    The linkage between Public Utility Commission (PUC) regulation, the deteriorating financial health of the electric utility industry, and implementation of national energy policy, particularly the reduction of foreign petroleum consumption in the utility sector is examined. The role of the Nation's utilities in the pursuit of national energy policy goals and postulates a linkage between PUC regulation, the poor financial health of the utility industry, and the current and prospective failure to displace foreign petroleum in the utility sector is discussed. A brief history of PUC regulation is provided. The concept of regulatory climate and how the financial community has developed a system of ranking regulatory climate in the various State jurisdictions are explained. The existing evidence on the hypothesis that the cost of capital to a utility increases and its availability is reduced as regulatory climate grows more unfavorable from an investor's point of view is analyzed. The implications of this cost of capital effect on the electric utilities and collaterally on national energy policy and electric ratepayers are explained. Finally various State, regional and Federal regulatory responses to problems associated with PUC regulation are examined.

    An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies. Chapters presented are: The FERC Response to Oral Comments on the Proposed Rules Implementing Sections 201 and 210 of PURPA; Additional Changes Made or Not Made That Were Addressed in Other Than Oral Testimony; View on the Proposed Rules Implementing Sections 201 and 210 of PURPA; Response to Comments on the Proposed 201 and 210 Rules; and Summary Analysis of the Environmental Assessment of the Rules.     Low level radioactive waste (LLW) is generated from various nuclear applications in Bangladesh. The major sources of radioactive waste in the country are at present: (a) the 3 MW TRIGA Mark-II research reactor; (b) the radioisotope production facility; (c) the medical, industrial and research facilities that use radionuclides; and (d) the industrial facility for processing monazite sands. Radioactive waste needs to be safely managed because it is potentially hazardous to human health and the environment. According to Nuclear Safety and Radiation Control Act-93, the Bangladesh Atomic Energy Commission (BAEC) is the governmental body responsible for the receipt and final disposal of radioactive wastes in the whole country. Waste management policy has become an important environmental, social, and economical issue for LLW in Bangladesh. Policy and strategies will serve as a basic guide for radioactive waste management in Bangladesh. The waste generator is responsible for on-site collection, conditioning and temporary storage of the waste arising from his practice. The Central Waste Processing and Storage Unit (CWPSU) of BAEC is the designated national facility with the requisite facility for the treatment, conditioning and storage of radioactive waste until a final disposal facility is established and becomes operational. The Regulatory Authority is responsible for the enforcement of compliance with provisions of the waste management regulation and other relevant requirements by the waste generator and the CWPSU. The objective of this paper is to present, in a concise form, basic information about the radioactive waste management infrastructure, regulations, policies and strategies including the total inventory of low level radioactive waste in the country. For improvement and strengthening in terms of operational capability, safety and security of RW including spent radioactive sources and overall security of the facility (CWPSF), the facility is expected to serve waste management need in the country and, in the course of time, the facility may be turned into a regional level training centre. It is essential for safe conduction and culture of research and application in nuclear science and technology maintaining the relevant safety of man and environment and future generations to come.     This report presents the schedules and methods required to comply with the newly promulgated Underground Storage Tank (UST) Regulations Title 40 Code of Federal Regulations (CFR) 280 and 281. These rules were promulgated by the US Environmental Protection Agency (EPA) on September 23, 1988, and became effective December 22, 1988. These regulations are required by Subtitle I of the Resource Conservation and Recovery Act of 1976. Their purpose is to protect the groundwater supplies of the United States in the following ways: Closing old tanks; detecting and remediating tank leaks and spills; establishing stringent standards for new tanks; and upgrade of existing tanks to new-tank standards. 3 refs., 5 tabs.

    By vacating the Federal Energy Commission's (FERC) Order 745 in Electric Power Supply Association vs. FERC (EPSA, 2014) the U.S. Court of Appeals for the D.C Circuit injected uncertainty into the future of demand response (DR) resources in U.S. wholesale markets. Many possible future scenarios in which DR continues to be available to provide capacity for resource adequacy would need to rely on a potential checkerboard of policies promulgated by state utility commissions. However, the states that will be most directly impacted by the potential implications from the EPSA ruling are precisely those that have the fewest policies currently in place to promote retail program development.

