    Prior to 2008, transfers of radioactive material within the Savannah River Site (SRS) boundary, referred to as onsite transfers, were authorized by Transportation Safety Basis (TSB) documents that only required approval by the SRS contractor. This practice was in accordance with the existing SRS Transportation Safety Document (TSD). In 2008 the Department of Energy Savannah River Field Office (DOE-SR) requested that the SRS TSD be revised to require DOE-SR approval of all Transportation Safety Basis (TSB) documents. As a result, the primary SRS contractor embarked on a multi-year campaign to consolidate old or generate new TSB documents and obtain DOE-SR approval for each. This paper focuses on the challenges incurred during the rewriting or writing of and obtaining DOE-SR approval of all Savannah River Site Onsite Transportation Safety Basis documents.

    The majority of transports of radioactive materials are carried out in packages which don't need a package design approval by a competent authority. Low-active radioactive materials are transported in such packages e.g. in the medical and pharmaceutical industry and in the nuclear industry as well. Decommissioning of NPP's leads to a strong demand for packages to transport low and middle active radioactive waste. According to IAEA regulations the 'non-competent authority approved package types' are the Excepted Packages and the Industrial Packages of Type IP-1, IP-2 and IP-3 and packages of Type A. For these types of packages an assessment by the competent authority is required for the quality assurance measures for the design, manufacture, testing, documentation, use, maintenance and inspection (IAEA SSR 6, Chap. 306). In general a compliance audit of the manufacturer of the packaging is required during this assessment procedure. Their regulatory level in the IAEA regulations is not comparable with the 'regulatory density' for packages requiring competent authority package design approval. Practices in different countries lead to different approaches within the assessment of the quality assurance measures in the management system as well as in the quality assurance program of a special package design. To use the package or packaging in a safe manner and in compliance with the regulations a management system for each phase of the life of the package or packaging is necessary. The relevant IAEA-SSR6 chap. 801 requires documentary verification by the consignor concerning package compliance with the requirements. (authors)

    The U.S. Nuclear Regulatory Commission (NRC) was established in 1974 with the mission to license and regulate the civilian use of nuclear materials for commercial, industrial, academic, and medical uses in order to protect public health and safety, and the environment, and promote the common defense and security. Currently, approximately half (∼49%) of the workforce at the NRC has been with the Agency for less than six years. As part of the Agency's mission, the NRC has partial responsibility for the oversight of the transportation and storage of radioactive materials. The NRC has experienced a significant level of expertise leaving the Agency due to staff attrition. Factors that contribute to this attrition include retirement of the experienced nuclear workforce and mobility of staff within or outside the Agency. Several knowledge management (KM) initiatives have been implemented within the Agency, with one of them including the formation of a Division of Spent Fuel Storage and Transportation (SFST) KM team. The team, which was formed in the fall of 2008, facilitates capturing, transferring, and documenting regulatory knowledge for staff to effectively perform their safety oversight of transportation and storage of radioactive materials, regulated under Title 10 of the Code of Federal Regulations (10 CFR) Part 71 and Part 72. In terms of KM, the SFST goal is to share critical information among the staff to reduce the impact from staff's mobility and attrition. KM strategies in place to achieve this goal are: (1) development of communities of practice (CoP) (SFST Qualification Journal and the Packaging and Storing Radioactive Material) in the on-line NRC Knowledge Center (NKC); (2) implementation of a SFST seminar program where the seminars are recorded and placed in the Agency's repository, Agency-wide Documents Access and Management System (ADAMS); (3) meeting of technical discipline group programs to share knowledge within specialty areas; (4) development of

    Shipments of radioactive materials within the regulatory jurisdiction of the US Department of Energy (DOE) must meet the package design requirements contained in Title 10 of the Code of Federal Regulations, Part 71, and DOE Order 5480.3. These regulations do not provide design criteria requirements, but only detail the approval standards, structural performance criteria, and package integrity requirements that must be met during transport. The DOE recommended design criterion for high-level Category I radioactive packagings is Section III, Division 1, of the ASME Boiler and Pressure Vessel Code. However, alternative design criteria may be used if all the design requirements are satisfied. The purpose of this paper is to review alternatives to the Code criteria and discuss their applicability to the design of containment vessels in packages for high-level radioactive materials. Issues such as design qualification by physical testing, the use of scale models, and problems encountered using a non-ASME design approach are addressed.

    Radioactive materials transportation is stringently regulated by the Department of Transportation and the Nuclear Regulatory Commission to protect the public and the environment. As a Federal agency, however, the U.S. Department of Energy (DOE) must seek State, Tribal and local input on safety issues for certain transportation activities. This interaction has invariably resulted in the imposition of extra-regulatory requirements, greatly increasing transportation costs and delaying schedules while not significantly enhancing the level of safety. This paper discusses the results an analysis of the regulatory and negotiated requirements established for a July 1998 shipment of spent nuclear fuel from foreign countries through the west coast to the Idaho National Engineering and Environmental Laboratory (INEEL). Staff from the INEEL Nuclear Materials Engineering and Disposition Department undertook the analysis in partnership with HMTC, to discover if there were instances where requirements derived from stakeholder interactions duplicate, contradict, or otherwise overlap with regulatory requirements. The study exhaustively lists and classifies applicable Department of Transportation (DOT) and Nuclear Regulatory Commission (NRC) regulations. These are then compared with a similarly classified list of requirements from the Environmental Impact Statements (EIS) and those developed during stakeholder negotiations. Comparison and analysis reveals numerous attempts to reduce transportation risk by imposing more stringent safety measures than those required by DOT and NRC. These usually took the form of additional inspection, notification and planning requirements. There are also many instances of overlap with, and duplication of regulations. Participants will gain a greater appreciation for the need to understand the risk-oriented basis of the radioactive materials regulations and their effectiveness in ensuring safety when negotiating extra-regulatory requirements.

