    The linkage between Public Utility Commission (PUC) regulation, the deteriorating financial health of the electric utility industry, and implementation of national energy policy, particularly the reduction of foreign petroleum consumption in the utility sector is examined. The role of the Nation's utilities in the pursuit of national energy policy goals and postulates a linkage between PUC regulation, the poor financial health of the utility industry, and the current and prospective failure to displace foreign petroleum in the utility sector is discussed. A brief history of PUC regulation is provided. The concept of regulatory climate and how the financial community has developed a system of ranking regulatory climate in the various State jurisdictions are explained. The existing evidence on the hypothesis that the cost of capital to a utility increases and its availability is reduced as regulatory climate grows more unfavorable from an investor's point of view is analyzed. The implications of this cost of capital effect on the electric utilities and collaterally on national energy policy and electric ratepayers are explained. Finally various State, regional and Federal regulatory responses to problems associated with PUC regulation are examined.

    Low level radioactive waste (LLW) is generated from various nuclear applications in Bangladesh. The major sources of radioactive waste in the country are at present: (a) the 3 MW TRIGA Mark-II research reactor; (b) the radioisotope production facility; (c) the medical, industrial and research facilities that use radionuclides; and (d) the industrial facility for processing monazite sands. Radioactive waste needs to be safely managed because it is potentially hazardous to human health and the environment. According to Nuclear Safety and Radiation Control Act-93, the Bangladesh Atomic Energy Commission (BAEC) is the governmental body responsible for the receipt and final disposal of radioactive wastes in the whole country. Waste management policy has become an important environmental, social, and economical issue for LLW in Bangladesh. Policy and strategies will serve as a basic guide for radioactive waste management in Bangladesh. The waste generator is responsible for on-site collection, conditioning and temporary storage of the waste arising from his practice. The Central Waste Processing and Storage Unit (CWPSU) of BAEC is the designated national facility with the requisite facility for the treatment, conditioning and storage of radioactive waste until a final disposal facility is established and becomes operational. The Regulatory Authority is responsible for the enforcement of compliance with provisions of the waste management regulation and other relevant requirements by the waste generator and the CWPSU. The objective of this paper is to present, in a concise form, basic information about the radioactive waste management infrastructure, regulations, policies and strategies including the total inventory of low level radioactive waste in the country. For improvement and strengthening in terms of operational capability, safety and security of RW including spent radioactive sources and overall security of the facility (CWPSF), the facility is expected to serve waste management need in the country and, in the course of time, the facility may be turned into a regional level training centre. It is essential for safe conduction and culture of research and application in nuclear science and technology maintaining the relevant safety of man and environment and future generations to come.     By vacating the Federal Energy Commission's (FERC) Order 745 in Electric Power Supply Association vs. FERC (EPSA, 2014) the U.S. Court of Appeals for the D.C Circuit injected uncertainty into the future of demand response (DR) resources in U.S. wholesale markets. Many possible future scenarios in which DR continues to be available to provide capacity for resource adequacy would need to rely on a potential checkerboard of policies promulgated by state utility commissions. However, the states that will be most directly impacted by the potential implications from the EPSA ruling are precisely those that have the fewest policies currently in place to promote retail program development.

