    Since its passage in 1980, the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) has provided the US Environmental Protection Agency a tool for combating threats to human health and the environment resulting from hazardous wastes. As times have changed, so has the program. The 1986 Superfund Amendments and Reauthorization Act (SARA) changed CERCLA for the first time. The time has come to change the bill again. Many proposals for Superfund reform have been debated in Congress. These debates have focused in large part on the following aspects of the program: community involvement; State involvement; liability; and remedy selection. By focusing on these areas, and making changes where needed, the program can build upon lessons learned and chart a course for the future.

    The enactment of the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) in 1980 gave the Federal government, for the first time, the authority to take direct action or force the responsible party to respond to emergencies involving uncontrolled release of hazardous substances. The Act set up a five year program and established a trust fund -- ``the Superfund`` -- of $1.6 billion. The primary authorities contained in CERCLA enabled the Federal government to perform cleanups at sites where there were no responsible parties and to respond to emergency situations involving hazardous materials. Since the last reauthorization of Superfund, specific areas of concern, including program administration, have come to light. All parties agree that legislative changes are needed to reform the current program. As it stands now, cleanup levels are inconsistent, cleanup costs are excessive, and State and local governments have little say in the decision making process that affects their economic and social well being. Reforming Superfund will potentially make the program more equitable, effective, and efficient. This paper will focus on four of the major components of the Superfund program: (1) community involvement, (2) State involvement, (3) liability of responsible parties, and (4) remedy selection. In addition to highlighting current provisions of the law, potential reforms introduced in both the 103rd and 104th Congresses relating to each of the four areas will also be discussed.

    The US Department of Energy (DOE) is committed to conducting its operations in a safe and environmentally sound manner. High priorities for the Department are identifying and correcting environmental problems at DOE facilities that resulted from past operations, and preventing environmental problems from occurring during present and future operations. In this regard, the Department is committed to clean up the 1989 inventory of sites in the Environmental Restoration Program by the year 2019. DOE has issued an Order and guidance establishing policy and procedures for activities conducted under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended by the Superfund Amendments and Reauthorization Act (SARA), and has developed a Five-Year Plan, updated annually, that integrates planning for corrective activities, environmental restoration and waste management operations at its facilities.     Global warming causes extremely bad weather in the near term. They have already caught the attention of the insurance industry, as they suffered massive losses in the last decade. Twenty-one out of the 25 largest catastrophes in the US, mainly in the form of hurricanes have occurred in the last decade. The insurance industry has reacted by taking the risk of global warming in decisions as to pricing and underwriting decisions. But they have yet to take a more active role in regulating the factors that contributes to global warming. How global warming can impact the financial industry and the modern economy is explored. Insurance and modern financial derivatives are key to the efficient functioning of the modern economy, without which the global economy can still function but will take a giant step backward. Any risk as global warming that causes economic surprises will hamper the efficient working of the financial market and the modern economy.

    Insuring solar photovoltaic (PV) systems poses certain challenges. Insurance premiums, which can represent a significant part of overall costs for PV developers, can affect market competition. The market for certain types of insurance products is limited. Historical loss data is lacking, and test data for the long-term viability of PV products under real-life conditions is limited. Insurers' knowledge about PV systems and the PV industry is uneven even as the industry introduces innovative contractual structures and business models. Interviews conducted for this report with PV project developers, insurance brokers, and underwriters suggest government actions aimed at better testing, data collection, and communication could facilitate the development of a market for PV insurance products. This report identifies actions by governments, national laboratories, and other stakeholders that could accelerate the development of insurance products in support PV systems. Such actions include: increasing understanding of the solar PV industry among insurance professionals; expanding the availability of PV historical loss data; evaluating the expansion of renewable energy business classification; developing module and component testing capabilities and services offered by federal labs; and, advancing industry standards for PV system installers.

    In this paper we take a look at a simple portfolio insurance strategy using a protective put and computationally derive the investor's governing utility structures underlying such a strategy under alternative market scenarios. Investor utility is deemed to increase with an increase in the excess equity generated by the portfolio insurance strategy over a simple investment strategy without any insurance. Three alternative market scenarios (probability spaces) have been explored -- 'Down', 'Neutral' and 'Up', categorized according to whether the price of the underlying security is most likely to go down, stay unchanged or go up. The methodology used is computational, primarily based on simulation and numerical extrapolation. The Arrow-Pratt measure of risk aversion has been used to determine how the investors react towards risk under the different scenarios.