    This thesis discusses a recent United States Supreme Court case that will have a profound influence on the licensure of hydroelectric projects and the related ability of States to protect the quality of their waters. On October 4, 1993, the Supreme Court granted a Writ of Certiorari to resolve a conflict among the state courts of last resort. This case involves two fundamental and competing national interests: the nation's thirst for cheap, dependable power versus its equally strong desire to improve the quality of its water resources. It also involves two underlying regulatory regimes that overlap and conflict with each other in some ways. This case illustrates how those two national interests and their underlying regulatory regimes cannot always be reconciled. It also demonstrates how Congress, with its muddled ways of passing legislation, can create conflicts between federal and state regulatory agencies.

    For certification, packages used for the transportation of plutonium by air must survive the hypothetical thermal environment specified in 10CFR71.74(a)(5). This regulation specifies that 'the package must be exposed to luminous flames from a pool fire of JP-4 or JP-5 aviation fuel for a period of at least 60 minutes.' This regulation was developed when jet propellant (JP) 4 and 5 were the standard jet fuels. However, JP-4 and JP-5 currently are of limited availability in the United States of America. JP-4 is very hard to obtain as it is not used much anymore. JP-5 may be easier to get than JP-4, but only through a military supplier. The purpose of this paper is to illustrate that readily-available JP-8 fuel is a possible substitute for the aforementioned certification test. Comparisons between the properties of the three fuels are given. Results from computer simulations that compared large JP-4 to JP-8 pool fires using Sandia's VULCAN fire model are shown and discussed. Additionally, the Container Analysis Fire (CAFE) code was used to compare the thermal response of a large calorimeter exposed to engulfing fires fueled by these three jet propellants. The paper then recommends JP-8 as an alternate fuel that complies with the thermal environment implied in 10CFR71.74.

    The National Nuclear Security Administration (NNSA) has submitted an application to the Nuclear Regulatory Commission (NRC) for the air shipment of plutonium metal within the Plutonium Air Transportable (PAT-1) packaging. The PAT-1 packaging is currently authorized for the air transport of plutonium oxide in solid form only. The INMM presentation will provide a limited overview of the scope of the plutonium metal initiative and provide a status of the NNSA application to the NRC.

    The purpose of the Authorization Agreement is to serve as a mechanism whereby the U.S. Department of Energy, Richland Operations Office (RL) and Fluor Hanford (FH) jointly clarify and agree to key conditions for conducting work safely and efficiently in the Fast Flux Test Facility (FFTF). Work must be accomplished in a manner that achieves high levels of quality while protecting the environment and the safety and health of workers and the public, and complying with applicable contractual and regulatory requirements. It is the intent of this Agreement to address those items of significant importance in establishing and supporting the FFTF Authorization Envelope, but this Agreement in no way alters the terms and conditions of the Project Hanford Management Contract (PHMC), Contract Number DE-AC06-96RL13200.

    Part I of the hearing record covers testimony relating to the extension of antitrust defense availability to the International Energy Agency (IEA); an authorization request by the Department of Transportation (DOT) to comply with pipeline safety regulations; and the administration's reluctance to promote gasohol use in federal vehicles. The first day's hearing included discussion of H.R. 2166, which extended the IEA authority by amending the Energy Policy and Conservation Act, and the testimony of four witnesses representing federal agencies involved in international affairs. On the second day, three DOT witnesses described pipeline-safety programs, enforcement, and procedures, with emphasis on the transport of liquefied natural gas. On the third day, nine witnesses representing gasohol-producing states, the US Army Equipment Research and Development Command, federal fleet services, and DOE examined the appropriateness and compliance record of Executive Order 12261 mandating gasohol for federally owned or leased vehicles. At issue was the need to convert Midwest grains to fuel at a time when oil is plentiful, the performance of alcohol fuels, and the administration's preference for working through the marketplace.     Sometimes the only feasible means of shipping research reactor spent nuclear fuel (SNF) among countries is via air transport because of location or political conditions. The International Atomic Energy Agency (IAEA) has established a regulatory framework to certify air transport Type C casks. However, no such cask has been designed, built, tested, and certified. In lieu of an air transport cask, research reactor SNF has been transported using a Type B cask under an exemption with special arrangements for administrative and security controls. This work indicates that it may be feasible to transport commercial power reactor SNF assemblies via air, and that the cost is only about three times that of shipping it by railway. Optimization (i.e., reduction) of this cost factor has yet to be done. (authors)

