    Washington River Protection Solutions, LLC (WRPS) has faced significant project management challenges in managing Davis-Bacon construction work that meets contractually required small business goals. The unique challenge is to provide contracting opportunities to multiple small business constructioin subcontractors while performing high hazard work in a safe and productive manner. Previous to the WRPS contract, construction work at the Hanford Tank Farms was contracted to large companies, while current Department of Energy (DOE) Contracts typically emphasize small business awards. As an integral part of Nuclear Project Management at Hanford Tank Farms, construction involves removal of old equipment and structures and installation of new infrastructure to support waste retrieval and waste feed delivery to the Waste Treatment Plant. Utilizing the optimum construction approach ensures that the contractors responsible for this work are successful in meeting safety, quality, cost and schedule objectives while working in a very hazardous environment. This paper descirbes the successful transition from a traditional project delivery method that utilized a large business general contractor and subcontractors to a new project construction management model that is more oriented to small businesses. Construction has selected the Agency Construction Management Method (John E Schaufelberger, Len Holm, "Management of Construction Projects, A Constructor's Perspective", University of Washington, Prentice Hall 2002). This method was implemented in the first quarter of Fiscal Year 2009 (FY2009), where Construction Management is performed by substantially home office resources from the URS Northwest Office in Richland, Washington. The Agency Method has allowed WRPS to provide proven Construction Managers and Field Leads to mentor and direct small business contractors, thus providing expertise and assurance of a successful project. Construction execution contracts are subcontracted directly by WRPS to small or disadvantaged contractors that are mentored and supported by URS personnel. Each small contractor is mentored and supported utilizing the principles of the Construction Industry Institute (CII) Partnering process. Some of the key mentoring and partnering areas that are explored in this paper are, internal and external safety professional support, subcontractor safety teams and the interface with project and site safety teams, quality assurance program support to facilitate compliance with NQA-1, construction, team roles and responsibilities, work definition for successful fixed price contracts, scheduling and interface with project schedules and cost projection/accruals. The practical application of the CII Partnering principles, with the Construction Management expertise of URS, has led to a highly successful construction model that also meets small business contracting goals.

This is the primary mission of the Risk Assessment and Management Commission (Risk Commission). The Clean Air Act Amendments of 1990 (CAAA), created the Risk Commission reflecting Congress' concern over agency use of risk assessment and risk management techniques and methodologies to implement federal laws protective of human health.     This report presents results from a program evaluation of the U.S. Department of Energy?s Buildings Technologies Program (BTP) participation in collaborative international technology implementing agreements. The evaluation was conducted by researchers from the Pacific Northwest National Laboratory and the Lawrence Berkeley National Laboratory in the fall of 2007 and winter 2008 and was carried out via interviews with stakeholders in four implementing agreements in which BTP participates, reviews of relevant program reports, websites and other published materials. In addition to these findings, the report includes a variety of supporting materials such that aim to assist BTP managers who currently participate in IEA implementing agreements or who may be considering participation.

    With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances.     This grant project was a major step toward completion of the Risk Based Data Management System (RBDMS) project. Additionally the project addresses the needs identified during the projects initial phases. By implementing this project, the following outcomes were sought: (1) State regulatory agencies implemented more formalized environmental risk management practices as they pertain to the production of oil and gas, and injection via Class II wells. (2) Enhancement of oil and gas production by implementing a management system supporting the saving of abandoned or idle wells located in areas with a relatively low environmental risk of endangering underground sources of drinking water (USDWs) in a particular state. (3) Verification that protection of USDWs is adequate and additional restrictions of requirements are not necessary in areas with a relatively low environmental risk. (4) Standardization of data and information maintained by state regulatory agencies and decrease the regulatory cost burden on producers operating in multiple states, and (5) Development of a system for electronic data transfer among operators and state regulatory agencies and reduction of overall operator reporting burdens.

