    Under Executive Order 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations, the Department of Energy (DOE) and Sandia National Laboratories New Mexico (SNL) are required to identify and address, as appropriate, disproportionately high, adverse human health or environmental effects of their activities on minority and low-income populations. The National Environmental Policy Act (NEPA) also requires that environmental justice issues be identified and addressed. This presents a challenge for SNL because it is located in a culturally diverse area. Successfully addressing potential impacts is contingent upon accurately identifying them through objective analysis of demographic information. However, an effective public participation process, which is necessarily subjective, is also needed to understand the subtle nuances of diverse populations that can contribute to a potential impact, yet are not always accounted for in a strict demographic profile. Typically, there is little or no coordination between these two disparate processes. This report proposes a five-step method for reconciling these processes and uses a hypothetical case study to illustrate the method. A demographic analysis and community profile of the population within 50 miles of SNL were developed to support the environmental justice analysis process and enhance SNL`s NEPA and public involvement programs. This report focuses on developing a methodology for identifying potentially impacted populations. Environmental justice issues related to worker exposures associated with SNL activities will be addressed in a separate report.

    The environmental justice movement has come a long way since its birth a decade ago in rural and mostly African American Warren County, North Carolina. The selection of Warren County for a PCB landfill, they brought national attention to waste facility siting inequities and galvanized African American church and civil rights leaders` support for environmental justice. The demonstrations also put {open_quotes}environmental racism{close_quotes} on the map and challenged the myth that African Americans are not concerned about or involved in environmental issues. Grassroots groups, after decades of struggle, have grown to become the core of the multi-issue, multiracial, and multi-regional environmental justice movement. Diverse community-based groups have begun to organize and link their struggles to issues of civil and human rights, land rights and sovereignty, cultural survival , racial and social justice, and sustainable development. The impetus for getting environmental justice on the nations`s agenda has come from an alliance of grassroots activists, civil rights leaders, and a few academicians who questioned the foundation of the current environmental protection paradigm--where communities of color receive unequal protection. Whether urban ghettos and barrios, rural {open_quotes}poverty pockets,{close_quotes} Native American reservations, or communities in the Third World, grassroots groups are demanding an end to unjust and nonsustainable environmental and development policies.

    Environmental Justice (EJ) concerns are now a pervasive part of environmental policy. Moreover, Federal Executive Order 12898 mandates its diffusion throughout federal government programs, and many states are developing similar programs. EJ concerns first arose in the environmental field in the context of hazardous waste facilities. Thus, hazardous waste applications provide important analytical models for EJ issues addressed in other programs, such as environmental assessment (EA). At the present time, EJ concerns are treated largely qualitatively in EAs and environmental impact statements (EISs) in sections dealing with neighborhood and community character or socioeconomics. The manner in which EJ issues are examined in EISs is described using examples from recent EISs, and an approach to quantifying EJ in terms of demographic patterns is presented using techniques previously applied by the author to hazardous waste sites (primarily sites on the National Priorities List under the Superfund program). Various geographic levels and demographic parameters are discussed and compared. A key point is the manner in which the choice of a comparison area influences conclusions about a particular area. these methods are critical in addressing such issues as whether proposed projects are being located in areas with relatively greater proportions of {open_quotes}vulnerable{close_quotes} populations or, in the case of public service projects, how these populations are served relative to other populations by the facilities that are the subject of the assessment.

    Evaluations of environmental justice for government actions concerned with the transportation of hazardous materials over cross country routes presents a significant challenge in spatial data analysis. The sheer volume of data required for accurate identification of minority and low-income populations along the routes and at the endpoints can be formidable. Managing and integrating large volumes of information with state-of-the-art tools is essential in the analysis of environmental justice and equity concerns surrounding transportation of hazardous materials. This paper discusses the role and limitations of geographical information systems in the analysis and visualization of populations potentially affected by the transportation of hazardous materials over transcontinental ground and water routes. Case studies are used to demonstrate the types of data and analyses needed for evaluations of environmental justice for cross country routes and end points. Inherent capabilities and limitations in spatial resolution are evaluated for environmental assessments in which potentially affected areas are quantified based on the physical characteristics of the hazardous cargo.

