    Two distinct yet closely related waste remediation projects are finally underway in Canada under the Port Hope Area Initiative (PHAI) which aims to clean up 1.7 million cubic metres (m{sup 3}) of low-level radioactive waste (LLRW) arising from 60 years of uranium and radium operations. Under the PHAI, the Port Hope Project and the smaller Port Granby Project will result in the consolidation of the LLRW within two highly engineered, above-ground mounds, to be constructed within the municipalities of Port Hope and Clarington. These projects will fulfill the federal government commitment to the safe, long-term management of the LLRW, as set out in the legal agreement signed by the government and the host municipalities in 2001. The federal authorization to commence PHAI Remediation and Construction Phase 2 was received in late 2011 and several enabling infrastructure construction and radiological survey contracts were awarded in 2012. The contracts to remediate the waste sites and construct the new engineered mounds will be tendered in 2013. At the end of Phase 2, environmental risks will be substantially mitigated, land development restrictions lifted, and an honourable legacy left for future generations. (authors)

    The current emphasis on enforcement to achieve compliance with environmental regulations places increased demands on environmental professionals to generate legally defensible data. Since any environmental data may potentially be used in civil or criminal litigation, it must be suitable for use as admissible evidence. Although data cannot be guaranteed to be legally defensible because the proof of defensibility can only be determined in actual legal proceedings, there are steps that can be taken to enhance or increase the chances of admissibility. In order for data to be defensible and of known and documented quality, all sampling and analysis activities must meet applicable technical standards and be fully documented. Record keeping must be stressed throughout all sampling and analysis activities; failure to keep proper records is a common allegation in enforcement actions and a cause for lack of data defensibility. Though there is extensive reference documentation on the requirements for technical data quality, there is limited guidance available on data defensibility procedures. This paper provides guidance to assist field samplers, laboratory personnel, and project managers in planning for and generating legally defensible data. A example checklist that can be used in the planning and verification stages of the data generation process is provided.

    Business is booming for environmental professionals. Increasingly, environmental consultants and engineers are called upon by property owners and government agencies to clean up contaminated sites, assess environmental risk for potential purchasers and lenders, and investigate the extent of contamination prior to a real estate purchase. But these activities are not risk-free for the environmental professional. To the contrary, there are many ways for a remediation or site assessment to go awry. Risks that the remediation contractor face include the possibility that activities on the site may actually cause or contribute to further releases of the hazardous substances sought to be remediated. Because environmental professionals many times face substantial risk in performing their jobs, it is necessary that they understand and appreciate the potential liabilities when something does go wrong, and how to best protect themselves. This article describes the types of legal theories that could be brought against environmental professionals and how to best protect yourself from such liability.

    Unocal Corporation has given the Indonesian Government notice of intent to proceed with a geothermal project to provide steam for a 110 megawatt electrical generating plant. The company has drilled 11 wells, and has confirmed reserves for more than 230 megawatts of generating capacity. Indonesia's state electric company, PLN, will build the power plant. Ansaldo, an Italian company, will supply equipment and manage the construction. With the notice of intent to proceed, Unocal Geothermal of Indonesia, Ltd. will begin drilling additional wells and build the field facilities necessary to provide steam to the power plant.

    The Chemical Weapons Convention (CWC) offers a unique challenge to the US system of constitutional law. Its promise of eliminating what is the most purely genocidal type of weapon from the world`s arsenals as well as of destroying the facilities for producing these weapons, brings with it a set of novel legal issues. The reservations about the CWC expressed by US business people are rooted in concern about safeguarding confidential business information and protecting the constitutional right to privacy. The chief worry is that international verification inspectors will misuse their power to enter commercial property and that trade secrets or other private information will be compromised as a result. It has been charged that the Convention is probably unconstitutional. The author categorically disagrees with that view and is aware of no scholarly writing that supports it. The purpose of this presentation is to show that CWC verification activities can be implemented in the US consistently with the traditional constitutional regard for commercial and individual privacy. First, he very briefly reviews the types of verification inspections that the CWC permits, as well as some of its specific privacy protections. Second, he explains how the Fourth Amendment right to privacy works in the context of CWC verification inspections. Finally, he reviews how verification inspections can be integrated into these constitutional requirements in the SU through a federal implementing statute.

