    The open government initiatives have provided tremendous data resources for the transportation system and emergency services in urban areas. This paper proposes a traffic simulation framework using high temporal resolution demographic data and real time open government data for evacuation planning and operation. A comparison study using real-world data in Seattle, Washington is conducted to evaluate the framework accuracy and evacuation efficiency. The successful simulations of selected area prove the concept to take advantage open government data, open source data, and high resolution demographic data in emergency management domain. There are two aspects of parameters considered in this study: user equilibrium (UE) conditions of traffic assignment model (simple Non-UE vs. iterative UE) and data temporal resolution (Daytime vs. Nighttime). Evacuation arrival rate, average travel time, and computation time are adopted as Measure of Effectiveness (MOE) for evacuation performance analysis. The temporal resolution of demographic data has significant impacts on urban transportation dynamics during evacuation scenarios. Better evacuation performance estimation can be approached by integrating both Non-UE and UE scenarios. The new framework shows flexibility in implementing different evacuation strategies and accuracy in evacuation performance. The use of this framework can be explored to day-to-day traffic assignment to support daily traffic operations.

    This report summarizes the Nuclear Regulatory Commission staff`s observations and lessons learned from the five License Renewal Demonstration Program (LRDP) site visits performed by the staff from March 25, 1996, through August 16, 1996. The LRDP was a Nuclear Energy Institute (NEI) program intended to assess the effectiveness of the guidance provided by NEI 95-10, Revision 0, {open_quotes}Industry Guideline for Implementing the Requirements of 10 CFR Part 54 - The License Renewal Rule,{close_quotes} to implement the requirements of Title 10 of the Code of Federal Regulations, Part 54 (10 CFR Part 54), {open_quotes}Requirements for Renewal of Operating Licenses for Nuclear Power Plants.{close_quotes} In general, NEI 95-10 appeared to contain the basic guidance needed for scoping, screening, identifying aging effects, developing aging management programs, and performing time-limited aging analyses. However, inconsistent implementation of this guidance in some areas was an indication that clarification of existing guidance and/or the inclusion-of some new guidance may be needed for applicants to develop a license renewal program that is consistent with the intent of the rule.

    This paper reports that Kirkland As, Oslo, has received a geophysical survey and exploration contract (GSEC) in a sizzling exploration and development theater off the Philippines. The license covers about 6,000 sq miles of undisputed waters, with depths mostly less than 300 ft, and lies in the Reed Bank area off Northwest Palawan Island, where several major oil and gas strikes have been made recently. Kirkland has 1 year in which to carry out its seismic work commitment. The terms of the GSEC then give an option to drill one well in a 6 month period. Once the results have been analyzed, the company can either drill another well or enter into a service contract for the license. Kirkland has a 65% share in the license, with the remainder split between Philippine companies Philodrill Corp., Beguet Mining Corp. subsidiary Petrofields, and Seafront Resources Corp. The Philippines is one of Kirkland's main areas of activity, the Kirkland Commercial Manager Ralph Baxter.

    Deep geological disposal of long-lived radioactive waste is currently considered a major challenge. Until present, only three deep geological disposal facilities have worldwide been operated: the Asse experimental repository (1967-1978) and the Morsleben repository (1971-1998) in Germany as well as the Waste Isolation Pilot Plant (WIPP) in the USA (1999 to present). Recently, the licensing procedure for the fourth such facility, the German Konrad repository, ended with a positive ''Planfeststellung'' (plan approval). With its plan approval decision, the licensing authority, the Ministry of the Environment of the state of Lower Saxony, approved the single license needed pursuant to German law to construct, operate, and later close down this facility.

