    Export of commodities, encouraged by both the private sector and the Federal Government, helps to improve our position in the global economy and is in the national interest of the US. However, exports of commodities or technologies, without regard to whether they may significantly contribute to the military potential of individual countries or combination of countries or enhance the proliferation of weapons of mass destruction, may adversely affect the national security of the US. The Federal Government, therefore, implements several laws, Executive Orders, and regulations to control the export of certain commodities and technologies. These commodities and technologies require a license for export. Some of the controlled items are designated as ''dual-use,'' that is, commodities and technologies that have both civilian and military application. Some dual-use commodities are designated as ''nuclear dual-use''--items controlled for nuclear nonproliferation purposes. Another group of controlled commodities is designated as munitions, which are goods and technologies that have solely military uses. The Department of Energy (Energy) conducts reviews of export license applications for nuclear dual-use items and certain munitions. On August 26, 1998, the Chairman of the Senate Committee on Governmental Affairs requested that the Inspectors General from the Departments of Commerce, Defense, Energy, State, and Treasury, and the Central Intelligence Agency (CIA), update and expand on a 1993 interagency review conducted by the Inspectors General of the Departments of Commerce, Defense, Energy, and State of the export licensing processes for dual-use and munitions commodities.

    This report summarizes the results of a joint project on renewable energy of the National Association of Regulatory Utility Commissioners (NARUC) and the US DOE. NARUC'S Task Force on Renewable Energy conducted a review of the current state of renewable energy technologies to evaluate their potential and extract key policy lessons from experience already gained in deployment of these technologies in numerous states. The main focus of this effort has been to clarify how utility regulators affect the development of renewable energy resources. The goal of the project was twofold: (1) identify the factors that have led to success or failure or renewable energy technologies in various energy markets, and (2) to develop an agenda on renewable energy and utility regulation for NARUC and the DOE. This report consists of three sections: renewable energy contributions, costs and potential; factors affecting development of renewable energy resources; and a renewable energy agenda for NARUC.

    The purpose of our inspection was to review the Department of Energy`s (Energy) export licensing process for dual-use and military (munitions) commodities subject to nuclear nonproliferation controls. Specifically, we reviewed Energy`s authorities, procedures, and policies pertaining to the export licensing process and examined procedures for safeguarding data transmitted between Energy and other agencies involved in the export licensing process. We also reviewed Energy`s role as a member of the Subgroup on Nuclear Export Coordination. Our review of the sample of 60 export cases did not find evidence to lead us to believe that Energy`s recommendations for these cases were inappropriate or incorrect. We identified, however, problems regarding management systems associated with the export license review process. We found that without documentation supporting export licensing decisions by the Export Control Operations Division (ECOD), we could not determine whether ECOD analysts considered all required criteria in their review of export cases referred to Energy. For example, we found that the ECOD did not retain records documenting the bases for its advice, recommendations, or decisions regarding its reviews of export license cases or revisions to lists of controlled commodities and, therefore, was not in compliance with certain provisions of the Export Administration Act, as amended, and Energy records management directives. Additionally, we found that the degree of compliance by Energy with the export licensing review criteria contained in the Export Administration Regulations and the Nuclear Non-Proliferation Act of 1978 could not be determined because ECOD did not retain records documenting the bases for its advice and recommendations on export cases.

    A sample of 893 Oregon individuals from a Western Regional Agricultural Experiment Station Project (W-159 Consequences of Energy Conservation Policies for Western Region Households) was used to analyze consumer attitudes toward potentially restrictive energy conservation regulations. Belief in the seriousness of the energy problem, a psychological measure of internal control (internality), and eight socio-demographic characteristics were examined in relation to consumer attitudes toward these regulations. Those who did not believe in the seriousness of the energy problem were over 50 years of age, male, had less than a college degree, and opposed mandatory energy conservation regulations related to home thermostat settings. Homeowners opposed the regulation requiring their homes to pass an energy audit. Opposition to regulations appeared to be related only to an individual's perception of the consequences of the regulation, and not to belief in the enregy problem or locus of control. Those with low internality scores included females, rural residents, respondents over 50, and those with less than a college degree.

