    The potential environmental impact of offshore platform disposal can be illustrated by both the numbers of platforms and the complexity of their abandonment options. Some 7,000 platforms are in place worldwide. In the US, approximately a quarter of the platforms are more than 25 years old and in sight of their end of service. In addition, 22,000 miles of pipeline are located on the Outer Continental Shelf (OCS) in the United States. There are more offshore platforms in the U.S. Gulf of Mexico than in any other single area in the world. It is estimated that between October 1995 and December 2000, approximately 665 of the nearly 3,800 existing structures will be removed. Couple this with the mammoth size, the vagaries of the ocean, and the levels of sometimes conflicting international and federal laws, and the magnitude of the challenge to protect the environment becomes clear. The Offshore International Newsletter (11/06/95) stated, {open_quotes}In three of the last four years, annual Gulf of Mexico platform removals have exceeded installations, a trend that will likely continue.{close_quotes} Between 100 and 150 platforms have been removed from the OCS each year for the past six or seven years. As increasing numbers of wells, pipelines, and platforms are decommissioned and disposed of, it is important that the relevant techniques, policies, and regulations be discussed and evaluated. The goal of this workshop is to facilitate and document this discussion in an open, objective, and inclusive way. Since U.S. practices and policies provide precedents for other countries, international participation is encouraged and anticipated.

    An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). It is felt, however, that the analysis is applicable both to cogeneration and other emerging technologies.     As offshore oil and gas resources become exhausted, the associated production platforms and facilities will be decommissioned. The world-wide oil and gas industry is strictly regulated by global, regional and national guidelines which have been developed by governments to find the most responsible framework to perform the decommissioning. In the summer of 1995, the Brent Spar incident brought uncertainty to decommissioning world-wide. In June of 1995, a moratorium prohibiting sea disposal within the North East Atlantic was imposed by the Oslo Commission, and an unsuccessful attempt was made in December of 1995 to impose a world-wide moratorium on sea disposal at the London Convention.

    In the past, most efforts for reducing airborne radio nuclide releases and controlling radioactive wastes have been directed to the development of new and improved technologies. Little attention has been paid to the possible application to these problems of new, innovative policies. Yet, experience in other fields shows that such applications could be beneficial. A prime example is the {open_quotes}open-market trading rule,{close_quotes} now being widely used in the U.S. for the control of a range of environmental problems. Through this rule, nuclear facility operators would be permitted to control airborne emissions in a more cost-effective manner, and those responsible for decommissioning and decontaminating nuclear facilities no longer in operation could do so at far lower costs while generating significantly smaller volumes of radioactive wastes. Application of such a policy would also significantly reduce the demands on existing, and the need for research to develop new, improved, control technologies. 16 refs.

    Low level radioactive waste (LLW) is generated from various nuclear applications in Bangladesh. The major sources of radioactive waste in the country are at present: (a) the 3 MW TRIGA Mark-II research reactor; (b) the radioisotope production facility; (c) the medical, industrial and research facilities that use radionuclides; and (d) the industrial facility for processing monazite sands. Radioactive waste needs to be safely managed because it is potentially hazardous to human health and the environment. According to Nuclear Safety and Radiation Control Act-93, the Bangladesh Atomic Energy Commission (BAEC) is the governmental body responsible for the receipt and final disposal of radioactive wastes in the whole country. Waste management policy has become an important environmental, social, and economical issue for LLW in Bangladesh. Policy and strategies will serve as a basic guide for radioactive waste management in Bangladesh. The waste generator is responsible for on-site collection, conditioning and temporary storage of the waste arising from his practice. The Central Waste Processing and Storage Unit (CWPSU) of BAEC is the designated national facility with the requisite facility for the treatment, conditioning and storage of radioactive waste until a final disposal facility is established and becomes operational. The Regulatory Authority is responsible for the enforcement of compliance with provisions of the waste management regulation and other relevant requirements by the waste generator and the CWPSU. The objective of this paper is to present, in a concise form, basic information about the radioactive waste management infrastructure, regulations, policies and strategies including the total inventory of low level radioactive waste in the country. These regulations are required by Subtitle I of the Resource Conservation and Recovery Act of 1976.     Utility regulators increasingly take responsibility for the [open quotes]extemalities[close quotes] associated with their decisions, meaning the economic and social costs related to rate decisions or other kinds of authorizations. Yet, when Congress adopted the National Environmental Policy Act of 1969 (NEPA), it intervened to ensure protection of the natural environment, not from abuses by the citizenry but from the activities of the federal government itself. Comprised of action forcing procedures, NEPA was designed to infuse the decisional processes of federal agencies with a broad awareness of the environmental consequences of their actions. NEPA encourages decisionmakers to counterbalance the organic statutory and political missions of their departments or agencies with a sensitivity to the ecological consequences of their directives and authorizations. This paper examines how the requirements of NEPA have fared in the environment of classical public utility regulation at the Federal Energy Regulatory Commission. Commission proceedings did not evidence any widely held opinion that economic regulation of the gas industry is hostile to the NEPA process.