    This report describes legal, regulatory, and institutional considerations likely to shape the development and deployment of distributed resources. It is based on research co-sponsored by the National Renewable Energy Laboratory (NREL) and four investor-owned utilities (Central & South West Services, Cinergy Corp., Florida Power Corporation, and San Diego Gas & Electric Company). The research was performed between August 1995 and March 1996 by a team of four consulting firms experienced in energy and utility law, regulation, and economics. It is the survey phase of a project known as the Distributed Resources Institutional Analysis Project.

    This document updates and expands the report with a similar title issued in October 1980. This document examines a number of legal and regulatory issues that potentially can affect implementation of the aquifer thermal energy storage (ATES) concept. This concept involves the storage of thermal energy in an underground aquifer until a later date when it can be effectively utilized. Either heat energy or chill can be stored. Potential end uses of the energy include district space heating and cooling, industrial process applications, and use in agriculture or aquaculture. Issues are examined in four categories: regulatory requirements, property rights, potential liability, and issues related to heat or chill delivery.

    The commercial exploitation of Liquefied Petroleum Gas (LPG) in New Zealand has occurred without a particular and comprehensive concern for any legal implications. The paper in Part I examines definitional questions, assesses in Part II the ability of courts and quasi-courts to evaluate risks associated with the product, examines in Part III the utility of common law remedies for injuries or associated with or arising from LPG, analyzes in Part IV the statutory regulation of LPG, concentrating particularly on the Dangerous Goods (Class 2 - Gases) Regulations 1980, discusses in Part V recent planning case-law concerning LPG development, and concludes that some reform is necessary to produce a more-coherent and precise regulatory regime that takes into account both the needs of developers and those affected by the development of LPG.

    The issue of possibly unrecoverable cost incurred by a utility, or `stranded costs,` has emerged as a major obstacle to developing a competitive generation market. Stranded or transition costs are defined as costs incurred by a utility to serve its customers that were being recovered in rates but are no longer due to availability of lower-priced alternative suppliers. The idea of `stranded cost,` and more importantly arguments for its recovery, is a concept with little basis in economic theory, legal precedence, or precedence in other deregulated industries. The main argument recovery is that the ``regulatory compact`` requires it. This is based on the misconception that the regulator compact is simply: the utility incurs costs on behalf of its customers because of the ``obligation to serve`` so, therefore, customers are obligated to pay. This is a mischaracterization of what the compact was and how it developed. Another argument is that recovery is required for economic efficiency. This presumes, however, a very narrow definition of efficiency based on preventing ``uneconomic`` bypass of the utility and that utilities minimize costs. A broader definition of efficiency and the likelihood of cost inefficiencies in the industry suggest that the cost imposed on customers from inhibiting competition could exceed the gains from preventing uneconomic bypass. Both these issues are examined in this paper.

    The study describes the results of a survey of 547 local water supply systems serving some 31 million residents of urban areas in the states of Alabama, California, Florida, Oklahoma, Tennessee and Wyoming. While examining the legal and administrative aspects of drought management, the survey also included the assessment of the current status of drought preparedness and long-term drought protection among the responding water supply systems. The rate of legal or administrative problems encountered during drought response was surprisingly low, affecting only twenty percent of all implementing systems. The low incidence of difficulties counters a widespread assumption that the legal environment frequently restrains or constricts drought response efforts.

    This thesis is the culminating project for my participation in the OECD NEA International School of Nuclear Law. This paper will begin by providing a historical background to current disarmament and denuclearization treaties. This paper will discuss the current legal framework based on current and historical activities related to denuclearization and nuclear disarmament. Then, it will propose paths forward for the future efforts, and describe the necessary legal considerations. Each treaty or agreement will be examined in respect to its requirements for: 1) limitations and implementation; 2) and verification and monitoring. Then, lessons learned in each of the two areas (limitations and verification) will be used to construct a proposed path forward at the end of this paper.