    Export of commodities, encouraged by both the private sector and the Federal Government, helps to improve our position in the global economy and is in the national interest of the US. However, exports of commodities or technologies, without regard to whether they may significantly contribute to the military potential of individual countries or combination of countries or enhance the proliferation of weapons of mass destruction, may adversely affect the national security of the US. The Federal Government, therefore, implements several laws, Executive Orders, and regulations to control the export of certain commodities and technologies. These commodities and technologies require a license for export. Some of the controlled items are designated as ''dual-use,'' that is, commodities and technologies that have both civilian and military application. Some dual-use commodities are designated as ''nuclear dual-use''--items controlled for nuclear nonproliferation purposes. Another group of controlled commodities is designated as munitions, which are goods and technologies that have solely military uses. The Department of Energy (Energy) conducts reviews of export license applications for nuclear dual-use items and certain munitions. On August 26, 1998, the Chairman of the Senate Committee on Governmental Affairs requested that the Inspectors General from the Departments of Commerce, Defense, Energy, State, and Treasury, and the Central Intelligence Agency (CIA), update and expand on a 1993 interagency review conducted by the Inspectors General of the Departments of Commerce, Defense, Energy, and State of the export licensing processes for dual-use and munitions commodities.

    The Port Hope remediation project is a part of a larger initiative of the Canadian Federal Government the Port Hope Area Initiative (PHAI) which is based upon a community proposal. The Government of Canada, through Natural Resources Canada (NRCan) is investing $1.28 billion over 10 years to clean up historic low-level radioactive waste in the Port Hope Area and to provide long-term safe management of the low-level radioactive wastes in the Port Hope Area. These wastes arose from the activities of a former Federal Crown Corporation (Eldorado Nuclear) and its private sector predecessors. In Canada, historic waste are defined as low-level radioactive waste that was managed in a manner no longer considered acceptable, but for which the original producer cannot reasonably be held responsible or no longer exists and for which the Federal Government has accepted responsibility. In Canada, under the current regulatory framework, the environmental remediation is not considered as a distinct phase of the nuclear cycle. The regulatory approach for dealing with existing sites contaminated with radioactive residues is defined on the basis of risk and application of existing regulations. A unique regulatory approach was taken by the Canadian Nuclear Safety Commission (CNSC) to address the various licensing issues and to set out the requirements for licensing of the Port Hope Project within the current regulatory framework. The NGNP Project has adopted the 10 CFR 52 Combined License (COL) application process, as recommended in the Report to Congress, dated August 2008, as the foundation for the NGNP licensing strategy. NRC licensing of the NGNP plant utilizing this process will demonstrate the efficacy of licensing future HTGRs for commercial industrial applications. The inherently safe HTGR design characteristics can be utilized to supply high-temperature process heat, co-generated electricity, and/or hydrogen for a number of industrial applications (e.g., petrochemical processes).     The Hanford Site was established in 1943 as one of the three original Manhattan Project locations involved in the development of atomic weapons. It continued as a defense production center until 1988, when its mission changed to environmental restoration and remediation. The Hanford Site is changing its business strategy and in doing so, is reinventing government. This new development has been significantly influenced by a number of external sources. These include: the change in mission, reduced security requirements, new found partnerships, fiscal budgets, the Tri-Party agreement and stakeholder involvement. Tight budgets and the high cost of cleanup require that the site develop and implement innovative cost saving approaches to its mission. Costeffective progress is necessary to help assure continued funding by Congress.

    The US Army Corps of Engineers has retained Idaho National Laboratory (INL) to conduct a study of past INL experiences and complete a report that identifies the processes that are needed for the development of renewable energy projects on government properties. The INL has always maintained expertise in power systems and applied engineering and INLs renewable energy experiences date back to the 1980s when our engineers began performing US Air Force wind energy feasibility studies and development projects. Over the last 20+ years of working with Department of Defense and other government agencies to study, design, and build government renewable projects, INL has experienced the dos and donts for being successful with a project. These compiled guidelines for government renewable energy projects could include wind, hydro, geothermal, solar, biomass, or a variety of hybrid systems; however, for the purpose of narrowing the focus of this report, wind projects are the main topic discussed throughout this report. It is our thought that a lot of what is discussed could be applied, possibly with some modifications, to other areas of renewable energy. It is also important to note that individual projects (regardless the type) vary to some degree depending on location, size, and need but in general these concepts and directions can be carried over to the majority of government renewable energy projects. This report focuses on the initial development that needs to occur for any project to be a successful government renewable energy project.

