    Utility-scale solar projects have grown rapidly in number and size over the last few years, driven in part by strong renewable portfolio standards (RPS) and federal incentives designed to stimulate investment in renewable energy technologies. This report provides an overview of such policies, as well as the project financial structures they enable, based on industry literature, publicly available data, and questionnaires conducted by the National Renewable Energy Laboratory (NREL).

    This report is an analysis of the issues confronting US energy policymakers and the US geothermal industry as the result of the implementation and interpretation of the 1978 Public Utility Regulatory Policies Act, commonly known as PURPA. It seeks to answer four sets of questions about PURPA: (1) What has the existence of PURPA meant to the US geothermal industry. (2) How has the interpretation of PURPA evolved over the past decade. (3) What particular portions of PURPA rule making have been most crucial to the growth and development of the geothermal industry. (4) What aspects of PURPA have been most troubling to utilities purchasing or developing geothermal energy.

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

    The idea to do this research was suggested by the efforts of some consumer groups and others to seek passage of a law in the United States to exempt investor-owned electric utilities from federal income taxes. The goal of the consumer groups is to reduce the charges to utility customers (which is measured in this study by the amount of the operating revenues of the utilities) while not causing any harm to the utilities. The population of interest consisted of all investor-owned electric utilities included on a current Compustat utility tape. In the analysis of the data, the changes in cash flow, operating revenue, and net income were summarized by the 89 utilities as a total group and by the division of the utilities into smaller groups or combinations which used the same accounting methods during the test period. The results of this research suggest the following conclusions concerning the change to a situation in which electric utilities are not subject to federal income taxes: (1) as a group, the decrease in cash flow would be significant, (2) as a group, the decrease in operating revenue (charges to customers) would not be significant, (3) as a group, the increase in net income would be significant, and (4) in analyzing the effects of any financial adjustments or changes on electric utilities, the accounting policies used to the utilities are an important factor.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    Since the mid-1990s the governments of the United States (U.S.) and the Russian Federation (RF) have been collaborating on nonproliferation projects, particularly in the protection of nuclear material through the Department of Energy's (DOE) National Nuclear Security Administration (NNSA). To date, this collaboration has resulted in upgrades to more than 72 RF Ministry of Defense (MOD) sensitive sites and facilities. These upgrades include physical protection systems (PPS), facilities to ensure material remains secure in various configurations, and infrastructure to support, maintain, and sustain upgraded sites. Significant effort on the part of both governments has also been expended to ensure that personnel obtain the necessary skills and training to both operate and maintain the security systems, thereby ensuring long term sustainability. To accomplish this, initial vendor training on physical protection systems was provided to key personnel, and an approved training curriculum was developed to teach the skills of operating, managing, administering, and maintaining the installed physical protection systems. This approach also included documentation of the processes and procedures to support infrastructure, requisite levels of maintenance and testing of systems and equipment, lifecycle management support, inventory systems and spare parts caches. One of the core components in the U.S. exit strategy and full transition to the RF MOD is the development and utilization of regional centers to facilitate centralized training and technical support to upgraded MOD sites in five regions of the RF. To date, two regional centers and one regional classroom facility are functional, and two additional regional centers are currently under construction. This paper will address the process and logistics of regional center establishment and the future vision for integrated regional center support by the RF MOD.

    The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. This supplement contains review comments prepared by knowledgeable experts who reviewed early drafts of the Congressional report. Responses to the review comments by the Jet Propulsion Laboratory, preparer of the Congressional report, are also included in this supplement.     Washington State's geothermal potential is wide spread. Hot springs and five strato volcanoes existing throughout the Cascade Range, limited hot spring activity on the Olympic Peninsula, and broad reaching, low temperature geothermal resources found in the Columbia Basin comprise the extent of Washington's known geothermal resources. Determination of resource ownership is the first step in proceeding with geothermal exploration and development activities. The federal and state processes are examined from pre-lease activity through leasing and post-lease development concerns. Plans, permits, licenses, and other requirements are addressed for the federal, state, and local level. Lease, permit, and other forms for a number of geothermal exploration and development activities are included. A map of public lands and another displaying the measured geothermal resources throughout the state are provided.

