For over two years, The Keystone Center facilitated a dialogue on State and Federal Regulation of the Electricity Industry. The intent of this report is to assist policy-makers faced with decisions about changes to traditional utility regulation and planning and provide an overview of a diverse group`s deliberations on regulatory jurisdictional conflicts. This report is not a consensus document, rather it is a staff written summary of two years of discussion on the issues. The participants in the Keystone Dialogue believed that all affected interests could benefit from, if nothing else, a summary of their discussions of state/federal issues. The electric utility industry is one of the last remaining, heavily regulated industries in the United States. Rate and corporate regulation is split between state and federal governments and there is distinct regulatory authority at each level. For example, retail rate regulation occurs at the state level, the Federal Energy Regulatory Commission is responsible for wholesale rate regulation under the Federal Power Act, and the Securities and Exchange Commission oversees registered utility holding companies as defined under the Public Utility Holding Company Act of 1935. This jurisdictional split between state and federal regulation has evolved over many years through legislation and litigation on such matters. The creation of this allocation of regulatory responsibility was initiated in 1935 with the passage of the Public Utility Holding Company Act and the Federal Power Act when the economic and technological changes that are now occurring in the industry simply could not have been envisioned.

American politics and policies in the regulation of Mexican natural gas imports

Regulation of natural gas imports from Mexico has been dominated by the industry's domestic regulatory-issue agenda throughout the 30-year trade history. Three distinct phases are identified. In the 1950's, Mexican imports were assessed in terms of their effect on a domestic industry experiencing rapid growth and inter-fuel competition. In the 1960's and thereafter, preservation of domestic price regulation was the overriding criterion for determination of the public interest in Mexican import applications. In the most recent phase, national security considerations activated by the energy crisis have increased the salience of foreign economic policy in the regulation of Mexican natural gas imports. Notwithstanding, domestic issues have continued to predominate. The increasing importance of foreign economic policy in determination of the public interest in Mexican imports is apparent in the transformation of regulatory practice. An administrative process in which the Federal Power Commission interpreted a vague Congressional mandate for the public interest in adversarial public hearings was transformed in the Carter Administration. Explicit policy guidelines were enunciated and interpreted in the Department of Energy under the jurisdiction of its Secretary. Policy consistency and containment of pluralist participatory politics were explicit objectives of a new Congressional mandate that greatly modified regulatory procedures initiated by the Natural Gas Act in 1938.

''Measuring the Costs of Climate Change Policies''

Studies of the costs of climate change policies have utilized a variety of measures or metrics for summarizing costs. The leading economic models have utilized GNP, GDP, the ''area under a marginal cost curve,'' the discounted present value of consumption, and a welfare measure taken directly from the utility function of the model's representative agent (the ''Equivalent Variation''). Even when calculated using a single model, these metrics do not necessarily give similar magnitudes of costs or even rank policies consistently. This paper discusses in non-technical terms the economic concepts lying behind each concept, the theoretical basis for expecting each measure to provide a consistent ranking of policies, and the reasons why different measures provide different rankings. It identifies a method of calculating the ''Equivalent Variation'' as theoretically superior to the other cost metrics in ranking policies. When regulators put forward new economic or regulatory policies, there is a need to compare the costs and benefits of these new policies to existing policies and other alternatives to determine which policy is most cost-effective. For command and control policies, it is quite difficult to compute costs, but for more market-based policies, economists have had a great deal of success employing general equilibrium models to assess a policy's costs. Not all cost measures, however, arrive at the same ranking. Furthermore, cost measures can produce contradictory results for a specific policy. These problems make it difficult for a policy-maker to determine the best policy. For a cost measures to be of value, one would like to be confident of two things. First one wants to be sure whether the policy is a winner or loser. Second, one wants to be confident that a measure produces the correct policy ranking. That is, one wants to have confidence in a policy measure's ability to correctly rank policies from most beneficial to most harmful. This paper analyzes empirically these two properties of different costs measures as they pertain to assessing the costs of the carbon abatement policies, especially the Kyoto Protocol, under alternative assumptions about implementation.