    President Carter issued Executive Order 12044 (3/28/78) that required all Federal agencies to distinguish between significant and insignificant regulations, and to determine whether a regulation will result in major impacts. This study gathered information on the impact of the order and the guidelines on the Office of Conservation and Solar Energy (CS) regulatory practices, investigated problems encountered by the CS staff when implementing the order and guidelines, and recommended solutions to resolve these problems. Major tasks accomplished and discussed are: (1) legislation, Executive Orders, and DOE Memoranda concerning Federal administrative procedures relevant to the development and analysis of regulations within CS reviewed; (2) relevant DOE Orders and Memoranda analyzed and key DOE and CS staff interviewed in order to accurately describe the current CS regulatory process; (3) DOE staff from the Office of the General Counsel, the Office of Policy and Evaluation, the Office of the Environment, and the Office of the Secretary interviewed to explore issues and problems encountered with current CS regulatory practices; (4) the regulatory processes at five other Federal agencies reviewed in order to see how other agencies have approached the regulatory process, dealt with specific regulatory problems, and responded to the Executive Order; and (5) based on the results of the preceding four tasks, recommendations for potential solutions to the CS regulatory problems developed.     Local climate regulation by urban green areas is an important urban ecosystem service, as it reduces the extent of the urban heat island and therefore enhances quality of life. Local and regional planning policies can control land use changes in an urban region, which in turn alter local climate regulation. Thus, this paper describes a method for estimating the impacts of current land uses as well as local and regional planning policies on local climate regulation, using evapotranspiration and land surface emissivity as indicators. This method can be used by practitioners to evaluate their policies. An application of this method is demonstrated for the case study Leipzig (Germany). Results for six selected planning policies in Leipzig indicate their distinct impacts on climate regulation and especially the role of their spatial extent. The proposed method was found to easily produce a qualitative assessment of impacts of planning policies on climate regulation.

    Representatives of industry, the US Chamber of Commerce, the Citizen/Labor Energy Coalition, government agencies, and others testified at a hearing on the issue of reducing oil imports as a way to strengthen the domestic oil industry. An amendment to the trade bill that would impose an import fee on oil raised concerns that it might be counter-productive by causing hardship on individuals and other industries because of higher prices. Another concern was that the amendment relinquishes congressional power to tax and set policy to the president. The discussion covered the level of oil imports and changes in import activity at various points in history, although there was little consensus of interpretation. Oil marketers oppose the amendment on the ground that automatic triggers of import fees, quotas, and other strategies are unfair and economically risky. An appendix with additional material submitted for the record follows the testimony of the 14 witnesses.

    Feed-in tariffs (FITs) are the most prevalent renewable energy policy used globally to date, and there are many benefits to the certainty offered in the marketplace to reduce development risks and associated financing costs and to grow the renewable energy industry. However, concerns over escalating costs in jurisdictions with FIT policies have led to increased attention on cost control in renewable energy policy design. In recent years, policy mechanisms for containing FIT costs have become more refined, allowing policymakers to exert greater control on policy outcomes and on the resulting costs to ratepayers. As policymakers and regulators in the United States begin to explore the use of FITs, careful consideration must be given to the ways in which policy design can be used to balance the policies' advantages while bounding its costs. This report explores mechanisms that policymakers have implemented to limit FIT policy costs. If designed clearly and transparently, such mechanisms can align policymaker and market expectations for project deployment. Three different policy tools are evaluated: (1) caps, (2) payment level adjustment mechanisms, and (3) auction-based designs. The report employs case studies to explore the strengths and weaknesses of these three cost containment tools. These tools are then evaluated with a set of criteria including predictability for policymakers and the marketplace and the potential for unintended consequences.

    On April 13, 1983, the US Nuclear Regulatory Commission issued for public comment a ''Proposed Commission Policy Statement on Severe Accidents and Related Views on Nuclear Reactor Regulation'' (48 FR 16014). This report presents and discusses the Commission's final version of that policy statement now entitled, ''Policy Statement on Severe Reactor Accidents Regarding Future Designs and Existing Plants.'' It provides an overview of comments received from the public and the Advisory Committee on Reactor Safeguards and the staff response to these. In addition to the Policy Statement, the report discusses how the policies of this statement relate to other NRC programs including the Severe Accident Research Program; the implementation of safety measures resulting from lessons learned in the accident at Three Mile Island; safety goal development; the resolution of Unresolved Safety Issues and other Generic Safety Issues; and possible revisions of rules or regulatory requirements resulting from the Severe Accident Source Term Program. Also discussed are the main features of a generic decision strategy for resolving Regulatory Questions and Technical Issues relating to severe accidents; the development and regulatory use of new safety information; the treatment of uncertainty in severe accident decision making; and the development and implementation of a Systems Reliability Program for both existing and future plants to ensure that the realized level of safety is commensurate with the safety analyses used in regulatory decisions.