    The National Environmental Research Parks are outdoor laboratories that provide opportunities for environmental studies on protected lands that act as buffers around Department of Energy (DOE) facilities. The research parks are used to evaluate the environmental consequences of energy use and development as well as the strategies to mitigate these effects. They are also used to demonstrate possible environmental and land-use options. The seven parks are: Fermilab National Environmental Research Park; Hanford National Environmental Research Park; Idaho National Environmental Research Park; Los Alamos National Environmental Research Park; Nevada National Environmental Research Park; Oak Ridge National Environmental Research Park; and Savannah River National Environmental Research Park.   6. A screening approach for identifying environmental justice issues in environmental impact statements

    Executive Order 12898 and the accompanying memorandum addressed to Federal agency heads, both issued on February 11, 1994, require NEPA processes to incorporate environmental justice. The NEPA processes affected are: (1) public involvement formats, (2) analyses of potential impacts. The Executive Order clearly indicates that research strategies and mitigation measure should be developed with the input of the populations mentioned in the Executive Order, i.e., minority and low-income populations. However, an enhanced public involvement process may not occur because the NEPA activity may have been underway before the Executive Order was issued or because the agency chooses not to change traditional public participation mechanisms. It is also possible that enhanced mechanisms may not effectively elicit involvement. In either case, analysis that considers environmental justice must proceed. These analyses could be highly data-intensive--requiring new or modified methodological approaches-- and time-intensive, particularly if the process elements of the executive order are interpreted broadly, Federal agencies and NEPA project managers already have expressed concern about the potential cost of conducting exhaustive environmental justice related analyses where they may not be warranted. Also, the time and resources required to conduct a full environmental justice analysis is counter to recent trends to streamline the NEPA process. In light of this, a process to screen for indicators of the potential for environmental justice issues has been developed. The method incorporates separate screens for human health impacts, socioeconomic impacts, and social structural impacts. Positive results of any screen indicates the need for full-scale, environmental-justice-related analysis of that category of impact. The screen is intended as a useful tool in implementing environmental justice in environmental impact statements.

    The paper addresses the specific empowerment needs of communities and workers fighting for environmental justice. Thousands of people of color and poor communities throughout the United States are victimized by policies and practices of environmental racism which resulted in the disproportionate burden of exposure to environmental contamination where they live, work and play. Powerful interests who own and operate polluting industries and waste disposal facilities prey on poor, low income and non-white communities because they view them as areas of least resistance and {open_quotes}sacrifice zones.{close_quotes} Leaders and members of organizations from communities threatened or already devastated by contamination are waging determined, courageous and heroic struggles against giant corporate polluters. In many instances, the leaders and members of these grassroots environmental groups are literally sick and dying from contamination as they seek to organize for clean, safe and healthy communities. A key issue for communities and workers fighting for environmental justice is realizing true empowerment. Communities and workers must develop empowerment and capacity building skills in the areas of community and labor organizing; media relations and public education; legal advocacy; legislative and regulatory tracking; lobbying; health monitoring and health services; research; scientific technical needs (eg. air, water and soil testing); fundraising and economic sustainable development; institutional and organizational development; voter education and electoral politics; and youth and adult leadership training. When these empowerment skills are combined with a clear vision of justice for the future, communities will be able to fight cooporations armed with high-powered lawyers, lobbyists, public relations firms and bought-off politicians.

    The conceptual design of Environmental Protection Systems (EPS) for the National Ignition Facility (NIF) is described. These systems encompass tritium and activated debris handling, chamber, debris shield and general decontamination, neutron and gamma monitoring, and radioactive, hazardous and mixed waste handling. Key performance specifications met by EPS designs include limiting the tritium inventory to 300 Ci and total tritium release from NIF facilities to less than 10 Ci/yr. Total radiation doses attributable to NIF shall remain below 10 mrem/yr for any member of the general public and 500 mrem/yr for NIF staff. ALARA-based design features and operational procedures will, in most cases, result in much lower measured exposures. Waste minimization, improved cycle time and reduced exposures all result from the proposed CO2 robotic arm cleaning and decontamination system, while effective tritium control is achieved through a modern system design based on double containment and the proven detritiation technology.

    The 1994 Basel Convention concluded with a historical agreement to immediately ban the export of hazardous wastes for disposal from member countries of the Organization for Economic Co-operation and Development (OECD) to non-OECD nations. The OECD nations account for approximately 98 percent of the world`s toxic waste generation. As of December 31, 1997, exports of wastes for recycling will be illegal. For many years, industrialized nations have shipped hazardous wastes to developing nations under the guise of recycling. The ban will make 90 percent of current shipments unlawful. The United States was among the industrialized OCED nations declining to partake in the agreement. In March 1994, the Waste Export and Import Control Act was introduced to Congress by a concerned coalition of Representatives. The bill would ban all exports of toxic wastes except to those nations. Critics have argued that the nature of the Agreement makes it unenforceable under certain conditions. Applied geographical techniques are employed to reveal regions where the effectiveness of the waste ban may be challenged. Formulas are developed to determine the cost-benefit ratio for non-OECD nations involved in significant levels of toxic waste trade. Political and historical analyses are applied in order to clarify the U.S. opposition to the ban. A list of predictions is offered with the future of hazardous waste transhipments within the context of the world`s ever-changing geo-political sphere. Suggestions for improving the effectiveness and enforceability of the Basel Agreement are offered for discussion.