    This study illuminates the fact that government petroleum regulations did not work as expected, and that they had contradictory and even destructive results. Using the methods and language of economic analysis, it also encompasses the broad social and political scope of the energy crisis, which is described as primarily a battle over the appropriate distribution of income within society, rather than the manifestation of some massive failure of markets and institutions to allocate the nation's resources effectively. One of the author's conclusions is that when policymakers address the income-transfer issue, they should use the straightforward mechanism of general income tax and welfare legislation. The book analyzes such topics as the position of the US oil industry in the international market, the Entitlements Program, and the effects of the Emergency Petroleum Allocation Act of 1973, the Energy Policy and Conservation Act of 1974, and the Crude Oil Windfall Profits Tax Act of 1980. 196 references, 30 figures, 35 tables.

    In 1984 the US Congress enacted the Hazardous and Solid Waste Amendments (HSWA) to the Resource Conservation and Recovery Act (RCRA). One of the goals of this legislation was to focus attention on the need to reduce or eliminate hazardous waste so as to minimize the threat to human health and the environment. Subsequently, in September of 1988, DOE issued a Radioactive Waste Management Policy, DOE Order 5820.2A, and in November a General Environmental Program Order, DOE Order 5400.1. These documents embrace the principles set forth in RCRA, and expand their scope to include radioactive, mixed, and pollutant waste, and all actions for reducing waste from the point of generation through waste treatment, storage, transportation and disposal. This paper will present an overview of the legislation and policies for waste reduction and, in addition, give site responsibilities for implementing waste reduction program activities.

    As wind energy becomes a larger portion of the world's energy portfolio there has been an increased interest for wind turbines to control their active power output to provide ancillary services which support grid reliability. One of these ancillary services is the provision of frequency regulation, also referred to as secondary frequency control or automatic generation control (AGC), which is often procured through markets which recently adopted performance-based compensation. A wind turbine with a control system developed to provide active power ancillary services can be used to provide frequency regulation services. Simulations have been performed to determine the AGC tracking performance at various power schedule set-points, participation levels, and wind conditions. The performance metrics used in this study are based on those used by several system operators in the US. Another metric that is analyzed is the damage equivalent loads (DELs) on turbine structural components, though the impacts on the turbine electrical components are not considered. The results of these single-turbine simulations show that high performance scores can be achieved when there is sufficient wind resource available. The capability of a wind turbine to rapidly and accurately follow power commands allows for high performance even when tracking rapidly changing AGC signals. As the turbine de-rates to meet decreased power schedule set-points there is a reduction in the DELs, and the participation in frequency regulation has a negligible impact on these loads.

    There is growing state-level interest in the USA in accelerating the development of low-carbon coal technologies, including carbon capture and storage (CCS). Many states have adopted greenhouse gas emission targets and made commitments to low-carbon energy, and believe that these polices will result in job creation, air quality improvements, and reliable low-cost energy supplies. This paper provides an overview of options for states to encourage the deployment of carbon capture and sequestration. It describes actions (including legislation, regulations, and incentives) throughout the country. It also reviews in greater detail the range of policies available to state Public Utility Commissions for advancing deployment of CCS. Many states are adopting meaningful incentives for integrated gasification combined cycle (IGCC) power plants, and, as a handful of states are beginning to demonstrate, a number of these incentives can apply to CCS as well. States also have a number of authorities relevant to advancement of clean coal power, particularly within the domain of state public utility commissions (PUCs). State commissions have a wide array of policy options available to them in pursuing this goal, and will play a crucial role in determining the speed and effectiveness with which such technologies are deployed. States also enjoy major advantages, such as their direct jurisdiction over many critical power plant issues (including siting and retail ratemaking) that federal agencies do not possess. Regardless of the final form of federal greenhouse gas rules, states have the chance to gain experience as first movers and policy innovators, and will play an important role in shaping a low-carbon future. Although national policy is essential, a proactive approach by state policymakers and regulators to drive CCS can reduce future compliance costs, speed the required technological developments, and pave the way for future national policy.

