    This final report summarizes the accomplishments of the 6-year Environmental Management Cooperative Agreement (EMCA) between the Energy and Environmental Research Center (EERC), a nonprofit, contract-supported unit of the University of North Dakota, and the U.S. Department of Energy (DOE) National Energy Technology Laboratory (NETL). The first portion of the report summarizes EMCA's structure, activities, and accomplishments. The appendix contains profiles of the individual EMCA tasks. Detailed descriptions and results of the tasks can be found separately in published Final Topical Reports. EMCA (DOE Contract No. DE-FC21-94MC31388) was in place from the fall of 1994 to the summer of 2001. Under EMCA, approximately $5.4 million was applied in three program areas to expedite the commercialization of 15 innovative technologies for application in DOE's EM Program ($3.8 million, or 69% of funds), provide technical support to the Deactivation and Decommissioning Focus Area (DDFA; $1.04 million, or 19% of funds), and provide for the coordination of the EMCA activities ($0.62 million, or 11% of funds). The following sections profile the overall accomplishments of the EMCA program followed by a summary of the accomplishments under each of the EMCA areas: commercialization, DDFA technical support, and management. Table 1 provides an overview of EMCA, including program areas, program activities, the duration and funding of each activity, and the associated industry partner, if appropriate.

    This report presents results from a program evaluation of the U.S. Department of Energy?s Buildings Technologies Program (BTP) participation in collaborative international technology implementing agreements. The evaluation was conducted by researchers from the Pacific Northwest National Laboratory and the Lawrence Berkeley National Laboratory in the fall of 2007 and winter 2008 and was carried out via interviews with stakeholders in four implementing agreements in which BTP participates, reviews of relevant program reports, websites and other published materials. In addition to these findings, the report includes a variety of supporting materials such that aim to assist BTP managers who currently participate in IEA implementing agreements or who may be considering participation.

Even though DOE has been a key participant in international research activities through the IEA since the 1970s, the experience, knowledge, and institutional memory associated with these activities can be lost or forgotten easily as key DOE managers retire or leave the department. The guide seeks to assemble in a single reference some of the learning that has occurred through participation in IEA IAs as a guide for BTP managers currently responsible for IAs and for those who might consider entering into new IEA activities in the future.

    The objectives of this project were to evaluate the potential utilization in road construction of wastes produced from the Coolside, LIMB (limestone injection multi-stage burner) and FBC (fluidized-bed combustion) processes, and to specify criteria for landfill disposal of waste from the Coolside process. These three processes are considered to be clean coal technologies. The Coolside process involves injecting an aqueous slurry of hydrated lime into the ductwork downstream of the air preheater in a coal-fired boiler. The hydrated lime captures sulfur dioxide from the flue gas producing anhydrous calcium sulfite and calcium sulfate, which are collected along with the unused hydrated lime and fly ash. The LIMB process involves injection of lime or hydrated lime directly into the furnace to capture sulfur dioxide. The waste consists principally of anhydrous calcium sulfate, lime, and fly ash. Both processes were demonstrated successfully at the Edgewater Station of Ohio Edison in Lorrain, OH, from 1989 to 1992. Circulating fluidized-bed combustion (FBC) is a commercial technology which combines steam generation with SO{sub 2} control by burning coal in a circulating bed of limestone. The waste, chemically similar to LIMB waste, is produced by bleed-off of the bed material and by collection of the flue dust. All three processes produce a dry solid waste, which must either be used or disposed of and managed to ensure environmental compliance and economic feasibility. The project was completed in June 1996.

    An assessment of Los Alamos National Laboratory`s management system related to facility compliance with an element of the Clean Air Act was performed under contract by a team from Northern Arizona University. More specifically, a Federal Facilities Compliance Agreement (FFCA) was established in 1996 to bring the Laboratory into compliance with emissions standards of radionuclides, commonly referred to as Rad/NESHAP. In the fall of 1996, the four-person team of experienced environmental managers evaluated the adequacy of relevant management systems to implement the FFCA provisions. The assessment process utilized multiple procedures including document review, personnel interviews and re-interviews, and facility observations. The management system assessment was completed with a meeting among team members, Laboratory officials and others on November 1, 1996 and preparation of an assessment report.