    Energy economists have long argued the benefits of real time pricing (RTP) of electricity. Their basis for modeling customers response to short-term fluctuations in electricity prices are based on theories of rational firm behavior, where management strives to minimize operating costs and optimize profit, and labor, capital and energy are potential substitutes in the firm's production function. How well do private firms and public sector institutions operating conditions, knowledge structures, decision-making practices, and external relationships comport with these assumptions and how might this impact price response? We discuss these issues on the basis of interviews with 29 large (over 2 MW) industrial, commercial, and institutional customers in the Niagara Mohawk Power Corporation service territory that have faced day-ahead electricity market prices since 1998. We look at stories interviewees told about why and how they respond to RTP, why some customers report that they can't, and why even if they can, they don't. Some firms respond as theorized, and we describe their load curtailment strategies. About half of our interviewees reported that they were unable to either shift or forego electricity consumption even when prices are high ($0.50/kWh). Reasons customers gave for why they weren't price-responsive include implicit value placed on reliability, pricing structures, lack of flexibility in adjusting production inputs, just-in-time practices, perceived barriers to onsite generation, and insufficient time. We draw these observations into a framework that could help refine economic theory of dynamic pricing by providing real-world descriptions of how firms behave and why.

    The International Energy Agency's emergency oil sharing system is designed to enable member nations to share oil supplied during an oil supply disruption equal to or exceeding 7 percent or more of members' oil supplies. However, participation could have anticompetitive consequences and under U.S. antitrust laws could result in suits against U.S. companies. To ensure participation of major U.S. oil companies, legislation provides a statutory defense against any civil or criminal suit brought under federal or state antitrust laws for some actions. This report describes efforts to expand the antitrust and breach of contract defenses for oil company supply transactions during an oil emergency and to resolve the problem of foreign blockage of information critical to U.S. antitrust review of oil transactions involving foreign affiliates of U.S. companies.

    Two Western groups - Shell and a consortium made up of Agip, Conoco, and Total - have offered to buy the refining operations of Chemopetrol Litvinov and Kaucuk Kralupy, both in the Czech republic. Meanwhile, Amoco, Neste, and PCD are looking at the possibility of acquiring some of the plastics plants at Litvinov. Amoco is interested in the polypropylene operations, Neste in polyethylene, and PCD in both. The two Czech firms are included in the second wave of privatization, which will begin in midyear. So far, there have been no offers for the 80,000-m.t./year polystyrene and 60,000-m.t./year styrene butadiene rubber operations belonging to Kralupy, although Atochem representatives recently visited the plants. Litvinov is carrying out revamping operations at its core unit, a 12-year-old, 450,000-m.t./year ethylene plant. The plant, currently running at 400,000 m.t./year, supplies downstream plants, Neratovice, and sells on the export markets. An existing ethylene pipeline between Litvinov and Bohlen in eastern Germany, which used to supply an average 100,000 m.t./year of ethylene to Bohen in exchange for naphtha, is virtually unused. One proposal involves reactivating this exchange to secure ethylene feedstock for plants in eastern Germany. According to some sources, a preliminary decision has been made to shut down the 100,000-m.t./year ethylene plant at Leuna and possibly to expand the Bohlen cracker by 100,000 m.t./year, to 400,000 m.t./year by the late 1990s.

    The Hanford Site has hosted similar activities, including both Hanford Summits I and II. The Hanford Summits were two-day televised events to discuss the commitment of the current Presidential administration to the environmental restoration of the Hanford Site. Public involvement and strategic issues established from Hanford Summit I include: Regulatory issues, training and education, economic development and partnership, and technology transfer. Hanford Summit II provided a summary of how Secretary of Energy O`Leary is proceeding on the above strategic issues. The DOE and Westinghouse School for Environmental Excellence frequently offers a six-week course for environmental professionals and workers. Approximately thirty to forty individuals attend the training course, which provides training in environmental regulation compliance. The Hanford Site has hosted two previous International Atomic Energy Agency training courses. The courses lasted two weeks and had approximately eight to ten participants. Nuclear Material Management and Neutron Monitoring were the courses hosted by the Hanford Site.

    In addition to management of the Water Budget, the Water Budget Managers and FPC staff developed and directed the Smolt Monitoring and Water Budget Evaluation Programs of Section 304(d) of the Fish and Wildlife Program. The fishery agencies and tribes also authorized the Water Budget Managers to coordinate agency and tribal system operational requests throughout the year, including spill management for fish passage. This report summarizes Water Budget Manager activities in implementing program measures, including 1986 flow conditions, water budget usage and spill management, and the in-season management portion of the 1986 Smolt Monitoring Program including data management.

