    Two distinct yet closely related waste remediation projects are finally underway in Canada under the Port Hope Area Initiative (PHAI) which aims to clean up 1.7 million cubic metres (m{sup 3}) of low-level radioactive waste (LLRW) arising from 60 years of uranium and radium operations. Under the PHAI, the Port Hope Project and the smaller Port Granby Project will result in the consolidation of the LLRW within two highly engineered, above-ground mounds, to be constructed within the municipalities of Port Hope and Clarington. These projects will fulfill the federal government commitment to the safe, long-term management of the LLRW, as set out in the legal agreement signed by the government and the host municipalities in 2001. The federal authorization to commence PHAI Remediation and Construction Phase 2 was received in late 2011 and several enabling infrastructure construction and radiological survey contracts were awarded in 2012. The contracts to remediate the waste sites and construct the new engineered mounds will be tendered in 2013. At the end of Phase 2, environmental risks will be substantially mitigated, land development restrictions lifted, and an honourable legacy left for future generations. (authors)

    This paper reviews the public service responsibilities of lawyers, and how they can fulfill the annual goal of performing pro bono services by serving certain public involvement groups, including organization involved in Constitutional issues and environmental protection matters. Public involvement groups should consider their needs for legal services and consider soliciting lawyers to serve on their boards or to volunteer legal services which will assist those lawyers in fulfilling their professional obligations under Rules of Professional Conduct. The group should identify specific activities and tasks that require the skills and training of a lawyer, including corporate governance issues; conflict-of-interest questions; the statutory construction of laws, regulations and ordinances; or analysis of potential liability. The addition of a lawyer to advisory boards for governmental agencies and for non-profit boards of charitable, religious, civic, community, environmental and educational organizations may provide those boards with knowledge, analytical approaches and insights that complement the abilities of other board members. Rules of Professional Conduct applicable to lawyers include admonitions for lawyers to provide 'Public Service'. Representative of many rules, the American Bar Association Model Rule 6.1, entitled 'Voluntary Pro Bono Publico Service' addresses every lawyer's professional responsibility to provide legal services to those 'unable to pay'. This Model Rule exhorts each lawyer to provide fifty (50) hours of legal services without fee or expectation of fee to persons of limited means or charitable, religious or civic, community, governmental and educational organizations or to individuals, groups or organizations seeking 'to secure or protect civil rights, civil liberties, or public rights, or charitable, religious, civic, community, governmental and educational organizations in matters in furtherance of their purposes, where the payment of

    Unocal Corporation has given the Indonesian Government notice of intent to proceed with a geothermal project to provide steam for a 110 megawatt electrical generating plant. The company has drilled 11 wells, and has confirmed reserves for more than 230 megawatts of generating capacity. Indonesia's state electric company, PLN, will build the power plant. Ansaldo, an Italian company, will supply equipment and manage the construction. With the notice of intent to proceed, Unocal Geothermal of Indonesia, Ltd. will begin drilling additional wells and build the field facilities necessary to provide steam to the power plant.

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    This data documentation presents the results of the surface water and atmospheric underway measurements of mole fraction of carbon dioxide (xCO{sub 2}), sea surface salinity, and sea surface temperature, obtained during the World Ocean Circulation Experiment (WOCE) Indian Ocean survey cruises (December 1994--January 1996). Discrete and underway carbon measurements were made by members of the CO{sub 2} survey team. The survey team is a part of the Joint Global Ocean Flux Study supported by the US Department of Energy to make carbon-related measurements on the WOCE global survey cruises. Approximately 200,000 surface seawater and 50,000 marine air xCO{sub 2} measurements were recorded.

    Because the Chemical Weapons Convention (CWC) contains the best developed verification regime in multilaterial arms control history, some have raised concerns for the chemical industry that have legal implications. Chief among these are safeguarding confidential business information and protecting constitutional rights during inspections. This discussion will show how the CWC and proposed national implementing legislation work together to allay these concerns. Both concerns are legitimate. Confidential business information could be lost to a national government or the CWC governing body accidentially or purposely. The CWC regime of routine and challenge inspections are searches under the constitution and could, if abused, potentially conflict with recognized commercial privacy interests. Neither concern justifies opposition to the convention, but both need to be addressed in national implementing legislation. Proposed US legislation goes far in this direction, but can be improved.

    The social and legal framework within which bioremediation technologies must be researched, developed, and deployed in the US are discussed in this report. Discussions focus on policies, laws and regulations, intellectual property, technology transfer, and stakeholder concerns. These discussions are intended to help program managers, scientists and engineers understand the social and legal framework within which they work, and be cognizant of relevant issues that must be navigated during bioremediation technology research, development, and deployment activities. While this report focuses on the legal and social environment within which the DOE operates, the laws, regulations and social processes could apply to DoD and other sites nationwide. This report identifies specific issues related to bioremediation technologies, including those involving the use of plants; native, naturally occurring microbes; non-native, naturally occurring microbes; genetically engineered organisms; and microbial products (e.g., enzymes, surfactants, chelating compounds). It considers issues that fall within the following general categories: US biotechnology policy and the regulation of field releases of organisms; US environmental laws and waste cleanup regulations; intellectual property and patenting issues; technology transfer procedures for commercializing technology developed through government-funded research; stakeholder concerns about bioremediation proposals; and methods for assuring public involvement in technology development and deployment.