  18. Disposal of oil field wastes into salt caverns: Feasibility, legality, risk, and costs

    Salt caverns can be formed through solution mining in the bedded or domal salt formations that are found in many states. Salt caverns have traditionally been used for hydrocarbon storage, but caverns have also been used to dispose of some types of wastes. This paper provides an overview of several years of research by Argonne National Laboratory on the feasibility and legality of using salt caverns for disposing of oil field wastes, the risks to human populations from this disposal method, and the cost of cavern disposal. Costs are compared between the four operating US disposal caverns and other commercial disposal options located in the same geographic area as the caverns. Argonne`s research indicates that disposal of oil field wastes into salt caverns is feasible and legal. The risk from cavern disposal of oil field wastes appears to be below accepted safe risk thresholds. Disposal caverns are economically competitive with other disposal options.

    The legal and institutional obstacles to the development of small-scale hydroelectric energy at the state level are discussed. The Federal government also exercises extensive regulatory in the area, and the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC is examined. The initial obstacle that all developers confront in Wisconsin is obtaining the authority to utilize the bed, banks, and flowing water at a proposed dam site.     This paper examines the legal issues involved with employer monitoring of employee e-mail. In addition to identifying pertinent legal issues, the paper provides guidelines that will help the Pacific Northwest National Laboratory (PNNL) establish a program for monitoring outgoing e-mail to insure compliance with company policies, particularly those regarding protection of trade secrets and proprietary information, and to comply with the Department of Energy`s (DOE) procedures for protecting Export Controlled Information (ECI). Electronic communication has allowed companies to enhance efficiency, responsiveness and effectiveness. E-mail allows employees to transmit all types of data to other individuals inside and outside of their companies. The ease with which information can be transmitted by e-mail has placed trade secrets, proprietary information, and other sensitive data at risk from inadvertent disclosure by employees. As employers attempt to protect their interests through measures such as monitoring e-mail, they may expose themselves to liability under federal and state laws for violating employee privacy. Business use of e-mail has proliferated so rapidly that the federal and state legal systems have not been able to adequately address the issues arising out of its use in the workplace.

    In late 2006, the seaside community in Esperance Western Australia was alerted to thousands of native bird species dying. The source of the lead (Pb) was determined by Pb isotopes to derive from the handling of Pb carbonate concentrate through the Port, which began in July 2005. Concern was expressed for the impact of this on the community. Our objectives were to employ Pb isotope ratios to evaluate the source of Pb in environmental samples for use in legal proceedings, and for use in remediation and monitoring. Isotope measurements were undertaken of bird livers, plants, drinking water, soil, harbour sediments, air, bulk ceiling dust, gutter sludge, surface swabs and blood. The unique lead isotopic signature of the contaminating Pb carbonate enabled diagnostic apportionment of lead in samples. Apart from some soil and water samples, the proportion of contaminating Pb was >95% in the environmental samples. Lead isotopes were critical in resolving legal proceedings, are being used in the remediation of premises, were used in monitoring of workers involved in the decontamination of the storage facility, and monitoring transport of the concentrate through another port facility. Air samples show the continued presence of contaminant Pb, more than one year after shipping of concentrate ceased, probably arising from dust resuspension. Brief details of the comprehensive testing and cleanup of the Esperance community are provided along with the role of the Community. Lead isotopic analyses can provide significant benefits to regulatory agencies, interested parties, and the community where the signature is able to be characterised with a high degree of certainty. - Highlights: Black-Right-Pointing-Triangle Lead carbonate concentrate.     The legal and institutional obstacles to the development of small-scale hydroelectric in West Virginia at the state level are described. The Federal government also exercises extensive regulatory authority in the area. The introductory section examines the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and concludes with an inquiry into the practical use of the doctrine by FERC. The development of small-scale hydroelectric energy depends on the selection of a site which will produce sufficient water power capacity to make the project economically attractive to a developer. In West Virginia, the right to use the flowing waters of a stream, creek, or river is appurtenant to the ownership of the lands bordering the watercourse. The lands are known as riparian lands. The water rights are known as riparian rights. Thus, the first obstacle a developer faces involves the acquisition of riparian lands and the subsequent right to the use of the water. The water law in West Virginia is discussed in detail followed by discussions on direct and indirect regulations; continuing obligations; financial considerations; and interstate organizations.