    Specification packages are broad families of package designs developed and authorized by the US Department of Transportation (DOT) and the Nuclear Regulatory Commission (NRC) for transport of certain Type B and fissile radioactive materials, with each specification containing a number of designs of various sizes. The specification package designs have remained essentially unchanged in a changing regulatory environment. Changes to package designs or authorized contents under the DOT system can be accomplished by rule making action, but there has been little updating of the designs over the years. Many of the individual package designs are no longer supported by reasonably current safety analyses. Since the publication of these specifications, there have been changes in regulatory requirements and improvements in methods of testing and analysis. Additionally, contemplated revisions to the DOT and NRC regulations to bring design requirements into accord with IAEA Safety Series No. 6, 1985 Edition would eliminate fissile classes and require resistance to a crush test for small Type B packages meeting certain criteria. The NRC has requested that the Oak Ridge National Laboratory (ORNL) staff review the safety documentation of the specification packages to determine the possible need for further testing and analysis, modifications to the designs, and, perhaps, elimination of any designs for which there is insufficient demonstration of compliance with current and proposed requirements. This paper will present a summary of the technical data and information concerning the use of the packages that has been received to date.

    Packages for the transportation of radioactive material must meet performance criteria to assure safety and environmental protection. The stringency of the performance criteria is based on the degree of hazard of the material being transported. Type B packages are used for transporting large quantities of radioisotopes (in terms of A{sub 2} quantities). These packages have the most stringent performance criteria. Material with less than an A{sub 2} quantity are transported in Type A packages. These packages have less stringent performance criteria. Transportation of LSA and SCO materials must be in {open_quotes}strong-tight{close_quotes} packages. The performance requirements for the latter packages are even less stringent. All of these package types provide a high level of safety for the material being transported. In this paper, regulatory tests that are used to demonstrate this safety will be described. The responses of various packages to these tests will be shown. In addition, the response of packages to extra-regulatory tests will be discussed. The results of these tests will be used to demonstrate the high level of safety provided to workers, the public, and the environment by packages used for the transportation of radioactive material.

    The purpose of this design calculation is to estimate radiation doses received by personnel working in the Transportation Cask Receipt and Return Facility (TCRRF) of the repository including the personnel at the security gate and cask staging areas. This calculation is required to support the preclosure safety analysis (PCSA) to ensure that the predicted doses are within the regulatory limits prescribed by the U.S. Nuclear Regulatory Commission (NRC). The Cask Receipt and Return Facility receives NRC licensed transportation casks loaded with spent nuclear fuel (SNF) and high-level radioactive waste (HLW). The TCRRF operation starts with the receipt, inspection, and survey of the casks at the security gate and the staging areas, and proceeds to the process facilities. The transportation casks arrive at the site via rail cars or trucks under the guidance of the national transportation system. This calculation was developed by the Environmental and Nuclear Engineering organization and is intended solely for the use of Design and Engineering in work regarding facility design. Environmental and Nuclear Engineering personnel should be consulted before using this calculation for purposes other than those stated herein or for use by individuals other than authorized personnel in the Environmental and Nuclear Engineering organization.

    The Plutonium Air Transportable Package, Model PAT-1, is certified under Title 10, Code of Federal Regulations Part 71 by the U.S. Nuclear Regulatory Commission (NRC) per Certificate of Compliance (CoC) USA/0361B(U)F-96 (currently Revision 9). The National Nuclear Security Administration (NNSA) submitted SAND Report SAND2009-5822 to NRC that documented the incorporation of plutonium (Pu) metal as a new payload for the PAT-1 package. NRC responded with a Request for Additional Information (RAI), identifying information needed in connection with its review of the application. The purpose of this SAND report is to provide the authors responses to each RAI. SAND Report SAND2010-6106 containing the proposed changes to the Addendum is provided separately.

    The Waste Isolation Pilot Plant (WIPP), located near Carlsbad, New Mexico, USA, is a US Department of Energy (DOE) facility designed as a permanent repository for transuranic wastes in the center of a 2,000-foot-thick salt bed situated 2,150 feet underground. Construction of the facility started in 1975, under a congressional act of site selection. In 1979, demonstration of safe disposal at the WIPP was authorized by Public Law 96-164. The operational philosophy and practice at the facility are: (1) start clean -- stay clean, (2) meet or exceed regulatory requirements, and (3) control radiation exposure levels to as low as reasonably achievable (ALARA). Strict safety measures must be taken in the areas of waste preparation, transportation, and facility operation.

Advective transport occurs when radionuclides that are dissolved or sorbed onto colloids (or both) are carried from the waste package by the portion of the seepage flux that passes through waste package breaches. Diffusive transport occurs as a result of a gradient in radionuclide concentration and may take place while advective transport is also occurring, as well as when no advective transport is occurring. Diffusive transport is addressed in detail because it is the sole means of transport when there is no flow through a waste package, which may dominate during the regulatory compliance period in the nominal and seismic scenarios. The advective transport rate, when it occurs, is generally greater than the diffusive transport rate. Colloid-facilitated advective and diffusive transport is also modeled and is presented in detail in Appendix B of this report.

