    Proposed actions tend to evolve over time. Once National Environmental Policy Act (NEPA) documentation is completed, agencies are at risk that subsequent changes may not be adequately covered or that existing NEPA documentation maybe completely invalidated. Neither NEPA nor its subsequent regulations provide sufficient direction for determining the degree to which a proposed action may change before preparation of new or supplemental documentation is necessary. Yet, decisionmakers are routinely involved in determining if a change to a proposed action departs, to such an extent, from the description presented in the NEPA document that additional documentation is necessary. Experience demonstrates that no two decisionmakers will completely agree, one decisionmaker might believe that a particular change would not require additional documentation, while the other concludes the exact opposite. Lacking definitive direction, decisionmakers and critics alike may point to a universe of potential considerations as the basis for defending their claim that a change in an action does or does not require new or additional NEPA documentation. Assertions are often based on equivocal opinions that can be neither proved nor disproved. Moreover, decisionmakers are frequently placed in an arduous dilemma of justifying a decision, for which there is no generally accepted methodology on which to base the decision. Lack of definitive direction can prolong the decisionmaking process, resulting in project delays. This can also lead to inappropriate levels of NEPA documentation, inconsistencies in decisionmaking, and increased risk of a legal challenge because of insufficient documentation. Clearly, a more systematic and less subjective approach is needed, A tool for streamlining the NEPA process, by reducing this degree of subjectivity, is presented in this paper.

  9. Consequences of proposed changes to Clean Water Act thermal discharge requirements

    This paper summarizes three studies that examined the economic and environmental impact on the power industry of (1) limiting thermal mixing zones to 1,000 feet, and (2) eliminating the Clean Water Act (CWA) {section}316(1) variance. Both of these proposed changes were included in S. 1081, a 1991 Senate bill to reauthorize the CWA. The bill would not have provided for grandfathering plants already using the variance or mixing zones larger than 1000 feet. Each of the two changes to the existing thermal discharge requirements were independently evaluated. Power companies were asked what they would do if these two changes were imposed. Most plants affected by the proposed changes would retrofit cooling towers and some would retrofit diffusers. Assuming that all affected plants would proportionally follow the same options as the surveyed plants, the estimated capital cost of retrofitting cooling towers or diffusers at all affected plants ranges from $21.4 to 24.4 billion. Both cooling towers and diffusers exert a 1%-5.8% energy penalty on a plant`s output. Consequently, the power companies must generate additional power if they install those technologies. The estimated cost of the additional power ranges from $10 to 18.4 billion over 20 years. Generation of the extra power would emit over 8 million tons per year of additional carbon dioxide. Operation of the new cooling towers would cause more than 1.5 million gallons per minute of additional evaporation. Neither the restricted mixing zone size nor the elimination of the {section}316(1) variance was adopted into law. More recent proposed changes to the Clean Water Act have not included either of these provisions, but in the future, other Congresses might attempt to reintroduce these types of changes.

    Here, we discuss that rice is one of the main crops grown in southern China. Global climate change has significantly altered the local water availability and temperature regime for rice production. In this study, we explored the influence of climate change on suitable rice cropping areas, rice cropping systems and crop water requirements (CWRs) during the growing season for historical (from 1951 to 2010) and future (from 2011 to 2100) time periods. The results indicated that the land areas suitable for rice cropping systems shifted northward and westward from 1951 to 2100 but with different amplitudes.

    An approach of short-notice random inspections (SNRIs) for inventory-change verification can enhance the effectiveness and efficiency of international safeguards at natural or low-enriched uranium (LEU) fuel fabrication plants. According to this approach, the plant operator declares the contents of nuclear material items before knowing if an inspection will occur to verify them. Additionally, items about which declarations are newly made should remain available for verification for an agreed time. This report details a six-month field test of the feasibility of such SNRIs which took place at the Westinghouse Electric Corporation Commercial Nuclear Fuel Division. Westinghouse personnel made daily declarations about both feed and product items, uranium hexafluoride cylinders and finished fuel assemblies, using a custom-designed computer ``mailbox``. Safeguards inspectors from the IAEA conducted eight SNRIs to verify these declarations. Items from both strata were verified during the SNRIs by means of nondestructive assay equipment. The field test demonstrated the feasibility and practicality of key elements of the SNRI approach for a large LEU fuel fabrication plant.

