    The courts ruled in the 1979 Plateau decision that the Secretary of the Interior is obligated to allocate federal royalty oil among all refineries not having their own crude oil source of supply, and can not impose Small Business Administration (SBA) eligibility requirements on potential purchasers of federal royalty oil. The effects of this decision was to derail the government's attempt to make royalty oil produced from Outer Continental Shelf leases and onshore sites available to the same refiners. The Minerals Management Service has yet to adopt final regulations harmonizing the court's ruling with applicable statutory requirements, resulting in actions of dubious legality. 75 references.

    This paper reports that Canadian petroleum companies have welcomed a revamp of Alberta's royalty structure but say it falls short of what is needed to revitalize activity in the province. The changes will give producers a cut in royalties of at least $170 million (Canadian)/year, offer incentives for new drilling, and index royalty levels to prices. The new royalty plan also will reward companies that funnel more capital into increased exploration programs. The industry association the new royalty rates tied to prices could increase royalties if prices rise above $26 (Canadian)/bbl for oil and $1.70 (Canadian)/Mcf for natural gas. Royalty take would decline below these prices. Oil prices currently are near the $26/bbl level.     The Secretary of the Interior has used his authority to reduce royalty rates on eight Federal coal leases - amounting to $12 million in reduced Federal revenues. Requests for royalty rate reductions were precipitated by recent legislative enactments and a 2-year departmental experiment that raised royalty rates on coal leases to significantly higher levels. Because the Secretary is authorized to readjust the royalty rates on 438 leases by 1990 more requests for royalty reductions are likely in the future. The Interior Department has not clearly defined its policy and procedures on royalty rate reductions. The approval process is inconsistent, and accounting and auditing expertise needed to evaluate reduction requests have not been used adequately. GAO recommends that Interior develop a more clearly defined policy and accompanying regulations on royalty rate reductions, determine when audits of applicants' financial statements are needed, and better use existing financial expertise in its evaluations of reduction requests.

    In the natural gas business, the word ``royalty`` usually brings to mind the fee producers pay on each unit of gas they produce from wells drilled on acreage leased from the government. This production-oriented word now is taking on added meaning and quickly becoming part of the gas utility lexicon. If organizations representing appliance-sales and service companies have their way, the local gas company will soon be paying an annual royalty to its customers as compensation for what these groups allege is the ``free`` use of the utility name and reputation -- also known as its ``good will`` -- by its unregulated business units that sell, install and repair appliances. This royalty would be returned to gas customers through an equivalent reduction in a utility`s base rate -- the revenue it requires each year to cover expenses and provide a return on its investment. Resolution of the issue is pending in three state: State courts in New York and Minnesota are reviewing regulatory orders instituting the royalty, and regulators in Maryland are debating the question. Legal aspects of these pending regulations are discussed.

    The Department of Interior receives a royalty from oil production on federal lands. Interior can take the royalty as a cash payment or a portion of the oil itself, which it can then sell to small and independent refiners who are determined to be in need of crude oil supplies. Sales of this so-called royalty oil have been held about every 3 years since 1970. In early 1985, Interior announced its intention to terminate the program because of its declining importance and proposed legislation to that effect. While GAO sees no compelling need to legislatively restrict Interior's ability to hold future royalty oil sales now or in the future, it has identified several ways to improve the program's effectiveness. This report examines Interior's basis for the most recent sales and the current status and need for the royalty oil program and discusses ways in which its administration might be improved if future sales are held.

The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

In the likely event that the West Virginia courts are faced with this issue, they would be wise to adopt the implied duty to market theory, thereby, putting the onus on the lessee to either provide up front in the lease for the apportionment of costs after the discovery of the gas, or in those instances where the lease is silent as to who will incur the cost, to place the burden on the lessee to cover those costs. Regarding transportation costs, even in jurisdictions such as Oklahoma, where the lessee is obligated to develop the gas he has found so that it will bring the highest possible market value, the lessee is not required to provide for pipeline facilities beyond the lease premises. Kansas courts have also held that the lessee has a general duty to see that the gas is marketed, but that it is not required to pay the lessor`s share of transportation charges form the well to some distant place. Thus, in West Virginia when a gas lease is silent as what costs a lessee may properly deduct from a lessor`s royalty payment, the lessee should bear the costs under the implied duty to market theory if those costs do not involve enhancing the product or transporting it to some place of sale off the leased premises.

