  2. Compensatory mitigation and screening rules in environmental impact assessment

    Concerns about the effectiveness of environmental impact assessment (EIA) have prompted proposals to improve its performance by limiting the discretion of decision-makers in screening. To investigate whether such proposals are likely to generate the desired results, we conducted an evaluation of the screening process under the Australian government's EIA regime from its introduction on 16 July 2000 to 30 June 2013 (study period). Almost 1 in 5 ‘particular manner’ decisions—a type of screening decision under the regime—were found to be unlawful. The extent of non-compliance is explained on the basis of convenience. The department was required to assess a large number of projects under tight timeframes and with limited resources, while being pressured by proponents to allow their projects to bypass EIA. These pressures resulted in the development of an informal custom whereby the formal compensatory mitigation restrictions were frequently ignored. The results highlight the relative significance of formal and informal institutions in EIA. Formal EIA rules typically provide a mere outline of the process. The informal institutions adopted by administrators often have a greater influence on how the process operates and what it achieves. - Highlights: • Concerns about the effectiveness of environmental impact assessment (EIA) have prompted proposals to improve its performance by limiting the discretion of decision-makers in screening. • To investigate whether such proposals are likely to generate the desired results, we conducted an evaluation of the Australian government's screening process, looking at the extent of compliance with a formal prohibition on the consideration of compensatory mitigation. • Almost 1 in 5 ‘particular manner’ decisions – a type of screening decision under the regime – were found to be unlawful (with a 95% confidence interval of between 1:4 and 1:7) because of a failure to abide by the compensatory mitigation restrictions

    Article number 16 of the Water Framework Directive (Directive 2000/60/EC) lays down the community strategy for establishment of harmonised quality standards for the priority substances and other substances posing a significant risk to the aquatic environment. In order to achieve the protection objectives of the Directive 2000/60/EC, the Italian Ministry of the Environment proposed the quality standards for surface water, sediments and biota related to the priority substances listed in the decision No. 2455/2001/EC of the European Parliament and of the Council of November 20 (2001) [Decision N. 2455/2001/EC of the European Parliament and of the Council of 20 November 2001. The list of priority substances in the field of water policy and amending Directive 2000/60/EC. Official Journal of the European Communities, 15.12.2001, p. 5]. Particularly, for the protection of the marine environment, the proposed Italian rules state that, from 1 January 2021, the concentrations of the hazardous priority substances in Italian marine and lagoon waters must be near the natural background for natural substances, like metals, and near zero for the anthropogenic one. According to Directive 2000/60/EC, the Italian Ministry of Environment issued in 2003 Decree 367 in which has derived 160 Environmental Quality Standard (EQS) for water and 27 Environmental Quality Objective (EQO) for sediment of marine coastal area, lagoons and coastal ponds. Biota quality standards have still to be fixed. The paper illustrates the criteria applied for the definition of the quality standards and some comments are presented.

    EPA, OTC and OTAG are all coming out with new air emissions rules for electric utility plants. The economic impact of these new rules is certain to be far-reaching and influence fuel choices, capital investments and electric plant dispatch decisions. Recent studies by Hill and Associates of these emerging rules and their economic impacts under deregulation indicate significant shifting of fuel choices and strong inter-regional wheeling of electricity. The author discusses the following: Which NERC regions fare best and worst under the combination of deregulation and the environmental rules? Whether just switching to cleaner coal will be enough for most coal plants? How coal usage is stimulated by electric utility deregulations? How electric utility mergers affect the economics of environmental compliance? Projections of future SO{sub 2} allowance prices. Why NO{sub x} allowance will likely follow a different price path then SO{sub 2} allowances? How coal prices are likely to respond to increased fuel switching?     Clean Air Interstate Rule (CAIR) is a cap-and-trade program promulgated by the Environmental Protection Agency in 2005, covering 28 eastern U.S. states and the District of Columbia. It was designed to reduce sulfur dioxide (SO2) and nitrogen oxide (NOx) emissions in order to help states meet their National Ambient Air Quality Standards (NAAQS) for ozone and particulate matter (PM2.5) and to further emissions reductions already achieved through the Acid Rain Program and the NOx State Implementation Plan call program. The rule was set to commence in 2009 for seasonal and annual NOx emissions and in 2010 for SO2 emissions.

