    The methodology and computer model described here were developed to analyze the cash flows for the federal government taking title to and managing spent nuclear fuel. The methodology has been used by the US Department of Energy (DOE) to estimate the spent fuel disposal fee that will provide full cost recovery. Although the methodology was designed to analyze interim storage followed by spent fuel disposal, it could be used to calculate a fee for reprocessing spent fuel and disposing of the waste. The methodology consists of two phases. The first phase estimates government expenditures for spent fuel management. The second phase determines the fees that will result in revenues such that the government attains full cost recovery assuming various revenue collection philosophies. These two phases are discussed in detail in subsequent sections of this report. Each of the two phases constitute a computer module, called SPADE (SPent fuel Analysis and Disposal Economics) and FEAN (FEe ANalysis), respectively.

    The Office of Procurement and Assistance Management has proposed changes to the method used to annually calculate and negotiate ``for profit`` management and operating contractor available fees. This proposal will increase contractor fees in exchange for the contractor`s purported assumption of additional risk. In 1991, the Department, through the Accountability Rule, increased contractor fees as an incentive to improve contractor performance and accountability. Despite the lack of measurable benefits of this effort, the Department is crafting a new fee policy which will, depending upon how it is executed, increase fees above the amount provided through the Accountability Rule as an incentive to the Department`s management and operating contractors. The objective of the audit was to determine whether the Department`s proposed change to the fee structure for determining management and operating contractor fees will be cost effective. This report describes the study`s approach, its findings and recommendations, management and auditor comments, and includes appendices with further data.

  12. U.S. Department of Energy Office of Inspector General report on inspection of Westinghouse Savannah River Company fees for managing and operating the Savannah River Site

    During the first five years of its contract with the Department of Energy, Westinghouse Savannah River Company was paid over $130 million in fees to manage and operate the Savannah River Site. Fees paid to Westinghouse steadily increased over the five year period. For example, fees paid for the last six months of this five year period were over three times as large as fees paid for the first six months. The purpose of this inspection was to review the Department`s annual negotiation of total available fees with Westinghouse, and to examine the reasons for the growth in fees over this five year period. The review disclosed that, after Fiscal Year 1989, the Department used an increasing number of fee bases in calculating Westinghouse Savannah River Company`s fixed-fee-equivalents from the maximum fee schedules within the Department of Energy Acquisition Regulation. The authors found that the Department had significantly increased the percentage of the dollar value of subcontracts being placed in Westinghouse`s fee bases for fee calculation purposes. They found that the Department had effectively increased Westinghouse`s fixed-fee-equivalents by approximately $3 million in both Fiscal Year 1993 and 1994 to, in large part, fund an unallowable employee incentive compensation program. They found that Westinghouse`s total paid fees for the five year period increased significantly over what they would have been had the terms resulting from the original competitive negotiations been maintained. The authors recommended that the Deputy Assist Secretary for Procurement and Assistance Management require that changes in either the number or composition of fee bases used in calculating fees from the maximum fee schedules be submitted to the Department`s Procurement Executive for approval.

    As the penetration of variable generation (wind and solar) increases around the world, there is an accompanying growing interest and importance in accurately assessing the contribution that these resources can make toward planning reserve. This contribution, also known as the capacity credit or capacity value of the resource, is best quantified by using a probabilistic measure of overall resource adequacy. In recognizing the variable nature of these renewable resources, there has been interest in exploring the use of reliability metrics other than loss of load expectation. In this paper, we undertake some comparisons using data from the Western Electricity Coordinating Council in the western United States.

    To provide a consistent Department of Energy approach on the disclosure of award fee and incentive fee reports (fee determination reports) for management and operating contracts and other major contracts at the Department’s sites, the Department will, in the near future, be implementing the following policy: programs shall, at a minimum, publish a one-page score card for each contractor summarizing the fee determination and release the fee determination report upon request. However, programs will only release the fee determination report to the public after appropriate redactions are made. The Department’s Senior Procurement Executives, in consultation with the Heads of Contracting Activities and the Office of General Counsel, intend to develop and issue the policy shortly.