    This paper proposes a control method to regulate voltages in 3 phase unbalanced electrical distribution systems. A constrained optimization problem to minimize voltage deviations and maximize distributed energy resource (DER) active power output is solved by harmony search algorithm. IEEE 13 Bus Distribution Test System was modified to test three different cases: a) only voltage regulator controlled system b) only DER controlled system and c) both voltage regulator and DER controlled system. The simulation results show that systems with both voltage regulators and DER control provide better voltage profile.

    This paper seeks to briefly characterize the evolving role of power sector regulation. Given current global dynamics, regulation of the power sector is undergoing dramatic changes. This transformation is being driven by various factors including technological advances and cost reductions in renewable energy, energy efficiency, and demand management; increasing air pollution and climate change concerns; and persistent pressure for ensuring sustainable economic development and increased access to energy services by the poor. These issues add to the already complex task of power sector regulation, of which the fundamental remit remains to objectively and transparently ensure least-cost service delivery at high quality. While no single regulatory task is trivial to undertake, it is the prioritization and harmonization of a multitude of objectives that exemplifies the essential challenge of power sector regulation. Evolving regulatory roles can be understood through the concept of existing objectives and an additional layer of emerging objectives. Following this categorization, we describe seven existing objectives of power sector regulators and nine emerging objectives, highlighting key challenges and outlining interdependencies. This essay serves as a preliminary installment in the Clean Energy Regulatory Initiative (CERI) series, and aims to lay the groundwork for subsequent reports and case studies that will explore these topics in more depth.

    We are developing a full software system for accelerating semantic graph databases on commodity cluster that scales to hundreds of nodes while maintaining constant query throughput. Our framework comprises a SPARQL to C++ compiler, a library of parallel graph methods and a custom multithreaded runtime layer, which provides a Partitioned Global Address Space (PGAS) programming model with fork/join parallelism and automatic load balancing over a commodity clusters. We present preliminary results for the compiler and for the runtime.

    The authority to regulate public utilities is vested generally in the Louisiana Public Service Commission, composed of five members elected by the general electorate and elected for six-year terms. The Commission is charged with regulating all public utilities and has such other regulatory authority as provided by law. The Commission, however, has no power to regulate a public utility owned, operated, or regulated on the effective data of this constitution (1921) by the governing authority of one or more political subdivisions unless the Commission is authorized to regulate these utilities by the electorate of the political subdivision involved. An additional statutory provision excludes all municipally-owned public utilities from Commission regulation. New Orleans has retained the regulatory authority which it held as of the effective date of the Louisiana Constitution. Therefore, the Commission exercises no regulatory powers over investor or municipally-owned utilities in New Orleans. A municipality is empowered to own and operate a revenue-producing public utility within or without its boundaries and it may sell and distribute the commodity or service of the public utility within or without its corporate limits and may establish rates, rules, and regulations with respect to the sale and distribution. Public utility regulatory statutes, energy facility siting programs, and municipal franchising authority are examined to identify how they may impact on the ability of an organization, whether or not it be a regulated utility, to construct and operate an ICES.

    Power transfer rate at a charging facility can be maximized by employing a feedback scheme. The state of charge (SOC) and temperature of the regenerative energy storage system (RESS) pack of a vehicle is monitored to determine the load due to the RESS pack. An optimal frequency that cancels the imaginary component of the input impedance for the output signal from a grid converter is calculated from the load of the RESS pack, and a frequency offset f* is made to the nominal frequency f.sub.0 of the grid converter output based on the resonance frequency of a magnetically coupled circuit. The optimal frequency can maximize the efficiency of the power transfer. Further, an optimal grid converter duty ratio d* can be derived from the charge rate of the RESS pack. The grid converter duty ratio d* regulates wireless power transfer (WPT) power level.