    On June 29, 2004, the Environmental Protection Agency issued a comprehensive final rule regulating emissions from nonroad diesel engines and sulfur content in nonroad diesel fuel. The nonroad fuel market makes up more than 18% of the total distillate pool. The rule applies to new equipment covering a broad range of engine sizes, power ratings, and equipment types. There are currently about 6 million pieces of nonroad equipment operating in the United States, and more than 650,000 new units are sold each year.

    On February 8, 2008, a three-judge panel on the D.C. Circuit of the U.S. Court of Appeals issued a decision to vacate the Clean Air Mercury Rule (CAMR). In its ruling, the panel cited the history of hazardous air pollutant regulation under Section 112 of the Clean Air Act (CAA). Section 112, as written by Congress, listed emitted mercury as a hazardous air pollutant that must be subject to regulation unless it can be proved harmless to public welfare and the environment. In 2000, the Environmental Protection Agency ruled that mercury was indeed hazardous and must be regulated under Section 112 and, therefore, subjected to the best available control technology for mitigation.

    A parallel processing system for production rule programs utilizes a host processor for storing production rule right hand sides (RHS) and a plurality of rule processors for storing left hand sides (LHS). The rule processors operate in parallel in the recognize phase of the system recognize -Act Cycle to match their respective LHS's against a stored list of working memory elements (WME) in order to find a self consistent set of WME's. The list of WME is dynamically varied during the Act phase of the system in which the host executes or fires rule RHS's for those rules for which a self-consistent set has been found by the rule processors. The host transmits instructions for creating or deleting working memory elements as dictated by the rule firings until the rule processors are unable to find any further self-consistent working memory element sets at which time the production rule system is halted.

    Many computational intelligence techniques for anomaly based network intrusion detection can be found in literature. Translating a newly discovered intrusion recognition criteria into a distributable rule can be a human intensive effort. This paper explores a multi-modal genetic algorithm solution for autonomous rule creation. This algorithm focuses on the process of creating rules once an intrusion has been identified, rather than the evolution of rules to provide a solution for intrusion detection. The algorithm was demonstrated on anomalous ICMP network packets (input) and Snort rules (output of the algorithm). Output rules were sorted according to a fitness value and any duplicates were removed. The experimental results on ten test cases demonstrated a 100 percent rule alert rate. Out of 33,804 test packets 3 produced false positives. Each test case produced a minimum of three rule variations that could be used as candidates for a production system.

    On February 9, 2007, the Environmental Protection Agency (EPA) released its MSAT2 rule, which will establish controls on gasoline, passenger vehicles, and portable fuel containers. The controls are designed to reduce emissions of benzene and other hazardous air pollutants. Benzene is a known carcinogen, and the EPA estimates that mobile sources produced more than 70% of all benzene emissions in 1999. Other mobile source air toxics, including 1,3-butadiene, formaldehyde, acetaldehyde, acrolein, and naphthalene, also are thought to increase cancer rates or contribute to other serious health problems.

    On December 23, 2008, the D.C. Circuit Court remanded but did not vacate the Clean Air Interstate Rule (CAIR), overriding its previous decision on February 8, 2008, to remand and vacate CAIR. The December decision, which is reflected in Annual Energy Outlook 2010 (AEO) , allows CAIR to remain in effect, providing time for the Environmental Protection Agency to modify the rule in order to address objections raised by the Court in its earlier decision. A similar rule, referred to as the Clean Air Mercury Rule (CAMR), which was to set up a cap-and-trade system for reducing mercury emissions by approximately 70%, is not represented in the AEO2010 projections, because it was vacated by the D.C. Circuit Court in February 2008.