    Fiscal Year 1999 represents the third fill year utilizing a results-oriented, performance-based evaluation for the Contractor's operations and management of the DOE Pacific Northwest National Laboratory (here after referred to as the Laboratory). However, this is the first year that the Contractor's fee is totally performance-based utilizing the same Critical Outcomes. This document describes the critical outcomes, objectives, performance indicators, expected levels of performance, and the basis for the evaluation of the Contractor's performance for the period October 1, 1998 through September 30, 1999, as required by Clauses entitled ''Use of Objective Standards of Performance, Self Assessment and Performance Evaluation'' and ''Performance Measures Review'' of the Contract DE-ACO6-76RL01830. Furthermore, it documents the distribution of the total available performance-based fee and the methodology set for determining the amount of fee earned by the Contractor as stipulated within the causes entitled ''Estimated Cost and Annual Fee,'' ''Total Available Fee'' and ''Allowable Costs and Fee.'' In partnership with the Contractor and other key customers, the Department of Energy (DOE) Headquarters (HQ) and Richland Operations Office (RL) has defined four critical outcomes that serve as the core for the Contractor's performance-based evaluation and fee determination. The Contractor also utilizes these outcomes as a basis for overall management of the Laboratory.

  6. Recent Trends in the Adequacy of Nuclear Plant Decommissioning Funding

    Concerned about the potential cost and sufficiency of funds to decommission the nation's nuclear power plants, the Congress asked the U.S. General Accounting Office (GAO) to assess the adequacy, as of December 31, 1997, of electric utilities'; funds to eventually decommission their plants. GAO's report (GAO/RCED-99-75) on this issue addressed three alternative assumption scenarios--baseline (most likely), optimistic, and pessimistic; and was issued in May 1999. This paper updates GAO's baseline assessment of fund adequacy in 1997, and extends the analysis through 2000. In 2000, we estimate that the present value cost to decommission the nation's nuclear plants is about $35 billion; utility fund balances are about $29 billion. Both our two measures of funding adequacy for utilities are on average not only much above ideal levels, but also overall have greatly improved since 1997. However, certain utilities still show less than ideal fund balances and annual contributions. We suggest that the range of these results among the individual utilities is a more important policy measure to assess the adequacy of decommissioning funding than is the funding adequacy for the industry as a whole.

    This project is part of the National Network for Environmental Management Studies conducted under the auspices of the Office of Cooperative Environmental Management - U.S. Environmental Protection Agency. With the phasing out of EPA's construction grants program and the implementation of State Revolving Funds (SRF's), it appears that more money will be needed for the financing of waste-water treatment facilities in the next twenty years. Infrastructure needs for waste-water treatment facilities will increase significantly due to required replacement and upgrading needs, while user fees may be significantly understated due to years of capital subsidies. With Federal seed capital for the SRF's stopping after 1994, alternative sources of funding will be necessary. An effluent fee program could both offer a way to make the polluter pay and provide a reliable financing mechanism for the SRF's. The paper discusses the experience of effluent fees in Europe, and proposes an effluent fee program that would provide needed capital to the State Revolving Fund. The fee would be tied into the National Pollutant Discharge Elimination System permits through gradual implementation. Various options for setting the fee and enforcement procedures are also discussed.

    Traditional probabilistic methods have been used to evaluate resource adequacy. The increasing presence of variable renewable generation in power systems presents a challenge to these methods because, unlike thermal units, variable renewable generation levels change over time because they are driven by meteorological events. Thus, capacity value calculations for these resources are often performed to simple rules of thumb. This paper follows the recommendations of the North American Electric Reliability Corporation?s Integration of Variable Generation Task Force to include variable generation in the calculation of resource adequacy and compares different reliability metrics. Examples are provided using the Western Interconnection footprint under different variable generation penetrations.

    Variable generation is on track to become a significant contributor to electric power systems worldwide. Thus, it is important to analyze the effect that renewables will have on the reliability of systems. In this paper we present a new tool being implemented at the National Renewable Energy Laboratory, which allows the inclusion of variable generation in the power system resource adequacy. The tool is used to quantify the potential contribution of transmission to reliability in highly interconnected systems and an example is provided using the Western Interconnection footprint.

    The Exxon Valdez spill abruptly brought to the nation's attention the risks of transporting crude oil. While oil tanker transportation received many of the headlines, the safety of pipelines carrying oil and the terminals that store it have also been called into question. GAO testified on the adequacy of regulatory oversight of the 800-mile Trans-Alaska Pipeline System and the terminal at Valdez, Alaska. This paper reports increased and coordinated regulatory oversight as a major component of an effective operational and emergency response strategy for the pipeline. The current lack of comprehensive and systematic oversight is of particular concern because of recent revelations of significant corrosion problems in the pipeline.