    The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. The pertinent categories of state and local regulations and programs are explained, then detailed analysis is conducted on the covered products and regulations. Issues relating to the timing of preemption of state regulations are discussed, as well as issues relating to burden of proof, contents of petitions for exemptions from preemption, criteria for evaluating petitions, and procedural and other issues.     Energy produced by intermittent renewable resources is sharply increasing in the United States. At high penetration levels, volatility of wind power production could cause additional problems for the power system balancing functions such as regulation. This paper reports some partial results of a project work, recently conducted by the Pacific Northwest National Laboratory (PNNL) for Bonneville Power Administration (BPA). The project proposes to mitigate additional intermittency with the help of Wide Area Energy Management System (WAEMS) that would provide a two-way simultaneous regulation service for the BPA and California ISO systems by using a large energy storage facility. The paper evaluates several utility-scale energy storage technology options for their usage as regulation resources. The regulation service requires a participating resource to quickly vary its power output following the rapidly and frequently changing regulation signal. Several energy storage options have been analyzed based on thirteen selection criteria. The evaluation process resulted in the selection of flywheels, pumped hydro electric power (or conventional hydro electric power) plant and sodium sulfur or nickel cadmium batteries as candidate technologies for the WAEMS project. A cost benefit analysis should be conducted to narrow the choice to one technology.

    Major environmental issues that are likely to affect the implementation of energy technologies between now and the year 2000 are identified and assessed. The energy technologies specifically addressed are: oil recovery and processing; gas recovery and processing; coal liquefaction; coal gasification (surface); in situ coal gasification; direct coal combustion; advanced power systems; magnetohydrodynamics; surface oil shale retorting; true and modified in situ oil shale retorting; geothermal energy; biomass energy conversion; and nuclear power (fission). Environmental analyses of these technologies included, in addition to the main processing steps, the complete fuel cycle from resource extraction to end use. A comprehensive survey of the environmental community (including environmental groups, researchers, and regulatory agencies) was carried out in parallel with an analysis of the technologies to identify important future environmental issues. Each of the final 20 issues selected by the project staff has the following common attributes: consensus of the environmental community that the issue is important; it is a likely candidate for future regulatory action; it deals with a major environmental aspect of energy development. The analyses of the 20 major issues address their environmental problem areas, current regulatory status, and the impact of future regulations. These analyses are followed by a quantitative assessment of the impact on energy costs and nationwide pollutant emissions of possible future regulations. This is accomplished by employing the Strategic Environmental Assessment System (SEAS) for a subset of the 20 major issues. The report concludes with a more general discussion of the impact of environmental regulatory action on energy development.

    This Exploratory LDRD aimed to develop molecular breeding methodology for biofuel algal strain improvement for applications in waste to energy / commodity conversion technologies. Genome shuffling technologies, specifically protoplast fusion, are readily available for the rapid production of genetic hybrids for trait improvement and have been used successfully in bacteria, yeast, plants and animals. However, genome fusion has not been developed for exploiting the remarkable untapped potential of eukaryotic microalgae for large scale integrated bio-conversion and upgrading of waste components to valued commodities, fuel and energy. The proposed molecular breeding technology is effectively sexual reproduction in algae; though compared to traditional breeding, the molecular route is rapid, high-throughput and permits selection / improvement of complex traits which cannot be accomplished by traditional genetics. Genome fusion technologies are the cutting edge of applied biotechnology. The goals of this Exploratory LDRD were to 1) establish reliable methodology for protoplast production among diverse microalgal strains, and 2) demonstrate genome fusion for hybrid strain production using a single gene encoded trait as a proof of the concept.

    The US DOE Protocol for uniformly measuring and expressing the performance of energy storage systems, first developed in 2012 through inclusive working group activities, provides standardized methodologies for evaluating an energy storage system’s ability to supply specific services to electrical grids. This article elaborates on the data and decisions behind the duty-cycle used for frequency regulation in this protocol. Analysis of a year of publicly available frequency regulation control signal data from a utility was considered in developing the representative signal for this use case. Moreover, this showed that signal standard deviation can be used as a metric for aggressivenessmore » or rigor. From these data, we select representative 2 h long signals that exhibit nearly all of dynamics of actual usage under two distinct regimens, one for average use and the other for highly aggressive use. Our results were combined into a 24-h duty-cycle comprised of average and aggressive segments. The benefits and drawbacks of the selected duty-cycle are discussed along with its potential implications to the energy storage industry.« less

    High performance computing has experienced tremendous gains in system performance over the past 20 years. Unfortunately other system capabilities, such as file I/O, have not grown commensurately. In this activity, we present the results of our tests of two leading file systems (GPFS and Lustre) on the same physical hardware. This hardware is the standard commodity storage solution in use at LLNL and, while much smaller in size, is intended to enable us to learn about differences between the two systems in terms of performance, ease of use and resilience. This work represents the first hardware consistent study of the two leading file systems that the authors are aware of.

