  2. Public Utility Commission in the year 2000

    SciTech Connect (OSTI)

    Jones, D.N.

    1995-12-31

This article is about What is and What ought to be as we look to the institution of public utility commission regulation at the turn of the century. To signal my own view at the outset, I find the prospects somewhat worrisome in light of the nature and direction of much of the response to real and imaginary changes in the regulated sectors. I surely do not call for standing in place, but I strongly believe we should leave the place standing. The following items are discernable trends that will shape the PUC at the turn-of-the century: (1) dichotomy of customers into core and noncore groups, (2) unbundling and new service offerings with a menu of prices, (3) relaxed regulation and increased reliance on market solutions instead of command and control, (4) increased use of market-based pricing and incentive ratemaking, (5) large users seeking lowest-cost generation and supply services, (6) shift from old regulatory bargains regarding exclusive territorial franchises and assured recovery of costs and investments, (7) utility diversification, (8) increasing business risk for utilities, amd (9) uncertainty as to continued utility attention to social goals and a changing obligation to serve. For each of these, the author focuses on: (1) changing missions and roles of the PUC, (2) the strategies for achieving them, and (3) the implementation requirements that operationalize the strategies.

  5. The Oregon Geothermal Planning Conference

    SciTech Connect (OSTI)

    1980-10-02

Oregon's geothermal resources represent a large portion of the nation's total geothermal potential. The State's resources are substantial in size, widespread in location, and presently in various stages of discovery and utilization. The exploration for, and development of, geothermal is presently dependent upon a mixture of engineering, economic, environmental, and legal factors. In response to the State's significant geothermal energy potential, and the emerging impediments and incentives for its development, the State of Oregon has begun a planning program intended to accelerate the environmentally prudent utilization of geothermal, while conserving the resource's long-term productivity. The program, which is based upon preliminary work performed by the Oregon Institute of Technology's Geo-Heat Center, will be managed by the Oregon Department of Energy, with the assistance of the Departments of Economic Development, Geology and Mineral Industries, and Water Resources. Funding support for the program is being provided by the US Department of Energy. The first six-month phase of the program, beginning in July 1980, will include the following five primary tasks: (1) coordination of state and local agency projects and information, in order to keep geothermal personnel abreast of the rapidly expanding resource literature, resource discoveries, technological advances, and each agency's projects. (2) Analysis of resource commercialization impediments and recommendations of incentives for accelerating resource utilization. (3) Compilation and dissemination of Oregon geothermal information, in order to create public and potential user awareness, and to publicize technical assistance programs and financial incentives. (4) Resource planning assistance for local governments in order to create local expertise and action; including a statewide workshop for local officials, and the formulation of two specific community resource development plans. (5) Formulation and

  10. Feasibility study: utilization of landfill gas for a vehicle fuel system, Rossman's landfill, Clackamas County, Oregon

    SciTech Connect (OSTI)

    1981-01-01

In 1978, a landfill operator in Oregon became interested in the technical and economic feasibility of recovering the methane generated in the landfill for the refueling of vehicles. DOE awarded a grant for a site-specific feasibility study of this concept. This study investigated the expected methane yield and the development of a conceptual gas-gathering system; gas processing, compressing, and storage systems; and methane-fueled vehicle systems. Cost estimates were made for each area of study. The results of the study are presented. Reasoning that gasoline prices will continue to rise and that approximately 18,000 vehicles in the US have been converted to operate on methane, a project is proposed to use this landfill as a demonstration site to produce and process methane and to fuel a fleet (50 to 400) vehicles with the gas produced in order to obtain performance and economic data on the systems used from gas collection through vehicle operation. The 1992 edition of the Financial Statistics of Major US Publicly Owned Electric Utilities publication presents 4 years (1989 through 1992) of summary financial data and current year detailed financial data on the major publicly owned electric utilities. The objective of the publication is to provide Federal and State governments, industry, and the general public with current and historical data that can be used for policymaking and decisionmaking purposes related to publicly owned electric utility issues. Generator and nongenerator summaries are presented in this publication. Four years of summary financial data are provided. Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, and operating revenue, and electric energy account data. The primary source of publicly owned financial data is the Form EIA-412, {open_quotes}Annual Report of Public Electric Utilities.{close_quotes} Public electric utilities file this survey on a fiscal year, rather than a calendar year basis, in conformance with their recordkeeping practices. In previous editions of this publication, data were aggregated by the two most commonly reported fiscal years, June 30 and December 31. This omitted approximately 20 percent of the respondents who operate on fiscal years ending in other months. Accordingly, the EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents.