    The Office for Nuclear Regulation (ONR) is an independent safety, security and transport regulator of the UK nuclear industry. ONR regulates all civil nuclear reactor power stations, fuel manufacture, enrichment, spent fuel reprocessing, most defence sites and installations that store and process legacy spent fuel and radioactive waste. The responsibility for funding and strategic direction of decommissioning and radioactive waste management of state owned legacy sites has rested solely with the Nuclear Decommissioning Authority (NDA) since 2005. A key component of NDA's mandate was to encourage new strategic approaches and innovation to dealing with the UK's waste legacy and which deliver value-for-money to the UK taxpayer. ONR, as an agency of the Health and Safety Executive, is entirely independent of NDA and regulates all prescribed activities on NDA's sites. NDA's competition of site management and closure contracts has attracted significant international interest and the formation of consortia comprised of major British, US, French and Swedish organizations bidding for those contracts. The prominence of US organizations in each of those consortia reflects the scale and breadth of existing waste management and D and D projects in the US. This paper will articulate, in broad terms, the challenges faced by international organizations seeking to employ 'off-the-shelf' technology and D and D techniques, successfully employed elsewhere, into the UK regulatory context. The predominantly 'goal-setting' regulatory framework in the UK does not generally prescribe a minimum standard to which a licensee must adhere. The legal onus on licensees in the UK is to demonstrate, whatever technology is selected, that in its applications, risks are reduced 'So Far As Is Reasonably Practicable' or 'SFAIRP'.     The Interstate Oil and Gas Compact Commission (IOGCC) engaged in numerous projects outlined under the scope of work discussed in the United States Department of Energy (DOE) grant number DE-FC26-04NT15456 awarded to the IOGCC. Numerous projects were completed that were extremely valuable to state oil and gas agencies as a result of work performed utilizing resources provided by the grant. There are numerous areas in which state agencies still need assistance. This additional assistance will need to be addressed under future scopes of work submitted annually to DOE's Project Officer for this grant. This report discusses the progress of the projects outlined under the grant scope of work for the 2005-2006 areas of interest, which are as follows: Area of Interest No. 1--Regulatory Streamlining and Improvement: This area of interest continues to support IOGCC's regulatory streamlining efforts that include the identification and elimination of unnecessary duplications of efforts between and among state and federal programs dealing with exploration and production on public lands. Area of Interest No. 2--Technology: This area of interest seeks to improve efficiency in states through the identification of technologies that can reduce costs. Area of Interest No. 3--Training and Education: This area of interest is vital to upgrading the skills of regulators and industry alike. Within the National Energy Policy, there are many appropriate training and education opportunities. Education was strongly endorsed by the President's National Energy Policy Development group. Acting through the governors offices, states are very effective conduits for the dissemination of energy education information.     Heavy ion beam transport through the containment chamber plays a crucial role in all heavy ion fusion (HIF) scenarios. Here, several parameters are used to characterize the operating space for HIF beams; transport modes are assessed in relation to evolving target/accelerator requirements; results of recent relevant experiments and simulations of HIF transport are summarized; and relevant instabilities are reviewed. All transport options still exist, including (1) vacuum ballistic transport, (2) neutralized ballistic transport, and (3) channel-like transport. Presently, the European HIF program favors vacuum ballistic transport, while the US HIF program favors neutralized ballistic transport with channel-like transport as an alternate approach. Further transport research is needed to clearly guide selection of the most attractive, integrated HIF system.

    Uranium contamination is prevalent at many of the U.S. DOE facilities and at several civilian sites that have supported the nuclear fuel cycle. The potential off-site mobility of uranium depends on the partitioning of uranium between aqueous and solid (soil and sediment) phases. Hexavalent U (as uranyl, UO{sub 2}{sup 2+}) is relatively mobile, forming strong complexes with ubiquitous carbonate ion which renders it appreciably soluble even under mild reducing conditions. In the presence of carbonate, partition of uranyl to ferri-hydrate and select other mineral phases is usually maximum in the near-neutral pH range {approx} 5-8. The surface complexation reaction of uranyl with iron-containing minerals has been used as one means to model subsurface migration, used in conjunction with information on the site water chemistry and hydrology. Partitioning of uranium is often studied by short-term batch 'equilibrium' or long-term soil column testing ; MCLinc has performed both of these methodologies, with selection of method depending upon the requirements of the client or regulatory authority. Speciation of uranium in soil may be determined directly by instrumental techniques (e.g., x-ray photoelectron spectroscopy, XPS; x-ray diffraction, XRD; etc.) or by inference drawn from operational estimates. Often, the technique of choice for evaluating low-level radionuclide partitioning in soils and sediments is the sequential extraction approach. This methodology applies operationally-defined chemical treatments to selectively dissolve specific classes of macro-scale soil or sediment components. These methods recognize that total soil metal inventory is of limited use in understanding bioavailability or metal mobility, and that it is useful to estimate the amount of metal present in different solid-phase forms. Despite some drawbacks, the sequential extraction method can provide a valuable tool to distinguish among trace element fractions of different solubility related to