    The NRC has stated its concern about the reliability of the offsite power system as the preferred emergency source and about the possible damage to a pressurized water reactor (PWR) that could result from a rapid decay of power grid frequency. ORNL contracted with NRC to provide technical assistance to establish criteria that can be used to evaluate the offsite power system for the licensing of a nuclear power plant. The results of many of the studies for this contract are recommendations to assess and control the power grid during operation. This is because most of the NRC regulations pertaining to the offsite power system are related to the design of the power grid, and we believe that additional emphasis on monitoring the power grid operation will improve the reliability of the nuclear plant offsite power supply. 46 refs., 10 figs.

    On April 13, 1983, the US Nuclear Regulatory Commission issued for public comment a ''Proposed Commission Policy Statement on Severe Accidents and Related Views on Nuclear Reactor Regulation'' (48 FR 16014). This report presents and discusses the Commission's final version of that policy statement now entitled, ''Policy Statement on Severe Reactor Accidents Regarding Future Designs and Existing Plants.'' It provides an overview of comments received from the public and the Advisory Committee on Reactor Safeguards and the staff response to these. In addition to the Policy Statement, the report discusses how the policies of this statement relate to other NRC programs including the Severe Accident Research Program; the implementation of safety measures resulting from lessons learned in the accident at Three Mile Island; safety goal development; the resolution of Unresolved Safety Issues and other Generic Safety Issues; and possible revisions of rules or regulatory requirements resulting from the Severe Accident Source Term Program. Also discussed are the main features of a generic decision strategy for resolving Regulatory Questions and Technical Issues relating to severe accidents; the development and regulatory use of new safety information; the treatment of uncertainty in severe accident decision making; and the development and implementation of a Systems Reliability Program for both existing and future plants to ensure that the realized level of safety is commensurate with the safety analyses used in regulatory decisions.

    A current trend in spectrum regulation is to incorporate spectrum sharing through the design of spectrum access rules that support Dynamic Spectrum Access (DSA). This paper develops a decision-theoretic framework for regulators to assess the impacts of different decision rules on both primary and secondary operators. We analyze access rules based on sensing and exclusion areas, which in practice can be enforced through geolocation databases. Our results show that receiver-only sensing provides insufficient protection for primary and co-existing secondary users and overall low social welfare. On the other hand, using sensing information between the transmitter and receiver of a communication link, provides dramatic increases in system performance. The performance of using these link end points is relatively close to that of using many cooperative sensing nodes associated to the same access point and large link exclusion areas. These results are useful to regulators and network developers in understanding in developing rules for future DSA regulation.

    There is growing state-level interest in the USA in accelerating the development of low-carbon coal technologies, including carbon capture and storage (CCS). Many states have adopted greenhouse gas emission targets and made commitments to low-carbon energy, and believe that these polices will result in job creation, air quality improvements, and reliable low-cost energy supplies. This paper provides an overview of options for states to encourage the deployment of carbon capture and sequestration. It describes actions (including legislation, regulations, and incentives) throughout the country. It also reviews in greater detail the range of policies available to state Public Utility Commissions for advancing deployment of CCS. Many states are adopting meaningful incentives for integrated gasification combined cycle (IGCC) power plants, and, as a handful of states are beginning to demonstrate, a number of these incentives can apply to CCS as well. States also have a number of authorities relevant to advancement of clean coal power, particularly within the domain of state public utility commissions (PUCs). State commissions have a wide array of policy options available to them in pursuing this goal, and will play a crucial role in determining the speed and effectiveness with which such technologies are deployed. States also enjoy major advantages, such as their direct jurisdiction over many critical power plant issues (including siting and retail ratemaking) that federal agencies do not possess. Regardless of the final form of federal greenhouse gas rules, states have the chance to gain experience as first movers and policy innovators, and will play an important role in shaping a low-carbon future. Although national policy is essential, a proactive approach by state policymakers and regulators to drive CCS can reduce future compliance costs, speed the required technological developments, and pave the way for future national policy.

    On February 8, 2008, a three-judge panel on the D.C. Circuit of the U.S. Court of Appeals issued a decision to vacate the Clean Air Mercury Rule (CAMR). In its ruling, the panel cited the history of hazardous air pollutant regulation under Section 112 of the Clean Air Act (CAA). Section 112, as written by Congress, listed emitted mercury as a hazardous air pollutant that must be subject to regulation unless it can be proved harmless to public welfare and the environment. In 2000, the Environmental Protection Agency ruled that mercury was indeed hazardous and must be regulated under Section 112 and, therefore, subjected to the best available control technology for mitigation.