Under certain circumstances, HUD incentives allow public housing capital funds and extra energy savings from energy conservation measures to be allocated by the housing authority toward needed repairs and other eligible expenses. The rate reduction incentive allows public housing authorities to retain either 50% or 100% of the savings from a renewable-energy related reduced utility rate.

This article examines the various sides of the debate over whether financial incentives should be offered those utilities with aggressive conservation programs as part of their load management scheme. The author feels that the desire of some of the utilities to operate as pure businesses instead of as public service companies that have obligations to their community and society beyond the obligations of ordinary business will lead to the surrender of an ideal where electric utilities are public service corporations obligated to do the right thing.

  5. Antitrust concerns in the modern public utility environment

    SciTech Connect (OSTI)

    Meeks, J.E.

    1996-04-01

Direct regulation of public utility activity and behavior has been the predominant approach to protect the public interest in this country. Changes in technology, as well as new thinking about the optimum role of regulation, have created a changing atmosphere in all of the traditional public utility industries. Competitive markets for many of the products and services in these industries have been developing. While monopoly power will continue to exist in certain parts of these industries and require direct regulation, in many areas a growing reliance upon competition as the best method of serving the public interest is developing. With this shift in emphasis from regulation to free markets, the antitrust laws take on new importance for these industries. In the absence of direct regulator control, those laws are society`s primary method of insuring the markets necessary to make competition an effective device for protecting the public interest. This study provides an overview of the antitrust laws, briefly describes the applicable theoretical underpinnings, and then turns to areas where public utility activity may pose special problems or conflicts with prevailing antitrust policy.

    SciTech Connect (OSTI)

    Feurer, D.A.; Weaver, C.L.

    1981-01-01

A detailed description is given of the laws and programs of the State of Nebraska governing the regulation of public energy utilities, the siting of energy generating and transmission facilities, the municipal franchising of public energy utilities, and the prescription of rates to be charged by utilities including attendant problems of cost allocations, rate base and operating expense determinations, and rate of return allowances. These laws and programs are analyzed to identify impediments which they may present to the implementation of Integrated Community Energy Systems (ICES). This report is one of fifty-one separate volumes which describe such regulatory programs at the Federal level and in each state as background to the report entitiled ''Community Energy Systems and the Law of Public Utilities--Volume One: An Overview.'' This report also contains a summary of a strategy described in Volume One - An Overview for overcoming these impediments by working within the existing regulatory framework and by making changes in the regulatory programs to enhance the likelihood of ICES implementation.

  14. Calculating fairness. [Estimating fair return on equity for public utilities

    SciTech Connect (OSTI)

    Makholm, J.D.; Sander, D.O. )

    1993-11-15

Despite the recent restructuring, unbundling, competition, and incentive regulation that has complicated the utility business, estimating the fair rate of return on equity (ROE) remains an important part of public utility base rate cases. For the past two decades, the two most popular methods that regulatory commissions have used for estimating the cost of equity capital for regulated utilities have been the dividend discount method (known as the Discounted Cash Flow model of DCF) and the Capital Asset Pricing Model (or CAPM). Both models use common stock price behavior to draw inferences about the cost of equity. The DCF combines a stock's dividend yield and its predicted dividend growth rate. The CAPM relates changes in a stock's price to changes in the overall market for security prices. These methods have come into question, however, as utilities have increasingly diversified into unregulated activities. When a utility's regulated activities account for 95 to 99 percent of its revenues, there is little practical need to question that its company-specific cost-of-equity capital is overwhelmingly dominated by its regulated activities. But as this percentage continues to decrease, a company's specific cost of equity, as calculated by the DCF or CAPM, is influenced to a larger degree by its unregulated subsidiaries. Two general remedies are available to resolve the problem of setting the fair ROE when the company has substantial holdings in unregulated subsidiaries. One is to abandon (either partially or fully) the practice of using company-specific market information and use a proxy group of comparable utilities instead. The other is to continue using company-specific data, but to adjust the resulting estimates to account for the utility's diversification activity.