  5. CONTRACTOR LEGAL MANAGEMENT REQUIREMENTS: FINAL RULE

    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    On February 8, 2008, a three-judge panel on the D.C. Circuit of the U.S. Court of Appeals issued a decision to vacate the Clean Air Mercury Rule (CAMR). In its ruling, the panel cited the history of hazardous air pollutant regulation under Section 112 of the Clean Air Act (CAA). Section 112, as written by Congress, listed emitted mercury as a hazardous air pollutant that must be subject to regulation unless it can be proved harmless to public welfare and the environment. In 2000, the Environmental Protection Agency ruled that mercury was indeed hazardous and must be regulated under Section 112 and, therefore, subjected to the best available control technology for mitigation.

However, considering that economic policy making is causing significant direct and indirect environmental problems and that almost every aspect of governmental policy has an economic aspect, EIAs on economic policies are of the utmost urgency. The purpose of this study is to review the EIA work that has been carried out on trade policy in China through four case studies, and illustrate how trade policy EIAs can be helpful in achieving better environmental outcomes in the area of trade. Through the trade policy EIA case studies we try to argue for the feasibility of conducting EIAs on economic policies in China. We also discuss the implications of the case studies from the point of view of how to proceed with EIAs on economic policy and how to promote their practice. - Highlights: • SEA system is incomplete and stays limited to the plan EIA level in China. • EIA on economic policy is of utmost importance for all the developing countries. • Four case studies of trade policy EIA in China are reviewed for policy implications. • Departmental competition for political power impedes economic policy EIAs in China. • Legislative regulation on policy EIA is the first thing needed to overcome barrier.

    In a somewhat surprising move, the U.S. Department of Labor has decided not to appeal a court decision essentially dropping regulations established by the Occupational Safety and Health Administration (OSHA) for about 400 hazardous substances. The decision leaves unregulated or subject to reduced standards substances that range from carbon monoxide to perchloroethylene. The Labor Department had until March 22, 1993, to appeal the court decision. On July 8, 1992, the U.S. Court of Appeals for the 11th Circuit overturned OSHA's final Air Contaminants Standard, which was promulgated in 1989. The standard established permissible exposure limits (PELs) for 428 toxic substances. In AFL-CIO vs. OSHA, the Court ruled that OSHA failed to make a separate scientific case for evaluating health risks of each chemical. Because of the decision not to appeal, PELs for more than half of the substances regulated by OSHA now are removed from the books or revert to the voluntary industry standards adopted by OSHA in 1970 and in force prior to the 1989 final rule.

    The ills of utility regulation have been overstated by interested players and at least some academics. One can have the best features of both competition and regulation by a paradigm that combines some regulation with stronger antitrust enforcement. It is now obvious that the success of deregulation actually depends crucially on whether antitrust policy is effective in preventing monopoly. In fact, antitrust policies have been extremely weak since 1980, under a deliberate Reagan administration withdrawal of enforcement. Where deregulation has led to market dominance, which antitrust cannot well cure, the policy changes of the 1980`s may have created costly and irreversible mistakes in a number of major sectors. Yet fast-paced events are currently creating a frenzy of even more deregulation, supposedly to fit new {open_quotes}revolutions{close_quotes} in technology and the impacts of large mergers. Instead it is time for particular caution in electricity.

    Studies of the costs of climate change policies have utilized a variety of measures or metrics for summarizing costs. The leading economic models have utilized GNP, GDP, the ''area under a marginal cost curve,'' the discounted present value of consumption, and a welfare measure taken directly from the utility function of the model's representative agent (the ''Equivalent Variation''). Even when calculated using a single model, these metrics do not necessarily give similar magnitudes of costs or even rank policies consistently. This paper discusses in non-technical terms the economic concepts lying behind each concept, the theoretical basis for expecting each measure to provide a consistent ranking of policies, and the reasons why different measures provide different rankings. It identifies a method of calculating the ''Equivalent Variation'' as theoretically superior to the other cost metrics in ranking policies. When regulators put forward new economic or regulatory policies, there is a need to compare the costs and benefits of these new policies to existing policies and other alternatives to determine which policy is most cost-effective. For command and control policies, it is quite difficult to compute costs, but for more market-based policies, economists have had a great deal of success employing general equilibrium models to assess a policy's costs. Not all cost measures, however, arrive at the same ranking. Furthermore, cost measures can produce contradictory results for a specific policy. These problems make it difficult for a policy-maker to determine the best policy. For a cost measures to be of value, one would like to be confident of two things. First one wants to be sure whether the policy is a winner or loser. Second, one wants to be confident that a measure produces the correct policy ranking. That is, one wants to have confidence in a policy measure's ability to correctly rank policies from most beneficial to most harmful. This paper analyzes

