    An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies. Chapters presented are: The FERC Response to Oral Comments on the Proposed Rules Implementing Sections 201 and 210 of PURPA; Additional Changes Made or Not Made That Were Addressed in Other Than Oral Testimony; View on the Proposed Rules Implementing Sections 201 and 210 of PURPA; Response to Comments on the Proposed 201 and 210 Rules; and Summary Analysis of the Environmental Assessment of the Rules.     For over two years, The Keystone Center facilitated a dialogue on State and Federal Regulation of the Electricity Industry. The intent of this report is to assist policy-makers faced with decisions about changes to traditional utility regulation and planning and provide an overview of a diverse group`s deliberations on regulatory jurisdictional conflicts. This report is not a consensus document, rather it is a staff written summary of two years of discussion on the issues. The participants in the Keystone Dialogue believed that all affected interests could benefit from, if nothing else, a summary of their discussions of state/federal issues. The electric utility industry is one of the last remaining, heavily regulated industries in the United States. Rate and corporate regulation is split between state and federal governments and there is distinct regulatory authority at each level. For example, retail rate regulation occurs at the state level, the Federal Energy Regulatory Commission is responsible for wholesale rate regulation under the Federal Power Act, and the Securities and Exchange Commission oversees registered utility holding companies as defined under the Public Utility Holding Company Act of 1935. This jurisdictional split between state and federal regulation has evolved over many years through legislation and litigation on such matters. The creation of this allocation of regulatory responsibility was initiated in 1935 with the passage of the Public Utility Holding Company Act and the Federal Power Act when the economic and technological changes that are now occurring in the industry simply could not have been envisioned.

    Regulation of natural gas imports from Mexico has been dominated by the industry's domestic regulatory-issue agenda throughout the 30-year trade history. Three distinct phases are identified. In the 1950's, Mexican imports were assessed in terms of their effect on a domestic industry experiencing rapid growth and inter-fuel competition. In the 1960's and thereafter, preservation of domestic price regulation was the overriding criterion for determination of the public interest in Mexican import applications. In the most recent phase, national security considerations activated by the energy crisis have increased the salience of foreign economic policy in the regulation of Mexican natural gas imports. Notwithstanding, domestic issues have continued to predominate. The increasing importance of foreign economic policy in determination of the public interest in Mexican imports is apparent in the transformation of regulatory practice. An administrative process in which the Federal Power Commission interpreted a vague Congressional mandate for the public interest in adversarial public hearings was transformed in the Carter Administration. Explicit policy guidelines were enunciated and interpreted in the Department of Energy under the jurisdiction of its Secretary. Policy consistency and containment of pluralist participatory politics were explicit objectives of a new Congressional mandate that greatly modified regulatory procedures initiated by the Natural Gas Act in 1938.

    The NRC has stated its concern about the reliability of the offsite power system as the preferred emergency source and about the possible damage to a pressurized water reactor (PWR) that could result from a rapid decay of power grid frequency. ORNL contracted with NRC to provide technical assistance to establish criteria that can be used to evaluate the offsite power system for the licensing of a nuclear power plant. The results of many of the studies for this contract are recommendations to assess and control the power grid during operation. This is because most of the NRC regulations pertaining to the offsite power system are related to the design of the power grid, and we believe that additional emphasis on monitoring the power grid operation will improve the reliability of the nuclear plant offsite power supply. 46 refs., 10 figs.

    A current trend in spectrum regulation is to incorporate spectrum sharing through the design of spectrum access rules that support Dynamic Spectrum Access (DSA). This paper develops a decision-theoretic framework for regulators to assess the impacts of different decision rules on both primary and secondary operators. We analyze access rules based on sensing and exclusion areas, which in practice can be enforced through geolocation databases. Our results show that receiver-only sensing provides insufficient protection for primary and co-existing secondary users and overall low social welfare. On the other hand, using sensing information between the transmitter and receiver of a communication link, provides dramatic increases in system performance. The performance of using these link end points is relatively close to that of using many cooperative sensing nodes associated to the same access point and large link exclusion areas. These results are useful to regulators and network developers in understanding in developing rules for future DSA regulation.