    When policy makers propose new policies, there is a need to assess the costs and benefits of the proposed policy measures, to compare them to existing and alternative policies, and to rank them according to their effectiveness. In the case of equipment energy efficiency regulations, comparing the effects of a range of alternative policy measures requires evaluating their effects on consumers’ budgets, on national energy consumption and economics, and on the environment. Such an approach should be able to represent in a single framework the particularities of each policy measure and provide comparable results. This report presents an integrated methodological framework to assess prospectively the energy, economic, and environmental impacts of energy efficiency policy measures. The framework builds on the premise that the comparative assessment of energy efficiency policy measures should (a) rely on a common set of primary data and parameters, (b) follow a single functional approach to estimate the energy, economic, and emissions savings resulting from each assessed measure, and (c) present results through a set of comparable indicators. This framework elaborates on models that the U.S. Department of Energy (DOE) has used in support of its rulemakings on mandatory energy efficiency standards. In addition to a rigorous analysis of the impacts of mandatory standards, DOE compares the projected results of alternative policy measures to those projected to be achieved by the standards. The framework extends such an approach to provide a broad, generic methodology, with no geographic or sectoral limitations, that is useful for evaluating any type of equipment energy efficiency market intervention. The report concludes with a demonstration of how to use the framework to compare the impacts estimated for twelve policy measures focusing on increasing the energy efficiency of gas furnaces in the United States.

    In this paper, we explore the role of data science in the public policy lifecycle. We posit policy documents (bills, acts, regulations and directives) as forms of social objects and present a methodology to understand interactions between prior context in professional and personal social networks to a given public policy document release. We employ natural language processing tools along with recent advances in semantic reasoning to formulate document-level proximity metrics which we use to predict the relevance (and impact) of the policy artifacts. These metrics serve as a measure of excitation between people and the public policy initiatives.

    This paper examines the potential effects that emerging mandatory carbon markets have for voluntary markets for renewable energy, or green power markets. In an era of carbon regulation, green power markets will continue to play an important role because many consumers may be interested in supporting renewable energy development beyond what is supported through mandates or other types of policy support. The paper examines the extent to which GHG benefits motivate consumers to make voluntary renewable energy purchases and summarizes key issues emerging as a result of these overlapping markets, such as the implications of carbon regulation for renewable energy marketing claims, the demand for and price of renewable energy certificates (RECs), and the use of RECs in multiple markets (disaggregation of attributes). It describes carbon regulation programs under development in the Northeast and California, and how these might affect renewable energy markets in these regions, as well as the potential interaction between voluntary renewable energy markets and voluntary carbon markets, such as the Chicago Climate Exchange (CCX). It also briefly summarizes the experience in the European Union, where carbon is already regulated. Finally, the paper presents policy options for policymakers and regulators to consider in designing carbon policies to enable carbon markets and voluntary renewable energy markets to work together.

    This final report summarizes work carried out under agreement with the US Department of Energy, related to wind energy policy issues. This project has involved a combination of outreach and publications on wind energy, with a specific focus on educating state-level policymakers. Education of state policymakers is vitally important because state policy (in the form of incentives or regulation) is a crucial part of the success of wind energy. State policymakers wield a significant influence over all of these policies. They are also in need of high quality, non-biased educational resources which this project provided. This project provided outreach to legislatures, in the form of meetings designed specifically for state legislators and legislative staff, responses to information requests on wind energy, and publications. The publications addressed: renewable energy portfolio standards, wind energy transmission, wind energy siting, case studies of wind energy policy, avian issues, economic development, and other related issues. These publications were distributed to legislative energy committee members, and chairs, legislative staff, legislative libraries, and other related state officials. The effect of this effort has been to provide an extensive resource of information about wind information for state policymakers in a form that is useful to them. This non-partisan information has been used as state policymakers attempt to develop their own policy proposals related to wind energy in the states.