    Trojan Nuclear Plant (Trojan) and Maine Yankee Nuclear Plant (Maine Yankee) were the first two power reactors to complete decommissioning under the U. S. Nuclear Regulatory Commission's (NRC's) License Termination Rule (LTR), 10 CFR Part 20, Subpart E. The respective owners' decisions to decommission the sites resulted in different approaches to both the physical aspects of the decommissioning, and the approach for obtaining approval for completing the decommissioning in accordance with regulations. Being in different States, the two single-unit pressurized water reactor sites had different State requirements and levels of public interest that impacted the decommissioning approaches. This resulted in significant differences in decommissioning planning, conduct of decommissioning operations, volumes of low- level radioactive waste disposed, and the final status survey (FSS) program. While both licensees have Independent Spent Fuel Storage Installations (ISFSIs), Trojan obtained a separate license for the ISFSI in accordance with the requirements of 10 CFR Part 72 and terminated their 10 CFR Part 50 license. Maine Yankee elected to obtain a general license under 10 CFR Part 50 for the ISFSI and reduce the physical site footprint to the ISFSI through a series of license amendments. While the NRC regulations are flexible and allow different approaches to ISFSI licensing there are separate licensing requirements that must be addressed. In 10 CFR 50.82, the NRC mandates public participation in the decommissioning process. For Maine Yankee, public input resulted in the licensee entering into an agreement with a concerned citizen group and resulted in State legislation that significantly lowered the dose limit below the NRC radiological criteria of 25 mrem (0.25 mSv) per year (yr) in 10 CFR 20.1402 for unrestricted use. The lowering of the radiological criteria resulted in a significant dose modeling effort using site-specific Derived Concentrations Guideline Levels (DCGLs) that were well below the NRC DCGL screening values. This contributed to a longer than anticipated period to obtain NRC approval of the Maine Yankee License Termination Plan (LTP). By employing the lessons learned from its first LTP submittal, which was not accepted by the NRC staff, Trojan was able to obtain approval of its revised LTP promptly. While both licensees provided final status survey reports (FSSRs) for NRC approval, the Trojan approach to decommissioning and data management allowed NRC to efficiently review FSS records and supporting documentation. Therefore, NRC was able to review Trojan's FSSR more efficiently than Maine Yankee's FSSR. This paper describes the regulatory impacts of the two different approaches to the decommissioning, the development of licensee required plans, decommissioning operations and records, the differences in licensing processes, and the lessons learned for improving the processes.     An overview is given on the development and the advantages of coupled codes which integrate 3D neutron kinetics into thermal-hydraulic system codes. The work performed within GRS by coupling the thermal-hydraulic system code ATHLET and the 3D neutronics code QUABOX/CUBBOX is described as an example. The application of the coupled codes as best-estimate simulation tools for safety analysis is discussed. Some examples from German licensing practices are given which demonstrate how the improved analytical methods of coupled codes have contributed to solve licensing issues related to optimized and more economical use of fuel.     