In the near term, regulators, utility managements, and legislators will grapple with numerous issues surrounding the development of cogeneration projects as sources of electric power. The Federal Energy Regulatory Commission predicts that 12,000 MW of new cogeneration plants will be constructed during the 1980s, and all 50 states are in the process of implementing new regulations pursuant to the Public Utility Regulatory Policies Act. The US utility system's overall fuel efficiency of 29% offers rich opportunities to conserve fuel, reduce costs, and decrease pollution via cogeneration. Policymakers should stop viewing utilities simply as efficiency tax collectors on the one hand and opponents of innovation on the other. In addition to mothballing inefficient central utility stations, the US must rapidly deploy district heating with cogenerated heat; policymakers should look beyond the obsolete stream systems and encourage development of the high-temperature hot-water systems so successful in Europe.

President Carter issued Executive Order 12044 (3/28/78) that required all Federal agencies to distinguish between significant and insignificant regulations, and to determine whether a regulation will result in major impacts. This study gathered information on the impact of the order and the guidelines on the Office of Conservation and Solar Energy (CS) regulatory practices, investigated problems encountered by the CS staff when implementing the order and guidelines, and recommended solutions to resolve these problems. Major tasks accomplished and discussed are: (1) legislation, Executive Orders, and DOE Memoranda concerning Federal administrative procedures relevant to the development and analysis of regulations within CS reviewed; (2) relevant DOE Orders and Memoranda analyzed and key DOE and CS staff interviewed in order to accurately describe the current CS regulatory process; (3) DOE staff from the Office of the General Counsel, the Office of Policy and Evaluation, the Office of the Environment, and the Office of the Secretary interviewed to explore issues and problems encountered with current CS regulatory practices; (4) the regulatory processes at five other Federal agencies reviewed in order to see how other agencies have approached the regulatory process, dealt with specific regulatory problems, and responded to the Executive Order; and (5) based on the results of the preceding four tasks, recommendations for potential solutions to the CS regulatory problems developed. Feed-in tariffs (FITs) are the most prevalent renewable energy policy used globally to date, and there are many benefits to the certainty offered in the marketplace to reduce development risks and associated financing costs and to grow the renewable energy industry. However, concerns over escalating costs in jurisdictions with FIT policies have led to increased attention on cost control in renewable energy policy design. In recent years, policy mechanisms for containing FIT costs have become more refined, allowing policymakers to exert greater control on policy outcomes and on the resulting costs to ratepayers. As policymakers and regulators in the United States begin to explore the use of FITs, careful consideration must be given to the ways in which policy design can be used to balance the policies' advantages while bounding its costs. This report explores mechanisms that policymakers have implemented to limit FIT policy costs. If designed clearly and transparently, such mechanisms can align policymaker and market expectations for project deployment. Three different policy tools are evaluated: (1) caps, (2) payment level adjustment mechanisms, and (3) auction-based designs. The report employs case studies to explore the strengths and weaknesses of these three cost containment tools. These tools are then evaluated with a set of criteria including predictability for policymakers and the marketplace and the potential for unintended consequences.

Investigation of an incident at an LPG storage facility in Texas by U.S. Department of Transportation resulted in recommendation that state regulation of natural gas cavern storage might be improved. Interstate Oil & Gas Compact Commission has established a subcommittee to analyze the benefits and risks associated with natural gas cavern storage, and to draft a regulation model which will suggest engineering and performance specifications. The resulting analysis and regulatory language will be reviewed by I.O.G.C.C., and if approved, distributed to member states (including New York) for consideration. Should the states desire assistance in modifying the language to reflect local variables, such as policy and geology, I.O.G.C.C. may offer assistance. The proposed presentation will review the I.O.G.C.C. product (if published at that date), and discuss implications of its application in New York.