    Examples are provided of the great gulf between what the design professions are capable of doing and what they are actually doing. Principles of resolutionary design are applied to the problem. The result: changes in tax policy with substantial economic gain in the best interest of all the people. It is recommended that taxation of what one wants to conserve--energy resource use--be substituted over the long term for taxation of what one does not want to minimize--income. It is time for lenders, in the case of dwelling construction, to accept appraisals based on present worth, in turn based on competent life-cycle costing and certified by engineering economic analysis. It is time for the professional societies and the publicly regulated utilities to join forces with the lenders and the appraisers in a matter which is in the best interest of all the people.

    Power through Policy: 'Best Practices' for Cost-Effective Distributed Wind is a U.S. Department of Energy (DOE)-funded project to identify distributed wind technology policy best practices and to help policymakers, utilities, advocates, and consumers examine their effectiveness using a pro forma model. Incorporating a customized feed from the Database of State Incentives for Renewables and Efficiency (DSIRE), the Web-based Distributed Wind Policy Comparison Tool (Policy Tool) is designed to assist state, local, and utility officials in understanding the financial impacts of different policy options to help reduce the cost of distributed wind technologies. The Policy Tool can be used to evaluate the ways that a variety of federal and state policies and incentives impact the economics of distributed wind (and subsequently its expected market growth). It also allows policymakers to determine the impact of policy options, addressing market challenges identified in the U.S. DOE’s '20% Wind Energy by 2030' report and helping to meet COE targets.

    There is growing state-level interest in the USA in accelerating the development of low-carbon coal technologies, including carbon capture and storage (CCS). Many states have adopted greenhouse gas emission targets and made commitments to low-carbon energy, and believe that these polices will result in job creation, air quality improvements, and reliable low-cost energy supplies. This paper provides an overview of options for states to encourage the deployment of carbon capture and sequestration. It describes actions (including legislation, regulations, and incentives) throughout the country. It also reviews in greater detail the range of policies available to state Public Utility Commissions for advancing deployment of CCS. Many states are adopting meaningful incentives for integrated gasification combined cycle (IGCC) power plants, and, as a handful of states are beginning to demonstrate, a number of these incentives can apply to CCS as well. States also have a number of authorities relevant to advancement of clean coal power, particularly within the domain of state public utility commissions (PUCs). State commissions have a wide array of policy options available to them in pursuing this goal, and will play a crucial role in determining the speed and effectiveness with which such technologies are deployed. States also enjoy major advantages, such as their direct jurisdiction over many critical power plant issues (including siting and retail ratemaking) that federal agencies do not possess. Regardless of the final form of federal greenhouse gas rules, states have the chance to gain experience as first movers and policy innovators, and will play an important role in shaping a low-carbon future. Although national policy is essential, a proactive approach by state policymakers and regulators to drive CCS can reduce future compliance costs, speed the required technological developments, and pave the way for future national policy.

Chapter One very briefly sketches each step in the development of a significant regulation, noting important requirements and participants. Chapter Two expands upon the Overview, providing the details of the process, the rationale and source of requirements, concurrence procedures, and advice on the timing and synchronization of steps. Chapter Three explains the types of analysis documents that may be required for a program. Regulatory Analyses, Environmental Impact Statements, Urban and Community Impact Analyses, and Regulatory Flexibility Analyses are all discussed. Specific information to be included in the documents and the circumstances under which the documents need to be prepared are explained. Chapter Four is a step-by-step discussion of how to do good analysis. Use of models and data bases is discussed. Policy objectives, alternatives, and decision making are explained. In Chapter five guidance is provided on identifying the public that would most likely be interested in the regulation, involving its constituents in a dialogue with CS, evaluating and handling comments, and engineering the final response. Chapter Six provides direction on planning the evaluation, monitoring the regulation's success once it has been promulgated, and allowing for constructive support or criticism from outside DOE.