This report presents and discusses the Commission's final version of that policy statement now entitled, ''Policy Statement on Severe Reactor Accidents Regarding Future Designs and Existing Plants.'' It provides an overview of comments received from the public and the Advisory Committee on Reactor Safeguards and the staff response to these. The US Department of Transportation's (DOT) Research and Special Programs Administration (RSPA) enacted the regulation with the intent of ensuring a qualified workforce by the year 2002. Under the OQ Rule, the natural gas and liquid pipeline industry is required to train, test, and maintain records for its workforce. Operators must develop a written qualification program by April 27, 2001, and complete the qualification of individuals performing covered tasks by October 29, 2002.     On February 8, 2008, a three-judge panel on the D.C. Circuit of the U.S. Court of Appeals issued a decision to vacate the Clean Air Mercury Rule (CAMR). In its ruling, the panel cited the history of hazardous air pollutant regulation under Section 112 of the Clean Air Act (CAA). Section 112, as written by Congress, listed emitted mercury as a hazardous air pollutant that must be subject to regulation unless it can be proved harmless to public welfare and the environment. In 2000, the Environmental Protection Agency ruled that mercury was indeed hazardous and must be regulated under Section 112 and, therefore, subjected to the best available control technology for mitigation.

    Productions of waste containers, waste forms and, consequently, waste packages are based on the regulations issued by the German Federal Ministry for the Environment and on the repository storage criteria of the Federal Office for Radiation Protection. Waste treatment facilities must install quality assurance systems and introduce detailed conditioning rules in order to verify these requirements. The conditioning rules incorporate descriptions of all conditioning steps as well as instructions to operators; they are laid down in conditioning manuals. By way of example, the procedure for evaporator concentrate cementation is outlined.

    This report of the Committee on Oil Pipeline Regulations is divided into five sections. Section I addresses Order 561, a final rule entitled [open quotes]Revisions to Oil Pipeline Regulations Pursuant to the Energy Policy Act of 1992,[close quotes] which was released by the Federal Energy Regulatory Commission (FERC) on October 23, 1993. Section II discusses the question of FERC jurisdiction over partial abandments of service, focusing on the ARCO Pipe Line Co. case which centered on whether a pipeline may discontinue shipping in one direction even though the pipeline will continue to ship in another direction, and the Chevron Pipe Line Co. case in which the Commission ruled that it does not have the authority to prevent a pipeline from temporarily suspending service. Section II addresses the Lakehead Pipe Line Co., Ltd. Partnership case, in which the Administrative Law Judge issued an Initial Decision resolving Phase I issues. Section IV of the article discusses whether or not a pipeline may base its rates on the cost of leasing capacity from an other pipeline. Five cases are examined in which pipelines that proposed initial rates allegedly based on the cost of a lease found their tariffs protested. Section V reviews the matter of the Williams Pipe Line Co. rate case in which the Commission issued an order on complaint in which it granted in part and denied in part several shippers' request for an order directing Williams Pipe Line Co. to (1) cease levying unauthorized charges, (2) pay reparations to shippers, and (3) be subjected to sanction for violations of the Interstate Commerce Act.

The CAM stores data tags associated with rules of a security policy to compare the bus transaction tag to the data tags. The CAM generates an output signal indicating whether one or more matches occurred. The response policy unit is coupled to the CAM to receive the output signal from the CAM and to execute a policy action in response to the output signal.

    Many who speak of the end of the Cold War emphasize the warming of international relations when they speak of the momentous consequences of this event. According to this image, the half century since Trinity has been a period of sparse international communication during which the Eastern and Western blocs hibernated in their isolated dens of security alliances. Yet it is equally valid to consider the implications of the end of the war footing that has underlain the policies of all of the major military powers during the last fifty years. While meaningful international dialogue was in a state of relative lethargy during much of this period, the military establishments of the Great Powers were actively engaged in using as much force as possible in their efforts to control world affairs, short of triggering a nuclear holocaust. International discourse, at least in English, was rife with such military images as appeasement, containment, crisis stability, and tripwires. From the military posture of the U.S. and Russia a tense peace ironically emerged, but the terms by which decisions were made about controlling weapons of mass destruction (i.e., nuclear, chemical, and biological weapons) were the terms of war. The thesis of this paper is that the end of the Cold War marks a shift away from reliance on military might toward an international commitment to control weapons of mass destruction through the rule of law developed by John Rawls. The progression of agreements during this century to limit weapons of mass destruction testifies to this new development. A review of arms control agreements that the U.S. is a part of show clear growth of the rule of law as the world has left the Cold War.