    Against the backdrop of more than 20 years of increasingly stringent environmental regulation, ever-expanding exploration and development moratoria on the Outer Continental Shelf (OCS), and reductions in producer tax incentives, oil and natural gas exploration companies active in deep waters of the Gulf of Mexico recently won a significant legislative victory. On Nov. 28, 1995, President Clinton signed into law S.395, the Alaska Power Administration Sale Act. Title 3 of S.395 embodies the Outer Continental Shelf Deep Water Royalty Relief Act. This landmark legislation provides substantial incentives for oil and natural gas production in the gulf of Mexico by temporarily eliminating royalties on certain deepwater leases. It is the first direct incentive for oil and gas production enacted at the federal level in many years. This paper reviews the elements used to arrive at this successful legislation including the congressional leadership. It describes debates, cabinet level discussions, and use of parlimentary procedures.

    Project Description: Propane Vehicle Demonstration Grants The Propane Vehicle Demonstration Grants was established to demonstrate the benefits of new propane equipment. The US Department of Energy, the Propane Education & Research Council (PERC) and the Propane Vehicle Council (PVC) partnered in this program. The project impacted ten different states, 179 vehicles, and 15 new propane fueling facilities. Based on estimates provided, this project generated a minimum of 1,441,000 new gallons of propane sold for the vehicle market annually. Additionally, two new off-road engines were brought to the market. Projects originally funded under this project were the City of Portland, Colorado, Kansas City, Impco Technologies, Jasper Engines, Maricopa County, New Jersey State, Port of Houston, Salt Lake City Newspaper, Suburban Propane, Mutual Liquid Propane and Ted Johnson.

    This Final Technical Report provides a concise retrospective and summary of all facets of the Sheldon Jackson College electrical Infrastructure Renovation portion of the Indian River Hydroelectric Project Grant of the City and Borough of Sitka, Alaska. The Project Overview describes the origins of the project, the original conditions that provided the impetus for the grant funding, how the grant amendment was developed, the conceptual design development, and the actual parameters of the final project as it went out to bid. The Project Overview also describes the ''before and after'' conditions of the project. The Objectives division of this Final Technical Report describes the amendment-funded goals of the project. It also describes the milestones of project development and implementation, as well as, the rationale behind the milestone array. The Description of Activities Performed division of this report provides an in-depth chronological analysis of progressive project implementation. Photographs will provide further illustration of particular functional aspects of the renovation project within project parameters. The Conclusions and Recommendations division of this report provides a comprehensive retrospective analysis of the project.

    During the 2002 Fiscal year, funds from the DOE matching grant program, along with matching funds from the industrial sponsors, have been used to support research in the area of thermal-hydraulics. Both experimental and numerical research projects have been performed. Experimental research focused on two areas: (1) Identification of the root cause mechanism for axial offset anomaly in pressurized water reactors under prototypical reactor conditions, and (2) Fluid dynamic aspects of thin liquid film protection schemes for inertial fusion reactor chambers. Numerical research focused on two areas: (1) Multi-fluid modeling of both two-phase and two-component flows for steam conditioning and mist cooling applications, and (2) Modeling of bounded Rayleigh-Taylor instability with interfacial mass transfer and fluid injection through a porous wall simulating the ''wetted wall'' protection scheme in inertial fusion reactor chambers. Details of activities in these areas are given.

    The House report on H.R. 3479 adjusting royalty payments on oil and gas leases recommends passage with certain amendments. The recommended title for the Act is The Notice to Lessees No. 5 (NTL-5) Gas Royalty Act of 1987. The Act addresses problems involving some onshore and Indian leases, and redefines the procedures for determining the value of the lease. The report summarizes the purpose and need for the legislation, analyzes it by section, and concludes with communications between the committee and the Interior Department. A minority view argues in favor of placing the highest possible value on leases in order to be fair to taxpayers.