The research was performed between August 1995 and March 1996 by a team of four consulting firms experienced in energy and utility law, regulation, and economics. Particular attention is focused on considerations of federal antitrust law surrounding collective buying and other joint operations by electric utilities. Attention is also given to considerations suggested by the economic theory of monopsony (markets with a single buyer) and oligopsony (markets with a small number of buyers). This document examines a number of legal and regulatory issues that potentially can affect implementation of the aquifer thermal energy storage (ATES) concept. This concept involves the storage of thermal energy in an underground aquifer until a later date when it can be effectively utilized. Either heat energy or chill can be stored. Potential end uses of the energy include district space heating and cooling, industrial process applications, and use in agriculture or aquaculture. Issues are examined in four categories: regulatory requirements, property rights, potential liability, and issues related to heat or chill delivery.

    Natural resource damages liability is a major development in environmental law. Government authorities are increasingly seeking damage claims for injury to natural resources, invoking the natural resource damages (NRD) provisions of the federal Superfund statute and the Oil Pollution Act. The number of Claims asserted is increasing, and the amounts sought range to hundreds of millions of dollars, with some claims exceeding $1 billion. Some assert that the federal NRD program is an awakening sleeping giant that could threaten to rival the Superfund cleanup program in cost and the potential for imposing far-reaching liabilities on a wide range of businesses as well as the federal government. Lawyers, economists, and other experts on NRD have become fully engaged in comprehensive analyses of the legal, economic and policy issues presented by NRD claims, including a full review of the NRD litigating record. Many critics find that existing NRD law and practice is flawed; produces excessive liability claims, skewed incentives and economic waste; and urgently needs reform. Changes have been recommended to improve the law and refocus the NRD program on achieving cost-effective restoration of injured natural resources. These analytical endeavors are especially timely because Congress is currently considering significant changes in NRD law. This overview will provide a brief background summary of the NRD program and highlight some of the central legal and scientific issues facing government policy makers and litigants in NRD cases.

    The study describes the results of a survey of 547 local water supply systems serving some 31 million residents of urban areas in the states of Alabama, California, Florida, Oklahoma, Tennessee and Wyoming. While examining the legal and administrative aspects of drought management, the survey also included the assessment of the current status of drought preparedness and long-term drought protection among the responding water supply systems. The rate of legal or administrative problems encountered during drought response was surprisingly low, affecting only twenty percent of all implementing systems. The low incidence of difficulties counters a widespread assumption that the legal environment frequently restrains or constricts drought response efforts.

This paper will begin by providing a historical background to current disarmament and denuclearization treaties. This paper will discuss the current legal framework based on current and historical activities related to denuclearization and nuclear disarmament. Then, it will propose paths forward for the future efforts, and describe the necessary legal considerations. Each treaty or agreement will be examined in respect to its requirements for: 1) limitations and implementation; 2) and verification and monitoring. Then, lessons learned in each of the two areas (limitations and verification) will be used to construct a proposed path forward at the end of this paper.

  6. Disposal of oil field wastes into salt caverns: Feasibility, legality, risk, and costs

    Salt caverns can be formed through solution mining in the bedded or domal salt formations that are found in many states. Salt caverns have traditionally been used for hydrocarbon storage, but caverns have also been used to dispose of some types of wastes. This paper provides an overview of several years of research by Argonne National Laboratory on the feasibility and legality of using salt caverns for disposing of oil field wastes, the risks to human populations from this disposal method, and the cost of cavern disposal. Costs are compared between the four operating US disposal caverns and other commercial disposal options located in the same geographic area as the caverns. Argonne`s research indicates that disposal of oil field wastes into salt caverns is feasible and legal. The risk from cavern disposal of oil field wastes appears to be below accepted safe risk thresholds. Disposal caverns are economically competitive with other disposal options.

The initial obstacle that all developers confront in Wisconsin is obtaining the authority to utilize the bed, banks, and flowing water at a proposed dam site. This involves a determination of ownership of the stream banks and bed and the manner of obtaining either their title or use; and existing constraints with regard to the use of the water. Wisconsin follows the riparian theory of water law.

    This paper examines the legal issues involved with employer monitoring of employee e-mail. In addition to identifying pertinent legal issues, the paper provides guidelines that will help the Pacific Northwest National Laboratory (PNNL) establish a program for monitoring outgoing e-mail to insure compliance with company policies, particularly those regarding protection of trade secrets and proprietary information, and to comply with the Department of Energy`s (DOE) procedures for protecting Export Controlled Information (ECI). Electronic communication has allowed companies to enhance efficiency, responsiveness and effectiveness. E-mail allows employees to transmit all types of data to other individuals inside and outside of their companies. The ease with which information can be transmitted by e-mail has placed trade secrets, proprietary information, and other sensitive data at risk from inadvertent disclosure by employees. As employers attempt to protect their interests through measures such as monitoring e-mail, they may expose themselves to liability under federal and state laws for violating employee privacy. Business use of e-mail has proliferated so rapidly that the federal and state legal systems have not been able to adequately address the issues arising out of its use in the workplace.