A Framework for Comparative Assessments of Energy Efficiency Policy Measures

When policy makers propose new policies, there is a need to assess the costs and benefits of the proposed policy measures, to compare them to existing and alternative policies, and to rank them according to their effectiveness. In the case of equipment energy efficiency regulations, comparing the effects of a range of alternative policy measures requires evaluating their effects on consumers budgets, on national energy consumption and economics, and on the environment. Such an approach should be able to represent in a single framework the particularities of each policy measure and provide comparable results. This report presents an integrated methodological framework to assess prospectively the energy, economic, and environmental impacts of energy efficiency policy measures. The framework builds on the premise that the comparative assessment of energy efficiency policy measures should (a) rely on a common set of primary data and parameters, (b) follow a single functional approach to estimate the energy, economic, and emissions savings resulting from each assessed measure, and (c) present results through a set of comparable indicators. This framework elaborates on models that the U.S. Department of Energy (DOE) has used in support of its rulemakings on mandatory energy efficiency standards. In addition to a rigorous analysis of the impacts of mandatory standards, DOE compares the projected results of alternative policy measures to those projected to be achieved by the standards. The framework extends such an approach to provide a broad, generic methodology, with no geographic or sectoral limitations, that is useful for evaluating any type of equipment energy efficiency market intervention. The report concludes with a demonstration of how to use the framework to compare the impacts estimated for twelve policy measures focusing on increasing the energy efficiency of gas furnaces in the United States.

Because the futures market in petroleum products is a relatively recent phenomenon, the implications of public policies formulated for that market have not yet been fully explored. To provide the Office of Competition of the Department of Energy (DOE) with sufficient information to assess policy alternatives, Resource Planning Associates, Inc. (RPA) was asked to analyze the development of the futures market in No. 2 oil, assess the potential for futures markets in other petroleum products, and identify policy alternatives available to DOE. To perform this analysis, the criteria for a viable futures market was established first. Then, the experience to date with the 18-month-old futures market in No. 2 oil was examined, and the potential for viable futures markets in No. 6 oil, gasoline, jet fuel, and crude oil was assessed. Finally, how existing DOE regulations and prospective actions might affect petroleum futures market development was investigated.

We posit policy documents (bills, acts, regulations and directives) as forms of social objects and present a methodology to understand interactions between prior context in professional and personal social networks to a given public policy document release. We employ natural language processing tools along with recent advances in semantic reasoning to formulate document-level proximity metrics which we use to predict the relevance (and impact) of the policy artifacts. Implications of Carbon Regulation for Green Power Markets

This paper examines the potential effects that emerging mandatory carbon markets have for voluntary markets for renewable energy, or green power markets. In an era of carbon regulation, green power markets will continue to play an important role because many consumers may be interested in supporting renewable energy development beyond what is supported through mandates or other types of policy support. The paper examines the extent to which GHG benefits motivate consumers to make voluntary renewable energy purchases and summarizes key issues emerging as a result of these overlapping markets, such as the implications of carbon regulation for renewable energy marketing claims, the demand for and price of renewable energy certificates (RECs), and the use of RECs in multiple markets (disaggregation of attributes). It describes carbon regulation programs under development in the Northeast and California, and how these might affect renewable energy markets in these regions, as well as the potential interaction between voluntary renewable energy markets and voluntary carbon markets, such as the Chicago Climate Exchange (CCX). It also briefly summarizes the experience in the European Union, where carbon is already regulated. Finally, the paper presents policy options for policymakers and regulators to consider in designing carbon policies to enable carbon markets and voluntary renewable energy markets to work together.

This chapter briefly revisits the constraints and opportunities of mitigation and adaptation, and highlights and the multiple linkages, synergies and trade-offs between mitigation, adaptation and urban development. The chapter then presents future policy directions, focusing on local, national and international principles and policies for supporting and enhancing urban responses to climate change. In summary, policy directions for linking climate change responses with urban development offer abundant opportunities; but they call for new philosophies about how to think about the future and how to connect different roles of different levels of government and different parts of the urban community. In many cases, this implies changes in how urban areas operate - fostering closer coordination between local governments and local economic institutions, and building new connections between central power structures and parts of the population who have often been kept outside of the circle of consultation and discourse. The difficulties involved in changing deeply set patterns of interaction and decision-making in urban areas should not be underestimated. Because it is so difficult, successful experiences need to be identified, described and widely publicized as models for others. However, where this challenge is met, it is likely not only to increase opportunities and reduce threats to urban development in profoundly important ways, but to make the urban area a more effective socio-political entity, in general - a better city in how it works day to day and how it solves a myriad of problems as they emerge - far beyond climate change connections alone. It is in this sense that climate change responses can be catalysts for socially inclusive, economically productive and environmentally friendly urban development, helping to pioneer new patterns of stakeholder communication and participation.