    Objectives of the workshop were: to review and evaluate the state-of-the-art of environmental impact assessments as applied to the regulation of applications of nuclear energy and related ancillary systems; to identify areas where existing technology allows establishing acceptable methods or standard practices that will meet the requirements of the NRC regulations, standards and guides for both normal operations and off-standard conditions including accident considerations; to illuminate topics where existing models or analytical methods are deficient because of unverified assumptions, a paucity of empirical data, conflicting results reported in the literature or a need for observation of operation systems; to compile, analyze and synthesize a prioritized set of research needs to advance the state-of-the-art to the level which will meet all of the requirements of the Commission's regulations, standards and guides; and to develop bases for maintaining the core of regulatory guidance at the optimum level balancing technical capabilities with practical considerations of cost and value to the regulatory process. The discussion held in small group sessions on aquatic, atmospheric, and terrestrial pathways are presented. The following research needs were identified as common to all three groups: validation of models; characterization of source terms; development of screening techniques; basis for de minimis levels of contamination; and updating of objectives for environmental monitoring programs.

  15. Survey of Alternative Feedstocks for Commodity Chemical Manufacturing

    The current high prices for petroleum and natural gas have spurred the chemical industry to examine alternative feedstocks for the production of commodity chemicals. High feedstock prices have driven methanol and ammonia production offshore. The U.S. Chemical Industry is the largest user of natural gas in the country. Over the last 30 years, alternatives to conventional petroleum and natural gas feedstocks have been developed, but have limited, if any, commercial implementation in the United States. Alternative feedstocks under consideration include coal from unconventional processing technologies, such as gasification and liquefaction, novel resources such as biomass, stranded natural gas from unconventional reserves, and heavy oil from tar sands or oil shale. These feedstock sources have been evaluated with respect to the feasibility and readiness for production of the highest volume commodity chemicals in the United States. Sources of organic compounds, such as ethanol from sugar fermentation and bitumen-derived heavy crude are now being primarily exploited for fuels, rather than for chemical feedstocks. Overall, government-sponsored research into the use of alternatives to petroleum feedstocks focuses on use for power and transportation fuels rather than for chemical feedstocks. Research is needed to reduce cost and technical risk. Use of alternative feedstocks is more common outside the United States R&D efforts are needed to make these processes more efficient and less risky before becoming more common domestically. The status of alternative feedstock technology is summarized.

  16. Efficient Execution of Recursive Programs on Commodity Vector Hardware

    The pursuit of computational efficiency has led to the proliferation of throughput-oriented hardware, from GPUs to increasingly-wide vector units on commodity processors and accelerators. This hardware is designed to efficiently execute data-parallel computations in a vectorized manner. However, many algorithms are more naturally expressed as divide-and-conquer, recursive, task-parallel computations; in the absence of data parallelism, it seems that such algorithms are not well-suited to throughput-oriented architectures. This paper presents a set of novel code transformations that expose the data-parallelism latent in recursive, task-parallel programs. These transformations facilitate straightforward vectorization of task-parallel programs on commodity hardware. We also present scheduling policies that maintain high utilization of vector resources while limiting space usage. Across several task-parallel benchmarks, we demonstrate both efficient vector resource utilization and substantial speedup on chips using Intel's SSE4.2 vector units as well as accelerators using Intel's AVX512 units.