    The legal and institutional obstacles to the development of small-scale hydroelectric in West Virginia at the state level are described. The Federal government also exercises extensive regulatory authority in the area. The introductory section examines the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and concludes with an inquiry into the practical use of the doctrine by FERC. The development of small-scale hydroelectric energy depends on the selection of a site which will produce sufficient water power capacity to make the project economically attractive to a developer. In West Virginia, the right to use the flowing waters of a stream, creek, or river is appurtenant to the ownership of the lands bordering the watercourse. The lands are known as riparian lands. The water rights are known as riparian rights. Thus, the first obstacle a developer faces involves the acquisition of riparian lands and the subsequent right to the use of the water. The water law in West Virginia is discussed in detail followed by discussions on direct and indirect regulations; continuing obligations; financial considerations; and interstate organizations.

The Federal government also exercises extensive regulatory authority in the area. The dual regulatory system is examined with the aim of creating a more orderly understanding of the vagaries of the system, focusing on the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC. In Maryland, by common law rule, title to all navigable waters and to the soil below the high-water mark of those waters is vested in the state as successor to the Lord Proprietary who had received it by grant from the Crown. Rights to non-navigable water, public trust doctrine, and eminent domain are also discussed. Direct and indirect regulations, continuing obligations, loan programs, and regional organizations are described in additional sections.

The first step the small scale hydroelectric developer must take is that of acquiring title to the real property comprising the development site. The real estate parcel must include the requisite interest in the land adjacent to the watercourse, access to the underlying streambed and where needed, the land necessary for an upstream impoundment area. Land acquisition may be effectuated by purchase, lease, or grant by the state. In addition to these methods, New York permits the use of the eminent domain power of the state for public utilities under certain circumstances.

    Many existing proposals either lack sufficient concreteness to make carbon capture and geological sequestration (CCGS) operational or fail to focus on a comprehensive, long term framework for its regulation, thus failing to account adequately for the urgency of the issue, the need to develop immediate experience with large scale demonstration projects, or the financial and other incentives required to launch early demonstration projects. We aim to help fill this void by proposing a roadmap to commercial deployment of CCGS in the United States.This roadmap focuses on the legal and financial incentives necessary for rapid demonstration of geological sequestration in the absence of national restrictions on CO2 emissions. It weaves together existing federal programs and financing opportunities into a set of recommendations for achieving commercial viability of geological sequestration.

One challenge regards conceptualizing precisely what commodity is to be managed across space and time. The US Supreme Court view is that waste disposal is the article of commerce per se. Some justices, however, have argued that while waste disposal is the article of commerce, its interstate flow could be impeded by states on the grounds that they have the authority to regulate natural resource quality within their boundaries. The argument in this paper is that adopting the economic theory view of the article of commerce as landfill space brings the majority and dissenting US Supreme Court views-and the resulting sides of the public policy dispute-into closer alignment. We discuss waste management policy tools that emerge from this closer alignment that are more likely to both withstand judicial scrutiny and achieve economic efficiency.

  4. Preliminary technical and legal evaluation of disposing of nonhazardous oil field waste into salt caverns

    Caverns can be readily formed in salt formations through solution mining. The caverns may be formed incidentally, as a result of salt recovery, or intentionally to create an underground chamber that can be used for storing hydrocarbon products or compressed air or disposing of wastes. The purpose of this report is to evaluate the feasibility, suitability, and legality of disposing of nonhazardous oil and gas exploration, development, and production wastes (hereafter referred to as oil field wastes, unless otherwise noted) in salt caverns. Chapter 2 provides background information on: types and locations of US subsurface salt deposits; basic solution mining techniques used to create caverns; and ways in which salt caverns are used. Later chapters provide discussion of: federal and state regulatory requirements concerning disposal of oil field waste, including which wastes are considered eligible for cavern disposal; waste streams that are considered to be oil field waste; and an evaluation of technical issues concerning the suitability of using salt caverns for disposing of oil field waste. Separate chapters present: types of oil field wastes suitable for cavern disposal; cavern design and location; disposal operations; and closure and remediation. This report does not suggest specific numerical limits for such factors or variables as distance to neighboring activities, depths for casings, pressure testing, or size and shape of cavern. The intent is to raise issues and general approaches that will contribute to the growing body of information on this subject.

    This report updates and expands the second edition of the ELSI Bibliography, published in 1993. The Bibliography and Supplement provides a comprehensive resource for identifying publications on the major topics related to the ethical, legal and social issues (ELSI) of the Human Genome Project. The Bibliography and Supplement are extracted from a database compiled at Los Alamos National Laboratory with the support of the Office of Energy Research, US Department of Energy. The second edition of the ELSI Bibliography was dated May 1993 but included publications added to the database until fall 1993. This Supplement reflects approximately 1,000 entries added to the database during the past year, bringing the total to approximately 7,000 entries. More than half of the new entries were published in the last year, and the remainder are earlier publications not previously included in the database. Most of the new entries were published in the academic and professional literature. The remainder are press reports from newspapers of record and scientific journals. The topical listing of the second edition has been followed in the Supplement, with a few changes. The topics of Cystic Fibrosis, Huntington`s Disease, and Sickle Cell Anemia have been combined in a single topic, Disorders. Also, all the entries published in the past year are included in a new topic, Publications: September 1993--September 1994, which provides a comprehensive view of recent reporting and commentary on the science and ELSI of genetics.