    A parallel processing system for production rule programs utilizes a host processor for storing production rule right hand sides (RHS) and a plurality of rule processors for storing left hand sides (LHS). The rule processors operate in parallel in the recognize phase of the system recognize -Act Cycle to match their respective LHS's against a stored list of working memory elements (WME) in order to find a self consistent set of WME's. The list of WME is dynamically varied during the Act phase of the system in which the host executes or fires rule RHS's for those rules for which a self-consistent set has been found by the rule processors. The host transmits instructions for creating or deleting working memory elements as dictated by the rule firings until the rule processors are unable to find any further self-consistent working memory element sets at which time the production rule system is halted.

    To help meet legislatively mandated and programmatic mission requirements, the Department of Energy (DOE) awards grants to colleges and universities, state and local governments, individuals, small businesses, and non-profit corporations. As of July 15, 1996, the DOE was responsible for administering over 7,400 grants with purposes ranging from basic research to weatherizing homes. The Government`s share of these grants was about $8 billion. The objective of this audit was to determine whether the DOE received final deliverables, detailing grantee accomplishments and expenditure of funds, in accordance with Federal and Departmental policies and procedures. The Code of Federal Regulations requires that grants benefit the general public. This is demonstrated through technical and/or financial reports that each grantee is usually required to deliver. These reports describe the final results of the grant effort. In spite of this requirement, many grantees did not provide final technical and/or financial reports. For example, at the five procurement offices audited, it is projected that the Department had not received final deliverables on 718 inactive grants valued at about $232 million. In other cases, officials inappropriately extended performance periods so that the grant instrument would continue to be classified as active. This non-reporting occurred because the Department did not effectively implement existing procedures or establish other monitoring procedures that ensured grantees fulfilled their grant obligations. Specifically, the Department did not establish procedures to withhold payment if a grantee failed to comply with grant terms and conditions. In addition, the Department did not defer additional awards to grantees that had not met the tenons and conditions of prior grants and inappropriately extended grant performance periods for excessive periods of time. Further, Departmental personnel waived reporting requirements in order to close out grant awards.

    Many computational intelligence techniques for anomaly based network intrusion detection can be found in literature. Translating a newly discovered intrusion recognition criteria into a distributable rule can be a human intensive effort. This paper explores a multi-modal genetic algorithm solution for autonomous rule creation. This algorithm focuses on the process of creating rules once an intrusion has been identified, rather than the evolution of rules to provide a solution for intrusion detection. The algorithm was demonstrated on anomalous ICMP network packets (input) and Snort rules (output of the algorithm). Output rules were sorted according to a fitness value and any duplicates were removed. The experimental results on ten test cases demonstrated a 100 percent rule alert rate. Out of 33,804 test packets 3 produced false positives. Each test case produced a minimum of three rule variations that could be used as candidates for a production system.

    The initial classification of fusion rules have shown that rational conformal field theory is very limited. In this paper we study the fusion rules of extend ed current algebras. Explicit formulas are given for the S matrix and the fusion rules, based on the full splitting of the fixed point fields. We find that in s ome cases sensible fusion rules are obtained, while in others this procedure lea ds to fractional fusion constants.

Decay rate sum rules are also computed to this order. Particular attention is given to sum rules arising from the isospin and U-spin subgroups, the former providing sensitive tests for alternative sources of SU(3) breaking.     Recently (hep-th/9307183) we showed that for the case of the WZW- and the minimal models fusion can be understood as a certain ring-like tensor product of the symmetry algebra. In this paper we generalize this analysis to arbitrary chiral algebras. We define the tensor product of conformal field theory in the general case and prove that it is associative and symmetric up to equivalence. We also determine explicitly the action of the chiral algebra on this tensor product. In the second part of the paper we demonstrate that this framework provides a powerful tool for calculating restrictions for the fusion rules of chiral algebras. We exhibit this for the case of the $W_{3}$-algebra and the $N=1$ and $N=2$ NS superconformal algebras.