The dual regulatory system is examined with the aim of creating a more orderly understanding of the vagaries of the system, focusing on the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC. In Maryland, by common law rule, title to all navigable waters and to the soil below the high-water mark of those waters is vested in the state as successor to the Lord Proprietary who had received it by grant from the Crown. Rights to non-navigable water, public trust doctrine, and eminent domain are also discussed. Direct and indirect regulations, continuing obligations, loan programs, and regional organizations are described in additional sections.

    Many existing proposals either lack sufficient concreteness to make carbon capture and geological sequestration (CCGS) operational or fail to focus on a comprehensive, long term framework for its regulation, thus failing to account adequately for the urgency of the issue, the need to develop immediate experience with large scale demonstration projects, or the financial and other incentives required to launch early demonstration projects. We aim to help fill this void by proposing a roadmap to commercial deployment of CCGS in the United States.This roadmap focuses on the legal and financial incentives necessary for rapid demonstration of geological sequestration in the absence of national restrictions on CO2 emissions. It weaves together existing federal programs and financing opportunities into a set of recommendations for achieving commercial viability of geological sequestration.

One challenge regards conceptualizing precisely what commodity is to be managed across space and time. The US Supreme Court view is that waste disposal is the article of commerce per se. Some justices, however, have argued that while waste disposal is the article of commerce, its interstate flow could be impeded by states on the grounds that they have the authority to regulate natural resource quality within their boundaries. The argument in this paper is that adopting the economic theory view of the article of commerce as landfill space brings the majority and dissenting US Supreme Court views-and the resulting sides of the public policy dispute-into closer alignment. We discuss waste management policy tools that emerge from this closer alignment that are more likely to both withstand judicial scrutiny and achieve economic efficiency.

    Caverns can be readily formed in salt formations through solution mining. The caverns may be formed incidentally, as a result of salt recovery, or intentionally to create an underground chamber that can be used for storing hydrocarbon products or compressed air or disposing of wastes. The purpose of this report is to evaluate the feasibility, suitability, and legality of disposing of nonhazardous oil and gas exploration, development, and production wastes (hereafter referred to as oil field wastes, unless otherwise noted) in salt caverns. Chapter 2 provides background information on: types and locations of US subsurface salt deposits; basic solution mining techniques used to create caverns; and ways in which salt caverns are used. Later chapters provide discussion of: federal and state regulatory requirements concerning disposal of oil field waste, including which wastes are considered eligible for cavern disposal; waste streams that are considered to be oil field waste; and an evaluation of technical issues concerning the suitability of using salt caverns for disposing of oil field waste. Separate chapters present: types of oil field wastes suitable for cavern disposal; cavern design and location; disposal operations; and closure and remediation. This report does not suggest specific numerical limits for such factors or variables as distance to neighboring activities, depths for casings, pressure testing, or size and shape of cavern. The intent is to raise issues and general approaches that will contribute to the growing body of information on this subject.

    As stated in the European legislation, cosmetic products present on the European market must be safe for the consumer. Safety evaluation of the products is carried out by a qualified safety assessor who needs to consider potential exposure scenarios next to the physicochemical and toxicological profiles of all composing ingredients. Whereas, until recently, the tools to determine the toxicological profile of cosmetic ingredients mainly consisted of animal experiments, they have now been narrowed down substantially by the legally imposed animal testing ban on cosmetic ingredients, taken up in the Cosmetic Products Directive (76/768/EEC). This Directive, however, is not a stand-alone piece of European legislation, since as well directly as indirectly it is influenced by a complex web of related legislations. Vertical legislations deal with different categories of chemicals, including dangerous substances, biocides, plant protection products, food additives, medicinal products, and of course also cosmetics. Horizontal legislative texts, on the contrary, cover more general fields such as protection of experimental animals, consumer product safety, misleading of consumers, specific provisions for aerosols, and others. Experience has learnt that having a general overview of these related legislations is necessary to understand their impact on the cosmetic world in general terms and on cosmetic safety evaluation in particular. This goes for a variety of concerned parties, including national and European regulators/agencies, contract laboratories, raw material suppliers, cosmetic companies, research and educational centers. They all deal with a number of aspects important for the quality and toxicity of cosmetics and their ingredients. This review summarises the most relevant points of the legislative texts of different types of product categories and emphasises their impact on the safety evaluation of cosmetics.

