which were selected through a competitive solicitation. The four organizations selected are Windward Engineering (Utah), The Alternative Energy Institute at West Texas A and M (Texas), a consortium consisting of Kansas State University and Colby Community College (Kansas), and Intertek (New York). Each organization will test two small wind turbines as part of their respective subcontracts with DOE and NREL. The testing results will be made publically available. The goal is to establish a lower-cost U.S. small wind testing capability that will lead to increased SWT certification. Turbine installation is ongoing. Testing began in early 2011 and is scheduled to conclude in mid-late 2012.

    In order to understand the benefits of cogeneration -- the on site production of electricity and hot water -- it is beneficial to know the overall efficiency of the energy media presently being used when compared to cogeneration. Virtually every commercial and industrial establishment purchases their electricity from the local utility company and heat their water by using on site boilers and hot water heaters fired by natural gas or propane -- which they also purchase from an outside supplier. When on-site cogeneration is compared to purchased power the results in fuel usage efficiency are: cogeneration -- 89.2%; purchased power -- 52.6%. The overall result of on site, properly applied cogeneration is an economical, environmental, and conservational tool that preserves an establishment`s cash, helps reduce pollution and conserves a precious natural resource.

    This report examines the current policy, legal, and regulatory framework pertaining to used nuclear fuel and high level waste management in the United States. The goal is to identify potential changes that if made could add flexibility and possibly improve the chances of successfully implementing technical aspects of a nuclear waste policy. Experience suggests that the regulatory framework should be established prior to initiating future repository development. Concerning specifics of the regulatory framework, reasonable expectation as the standard of proof was successfully implemented and could be retained in the future; yet, the current classification system for radioactive waste, including hazardous constituents, warrants reexamination. Whether or not consideration of multiple sites are considered simultaneously in the future, inclusion of mechanisms such as deliberate use of performance assessment to manage site characterization would be wise. Because of experience gained here and abroad, diversity of geologic media is not particularly necessary as a criterion in site selection guidelines for multiple sites. Stepwise development of the repository program that includes flexibility also warrants serious consideration. Furthermore, integration of the waste management system from storage, transportation, and disposition, should be examined and would be facilitated by integration of the legal and regulatory framework. Finally, in order to enhance acceptability of future repository development, the national policy should be cognizant of those policy and technical attributes that enhance initial acceptance, and those policy and technical attributes that maintain and broaden credibility.

    Multilayer assemblies of epitaxially-grown, III-V semiconductor materials are being investigated for use in thermophotovoltaic (TPV) energy conversion applications. It has been observed that thick, highly-doped semiconductor layers within cell architectures dominate the parasitic free-carrier absorption (FCA) of devices at wavelengths above the bandgap of the semiconductor material. In this work, the wavelength-dependent, free-carrier absorption of p- and n-type InGaAs layers grown epitaxially onto semi-insulating (SI) InP substrates has been measured and related to the total absorption of long-wavelength photons in thermophotovoltaic devices. The optical responses of the TPV cells are then used in the calculation of spectral utilization factors and device efficiencies.

    In the twentieth century, coal has become the major fuel for electric power generation in the U.S. and most of the nonpetroleum-producing countries of the world. In 1998, the world coal-fired capacity for electric power generation was about 815 GW, consuming large quantities of coals of all ranks. Today, coal provides a third of the world`s energy requirements. In fact, coal use for power generation has grown steadily since the oil embargo in 1973 and has seen an even faster rate of growth in recent years. It has been reported that the global demand for new coal will increase by more than 1500 million tons by the year 2000. However, this increased production of coal has its drawbacks, including the concomitant production of coal waste. Reported estimates indicate that billions of tons of coal waste have already been disposed of in waste impoundments throughout the U.S. Further, in the U.S. today, about 20-25 % of each ton of mined coal is discarded by preparation plants as gob and plant tailings. It appears that the most economical near-term approach to coal waste recovery is to utilize the waste coal fines currently discarded with the refuse stream, rather than attempt to recover coal from waste impoundments that require careful prior evaluation and site preparation. A hypothetical circuit was designed to examine the economics of recovery and utilization of waste coal fines. The circuit recovers products from 100 tons per hour (tph) of coal waste feed recovering 70 tph of fine coal that can be used in coal-fired boilers. The present analysis indicates that the coal waste recovery is feasible and economical. In addition, significant environmental benefits can be expected.

    A certificate of graduate studies in Biobased Industrial Products is to be established at Kansas State University (KSU) along with the development of a similar program at Pittsburg State University, Pittsburg, KS. At KSU, the program of study will be coordinated through the steering committee of the Agricultural Products Utilization Forum (APUF); the certificate of graduate studies will be awarded through the Graduate School of Kansas State University. This certificate will establish an interdisciplinary program of study that will: (1) ensure participating students receive a broad education in several disciplines related to Biobased Industrial Products, (2) provide a documented course of study for students preferring a freestanding certificate program, and (3) provide a paradigm shift in student awareness away from petroleum-based feedstocks to the utilization of renewable resources for fuels and chemical feedstocks. The academic program described herein will accomplish this goal by: (1) providing exposure to several academic disciplines key to Biobased Industrial Products; (2) improving university/industry collaboration through an external advisory board, distance learning opportunities, and student internships; (3) expanding the disciplines represented on the students' supervisory committee; (4) establishing a seminar series on Biobased Industrial Products that draws upon expert speakers representing several disciplines; and (5) increasing collaboration between disciplines. Numerous research programs emphasizing Biobased Industrial Products currently exist at KSU and PSU. The certificate of graduate studies, the emphasis on interdisciplinary collaboration within the students? thesis research, the proposed seminar series, and formation of an industrial advisory board will: (1) provide an interdisciplinary academic experience that spans several departments, four colleges, four research centers, and two universities; (2) tangibly promote collaboration between KSU and PSU; (3) catalyze involvement of plant geneticists with researchers active in the development and utilization of biobased industrial products; and, (4) promote university/industry collaboration.