In this article, we examine the manner in which utilities assess the financial risks associated with future carbon regulations within their long-term resource plans. We base our analysis on a review of the most recent resource plans filed by fifteen electric utilities in the Western United States. Virtually all of these utilities made some effort to quantitatively evaluate the potential cost of future carbon regulations when analyzing alternate supply- and demand-side resource options for meeting customer load. Even without Federal climate regulation in the U.S., the prospect of that regulation is already having an impact on utility decision-making and resource choices.     Over the past decades muon spin rotation techniques (mSR) have established themselves as an invaluable tool to study a variety of static and dynamic phenomena in bulk solid state physics and chemistry. Common to all these approaches is that the muon is utilized as a spin microprobe and/or hydrogen-like probe, implanted in the material under investigation. Recent developments extend the range of application to near surface phenomena, thin film and super-lattice studies. After briefly summarizing the production of so called surface muons used for bulk studies, and discussing the principle differences between pulsed and continuous muon beams, the production of keV-energy muon sources will be discussed. A few topical examples from different active research fields will be presented to demonstrate the power of these techniques.

    Renewable energy has become a viable solution for the United States (US) increasing demand for energy. Often referred to as Green Energy, renewable energy uses the earth`s natural resources to create energy. The wind, sun, water, and the earth`s molten core each offer an attainable form of energy. Hydroelectricity uses running water, wind power uses high speed winds, solar panels collect solar energy as heat, and geothermal energy uses the earth`s molten core to heat water. The Department of Energy classifies Renewable Energy into the following sections: Geothermal Energy, Fuel from Biomass, and Solar Electric. Solar Electric is further subdivided into Solar Thermal Electric, Photovoltaics (Solar Cells), Wind/Windmills, Ocean Thermal Electric and Hydropower/Hydroelectric Dams. Currently, renewable energy provides only 12% of the US electricity supply. Approximately 10% of this is supplied by hydroelectric sources, 1% of this is supplied by hydroelectric sources, 1% is supplied by biomass, and less than 1% is supplied by geothermal, wind and solar combined. Nationally, the generating capacity of renewable energy has increased slightly during the 1990`s. Renewable energy generation contributes to approximately 94 thousand Megawatts of electricity compared to approximately 682 thousand Megawatts of electricity generated from nonrenewables in the year 1996. The continued implementation and utilization of renewable energy in the US are dependent upon several variables. These variables include: the support from Federal and State governments, utility purchase requirements if utility deregulation is passed, and consumer education on the environmental benefits of renewable energy.

    The United States is home to over 80,000 dams, of which approximately 3% are equipped with hydroelectric generating capabilities. When a dam serves as a hydropower facility, it provides a variety of energy services that range from clean, reliable power generation to load balancing that supports grid stability. In most cases, the benefits of dams and their associated reservoirs go far beyond supporting the nation s energy demand. As evidenced by the substantial presence of non-powered dams with the ability to store water in large capacities, the primary purpose of a dam may not be hydropower, but rather one of many other purposes. A dam and reservoir may support navigation, recreation, flood control, irrigation, and water supply, with each multipurpose benefit providing significant social and economic impacts on a local, regional, and national level. When hydropower is one of the services provided by a multipurpose reservoir, it is then part of an integrated system of competing uses. Operating rules, management practices, consumer demands, and environmental constraints must all be balanced to meet the multipurpose project s objectives. When federal dams are built, they are authorized by Congress to serve one or more functions. Legislation such as the Water Resources Development Act regulates the operation of the facility in order to coordinate the authorized uses and ensure the dam s intended objectives are being met. While multipurpose reservoirs account for billions of dollars in contributions to National Economic Development (NED) every year, no attempt has been made to evaluate their benefits on a national scale. This study is an on-going work conducted by Oak Ridge National Laboratory in an effort to estimate the economic benefits of multipurpose hydropower reservoirs in the United States. Given the important role that federal hydropower plays in the U.S., the first focus of this research will target the three main federal hydropower owners Tennessee Valley

Using ReEDS scenarios with this improved capability, we find that this 'financing' shift would soften the blow of the ITC reversion; however, the overall impacts of such a shift in capital structure are estimated to be small and near-term utility-scale PV deployment is found to be much more sensitive to other factors that might drive down utility-scale PV prices.