One of the dangers in policy debates, especially those involving many complex and interrelated subjects, is that the debate will plunge into the depths of details to the exclusion of firmly establishing overarching logic and principles. Sometimes this is because it is extremely difficult for the human brain simultaneously to think of many things at many levels. Sometimes it is because that central logic is forgotten along the way or, worse, never in place to begin with. The policy debate on electricity industry restructuring is no exception. This danger of concentrating on the details and obscuring the central principles permeates the wide-ranging restructuring debates, and certainly has contaminated questions about the subissue of the Public Utility Holding Company Act (PUHCA).

This manual is divided into three distinct sections. Part one contains 40 passive solar home plans designed for the Pacific Northwest by Oregon architects and designers. Floor plans and exterior renderings of multi-family and single-family dwellings, earth sheltered and bermed designs, and light commercial structures are included. The degree of solar contribution each residence achieves is graphically presented for ease of understanding. Part two, renewable-energy-resource guide, is primarily designed as a locator to indepth publications that explain specific energy resources in detail. It contains illustrated book reviews of pertinent private and government publications available. Various tables, forms, diagrams, energy system evaluation criteria, an illustrated glossary, BPA energy programs, utility programs, financial outlooks and non-profit organizations are included. The product locator index makes up part three. This indexed directory contains the listings of businesses, including the address, phone number, contact person and a 30 to 50 word description of the product or services currently offered. These renewable energy companies range from architectural and engineering services to research and development firms.

    SciTech Connect (OSTI)

    1998-12-01

The 1997 edition of the ``Financial Statistics of Major U.S. Publicly Owned Electric Utilities`` publication presents 5 years (1993 through 1997) of summary financial data and current year detailed financial data on the major publicly owned electric utilities. The objective of the publication is to provide Federal and State governments, industry, and the general public with current and historical data that can be used for policymaking and decisionmaking purposes related to publicly owned electric utility issues. Generator (Tables 3 through 11) and nongenerator (Tables 12 through 20) summaries are presented in this publication. Five years of summary financial data are provided (Tables 5 through 11 and 14 through 20). Summaries of generators for fiscal years ending June 30 and December 31, nongenerators for fiscal years ending June 30 and December 31, and summaries of all respondents are provided in Appendix C. The composite tables present aggregates of income statement and balance sheet data, as well as financial indicators. Composite tables also display electric operation and maintenance expenses, electric utility plant, number of consumers, sales of electricity, operating revenue, and electric energy account data. The primary source of publicly owned financial data is the Form EIA-412, ``Annual Report of Public Electric Utilities.`` Public electric utilities file this survey on a fiscal year basis, in conformance with their recordkeeping practices. The EIA undertook a review of the Form EIA-412 submissions to determine if alternative classifications of publicly owned electric utilities would permit the inclusion of all respondents. The review indicated that financial indicators differ most according to whether or not a publicly owned electric utility generates electricity. Therefore, the main body of the report provides summary information in generator/nongenerator classifications. 2 figs., 101 tabs.

  11. Public Utility Regulatory Policies Act of 1978. Annual report to Congress

    SciTech Connect (OSTI)

    None,

    1980-05-01

Titles I and III of the Public Utility Regulatory Policies Act of 1978 (PURPA) establish retail regulatory policies for electric and natural gas utilities, respectively, aimed at achieving three purposes: conservation of energy supplied by electric and gas utilities; efficiency in the use of facilities and resources by these utilities; equitable rates to electricity and natural gas consumers. PURPA also continues the pilot utility implementation program, authorized under Title II of the Energy Conservation and Production ACT (ECPA), to encourage adoption of cost-based rates and efficient energy-management practices. The purpose of this report is twofold: (1) to summarize and analyze the progress that state regulatory authorities and certain nonregulated utilities have made in their consideration of the PURPA standards; and (2) to summarize the Department of Energy (DOE) activities relating to PURPA and ECPA. The report provides a broad overview and assessment of the status of electric and gas regulation nationwide, and thus helps provide the basis for congressional and DOE actions targeted on the utility industry to address pressing national energy problems.