    The U.S. Department of Transportation (DOT) Specification 6M packaging was in extensive use for more than 40 years for in-commerce shipments of Type B quantities of fissile and radioactive material (RAM) across the USA, among the Department of Energy (DOE) laboratories, and between facilities in the DOE production complex. In January 2004, the DOT Research and Special Programs Administration (RSPA) Agency issued a final rule in the Federal Register to ammend requirements in the Hazardous Materials Regulations (HMR) pertaining to the transportation of radioactive materials. The final rule became effective on October 1, 2004. One of those changes discontinued the use of the DOT specification 6M, along with other DOT specification packagings, on October 1, 2008. A main driver for the change was due to the fact that 6M specification packagings were not supported by a Safety Analysis Report for Packagings (SARP) that was compliant with Title 10 of the Code of Federal Regulations (CFR) Part 71 (10 CFR 71). The regulatory rules for the discontinued use have been edited in Title 49 of the CFR Parts 100-185, 2004 edition and thereafter. Prior to October 1, 2008, the use of the 6M within the boundaries of the Savannah River Site (SRS), called an onsite transfer, was governed by an onsite transportation document that referenced 49 CFR Parts 100-185. SRS had to develop an Onsite Safety Assessment (OSA) which was independent of 49 CFR in order to justify the continued use of the DOT Specification 6M for the transfer of radioactive material (RAM) at the SRS after October 1, 2008. This paper will discuss the methodology for and difficulties associated with authorizing the DOT Specification 6M Packaging for continued use at the Savannah River Site.

    The transport of Dangerous Goods-Class no.7 Radioactive Material (RAM), is an important part of the Romanian Radioactive Material Management. The overall aim of this activity is for enhancing operational safety and security measures during the transport of the radioactive materials, in order to ensure the protection of the people and the environment. The paper will present an overall of the safety and security measures recommended and implemented during transportation of RAM in Romania. Some aspects on the potential threat environment will be also approached with special referring to the low level radioactive material (waste) and NORM transportation either by road or by rail. A special attention is given to the assessment and evaluation of the possible radiological consequences due to RAM transportation. The paper is a part of the IAEA's Vienna Scientific Research Contract on the State Management of Nuclear Security Regime (Framework) concluded with the Institute for Nuclear Research, Romania, where the author is the CSI (Chief Scientific Investigator). The transport of RAM in Romania is a very sensible and complex problem taking into consideration the importance and the need of the security and safety for such activities. The Romanian Nuclear Regulatory Body set up strictly regulation and procedures according to the Recommendation of the IAEA Vienna and other international organizations. There were implemented the adequate regulation and procedures in order to keep the environmental impacts and the radiological consequences at the lower possible level and to assure the effectiveness of state nuclear security regime due to possible malicious acts in carrying out these activities including transport and the disposal site at the acceptable international levels.     The US Department of Energy (DOE) is charged with responsibly managing the largest volume of mixed waste in the United States. This responsibility includes managing waste in compliance with all applicable Federal and State laws and regulations, and in a cost-effective, environmentally responsible manner. Managing certain treated mixed wastes in Resource Conservation and Recovery Act (RCRA) permitted storage and disposal units (specifically those mixed wastes that pose low risks from the hazardous component) is unlikely to provide additional protection to human health and the environment beyond that afforded by managing these wastes in storage and disposal units subject to requirements for radiological control. In October, 1995, the DOE submitted a regulatory reform proposal to the Environmental Protection Agency (EPA) relating to vitrified mixed waste forms. The technical proposal supports a regulatory strategy that would allow vitrified mixed waste forms treated through a permit or other environmental compliance mechanism to be granted an exemption from RCRA hazardous waste regulation, after treatment, based upon the inherent destruction and immobilization capabilities of vitrification technology. The vitrified waste form will meet, or exceed the performance criteria of the Environmental Assessment (EA) glass that has been accepted as an international standard for immobilizing radioactive waste components and the LDR treatment standards for inorganics and metals for controlling hazardous constituents. The proposal further provides that vitrified mixed waste would be responsibly managed under the Atomic Energy Act (AEA) while reducing overall costs. Full regulatory authority by the EPA or a State would be maintained until an acceptable vitrified mixed waste form, protective of human health and the environment, is produced.

Advective transport occurs when radionuclides that are dissolved or sorbed onto colloids (or both) are carried from the waste package by the portion of the seepage flux that passes through waste package breaches. Diffusive transport occurs as a result of a gradient in radionuclide concentration and may take place while advective transport is also occurring, as well as when no advective transport is occurring. Diffusive transport is addressed in detail because it is the sole means of transport when there is no flow through a waste package, which may dominate during the regulatory compliance period in the nominal and seismic scenarios. The advective transport rate, when it occurs, is generally greater than the diffusive transport rate. Colloid-facilitated advective and diffusive transport is also modeled and is presented in detail in Appendix B of this report.