    In the near term, regulators, utility managements, and legislators will grapple with numerous issues surrounding the development of cogeneration projects as sources of electric power. The Federal Energy Regulatory Commission predicts that 12,000 MW of new cogeneration plants will be constructed during the 1980s, and all 50 states are in the process of implementing new regulations pursuant to the Public Utility Regulatory Policies Act. The US utility system's overall fuel efficiency of 29% offers rich opportunities to conserve fuel, reduce costs, and decrease pollution via cogeneration. Policymakers should stop viewing utilities simply as efficiency tax collectors on the one hand and opponents of innovation on the other. In addition to mothballing inefficient central utility stations, the US must rapidly deploy district heating with cogenerated heat; policymakers should look beyond the obsolete stream systems and encourage development of the high-temperature hot-water systems so successful in Europe.

    Many computational intelligence techniques for anomaly based network intrusion detection can be found in literature. Translating a newly discovered intrusion recognition criteria into a distributable rule can be a human intensive effort. This paper explores a multi-modal genetic algorithm solution for autonomous rule creation. This algorithm focuses on the process of creating rules once an intrusion has been identified, rather than the evolution of rules to provide a solution for intrusion detection. The algorithm was demonstrated on anomalous ICMP network packets (input) and Snort rules (output of the algorithm). Output rules were sorted according to a fitness value and any duplicates were removed. The experimental results on ten test cases demonstrated a 100 percent rule alert rate. Out of 33,804 test packets 3 produced false positives. Each test case produced a minimum of three rule variations that could be used as candidates for a production system.

    The Gerasimov-Drell-Hearn sum rule and related dispersive integrals connect real and virtual Compton scattering to inclusive photo- and electroproduction. Being based on universal principles as causality, unitarity, and gauge invariance, these relations provide a unique testing ground to study the internal degrees of freedom that hold a system together. The present contribution reviews the spin-dependent sum rules and cross sections of the nucleon. At small momentum transfer, the data sample information on the long range phenomena (Goldstone bosons and collective resonances), whereas the primary degrees of freedom (quarks and gluons) become visible at large momentum transfer (short distance). The rich body of new data covers a wide range of phenomena from coherent to incoherent processes, and from the generalized spin polarizabilities on the low-energy side to higher twist effects in deep inelastic scattering.

    President Carter issued Executive Order 12044 (3/28/78) that required all Federal agencies to distinguish between significant and insignificant regulations, and to determine whether a regulation will result in major impacts. This study gathered information on the impact of the order and the guidelines on the Office of Conservation and Solar Energy (CS) regulatory practices, investigated problems encountered by the CS staff when implementing the order and guidelines, and recommended solutions to resolve these problems. Major tasks accomplished and discussed are: (1) legislation, Executive Orders, and DOE Memoranda concerning Federal administrative procedures relevant to the development and analysis of regulations within CS reviewed; (2) relevant DOE Orders and Memoranda analyzed and key DOE and CS staff interviewed in order to accurately describe the current CS regulatory process; (3) DOE staff from the Office of the General Counsel, the Office of Policy and Evaluation, the Office of the Environment, and the Office of the Secretary interviewed to explore issues and problems encountered with current CS regulatory practices; (4) the regulatory processes at five other Federal agencies reviewed in order to see how other agencies have approached the regulatory process, dealt with specific regulatory problems, and responded to the Executive Order; and (5) based on the results of the preceding four tasks, recommendations for potential solutions to the CS regulatory problems developed.     This paper discusses the initiative to transfer the regulation of Department of Energy (DOE) nuclear facilities to the US Nuclear Regulatory Commission (NRC). The paper gives an overview of some of the major technical, policy and legal issues that accompany this initiative. The paper focuses on specific issues and how they may be affected by external regulation of occupational radiation protection at DOE facilities. Differences between the NRC and the DOE approach to regulating nuclear safety are compared and contrasted. Some projected impacts from this transition are examined. Finally, recommendations are provided that may enhance the transition, increasing the likelihood of successful external NRC regulation.