  1. A Review on Biomass Densification Systems to Develop Uniform Feedstock Commodities for Bioenergy Application

    Developing uniformly formatted, densified feedstock from lignocellulosic biomass is of interest to achieve consistent physical properties like size and shape, bulk and unit density, and durability, which significantly influence storage, transportation and handling characteristics, and, by extension, feedstock cost and quality. A variety of densification systems are considered for producing a uniform format feedstock commodity for bioenergy applications, including (a) baler, (b) pellet mill, (c) cuber, (d) screw extruder, (e) briquette press, (f) roller press, (g) tablet press, and (g) agglomerator. Each of these systems has varying impacts on feedstock chemical and physical properties, and energy consumption. This review discusses the suitability of these densification systems for biomass feedstocks and the impact these systems have on specific energy consumption and end product quality. For example, a briquette press is more flexible in terms of feedstock variables where higher moisture content and larger particles are acceptable for making good quality briquettes; or among different densification systems, a screw press consumes the most energy because it not only compresses but also shears and mixes the material. Pretreatment options like preheating, grinding, steam explosion, torrefaction, and ammonia fiber explosion (AFEX) can also help to reduce specific energy consumption during densification and improve binding characteristics. Binding behavior can also be improved by adding natural binders, such as proteins, or commercial binders, such as lignosulphonates. The quality of the densified biomass for both domestic and international markets is evaluated using PFI (United States Standard) or CEN (European Standard).

    Simply stated, a price squeeze occurs when a firm with monopoly power on the primary, or wholesale, level engages in a prolonged price increase that drives competitors out of the secondary, or retail level, and thereby extends its monopoly power to the secondary market. A price squeeze will not be found, however, for any short-term exercise in market power. Rather, because anticompetitive effects of a price squeeze are indirect, the price squeeze must last long enough and be severe enough to produce effects on actual or potential competition in the secondary market. In regulated electric industries, a price squeeze claim usually arises from the complex relationship between the supplier, the wholesale customer, the retail customer, and the federal and state regulators. The supplier sells electric power to both wholesale and retail customers. Wholesale transactions are regulated by federal regulators, and retail transactions are regulated at the state level. The wholesale customers in turn sell power to their retail customers. Over the last several years, there have been substantial developments in the application of the price squeeze doctrine to fully-regulated electric utilities. This article will examine the current developments in this area, and attempt to highlight the burdens potential litigants, both plaintiffs and defendants, must overcome to succeed.

    This report is the second in a series of three reports describing the potential of GE’s DR-enabled appliances to provide benefits to the utility grid. The first report described the modeling methodology used to represent the GE appliances in the GridLAB-D simulation environment and the estimated potential for peak demand reduction at various deployment levels. The third report will explore the technical capability of aggregated group actions to positively impact grid stability, including frequency and voltage regulation and spinning reserves, and the impacts on distribution feeder voltage regulation, including mitigation of fluctuations caused by high penetration of photovoltaic distributed generation. In this report, a series of analytical methods were presented to estimate the potential cost benefit of smart appliances while utilizing demand response. Previous work estimated the potential technical benefit (i.e., peak reduction) of smart appliances, while this report focuses on the monetary value of that participation. The effects on wholesale energy cost and possible additional revenue available by participating in frequency regulation and spinning reserve markets were explored.

For a given fuel/transportation technology combination, GREET 1.5 calculates (1) the fuel-cycle consumption of total energy (all energy sources), fossil fuels (petroleum, natural gas, and coal), and petroleum; (2) the fuel-cycle emissions of GHGs -- primarily carbon dioxide (CO2), methane (CH4), and nitrous oxide (N20); and (3) the fuel-cycle emissions of five criteria pollutants: volatile organic compounds (VOCs), carbon monoxide (C0), nitrogen oxides (N0x), sulfur oxides (S0x), and particulate matter with a diameter measuring 10 micrometers or less (PM10).     With the large use of residential air conditioner (A/C) motors during the summer peaks, the potential of motor stalling events have increased in the recent years. The stalled motor loads have been found to be the most important cause of delayed voltage recovery following severe system disturbances, such as a subtransmission fault. The proper modeling of the stalled motors is a very important factor in identifying the effect of these motors in voltage recovery after the fault. This paper presents a methodology for modeling the stalled low inertia induction motors based on a sample utility system and a small primary distribution circuit. The prevention of the stalling of motors plays an important role in maintaining the voltage profile of the system after system disturbances. Distributed Energy Resource (DER) is used to prevent the motor stalling events so that the delayed voltage recovery of the system may be avoided.