    The Transuranic Package Transporter II (TRUPACT-II) is a US Nuclear Regulatory Commission (NRC) certified Type B packaging for the shipment of contact-handled transuranic (CH-TRU) material by the US Department of Energy (DOE). The NRC approved the TRUPACT-II design as meeting the requirements of Title 10, Code of Federal Regulations, Part 71 (10 CFR 71) and issued Certificate of Compliance (CofC) Number 9218 to the DOE. There are currently 15 certified TRUPACT-IIs. Additional TRUPACT-IIs will be required to make more than 15,000 shipments of CH-TRU waste to the Waste Isolation Pilot Plant (WIPP) site near Carlsbad, New Mexico. The TRUPACT-II may also be used for the DOE inter-site and intra-site shipments of CH-TRU waste. The Land Withdrawal Act (Public Law 102-579), enacted by the US Congress, October 30, 1992, and an agreement between the DOE and the State of New Mexico, signed August 4, 1987, both stipulate that only NRC approved packaging may be used for shipments of TRU waste to the WIPP. Early in the TRUPACT-II development phase it was decided that the transportation system (tractor, trailer, and TRUPACT-II) should be highway legal on all routes without the need for oversize and/or overweight permits. In large measure, public acceptance of the DOE`s efforts to safely transport CH-TRU waste depends on the public`s perception that the TRUPACT-II is in compliance with all applicable regulations, standards, and quality assurance requirements. This paper addresses some of the numerous regulations applicable to Type B packaging, and it describes how the TRUPACT-II complies with these regulations.

  12. Experiences on a Regulatory Clearance of the Radioactive Wastes at KAERI

    At the Korea Atomic Energy Research Institute (KAERI) in Daejeon, about 4,500 drums of old radioactive soil and concrete wastes have been stored since their generation and transport to Daejeon in 1988. The wastes have been stored for more than 18 years. So, according to the analysis result for their radioactivity, some of them can be regularly cleared. In addition to that, about 2,200 tonnes of decommissioning wastes were generated during the dismantling of Korean research reactors no.1 and no.2 (KRR-1 and KRR-2) from 1997 to 2005. Among those, only 13% were classified as radioactive wastes and part of remains were cleared. In this paper, the experiences on a regulatory clearance of radioactive wastes at KAERI were discussed. First, for the old wastes, a working procedure for representative sampling of each drum and an analysis was developed. Also, as these old wastes are already in a storage facility, some equipment and tools for easy sampling and restricting a contamination of a storage facility were developed and applied. Following the working procedure, the old wastes with a surface dose rate less than 0.3 {mu}Sv/hr were selected for an analysis. Based on the analysis results of a sample, the waste with a radioactivity concentration less than 0.4 Bq/g was classified as an object for regulatory clearance. According to the radiological dose assessment result and the dose criteria regulated by Atomic Energy Act of Korea (individual dose<10 {mu}Sv/yr, collective dose<1 man.Sv/yr), about 2,800 drums of wastes were determined for a clearance and they are under process for a license. After a clearance, it is scheduled for the wastes to be disposed of at a public dumping ground. Second, for the recently generated decommissioning wastes, the analysis for their radioactive characteristics was simpler than that for the old wastes. The distribution of a radioactivity levels, a gross alpha/beta contamination and a surface dose rate was measured to assess the radiological

    This report provides an overview of the regulatory frameworks governing natural gas supply chain infrastructure siting, construction, operation, and maintenance. Information was drawn from a number of sources, including published analyses, government reports, in addition to relevant statutes, court decisions and regulatory language, as needed. The scope includes all onshore facilities that contribute to methane emissions from the natural gas sector, focusing on three areas of state and federal regulations: (1) natural gas pipeline infrastructure siting and transportation service (including gathering, transmission, and distribution pipelines), (2) natural gas pipeline safety, and (3) air emissions associated with the natural gas supply chain. In addition, the report identifies the incentives under current regulatory frameworks to invest in measures to reduce leakage, as well as the barriers facing investment in infrastructure improvement to reduce leakage. Policy recommendations regarding how federal or state authorities could regulate methane emissions are not provided; rather, existing frameworks are identified and some of the options for modifying existing regulations or adopting new regulations to reduce methane leakage are discussed.

    The Exxon Valdez spill abruptly brought to the nation's attention the risks of transporting crude oil. While oil tanker transportation received many of the headlines, the safety of pipelines carrying oil and the terminals that store it have also been called into question. GAO testified on the adequacy of regulatory oversight of the 800-mile Trans-Alaska Pipeline System and the terminal at Valdez, Alaska. This paper reports increased and coordinated regulatory oversight as a major component of an effective operational and emergency response strategy for the pipeline. The current lack of comprehensive and systematic oversight is of particular concern because of recent revelations of significant corrosion problems in the pipeline.

    For the transportation of Radioactive Material (RAM) packages, the requirements for the maximum allowed dose rate at the package surface and in its vicinity are given in Title 10 of the Code of Federal Regulations, Section 71.47. The regulations are based on the acceptable dose rates to which the public, workers, and the environment may be exposed. As such, the regulations specify dose rates, rather than quantity of radioactive isotopes and require monitoring to confirm the requirements are met. 10CFR71.47 requires that each package of radioactive materials offered for transportation must be designed and prepared for shipment so that under conditions normally incident to transportation the radiation level does not exceed 2 mSv/h (200 mrem/h) at any point on the external Surface of the package, and the transport index does not exceed 10. Before shipment, the dose rate of the package is determined by measurement, ensuring that it conforms to the regulatory limits, regardless of any analyses. This is the requirement for all certified packagings. This paper discusses the requirements for establishing the dose rates when shipping RAM packages and the precedents for meeting these requirements by measurement.