The purpose of this document is to describe how the DOE-Richland Operations (DOE-RL) will meet those responsibilities on the Hanford Site, pursuant to guidelines for Agency Responsibilities under the Historic Preservation Act (FR 53:31, February 17, 1988). This document is intended for multiple uses.     Following graduation from a college or university with a technical degree, or through years of experience, an individual's training and career development activities typically focus on enhancing technical problem-solving skills. However, as these technical professionals, herein referred to as 'Techies', advance throughout their careers, they may be required to accept and adapt to the role of being a manager, and must undergo a transition to learn and rely on new problem-solving skills. However, unless a company has a specific manager-trainee class to address this subject and develop talent from within, an employee's management style is learned and developed 'on the job'. Both positive and negative styles are nurtured by those managers having similar qualities. Unfortunately, a negative style often contributes to the deterioration of employee morale and ultimate closing of a department or company. This paper provides the core elements of an effective management training program for 'Teaching Managers How to Manage' derived from the Department of Energy's Integrated Safety Management System and the Occupational Safety and Health Administration 's Voluntary Protection Program. Discussion topics and real-life examples concentrate on transitioning an employee from a 'Techie' to a manager; common characteristics of being a manager; the history and academic study of management; competition, change and the business of waste management; what to do after taking over a department by applying Hylko's Star of Success; command media; the formal and informal organizational charts; chain of command; hiring and developing high-degree, autonomous employees through effective communication and delegation; periodic status checks; and determining if the program is working successfully. These common characteristics of a strong management/leadership culture and practical career tips discussed herein provide a solid foundation for any company or department that is serious about developing an effective management training program for its employees. In turn, any employee in any work environment can begin using this information immediately if they want to become a better manager. (authors)

    Cultural resources management and historic preservation compliance are best approached within the broader framework of natural resources planning and land management. Argonne National Laboratory is currently assisting federal agencies with the development of computer- based resource management systems for large facilities, and cultural resources management and preservation are components of these systems. In the area of cultural resources, Argonne is using the GIS tool to demonstrate how federal facilities can manage large, complex databases, integrate cultural resource data with other environmental variables, model distributions of resources to aid in inventory and evaluation, link the data to quantitative and impact modes, and effectively manage and monitor resource planning activities and environmental compliance.

    The Resource Conservation and Recovery Act (RCRA) of 1976 and its subsequent amendments have had a dramatic impact on hazardous waste management for business and industry. The complexity of this law and the penalties for noncompliance have made it one of the most challenging regulatory programs undertaken by the Environmental Protection Agency (EPA). The fundamentals of RCRA include ``cradle to grave`` management of hazardous waste, covering generators, transporters, and treatment, storage, and disposal facilities. The regulations also address extensive definitions and listing/identification mechanisms for hazardous waste along with a tracking system. Treatment is favored over disposal and emphasis is on ``front-end`` treatment such as waste minimization and pollution prevention. A study of large corporations such as Xerox, 3M, and Dow Chemical, as well as the public sector, has shown that well known and successful hazardous waste management programs emphasize pollution prevention and employment of techniques such as proactive environmental management, environmentally conscious manufacturing, and source reduction. Nearly all successful hazardous waste programs include some aspects of Total Quality Management, which begins with a strong commitment from top management. Hazardous waste management at the Rocky Flats Plant is further complicated by the dominance of ``mixed waste`` at the facility. The mixed waste stems from the original mission of the facility, which was production of nuclear weapons components for the Department of Energy (DOE). A Quality Assurance Program based on the criterion in DOE Order 5700.6C has been implemented at Rocky Flats. All of the elements of the Quality Assurance Program play a role in hazardous waste management. Perhaps one of the biggest waste management problems facing the Rocky Flats Plant is cleaning up contamination from a forty year mission which focused on production of nuclear weapon components.