    The ``Model National Environmental Policy Act (NEPA) Process`` includes: References to regulations, guidance documents, and plans; training programs; procedures; and computer databases. Legislative Acts and reference documents from Congress, US Department of Energy, and Lockheed Idaho Technologies Company provide the bases for conducting NEPA at the Idaho National Engineering Laboratory (INEL). Lockheed Idaho Technologies Company (LITCO) NEPA / Permitting Department, the Contractor Environmental Organization (CEO) is responsible for developing and maintaining LITCO NEPA and permitting policies, guidance, and procedures. The CEO develops procedures to conduct environmental evaluations based on NEPA, Council on Environmental Quality (CEQ) regulations, and DOE guidance. This procedure includes preparation or support of environmental checklists, categorical exclusion determinations, environmental assessment determinations, environmental assessments, and environmental impact statements. In addition, the CEO uses this information to train personnel conducting environmental evaluations at the INEL. Streamlining these procedures fosters efficient use of resources, quality documents, and better decisions on proposed actions.

    This 1993 report contains monitoring data from routine radiological and nonradiological environmental surveillance activities. Summaries of significant environmental compliance programs in progress, such as National Environmental Policy Act documentation, environmental permits, environmental restoration, and various waste management programs for Sandia National Laboratories in Albuquerque, New Mexico, are included. The maximum offsite dose impact was calculated to be 0.0016 millirem. The total population within a 50-mile (80 kilometer) radius of Sandia National Laboratories/New Mexico received an estimated collective dose of 0.027 person-rem during 1993 from the laboratories operations, As in the previous year, the 1993 operations at Sandia National Laboratories/New Mexico had no discernible impact on the general public or on the environment. This report is prepared for the U.S. Department of Energy in compliance with DOE Order 5400.1.

The Survey is being conducted by an interdisciplinary team of environmental specialists, led and managed by the Office of Environment, Safety and Health's Office of Environmental Audit. The team includes outside experts supplied by a private contractor. The objective of the Survey is to identify environmental problems and areas of environmental risk associated with ANL. The Survey covers all environmental media and all areas of environmental regulation. It is being performed in accordance with the DOE Environmental Survey Manual. The on-site phase of the Survey involves the review of existing site environmental data, observations of the operations carried on at ANL, and interviews with site personnel. The Survey team developed a Sampling and Analysis (S A) Plan to assist in further assessing certain of the environmental problems identified during its on-site activities. The S A Plan will be executed by the Oak Ridge National Laboratory (ORNL).     This report documents the results of the Environmental Monitoring Program at Brookhaven National Laboratory and summarizes information about environmental compliance for 1995. To evaluate the effect of Brookhaven National Laboratory`s operations on the local environment, measurements of direct radiation, and of a variety of radionuclides and chemical compounds in the ambient air, soil, sewage effluent, surface water, groundwater, fauna, and vegetation were made at the Brookhaven National Laboratory site and at adjacent sites. The report also evaluates the Laboratory`s compliance with all applicable guides, standards, and limits for radiological and nonradiological emissions and effluents to the environment. Areas of known contamination are subject to Remedial Investigation/Feasibility Studies under the Inter Agency Agreement established by the Department of Energy, Environmental Protection Agency and the New York Department of Environmental Conservation. Except for identified areas of soil and groundwater contamination, the environmental monitoring data has continued to demonstrate that compliance was achieved with the applicable environmental laws and regulations governing emission and discharge of materials to the environment. Also, the data show that the environmental impacts at Brookhaven National Laboratory are minimal and pose no threat to the public nor to the environment. This report meets the requirements of Department of Energy Orders 5484.1, Environmental Protection, Safety, and Health Protection Information reporting requirements and 5400.1, General Environmental Protection Programs.