    Many who speak of the end of the Cold War emphasize the warming of international relations when they speak of the momentous consequences of this event. According to this image, the half century since Trinity has been a period of sparse international communication during which the Eastern and Western blocs hibernated in their isolated dens of security alliances. Yet it is equally valid to consider the implications of the end of the war footing that has underlain the policies of all of the major military powers during the last fifty years. While meaningful international dialogue was in a state of relative lethargy during much of this period, the military establishments of the Great Powers were actively engaged in using as much force as possible in their efforts to control world affairs, short of triggering a nuclear holocaust. International discourse, at least in English, was rife with such military images as appeasement, containment, crisis stability, and tripwires. From the military posture of the U.S. and Russia a tense peace ironically emerged, but the terms by which decisions were made about controlling weapons of mass destruction (i.e., nuclear, chemical, and biological weapons) were the terms of war. The thesis of this paper is that the end of the Cold War marks a shift away from reliance on military might toward an international commitment to control weapons of mass destruction through the rule of law developed by John Rawls. The progression of agreements during this century to limit weapons of mass destruction testifies to this new development. A review of arms control agreements that the U.S. is a part of show clear growth of the rule of law as the world has left the Cold War.

    A parallel processing system for production rule programs utilizes a host processor for storing production rule right hand sides (RHS) and a plurality of rule processors for storing left hand sides (LHS). The rule processors operate in parallel in the recognize phase of the system recognize -Act Cycle to match their respective LHS's against a stored list of working memory elements (WME) in order to find a self consistent set of WME's. The list of WME is dynamically varied during the Act phase of the system in which the host executes or fires rule RHS's for those rules for which a self-consistent set has been found by the rule processors. The host transmits instructions for creating or deleting working memory elements as dictated by the rule firings until the rule processors are unable to find any further self-consistent working memory element sets at which time the production rule system is halted.

    President Carter issued Executive Order 12044 (3/28/78) that required all Federal agencies to distinguish between significant and insignificant regulations, and to determine whether a regulation will result in major impacts. This study gathered information on the impact of the order and the guidelines on the Office of Conservation and Solar Energy (CS) regulatory practices, investigated problems encountered by the CS staff when implementing the order and guidelines, and recommended solutions to resolve these problems. Major tasks accomplished and discussed are: (1) legislation, Executive Orders, and DOE Memoranda concerning Federal administrative procedures relevant to the development and analysis of regulations within CS reviewed; (2) relevant DOE Orders and Memoranda analyzed and key DOE and CS staff interviewed in order to accurately describe the current CS regulatory process; (3) DOE staff from the Office of the General Counsel, the Office of Policy and Evaluation, the Office of the Environment, and the Office of the Secretary interviewed to explore issues and problems encountered with current CS regulatory practices; (4) the regulatory processes at five other Federal agencies reviewed in order to see how other agencies have approached the regulatory process, dealt with specific regulatory problems, and responded to the Executive Order; and (5) based on the results of the preceding four tasks, recommendations for potential solutions to the CS regulatory problems developed. Local and regional planning policies can control land use changes in an urban region, which in turn alter local climate regulation. Thus, this paper describes a method for estimating the impacts of current land uses as well as local and regional planning policies on local climate regulation, using evapotranspiration and land surface emissivity as indicators. This method can be used by practitioners to evaluate their policies. An application of this method is demonstrated for the case study Leipzig (Germany). Results for six selected planning policies in Leipzig indicate their distinct impacts on climate regulation and especially the role of their spatial extent. The proposed method was found to easily produce a qualitative assessment of impacts of planning policies on climate regulation.

    Representatives of industry, the US Chamber of Commerce, the Citizen/Labor Energy Coalition, government agencies, and others testified at a hearing on the issue of reducing oil imports as a way to strengthen the domestic oil industry. An amendment to the trade bill that would impose an import fee on oil raised concerns that it might be counter-productive by causing hardship on individuals and other industries because of higher prices. Another concern was that the amendment relinquishes congressional power to tax and set policy to the president. The discussion covered the level of oil imports and changes in import activity at various points in history, although there was little consensus of interpretation. Oil marketers oppose the amendment on the ground that automatic triggers of import fees, quotas, and other strategies are unfair and economically risky. An appendix with additional material submitted for the record follows the testimony of the 14 witnesses.