    Conventional wisdom in the US is that firms face a trade-off between environmental efforts and profit because of the belief that environmental protection invariably involves costs that reduce profits. Firms, therefore, generally perceive environmental protection as an impediment to their goal of profit maximization. Environmental efforts are viewed as an added hurdle in producing a product, rather than an as intrinsic part of well-designed operations. From this perspective, firms have no incentive to engage in environmental protection efforts, and will do so only if they are forced (or are given incentives) by government or if they perceive in advance potential profits from their efforts (e.g., a market for environmental products). The concept of a trade-off between the environment and profit, however, has been challenged recently. A common argument raised for questioning this trade-off is that efforts directed at environmental protection will lead to the development of new technologies and will give US firms a competitive advantage in the emerging environmental industry. It is argued that opportunities available within this growth field outweigh costs of entry and research. Recent publications (World Wildlife Fund, 1992; Resources for the Future, 1993) have proposed that government actions, may encourage the development of the environmental industry and, thus, improve both economic and environmental performance. Suggested governmental actions include using market incentives rather than command and control regulation to achieve environmental goals, integrating environmental values into governmental policy analysis, and supporting investments in environmental technologies. This paper details the economics and benefits of various waste management efforts.

Due to initiatives of the Clinton-Gore administration, biologists across the nation are trying to define and use a new concept called ecosystem management. {open_quotes}Ecosystem management{close_quotes} was born in the frustration of trying to deal with the spotted owl controversy in the Northwest. Biologists could not agree on what should be done. And the biologists and economists rarely got together to try to solve problems. Some astute individuals realized that to achieve a sustainable development, ecosystems would have to be managed on a much larger scale than merely small plots of lands. And people from many different backgrounds and disciplines would need to come together to find solutions. This paper will present the views of a Washington insider who has been a player (although too frequently a minor league player!) in administration initiatives to infuse ecosystem management principles and practices in our national conscience. Today, federal agency staff talk to those in other offices within their own agency. Federal agency staff also work on joint projects across federal agencies. In addition, state government, nonprofits, universities, interested individuals, and tribal governments are becoming involved. This is the biological {open_quotes}revolution{close_quotes} that is in progress. The emphasis is shifting from looking at the life history and problems of single species to a much broader approach of examining many species, including humans. The author will present a report on results of the ecosystem management initiative in the last year and point out some of the hurdles still ahead.

The U.S. Department of Energy (DOE) Federal Energy Management Program (FEMP) assists Federal agencies with managing their greenhouse gas (GHG) emissions. GHG management entails measuring emissions and understanding their sources, setting a goal for reducing emissions, developing a plan to meet this goal, and implementing the plan to achieve reductions in emissions. FEMP provides the following services to help Federal agencies meet the requirements of inventorying and reducing their GHG emissions: (1) FEMP offers one-on-one technical assistance to help agencies understand and implement the Federal Greenhouse Gas Accounting and Reporting Guidance and fulfill their inventory reporting requirements. (2) FEMP provides training, tools, and resources on FedCenter to help agencies complete their annual inventories. (3) FEMP serves a leadership role in the interagency Federal Working Group on Greenhouse Gas Accounting and Reporting that develops recommendations to the Council on Environmental Quality (CEQ) for the Federal Greenhouse Gas Accounting and Reporting Guidance. (4) As the focus continues to shift from measuring emissions (completing inventories) to mitigating emissions (achieving reductions), FEMP is developing a strategic planning framework and resources for agencies to prioritize among a variety of options for mitigating their GHG emissions, so that they achieve their reduction goals in the most cost-effective manner. These resources will help agencies analyze their high-quality inventories to make strategic decisions about where to use limited resources to have the greatest impact on reducing emissions. Greenhouse gases trap heat in the lower atmosphere, warming the earth's surface temperature in a natural process known as the 'greenhouse effect.' GHGs include carbon dioxide (CO{sub 2}), methane (CH{sub 4}), nitrous oxide (N{sub 2}O), perfluorocarbons (PFCs), hydrofluorocarbons (HFCs), and sulfur hexafluoride (SF{sub 6}). Human activities have caused a rapid increase in GHG concentrations. This rising level contributes to global climate change, which contributes to environmental and public health problems.