The Western Area Power Administration is about to impose integrated resource planning requirements on its 612 public-power customers as part of its Energy Planning and Management Program (EPAM) and consistent with the Energy Policy Act of 1992. EPAM will affect public utilities over a 15-state region stretching from Minnesota to California, Montana to Texas. In this study, an assessment is made of the environmental impacts of the IRP requirements. Environmental impacts are calculated based on modeled changes in electric power generation and capacity additions.

  1. Incentive regulation of investor-owned nuclear power plants by public utility regulators. Revision 1

    SciTech Connect (OSTI)

    McKinney, M.D.; Seely, H.E.; Merritt, C.R.; Baker, D.C.

    1995-04-01

The US Nuclear Regulatory Commission (NRC) periodically surveys the Federal Energy Regulatory Commission (FERC) and state regulatory commissions that regulate utility owners of nuclear power plants. The NRC is interested in identifying states that have established economic or performance incentive programs applicable to nuclear power plants, how the programs are being implemented, and in determining the financial impact of the programs on the utilities. The NRC interest stems from the fact that such programs have the potential to adversely affect the safety of nuclear power plants. The current report is an update of NUREG/CR-5975, Incentive Regulation of Investor-Owned Nuclear Power Plants by Public Utility Regulators, published in January 1993. The information in this report was obtained from interviews conducted with each state regulatory agency that administers an incentive program and each utility that owns at least 10% of an affected nuclear power plant. The agreements, orders, and settlements that form the basis for each incentive program were reviewed as required. The interviews and supporting documentation form the basis for the individual state reports describing the structure and financial impact of each incentive program.

  2. Public Utility Regulatory Policies Act of 1978: Natural Gas Rate Design Study

    SciTech Connect (OSTI)

    1980-05-01

First, the comments on May 3, 1979 Notice of Inquiry of DOE relating to the Gas Utility Rate Design Study Required by Section 306 of PURPA are presented. Then, comments on the following are included: (1) ICF Gas Utility Model, Gas Utility Model Data Outputs, Scenario Design; (2) Interim Model Development Report with Example Case Illustrations; (3) Interim Report on Simulation of Seven Rate Forms; (4) Methodology for Assessing the Impacts of Alternative Rate Designs on Industrial Energy Use; (5) Simulation of Marginal-Cost-Based Natural Gas Rates; and (6) Preliminary Discussion Draft of the Gas Rate Design Study. Among the most frequent comments expressed were the following: (a) the public should be given the opportunity to review the final report prior to its submission to Congress; (b) results based on a single computer model of only four hypothetical utility situations cannot be used for policy-making purposes for individual companies or the entire gas industry; (c) there has been an unobjective treatment of traditional and economic cost rate structures; the practical difficulties and potential detrimental consequences of economic cost rates are not fully disclosed; and (d) it is erroneous to assume that end users, particularly residential customers, are influenced by price signals in the rate structure, as opposed to the total bill.

  3. Tracking the Reliability of the U.S. Electric Power System: An Assessment of Publicly Available Information Reported to State Public Utility Commissions

    SciTech Connect (OSTI)

LaCommare, Kristina H.; Eto, Joseph H.

    2008-10-10

Large blackouts, such as the August 14-15, 2003 blackout in the northeasternUnited States and Canada, focus attention on the importance of reliable electric service. As public and private efforts are undertaken to improve reliability and prevent power interruptions, it is appropriate to assess their effectiveness. Measures of reliability, such as the frequency and duration of power interruptions, have been reported by electric utilities to state public utility commissions for many years. This study examines current state and utility practices for collecting and reporting electricity reliability information and discusses challenges that arise in assessing reliability because of differences among these practices. The study is based primarily on reliability information for 2006 reported by 123 utilities to 37 state public utility commissions.

  4. Renewable Electricity Benefits Quantification Methodology: A Request for Technical Assistance from the California Public Utilities Commission

    SciTech Connect (OSTI)

    Mosey, G.; Vimmerstedt, L.

    2009-07-01

The California Public Utilities Commission (CPUC) requested assistance in identifying methodological alternatives for quantifying the benefits of renewable electricity. The context is the CPUC's analysis of a 33% renewable portfolio standard (RPS) in California--one element of California's Climate Change Scoping Plan. The information would be used to support development of an analytic plan to augment the cost analysis of this RPS (which recently was completed). NREL has responded to this request by developing a high-level survey of renewable electricity effects, quantification alternatives, and considerations for selection of analytic methods. This report addresses economic effects and health and environmental effects, and provides an overview of related analytic tools. Economic effects include jobs, earnings, gross state product, and electricity rate and fuel price hedging. Health and environmental effects include air quality and related public-health effects, solid and hazardous wastes, and effects on water resources.