    The cellular automata with local permutation invariance are considered. We show that in the two-state case the set of such automata coincides with the generalized Game of Life family. We count the number of equivalence classes of the rules under consideration with respect to permutations of states. This reduced number of rules can be efficiently generated in many practical cases by our C program. Since a cellular automaton is a combination of a local rule and a lattice, we consider also maximally symmetric two-dimensional lattices.     In the US, there are three new regulations now in development that will lower the limits for NO{sub x} emissions from gas turbines: (1) New National Ambient Air Quality Standards (NAAQS) for Particulate Matter, and Possibly revision to the Ozone standard (both of these new programs will target NO{sub x} emissions); (2) New regulations stemming from the Ozone Transport Assessment Group (OTAG) recommendations (again, NO{sub x} is the primary focus); (3) Revision of the New Source Performance Standard (NSPS) for gas turbines and a new rule that will impose new toxic emission requirements, (the Industrial Combustion Coordinated Rulemaking, stemming from revisions to Title III of the Clean Sir Act Amendments of 1990). The toxic rule should be of particular concern to the gas turbine industry in that it may impose the use of expensive toxic emission control techniques that may not provide any significant health benefits to the public. In addition, the European Community is currently drafting a new regulation for combustion sources that will require gas turbines to meet levels that are lower than any in Europe today. This paper will consider all 5 of these regulatory actions and will: review the proposed regulations; discuss timing for regulation development and implementation; assess the probable impact of each regulation; and provide opinions on the fate of each regulation. Both manufacturers and users of gas turbines should be aware of these proceedings and take an active role in the rule development.

    The US Acid Rain Program is one of the first, and by far the most extensive, applications of a market based approach to pollution control. From the beginning, there has been concern whether utilities would participate in allowance trading, and whether regulatory activity at the state level would further complicate utilities` decision to trade allowances. This paper finds that public utility commission regulation has encouraged allowance trading activity in states with regulatory rulings, but that allowance trading activity has not been limited to states issuing regulations. Until there is evidence suggesting that significant additional cost savings could have been obtained if additional allowance trading activity had occurred in states without regulations or that utilities in states with regulations are still not taking advantage of all cost saving trading opportunities, this analysis suggests that there is little reason to believe that allowance trading activity is impeded by public utility commission regulations.

    Corrected trapezoidal rules are proved for $\\int_a^b f(x)\\,dx$ under the assumption that $f"\\in L^p([a,b])$ for some $1\\leq p\\leq\\infty$. Such quadrature rules involve the trapezoidal rule modified by the addition of a term $k[f'(a)-f'(b)]$. The coefficient $k$ in the quadrature formula is found that minimizes the error estimates. It is shown that when $f'$ is merely assumed to be continuous then the optimal rule is the trapezoidal rule itself. In this case error estimates are in terms of the Alexiewicz norm. This includes the case when $f"$ is integrable in the Henstock--Kurzweil sense or as a distribution. All error estimates are shown to be sharp for the given assumptions on $f"$. It is shown how to make these formulas exact for all cubic polynomials $f$. Composite formulas are computed for uniform partitions.

    Feed-in tariffs (FITs) are the most prevalent renewable energy policy used globally to date, and there are many benefits to the certainty offered in the marketplace to reduce development risks and associated financing costs and to grow the renewable energy industry. However, concerns over escalating costs in jurisdictions with FIT policies have led to increased attention on cost control in renewable energy policy design. In recent years, policy mechanisms for containing FIT costs have become more refined, allowing policymakers to exert greater control on policy outcomes and on the resulting costs to ratepayers. As policymakers and regulators in the United States begin to explore the use of FITs, careful consideration must be given to the ways in which policy design can be used to balance the policies' advantages while bounding its costs. This report explores mechanisms that policymakers have implemented to limit FIT policy costs. If designed clearly and transparently, such mechanisms can align policymaker and market expectations for project deployment. Three different policy tools are evaluated: (1) caps, (2) payment level adjustment mechanisms, and (3) auction-based designs. The report employs case studies to explore the strengths and weaknesses of these three cost containment tools. These tools are then evaluated with a set of criteria including predictability for policymakers and the marketplace and the potential for unintended consequences.