    The objective of this project management plan is to define the tasks and deliverables that will support the treatment, storage, and disposal of remote-handled and large container contact-handled low-level mixed waste, and the storage of Greater-Than-Category 3 waste. The plan is submitted to fulfill the requirements of the Hanford Federal Facility Agreement and Consent Order Milestone M-91-10. The plan was developed in four steps: (1) the volumes of the applicable waste streams and the physical, dangerous, and radioactive characteristics were established using existing databases and forecasts; (2) required treatment was identified for each waste stream based on land disposal restriction treatment standards and waste characterization data; (3) alternatives for providing the required treatment were evaluated and the preferred options were selected; and (4) an acquisition plan was developed to establish the techuical, schedule, and cost baselines for providing the required treatment capabilities. The major waste streams are summarized in the table below, along with the required treatment for disposal.

    Following lengthy and intensive negotiations, OPEC recently reached agreement on new prices and production quotas. Although the agreement has been met by general skepticism, Bankers Trust believes that the chances of defending the new marker price are reasonably good. Saudi willingness to reduce oil production and earnings to shield less financially secure OPEC members from the full impact of production cuts provides added and much-needed strength to the organization. If indeed the OPEC agreement proves successful, product prices in the important US market may have already bottomed out.

    This paper proposes that strengthening regional capabilities for formulating and implementing arms control and confidence-building measures is a tangible method of enhancing regional security. It discusses the importance of developing a regional infrastructure for arms control and confidence building and elucidates the role of technology in facilitating regional arms control and confidence-building agreements. In addition, it identifies numerous applications for regional cooperative monitoring in the areas of arms control, resource management, international commerce and disaster response. The Cooperative Monitoring Center at Sandia National Laboratories, whose aim is to help individual countries and regions acquire the tools they need to develop their own solutions to regional problems, is discussed briefly. The paper ends with recommendations for establishing regional cooperative monitoring centers.

    This paper argues that cooperative monitoring plays a critical role in the implementation of regional security agreements and confidence building measures. A framework for developing cooperative monitoring options is proposed and several possibilities for relating bilateral and regional monitoring systems to international monitoring systems are discussed. Three bilateral or regional agreements are analyzed briefly to illustrate different possibilities. These examples illustrate that the relationship of regional or bilateral arms control or security agreements to international agreements depends on a number of factors: the overlap of provisions between regional and international agreements; the degree of interest in a regional agreement among the international community; efficiency in implementing the agreement; and numerous political considerations. Given the importance of regional security to the international community, regions should be encouraged to develop their own infrastructure for implementing regional arms control and other security agreements. A regional infrastructure need not preclude participation in an international regime. On the contrary, establishing regional institutions for arms control and nonproliferation could result in more proactive participation of regional parties in developing solutions for regional and international problems, thereby strengthening existing and future international regimes. Possible first steps for strengthening regional infrastructures are identified and potential technical requirements are discussed.

Three bilateral or regional agreements are analyzed briefly to illustrate different possibilities: (1) the demilitarization of the Sinai region between Israel and Egypt in the 1970s; (2) the 1991 quadripartite agreement for monitoring nuclear facilities among Brazil, Argentina, The Argentine-Brazilian Agency for Accounting and Control of Nuclear Materials and the International Atomic Energy Agency; and (3) a bilateral Open Skies agreement between Hungary and Romania in 1991. These ultra-fast machines derive much of their computational capability from extreme node counts (over 18000 nodes in the case of the Titan machine). Time-agreement is commonly utilized by parallel programming applications and tools, distributed programming application and tools, and system software. Our time-agreement measurements detail the degree of time variance between nodes and how that variance changes over time. The dataset includes empirical measurements and the accompanying spreadsheets.