    In the US, there are three new regulations now in development that will lower the limits for NO{sub x} emissions from gas turbines: (1) New National Ambient Air Quality Standards (NAAQS) for Particulate Matter, and Possibly revision to the Ozone standard (both of these new programs will target NO{sub x} emissions); (2) New regulations stemming from the Ozone Transport Assessment Group (OTAG) recommendations (again, NO{sub x} is the primary focus); (3) Revision of the New Source Performance Standard (NSPS) for gas turbines and a new rule that will impose new toxic emission requirements, (the Industrial Combustion Coordinated Rulemaking, stemming from revisions to Title III of the Clean Sir Act Amendments of 1990). The toxic rule should be of particular concern to the gas turbine industry in that it may impose the use of expensive toxic emission control techniques that may not provide any significant health benefits to the public. In addition, the European Community is currently drafting a new regulation for combustion sources that will require gas turbines to meet levels that are lower than any in Europe today. This paper will consider all 5 of these regulatory actions and will: review the proposed regulations; discuss timing for regulation development and implementation; assess the probable impact of each regulation; and provide opinions on the fate of each regulation. Both manufacturers and users of gas turbines should be aware of these proceedings and take an active role in the rule development.

    Recently (hep-th/9307183) we showed that for the case of the WZW- and the minimal models fusion can be understood as a certain ring-like tensor product of the symmetry algebra. In this paper we generalize this analysis to arbitrary chiral algebras. We define the tensor product of conformal field theory in the general case and prove that it is associative and symmetric up to equivalence. We also determine explicitly the action of the chiral algebra on this tensor product. In the second part of the paper we demonstrate that this framework provides a powerful tool for calculating restrictions for the fusion rules of chiral algebras. We exhibit this for the case of the $W_{3}$-algebra and the $N=1$ and $N=2$ NS superconformal algebras.

This includes the case when $f"$ is integrable in the Henstock--Kurzweil sense or as a distribution. All error estimates are shown to be sharp for the given assumptions on $f"$. It is shown how to make these formulas exact for all cubic polynomials $f$. Composite formulas are computed for uniform partitions.

We show that the sum rule of order N may be obtained in terms of a diagrammatic expansion, with (N?1)!/2 independent diagrams. These sum rules are used to derive upper and lower bounds to the energy of the fundamental mode of an inhomogeneous string; we also show that it is possible to improve these approximations taking into account the asymptotic behavior of the spectrum and applying the Shanks transformation to the sequence of approximations obtained to the different orders. We discuss three applications of these results. -- Highlights: •We derive an explicit expression for the sum rules of an inhomogeneous string. •We obtain a diagrammatic representation for the sum rules of a given order. •We obtain precise bounds on the lowest eigenvalue of the string.

    Feed-in tariffs (FITs) are the most prevalent renewable energy policy used globally to date, and there are many benefits to the certainty offered in the marketplace to reduce development risks and associated financing costs and to grow the renewable energy industry. However, concerns over escalating costs in jurisdictions with FIT policies have led to increased attention on cost control in renewable energy policy design. In recent years, policy mechanisms for containing FIT costs have become more refined, allowing policymakers to exert greater control on policy outcomes and on the resulting costs to ratepayers. As policymakers and regulators in the United States begin to explore the use of FITs, careful consideration must be given to the ways in which policy design can be used to balance the policies' advantages while bounding its costs. This report explores mechanisms that policymakers have implemented to limit FIT policy costs. If designed clearly and transparently, such mechanisms can align policymaker and market expectations for project deployment. Three different policy tools are evaluated: (1) caps, (2) payment level adjustment mechanisms, and (3) auction-based designs. The report employs case studies to explore the strengths and weaknesses of these three cost containment tools. These tools are then evaluated with a set of criteria including predictability for policymakers and the marketplace and the potential for unintended consequences.