    Many computational intelligence techniques for anomaly based network intrusion detection can be found in literature. Translating a newly discovered intrusion recognition criteria into a distributable rule can be a human intensive effort. This paper explores a multi-modal genetic algorithm solution for autonomous rule creation. This algorithm focuses on the process of creating rules once an intrusion has been identified, rather than the evolution of rules to provide a solution for intrusion detection. The algorithm was demonstrated on anomalous ICMP network packets (input) and Snort rules (output of the algorithm). Output rules were sorted according to a fitness value and any duplicates were removed. The experimental results on ten test cases demonstrated a 100 percent rule alert rate. Out of 33,804 test packets 3 produced false positives. Each test case produced a minimum of three rule variations that could be used as candidates for a production system.

  1. Confusion reigns over industrial stormwater regulations

    More than five years after Congress mandated controls for industrial and municipal stormwater discharges, many in the regulated community remain unclear about how the rules apply to them. The regulations' progress since the 1987 CWA amendments opened the door for their development often has been shaky and marked by setbacks. According to a federal appeals court decision issued last summer, that struggle is likely to continue. Although the original stormwater rules issued by EPA in November 1990 appeared to focus on heavy manufacturing facilities, as well as municipalities, the appellate court cleared a path that could draw light industrial plants and small construction sites within the regulations' domain. The rules in dispute bring under their umbrella any stormwater discharges associated with industrial activity to surface waters or municipal storm sewer systems. However, the regulations distinguish between facilities engaged in heavy industry and light, or enclosed industrial facilities, based on the probability that stormwater discharges will be contaminated and require regulation.

    The new Norwegian semisubmersible regulations are discussed. The Norwegian Maritime Directorate (NMD) requires that existing accommodation rigs have stability, mooring, emergency power generation, and lifesaving appliances upgraded by 1985. Drilling rigs in service must also be upgraded, but as yet, the NMD has not made up its mind what damage stability criteria to apply. Rigs that meet the NMD are discussed, as well as the projected costs of the implementation of the regulation. (JMT)

    The chance to add up to 900 new jobs and $54 million in tax revenues led Oklahoma regulators to agree to a one-time waiver of a controversial state ruling that discourages long-term buyback rates for cogenerators. The ruling will allow a 100 MW cogeneration project to proceed with its plan to sell steam to the Firestone tire plant and electricity to the local utility. Economic forecasts show that the deal will give the Oklahoma facility the lowest operating cost for any Firestone plant in the country. It will also make Oklahoma more attractive to new businesses and industry. Regulators emphasize that the waiver of rule 58-H applies only to this project, with future proposals to be judged on their own merits. Despite its large gas surplus, the state has virtually no cogeneration, which requires a steady, low-cost fuel supply, an expanding requirement for electricity, and the presence of large industrial steam users. Other issues the commission considered were the capacity and energy buyback rates.

    In his analysis of the oil industry-government relationship, the author examines the question of whether Big Oil is really bad and, if so, whether the government should leave it alone because it is unmanageable or regulate it for that reason. Responding to Robert Sherrill's The Oil Follies of 1970-1980 and its emphasis on conspiracy and betrayal, he focuses on the replacement of the Rule of Capture, which promoted the production of natural resources, with regulations restricting oil and gas production. He concludes that Big Government has not managed Big Oil well, but proposes an approach based on a series of workable projects instead of antitrust review. These initiatives could include efforts for horizontal and vertical divestiture, restrictions on tax divestiture, regulating cross-ownership, and a reworking of banking and tax laws.