    The TWRS Authorization Basis (AB) consists of a set of documents identified by TWRS management with the concurrence of DOE-RL. Upon implementation of the TWRS Basis for Interim Operation (BIO) and Technical Safety Requirements (TSRs), the AB list will be revised to include the BIO and TSRs. Some documents that currently form part of the AB will be removed from the list. This SD identifies each - requirement from those documents, and recommends a disposition for each to ensure that necessary requirements are retained when the AB is revised to incorporate the BIO and TSRs. This SD also identifies documents that will remain part of the AB after the BIO and TSRs are implemented. This document does not change the AB, but provides guidance for the preparation of change documentation.

    Utilities will be reluctant to share data that gives them a competitive advantage over competitors. For exactly that reason, regulators should be more proactive in reviewing and revising, if need be, their policies with respect to the confidentiality of that data. Historically, the electric utility industry has been regarded as one of the most open industries in the United States in terms of inter-company sharing of information and conducting joint research and development activities. But as the prospect of competition among electricity power providers has increased in recent years, investor-owned utilities have become concerned that their competitors will desire access to energy-related data that they may regard as proprietary or confidential. As a result, many utilities are now requesting that the data they submit to their utility regulatory commissions remain confidential. As noted in the discussion below, withholding utility information from the public is likely to have significant policy implications with respect to such matters as: (1) consumer education, the pursuit of truth, mutual respect among parties, and social cooperation; (2) creation of a fair market for competitive energy services; (3) the regulatory balance; (4) regional and national assessments of energy-savings opportunities; (5) research and development; and (6) evaluations of utility programs, plans, and policies. In response to these concerns, in late 1995 and early 1996 the author conducted a survey of state public utility commissions in the U.S. to assess: (1) the relative importance of the issue of confidential data in the regulatory arena; (2) the regulatory response to utility requests for confidentiality (e.g., formal policies, guidelines, rules and procedures, and decisions); and (3) the type of data filed as confidential with PUCs. In this article, the author focus on only the first two objectives of this study.

    The Public Utilities Commission (PUCO) is a body created by the Ohio State legislature to administer the provisions of the Ohio Public Utilities Act. It is composed of three commissioners appointed by the governor with the advice and consent of the senate. Once appointed, a commissioner serves for a six-year period. The PUCO is vested with the power and jurisdiction to supervise and regulate public utilities and railroads... . The term public utility includes every corporation, company, co-partnership, person or association, their lessees, trustees, or receivers, as defined in the Ohio Code. Among the various services enumerated in the Code under the definition of public utility are an electric light company; a gas company; a pipeline company transporting gas, oil or coal; a waterworks company; a heating or cooling company. The power to regulate public utilities is shared by the PUCO and municipal governments. The municipal regulatory authority is derived from the Ohio Constitution, statutory provisions, and municipal franchising authority. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    This paper will complement that delivered by Thomas root by following his historical analysis of the Fifth Amendment through recent case law with an analysis of regulatory taking through environmental statutes. The discussion will center on takings of water rights through application of the Clean Water Act and the Threatened and Endangered Species Act. Although the examples used will be hypothetical, they will be based upon factual situations. Some of the issues presented for consideration will be an examination of standing of municipalities and corporations under the Fifth Amendment, federal and state legislation impacting the judicial trend toward reviving the Fifth Amendment, budgetary considerations, and convergence from focus on real property to other types of property. The author will also discuss the judicial trend in the Fifth Amendment cases from reliance on federal power to regulate to financial impact on real property resulting from regulation, and the potential for a return to the analysis of the power to regulate through a resurrection of the Tenth Amendment limitation of powers.