    Since 1957, the International Atomic Energy Agency (IAEA) has worked to ensure the safe and responsible promotion of nuclear technology throughout the world. The IAEA operates at the intersection of the Nuclear Nonproliferation Treatys (NPT) fourth and third articles, which guarantee Parties to the Treaty the right to peaceful uses of nuclear technology, provided those activities are placed under safeguards verified by the IAEA. However, while the IAEA has enjoyed substantial success and prestige in the international community, there is a concern that its resources are being stretched to a point where it may no longer be possible to execute its multifaceted mission in its entirety. As noted by the Director General (DG) in 2008, demographics suggest that every aspect of the IAEAs operations will be in higher demand due to increasing reliance on non-carbon-based energy and the concomitant nonproliferation, safety, and security risks that growth entails. In addition to these nuclear energy concerns, the demand for technical developmental assistance in the fields of food security, resource conservation, and human health is also predicted to increase as the rest of the world develops. Even with a 100% value-for-money rating by the U.S. Office of Management and Budget (OMB) and being described as an extraordinary bargain by the United Nations Secretary-Generals High-level Panel on Threats, Challenges and Change, real budget growth at the Agency has been limited to zero-real growth for a better part of the last two decades. Although the 2012 regular budget (RB) received a small increase for most programs, the 2013 RB has been set at zero-real growth. As a result, the IAEA has had to defer infrastructure investments, which has hindered its ability to provide the public goods its Members seek, decreased global security and development opportunities, and functionally transformed the IAEA into a charity, dependent on extrabudgetary (EB) contributions to sustain its mission and capabilities. To resolve these resource constraints, we recommend the creation of an endowment, funded entirely through private contributions. Our initial estimates for the endowment are that a 2B principal. This level of capitalization could provide significant support to all aspects of the IAEAs mission, including Capital Investment and Innovation; Technical Cooperation; as well as incentivizing the policy and technology entrepreneurship that will be necessary for the future health of the nonproliferation regime. Given this potential, our future efforts will focus on a more rigorous assessment of the financial requirements, while simultaneously creating the beginnings of a functional organization. These include: organizational structure, metrics for grant-making and performance evaluation, and outreach and fundraising strategies. At the end of this process, there should be sufficient information and engagement to begin to operationalize the endowment through external funding sources.

    Executive Order 13423, Strengthening Federal Environmental, Energy, and Transportation Management establishes the policy that Federal agencies conduct their environmental, transportation, and energy-related activities in a manner that is environmentally, economically and fiscally sound, integrated, continually improving, efficient, and sustainable. The Department of Energy (DOE) has approved DOE Order 450.1A, Environmental Protection Program and DOE Order 430.2B, Departmental Energy, Renewable Energy and Transportation Management as the means of achieving the provisions of this Executive Order. DOE Order 450.1A mandates the development of Environmental Management Systems (EMS) to implement sustainable environmental stewardship practices that: (1) Protect the air, water, land, and other natural and cultural resources potentially impacted by facility operations; (2) Meet or exceed applicable environmental, public health, and resource protection laws and regulations; and (3) Implement cost-effective business practices. In addition, the DOE Order 450.1A mandates that the EMS must be integrated with a facility's Integrated Safety Management System (ISMS) established pursuant to DOE P 450.4, 'Safety Management System Policy'. DOE Order 430.2B mandates an energy management program that considers energy use and renewable energy, water, new and renovated buildings, and vehicle fleet activities. The Order incorporates the provisions of the Energy Policy Act of 2005 and Energy Independence and Security Act of 2007. The Order also includes the DOE's Transformational Energy Action Management initiative, which assures compliance is achieved through an Executable Plan that is prepared and updated annually by Lawrence Berkeley National Laboratory (LBNL, Berkeley Lab, or the Laboratory) and then approved by the DOE Berkeley Site Office. At the time of this revision to the EMS plan, the 'FY2009 LBNL Sustainability Executable Plan' represented the most current Executable Plan. These DOE Orders and associated policies establish goals and sustainable stewardship practices that are protective of environmental, natural, and cultural resources, and take a life cycle approach that considers aspects such as: (1) Acquisition and use of environmentally preferable products; (2) Electronics stewardship; (3) Energy conservation, energy efficiency, and renewable energy; (4) Pollution prevention, with emphasis on toxic and hazardous chemical and material reduction; (5) Procurement of efficient energy and water consuming materials and equipment; (6) Recycling and reuse; (7) Sustainable and high-performance building design; (8) Transportation and fleet management; and (9) Water conservation. LBNL's approach to sustainable environmental stewardship required under Order 450.1A poses the challenge of implementing its EMS in a compliance-based, performance-based, and cost-effective manner. In other words, the EMS must deliver real and tangible business value at a minimal cost. The purpose of this plan is to describe Berkeley Lab's approach for achieving such an EMS, including an overview of the roles and responsibilities of key Laboratory parties. This approach begins with a broad-based environmental policy consistent with that stated in Chapter 11 of the LBNL Health and Safety Manual (PUB-3000). This policy states that Berkeley Lab is committed to the following: (1) Complying with applicable environmental, public health, and resource conservation laws and regulations. (2) Preventing pollution, minimizing waste, and conserving natural resources. (3) Correcting environmental hazards and cleaning up existing environmental problems, and (4) Continually improving the Laboratory's environmental performance while maintaining operational capability and sustaining the overall mission of the Laboratory. A continual cycle of planning, implementing, evaluating, and improving processes will be performed to achieve goals, objectives, and targets that will help LBNL carry out this policy.     In the Department of Energy (DOE) Implementation Plan (IP) for Defense Nuclear Facilities Safety Board's Recommendation 2009-1, the DOE committed to studying the use of quantitative risk assessment methodologies at government agencies and industry. This study consisted of document reviews and interviews of senior management and risk assessment staff at six organizations. Data were collected and analyzed on risk assessment applications, risk assessment tools, and controls and infrastructure supporting the correct usage of risk assessment and risk management tools. The study found that the agencies were in different degrees of maturity in the use of risk assessment to support the analysis of high hazard operations and to support decisions related to these operations. Agencies did not share a simple, 'one size fits all' approach to tools, controls, and infrastructure needs. The agencies recognized that flexibility was warranted to allow use of risk assessment tools in a manner that is commensurate with the complexity of the application. The study also found that, even with the lack of some data, agencies application of the risk analysis structured approach could provide useful insights such as potential system vulnerabilities. This study, in combination with a companion study of risk assessment programs in the DOE Offices involved in high hazard operations, is being used to determine the nature and type of controls and infrastructure needed to support risk assessments at the DOE.