  6. Legal and financial methods for reducing low emission sources: Options for incentives

    There are two types of the so-called low emission sources in Cracow: over 1,000 local boiler houses and several thousand solid fuel-fired stoves. The accomplishment of each of 5 sub-projects offered under the American-Polish program entails solving the technical, financial, legal and public relations-related problems. The elimination of the low emission source requires, therefore, a joint effort of the following pairs: (a) local authorities, (b) investors, (c) owners and users of low emission sources, and (d) inhabitants involved in particular projects. The results of the studies developed by POLINVEST indicate that the accomplishment of the projects for the elimination of low emission sources will require financial incentives. Bearing in mind the today`s resources available from the community budget, this process may last as long as a dozen or so years. The task of the authorities of Cracow City is making a long-range operational strategy enabling reduction of low emission sources in Cracow.

  7. Disposal of NORM-contaminated oil field wastes in salt caverns -- Legality, technical feasibility, economics, and risk

    Some types of oil and gas production and processing wastes contain naturally occurring radioactive materials (NORM). If NORM is present at concentrations above regulatory levels in oil field waste, the waste requires special disposal practices. The existing disposal options for wastes containing NORM are limited and costly. This paper evaluates the legality, technical feasibility, economics, and human health risk of disposing of NORM-contaminated oil field wastes in salt caverns. Cavern disposal of NORM waste is technically feasible and poses a very low human health risk. From a legal perspective, there are no fatal flaws that would prevent a state regulatory agency from approaching cavern disposal of NORM. On the basis of the costs charged by caverns currently used for disposal of nonhazardous oil field waste (NOW), NORM waste disposal caverns could be cost competitive with existing NORM waste disposal methods when regulatory agencies approve the practice.

  8. Review and analysis of the adequacy of the legal and institutional framework for geothermal development in Washington State

    The legal and institutional framework within which geothermal energy must develop has its origin in the early 1970s. In 1970, the Federal Geothermal Steam Act was passed into law and in 1974 the Washington State Geothermal Act was passed. The legal and institutional framework thus established by the state and federal governments differed substantially in format, content, and direction. In many instances, the legal and institutional framework established left as many questions unanswered as answered, and in some cases, the framework has proven to be more of an obstacle to development than an aid. From an examination of how the state and federal governments have addressed the varying needs of geothermal development and how the courts have interpreted some of their decisions, it is clear that in order to ensure that the legal and institutional framework is adequate to serve the needs of geothermal development, it must address, at a minimum, the following topics: (1) providing developers with access and a priority right to carry out exploration and development activities; (2) characterization of the resource so as to minimize conflicts with other natural resources; (3) establishing ownership; and (4) giving careful consideration to such lease terms as rentals and royalties, lease renewals, and diligence requirements. In addition, the framework must address groundwater law and its implications for geothermal development and how geothermal development will be considered in terms of establishing utility law. At the local level, it is imperative that geothermal be given careful consideration when decisions on resource management, zoning, and regulation are made. Local governments also have the power to establish programs which can provide substantial incentives for geothermal development and, by so doing, ensure that geothermal energy contributes to economic stability and growth.

    The ELK team ([E]WA-IIT, [L]os Alamos National laboratory (LANL), and [K]ayvium Corporation (ELK)) used the legal Track task 302 as an opportunity to compare and integrate advanced semantic-automation strategies. The team members believe that enabling parties to discover, consume, analyze, and make decisions in a noisy and information-overloaded environment requires new tools. Together, as well as independently, they are actively developing these tools and view the TREC exercise as an opportunity to test, compare, and complement tools and approaches. Our collaboration is new to TREC, brought together by a shared interest in document relevance, concept-in-context identification and annotation, and the recognition that words out-of-context do not a match make. The team's intent was to lay the foundation for automating the mining and analysis of large volumes of electronic information by litigants and their lawyers, not only in the context of document discovery, but also to support litigation strategy, motion practice, deposition, trial tactics, etc. The premise was that a Subject Matter Expert- (SME-) built model can be automatically mapped onto various search engines for document retrieval, organization, relevance scoring, analysis and decision support. In the end, we ran nearly a dozen models, mostly, but not exclusively, with Kayvium Corporation's knowledge automation technology. The Sal Database Search Engine we used had a bug in its proximity feature, requiring that we develop a workaround. While the work-around was successful, it left us with insufficient time to converge the models to achieve expected quality. However, with optimized proximity processing in place, we would be able to run the model many more times, and believe repeatable quality would be a matter of working through a few requests to get the approach right. We believe that with more time, the results we would achieve might point towards a new way of processing documents for litigation support