    We derive explicit expressions for the sum rules of the eigenvalues of inhomogeneous strings with arbitrary density and with different boundary conditions. We show that the sum rule of order N may be obtained in terms of a diagrammatic expansion, with (N?1)!/2 independent diagrams. These sum rules are used to derive upper and lower bounds to the energy of the fundamental mode of an inhomogeneous string; we also show that it is possible to improve these approximations taking into account the asymptotic behavior of the spectrum and applying the Shanks transformation to the sequence of approximations obtained to the different orders. We discuss three applications of these results. -- Highlights: •We derive an explicit expression for the sum rules of an inhomogeneous string. •We obtain a diagrammatic representation for the sum rules of a given order. •We obtain precise bounds on the lowest eigenvalue of the string.

    A current trend in spectrum regulation is to incorporate spectrum sharing through the design of spectrum access rules that support Dynamic Spectrum Access (DSA). This paper develops a decision-theoretic framework for regulators to assess the impacts of different decision rules on both primary and secondary operators. We analyze access rules based on sensing and exclusion areas, which in practice can be enforced through geolocation databases. Our results show that receiver-only sensing provides insufficient protection for primary and co-existing secondary users and overall low social welfare. On the other hand, using sensing information between the transmitter and receiver of a communication link, provides dramatic increases in system performance. The performance of using these link end points is relatively close to that of using many cooperative sensing nodes associated to the same access point and large link exclusion areas. These results are useful to regulators and network developers in understanding in developing rules for future DSA regulation.

    A new technique has recently been developed, in which the Maximum Entropy Method is used to analyze QCD sum rules. This approach has the virtue of being able to directly generate the spectral function of a given operator, without the need of making an assumption about its specific functional form. To investigate whether useful results can be extracted within this method, we have first studied the vector meson channel, where QCD sum rules are traditionally known to provide a valid description of the spectral function. Our results show a significant peak in the region of the experimentally observed {rho}-meson mass, which is in agreement with earlier QCD sum rules studies and suggests that the Maximum Entropy Method is a strong tool for analyzing QCD sum rules.

    We argue that the geodesic rule, for global defects, is a consequence of the randomness of the values of the Goldstone field $\\phi$ in each causally connected volume. As these volumes collide and coalescence, $\\phi$ evolves by performing a random walk on the vacuum manifold $\\mathcal{M}$. We derive a Fokker-Planck equation that describes the continuum limit of this process. Its fundamental solution is the heat kernel on $\\mathcal{M}$, whose leading asymptotic behavior establishes the geodesic rule.

    Emission processes including {alpha} decay, heavy cluster decay, and proton and di-proton emission are analyzed in terms of the well-known factorization between the penetrability and the reduced width. By using a shifted harmonic oscillator plus Coulomb cluster-daughter interaction it is possible to derive a linear relation between the logarithm of the reduced width squared and the fragmentation potential, defined as the difference between the Coulomb barrier and the Q value. This relation is fulfilled with a good accuracy for transitions between ground states, as well as for most {alpha} decays to low-lying 2{sup +} excited states. The well-known Viola-Seaborg rule, connecting half-lives with the Coulomb parameter and the product between fragment charge numbers, as well as the Blendowske scaling rule, connecting the spectroscopic factor with the mass number of the emitted cluster, can be easily understood in terms of the fragmentation potential. It is shown that the recently evidenced two regions in the dependence of reduced proton half-lives versus the Coulomb parameter are directly connected with the corresponding regions of the fragmentation potential.

    Fusion rules in turbulence specify the analytic structure of many-point correlation functions of the turbulent field when a group of coordinates coalesce. We show that the existence of flux equilibrium in fully developed turbulent systems combined with a direct cascade induces universal fusion rules. In certain examples these fusion rules suffice to compute the multiscaling exponents exactly, and in other examples they give rise to an infinite number of scaling relations that constrain enormously the structure of the allowed theory.

Here we study these potentials in the frame work of supersymmetric WKB (SWKB) quantization approximation and find that SWKB quantization rule is superior to the modified Bohr-Sommerfield or WKB rules as it exactly reproduces the eigenenergies.

    The Mississippi DOE EPSCoR planning grant committee identified three focus areas for a proposal submitted on January 25, 1995, to the US DOE: Human Resource Development, Environmental Synergisms from Fuel Mixtures of Tire Particles and Low Rank Coals, and Energy Efficient Heat Transfer Equipment and Materials. In the human resources are, efforts were undertaken to identify and develop linkages with educational institutions, national laboratories, and industries and to identify strategies for attracting and involving students in areas leading to technical careers. The fuel mixtures project was directed toward developing ways to combine scrap tire particles and lignite coal into a blended fuel that could be used in electric power generation. In the energy efficient heat transfer area, analytical and experimental investigations were planned to increase the efficiency of heat exchangers and insulating materials.