    This executive summary describes the relationship of Federal law and regulation to state law and regulation of small-scale hydroelectric facilities. It also highlights important features of the constitutional law, statutory law, case law, and regulations of each of the six New England states. The summary may serve as a concise overview of and introduction to the detailed reports prepared by the Energy Law Institute on the legal and regulatory systems of each of the six states. The dual regulatory system is a function of the federalist nature of our government. This dual system is examined from the standpoint of the appropriate legal doctrine, i.e., the law of pre-emption, and the application of this law to the case of hydroelectric development. The regulation of small dams are discussed and flow diagrams of the regulations are presented for each of the six states - Maine, Massachusetts, Vermont, New Hampshire, Vermont, and Connecticut.

    This report examines the current policy, legal, and regulatory framework pertaining to used nuclear fuel and high level waste management in the United States. The goal is to identify potential changes that if made could add flexibility and possibly improve the chances of successfully implementing technical aspects of a nuclear waste policy. Experience suggests that the regulatory framework should be established prior to initiating future repository development. Concerning specifics of the regulatory framework, reasonable expectation as the standard of proof was successfully implemented and could be retained in the future; yet, the current classification system for radioactive waste, including hazardous constituents, warrants reexamination. Whether or not consideration of multiple sites are considered simultaneously in the future, inclusion of mechanisms such as deliberate use of performance assessment to manage site characterization would be wise. Because of experience gained here and abroad, diversity of geologic media is not particularly necessary as a criterion in site selection guidelines for multiple sites. Stepwise development of the repository program that includes flexibility also warrants serious consideration. Furthermore, integration of the waste management system from storage, transportation, and disposition, should be examined and would be facilitated by integration of the legal and regulatory framework. Finally, in order to enhance acceptability of future repository development, the national policy should be cognizant of those policy and technical attributes that enhance initial acceptance, and those policy and technical attributes that maintain and broaden credibility.

    The Port Hope Project is the larger of the two projects in the Port Hope Area Initiative (PHAI), Canada's largest low level radioactive waste (LLRW) cleanup. With a budget of approximately $1 billion, the Port Hope Project includes a broad and complex range of remedial elements from a state of the art water treatment plant, an engineered waste management facility, municipal solid waste removal, remediation of 18 major sites within the Municipality of Port Hope (MPH), sediment dredging and dewatering, an investigation of 4,800 properties (many of these homes) to identify LLRW and remediation of approximately 450 of these properties. This paper discusses the status of the Port Hope Project in terms of designs completed and regulatory approvals received, and sets out the scope and schedule for the remaining studies, engineering designs and remediation contracts.     Nigeria, the most populous country in Africa, has high rates of urbanization and industrialization. Until recently, decisions on most large-scale projects such as expressways, harbors, industries, dams, and irrigation were considered with an emphasis on traditional technical and cost-benefit analysis. Spurred by massive environmental degradation and persistent community agitation in oil producing areas, environmental impact assessment (EIA) legislation was passed in late 1992. The main purpose of this article is to review and assess the content of this legislation and the guidelines produced by the Federal Environmental Protection Agency (FEPA), the institution responsible for EIA administration. Some EIA reports have been prepared and reviewed by FEPA since 1994. There are some positive outcomes and expectations, but some problems have been identified as well, including: deliberate restriction of public involvement and participation by proponents and/or their consultants, interagency conflict leading to high cost and project delays especially in the oil industry, and restriction of public access to final EIA reports. These are discussed, and recommendations for improving the process are made.