  10. Human health safety evaluation of cosmetics in the EU: A legally imposed challenge to science

    As stated in the European legislation, cosmetic products present on the European market must be safe for the consumer. Safety evaluation of the products is carried out by a qualified safety assessor who needs to consider potential exposure scenarios next to the physicochemical and toxicological profiles of all composing ingredients. Whereas, until recently, the tools to determine the toxicological profile of cosmetic ingredients mainly consisted of animal experiments, they have now been narrowed down substantially by the legally imposed animal testing ban on cosmetic ingredients, taken up in the Cosmetic Products Directive (76/768/EEC). This Directive, however, is not a stand-alone piece of European legislation, since as well directly as indirectly it is influenced by a complex web of related legislations. Vertical legislations deal with different categories of chemicals, including dangerous substances, biocides, plant protection products, food additives, medicinal products, and of course also cosmetics. Horizontal legislative texts, on the contrary, cover more general fields such as protection of experimental animals, consumer product safety, misleading of consumers, specific provisions for aerosols, and others. Experience has learnt that having a general overview of these related legislations is necessary to understand their impact on the cosmetic world in general terms and on cosmetic safety evaluation in particular. This goes for a variety of concerned parties, including national and European regulators/agencies, contract laboratories, raw material suppliers, cosmetic companies, research and educational centers. They all deal with a number of aspects important for the quality and toxicity of cosmetics and their ingredients. This review summarises the most relevant points of the legislative texts of different types of product categories and emphasises their impact on the safety evaluation of cosmetics.

  11. Environmental Impact Assessment in the marine environment: A comparison of legal frameworks

    Environmental Impact Assessment (EIA) is a well-established practice in most developed countries, even though its application to projects in the marine environment is at a much earlier stage of development. We use the Portuguese example to address marine EIA legislation since its exclusive economic zone (EEZ) is currently the third largest in the European Union and its EIA legislation does not require various offshore activities with potentially negative environmental impacts to undergo EIA before being licensed. This paper aims to determine whether three types of projects implemented within Portuguese maritime zones – artificial reefs using sunken ships, hydrocarbon prospecting and wave-energy generation – would benefit from application of an appropriately designed EIA. We have conducted a structured review of EIA legal provisions from seven other countries, and considered whether a full EIA was required for each project type. Consequently, 12 Environmental Impact Statements (EIS) have been compared to identify patterns of (dis)similarity across countries and project types. Additionally, we identified key descriptors and predicted impacts for each project type referred to in their EIS. The main conclusion is that ultimately all three projects would benefit from mandatory EIA in Portugal. This paper is relevant for countries with large maritime areas and underdeveloped marine EIA legislation, helping improve international policy-making relating to these three types of marine projects. - Highlights: • EIA is not mandatory for some project types developed in Portuguese maritime zones. • Artificial reefs, oil&gas prospecting and wave-energy licensing differ in 8 countries. • EIA should be mandatory in Portugal for artificial reefs and oil&gas prospecting. • However, an AEInc approach is enough for wave-energy projects in Portugal. • Findings could be extended to other EU countries with extensive maritime zones.

    This volume of the final report is a compilation of the estimated capital and operating costs for the project. Using the definitive design as a basis, capital and operating costs were developed by obtaining quotations for equipment delivered to the site. Tables 1.1 and 1.2 provide a summary of the capital and operating costs estimated for the PGW Coal Gasification Project. In the course of its Phase I Feasibility Study of a medium-Btu coal-gas facility, Philadelphia Gas Works (PGW) identified the financing mechanism as having great impact on gas cost. Consequently, PGW formed a Financial/Legal Task Force composed of legal, financial, and project analysis specialists to study various ownership/management options. In seeking an acceptable ownership, management, and financing arrangement, certain ownership forms were initially identified and classified. Several public ownership, private ownership, and third party ownership options for the coal-gas plant are presented. The ownership and financing forms classified as base alternatives involved tax-exempt and taxable financing arrangements and are discussed in Section 3. Project implementation would be initiated by effectively planning the methodology by which commercial operation will be realized. Areas covered in this report are sale of gas to customers, arrangements for feedstock supply and by-product disposal, a schedule of major events leading to commercialization, and a plan for managing the implementation.

The feasibility of the allocation of MSW material recovery facilities (MRF) as intermediate points between the generators of these wastes and the options for reuse and disposal was evaluated, as well as the participation of associations and cooperatives of waste pickers. This network was mathematically modelled and validated through a scenario analysis of the municipality of São Mateus, which makes the location model more complete and applicable in practice. The mathematical model allows the determination of the number of facilities required for the reverse logistics network, their location, capacities, and product flows between these facilities. The fixed costs of installation and operation of the proposed MRF were balanced with the reduction of transport costs, allowing the inclusion of waste pickers to the reverse logistics network. The main contribution of this study lies in the proposition of a reverse logistics network for MSW simultaneously involving legal, environmental, economic and social criteria, which is a very complex goal.     This report examines the current policy, legal, and regulatory framework pertaining to used nuclear fuel and high level waste management in the United States. The goal is to identify potential changes that if made could add flexibility and possibly improve the chances of successfully implementing technical aspects of a nuclear waste policy. Experience suggests that the regulatory framework should be established prior to initiating future repository development. Concerning specifics of the regulatory framework, reasonable expectation as the standard of proof was successfully implemented and could be retained in the future; yet, the current classification system for radioactive waste, including hazardous constituents, warrants reexamination. Whether or not consideration of multiple sites are considered simultaneously in the future, inclusion of mechanisms such as deliberate use of performance assessment to manage site characterization would be wise. Because of experience gained here and abroad, diversity of geologic media is not particularly necessary as a criterion in site selection guidelines for multiple sites. Stepwise development of the repository program that includes flexibility also warrants serious consideration. Furthermore, integration of the waste management system from storage, transportation, and disposition, should be examined and would be facilitated by integration of the legal and regulatory framework. Finally, in order to enhance acceptability of future repository development, the national policy should be cognizant of those policy and technical attributes that enhance initial acceptance, and those policy and technical attributes that maintain and broaden credibility.