This summary describes the operations to clean up the equipment of the Nuclear Licensed Facility 57 (NLF 57). Due to the diversity of the research and development work carried out on the reprocessing of spent fuel in it, this installation is emblematic of many of the technical and organizational issues liable to be encountered in the final closure of nuclear facilities. The French atomic energy commission's center at Fontenay aux Roses (CEA-FAR) was created in 1946 to house pile ZOE. Laboratories for fuel cycle research were installed in existing buildings at the site. Work was later concentrated on spent fuel reprocessing, in a pilot workshop referred to as the 'Usine Pu'. In the early sixties, after the dismantling of these first generation facilities, a radiochemistry laboratory dedicated to research and development work on reprocessing was constructed, designated Building 18. During the same decade, more buildings were added: Building 54, storehouses and offices, Building 91, a hall and laboratories for chemical engineering research on natural and depleted uranium. Together, these three building constitute NLF 57. Building 18 architecture featured four similar modules. Each module had three levels: a sub-level consisting of technical galleries and rooms for the liquid effluent tanks, a ground floor and roof space in which the ventilation was installed. Offices, change rooms, four laboratories and a hall were situated on the ground floor. The shielded lines were installed in the laboratories and the halls. Construction of the building took place between 1959 and 1962, and its commissioning began in 1961. The research and development programs performed in NLF 57 related to studies of the reprocessing of spent fuel, including dry methods and the Purex process, techniques for the treatment of waste (vitrification, alpha waste decontamination, etc.) as well as studies and production of transuranic elements for industry and research. In addition to this work, the necessary methods of analysis for monitoring it were also developed. The research and development program finally ended on 30 June 1995. The NLF 57 cleanup program was intended to reduce the nuclear and conventional hazards and minimize the quantities of HLW and MLW during the subsequent dismantling work. To facilitate the organization of the cleanup work, it was divided into categories by type: - treatment and removal of nuclear material, - removal of radioactive sources, - treatment and removal of aqueous liquid waste, - treatment and removal of organic effluents, - treatment and removal of solid waste, - pumping out of the PETRUS tank, - flushing and decontamination of the tanks, - cleanup of Buildings 18 and 91/54. To estimate the cost of the operations and to monitor the progress of the work, an indicator system was put in place based on work units representative of the operation. The values of the work units were periodically updated on the basis of experience feedback. The cleanup progress is now 92% complete (06/12/31): - treatment and removal of nuclear material: 100%, - removal of radioactive sources: 100%, - treatment and removal of aqueous liquid waste: 64%, - treatment and removal of organic effluents: 87%, - treatment and removal of solid waste: 99%, - pumping out of the PETRUS tank: 69%, - flushing and decontamination of tank: 75%, - section cleaning of Buildings 18 and 91/: 90%. The DRSN/SAFAR is the delegated Project Owner for cleanup and dismantling operations. It is also the prime contractor for the cleanup and dismantling operations. SAFAR itself is responsible for operations relating to the CEA activity and those with technical risks (Removal of nuclear materials, Removal of radioactive sources, Pumping out plutonium and transuranic contaminated solvent and Flushing and decontamination of tanks and pipes). All other operations are sub-contracted to specialist companies. The NLF57 cleanup program as executed is capable of attaining activity levels compatible with a future dismantling operation using known and mastered techniques and producing a