    Departing from previous policy, in August 1993 the USEPA`s Water Office recommended that the agency regulate a proposed electric power plant`s cooling pond as a water of the US. At issue was a proposal by Florida Power corp. to build a new electric power plant in Polk County, Florida. A 2,600 acre cooling pond to collect heated and discharged water was included in the proposal. Region 4 USEPA staff asked USEPA Headquarters in Washington, DC to decide whether the pond was exempt from the CWA or a water of the US. The pond could be a habitat for migratory birds according to a memo prepared by Region 4 staff. The USEPA Water Office used the presence of migratory birds to claim a nexus to interstate commerce and therefore concluded that the pond should be regulated under the CWA. Electric power industry proponents have argued that an overly expansive definition of waters of the US may result in any new power plant being required to construct cooling towers. Cooling towers are said to be a more expensive and wasteful method to cool heated water. Region 4 ultimately recanted its earlier position after considerable discussions with various other Environmental Protection Agency offices and, no doubt industry pressure. Florida Power Corp. was not required to obtain an NPDES permit for the cooling pond. The lesson of Florida Power Corp. is that the regulatory environment for utilities can be uncertain under the Clean Water Act even in the face of a relatively straightforward exemption from regulation.

    The federal Surface Mining Control and Reclamation Act of 1977 not only established national performance standards and permitting procedures for the coal industry, but also provided for state primacy. The principle of state primacy is both simple and intuitively appealing. Because states do not have adequate resources to develop effective regulatory programs, the federal government would set up comprehensive procedures and criteria to guide the states in preparing their own plans. The obvious advantage of state primacy is that it provides for flexibility in implementation. Ultimately, state primacy is an experiment in cooperative federalism, a sharing of authority and responsibility between the states and the federal government to insure both the general welfare and sensitivity to local conditions. The history of surface mining regulation is instructive because it points out the pitfalls and promise of cooperative federalism as well as the critical role of the courts in making state primacy work.

And, state, municipal, and utility-sponsored loan programs have emerged to fill the gap between clean energy technology financing needs and private sector lending. In general, public loan programs are more favorable to clean energy technologies than are those offered by traditional lending institutions; however, public loan programs address only the high up-front costs of clean energy systems, and the technology installed under these loan programs rarely supports clean energy production at levels that have a notable impact on the broader energy sector. This report discusses ways to increase the impact of these loan programs and suggests related policy design considerations.

    The Resource Conservation and Recovery Act and the Safe Drinking Water Act are forcing those in charge of landfills to adhere to more stringent operating standards. This, along with the growing scarcity of landfill availability, makes the use of landfills less desirable for solid waste disposal. As such, new disposal methods that are environmentally safe and economically practical must be found. One alternative, that is not really new but which has gained renewed interest, is incineration. The Resource Conservation and Recovery Act also requires that government agencies should direct their installations to recover as many resources as possible. Therefore if incineration is to be implemented, heat recovery should be incorporated into the system. There are several processes available to convert raw refuse into a fuel for use in a heat recovery system. Refuse derived fuels (RDF) can be in the form of raw refuse, densified refuse, powdered refuse, gas, or pyrolytic oil. The only form of RDF that is economically feasible for systems designed to process less than 200 TPD (tons per day) is raw refuse. Most Navy bases generate far less than 200 TPD of solid waste and therefore the Navy has focused most of its attention on modular heat recovery incinerator (HRI) systems that utilize raw refuse as fuel.

Available plug-in electric vehicles (PEVs) provide an attractive option in the selection of alternative fuel vehicles. PEVs, which consist of both battery electric vehicles (BEVs) and plug-in hybrid electric vehicles (PHEVs), have significant advantages over internal combustion engine (ICE) vehicles in terms of energy efficiency, reduced petroleum consumption, and reduced production of greenhouse gas (GHG) emissions, and they provide performance benefits with quieter, smoother operation. This study intended to evaluate the extent to which the United States Coast Guard Headquarters (USCG HQ) could convert part or all of their fleet of vehicles from petroleum-fueled vehicles to PEVs.