    This quarter much progress was made in promoting cofiring through the many FETC/EPRI backed projects. During January 1, 1998 to March 31st, 1998 significant contractual agreements were arranged for future testing and analyses of previous testing were conducted. Most notable was the analysis done on the testing run at the Tennessee Valley Authority?s Colbert Fossil Plant that showed no significant impacts to the plant boiler due to cofiring. Northern Indiana Public Service Company also identified Bailly #7 as the site of the next series of tests using their plants. Other work done on these projects primarily focused on continued cofiring development. This report summarizes the activities during the first quarter in 1998 of the FETC/EPRI Biomass Cofiring Cooperative Agreement. It focuses upon reporting the results of testing in order to highlight the progress at utilities.

Allegheny Energy Supply Company LLC will accept the separate injection demonstration at its Albright Generating Station. During this period, also, efforts were made at program outreach. Papers were given at the Pittsburgh Coal Conference. This report summarizes the activities during the second calendar quarter in 2000 of the USDOE/EPRI Biomass Cofiring Cooperative Agreement. It focuses upon reporting the results of the relocation of Seward, and on the outreach efforts.

    During the period of April 1, 2000 through June 30, 2000, alternatives for relocating the Seward Generating Station cofiring project were investigated. A test was conducted at Bailly Generating Station of Northern Indiana Public Service Co., firing a blend of Black Thunder (Powder River Basin) coal and Illinois basin coal, in cyclone boiler designed for Illinois basin coal. This test at Bailly was designed to determine the technical feasibility of cofiring at that station using PRB coals. This report summarizes the activities during the second calendar quarter in 2000 of the USDOE/EPRI Biomass Cofiring Cooperative Agreement. It focuses upon reporting the results of construction and testing activities at these generating stations.

    During the period of October 1, 1998 through December 31, 1998, significant work was done in direct preparation for several cofiring tests. Major progress was made on several projects including cofiring at Seward (GPU Genco), Allen (TVA), and Bailly (NIPSCO). Most of the work was focused on construction activities at the Seward and Bailly Generating Stations. The conceptual design and feasibility study for gasification-based cofiring at the Allen Fossil Plant was completed. The feasibility study for cofiring at the Pirkey and Northeastern Generating Stations of Central and South West Utilities (C&SW) also was completed. This report summarizes the activities during the fourth calendar quarter in 1998--of the USDOE/EPRI Biomass Cofiring Cooperative Agreement. It focuses upon reporting the results of construction activities and related events.

    Voluntary agreements for energy efficiency improvement and reduction of energy-related greenhouse gas (GHG) emissions have been a popular policy instrument for the industrial sector in industrialized countries since the 1990s. A number of these national-level voluntary agreement programs are now being modified and strengthened, while additional countries--including some recently industrialized and developing countries--are adopting these type of agreements in an effort to increase the energy efficiency of their industrial sectors.Voluntary agreement programs can be roughly divided into three broad categories: (1) programs that are completely voluntary, (2) programs that use the threat of future regulations or energy/GHG emissions taxes as a motivation for participation, and (3) programs that are implemented in conjunction with an existing energy/GHG emissions tax policy or with strict regulations. A variety of government-provided incentives as well as penalties are associated with these programs. This paper reviews 23 energy efficiency or GHG emissions reduction voluntary agreement programs in 18 countries, including countries in Europe, the U.S., Canada, Australia, New Zealand, Japan, South Korea, and Chinese Taipei (Taiwan) and discusses preliminary lessons learned regarding program design and effectiveness. The paper notes that such agreement programs, in which companies inventory and manage their energy use and GHG emissions to meet specific reduction targets, are an essential first step towards GHG emissions trading programs.

    In 2012, India and Pakistan reaffirmed the Agreement on Reducing the Risk from Accidents Relating to Nuclear Weapons. Despite a history of mutual animosity and persistent conflict between the two countries, this agreement derives strength from a few successful nuclear confidence building measures that have stood the test of time. It also rests on the hope that the region would be spared a nuclear holocaust from an accidental nuclear weapon detonation that might be misconstrued as a deliberate use of a weapon by the other side. This study brings together two emerging strategic analysts from South Asia to explore measures to support the Agreement and further develop cooperation around this critical issue. This study briefly dwells upon the strategic landscape of nuclear South Asia with the respective nuclear force management structures, doctrines, and postures of India and Pakistan. It outlines the measures in place for the physical protection and safety of nuclear warheads, nuclear materials, and command and control mechanisms in the two countries, and it goes on to identify the prominent, emerging challenges posed by the introduction of new weapon technologies and modernization of the respective strategic forces. This is followed by an analysis of the agreement itself leading up to a proposed framework for cooperative measures that might enhance the spirit and implementation of the agreement.