    The relationship of Federal law and regulation to state law and regulation of small-scale hydroelectric facilities is described. Important features of the constitutional law, statutory law, case law, and regulations of each of the 7 mid-western states (Illinois, Indiana, Kentucky, Michigan, Ohio, West Virginia, and Wisconsin) are highlighted. The introductory section examines the dual regulatory system from the standpoint of the appropriate legal doctrine, i.e., the law of pre-emption, and the application of this law to the case of hydroelectric development and regulation of water resources. A state-by-state synopsis of these important provisions of the laws of the states that have a bearing on small-scale hydroelectric development is presented.

    Cumulative effects analysis (CEA) allows natural resource managers to understand the status of resources in historical context, learn from past management actions, and adapt future activities accordingly. U.S. federal agencies are required to complete CEA as part of environmental impact assessment under the National Environmental Policy Act (NEPA). Past research on CEA as part of NEPA has identified significant deficiencies in CEA practice, suggested methodologies for handling difficult aspects of CEA, and analyzed the rise in litigation over CEA in U.S. courts. This article provides a review of the literature and legal standards related to CEA as it is done under NEPA and then examines current practice on a U.S. National Forest, utilizing qualitative methods in order to provide a detailed understanding of current approaches to CEA. Research objectives were to understand current practice, investigate ongoing challenges, and identify impediments to improvement. Methods included a systematic review of a set of NEPA documents and semi-structured interviews with practitioners, scientists, and members of the public. Findings indicate that the primary challenges associated with CEA include: issues of both geographic and temporal scale of analysis, confusion over the purpose of the requirement, the lack of monitoring data, and problems coordinating and disseminating data. Improved monitoring strategies and programmatic analyses could support improved CEA practice.

    The Port Hope Project is the larger of the two projects in the Port Hope Area Initiative (PHAI), Canada's largest low level radioactive waste (LLRW) cleanup. With a budget of approximately $1 billion, the Port Hope Project includes a broad and complex range of remedial elements from a state of the art water treatment plant, an engineered waste management facility, municipal solid waste removal, remediation of 18 major sites within the Municipality of Port Hope (MPH), sediment dredging and dewatering, an investigation of 4,800 properties (many of these homes) to identify LLRW and remediation of approximately 450 of these properties. This paper discusses the status of the Port Hope Project in terms of designs completed and regulatory approvals received, and sets out the scope and schedule for the remaining studies, engineering designs and remediation contracts.     Nigeria, the most populous country in Africa, has high rates of urbanization and industrialization. Until recently, decisions on most large-scale projects such as expressways, harbors, industries, dams, and irrigation were considered with an emphasis on traditional technical and cost-benefit analysis. Spurred by massive environmental degradation and persistent community agitation in oil producing areas, environmental impact assessment (EIA) legislation was passed in late 1992. The main purpose of this article is to review and assess the content of this legislation and the guidelines produced by the Federal Environmental Protection Agency (FEPA), the institution responsible for EIA administration. Some EIA reports have been prepared and reviewed by FEPA since 1994. There are some positive outcomes and expectations, but some problems have been identified as well, including: deliberate restriction of public involvement and participation by proponents and/or their consultants, interagency conflict leading to high cost and project delays especially in the oil industry, and restriction of public access to final EIA reports. These are discussed, and recommendations for improving the process are made.

    The shipment of transuranic (TRU) radioactive waste to the Waste Isolation Pilot Plant (WIPP) in New Mexico raised a serious socioeconomic issue - the potential devaluation of property values due to the transportation of TRU waste from generator sites to the disposal facility. In 1992, the New Mexico Supreme Court held in City of Santa Fe v. Komis that a loss in value from public perception of risk was compensable. This issue has become an extremely important one for the development of the Yucca Mountain repository in Nevada for disposal of spent nuclear fuel and high-level radioactive waste. Much research has been conducted about the potential impacts of transportation of spent fuel and radioactive waste. This paper examines the pertinent studies conducted since the Komis case. It examines how the public debate on radioactive materials transportation continues and is now focused on transportation of high-level waste and spent nuclear fuel to the proposed Yucca Mountain repository. Finally, the paper suggests a path forward DOE can take to address this issue.