    In this paper we explore and develop a simple set of rules that apply to cutting, pasting, and folding honeycomb lattices. We consider origami-like structures that are extinsically flat away from zero-dimensional sources of Gaussian curvature and one-dimensional sources of mean curvature, and our cutting and pasting rules maintain the intrinsic bond lengths on both the lattice and its dual lattice.     Renewable energy certificates (RECs) represent the bundle of information that describes the characteristics of renewable electricity generation, and may be (and increasingly are) sold separately from the underlying electricity itself. RECs are a relatively new phenomenon, emerging as a tradable commodity in voluntary markets in the late 1990s, and gaining strength as a means of compliance with various state policy requirements affecting renewable generation in the early 2000s (Holt and Bird 2005). Twenty states and Washington, D.C. now have mandatory renewables portfolio standard (RPS) obligations, and most of these may be satisfied by owning and retiring RECs. Many states also have fuel source and emissions disclosure requirements, for which RECs are useful. Even where state policy does not allow unbundled and fully tradable RECs to meet these requirements, RECs may still be used as an accounting and verification tool (REC tracking systems are in place or under development in many regions of the U.S.). These applications, plus REC trading activity in support of voluntary green claims, give rise to potential ''double counting'' to the extent that the purchaser of the RECs and the purchaser of the underlying electricity both make claims to the renewable energy attributes of the facility in question (Hamrin and Wingate 2003). When renewable electricity is sold and purchased, an important question therefore arises: ''Who owns the RECs created by the generation of renewable energy?'' In voluntary transactions, most agree that the question of REC ownership can and should be negotiated between the buyer and the seller privately, and should be clearly established by contract. Claims about purchasing renewable energy should only be made if REC ownership can be documented. In many other cases, however, renewable energy transactions are either mandated or encouraged through state or federal policy. In these cases, the issue of REC ownership must often be answered by legislative or regulatory authorities. Some renewable energy contracts pre-date the existence of RECs, however, and in these cases the disposition of RECs is often unclear. Similarly, because of the recent appearance of RECs, legislation and regulation mandating the purchase of renewable energy has sometimes been silent on the disposition of the RECs associated with that generation. The resulting uncertainty in REC ownership has hindered the development of robust REC markets and has, in some cases, led to contention between buyers and sellers of renewable generation. The purpose of this report is to provide information and insight to state policy-makers, utility regulators, and others about different approaches to clarifying the ownership of RECs. We focus exclusively on three distinct areas in which REC ownership issues have arisen: (1) Qualifying Facilities (QFs) that sell their generation under the Public Utility Regulatory Policies Act (PURPA) of 1978; (2) Customer-owned generation that benefits from state net metering rules; and (3) Generation facilities that receive financial incentives from state or utility funds. This is a survey report. It reviews how both the federal government and states have addressed these issues to date, and highlights the arguments that have been raised for different REC ownership dispositions. Our aim is to describe the arguments on each side, and the context for the debates that are occurring. We do not, in this report, provide a list of policy recommendations for how policymakers should be addressing these issues.

    A new technique has recently been developed, in which the Maximum Entropy Method is used to analyze QCD sum rules. This approach has the virtue of being able to directly generate the spectral function of a given operator, without the need of making an assumption about its specific functional form. To investigate whether useful results can be extracted within this method, we have first studied the vector meson channel, where QCD sum rules are traditionally known to provide a valid description of the spectral function. Our results show a significant peak in the region of the experimentally observed {rho}-meson mass, which is in agreement with earlier QCD sum rules studies and suggests that the Maximum Entropy Method is a strong tool for analyzing QCD sum rules.