    Since the 1998 termination of LLW and ILW emplacement in the Morsleben repository (ERAM), Germany, the treatment, conditioning and documentation of radioactive waste products and packages have been continued on the basis of the waste acceptance requirements as of 1995, prepared for the Konrad repository near Salzgitter in Lower Saxony, Germany. The resulting waste products and packages are stored in interim storage facilities. Due to the Konrad license issued in 2002 the waste acceptance requirements have to be completed by additional requirements imposed by the licensing authority, e. g. for the declaration of chemical waste package constituents. Therefore, documentation of waste products and packages which are checked by independent experts and are in parts approved by the responsible authority (Office for Radiation Protection, BfS) up to now will have to be checked again for fulfilling the final waste acceptance requirements prior to disposal. In order to simplify these additional checks, databases are used to ensure an easy access to all known facts about the waste packages. A short balance of the existing waste products and packages which are already checked and partly approved by BfS as well as an overview on the established databases ensuring a fast access to the known facts about the conditioning processes is presented.     A major driving force for change in light-duty vehicle design and technology is the National Highway Traffic Safety Administration (NHTSA) and the U.S. Environmental Protection Agency (EPA) joint final rules concerning Corporate Average Fuel Economy (CAFE) and greenhouse gas (GHG) emissions for model years (MY) 2016 through 2025 passenger cars and light trucks. The chief goal of this current study is to compare the already rapid pace of fuel economy improvement and technological change over the previous decade to the needed rate of change to meet regulations over the next decade. EPA and NHTSA comparisons of the MY 2004 USmore » light-duty vehicle fleet to the MY 2014 fleet shows improved fuel economy (FE) of approximately 28% using the same FE estimating method mandated for CAFE regulations. Future predictions by EPA and NHTSA concerning ensemble fleet fuel economy are examined as an indicator of needed vehicle rate-of-change. A set of 40 same-model vehicle pairs for MY 2005 and MY 2015 is compared to examine changes in energy use and related technological change over the 10 year period. Powertrain improvements measured as increased vehicle efficiency, and vehicle mass-glider improvements measured as decreased tractive work requirements are quantified. The focus is first on conventional gasoline powertrain vehicles which currently dominate the market, with hybrids also examined due to their high potential importance for CAFE compliance. Most hybrid vehicles with significant sales in 2014 were represented in the study. Results show 10 years of progress for the studied vehicle set includes lowered tractive effort of about 5.6% and improved powertrain efficiency of about 16.5%. Further analysis shows that this high rate of past progress must increase by about 50% in order to meet the 2025 CAFE standards.     CH2M HILL Plateau Remediation Company (CH2M HILL) is the U.S. Department of Energy (DOE) prime contractor responsible for the environmental cleanup of the Hanford Site Central Plateau. As part of this responsibility, the CH2M HILL is faced with the task of complying with thousands of environmental requirements which originate from over 200 federal, state, and local laws and regulations, DOE Orders, waste management and effluent discharge permits, Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) response and Resource Conservation and Recovery Act (RCRA) corrective action documents, and official regulatory agency correspondence. The challenge is to manage this vast number of requirements to ensure they are appropriately and effectively integrated into CH2M HILL operations. Ensuring compliance with a large number of environmental requirements relies on an organization’s ability to identify, evaluate, communicate, and verify those requirements. To ensure that compliance is maintained, all changes need to be tracked. The CH2M HILL identified that the existing system used to manage environmental requirements was difficult to maintain and that improvements should be made to increase functionality. CH2M HILL established an environmental requirements management procedure and tools to assure that all environmental requirements are effectively and efficiently managed. Having a complete and accurate set of environmental requirements applicable to CH2M HILL operations will promote a more efficient approach to: • Communicating requirements • Planning work • Maintaining work controls • Maintaining compliance