    The Army Corps of Engineers, Pacific Ocean Division, participated in the interagency case study of sea level rise for Yap State in the Federated States of Micronesia. The study, on behalf of the National Oceanic and Atmospheric Administration, was in support of the Intergovernmental Panel on Climate Change. Engineering and environmental analyses indicate that resources within Yap State at risk from a 1.0 meter rise in sea level by the year 2100 are substantial, including coral reefs, sea grass beds, wetlands, native mangrove forests, groundwater, archaeological and cultural resources, and shoreline infrastructure. Severe constraints associated with land ownership patterns have helped prevent the potential for greater impact. Yet these same constraints will likely hinder future decisions regarding retreat, accommodation, or protection strategies. As a result, there are special institutional and cultural challenges that face Yap in developing and implementing appropriate responses to accelerated sea level rise. These are made more difficult with the many uncertainties associated with current predictions regarding the greenhouse effect.

  9. Environmental implications associated with integrated resource planning by public utilities in the western United States

    The Western Area Power Administration is about to impose integrated resource planning requirements on its 612 public-power customers as part of its Energy Planning and Management Program (EPAM) and consistent with the Energy Policy Act of 1992. EPAM will affect public utilities over a 15-state region stretching from Minnesota to California, Montana to Texas. In this study, an assessment is made of the environmental impacts of the IRP requirements. Environmental impacts are calculated based on modeled changes in electric power generation and capacity additions.

    On October 9, 2008, federal, state and local policy makers, emergency managers, and medical and public health officials convened in Seattle, Washington, for a workshop on Addressing the Federal-State-Local Interface Issues During a Catastrophic Event Such as an Anthrax Attack. The day-long symposium was aimed at generating a dialogue about recovery and restoration through a discussion of the associated challenges that impact entire communities, including people, infrastructure, and critical systems. The Principal Federal Official (PFO) provided an overview of the role of the PFO in a catastrophic event. A high-level summary of an anthrax scenario was presented. The remainder of the day was focused on interactive discussions among federal, state and local emergency management experts in the areas of: • Decision-making, prioritization, and command and control • Public health/medical services • Community resiliency and continuity of government. Key topics and issues that resulted from discussions included: • Local representation in the Joint Field Office (JFO) • JFO transition to the Long-Term Recovery Office • Process for prioritization of needs • Process for regional coordination • Prioritization - process and federal/military intervention • Allocation of limited resources • Re-entry decision and consistency • Importance of maintaining a healthy hospital system • Need for a process to establish a consensus on when it is safe to re-enter. This needs to be across all jurisdictions including the military. • Insurance coverage for both private businesses and individuals • Interaction between the government and industry. The symposium was sponsored by the Interagency Biological Restoration Demonstration, a collaborative regional program jointly funded by the U.S. Department of Homeland Security and the U.S. Department of Defense.   11. Neutronics Benchmarks for the Utilization of Mixed-Oxide Fuel: Joint US/Russian Progress Report for Fiscal 1997. Volume 3 - Calculations Performed in the Russian Federation

    This volume of the progress report provides documentation of reactor physics and criticality safety studies conducted in the Russian Federation during fiscal year 1997 and sponsored by the Fissile Materials Disposition Program of the US Department of Energy. Descriptions of computational and experimental benchmarks for the verification and validation of computer programs for neutron physics analyses are included. All benchmarks include either plutonium, uranium, or mixed uranium and plutonium fuels. Calculated physics parameters are reported for all of the contaminated benchmarks that the United States and Russia mutually agreed in November 1996 were applicable to mixed-oxide fuel cycles for light-water reactors.