    Most independent power financial proposals contain one or more elements of a non-recourse nature. Traditionally, this means prospective lenders will not have a substantial corporate credit or state guarantee standing behind a project loan, which forces attention to be focused on a single asset as the security and debt repayment source. While this major risk remains present, if properly understood, uncertainty can be mitigated and managed, including financial and development hazards inherent in hydropower projects. The specific risk points that a project developer or sponsor must satisfy from the lender`s purposes are numerous. However, they can be grouped primarily into seven key risk areas: project profile, site securing, power sales agreements, government agreements, in-service management, construction and insurance. While a developer strives for a minimum internal rate of return of at least 20 percent, the lender`s expectations are much more modest. Often, developers need to place themselves in the proverbial shoes of the other entity, namely the independent lender, whose only attraction may be some interest, fee income and placement of capital in a safe investment which provides a return in an orderly and uninterrupted manner. Only then is it possible to objectively view and effectively manage the risks mentioned earlier.

    This report discusses the activities of the Division of DOE Oversight in the areas of coordination with other State Agencies with regard to environmental restoration, corrective action, and waste management activities on the Oak Ridge Reservation; and the Division`s efforts to keep the public informed of those DOE activities that may impact their health and the environment. This report includes the status of the Division`s efforts in implementing the Tennessee Oversight Agreement (TOA). Each Program Section provides information concerning the status of its activities. The Administrative Section has been instrumental in achieving access to the ORR without prior notification to DOE and in obtaining documents and environmental, waste management, safety, and health information in a timely manner. The Environmental Restoration Program has provided in-depth document reviews and on-site coordination and monitoring of field activities required under the Federal Facility Agreement. Most notable of the activities are the investigations and planned remediation of the Lower East Fork Poplar Creek and the Watts Bar Reservoir. The Waste Management Program has audited DOE`s compliance with air, water, solid, hazardous, and mixed waste storage, treatment, and disposal regulations. Effort was focused on all three DOE Facilities on the ORR. The final portion of this report discusses the Division`s findings and recommendations. Most significant of these issues is the Division`s request to be an active participant in DOE`s prioritization of its TOA commitments. Other issues discussed include long term storage of radioactive waste and the use of environmental restoration funds. A discussion of those findings and recommendations provided in last year`s annual report and addressed by DOE are included in this report as well. All documents, logs, files, etc. supporting this report are available for review during routine business hours at the Division`s office.

    The Pacific Northwest National Laboratory has researched how participating countries divide funding obligations under International Energy Agency (IEA) Implementing Agreements (IAs). This is part of a broader assessment evaluating the buildings-area IAs. This particular part of the analysis looked at 12 IAs funded by the U.S. Department of Energy. By selecting a range of agreements, we hoped to understand the types of arrangements and the range of funding formulas. PNNL asked the U.S. Executive Committee (ExCo) members how the total contribution for their IA and its Annexes were determined, and how the total was then divided between participating countries.

    On July 19, 1996 the US Department of Energy (DOE), State of Colorado (CDPHE), and US Environmental Protection Agency (EPA) entered into an agreement called the Rocky Flats Cleanup Agreement (RFCA) for the cleanup and closure of the Rocky Flats Environmental Technology Site (RFETS or Rocky Flats). Major elements of the agreement include: an Integrated Site-Wide Baseline; up to twelve significant enforceable milestones per year; agreed upon soil and water action levels and standards for cleanup; open space as the likely foreseeable land use; the plutonium and TRU waste removed by 2015; streamlined regulatory process; agreement with the Defense Nuclear Facilities Safety Board (DNFSB) to coordinate activities; and a risk reduction focus. Successful implementation of RFCA requires a substantial effort by the parties to change their way of thinking about RFETS and meet the deliverables and commitments. Substantial progress toward Site closure through the implementation of RFCA has been accomplished in the short time since the signing, yet much remains to be done. Much can be learned from the Rocky Flats experience by other facilities in similar situations.