    Radiological consequence analyses are performed for potential releases from normal operations in surface and subsurface facilities and from Category 1 and Category 2 event sequences during the preclosure period. Surface releases from normal repository operations are primarily from radionuclides released from opening a transportation cask during dry transfer operations of spent nuclear fuel (SNF) in Dry Transfer Facility 1 (DTF 1), Dry Transfer Facility 2 (DTF 2), the Canister Handling facility (CHF), or the Fuel Handling Facility (FHF). Subsurface releases from normal repository operations are from resuspension of waste package surface contamination and neutron activation of ventilated air and silica dust from host rock in the emplacement drifts. The purpose of this calculation is to demonstrate that the preclosure performance objectives, specified in 10 CFR 63.111(a) and 10 CFR 63.111(b), have been met for the proposed design and operations in the geologic repository operations area. Preclosure performance objectives are discussed in Section 6.2.3 and are summarized in Tables 1 and 2.

    Eisenhower's Atoms for Peace speech in 1953 is remembered for engaging the world, and the Soviet Union in particular, in a dialogue about arms control and the formulation of a nuclear regime in which national and international security concerns growing from this unprecedented emerging and frightening new weapons capability would be addressed while tapping the civilian promise of nuclear applications for the good of mankind. Out of it came a series of initiatives, leading fifteen years later to the NPT, intended to allow the growth and spread of the beneficial uses of nuclear know-how while constraining the incentives and capabilities for nuclear weapons. The last 50 years has seen a gradual spread in nations with nuclear weapons, other nations with nuclear knowledge and capabilities, and still others with nuclear weapon intentions. Still most nations of the world have forgone weapon development, most have signed and abided by the NPT, and some that have had programs or even weapons, have turned these capabilities off. Yet despite this experience, and despite a relatively successful record up to a few years ago, there is today a clear and generally recognized crisis in nuclear governance, a crisis that affects the future of all the cross-cutting civilian/security issues we have cited. The crux of this crisis is a lack of consensus among the major powers whose support of international efforts is necessary for effective governance of nuclear activities. The lack of consensus focuses on three challenges: what to do about non-compliance, what to do about non-adherence, and what to do about the possible leakage of nuclear materials and technologies to terrorist groups. Short of regaining consensus on the priority to be given to nuclear material and technology controls, it is unlikely that any international regime to control nuclear materials and technologies, let alone oversee a growth in the nuclear power sector, will be successful in the tough cases where it needs to be successful. Regaining that consensus on the other hand means alleviating some fundamental insecurity on the part of states, and weakening the hold that terrorist groups have on some state governments. This in turn requires that some fundamental issues be addressed, with recognition that these are part of a suite of complex and dynamic interactions. Among these issues are: How will states provide for their own security and other central interests while preventing further proliferation, protecting against the use of nuclear weapons, and yet allowing for the possible expansion of nuclear power?; How best can states with limited resources to fight terrorist activities and safeguard nuclear materials be assisted in securing their materials and technologies?; What is the future role of international inspections? Does the IAEA remain the right organization to carry out these tasks? If not, what are the desired characteristics of a successor agency and can there be agreement on one?; How confident can we be of nonproliferation as latent nuclear weapon capabilities spread? The policies to address these and other issues must explicitly deal with NPT members who do not observe their obligations; NPT non-members; illicit trade in SNM and weapon technologies and the possibility of a regional nuclear war.

    A fully licensed transportation system for Radioisotope Thermoelectric Generators and Light-Weight Radioisotope Heater Units is currently being designed and built. The system will comply with all applicable US Department of Transportation regulations without the use of a DOE Alternative.'' The US Department of Transportation has special double containment'' requirements for plutonium. The system packaging uses a doubly contained bell jar'' concept. A refrigerated trailer is used for cooling the high-heat payloads. The same packaging is used for both high- and low-heat payloads.     This report proposes potential research priorities for the Department of Energy (DOE) with the intent of improving the licensability of the Sodium Fast Reactor (SFR). In support of this project, five panels were tasked with identifying potential safety-related gaps in available information, data, and models needed to support the licensing of a SFR. The areas examined were sodium technology, accident sequences and initiators, source term characterization, codes and methods, and fuels and materials. It is the intent of this report to utilize a structured and transparent process that incorporates feedback from all interested stakeholders to suggest future funding priorities for the SFR research and development. While numerous gaps were identified, two cross-cutting gaps related to knowledge preservation were agreed upon by all panels and should be addressed in the near future. The first gap is a need to re-evaluate the current procedures for removing the Applied Technology designation from old documents. The second cross-cutting gap is the need for a robust Knowledge Management and Preservation system in all SFR research areas. Closure of these and the other identified gaps will require both a reprioritization of funding within DOE as well as a re-evaluation of existing bureaucratic procedures within the DOE associated with Applied Technology and Knowledge Management.