The Progressive Insurance Automotive X PRIZE Education Program comprised three integrated components that were designed to educate the general public and create a multi-tiered initiative to engage students and showcase the 21st century skills students will need to compete in our global economy: teamwork, creativity, strong literacy, math and science skills, and innovative thinking. The elements included an Online Experience, a National Student Contest, and in person education events and activites. The project leveraged online connections, strategic partnerships, in-classroom, and beyond-the-classroom initiatives, as well as mainstream media. This education program supported by the U.S. Department of Energy (DOE) also funded the specification of vehicle telemetry and the full development and operation of an interactive online experience that allowed internet users to follow the Progressive Insurance Automotive X PRIZE vehicles as they performed in real-time during the Progressive Insurance Automotive X PRIZE competition events.

    Under Pay as You Drive insurance (PAYD), drivers would pay part of their automobile insurance premium as a per-gallon surcharge every time they filled their gas tank. By transfering a portion of the cost of owning a vehicle from a fixed cost to a variable cost, PAYD would discourage driving. PAYD has been proposed recently in California as a means of reforming how auto insurance is provided. PAYD proponents claim that, by forcing drivers to purchase at least part of their insurance every time they refuel their car, PAYD would reduce or eliminate the need for uninsured motorist coverage. Some versions of PAYD proposed in California have been combined with a no-fault insurance system, with the intention of further reducing premiums for the average driver. Other states have proposed PAYD systems that would base insurance premiums on annual miles driven. In this report we discuss some of the qualitative issues surrounding adoption of PAYD and other policies that would convert other fixed costs of driving (vehicle registration, safety/emission control system inspection, and driver license renewal) to variable costs. We examine the effects of these policies on two sets of objectives: objectives related to auto insurance reform, and those related to reducing fuel consumption, CO{sub 2} emissions, and vehicle miles traveled. We pay particular attention to the first objective, insurance reform, since this has generated the most interest in PAYD to date, at least at the state level.

    The incidence of commercial buildings with poor indoor air quality (IAQ), and the frequency of litigation over the effects of poor IAQ is increasing. If so, these increases have ramifications for insurance carriers, which pay for many of the costs of health care and general commercial liability. However, little is known about the actual costs to insurance companies from poor IAQ in buildings. This paper reports on the results of a literature search of buildings-related, business and legal databases, and interviews with insurance and risk management representatives aimed at finding information on the direct costs to the insurance industry of poor building IAQ, as well as the costs of litigation. The literature search and discussions with insurance and risk management professionals reported in this paper turned up little specific information about the costs of IAQ-related problems to insurance companies. However, those discussions and certain articles in the insurance industry press indicate that there is a strong awareness and growing concern over the "silent crisis" of IAQ and its potential to cause large industry losses, and that a few companies are taking steps to address this issue. The source of these losses include both direct costs to insurers from paying health insurance and professional liability claims, as weIl as the cost of litigation. In spite of the lack of data on how IAQ-related health problems affect their business, the insurance industry has taken the anecdotal evidence about their reality seriously enough to alter their policies in ways that have lessened their exposure. We conclude by briefly discussing four activities that need to be addressed in the near future: (1) quantifying IAQ-related insurance costs by sector, (2) educating the insurance industry about the importance of IAQ issues, (3) examining IAQ impacts on the insurance industry in the residential sector, and (4) evaluating the relationship between IAQ improvements and their impact on energy use.

    The article proposes an expert system for detection, and subsequent investigation, of groups of collaborating automobile insurance fraudsters. The system is described and examined in great detail, several technical difficulties in detecting fraud are also considered, for it to be applicable in practice. Opposed to many other approaches, the system uses networks for representation of data. Networks are the most natural representation of such a relational domain, allowing formulation and analysis of complex relations between entities. Fraudulent entities are found by employing a novel assessment algorithm, \\textit{Iterative Assessment Algorithm} (\\textit{IAA}), also presented in the article. Besides intrinsic attributes of entities, the algorithm explores also the relations between entities. The prototype was evaluated and rigorously analyzed on real world data. Results show that automobile insurance fraud can be efficiently detected with the proposed system and that appropriate data representation is vital.