This final report summarizes work carried out under agreement with the US Department of Energy, related to wind energy policy issues. This project has involved a combination of outreach and publications on wind energy, with a specific focus on educating state-level policymakers. Education of state policymakers is vitally important because state policy (in the form of incentives or regulation) is a crucial part of the success of wind energy. State policymakers wield a significant influence over all of these policies. They are also in need of high quality, non-biased educational resources which this project provided. This project provided outreach to legislatures, in the form of meetings designed specifically for state legislators and legislative staff, responses to information requests on wind energy, and publications. The publications addressed: renewable energy portfolio standards, wind energy transmission, wind energy siting, case studies of wind energy policy, avian issues, economic development, and other related issues. These publications were distributed to legislative energy committee members, and chairs, legislative staff, legislative libraries, and other related state officials. The effect of this effort has been to provide an extensive resource of information about wind information for state policymakers in a form that is useful to them. This non-partisan information has been used as state policymakers attempt to develop their own policy proposals related to wind energy in the states.

This report presents a discussion of directory-enabled policy-based networking with an emphasis on its role as the foundation for securely scalable enterprise networks. A directory service provides the object-oriented logical environment for interactive cyber-policy implementation. Cyber-policy implementation includes security, network management, operational process and quality of service policies. The leading network-technology vendors have invested in these technologies for secure universal connectivity that transverses Internet, extranet and intranet boundaries. Industry standards are established that provide the fundamental guidelines for directory deployment scalable to global networks. The integration of policy-based networking with directory-service technologies provides for intelligent management of the enterprise network environment as an end-to-end system of related clients, services and resources. This architecture allows logical policies to protect data, manage security and provision critical network services permitting a proactive defense-in-depth cyber-security posture. Enterprise networking imposes the consideration of supporting multiple computing platforms, sites and business-operation models. An industry-standards based approach combined with principled systems engineering in the deployment of these technologies allows these issues to be successfully addressed. This discussion is focused on a directory-based policy architecture for the heterogeneous enterprise network-computing environment and does not propose specific vendor solutions. This document is written to present practical design methodology and provide an understanding of the risks, complexities and most important, the benefits of directory-enabled policy-based networking.

This article is divided into five sections. The first section discusses the market and regulatory environment of bulk power sales. The second presents the legal framework for compacting and discusses the minimal constitutional barriers presented by the Compact Clause. The next section discusses the economic considerations inherent in attempting to regulate a national activity through regional authorities. The fourth section more fully develops the administrative and political problems that regional regulation must overcome to be successful. Using the legal, economic, and policy framework developed in the preceding sections, the final section analyzes the proposal encompassed in Senate Bill 2607, a proposal by the Arkansas Public Service Commission and Entergy Corporation to create regional organizations to provide integrated resource planning.

A decision support system (DSS) is being developed at the Radioactive Liquid Waste Treatment Facility, Los Alamos National Laboratory (LANL). The DSS will be used to evaluate alternatives for improving LANL`s existing central radioactive waste water treatment plant and to evaluate new site-wide liquid waste treatment schemes that are required in order to handle the diverse waste streams produced at LANL. The decision support system consists of interacting modules that perform the following tasks: rigorous process simulation, configuration management, performance analysis, cost analysis, risk analysis, environmental impact assessment, transportation modeling, and local, state, and federal regulation compliance checking. Uncertainty handling techniques are used with these modules and also with a decision synthesis module which combines results from the modules listed above. We believe the DSS being developed can be applied to almost any other industrial water treatment facility with little modification because in most situations the waste streams are less complex, fewer regulations apply, and the political environment is simpler. The techniques being developed are also generally applicable to policy and planning decision support systems in the chemical process industry.

He addresses the need for economically sound choices for future energy needs, which is complicated by what he refers to as 'the elephant in the room'climate change. This report examines the past twenty years of energy market events and energy policies to determine what may be useful for the future. The author focuses on two important lessons that should have been learned but which the author feels have been seriously misunderstood. The first is that oil price shocks were a very big and very real problem for oil importing countries, a problem the has not gone away. The second is that automobile fuel economy regulation has worked and worked effectively to reduce oil consumption and the externalities associated with it, and can still work effectively in the future.