    On February 16, 1992, the Government of the Czech Republic sanctioned, by its Decree No. 112/82, its first Energy Policy. Since that time, a number of conditions have changed: first of all, there was the partition of the former Federal Czechoslovak Republic, then the privatization of most of energy producing corporations, the deregulation of a significant proportion of power and energy commodities, the decision to bring to an end the construction of the Temelin nuclear power station, the creation of conditions for the construction of the Ingoldstadt oil pipeline, etc. These steps, on which the final decisions have been made, have brought about the necessity of updating the existing general Energy Policy. The updated Energy Policy is based on the Programme Statement by the Government of the Czech Republic of July 1992, as well as on other materials associated with energy and power generation, either approved or negotiated by the Government, in particular the State Environmental Policy the Rules of the State Raw Materials Policy, the European Association Agreement, the European Energy Charter, the results of the Uruguayan Round of GATT, the Convention on Climate Changes, the Ecological Action Programme for central and East-European countries, and other international documents that have either been, or are likely to be sanctioned by the Czech Government (especially the European Energy Charter Treaty, and the protocol on Trans-boundary Air Pollution and on Further Reduction of Sulphur Oxide Emissions).

    On October 20, 1993, the US Environmental Protection Agency (EPA) published in the Federal Register the proposed rule entitled Risk Management Programs for Chemical Accidental Release Prevention (40 CFR 68). Subsequently, on January 31, 1994, EPA published in the Federal Register the finalized list of 77 regulated toxic substances and 63 regulated flammable substances that are to be covered under the rule along with the associated threshold quantities for each substance. This list of substances will dictate which stationary sources will have to comply with the requirements of the proposed risk management program rule. The risk management program rule will most likely be finalized sometime after mid-1995. Covered facilities will then have a total of three years to achieve complete compliance with the requirements of the rule. This paper presents an approach for corporations with multiple sites to develop action plans for implementation of the risk management program rule. The process starts with a determination of which facilities are potentially covered, development of a matrix of requirements that each facility must comply with, and finally, common strategies that may be used in achieving compliance. Thus, a multi-facility corporation can develop a baseline compliance guideline document that individual plants can use in developing and implementing their risk management programs.

An amplifier is coupled to the positive line through a resistor and is connected between a difference circuit and the regulating transistor base which is negative due to the difference in voltage drop across thc diode and the resistor so that a change in the regulator output causes the amplifier to increase or decrease the base voltage and current and incrcase or decrease the transistor impedance to return the regulator output to normal.     For the last several years, the NRC, with encouragement from the industry, has been moving in the direction of risk informed regulation. This is consistent with the regulatory principle of efficiency, formally adopted by the Nuclear Regulatory Commission in 1991, which requires that regulatory activities be consistent with the degree of risk reduction they achieve. Probabilistic risk analysis has become the tool of choice for selecting the best of several alternatives. Closely related to risk informed regulation is the development of performance based rules. Such rules focus on the end result to be achieved. They do not specify the process, but instead establish the goals to be reached and how the achievement of those goals is to be judged. The inspection and enforcement activity is based on whether or not the goals have been met. The author goes on to offer comments on the history of the development of this process and its probable development in the future. He also addresses some issues which must be resolved or at least acknowledged. The success of risk informed regulation ultimately depends on having sufficiently reliable data to allow quantification of regulatory alternatives in terms of relative risk. Perhaps the area of human reliability and organizational performance has the greatest potential for improvement in reactor safety. The ability to model human performance is significantly less developed that the ability to model mechanical or electrical systems. The move toward risk informed, performance based regulation provides an unusual, perhaps unique, opportunity to establish a more rational, more effective basis for regulation.

    Local climate regulation by urban green areas is an important urban ecosystem service, as it reduces the extent of the urban heat island and therefore enhances quality of life. Local and regional planning policies can control land use changes in an urban region, which in turn alter local climate regulation. Thus, this paper describes a method for estimating the impacts of current land uses as well as local and regional planning policies on local climate regulation, using evapotranspiration and land surface emissivity as indicators. This method can be used by practitioners to evaluate their policies. An application of this method is demonstrated for the case study Leipzig (Germany). Results for six selected planning policies in Leipzig indicate their distinct impacts on climate regulation and especially the role of their spatial extent. The proposed method was found to easily produce a qualitative assessment of impacts of planning policies on climate regulation.