    Several existing nuclear-related agreements already require India and Pakistan, as members, to share information. The agreements are bilateral, regional, and international. Greater nuclear transparency between India and Pakistan could be promoted by first understanding the information flows required by existing agreements. This understanding is an essential step for developing projects that can incrementally advance the sensitivity of the information being shared. This paper provides a survey of existing nuclear-related agreements involving India and Pakistan, and suggests future confidence-building projects using the frameworks provided by these agreements. The Bilateral Agreement on the Prohibition of Attack against Nuclear Reactors and Nuclear Facilities is discussed as a basis for creating further agreements on restricting the use and deployment of nuclear weapons. The author suggests options for enhancing the value of the list of nuclear facilities exchanged annually as a part of this agreement. The International Atomic Energy Agency's regional cooperation agreement among countries in the Asia-Pacific region is an opportunity for greater subregional nuclear cooperation in South Asia. Linking the regional agreement with South Asian environmental cooperation and marine pollution protection efforts could provide a framework for projects involving Indian and Pakistani coastal nuclear facilities. Programs of the Food and Agriculture Organization of the United Nations that use nuclear techniques to increase food and crop production and optimize water management in arid areas also provide similar opportunities for nuclear cooperation. Other frameworks for nuclear cooperation originate from international conventions related to nuclear safety, transportation of nuclear wastes, worker protection against ionizing radiation, and the nondeployment of nuclear weapons in certain areas. The information shared by existing frameworks includes: laws and regulations (including internal inspection procedures that enforce compliance); lists of nuclear facilities; emergency response procedures and available resources; information related to the transportation of nuclear wastes (particularly via shipping); understanding and notification of accidental releases; and radionuclide release data from select coastal facilities. Incremental increases in the sensitivity of the information being shared could strengthen norms for Indian and Pakistani nuclear transparency. This paper suggests seven technology-based Indian and Pakistani nuclear transparency projects for consideration. Existing nuclear-related agreements provide an information-sharing framework within which the projects could occur. Eventually, as confidence increases and new agreements are negotiated, future projects could begin to deal with the accounting of fissile materials and nuclear weapons disposition and control.

    The Principle of Perturbative Agreement, as introduced by Hollands & Wald, is a renormalisation condition in quantum field theory on curved spacetimes. This principle states that the perturbative and exact constructions of a field theoretic model given by the sum of a free and an exactly tractable interaction Lagrangean should agree. We develop a proof of the validity of this principle in the case of scalar fields and quadratic interactions without derivatives which differs in strategy from the one given by Hollands & Wald for the case of quadratic interactions encoding a change of metric. Thereby we profit from the observation that, in the case of quadratic interactions, the composition of the inverse classical M{\\o}ller map and the quantum M{\\o}ller map is a contraction exponential of a particular type. Afterwards, we prove a generalisation of the Principle of Perturbative Agreement and show that considering an arbitrary quadratic contribution of a general interaction either as part of the free theory or as part of the perturbation gives equivalent results. Motivated by the thermal mass idea, we use our findings in order to extend the construction of massive interacting thermal equilibrium states in Minkowski spacetime developed by Fredenhagen & Lindner to the massless case. In passing, we also prove a property of the construction of Fredenhagen & Lindner which was conjectured by these authors.