  6. Review of Prior Commercial Building Energy Efficiency Retrofit Evaluation: A Report to Snohomish Public Utilities District

    SciTech Connect (OSTI)

    Price, Phillip

    2014-12-22

Snohomish County Public Utilities District (the District or Snohomish PUD) provides electricity to about 325,000 customers in Snohomish County, Washington. The District has an incentive programs to encourage commercial customers to improve energy efficiency: the District partially reimburses the cost of approved retrofits if they provide a level of energy performance improvement that is specified by contract. In 2013 the District contracted with Lawrence Berkeley National Laboratory to provide a third-party review of the Monitoring and Verification (M&V) practices the District uses to evaluate whether companies are meeting their contractual obligations. This work helps LBNL understand the challenges faced by real-world practitioners of M&V of energy savings, and builds on a body of related work such as Price et al. (2013). The District selected a typical project for which they had already performed an evaluation. The present report includes the District's original evaluation as well as LBNL's review of their approach. The review is based on the document itself; on investigation of the load data and outdoor air temperature data from the building evaluated in the document; and on phone discussions with Bill Harris of the Snohomish County Public Utilities District. We will call the building studied in the document the subject building, the original Snohomish PUD report will be referred to as the Evaluation, and this discussion by LBNL is called the Review.

  13. Expanding Geothermal Resource Utilization through Directed Research, Education, and Public Outreach

    SciTech Connect (OSTI)

    Calvin, Wendy

    2015-06-29

The Great Basin Center for Geothermal Energy (GBCGE or the Center) was established at the University of Nevada, Reno (UNR) in May 2000 to promote research and utilization of geothermal resources. The Center received funding through this grant to promote increased geothermal development in the Great Basin, with most of the funding used for peerreviewed research. Funding to the Center and work under the contract were initiated in March 2002, with supplemental funding in subsequent years. The Center monitored the research projects that were competitively awarded in a series of proposal calls between 2002 and 2007. Peer-reviewed research promoted identification and utilization of geothermal resources in Nevada. Projects used geology, geochemistry, geophysics, remote sensing, and the synthesis of multi-disciplinary information to produce new models of geothermal systems in the Western U.S. and worldwide. Funds were also used to support graduate student research and training. Part of the grant was used to support public outreach activities, including webpages, online maps and data resources, and informational workshops for stakeholders.

  19. Commissions as educating organizations: How to educate the public regarding the mission of the public utilities commission in the new regulatory environment

    SciTech Connect (OSTI)

    Sevel, F.

    1996-12-31

Numerous authors have discussed the massive changes in the new regulatory environment and the necessary impact of these changes on the roles, responsibilities, structure, function, and mission of the public utility commission. In fact, when public utility commissioners gathered in Denver for the NRRI/NARUC Commissioners Summit in April 1995, {open_quotes}they made it clear that they embraced change as necessary to effective commission functioning in new regulatory environments and made it clear that they were prepared to direct that change.{close_quotes} The Commissioners identified the following trends of change: (1) Dichotomy of customers in core and noncore groupings. (2) Unbundling and new service offerings. (3) Deregulation of certain services and markets. (4) Increased use of market-based pricing and incentive ratemaking. (5) Large users seeking lowest-cost service providers. (6) Shift from old regulatory compact [of] territorial exclusivity and assured recovery. (7) Changing obligation to serve. (8) Utility diversification into other businesses and use of holding company structures. (9) Increased business risk for utilities. (10) Uncertainty as to continued attention to social goals. In response to these changes, they identified five clusters of core missions for public utility commissions: (1) Protection of those customers who would not reap the full benefits of competition. (2) Support of competition balanced with an interest in fair and effective competition. (3) The provision of timely and clear decisions to utility managers and allowing utilities the flexibility to adapt to new conditions. (4) Preserving the commitment to social goals compatible with the competitive market. (5) Addressing the impact of new corporate structures, jurisdictional changes, necessary change in regulatory methods, and customer protection in the new environment.