    The traveler participated in a conference on environmental technology in Paris, sponsored by the US Embassy-Paris, US Environmental Protection Agency (EPA), the French Environmental Ministry, and others. The traveler sat on a panel for environmental aspects of energy technology and made a presentation on the potential contributions of Oak Ridge National Laboratory (ORNL) to a planned French-American Environmental Technologies Institute in Chattanooga, Tennessee, and Evry, France. This institute would provide opportunities for international cooperation on environmental issues and technology transfer related to environmental protection, monitoring, and restoration at US Department of Energy (DOE) facilities. The traveler also attended the Fourth International Conference on Environmental Contamination in Barcelona. Conference topics included environmental chemistry, land disposal of wastes, treatment of toxic wastes, micropollutants, trace organics, artificial radionuclides in the environment, and the use biomonitoring and biosystems for environmental assessment. The traveler presented a paper on The Fate of Radionuclides in Sewage Sludge Applied to Land.'' Those findings corresponded well with results from studies addressing the fate of fallout radionuclides from the Chernobyl nuclear accident. There was an exchange of new information on a number of topics of interest to DOE waste management and environmental restoration needs.

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

    OSHA`s Process Safety Management rule not only requires the performance of process hazards analyses (PHA`s) of covered areas, but the revalidation of these PHA`s every 5 years. With the May 26, 1997 deadline for the completion of initial PHA`s nearing and the pending approval on or before March 1996 of EPA`s Risk Management Programs (RMP) for Chemical Accidental Release Prevention ({section}40 CFR 68), PSM-covered facilities must start developing plans for compliance with one or more of the requirements of these regulations. This paper discusses some of the strategies that companies falling under Tier 3 of EPA`s RMP rule may use to comply with OSHA`s revalidation of PHA`s and the upcoming EPA rule. The paper also provides details on the use of other PSM elements for PHA revalidation (such as compliance audits and management of change), the development of schedules for PHA revalidation, preparation time, the revalidation process, and the documentation/identification of RMP hazard scenarios.

  20. CONTRACTOR LEGAL MANAGEMENT REQUIREMENTS: FINAL RULE

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    Sum rules provide useful insights into transition strength functions and are often expressed as expectation values of an operator. In this letter I demonstrate that non-energy-weighted transition sum rules have strong secular dependences on the energy of the initial state. Such non-trivial systematics have consequences: the simplification suggested by the generalized Brink–Axel hypothesis, for example, does not hold for most cases, though it weakly holds in at least some cases for electric dipole transitions. Furthermore, I show the systematics can be understood through spectral distribution theory, calculated via traces of operators and of products of operators. Seen through this lens,more » violation of the generalized Brink–Axel hypothesis is unsurprising: one expectssum rules to evolve with excitation energy. Moreover, to lowest order the slope of the secular evolution can be traced to a component of the Hamiltonian being positive (repulsive) or negative (attractive).« less

    The traveler attended an International Seminar on Environmental Toxicology sponsored by Her Royal Highness Princess Chulabhorn of Thailand. The objective of the seminar was to provide technical knowledge in the area of environmental toxicology to participants from developing countries in Asia. Priorities identified at the workshop which would aid in the application of environmental toxicology principles in developing countries were: a data base on toxicological properties of chemicals, increased research support in all aspects of science and technology in developing countries, increased public awareness and participation in the risk management process, and an increased number of training courses held in third world countries to facilitate exchange of experience and techniques.

The Area 5 Radioactive Waste Management site receives low-level and mixed low-level waste from some 28 different generators from across the DOE complex in support of the legacy clean-up DOE Environmental Management project. Without this capability, the DOE would not be able to complete the clean up and proper disposition of these wastes. The program includes environmental protection, compliance, and monitoring of the air, water, plants, animals, and cultural resources at the NNSS. Investigation and implementation of appropriate corrective actions to address the contaminated ground water facilities and soils resulting from historic nuclear testing activities, the demolition of abandoned nuclear facilities, as well as installation of ground water wells to identify and monitor the extent of ground water contamination.