    Objectives are: (1) Develop an inexpensive, rapid-response, high-sensitivity and selective electrochemical sensor for oxides of nitrogen (NO{sub x}) for compression-ignition, direct-injection (CIDI) OBD II systems; (2) Explore and characterize novel, effective sensing methodologies based on impedance measurements and designs and manufacturing methods that are compatible with mass fabrication; and (3) Collaborate with industry in order to (ultimately) transfer the technology to a supplier for commercialization. Approach used is: (1) Use an ionic (O{sup 2-}) conducting ceramic as a solid electrolyte and metal or metal-oxide electrodes; (2) Correlate NO{sub x} concentration with changes in cell impedance; (3) Evaluate sensing mechanisms and aging effects on long-term performance using electrochemical techniques; and (4) Collaborate with Ford Research Center to optimize sensor performance and perform dynamometer and on-vehicle testing. Work in FY2011 focused on using an algorithm developed in FY2010 in a simplified strategy to demonstrate how data from controlled laboratory evaluation could be applied to data from real-world engine testing. The performance of a Au wire prototype sensor was evaluated in the laboratory with controlled gas compositions and in dynamometer testing with diesel exhaust. The laboratory evaluation indicated a nonlinear dependence of the NO{sub x} and O{sub 2} sensitivity with concentration. For both NO{sub x} and O{sub 2}, the prototype sensor had higher sensitivity at concentrations less than {approx}20 ppm and {approx}7%, respectively, compared to lower NO{sub x} and O{sub 2} sensitivity at concentrations greater than {approx}50 ppm and {approx}10.5%, respectively. Results in dynamometer diesel exhaust generally agreed with the laboratory results. Diesel exhaust after-treatment systems will likely require detection levels less than {approx}20 ppm in order to meet emission regulations. The relevant mathematical expressions for sensitivity in different concentration regimes obtained from bench-level laboratory evaluation were used to adjust the sensor signal in dynamometer testing. Both NO{sub x} and O{sub 2} exhibited non-linear responses over the concentration regimes examined (0-100 ppm for NO{sub x} and 4-7% for O{sub 2}). Adjusted sensor signals had better agreement with both a commercial NO{sub x} sensor and FTIR measurements. However, the lack of complete agreement indicated that it was not possible to completely account for the nonlinear sensor behavior in certain concentration regimes. The agreement at lower NO{sub x} levels (less than 20 ppm) was better than at higher levels (50-100 ppm). Other progress in FY2011 included dynamometer testing of sensors with imbedded heaters and protective housings that were mounted directly into the exhaust manifold. Advanced testing protocols were used to evaluate the sensors. These experiments confirmed the potential for sensor robustness and durability. Advanced material processing methods appropriate for mass manufacturing, such as sputtering, are also being evaluated. A major milestone for this past year was the licensing of the LLNL NO{sub x} sensor technology to EmiSense Technologies, LLC. EmiSense has extensive experience and resources for the development of emission control sensors. A CRADA is in development that will allow LLNL to work in partnership with EmiSense to bring the LLNL NO{sub x} sensor technology to commercialization. Ford Motor Company is also a partner in this effort.

    Fiscal Year 1999 represents the third fill year utilizing a results-oriented, performance-based evaluation for the Contractor's operations and management of the DOE Pacific Northwest National Laboratory (here after referred to as the Laboratory). However, this is the first year that the Contractor's fee is totally performance-based utilizing the same Critical Outcomes. This document describes the critical outcomes, objectives, performance indicators, expected levels of performance, and the basis for the evaluation of the Contractor's performance for the period October 1, 1998 through September 30, 1999, as required by Clauses entitled ''Use of Objective Standards of Performance, Self Assessment and Performance Evaluation'' and ''Performance Measures Review'' of the Contract DE-ACO6-76RL01830. Furthermore, it documents the distribution of the total available performance-based fee and the methodology set for determining the amount of fee earned by the Contractor as stipulated within the causes entitled ''Estimated Cost and Annual Fee,'' ''Total Available Fee'' and ''Allowable Costs and Fee.'' In partnership with the Contractor and other key customers, the Department of Energy (DOE) Headquarters (HQ) and Richland Operations Office (RL) has defined four critical outcomes that serve as the core for the Contractor's performance-based evaluation and fee determination.     This report documents a review of State practices of reporting International Fuel Tax Agreement (IFTA) data to the U.S. Federal Highway Administration (FHWA). The purpose of the review is described in a notice published in the Federal Register (Vol. 65, No. 160, August 17, 2000, 50269-50272). The purpose is ''to increase the understanding of States on the importance of reporting adjusted IFTA data to the FHWA'', and ''to develop additional guidance on IFTA reporting''. The purpose is not to critique IFTA or any State. The review includes a survey of the forty eight IFTA member States, which was conducted January-April 2002. The States' responses to the survey are discussed in this report. The organization of the report follows further discussion in the Federal Register notice. Section 2 of the report is a general overview of IFTA. Section 3 describes in more detail how each State collects IFTA revenues. Section 4 is about how States separate out revenues not related to gallons of motor-fuel and direct motor-fuel gallon taxes. Section 5 describes how States calculate net IFTA gallons and the time delay in the processing. Section 6 is about difficulties in processing and reporting IFTA data. Timeliness is discussed further in Section 7, and alternatives for IFTA calculations if complete IFTA data are not available are discussed in Section 8. The IFTA survey questionnaire and instructions are in Appendices A and B. The survey responses of the States and the review of the IFTA system suggest that IFTA collections and data reporting are for the most part working well. Possible exceptions include (1) using off-road fuel use in IFTA mileage-per-gallon (mpg) estimates, (2) inconsistencies among States in definitions of taxable mileage or taxable fuel and consequential reporting differences, and (3) possible misinterpretations of ''net taxable gallons''.