    Environmental regulations can have a significant impact on product use, disposal, and recycling. This report summarizes the basic aspects of current federal, state and international regulations which apply to end-of-life photovoltaic (PV) modules and PV manufacturing scrap destined for disposal or recycling. It also discusses proposed regulations for electronics that may set the ground of what is to be expected in this area in the near future. In the US, several states have started programs to support the recycling of electronic equipment, and materials destined for recycling often are excepted from solid waste regulations during the collection, transfer, storage and processing stages. California regulations are described separately because they are different from those of most other states. International agreements on the movement of waste between different countries may pose barriers to cross-border shipments. Currently waste moves freely among country members of the Organization of Economic Cooperation and Development (OECD), and between the US and the four countries with which the US has bilateral agreements. However, it is expected, that the US will adopt the rules of the Basel Convention (an agreement which currently applies to 128 countries but not the US) and that the Convection's waste classification system will influence the current OECD waste-handling system. Some countries adopting the Basel Convention consider end-of-life electronics to be hazardous waste, whereas the OECD countries consider them to be non-hazardous. Also, waste management regulations potentially affecting electronics in Germany and Japan are mentioned in this report.

    When policy makers propose new policies, there is a need to assess the costs and benefits of the proposed policy measures, to compare them to existing and alternative policies, and to rank them according to their effectiveness. In the case of equipment energy efficiency regulations, comparing the effects of a range of alternative policy measures requires evaluating their effects on consumers’ budgets, on national energy consumption and economics, and on the environment. Such an approach should be able to represent in a single framework the particularities of each policy measure and provide comparable results. This report presents an integrated methodological framework to assess prospectively the energy, economic, and environmental impacts of energy efficiency policy measures. The framework builds on the premise that the comparative assessment of energy efficiency policy measures should (a) rely on a common set of primary data and parameters, (b) follow a single functional approach to estimate the energy, economic, and emissions savings resulting from each assessed measure, and (c) present results through a set of comparable indicators. This framework elaborates on models that the U.S. Department of Energy (DOE) has used in support of its rulemakings on mandatory energy efficiency standards. In addition to a rigorous analysis of the impacts of mandatory standards, DOE compares the projected results of alternative policy measures to those projected to be achieved by the standards. The framework extends such an approach to provide a broad, generic methodology, with no geographic or sectoral limitations, that is useful for evaluating any type of equipment energy efficiency market intervention. The report concludes with a demonstration of how to use the framework to compare the impacts estimated for twelve policy measures focusing on increasing the energy efficiency of gas furnaces in the United States.

    In this paper, we explore the role of data science in the public policy lifecycle. We posit policy documents (bills, acts, regulations and directives) as forms of social objects and present a methodology to understand interactions between prior context in professional and personal social networks to a given public policy document release. We employ natural language processing tools along with recent advances in semantic reasoning to formulate document-level proximity metrics which we use to predict the relevance (and impact) of the policy artifacts. These metrics serve as a measure of excitation between people and the public policy initiatives.

    This report presents security policies for microprocessor-based systems and gives an example of how to enforce these policies, using an independent, hardware-based monitor, in a hypothetical single-processor system. The purpose of these policies is to detect erroneous behavior of the microprocessor system and to guarantee that accesses (read, write, or execute), by executable procedures,to the various system resources (other procedure, data areas, and peripheral ports) are in accordance with rules that are defined precisely and completely. We present the main result of our research as a ''Second-Order Security Policy'', which describes a segmentation of system resources into a number of ''Blocks'' and defines access rights of each ''Process Block'' to all Blocks in the system. The hardware-monitor example is a conceptual design of an independent monitor that we believe can be built to enforce the second-order policy in real time. This approach will be effective in preventing erroneous accesses to data structures and peripherals and in detecting errors in the transfer of program control from Block to Block. 9 refs., 11 figs., 3 tabs.

    In 2005, the Environmental Protection Agency (EPA) finalized two regulations, the Clean Air Interstate Rule (CAIR) and the Clean Air Mercury Rule CAMR, that would reduce emissions from coal-fired power plants in the United States. Both CAIR and CAMR are included in the Annual Energy Outlook 2006 reference case. The EPA has received 11 petitions for reconsideration of CAIR and has provided an opportunity for public comment on reconsidering certain aspects of CAIR. Public comments were accepted until January 13, 2006. The EPA has also received 14 petitions for reconsideration of CAMR and is willing to reconsider certain aspects of the rule. Public comments were accepted for 45 days after publication of the reconsideration notice in the Federal Register. Several states and organizations have filed lawsuits against CAMR. The ultimate decision of the courts will have a significant impact on the implementation of CAMR.