    The 1993 Commodity Flow Survey (CFS) collected shipment data from a sample of approximately 200,000 domestic business establishments. Each selected establishment provided information on origin, destination, commodity, shipment weight and value, and modes of transport for a sample of its outbound shipments. One data item not reported by CFS participants was shipment distance. This important piece of information was estimated by simulating probable routes using computer models of the highway, rail, air, waterway, and pipeline networks and their interconnections. This paper describes the nature of the shipment distance estimation problem, the procedures used to estimate mode-specific distances between origin and destination ZIP codes, and the techniques used to validate the results.

The NTACS was conducted by the US Bureau of the Census for the US Department of Transportation (DOT).     The Massachusetts Institute of Technology (MIT) and Siemens Corporations (SCR) are developing new chemical synthesis processes for commodity chemicals from CO2. The process is assessed as a novel chemical sequestration technology that utilizes CO2 from dilute gas streams generated at industrial carbon emitters as a raw material to produce useful commodity chemicals. Work at Massachusetts Institute of Technology (MIT) commenced on October 1st, 2010, and finished on September 30th, 2013. During this period, we have investigated and accomplished five objectives that mainly focused on converting CO2 into high-value chemicals: 1) Electrochemical assessment of catalytic transformation of CO2 and epoxides to cyclic carbonates; 2) Investigation of organocatalytic routes to convert CO2 and epoxide to cyclic carbonates; 3) Investigation of CO2 Capture and conversion using simple olefins under continuous flow; 4) Microwave assisted synthesis of cyclic carbonates from olefins using sodium bicarbonates in a green pathway; 5) Life cycle analyses of integrated chemical sequestration process. In this final report, we will describe the detailed study performed during the three year period and findings and conclusions drawn from our research.