In partnership with the Contractor and other key customers, the Department of Energy (DOE) Richland Operations Office has defined six critical outcomes that same as the core for the Contractors performance evaluation. The Contractor also utilizes these outcomes as a basis for overall management of the Laboratory. As stated above six critical outcomes have been established for FY 1998. These outcomes are based on the following needs identified by DOE-HQ, RL and other customers of the Laboratory. Our Energy Research customer desires relevant, quality and cost effective science. Our Environmental Management customer wants technology developed, demonstrated, and deployed to solve environmental cleanup issues. To ensure the diversification and viability of the Laboratory as a National asset, RL and HQ alike want to increase the Science and Technical contributions of PNNL related to its core capabilities. RL wants improved leadership/management, cost-effective operations, and maintenance of a work environment, which fosters innovative thinking and high morale. RL and HQ alike desire compliance with environment, safety and health (ES and H) standards and disciplined conduct of operations for protection of the worker, environment, and the public, As with all of Hanford, DOE expects contribution of the Laboratory to the economic development of the Tri-Cities community, and the region, to build a new local economy that is less reliant on the Hanford mission, as well as enhancing the status of the Laboratory as a valued corporate citizen of the Northwest Region. The Critical Outcome system focuses all of these customer desires into specific objectives and performance indicators, with supporting measures to track and foster continued improvement in meeting the needs (outcomes) of the Laboratory's customers.

    The Office of Legacy Management (LM) is an integral part of the U.S. Department of Energy’s (DOE’s) strategy to ensure that legacy liabilities of former nuclear weapons production sites are properly managed following the completion of environmental cleanup activities. LM will work with each site using an integrated team approach to ensure a successful transition. Part of this process will include transition of Government records and information. The Office of Legacy Management Information and Records Management Transition Guidance focuses on LM’s goal to preserve and protect legacy records and information. This guidance document establishes a framework for the transfer of records management responsibilities for sites transferring to LM. It describes the requirements, responsibilities, and procedures for the efficient and cost-effective transfer of custody, ownership, and management of records and other information products from the transfer site to LM. Records management practices are critical to the functions of Federal agencies because records provide information about, or evidence of, the organization, functions, policies, decisions, procedures, operations, or other activities. Therefore, the information generated by an agency is created, maintained, and dispositioned through records management processes that ensure the appropriate preservation and retrieval of essential information. Because of their intrinsic value, best practices to preserve information and records should be utilized when records are transferred from one organization to another. As the transfer program completes cleanup activities at closure sites, a transitional process will facilitate the transparent shift in the management of site records activities to LM. The roles and responsibilities of the transfer site and/or program and LM described in this document are a necessary foundation for cooperation and coordination and are essential to the successful transition of records and information responsibilities. The DOE Office of the Chief Information Officer (OCIO) has a central role in DOE records management by providing guidance, expertise, and coordination to all DOE offices and organizations and coordination with the National Archives and Records Administration (NARA). LM and the transfer site will complete an integrated transition plan which will integrate all transition elements including information and records. As part of the overall transition plan, an Information and Records Transition Plan will be developed consistent with the integrated transition plan for the site transfer and included as an attachment. The Information and Records Management Transition Plan will be developed to assist both organizations in organizing the tasks; establishing a timetable and milestones for their completion; and identifying manpower, funding and other resources that will be needed to complete the ownership transfer. In addition, the plan will provide a valuable exchange of institutional knowledge that will assist LM in meeting the obligations of responsibly managing legacy records. Guidance for the development of the plan is included in this document. Records management concerns that may arise during site closure, such as management support, contract language and agreements, interactions with the OCIO and NARA, resource and budget considerations, and procedures to safeguard records are addressed. Guidelines and criteria for records management transition activities are also provided. These include LM expectations for the inventory, scheduling, and disposition of records; the management and transfer of electronic files, including databases and software; records finding aids, indices, and recordkeeping systems; and the process for the transfer of hard copy and electronic records to LM.