    ABSTRACT Demonstrating the structural integrity of U.S. nuclear power plant (NPP) containment structures, for beyond design-basis internal pressure loadings, is necessary to satisfy Nuclear Regulatory Commission (NRC) requirements and performance goals. This paper discusses methods for demonstrating the structural adequacy of the containment for beyond design-basis pressure loadings. Three distinct evaluations are addressed: (1) estimating the ultimate pressure capacity of the containment structure (10 CFR 50 and US NRC Standard Review Plan, Section 3.8) ; (2) demonstrating the structural adequacy of the containment subjected to pressure loadings associated with combustible gas generation (10 CFR 52 and 10 CFR 50); and (3) demonstrating the containment structural integrity for severe accidents (10 CFR 52 as well as SECY 90-016, SECY 93-087, and related NRC staff requirements memoranda (SRMs)). The paper describes the technical basis for specific aspects of the methods presented. It also presents examples of past issues identified in licensing activities related to these evaluations.

    In the early 1980s, the US Department of Energy/Defense Programs (DOE/DP) initiated a project to develop a safe and efficient transportation system for defense high level waste (DHLW). A long-standing objective of the DHLW transportation project is to develop a truck cask that represents the leading edge of cask technology as well as one that fully complies with all applicable DOE, Nuclear Regulatory Commission (NRC), and Department of Transportation (DOT) regulations. General Atomics (GA) designed the DHLW Truck Shipping Cask using state-of-the-art analytical techniques verified by model testing performed by Sandia National Laboratories (SNL). The analytical techniques include two approaches, inelastic analysis and elastic analysis. This topical report presents the results of the two analytical approaches and the model testing results. The purpose of this work is to show that there are two viable analytical alternatives to verify the structural adequacy of a Type B package and to obtain an NRC license. It addition, this data will help to support the future acceptance by the NRC of inelastic analysis as a tool in packaging design and licensing.

The disposal costs of four facilities are reviewed in this report, two operating facilities and two planned facilities. The operating facilities are located at Barnwell, South Carolina, and Richland, Washington. They are operated by Chem-Nuclear, LLC, (Chem-Nuclear), and US Ecology, Inc., (US Ecology), respectively. The planned facilities are expected to be built at Ward Valley, California, and Sierra Blanca, Texas. They will be operated by US Ecology and the State of Texas, respectively. This report found that disposal fees vary significantly among facilities for a variety of reasons. However, the information suggests that at each disposal facility, LLW generators pay equitable disposal fees.

    Waste treatment facilities are often shared among different municipalities as a means of managing wastes more efficiently. Usually, management costs are assigned to each municipality depending on the size of the population or total amount of waste produced, regardless of important environmental aspects such as per capita waste generation or achievements in composting or recycling. This paper presents a feebate (fee+rebate) system aimed to foster urban waste reduction and recovery. The proposal suggests that municipalities achieving better results in their waste management performance (from an ecological viewpoint) be recompensated with a rebate obtained from a fee charged to those municipalities that are less environmentally sound. This is a dynamic and flexible instrument that would positively encourage municipalities to reduce waste whilst increasing the recycling.

  11. Review and analysis of the adequacy of the legal and institutional framework for geothermal development in Washington State

    The legal and institutional framework within which geothermal energy must develop has its origin in the early 1970s. In 1970, the Federal Geothermal Steam Act was passed into law and in 1974 the Washington State Geothermal Act was passed. The legal and institutional framework thus established by the state and federal governments differed substantially in format, content, and direction. In many instances, the legal and institutional framework established left as many questions unanswered as answered, and in some cases, the framework has proven to be more of an obstacle to development than an aid. From an examination of how the state and federal governments have addressed the varying needs of geothermal development and how the courts have interpreted some of their decisions, it is clear that in order to ensure that the legal and institutional framework is adequate to serve the needs of geothermal development, it must address, at a minimum, the following topics: (1) providing developers with access and a priority right to carry out exploration and development activities; (2) characterization of the resource so as to minimize conflicts with other natural resources; (3) establishing ownership; and (4) giving careful consideration to such lease terms as rentals and royalties, lease renewals, and diligence requirements. In addition, the framework must address groundwater law and its implications for geothermal development and how geothermal development will be considered in terms of establishing utility law. At the local level, it is imperative that geothermal be given careful consideration when decisions on resource management, zoning, and regulation are made. Local governments also have the power to establish programs which can provide substantial incentives for geothermal development and, by so doing, ensure that geothermal energy contributes to economic stability and growth.