    The South Dakota Public Utilities Commission is authorized by statute to regulate gas and electric utilities. The Commission consists of three elected commissioners each of whom serves for a six year term. The Commissioners are elected by district and each must, at the time of election, be a resident of the district from which he has been elected. Each Commissioner must reside in the state capital and devote his entire time to the duties of his office. The Commission is part of the Department of Commerce and Consumer Protection. Municipal power to regulate privately owned electric and gas public utilities was terminated in 1975. A municipally-owned electric utility has the authority to regulate the sale, use, and rates of electric power and energy which it provides.     As part of the Spreader Bar Radiation Detector project, PNNL analyzed US import data shipped through US ports collected over the 12 months of 2006 (over 4.5 million containers). Using these data, we extracted a variety of distributions that are of interest to modelers and developers of active and passive detection systems used to 'scan' IMCCs for potential contraband. This report expands on some of the analysis presented in an earlier report from LLNL, by investigation the foreign port distribution of commodities shipped to the US. The majority of containers shipped to the United States are 40 ft containers ({approx}70%); about 25% are 20 ft; and about 3.6% are 45 ft containers. A small fraction (<1%) of containers are of other more specialized sizes, and very few ports actually ship these unique size containers (a full distribution for all foreign ports is shown in Appendix A below). The primary foreign ports that ship the largest fraction of each container are shown in the table below. Given that 45 ft containers comprise 1 of out every 27 containers shipped to the US, and given the foreign ports from which they are shipped, they should not be ignored in screening; further testing and analysis of radiation measurements for national security with this size container is warranted. While a large amount of NORM is shipped in IMCCs, only a few specific commodities are shipped with enough frequency to present potential issues in screening IMCCs at ports. The majority of containers with NORM will contain fertilizers (5,700 containers), granite (59,000 containers), or ceramic (225,000 containers) materials. Fertilizers were generally shipping in either 20- or 40 ft containers with equal frequency. While granite is mostly shipped in 20 ft containers, ceramic materials can be shipped in either 20- or 40 ft containers.     Until April 1, 1979, the Public Service Commission had been vested with exclusive jurisdiction over the regulation of rates and service of utilities. As of that date two new agencies, the Energy Regulatory Commission (ERC) and the Utility Regulatory Commission (URC), have replaced the Public Service Commission. The ERC consists of three full-time members appointed by the governor for four year terms and is responsible for enforcing the provisions of the Kentucky statutes relating to electric and gas utilities. The three-member URC is responsible for enforcing the provisions relating to non-energy utilities such as telephone, sewer, and water utilities. The statutes vest all regulatory authority over public utilities in either the ERC or the URC. Local governments retain only the power to grant local franchises. However, it should be noted, that any utility owned or operated by a political subdivision of the state is exempt from regulation. Thus, local government has complete authority over utilities which are self-owned.     The Idaho state legislature has created the Idaho Public Utilities Commission and has given the Commission the power and jurisdiction to supervise and regulate every public utility in the state. The Commission is comprised of three members appointed by the governor with the approval of the senate. Commissioners serve full time and are appointed for six year terms. No more than two of the members may be from the same political party. Title 61 of the Idaho Code, which establishes the Commission and delineates its powers, vests all regulatory responsibility in the Commission to the exclusion of local government. However, as an incident to their franchising power, municipalities may impose reasonable regulations on the use of their streets. The Idaho Supreme Court holds that the transfer of regulatory power over public utilities to the Commission did not diminish the powers and duties of municipalities to control and maintain their streets and alleys. Limited statutory authority also exists giving municipalities the power to regulate the fares, rates, rentals, or charges made for the service rendered under any franchise granted in such city, except such as are subject to regulation by the Public Utilities Commission. With the exception of this limited power, the Commission is the sole agency having regulatory power over Idaho public utilities.     The authority to regulate public utilities in Texas is generally vested in the Public Utilities Commission. The Commission is comprised of three members appointed by the governor, with the advice of at least two-thirds of the senate, for a six-year term. Prior to the passage of the Texas Public Utility Regulatory Act (PURA) in 1975, the power to regulate public utilities was vested almost exclusively in municipalities. Under PURA, municipalities retain exclusive original jurisdiction over all electric, water, and sewer utilities within the municipality. PURA provides that all regulations pertaining to public utilities promulgated by local regulatory agencies remain in effect unless they are superceded by Commission rules. The municipality's governing body is required to exercise its regulatory authority under rules and standards consistent with those promulgated by the Commission. The Commission has exclusive appellate jurisdiction to review orders and ordinances of regulatory municipalities.     Following the issuance of Title 10 Code of Federal Regulations Part 835 (10 CFR 835), {open_quotes}Occupational Radiation Protection,{close_quotes} in the Federal Register on 14 December 1993, all DOE facilities subject to the rule provisions were required to submit a radiation protection program that Sets forth the plans, schedules, and other measures for achieving compliance with the rule by 1 January 1996. Numerous DOE facilities identified areas of the rule where their facility needed either (1) a clarification of the intent and expectation of a provisions or (2) an exemption from the provisions. In response, the DOE Office of Worker Protection Programs and Hazards Management (EH-52) prepared and disseminated eight Radiological Control Technical Positions (RCTPs). These RCTPs provided clarifications of DOE`s intent and expectations for compliance with specific provisions of the rule. EH-52 also processed requests for exemptions from provisions of 10 CFR 835 received from twelve different DOE facilities. The DOE issued 21 separate responses to these facilities, each one addressing the specific exepemtion request. Each response contained (1) an Exemption Decision and (2) a Technical Position discussing the basis for either denying or granting with conditions, as applicable, the exemption request.