    Remarks on the problems and issues related to the United States-Philippines Bases Agreement and prospect for its renewal are included namely: analysis of the provisions of the new Philippine Constitution; ASEAN perspective on the bases; US policy on nuclear weapons and its interest and options; Philippine interests and priorities, including alternate plans to compensate for the possible withdrawal of the US from the Philippines; and then an assessment of the effects of these factors on the renewal of the Bases Agreement. There are difficulties and barriers to the renewal of the said Agreement posed by conflicting policies of both parties and also due to divergent views on priorities, constitutional processes of both countries, and time constraints for concluding an agreement. However there are options for the United States regarding the problem, depending upon the desired level of its presence in Asia/Pacific region and how central the Philippine bases are to US national security interests.

    The Master Safeguards and Security Agreement establishes a contract between the US Department of Energy-Headquarters and a US Department of Energy regional Operations Office regarding protection strategies, protection system performance, and acceptability of risks for US Department of Energy Safeguards and Security interests at a facility or site. An approved Master Safeguards and Security Agreement defines the protection system performance baseline for evaluations, inspections, and audits, and can introduce exceptions to US Department of Energy orders. Responsibilities and authorities for development and approval of a Master Safeguards and Security Agreement are outlined in US Department of Energy Order 5630.13, ''Master Safeguards and Security Agreement'' and US Department of Energy Order 5630.xx, ''Safeguards and Security Planning Program'' (draft). To date, 14 Master Safeguards and Security Agreements have been approved by the US Department of Energy-Headquarters and about 34 are in preparation or review. A total of approximately 50 are anticipated before completion of the program. The Master Safeguards and Security agreement program has been positively received by both the US Department of Energy-Headquarters and the US Department of Energy Operations Offices, because it provides visibility as to the effectiveness of Safeguards and Security protection systems and affords a sensible foundation for security planning based on risk. 6 refs., 3 figs., 6 tabs.

    When two or more working interest owners share an undivided interest in a natural gas well, it is not uncommon for production imbalances to occur. Sometimes such imbalances are remedied pursuant to a gas balancing agreement (GBA) entered into by the interest owners. However, if no GBA is entered into, the common law rules of cotenancy and any other agreement between the parties will be used to cure the production imbalance. In [open quotes]Weiser-Brown Oil Co. v. Samson Resources Co.[close quotes], the Court of Appeals for the Eighth Circuit held that, absent a GBA, a co-owner has no contractual right to recoup underproduction, only a right to an accounting as between cotenants, and that this right to an accounting does not run with the land to subsequent cotenants, but is only personal to the cotenant who has underproduced. This note analyzes the [open quotes]Weiser-Brown[close quotes] decision by first addressing the common law of cotenancy and how the common law is affected by the existence of an operating agreement. The conclusion reached is that, under an operating agreement, the right to make up an underproduction, even absent a GBA, is an assignable contract right, and that this right runs with the land to inure to subsequent grantees of the original part to the operating agreement.