    The EPRI FCODE-BETA fuel performance code is the mechanistic model portion for the SPEAR-BETA fuel reliability code, which was developed for EPRI by Entropy Limited. FCODE-BETA was assessed by Battelle, Pacific Northwest Laboratories, and Combustion Engineering, Inc., for adequacy in simulating fuel performance in fuel licensing proceedings. The assessment included a detailed review of those thermal and mechanical performance models of greatest importance to fuel licensing, including fission gas release, fuel temperatures, and cladding uniform strain. It was concluded that the code is inadequate for licensing calculations in its present form. Recommendations for modeling and usability improvements are made.

    When developing linear programming models, issues such as budget limitations, customer requirements, or licensing may preclude the use of commercial linear programming solvers. In such cases, one option is to use an open-source linear programming solver. A survey of linear programming tools was conducted to identify potential open-source solvers. From this survey, four open-source solvers were tested using a collection of linear programming test problems and the results were compared to IBM ILOG CPLEX Optimizer (CPLEX) [1], an industry standard. The solvers considered were: COIN-OR Linear Programming (CLP) [2], [3], GNU Linear Programming Kit (GLPK) [4], lp_solve [5] and Modular In-core Nonlinear Optimization System (MINOS) [6]. As no open-source solver outperforms CPLEX, this study demonstrates the power of commercial linear programming software. CLP was found to be the top performing open-source solver considered in terms of capability and speed. GLPK also performed well but cannot match the speed of CLP or CPLEX. lp_solve and MINOS were considerably slower and encountered issues when solving several test problems.

Developed at Pacific Northwest National Laboratory (PNNL), MeDICi has been released under an open source license and is based on enterprise-proven middleware technologies including a widely used Enterprise Service Bus (ESB), the standard Business Process Execution Language (BPEL), and open source message brokers. Wherever possible, we have built on existing open source, standards-based systems and integrated them into a coherent whole by creating simplified graphical programming tools such as a Workflow Designer and an easy to use and well-documented integration API. This software development approach allows us to: avoid re-creating complex service integration and orchestration systems, reap the benefits of continual improvements to the technology base, and focus on creating tools and APIs which allow for the creation of re-usable component-based software components applications and workflows. These aspects have facilitated rapid adoption of the platform within PNNL for demonstration and operational applications. In fact, MeDICi has been used for a wide range of integration projects including two sensor integration applications described later on in this paper. The remainder of this article white paper is organized as follows: Section 2 provides a high-level description of the MeDICi architecture. In Section 3, the open aspects of the API and tool development are highlighted. Section 4 explains system readiness by presenting relevant demonstrations and deployments.     This paper represents the Department of Energy Office of Nonproliferation Research and Development (NA-22) Simulations, Algorithms and Modeling (SAM) Program's first effort to identify and frame analytical methods and tools to aid export control professionals in effectively predicting proliferation intent; a complex, multi-step and multi-agency process. The report focuses on analytical modeling methodologies that alone, or combined, may improve the proliferation export control license approval process. It is a follow-up to an earlier paper describing information sources and environments related to international nuclear technology transfer. This report describes the decision criteria used to evaluate modeling techniques and tools to determine which approaches will be investigated during the final 2 years of the project. The report also details the motivation for why new modeling techniques and tools are needed. The analytical modeling methodologies will enable analysts to evaluate the information environment for relevance to detecting proliferation intent, with specific focus on assessing risks associated with transferring dual-use technologies. Dual-use technologies can be used in both weapons and commercial enterprises. A decision-framework was developed to evaluate which of the different analytical modeling methodologies would be most appropriate conditional on the uniqueness of the approach, data availability, laboratory capabilities, relevance to NA-22 and Office of Arms Control and Nonproliferation (NA-24) research needs and the impact if successful. Modeling methodologies were divided into whether they could help micro-level assessments (e.g., help improve individual license assessments) or macro-level assessment. Macro-level assessment focuses on suppliers, technology, consumers, economies, and proliferation context. Macro-level assessment technologies scored higher in the area of uniqueness because less work has been done at the macro level. An approach to developing testable hypotheses for the macro-level assessment methodologies is provided. The outcome of this works suggests that we should develop a Bayes Net for micro-level analysis and continue to focus on Bayes Net, System Dynamics and Economic Input/Output models for assessing macro-level problems. Simultaneously, we need to develop metrics for assessing intent in export control, including the risks and consequences associated with all aspects of export control.