    This report documents the technical evaluation of the adequacy of the station electric distribution system voltages for the Prairie Island Nuclear Generating Plant, Units 1 and 2. The evaluation is to determine if the onsite distribution system in conjunction with the offsite power sources has sufficient capacity to automatically start and operate all Class 1E loads within the equipment voltage ratings under certain conditions established by the Nuclear Regulatory Commission. The evaluation finds that with some minor transformer loading modifications, hardware changes and the results of equipment testing and manufacturer data, the offsite sources were demonstrated to supply adequate voltage to the Class 1E equipment under worst case conditions.

    Department of Energy (DOE) Policy (P) 450.4, Safety Management System Policy, commits to institutionalizing an Integrated Safety Management System (ISMS) throughout the DOE complex. The DOE Acquisition Regulations (DEAR 48 CFR 970) requires contractors to manage and perform work in accordance with a documented Integrated Safety Management System. The Manager, Richland Operations Office (RL), initiated a combined Phase 1 and Phase 2 Integrated Safety Management Verification review to confirm that PNNL had successfully submitted a description of their ISMS and had implemented ISMS within the laboratory facilities and processes. A combined review was directed by the Manager, RL, based upon the progress PNNL had made in the implementation of ISM. This report documents the results of the review conducted to verify: (1) that the PNNL integrated safety management system description and enabling documents and processes conform to the guidance provided by the Manager, RL; (2) that corporate policy is implemented by line managers; (3) that PNNL has provided tailored direction to the facility management; and (4) the Manager, RL, has documented processes that integrate their safety activities and oversight with those of PNNL. The general conduct of the review was consistent with the direction provided by the Under Secretary`s Draft Safety Management System Review and Approval Protocol. The purpose of this review was to provide the Manager, RL, with a recommendation to the adequacy of the ISMS description of the Pacific Northwest Laboratory based upon compliance with the requirements of 49 CFR 970.5204(-2 and -78); and, to provide an evaluation of the extent and maturity of ISMS implementation within the Laboratory. Further, this review was intended to provide a model for other DOE Laboratories.     This document contains the results of the Environmental Management Assessment of the Waste Isolation Pilot Plant (WIPP). This Assessment was conducted by EH-24 from July 19 through July 30, 1993 to advise the Secretary of Energy of the adequacy of management systems established at WIPP to ensure the protection of the environment and compliance with Federal, state, and DOE environmental requirements. The mission of WIPP is to demonstrate the safe disposal of transuranic (TRU) waste. During this assessment, activities and records were reviewed and interviews were conducted with personnel from the management and operating contractors. The U.S. Department of Energy National Nuclear Security Administration Nevada Site Office performed annual reviews in fiscal year (FY) 2004 by evaluating operational factors and research results that impact the continuing validity of the PA and CA results. This annual summary report presents data and conclusions from the FY 2004 review, and determines the adequacy of the PAs and CAs.     This report documents the results of the environmental management assessment performed at the National Renewable Energy Laboratory (NREL) in Golden, Colorado. The onsite portion of the assessment was conducted from September 14 through September 27, 1993, by DOE`s Office of Environmental Audit (EH-24) located within the Office of the Assistant Secretary for Environment, Safety, and Health (EH-1). During this assessment, the activities conducted by the assessment team included reviews of internal documents and reports from previous audits and assessments; interviews with US Department of Energy (DOE) and NREL contractor personnel; and inspections and observations of selected facilities and operations. The environmental management assessment of NREL focused on the adequacy of environmental management systems and assessed the formality of programs employing an approach that recognizes the level of formality implementing environmental programs may vary commensurate with non-nuclear research and development operations. The Assessment Team evaluated environmental monitoring, waste management and National Environmental Policy Act (NEPA) activities at NREL, from a programmatic standpoint. The results of the evaluation of these areas are contained in the Environmental Protection Programs section of this report. The scope of the NREL Environmental Management Assessment was comprehensive and included all areas of environmental management. At the same time, environmental monitoring, waste management, and NEPA activities were evaluated to develop a programmatic understanding of these environmental disciplines, building upon the results of previous appraisals, audits, and reviews performed at the NREL.