    This paper uses the Residential Energy Consumption Survey undertaken by the Energy Information Administration in 1990 to estimate the statistical association between household income and participation in electric utility energy conservation programs and the association between participation and the electricity consumption. The results indicate that utility rebates, energy audits, load management programs and other conservation measures tend to be undertaken at greater frequency by high income households than by low income households. Participants in conservation programs tend to occupy relatively new and energy efficient residences and undertake conservation measures other than utility programs, which suggests that utility sponsored programs are substitutes for other conservation investments. Electricity consumption during 1990 is not significantly less for households participating in utility programs than for nonparticipants, which also implies that utility conservation programs are displacing other conservation investments. Apparently, utility programs are not avoiding costs of new construction and instead are transferring wealth, particularly to high income participating households.

    This report is a legal study prepared to provide a review of the substantive and procedural laws of each regulatory jurisdiction that may affect implementation of the PURPA standards, and to summarize the current state of consideration and implementation of policies and rate designs similar or identical to the PURPA standards by state regulatory agencies and nonregulated utilities. This report is divided into three sections. The first section, the Introduction, summarizes the standards promulgated by PURPA and the results of the legal study. The second section, State Regulatory Law and Procedure, summarizes for each state or other ratemaking jurisdiction: (1) general constitutional and statutory provisions affecting utility rates and conditions of service; (2) specific laws or decisions affecting policy or rate design issues covered by PURPA standards; and (3) statutes and decisions governing administrative procedures, including judicial review. A chart showing actions taken on the policy and rate design issues addressed by PURPA is also included for each jurisdiction, and citations to relevant authorities are presented for each standard. State statutes or decisions that specifically define a state standard similar or identical to a PURPA standard, or that refer to one of the three PURPA objectives, are noted. This paper will begin by providing a historical background to current disarmament and denuclearization treaties. This paper will discuss the current legal framework based on current and historical activities related to denuclearization and nuclear disarmament. Then, it will propose paths forward for the future efforts, and describe the necessary legal considerations. Each treaty or agreement will be examined in respect to its requirements for: 1) limitations and implementation; 2) and verification and monitoring. Then, lessons learned in each of the two areas (limitations and verification) will be used to construct a proposed path forward at the end of this paper.

    Salt caverns can be formed through solution mining in the bedded or domal salt formations that are found in many states. Salt caverns have traditionally been used for hydrocarbon storage, but caverns have also been used to dispose of some types of wastes. This paper provides an overview of several years of research by Argonne National Laboratory on the feasibility and legality of using salt caverns for disposing of oil field wastes, the risks to human populations from this disposal method, and the cost of cavern disposal. Costs are compared between the four operating US disposal caverns and other commercial disposal options located in the same geographic area as the caverns. Argonne`s research indicates that disposal of oil field wastes into salt caverns is feasible and legal. The risk from cavern disposal of oil field wastes appears to be below accepted safe risk thresholds. Disposal caverns are economically competitive with other disposal options.

    In the early 1990s, only a handful of utilities offered their customers a choice of purchasing electricity generated from renewable energy sources. Today, more than 750 utilities--or about 25% of all utilities nationally--provide their customers a "green power" option. Through these programs, more than 70 million customers have the ability to purchase renewable energy to meet some portion or all of their electricity needs--or make contributions to support the development of renewable energy resources. Typically, customers pay a premium above standard electricity rates for this service. This report presents year-end 2006 data on utility green pricing programs, and examines trends in consumer response and program implementation over time. The data in this report, which were obtained via a questionnaire distributed to utility green pricing program managers, can be used by utilities to benchmark the success of their green power programs.

    This report presents year-end 2005 data on utility green pricing programs, and examines trends in consumer response and program implementation over time. The data in this report, which were obtained via a questionnaire distributed to utility green pricing program managers, can be used by utilities to benchmark the success of their green power programs. It is important to note that this report covers only a portion of voluntary markets for renewable energy. It does not cover green power sold by independent marketers except for cases in which the marketers work in conjunction with utilities or default electricity suppliers.

    The Utility flue gas desulfurization (FGD) Survey report, which is generated by a computerized data base management system, represents a survey of operational and planned domestic utility flue gas desulfurization (FGD) systems. It summarizes information contributed by the utility industry, system and equipment suppliers, system designers, research organizations, and regulatory agencies. The data cover system design, fuel characteristics, operating history, and actual system performance. Also included is a unit-by-unit discussion of problems and solutions associated with the boilers, scrubbers, and FGD systems. The development status (operational, under construction, or in the planning stages), system supplier, process, waste disposal practice, and regulatory class are tabulated alphabetically by utility company.