    Under the Public Utilities Act of 1965, utilities in North Carolina are regulated by the State's Utility Commission. The Commission consists of seven members who are appointed by the governor, subject to confirmation by the General Assembly sitting in joint session. The Commissioners serve eight year terms and the governor designates one of the commissioners as chairman. The Commission has an office of the executive director, who is appointed to a six year term by the governor subject to confirmaion by the General Assembly. The executive director heads the Commission's public staff. The public staff's duties include reviewing, investigating, and making recommendations on utility rates and services and intervention on behalf of the public in proceedings affecting consumer rates and generating plant certification. The Commission has the same power to regulate the operation of privately-owned public utilities within municipalities as it has to control those ouside. The only power over privately-owned utilities reserved to the municipalities is the power to grant franchises. A municipality may maintain its own utility systems, and such systems are not subject to the control and jurisdiction of the Commission. A diode in the positive line provides a constant voltage drop from the input to a regulating transistor emitter. An amplifier is coupled to the positive line through a resistor and is connected between a difference circuit and the regulating transistor base which is negative due to the difference in voltage drop across thc diode and the resistor so that a change in the regulator output causes the amplifier to increase or decrease the base voltage and current and incrcase or decrease the transistor impedance to return the regulator output to normal.   3. The great ``retail wheeling`` illusion, and more productive energy futures

    This paper sets out the reasons why many environmental and public interest organizations oppose retail wheeling. Cavanagh argues that retail wheeling would destroy incentives for energy efficiency improvements and renewable energy generation--benefits that reduce long-term energy service costs to society as a whole. The current debate over the competitive restructuring of the electric power industry is critical from both economic and environmental perspectives. All attempts to introduce broad-scale retail wheeling in the United States have failed; instead, state regulators are choosing a path that emphasizes competition and choice, but acknowledges fundamental differences between wholesale and retail markets. Given the physical laws governing the movement of power over centrally controlled grids, the choice offered to customers through retail wheeling of electricity is a fiction -- a re-allocation of costs is all that is really possible. Everyone wants to be able to claim the cheapest electricity on the system; unfortunately, there is not enough to go around. By endorsing the fiction of retail wheeling for certain types of customers, regulators would be recasting the retail electricity business as a kind of commodity exchange. That would reward suppliers who could minimize near-term unit costs of electricity while simultaneously destroying incentives for many investments, including cost-effective energy efficiency improvements and renewable energy generation, that reduce long-term energy service costs to society as a whole. This result, which has been analogized unpersuasively to trends in telecommunications and natural gas regulation, is neither desirable nor inevitable. States should go on saying no to retail wheeling in order to be able to create something better: regulatory reforms that align utility and societal interests in pursuing a least-cost energy future. An appendix contains notes on some recent Retail Wheeling Campaigns.

    The Constitution of the State of California grants to the Legislature control over persons and private corporations that own or operate a line, plant, or system for the production, generation, or transmission of heat, light, water, or power to be furnished either directly or indirectly to or for the public. The Constitution establishes the Public Utilities Commission and grants certain specific powers to the PUC, including the power to fix rates, establish rules and prescribe a uniform system of accounts. The Constitution also recognizes that the Legislature has plenary power to confer additional authority and jurisdiction upon the PUC. The Constitution prohibits regulation by a city, county, or other municipal body of matters over which the Legislature has granted regulatory power to the PUC.     Renewable energy certificates (RECs) are tradable instruments that convey the attributes of a renewable energy generator and the right to make certain claims about energy purchases. RECs first appeared in US markets in the late 1990s and are particularly important in states that accept or require them as evidence of compliance with renewables portfolio standards (RPS). The emergence of RECs as a tradable commodity has made utilities, generators, and regulators increasingly aware of the need to specify who owns the RECs in energy transactions. In voluntary transactions, most agree that the question of REC ownership can and should be negotiated privately between the buyer and the seller, and should be clearly established by contract. Claims about purchasing or using renewable energy should only be made if REC ownership can be documented. In many other cases, however, renewable energy transactions are either mandated or encouraged through state or federal policy. Because of the recent appearance of RECs, legislation and regulation mandating the purchase of renewable energy has sometimes been silent on the disposition of the RECs associated with that generation. Furthermore, some renewable energy contracts pre-date the existence of RECs, and therefore do not address REC ownership. In both of these instances, the issue of REC ownership must often be answered by legislative or regulatory authorities. The resulting uncertainty in REC ownership has hindered the development of robust REC markets and has, in some cases, led to contention between buyers and sellers of renewable generation. This article, which is based on a longer Berkeley Lab report, reviews federal and state efforts to clarify the ownership of RECs from Qualifying Facilities (QFs) that sell their generation under the Public Utility Regulatory Policies Act (PURPA) of 1978.