  3. Going the Distance? NRC's Response to the National Academy of Science's Transportation Study

    In February 2006, the National Academy of Sciences (NAS) published the results of a 3 1/2-year study, titled Going the Distance, that examined the safety of transporting spent nuclear fuel (SNF) and high level waste (HLW) in the United States. NAS initiated this study to address what it perceived to be a national need for an independent, objective, and authoritative analysis of SNF and HLW transport in the United States. The study was co-sponsored by the U.S. Nuclear Regulatory Commission (NRC), the U.S. Department of Energy (DOE), the U.S. Department of Transportation (DOT), the Electric Power Research Institute and the National Cooperative Highway Research Program. This paper addresses some of the recommendations made in the NAS study related to the performance of SNF transportation casks in long duration fires, the use of full-scale package testing, and the need for an independent review of transportation security prior to the commencement of large scale shipping campaigns to an interim storage site or geologic repository. In conclusion: The NRC believes that the current regulations in 10 CFR Part 71 for the design of SNF and HLW transportation packages provide a very high level of protection to the public for very severe accidents and credible threat scenarios. As recommended by the NAS study, additional studies of accidents involving severe fires have been completed. These studies have confirmed that spent fuel casks would be expected to withstand very severe fires without the release of any fission products from the spent fuel. Additionally, changes in rail operating procedures such as the use of dedicated trains and prohibition on the co-location of SNF and flammable liquids in rail tunnels can further reduce the already low probability of severe rail accident fires involving SNF and HLW.     The Nuclear Waste Policy Act of 1982 (NWPA), as amended, authorized the DOE to develop and manage a Federal system for the disposal of SNF and HLW. OCRWM was created to manage acceptance and disposal of SNF and HLW in a manner that protects public health, safety, and the environment; enhances national and energy security; and merits public confidence. This responsibility includes managing the transportation of SNF and HLW from origin sites to the Repository for disposal. The Transportation System Concept of Operations is the core high-level OCRWM document written to describe the Transportation System integrated design and present the vision, mission, and goals for Transportation System operations. By defining the functions, processes, and critical interfaces of this system early in the system development phase, programmatic risks are minimized, system costs are contained, and system operations are better managed, safer, and more secure. This document also facilitates discussions and understanding among parties responsible for the design, development, and operation of the Transportation System. Such understanding is important for the timely development of system requirements and identification of system interfaces. Information provided in the Transportation System Concept of Operations includes: the functions and key components of the Transportation System; system component interactions; flows of information within the system; the general operating sequences; and the internal and external factors affecting transportation operations. The Transportation System Concept of Operations reflects OCRWM's overall waste management system policies and mission objectives, and as such provides a description of the preferred state of system operation.     Quantitative modeling of the potential for contaminant transport from sources associated with underground nuclear testing at Yucca Flat is an important part of the strategy to develop closure plans for the residual contamination. At Yucca Flat, the most significant groundwater resource that could potentially be impacted is the Lower Carbonate Aquifer (LCA), a regionally extensive aquifer that supplies a significant portion of the water demand at the Nevada National Security Site, formerly the Nevada Test Site. Developing and testing reasonable models of groundwater flow in this aquifer is an important precursor to performing subsequent contaminant transport modeling used to forecast contaminant boundaries at Yucca Flat that are used to identify potential use restriction and regulatory boundaries. A model of groundwater flow in the LCA at Yucca Flat has been developed. Uncertainty in this model, as well as other transport and source uncertainties, is being evaluated as part of the Underground Testing Area closure process. Several alternative flow models of the LCA in the Yucca Flat/Climax Mine CAU have been developed. These flow models are used in conjunction with contaminant transport models and source term models and models of contaminant transport from underground nuclear tests conducted in the overlying unsaturated and saturated alluvial and volcanic tuff rocks to evaluate possible contaminant migration in the LCA for the next 1,000 years. Assuming the flow and transport models are found adequate by NNSA/NSO and NDEP, the models will undergo a peer review. If the model is approved by NNSA/NSO and NDEP, it will be used to identify use restriction and regulatory boundaries at the start of the Corrective Action Decision Document Corrective Action Plan (CADD/CAP) phase of the Corrective Action Strategy. These initial boundaries may be revised at the time of the Closure Report phase of the Corrective Action Strategy. (authors)

    The purpose of this Handbook is to provide guidance to the regulatory analyst to promote preparation of quality regulatory analysis documents and to implement the policies of the Regulatory Analysis Guidelines of the US Nuclear Regulatory Commission (NUREG/BR-0058 Rev. 2). This Handbook expands upon policy concepts included in the NRC Guidelines and translates the six steps in preparing regulatory analyses into implementable methodologies for the analyst. It provides standardized methods of preparation and presentation of regulatory analyses, with the inclusion of input that will satisfy all backfit requirements and requirements of NRC`s Committee to Review Generic Requirements. Information on the objectives of the safety goal evaluation process and potential data sources for preparing a safety goal evaluation is also included. Consistent application of the methods provided here will result in more directly comparable analyses, thus aiding decision-makers in evaluating and comparing various regulatory actions. The handbook is being issued in loose-leaf format to facilitate revisions. NRC intends to periodically revise the handbook as new and improved guidance, data, and methods become available.

    On July 1, 1993, a Regulatory Oversight (RO) organization was established within the United States Department of Energy (DOE), Oak Ridge Operations (ORO) to provide regulatory oversight of the DOE uranium enrichment facilities leased to the United States Enrichment Corporation (USEC). The purpose of the RO program was to ensure continued plant safety, safeguards and security while the Paducah and Portsmouth gaseous diffusion plants (GDPs) transitioned to regulatory oversight by the Nuclear Regulatory Commission (NRC). These activities were performed under the authority of the lease agreement between DOE and USEC until NRC issued a Certificate of Compliance or approved a Compliance Plan pursuant to Section 1701 of the Atomic Energy Act of 1954, as amended, and assumed regulatory responsibility. This report chronicles the formal development, operation and key activities of the RO organization from its beginning in July 1993, until the turnover of the regulatory oversight responsibility to the NRC on March 3, 1997. Through its evolution to closure, the RO program was a formal, proceduralized effort designed to provide consistent regulation and to facilitate transition to NRC. The RO Program was also a first-of-a-kind program for DOE. The process, experience, and lessons learned summarized herein should be useful as a model for transition of other DOE facilities to privatization or external regulation.