Black-Right-Pointing-Pointer Policy action is required in order to advance in the consecution of these principles. - Abstract: In this paper, the material and spatial characterization of the flows within a municipal solid waste (MSW) management system are combined through a Network-Based Spatial Material Flow Analysis. Using this information, two core indicators are developed for the bio-waste fraction, the Net Recovery Index (NRI) and the Transport Intensity Index (TII), which are aimed at assessing progress towards policy-related sustainable MSW management strategies and objectives. The NRI approaches the capacity of a MSW management system for converting waste into resources through a systematic metabolic approach, whereas the TII addresses efficiency in terms of the transport requirements to manage a specific waste flow throughout the entire MSW management life cycle. Therefore, both indicators could be useful in assessing key MSW management policy strategies, such as the consecution of higher recycling levels (sustainability principle) or the minimization of transport by locating treatment facilities closer to generation sources (proximity principle). To apply this methodological approach, the bio-waste management system of the region of Catalonia (Spain) has been chosen as a case study.     A complete scheme of scaling methods to design the reduced-height, reduced-pressure (RHRP) Institute of Nuclear Energy Research Integral System Test (IIST) facility and to specify test conditions for incident simulation was developed. In order to preserve core decay power history and coolant mass inventory during a transient, a unique power-to-mass scaling method is proposed and utilized for RHRP and full-height, full-pressure (FHFP) systems. To validate the current scaling method, three counterpart tests done at the IIST facility are compared with the FHFP tests in small-break loss-of-coolant, station blackout, and loss-of-feedwater accidents performed at the Large-Scale Test Facility (LSTF) and the BETHSY test facility. Although differences appeared in design, scaling, and operation conditions among the IIST, LSTF, and BETHSY test facilities, the important physical phenomena shown in the facilities are almost the same. The physics involved in incident transient phenomena are well measured and modeled by showing the common thermal-hydraulic behavior of key parameters and the general consistency of chronological events. The results also confirm the adequacy of power-to-mass scaling methodology.

    Following graduation from a college or university with a technical degree, or through years of experience, an individual's training and career development activities typically focus on enhancing technical problem-solving skills. However, as these technical professionals, herein referred to as 'Techies', advance throughout their careers, they may be required to accept and adapt to the role of being a manager, and must undergo a transition to learn and rely on new problem-solving skills. However, unless a company has a specific manager-trainee class to address this subject and develop talent from within, an employee's management style is learned and developed 'on the job'. Both positive and negative styles are nurtured by those managers having similar qualities. Unfortunately, a negative style often contributes to the deterioration of employee morale and ultimate closing of a department or company. This paper provides the core elements of an effective management training program for 'Teaching Managers How to Manage' derived from the Department of Energy's Integrated Safety Management System and the Occupational Safety and Health Administration 's Voluntary Protection Program. Discussion topics and real-life examples concentrate on transitioning an employee from a 'Techie' to a manager; common characteristics of being a manager; the history and academic study of management; competition, change and the business of waste management; what to do after taking over a department by applying Hylko's Star of Success; command media; the formal and informal organizational charts; chain of command; hiring and developing high-degree, autonomous employees through effective communication and delegation; periodic status checks; and determining if the program is working successfully. These common characteristics of a strong management/leadership culture and practical career tips discussed herein provide a solid foundation for any company or department that is serious about developing

  13. Program management assessment of Federal Facility Compliance Agreement regarding CAA-40 C.F.R. Part 61, Subpart H at the Los Alamos National Laboratory

    An assessment of Los Alamos National Laboratory`s management system related to facility compliance with an element of the Clean Air Act was performed under contract by a team from Northern Arizona University. More specifically, a Federal Facilities Compliance Agreement (FFCA) was established in 1996 to bring the Laboratory into compliance with emissions standards of radionuclides, commonly referred to as Rad/NESHAP. In the fall of 1996, the four-person team of experienced environmental managers evaluated the adequacy of relevant management systems to implement the FFCA provisions. The assessment process utilized multiple procedures including document review, personnel interviews and re-interviews, and facility observations. The management system assessment was completed with a meeting among team members, Laboratory officials and others on November 1, 1996 and preparation of an assessment report.