    Focusing on the American Southwest, the authors review physical explanations of subsidence, then offer an explanation for the evolving doctrines of responsibility, laws of support, tort liability, and ground water management. Still in its infancy, the effort to develop effective measures to prevent subsidence or compensate for damages will become increasingly clear. They note the societal cost of not dealing directly and rationally with the problem and the subsequent loss of initiatives and options. Ground water withdrawal is a relatively new cause of land subsidence. Dealing with sub-surface support and the avoidance of subsidence damage is a geo-political problem calling for rational planning and management. 50 references.

    In the electric power industry, fundamental changes are underway in Europe, America, Australia, New Zealand and, more recently, in Asia. Rooted in increased deregulation and competition, these changes are likely to radically alter the structure of the industry. Liberalization of electric power markets in the United Kingdom is, for the most part, complete. The generation market in the United States began opening to competition following the 1987 Public Utility Regulatory Policies Act (PURPA). The Energy Policy Act of 1992 set the stage for a much more dramatic change in the industry. The most far-reaching provision of the Act was its electricity title, which opened access to the electric transmission grid. With legal barriers now removed, the traditionally sheltered US electric utility market is becoming increasingly open to entry and competition. A number of important legislative, regulatory and governmental policy initiatives are underway in the Philippines that will have a profound effect on the electric power industry. In Thailand, the National Energy Planning Organization (NEPO) has undertaken a thorough investigation of industry restructuring. This paper summarizes recent international developments in the deregulation and liberalization of electricity markets in the U.K., U.S., Australia, and New Zealand. It focuses on the relevance of these experiences to development underway in the Philippines and Thailand, and presents alternative possible structures likely to emerge in these countries, drawing heavily on the authors' recent experiences in Thailand and the Philippines. The impact of these changes on the business environment for power generation and marketing will be discussed in detail, as will the opportunities these changes create for investment among private power producers.

    Genetic medical services provided by the Georgia Division of Public Health in two northern and two central districts are compared to services provided in a district in which a tertiary care facility is located. Genetics outreach public health nurses play key roles in Georgia's system of Children's Health Services Genetics Program, including significant roles as counselors and information sources on special needs social services and support organizations. Unique features of individual health districts, (e.g., the changing face of some rural communities in ethnocultural diversity and socioeconomic character), present new challenges to current and future genetics services delivery. Preparedness as to educational needs of both health professionals and the lay population is of foremost concern in light of the ever expanding knowledge and technology in medical genetics. Perspectives on genetics and an overview of services offered by a local private sector counselor are included for comparison to state supported services. The nature of the interactions which transpire between private and public genetic services resources in Georgia will be described. A special focus of this research includes issues associated with sickle cell disease newborn screening service delivery process in Georgia, with particular attention paid to patient follow-up and transition to primary care. Of particular interest to this focus is the problem of loss to follow-up in the current system. Critical factors in education and counseling of sickle cell patients and the expectations of expanding roles of primary care physicians are discussed. The Florida approach to the delivery of genetic services contrasts to the Georgia model by placing more emphasis on a consultant-specialist team approach.

    Two case studies, one involving a proposed synfuels technology licensing/technical assistance agreement and one a joint marketing of energy production and conservation equipment, illustrate how antitrust laws can affect export activities. The Export Trading Company Act embodies two different approaches to the problem. Title III provides antitrust preclearance protection in the form of immunity from antitrust suits and procedural advantages in private suits against the holder of an export trade certificate of review. The costs of these certificates of review include the time and money spent in preparing the application and negotiating the contents. There may also be costly delays in business plans and a cost in the disclosure of confidential business information. After reviewing the costs and benefits, the author concludes that Title III certificates of review will cost more in the long run, but will provide more benefits.

    In the past, stormwater runoff from landfills has been treated mainly by focusing on reducing the peak storm discharge rates so as not to hydraulically impact downstream subsheds. However, with the advent of stricter water quality regulations based on the Federal Clean Water Act, and the related NPDES and SPDES programs, landfill owners and operators are now legally responsible for the water quality of the runoff once it leaves the landfill site. At the Fresh Kills Landfill in New York City, the world`s largest covering over 2000 acres, landfilling activities have been underway since 1945. With the main objective at all older landfill sites having focused on maximizing the available landfill footprint in order to obtain the most possible airspace volume, consideration was not given for the future siting of stormwater basin structures. Therefore, when SCS Engineers began developing the first comprehensive stormwater management plan for the site, the primary task was to locate potential sites for all the stormwater basins in order to comply with state regulations for peak stormwater runoff control. The basins were mostly constructed where space allowed, and were sized to be as large as possible given siting and subshed area constraints. Seventeen stormwater basins have now been designed and are being constructed to control the peak stormwater runoff for the 25-year, 24-hour storm as required by New York State. As an additional factor of safety, the basins were also designed for controlled discharge of the 100-year, 24 hour storm.