The growing threat of climate change provides an added motivation for the risk community to better understand this area of opportunity. While analyses of climate change mitigation typically focus on the emissions-reduction characteristics of sustainable energy technologies, less often recognized are a host of synergistic ways in which these technologies also offer adaptation benefits, e.g. making buildings more resilient to natural disasters.     Geomagnetically induced currents are known to induce disturbances in the electric power grid. Here, we perform a statistical analysis of 11,242 insurance claims from 2000 through 2010 for equipment losses and related business interruptions in North-American commercial organizations that are associated with damage to, or malfunction of, electrical and electronic equipment. We find that claims rates are elevated on days with elevated geomagnetic activity by approximately 20% for the top 5%, and by about 10% for the top third of most active days ranked by daily maximum variability of the geomagnetic field. When focusing on the claims explicitly attributed to electrical surges (amounting to more than half the total sample), we find that the dependence of claims rates on geomagnetic activity mirrors that of major disturbances in the U.S. high-voltage electric power grid.     Maximizing Storage Rate and Capacity and Insuring the Environmental Integrity of Carbon Dioxide Sequestration in Geological Formations The U.S. and other countries may enter into an agreement that will require a significant reduction in CO2 emissions in the medium to long term. In order to achieve such goals without drastic reductions in fossil fuel usage, CO2 must be removed from the atmosphere and be stored in acceptable reservoirs. The research outlined in this proposal deals with developing a methodology to determine the suitability of a particular geologic formation for the long-term storage of CO2 and technologies for the economical transfer and storage of CO2 in these formations. A novel well-logging technique using nuclear-magnetic resonance (NMR) will be developed to characterize the geologic formation including the integrity and quality of the reservoir seal (cap rock). Well-logging using NMR does not require coring, and hence, can be performed much more quickly and efficiently. The key element in the economical transfer and storage of the CO2 is hydraulic fracturing the formation to achieve greater lateral spreads and higher throughputs of CO2. Transport, compression, and drilling represent the main costs in CO2 sequestration. The combination of well-logging and hydraulic fracturing has the potential of minimizing these costs. It is possible through hydraulic fracturing to reduce the number of injection wells by an order of magnitude. Many issues will be addressed as part of the proposed research to maximize the storage rate and capacity and insure the environmental integrity of CO2 sequestration in geological formations. First, correlations between formation properties and NMR relaxation times will be firmly established. A detailed experimental program will be conducted to determine these correlations. Second, improved hydraulic fracturing models will be developed which are suitable for CO2 sequestration as opposed to enhanced oil recovery (EOR). Although models that simulate the fracturing process exist, they can be significantly improved by extending the models to account for nonsymmetric, nonplanar fractures, coupling the models to more realistic reservoir simulators, and implementing advanced multiphase flow models for the transport of proppant. Third, it may be possible to deviate from current hydraulic fracturing technology by using different proppants (possibly waste materials that need to be disposed of, e.g., asbestos) combined with different hydraulic fracturing carrier fluids (possibly supercritical CO2 itself). Because current technology is mainly aimed at enhanced oil recovery, it may not be ideally suited for the injection and storage of CO2. Finally, advanced concepts such as increasing the injectivity of the fractured geologic formations through acidization with carbonated water will be investigated. Saline formations are located through most of the continental United States. Generally, where saline formations are scarce, oil and gas reservoirs and coal beds abound. By developing the technology outlined here, it will be possible to remove CO2 at the source (power plants, industry) and inject it directly into nearby geological formations, without releasing it into the atmosphere. The goal of the proposed research is to develop a technology capable of sequestering CO2 in geologic formations at a cost of US $10 per ton.

Title III of SARA contains the provisions of the Emergency Planning and Community Right-to-Know Act (EPCRA). SARA Title III may prove to be more pervasive and more demanding for industry than any of the other many rules and regulations promulgated by the Environmental Protection Agency. The Emergency Planning and Community Right-to-Know Act has four major provisions: planning for chemical emergencies; emergency notification of chemical accidents and releases; reporting of hazardous chemical inventories; and toxic chemical release reporting.

    In 1982, Congress authorized the Motor Carrier Safety Assistance Program (MCSAP), a Federal grant-in-aid program to improve commercial motor carrier safety. MCSAP was reauthorized in 1986, 1991, and 1998. In June 1997, in anticipation of and preparation for reauthorization, a MCSAP Formula Workgroup convened to analyze requirements for a new allocation formula and to develop the formula. Because of provisions in the Transportation Equity Act for the 21st Century (TEA-21), a major change in approach was to consider including performance (i.e., safety improvements) in the formula. Oak Ridge National Laboratory (ORNL) actively participated in the Workgroup activities, provided technical assistance in evaluating factors and conducting scenario analyses, prepared regulatory language for the Federal Register Notice of Proposed Rulemaking (NPRM), analyzed NPRM comments and recommended responses to the comments, assisted with preparation of the Federal Register Final Rule, developed the final spreadsheet, and prepared an informational brochure on MCSAP for use by the States. The allocation of MCSAP funds for FY2001 will use the new formula.