    Hazardous debris includes objects contaminated with hazardous waste. Examples of debris include tree stumps, timbers, boulders, tanks, piping, crushed drums, personal protective clothing, etc. Most of the hazardous debris encountered comes from Superfund sites and other facility remediation, although generators and treaters of hazardous waste also generate hazardous debris. Major problems associated with disposal of debris includes: Inappropriateness of many waste treatments to debris; Difficulties in obtaining representative samples; Costs associated with applying waste specific treatments to debris; Subtitle C landfill space was being used for many low hazard debris types. These factors brought about the need for debris treatment technologies and regulations that addressed these issues. The goal of such regulation was to provide treatment to destroy or remove the contamination if possible and, if this is achieved, to dispose of the cleaned debris as a nonhazardous waste. EPA has accomplished this goal through promulgation of the Hazardous Debris Rule, August 18, 1992.

    Borel transformed QCD sum rules conventionally use a real valued parameter (the Borel mass) for specifying the exponential weight over which hadronic spectral functions are averaged. In this paper, it is shown that the Borel mass can be generalized to have complex values and that new classes of sum rules can be derived from the resulting averages over the spectral functions. The real and imaginary parts of these novel sum rules turn out to have damped oscillating kernels and potentially contain a larger amount of information on the hadronic spectrum than the real valued QCD sum rules. As a first practical test, we have formulated the complex Borel sum rules for the phi meson channel and have analyzed them using the maximum entropy method, by which we can extract the most probable spectral function from the sum rules without strong assumptions on its functional form. As a result, it is demonstrated that, compared to earlier studies, the complex valued sum rules allow us to extract the spectral function with a significantly improved resolution and thus to study more detailed structures of the hadronic spectrum than previously possible.

    We present the first experimental tests of the recently derived fusion rules for Navier-Stokes (N-S) turbulence. The fusion rules address the asymptotic properties of many-point correlation functions as some of the coordinates coalesce, and form an important ingredient of the nonperturbative statistical theory of turbulence. Here we test the fusion rules when the spatial separations lie within the inertial range, and find good agreement between experiment and theory. An unexpected result is a simple linear law for the Laplacian of the velocity fluctuation conditioned on velocity increments across large separations.

    A sum rule which relates a stress-energy tensor correlator to thermodynamic functions is examined within the context of a simple nonconformal gravity dual. Such a sum rule was previously derived using AdS/CFT for conformal N=4 supersymmetric Yang-Mills theory, but we show that it does not generalize to the nonconformal theory under consideration. We provide a generalized sum rule and numerically verify its validity. A useful by-product of the calculation is the computation of the spectral density in a strongly coupled nonconformal theory. Qualitative features of the spectral densities and implications for lattice measurements of transport coefficients are discussed.

    In system development life cycle (SDLC), a system model can be developed using Data Flow Diagram (DFD). DFD is graphical diagrams for specifying, constructing and visualizing the model of a system. DFD is used in defining the requirements in a graphical view. In this paper, we focus on DFD and its rules for drawing and defining the diagrams. We then formalize these rules and develop the tool based on the formalized rules. The formalized rules for consistency check between the diagrams are used in developing the tool. This is to ensure the syntax for drawing the diagrams is correct and strictly followed. The tool automates the process of manual consistency check between data flow diagrams.

    Machine learning has emerged as a important tool for separating signal events from associated background in high energy particle physics experiments. This paper describes a new machine learning method based on ensembles of rules. Each rule consists of a conjuction of a small number of simple statements (''cuts'') concerning the values of individual input variables. These rule ensembles produce predictive accuracy comparable to the best methods. However their principal advantage lies in interpretation. Because of its simple form, each rule is easy to understand, as is its influence on the predictive model. Similarly, the degree of relevance of each of the respective input variables can be assessed. Graphical representations are presented that can be used to ascertain the dependence of the model jointly on the variables used for prediction.