  2. Slow and not so sure: Europe`s long march to electricity market liberalization

    Under Europe`s recent Directive on competition in electricity, Member States retain immense autonomy to set the competitive agenda within their borders. The result may well be a distinctly skewed - and far from open - trade in electricity, and little opportunity for even large customers to make a meaningful choice of suppliers. The final adoption last year by The European Council - effectively the legislative body of the European Community - of a regulatory measure requiring gradual liberalization of Europe`s electricity market is an event of more symbolic than real significance. During the seven years it has taken to negotiate and compromise upon a suitable legal framework for electricity market liberalization, the European market itself has moved on. Effective implementation of the newly adopted framework rules is unlikely to be a real catalyst for change in its own right, although it could still be an important force in shaping the direction of liberalization programs already underway at the national level. This article will examine the state of electricity market liberalization in what is now known as the European Union - the loose quasi-federal structure which subsists between the 15 Member States of the European Community (EC). It will focus in part upon the provisions of the new EC Directive on the creation of a single market for electricity, and in part upon the complex changes which are gradually transforming the European electricity market.

Full text of publication follows: A number of sites in Iraq have some degree of radiological contamination and require decommissioning and remediation in order to ensure radiological safety. Many of these sites in Iraq are located at the nuclear research centre at Al Tuwaitha. The International Atomic Energy Agency (IAEA) Board of Governors has approved a project to assist the Government of Iraq in the evaluation and decommissioning of former facilities that used radioactive materials. The project is divided into three phases: Phase 1: collect and analyze all available data and conduct training of the Iraqi staff, Phase 2: develop a decommissioning and remediation plan, and Phase 3: implement field activities relating to decommissioning, remediation and site selection suitable for final disposal of waste. Four working groups have been established to complete the Phase 1 work and significant progress has been made in drafting a new nuclear law which will provide the legal basis for the licensing of the decommissioning of the former nuclear complex. Work is also underway to collect and analysis existing date, to prioritize future activities and to develop a waste management strategy. This will be a long-term and costly project. (authors)

    The case study concerns two modern human uses of the Columbia River - irrigation aimed at agricultural land reclamation and hydroelectric power. The Grand Coulee Dam has become synonomous with large-scale generation of hydroelectric power providing the Pacific Northwest with some of the least-expensive electricity in the United States. The Columbia Basin Project has created a half-million acres of farmland in Washington out of a spectacular and vast desert. The South Columbia River Basin Irrigation District is seeking to harness the energy present in the water which already runs through its canals, drains, and wasteways. The South District's development strategy is aimed toward reducing the costs its farmers pay for irrigation and raising the capital required to serve the remaining 550,000 acres originally planned as part of the Columbia Basin Project. The economic, institutional, and regulatory problems of harnessing the energy at site PEC 22.7, one of six sites proposed for development, are examined in this case study.

    Subsidence over active longwall mines, which occurs concurrently with mining or is completed within a few days following coal extraction has been studied extensively over the past decade. On the other hand, subsidence over abandoned coal mines is difficult to predict and may take place decades after mining has ceased. Two types of delayed subsidence are normally observed: troughs, which are shallow depressions, and sinks, which are steep-sided pits. Both types of delayed subsidence may cause damages to surface structures. Most of the abandoned coal mines in the Appalachian coal field were mined by the room-and-pillar method. These mines generally are very shallow and are very irregular with unsupported roof spans of varying widths. The approach adopted in this research for predicting the subsidence potential over abandoned coal mines focuses on the development of a mathematical model, essentially a finite element model capable of modeling the viscoelastic behavior of rocks and coal. The simulation of the viscoelastic behavior of rocks and coal is needed for predicting the delayed subsidence. The assessment of subsidence potential over abandoned mine land is currently being conducted on two sites. Site investigation is aimed at obtaining the following data: surface topography, information on the overburden, local geology and ground crater hydrology, the physical and mechanical properties of the rock strats, past subsidence damages, if any, in the area, and the old mine maps. Most of the physical and mechanical properties of the rock strata will be obtained, if possible, from previous tests performed on similar types of rocks. Information on the viscoelastic behavior of the rocks and coals, however, are very scarce.

    This multitask research project was conducted in anticipation of a possible future increase in industrial efforts at CO2 storage in Colorado sedimentary basins. Colorado is already the home to the oldest Rocky Mountain CO2 storage site, the Rangely Oil Field, where CO2-EOR has been underway since the 1980s. The Colorado Geological Survey has evaluated storage options statewide, and as part of the SW Carbon Sequestration Partnership the Survey, is deeply engaged in and committed to suitable underground CO2 storage. As a more sustainable energy industry is becoming a global priority, it is imperative to explore the range of technical options available to reduce emissions from fossil fuels. One such option is to store at least some emitted CO2 underground. In this NETL-sponsored CO2 sequestration project, the Colorado School of Mines and our partners at the University of Colorado have focused on a set of the major fundamental science and engineering issues surrounding geomechanics, mineralogy, geochemistry and reservoir architecture of possible CO2 storage sites (not limited to Colorado). Those are the central themes of this final report and reported below in Tasks 2, 3, 4, and 6. Closely related to these reservoir geoscience issues are also legal, environmental and public acceptance concerns about pore space accessibility—as a precondition for CO2 storage. These are addressed in Tasks 1, 5 and 7. Some debates about the future course of the energy industry can become acrimonius. It is true that the physics of combustion of hydrocarbons makes it impossible for fossil energy to attain a carbon footprint anywhere nearly as low as that of renewables.