    The U.S. Department of Energy (DOE) Office of Civilian Radioactive Waste Management is in the process of preparing the Yucca Mountain license application for submission to the Nuclear Regulatory Commission as the nations first geologic repository for spent nuclear fuel (SNF) and high-level waste. Because the DOE SNF will be part of the license application, there are various components of the license application that will require information relative to the DOE SNF. The National Spent Nuclear Fuel Program (NSNFP) is the organization that directs the research, development, and testing of treatment, shipment, and disposal technologies for all DOE SNF. This report documents the work activities conducted by the NSNFP and discusses the relationship between these NSNFP technical activities and the license application. A number of the NSNFP activities were performed to provide risk insights and understanding of DOE SNF disposal as well as to prepare for anticipated questions from the regulatory agency.

    Expert panels comprised of subject matter experts identified at the U.S. National Laboratories (SNL, ANL, INL, ORNL, LBL, and BNL), universities (University of Wisconsin and Ohio State University), international agencies (IRSN, CEA, JAEA, KAERI, and JRC-IE) and private consultation companies (Radiation Effects Consulting) were assembled to perform a gap analysis for sodium fast reactor licensing. Expert-opinion elicitation was performed to qualitatively assess the current state of sodium fast reactor technologies. Five independent gap analyses were performed resulting in the following topical reports: (1) Accident Initiators and Sequences (i.e., Initiators/Sequences Technology Gap Analysis), (2) Sodium Technology Phenomena (i.e., Advanced Burner Reactor Sodium Technology Gap Analysis), (3) Fuels and Materials (i.e., Sodium Fast Reactor Fuels and Materials: Research Needs), (4) Source Term Characterization (i.e., Advanced Sodium Fast Reactor Accident Source Terms: Research Needs), and (5) Computer Codes and Models (i.e., Sodium Fast Reactor Gaps Analysis of Computer Codes and Models for Accident Analysis and Reactor Safety). Volume II of the Sodium Research Plan consolidates the five gap analysis reports produced by each expert panel, wherein the importance of the identified phenomena and necessities of further experimental research and code development were addressed.     The Ocean Thermal Energy Conversion Act of 1980 sets forth the basic rules of the OTEC legal regime and thus addresses legal uncertainties that had previously menaced the development of a commercial OTEC industry. The act establishes US jurisdiction over OTEC facilities and establishes a federal licensing system. Legal protection is extended to submarine electric transmission cables and equipment. The act makes applicable to OTEC facilities and plantships the Constitution, laws, and treaties of the US and the laws of the sthate to which an OTEC facility is connected. Specific determinations regarding the applicability or inapplicability to OTEC plants of various provisions of law also exist. Implementation of the act by NOAA is discussed, as well as additional considerations that OTEC developers need to keep in mind. (LEW)

    The current international energy trade governance system is fragmented and multi-layered. Streamlining it for greater legal cohesiveness and international political and economic cooperation would promote global energy security. The current article explores three levels of energy trade governance: multilateral, regional and bilateral. Most energy-rich countries are part of the multilateral trading system, which is institutionalized by the World Trade Organization (WTO). The article analyzes the multilateral energy trade governance system by focusing on the WTO and energy transportation issues. Regionally, the article focuses on five major regional agreements and their energy-related aspects and examines the various causes that explain the proliferation of regional trade agreements, their compatibility with WTO law, and then provides several examples of regional energy trade governance throughout the world. When it comes to bilateral energy trade governance, this article only addresses the European Unions (EU) bilateral energy trade relations. The article explores ways in which gaps could be filled and overlaps eliminated whilst remaining true to the high-level normative framework, concentrating on those measures that would enhance EU energy security.