    Sum rules provide useful insights into transition strength functions and are often expressed as expectation values of an operator. In this letter I demonstrate that non-energy-weighted transition sum rules have strong secular dependences on the energy of the initial state. Such non-trivial systematics have consequences: the simplification suggested by the generalized Brink–Axel hypothesis, for example, does not hold for most cases, though it weakly holds in at least some cases for electric dipole transitions. Furthermore, I show the systematics can be understood through spectral distribution theory, calculated via traces of operators and of products of operators. Seen through this lens,more » violation of the generalized Brink–Axel hypothesis is unsurprising: one expectssum rules to evolve with excitation energy.     Recently, Italian urban planning research in the field of seismic risk mitigation are renewing. In particular, it promotes strategies that integrate urban rehabilitation and aseismic objectives, and also politicizes that are directed to revitalizes urban systems, coupling physical renewal and socio-economic development.In Italy the first law concerning planning for seismic mitigation dates back 1974, the law n. 64 'Regulation for buildings with particular rules for the seismic areas' where the rules for buildings in seismic areas concerning also the local hazard. This law, in fact, forced the municipalities to acquire, during the formation of the plans, a preventive opinion of compatibility between planning conditions and geomorphology conditions of the territory. From this date the conviction that the seismic risk must be considered inside the territorial planning especially in terms of strategies of mitigation has been strengthened.The town planners have started to take an interest in seismic risk in the [80]s when the Irpinia's earthquake took place. The researches developed after this earthquake have established that the principal cause of the collapse of buildings are due to from the wrong location of urban settlements (on slopes or crowns) After Irpinia's earthquake the first researches on seismic risk mitigation, in particular on the aspects related to the hazards and to the urban vulnerability were made.

    Feed-in tariffs (FITs) are the most prevalent renewable energy policy used globally to date, and there are many benefits to the certainty offered in the marketplace to reduce development risks and associated financing costs and to grow the renewable energy industry. However, concerns over escalating costs in jurisdictions with FIT policies have led to increased attention on cost control in renewable energy policy design. In recent years, policy mechanisms for containing FIT costs have become more refined, allowing policymakers to exert greater control on policy outcomes and on the resulting costs to ratepayers. As policymakers and regulators in the United States begin to explore the use of FITs, careful consideration must be given to the ways in which policy design can be used to balance the policies' advantages while bounding its costs. This report explores mechanisms that policymakers have implemented to limit FIT policy costs. If designed clearly and transparently, such mechanisms can align policymaker and market expectations for project deployment. Three different policy tools are evaluated: (1) caps, (2) payment level adjustment mechanisms, and (3) auction-based designs. The report employs case studies to explore the strengths and weaknesses of these three cost containment tools. These tools are then evaluated with a set of criteria including predictability for policymakers and the marketplace and the potential for unintended consequences.

    The US Acid Rain Program is one of the first, and by far the most extensive, applications of a market based approach to pollution control. From the beginning, there has been concern whether utilities would participate in allowance trading, and whether regulatory activity at the state level would further complicate utilities` decision to trade allowances. This paper finds that public utility commission regulation has encouraged allowance trading activity in states with regulatory rulings, but that allowance trading activity has not been limited to states issuing regulations. Until there is evidence suggesting that significant additional cost savings could have been obtained if additional allowance trading activity had occurred in states without regulations or that utilities in states with regulations are still not taking advantage of all cost saving trading opportunities, this analysis suggests that there is little reason to believe that allowance trading activity is impeded by public utility commission regulations.

    legislative or regulatory authorities. Some renewable energy contracts pre-date the existence of RECs, however, and in these cases the disposition of RECs is often unclear. Similarly, because of the recent appearance of RECs, legislation and regulation mandating the purchase of renewable energy has sometimes been silent on the disposition of the RECs associated with that generation. The resulting uncertainty in REC ownership has hindered the development of robust REC markets and has, in some cases, led to contention between buyers and sellers of renewable generation. The purpose of this report is to provide information and insight to state policy-makers, utility regulators, and others about different approaches to clarifying the ownership of RECs. We focus exclusively on three distinct areas in which REC ownership issues have arisen: (1) Qualifying Facilities (QFs) that sell their generation under the Public Utility Regulatory Policies Act (PURPA) of 1978; (2) Customer-owned generation that benefits from state net metering rules; and (3) Generation facilities that receive financial incentives from state or utility funds. This is a survey report. It reviews how both the federal government and states have addressed these issues to date, and highlights the arguments that have been raised for different REC ownership dispositions. Our aim is to describe the arguments on each side, and the context for the debates that are occurring. We do not, in this report, provide a list of policy recommendations for how policymakers should be addressing these issues.