    This report documents the results of the environmental management assessment performed at the National Renewable Energy Laboratory (NREL) in Golden, Colorado. The onsite portion of the assessment was conducted from September 14 through September 27, 1993, by DOE`s Office of Environmental Audit (EH-24) located within the Office of the Assistant Secretary for Environment, Safety, and Health (EH-1). During this assessment, the activities conducted by the assessment team included reviews of internal documents and reports from previous audits and assessments; interviews with US Department of Energy (DOE) and NREL contractor personnel; and inspections and observations of selected facilities and operations. The environmental management assessment of NREL focused on the adequacy of environmental management systems and assessed the formality of programs employing an approach that recognizes the level of formality implementing environmental programs may vary commensurate with non-nuclear research and development operations. The Assessment Team evaluated environmental monitoring, waste management and National Environmental Policy Act (NEPA) activities at NREL, from a programmatic standpoint. The results of the evaluation of these areas are contained in the Environmental Protection Programs section of this report. The scope of the NREL Environmental Management Assessment was comprehensive and included all areas of environmental management. At the same time, environmental monitoring, waste management, and NEPA activities were evaluated to develop a programmatic understanding of these environmental disciplines, building upon the results of previous appraisals, audits, and reviews performed at the NREL.

    Sandia National Laboratories (SNL) is committed to conducting its operations in an environmentally safe and sound manner. It is mandatory that activities at SNL/California comply with all applicable environmental statutes, regulations, and standards. Moreover, SNL/California continuously strives to reduce risks to employees, the public, and the environment to the lowest levels reasonably possible. To help verify effective protection of public safety and preservation of the environment, SNL/California maintains an extensive, ongoing environmental monitoring program. This program monitors all significant effluents and the environment at the SNL/California site perimeter. Lawrence Livermore National Laboratory (LLNL) performs off-site external radiation monitoring for both sites. These monitoring efforts ensure that emission controls are effective in preventing contamination of the environment. As part of SNL/California`s Environmental Monitoring Program, an environmental surveillance system measures the possible presence of hazardous materials in groundwater, stormwater, and sewage. The program also includes an extensive environmental dosimetry program, which measures external radiation levels around the Livermore site and nearby vicinity. The Site Environmental Report describes the results of SNL/California`s environmental protection activities during the calendar year. It also summarizes environmental monitoring data and highlights major environmental programs. Overall, it evaluates SNL/California`s environmental management performance and documents the site`s regulatory compliance status.

To evaluate the effect of Brookhaven National Laboratory`s operations on the local environment, measurements of direct radiation, and of a variety of radionuclides and chemical compounds in the ambient air, soil, sewage effluent, surface water, groundwater, fauna, and vegetation were made at the Brookhaven National Laboratory site and at adjacent sites. The report also evaluates the Laboratory`s compliance with all applicable guides, standards, and limits for radiological and non-radiological emissions and effluents to the environment.

    The Idaho National Engineering and Environmental Laboratory Environmental Technologies Proof-of-Concept Project was initiated for the expedited development of new or conceptual technologies in support of groundwater fate, transport, and remediation; buried waste characterization, retrieval, and treatment; waste minimization/pollution prevention; and spent fuel handling and storage. In Fiscal Year 1996, The Idaho National Engineering and Environmental Laboratory proposed 40 development projects and the Department of Energy funded 15. The projects proved the concepts of the various technologies, and all the technologies contribute to successful environmental management.

    Sandia National Laboratories/New Mexico (SNL/NM) is operated in support of the U.S. Department of Energy (DOE) mission to provide weapon component technology and hardware for national security needs, and to conduct fundamental research and development (R&D) to advance technology in energy research, computer science, waste management, electronics, materials science, and transportation safety for hazardous and nuclear components.     Sandia National Laboratories, Environmental Programs completed an environmental baseline survey (EBS) of 12.6 acres located at Sandia National Laboratories/California (SNL/CA) in support of the proposed Collaboration in Research and Engineering for Advanced Technology and Education (CREATE) Facility. The survey area is comprised of several parcels of land within SNL/CA, County of Alameda, California. The survey area is located within T 3S, R 2E, Section 13. The purpose of this EBS is to document the nature, magnitude, and extent of any environmental contamination of the property; identify potential environmental contamination liabilities associated with the property; develop sufficient information to assess the health and safety risks; and ensure adequate protection for human health and the environment related to a specific property.

    The National Environmental Policy Act of 1969 (NEPA) sets forth national policy for the protection of the environment. The NEPA process is intended to help officials of the federal government make decisions that are based on an understanding of environmental consequences, and take actions that protect, restore, and enhance the environment. The California Environmental Quality Act of 1970 (CEQA) is similar to NEPA. The California legislature established CEQA to inform both state and local governmental decision-makers and the public about potential significant environmental effects of proposed activities, to identify ways to avoid or reduce environmental impacts, and to disclose to the public the reasons why a project is approved if significant environmental effects are involved. Lawrence Berkeley Laboratory (LBL), complies with the provisions of both NEPA and CEQA. This document defines the responsibilities and authorities for NEPA/CEQA compliance at LBL.