    This Current Year Work Plan presents in detail a description of the activities to be performed by the Joint Integration Office Rockwell International (JIO/RI) during FY86. It breaks down the activities into two major work areas: Program Management and Program Analysis. Program Management is performed by the JIO/RI by providing technical planning and guidance for the development of advanced TRU waste management capabilities. This includes equipment/facility design, engineering, construction, and operations. These functions are integrated to allow transition from interim storage to final disposition. JIO/RI tasks include program requirements identification, long-range technical planning, budget development, program planning document preparation, task guidance development, task monitoring, task progress information gathering and reporting to DOE, interfacing with other agencies and DOE lead programs, integrating public involvement with program efforts, and preparation of reports for DOE detailing program status. Program Analysis is performed by the JIO/RI to support identification and assessment of alternatives, and development of long-term TRU waste program capabilities. These analyses include short-term analyses in response to DOE information requests, along with performing an RH Cost/Schedule Optimization report. Systems models will be developed, updated, and upgraded as needed to enhance JIO/RI's capability to evaluate the adequacy of program efforts in various fields. A TRU program data base will be maintained and updated to provide DOE with timely responses to inventory related questions.

    Another key aspect of the NNSS mission is Environmental Management program, which addresses the environmental legacy from historic nuclear weapons related activities while also ensuring the health and safety of present day workers, the public, and the environment as current and future missions are completed. The Area 5 Radioactive Waste Management site receives low-level and mixed low-level waste from some 28 different generators from across the DOE complex in support of the legacy clean-up DOE Environmental Management project. Without this capability, the DOE would not be able to complete the clean up and proper disposition of these wastes. The program includes environmental protection, compliance, and monitoring of the air, water, plants, animals, and cultural resources at the NNSS. Investigation and implementation of appropriate corrective actions to address the contaminated ground water facilities and soils resulting from historic nuclear testing activities, the demolition of abandoned nuclear facilities, as well as installation of ground water wells to identify and monitor the extent of ground water contamination.

Bahir Dar in northwestern Ethiopia outsourced municipal waste services to a private waste company in 2008. While this institutional change has led to substantial improvement in the cleanliness of the city, its financial sustainability remains unclear. Is the private company able to generate sufficient revenues from their activities to offset the costs and generate some profit? This paper presents a cost-revenue analysis, based on data from July 2009 to June 2011. The analysis reveals that overall costs in Bahir Dar’s SWM system increased significantly during this period, mainly due to rising costs related to waste transportation. On the other hand, there is only one major revenue stream in place: the waste collection fee from households, commercial enterprises and institutions. As the efficiency of fee collection from households is only around 50%, the total amount of revenues are not sufficient to cover the running costs. This results in a substantial yearly deficit. The results of the research therefore show that a more detailed cost structure and cost-revenue analysis of this waste management service is important with appropriate measures, either by the privates sector itself or with the support of the local authorities, in order to enhance cost efficiency and balance the cost-revenues towards cost recovery.     The Confederated Tribes of Warm Springs Reservation of Oregon (Tribes) acquired the Forrest Conservation Area during July of 2002. The property is located in the Upper John Day subbasin within the Columbia basin. The property consists of two parcels comprising 4,232 acres. The Mainstem parcel consists of 3,445 acres and is located 1/2 mile to the east of Prairie City, Oregon on the mainstem John Day River. The Middle Fork parcel consists of 786 acres and is located one mile to the west of the town of Austin, OR on the Middle Fork John Day River. The Forrest Conservation Area is under a memorandum of agreement with the Bonneville Power Administration (BPA) to provide an annual written report generally describing the real property interests of the project and management activities undertaken or in progress. Acquisition of the Forrest Conservation Area was funded by BPA as part of their program to protect, mitigate, and enhance fish and wildlife habitat affected by hydroelectric facilities on the Columbia River and its tributaries. The intent of the Conservation Area is to partially mitigate fish and wildlife impacts for the John Day Dam on the Columbia River as outlined in the Northwest Power Planning Council's Wildlife Program (NPPC 1994, {section}11.1, {section}7.6). While the Tribes hold fee-title to the property, the BPA has assured a level of management funding for the protection and restoration of fish and wildlife habitat through a memorandum of agreement.