    The authors discuss how nuclear plants in the United States have taken actions to respond to the NRC Station Blackout Rule, 10CFR50.63. The rule requires that each light water cooled nuclear power plant licensed to operate must be able to withstand for a specified duration and recover from a station blackout. Station blackout is defined as the complete loss of a-c power to the essential and non-essential switch-gear buses in a nuclear power plant. A station blackout results from the loss of all off-site power as well as the on-site emergency a-c power system. There are two basic approaches to meeting the station blackout rule. One is to cope with a station blackout independent of a-c power. Coping, as it is called, means the ability of a plant to achieve and maintain a safe shutdown condition. The second approach is to provide an alternate a-c power source (AAC).

  18. A Framework for Comparative Assessments of Energy Efficiency Policy Measures

    When policy makers propose new policies, there is a need to assess the costs and benefits of the proposed policy measures, to compare them to existing and alternative policies, and to rank them according to their effectiveness. In the case of equipment energy efficiency regulations, comparing the effects of a range of alternative policy measures requires evaluating their effects on consumers budgets, on national energy consumption and economics, and on the environment. Such an approach should be able to represent in a single framework the particularities of each policy measure and provide comparable results. This report presents an integrated methodological framework to assess prospectively the energy, economic, and environmental impacts of energy efficiency policy measures. The framework builds on the premise that the comparative assessment of energy efficiency policy measures should (a) rely on a common set of primary data and parameters, (b) follow a single functional approach to estimate the energy, economic, and emissions savings resulting from each assessed measure, and (c) present results through a set of comparable indicators. This framework elaborates on models that the U.S. Department of Energy (DOE) has used in support of its rulemakings on mandatory energy efficiency standards. In addition to a rigorous analysis of the impacts of mandatory standards, DOE compares the projected results of alternative policy measures to those projected to be achieved by the standards. The framework extends such an approach to provide a broad, generic methodology, with no geographic or sectoral limitations, that is useful for evaluating any type of equipment energy efficiency market intervention. The report concludes with a demonstration of how to use the framework to compare the impacts estimated for twelve policy measures focusing on increasing the energy efficiency of gas furnaces in the United States.

    The Justice Department`s Guidelines don`t tell us very much about today`s (or tomorrow`s) electric market. However many electric utilities remain after this merger wave, competition will be forever changed. Earlier this year, the Federal Energy Regulatory Commission (FERC) issued a Notice of Inquiry (NOI) on merger policy, seeking advice on how to adapt old practices to a changing industry. Then, in July, it voted 3-2 to require a hearing on the proposed merger of Baltimore Gas & Electric and Potomac Electric Power. The majority expressed concern that applicants had defined relevant markets too broadly and inferred competition where market power might exist. The dissenting commissioners favored approval without hearing, noting that no intervenors had presented substantive claims that the merger would increase market power. Whether or not the FERC proceeds to a more activist policy on mergers, it must reevaluate the methods it uses to determine their effects on competition.

    This report summarizes the results of a joint project on renewable energy of the National Association of Regulatory Utility Commissioners (NARUC) and the US DOE. NARUC'S Task Force on Renewable Energy conducted a review of the current state of renewable energy technologies to evaluate their potential and extract key policy lessons from experience already gained in deployment of these technologies in numerous states. The main focus of this effort has been to clarify how utility regulators affect the development of renewable energy resources.     This report summarizes the results of a joint project on renewable energy of the National Association of Regulatory Utility Commissioners (NARUC) and the US DOE. NARUC`S Task Force on Renewable Energy conducted a review of the current state of renewable energy technologies to evaluate their potential and extract key policy lessons from experience already gained in deployment of these technologies in numerous states. The main focus of this effort has been to clarify how utility regulators affect the development of renewable energy resources.     We consider the modifications of monomial chaotic inflation models due to radiative corrections induced by inflaton couplings to bosons and/or fermions necessary for reheating. To the lowest order, ignoring gravitational corrections and treating the inflaton as a classical background field, they are of the Coleman-Weinberg type and parametrized by the renormalization scale ?. In cosmology, there are not enough measurements to fix ? so that we end up with a family of models, each having a slightly different slope of the potential. We demonstrate by explicit calculation that within the family of chaotic ?{sup 2} models, some may be ruled out by Planck whereas some remain perfectly viable. In contrast, radiative corrections do not seem to help chaotic ?{sup 4} models to meet the Planck constraints.