    In this paper we explore and develop a simple set of rules that apply to cutting, pasting, and folding honeycomb lattices. We consider origami-like structures that are extinsically flat away from zero-dimensional sources of Gaussian curvature and one-dimensional sources of mean curvature, and our cutting and pasting rules maintain the intrinsic bond lengths on both the lattice and its dual lattice. We find that a small set of rules is allowed providing a framework for exploring and building kirigami -- folding, cutting, and pasting the edges of paper.

    Environmental regulations can have a significant impact on product use, disposal, and recycling. This report summarizes the basic aspects of current federal, state and international regulations which apply to end-of-life photovoltaic (PV) modules and PV manufacturing scrap destined for disposal or recycling. It also discusses proposed regulations for electronics that may set the ground of what is to be expected in this area in the near future. In the US, several states have started programs to support the recycling of electronic equipment, and materials destined for recycling often are excepted from solid waste regulations during the collection, transfer, storage and processing stages. California regulations are described separately because they are different from those of most other states. International agreements on the movement of waste between different countries may pose barriers to cross-border shipments. Currently waste moves freely among country members of the Organization of Economic Cooperation and Development (OECD), and between the US and the four countries with which the US has bilateral agreements. However, it is expected, that the US will adopt the rules of the Basel Convention (an agreement which currently applies to 128 countries but not the US) and that the Convection's waste classification system will influence the current OECD waste-handling system. Some countries adopting the Basel Convention consider end-of-life electronics to be hazardous waste, whereas the OECD countries consider them to be non-hazardous. Also, waste management regulations potentially affecting electronics in Germany and Japan are mentioned in this report.

    When policy makers propose new policies, there is a need to assess the costs and benefits of the proposed policy measures, to compare them to existing and alternative policies, and to rank them according to their effectiveness. In the case of equipment energy efficiency regulations, comparing the effects of a range of alternative policy measures requires evaluating their effects on consumers’ budgets, on national energy consumption and economics, and on the environment. Such an approach should be able to represent in a single framework the particularities of each policy measure and provide comparable results. This report presents an integrated methodological framework to assess prospectively the energy, economic, and environmental impacts of energy efficiency policy measures. The framework builds on the premise that the comparative assessment of energy efficiency policy measures should (a) rely on a common set of primary data and parameters, (b) follow a single functional approach to estimate the energy, economic, and emissions savings resulting from each assessed measure, and (c) present results through a set of comparable indicators. This framework elaborates on models that the U.S. Department of Energy (DOE) has used in support of its rulemakings on mandatory energy efficiency standards. In addition to a rigorous analysis of the impacts of mandatory standards, DOE compares the projected results of alternative policy measures to those projected to be achieved by the standards. The framework extends such an approach to provide a broad, generic methodology, with no geographic or sectoral limitations, that is useful for evaluating any type of equipment energy efficiency market intervention. The report concludes with a demonstration of how to use the framework to compare the impacts estimated for twelve policy measures focusing on increasing the energy efficiency of gas furnaces in the United States.

    In this paper, we explore the role of data science in the public policy lifecycle. We posit policy documents (bills, acts, regulations and directives) as forms of social objects and present a methodology to understand interactions between prior context in professional and personal social networks to a given public policy document release. We employ natural language processing tools along with recent advances in semantic reasoning to formulate document-level proximity metrics which we use to predict the relevance (and impact) of the policy artifacts. These metrics serve as a measure of excitation between people and the public policy initiatives.

    In 2005, the Environmental Protection Agency (EPA) finalized two regulations, the Clean Air Interstate Rule (CAIR) and the Clean Air Mercury Rule CAMR, that would reduce emissions from coal-fired power plants in the United States. Both CAIR and CAMR are included in the Annual Energy Outlook 2006 reference case. The EPA has received 11 petitions for reconsideration of CAIR and has provided an opportunity for public comment on reconsidering certain aspects of CAIR. Public comments were accepted until January 13, 2006. The EPA has also received 14 petitions for reconsideration of CAMR and is willing to reconsider certain aspects of the rule. Public comments were accepted for 45 days after publication of the reconsideration notice in the Federal Register. Several states and organizations have filed lawsuits against CAMR. The ultimate decision of the courts will have a significant impact on the implementation of CAMR.