    This report summarizes geothermal technical assistance, R and D and technology transfer activities of the Geo-Heat Center at Oregon Institute of Technology for the third quarter of FY98 (April--June, 1998). It describes 231 contacts with parties during this period related to technical assistance with geothermal direct heat projects. Areas dealt with included requests for general information including material for high school and university students, and material on geothermal heat pumps, resource and well data, spacing heating and cooling, greenhouses, aquaculture, equipment, district heating, resorts and spas, industrial applications, snow melting and electric power. Research activities include work on model construction specifications for line shaft submersible pumps and plate heat exchangers, and a comprehensive aquaculture developers package. A brochure on Geothermal Energy in Klamath County was developed for state and local tourism use. Outreach activities include the publication of the Quarterly Bulletin (Vol. 19, No. 2) with articles on research at the Geo-Heat Center, sustainability of geothermal resources, injection well drilling in Boise, ID and a greenhouse project in the Azores.     the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans.     DOE Partnerships with States, Tribes and Other Federal Programs Help Responders Prepare for Challenges Involving Transport of Radioactive Materials Implementing adequate institutional programs and validating preparedness for emergency response to radiological transportation incidents along or near U.S. Department of Energy (DOE) shipping corridors poses unique challenges to transportation operations management. Delayed or insufficient attention to State and Tribal preparedness needs may significantly impact the transportation operations schedule and budget. The DOE Transportation Emergency Preparedness Program (TEPP) has successfully used a cooperative planning process to develop strong partnerships with States, Tribes, Federal agencies and other national programs to support responder preparedness across the United States. DOE TEPP has found that building solid partnerships with key emergency response agencies ensures responders have access to the planning, training, technical expertise and assistance necessary to safely, efficiently and effectively respond to a radiological transportation accident. Through the efforts of TEPP over the past fifteen years, partnerships have resulted in States and Tribal Nations either using significant portions of the TEPP planning resources in their programs and/or adopting the Modular Emergency Response Radiological Transportation Training (MERRTT) program into their hazardous material training curriculums to prepare their fire departments, law enforcement, hazardous materials response teams, emergency management officials, public information officers and emergency medical technicians for responding to transportation incidents involving radioactive materials. In addition, through strong partnerships with Federal Agencies and other national programs TEPP provided technical expertise to support a variety of radiological response initiatives and assisted several programs with integration of the nationally recognized MERRTT program

    This report is a legal study prepared to provide a review of the substantive and procedural laws of each regulatory jurisdiction that may affect implementation of the PURPA standards, and to summarize the current state of consideration and implementation of policies and rate designs similar or identical to the PURPA standards by state regulatory agencies and nonregulated utilities. This report is divided into three sections. The first section, the Introduction, summarizes the standards promulgated by PURPA and the results of the legal study. The second section, State Regulatory Law and Procedure, summarizes for each state or other ratemaking jurisdiction: (1) general constitutional and statutory provisions affecting utility rates and conditions of service; (2) specific laws or decisions affecting policy or rate design issues covered by PURPA standards; and (3) statutes and decisions governing administrative procedures, including judicial review. A chart showing actions taken on the policy and rate design issues addressed by PURPA is also included for each jurisdiction, and citations to relevant authorities are presented for each standard.     As large utility-scale solar photovoltaic (PV) and concentrating solar power (CSP) facilities are currently being built and planned for locations in the U.S. with the greatest solar resource potential, an understanding of water use for construction and operations is needed as siting tends to target locations with low natural rainfall and where most existing freshwater is already appropriated. Using methods outlined by the Bureau of Land Management (BLM) to determine water used in designated solar energy zones (SEZs) for construction and operations & maintenance, an estimate of water used over the lifetime at the solar power plant is determined and applied to each watershed in six Southwestern states. Results indicate that that PV systems overall use little water, though construction usage is high compared to O&M water use over the lifetime of the facility. Also noted is a transition being made from wet cooled to dry cooled CSP facilities that will significantly reduce operational water use at these facilities. Using these water use factors, estimates of future water demand for current and planned solar development was made. In efforts to determine where water could be a limiting factor in solar energy development, water availability, cost, and projected future competing demands were mapped for the six Southwestern states. Ten watersheds, 9 in California, and one in New Mexico were identified as being of particular concern because of limited water availability.

    The Department of Energy's Office of Civilian Radioactive Waste Management (OCRWM) committed in its November 2003 Strategic Plan for the Safe Transportation of Spent Nuclear Fuel and High-Level Radioactive Waste to Yucca Mountain: A Guide to Stakeholder Interactions to develop the transportation system collaboratively with stakeholders. The Strategic Plan further stated that four state regional groups (SRGs) would be the 'anchors' for OCRWM's collaboration with the states. The first major transportation planning activity that OCRWM initiated after publication of the Strategic Plan was the development of the Section 180(c) grant program. This document describes that collaboration and its outcomes from the perspective of the OCRWM participants and one of the SRGs, the Council of State Governments - Midwestern Office (CSG Midwest). Future climate scenarios are developed with a series of global and regional climate models, and the model output is bias-corrected to be consistent with observed data for the recent past.