The purpose of the SSP is to develop a baseline for policy, budget, and schedules for the DOE Environmental Restoration and Waste Management activities. The plan explains accomplishments since the Fiscal Year (FY) 1990 plan, demonstrates how present and future activities are prioritized, identifies currently funded activities and activities that are planned to be funded in the upcoming fiscal year, and describes future activities that SRS is considering.

    Proposed designs of the prebunching system of the NLC and TESLA are based on the assumption that scaling the SLC design to NLC/TESLA requirements should provide the desired performance. A simple equation is developed to suggest a scaling rule in terms of bunch charge and duration. Detailed simulations of prebunching systems scaled from a single design have been run to investigate these issues.

    The authors discuss how nuclear plants in the United States have taken actions to respond to the NRC Station Blackout Rule, 10CFR50.63. The rule requires that each light water cooled nuclear power plant licensed to operate must be able to withstand for a specified duration and recover from a station blackout. Station blackout is defined as the complete loss of a-c power to the essential and non-essential switch-gear buses in a nuclear power plant. A station blackout results from the loss of all off-site power as well as the on-site emergency a-c power system. There are two basic approaches to meeting the station blackout rule. One is to cope with a station blackout independent of a-c power. Coping, as it is called, means the ability of a plant to achieve and maintain a safe shutdown condition. The second approach is to provide an alternate a-c power source (AAC).

    The Nuclear Regulatory Commission (NRC) is conducting an enhanced participatory rulemaking to establish radiological criteria for the decommissioning of NRC-licensed facilities. As a part of this action, the Commission published in the Federal Register (59 FR 43200), on August 22, 1994, a proposed rule on radiological criteria for decommissioning, soliciting comments both on the rule as proposed and on certain specific items as identified in its supplementary statement of considerations. A draft Generic Environmental Impact Statement (GEIS) in support of the rule, also published in August 1994 as NUREG-1496, along with its Appendix A (NUREG-1501), were also made available for comment. A staff working draft on regulatory guidance (NUREG-1500)was also made available. This report summarizes the 1,309 comments on the proposed rule and supplementary items and the 311 comments on the GEIS as excerpted from 101 docketed letters received associated in the Federal/Register notice. Comments from two NRC/Agreement-States meetings are also summarized.

    An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies.     Global markets trading rights to emit greenhouse gases are now actively considered by the United Nations. This leads to a new phenomenon: environmental markets in a global scale. Is this new, or are these markets simply a global manifestation of a trend towards market solutions? This paper will show that there is a fundamental difference between global environmental markets and standard stock exchanges. Because the atmosphere of the planet is one and the same for all, these markets trade {open_quotes}public goods{close_quotes} which are, however, privately produced. These are different from all the goods that are traded in markets today. Efficiency in these markets dictates different rules, involving a more equitable allocation of property rights on environmental use, and this requires new institutional arrangements. There is a need for a new institution, an International Bank for Environmental Settlements (IBES), which can lead to organized trading and ensures market integrity and efficiency.

    Public participation processes are touted as an effective way to increase the capacity and legitimacy of environmental assessment and the regulatory process that rely on them. Recent changes to the Canadian environmental assessment process narrowed the criteria for who can participate in environmental assessments from any who were interested to those who were most directly affected. This article examines the potential consequences of this change by exploring other areas of Canadian regulatory law where a similar directed affected test has been applied. This new standard risks institutionalizing the long-understood representational bias confronted by more diffuse interest like environmental protection. Restricting participation to the directly affected is far too narrow a test for processes like environmental assessment that are designed to determine the public interest. -- Highlights: Public participation can improve the legitimacy of environmental assessments. New Canadian rules narrow the range of eligible participants. Similar rules in Alberta have excluded environmental representation. The new rules may institutionalize bias against more diffuse interests. Restricting participation to the directly affected is far too narrow.