    The shipment of transuranic (TRU) radioactive waste to the Waste Isolation Pilot Plant (WIPP) in New Mexico raised a serious socioeconomic issue - the potential devaluation of property values due to the transportation of TRU waste from generator sites to the disposal facility. In 1992, the New Mexico Supreme Court held in City of Santa Fe v. Komis that a loss in value from public perception of risk was compensable. This issue has become an extremely important one for the development of the Yucca Mountain repository in Nevada for disposal of spent nuclear fuel and high-level radioactive waste. Much research has been conducted about the potential impacts of transportation of spent fuel and radioactive waste. This paper examines the pertinent studies conducted since the Komis case. It examines how the public debate on radioactive materials transportation continues and is now focused on transportation of high-level waste and spent nuclear fuel to the proposed Yucca Mountain repository. Finally, the paper suggests a path forward DOE can take to address this issue.

    In the electric power industry, fundamental changes are underway in Europe, America, Australia, New Zealand and, more recently, in Asia. Rooted in increased deregulation and competition, these changes are likely to radically alter the structure of the industry. Liberalization of electric power markets in the United Kingdom is, for the most part, complete. The generation market in the United States began opening to competition following the 1987 Public Utility Regulatory Policies Act (PURPA). The Energy Policy Act of 1992 set the stage for a much more dramatic change in the industry. The most far-reaching provision of the Act was its electricity title, which opened access to the electric transmission grid. With legal barriers now removed, the traditionally sheltered US electric utility market is becoming increasingly open to entry and competition. A number of important legislative, regulatory and governmental policy initiatives are underway in the Philippines that will have a profound effect on the electric power industry. In Thailand, the National Energy Planning Organization (NEPO) has undertaken a thorough investigation of industry restructuring. This paper summarizes recent international developments in the deregulation and liberalization of electricity markets in the U.K., U.S., Australia, and New Zealand. It focuses on the relevance of these experiences to development underway in the Philippines and Thailand, and presents alternative possible structures likely to emerge in these countries, drawing heavily on the authors' recent experiences in Thailand and the Philippines. The impact of these changes on the business environment for power generation and marketing will be discussed in detail, as will the opportunities these changes create for investment among private power producers.

Full text of publication follows: A number of sites in Iraq have some degree of radiological contamination and require decommissioning and remediation in order to ensure radiological safety. Many of these sites in Iraq are located at the nuclear research centre at Al Tuwaitha. The International Atomic Energy Agency (IAEA) Board of Governors has approved a project to assist the Government of Iraq in the evaluation and decommissioning of former facilities that used radioactive materials. The project is divided into three phases: Phase 1: collect and analyze all available data and conduct training of the Iraqi staff, Phase 2: develop a decommissioning and remediation plan, and Phase 3: implement field activities relating to decommissioning, remediation and site selection suitable for final disposal of waste. Four working groups have been established to complete the Phase 1 work and significant progress has been made in drafting a new nuclear law which will provide the legal basis for the licensing of the decommissioning of the former nuclear complex. Work is also underway to collect and analysis existing date, to prioritize future activities and to develop a waste management strategy. This will be a long-term and costly project. (authors)

During the second quarter (1/1/2013 to 3/31/2013), all the technical and legal documents for the subcontracts to Purdue University, University of Illinois, and PlastiComp, Inc. were completed. The revised CRADA documents were sent to DOE, Autodesk, Toyota, and Magna for technical and legal reviews. PNNL Legal Services contacted project partners’ Legal counterparts for completing legal documents for the project. A non-disclosure agreement was revised and sent to all the parties for reviews.

That may have been the most dramatic leap forward in clean energy systems that the world has known. Until now. Today, another profound transformation is underway. A combination of forces is taking us from a carbon-centric, inefficient energy system to one that draws from diverse energy sources - including the sun. NREL analysis is helping guide energy systems policy and investment decisions through this transformation.     The Fuel Retrieval Subproject was established as part of the Spent Nuclear Fuel Project (SNF Project) to retrieve and repackage the SNF located in the K Basins. The Fuel Retrieval System (FRS) construction work is complete in the KW Basin, and start-up testing is underway. Design modifications and construction planning are also underway for the KE Basin. An independent review of the design verification process as applied to the K Basin projects was initiated in support of preparation for the SNF Project operational readiness review (ORR). A Design Verification Status Questionnaire, Table 1, is included which addresses Corrective Action SNF-EG-MA-EG-20000060, Item No.9 (Miller 2000).