    The Department of Energy's (Department) Office of River Protection (ORP) is responsible for the storage, treatment, and disposal of over 53 million gallons of highly radioactive waste from over 40 years of plutonium production at the Hanford Site. Because of the diversity, complexity, and large scope of its mission, coupled with its small staff, ORP told us that it has found it necessary to engage in service contracts to obtain consulting services, technical expertise, and support staff. Federal policy generally permits contractors to perform a wide range of support service activities, including, in most situations, the drafting of Government documents subject to the review and approval of Federal employees. Federal policy issued by the Office of Management and Budget, however, prohibits contractors from drafting agency responses to Congressional inquiries and reports issued by the Office of Inspector General and Government Accountability Office (GAO) because they are so closely related to the public interest and provide the appearance of private influence. To provide a majority of its needed services, ORP issued a Blanket Purchase Agreement to Project Assistance Corporation (PAC) in 2003. Through the Blanket Purchase Agreement, ORP acquired services in the areas of project management, risk assessment, program assessment, quality assurance, safety, cost and schedule estimating, budgeting and finance, and engineering. PAC has, in turn, subcontracted with various other firms to obtain some of the services needed by ORP. From 2005 to 2008, the total annual cost for the contract with PAC had grown from $4.7 million to $9.2 million. Because of the extent of the services provided and growing costs of the contract, we conducted this review to determine whether ORP appropriately administered its contract with the Project Assistance Corporation. Our review disclosed that, in some instances, ORP had not appropriately administered all work performed under the PAC contract. Specifically, ORP allowed PAC employees to perform work that was inherently governmental and created situations where a potential conflict of interest occurred. Specifically: (1) ORP assigned PAC employees responsibility for providing information and responses to Congressional inquiries and reports issued by the GAO and the Department of Energy's Office of Inspector General (OIG); and (2) PAC employees were also allowed to perform functions that created potential conflicts of interest. ORP permitted PAC employees, for example, to develop statements of work and approve funding of work to be performed under PAC's own contract. We concluded that these problems occurred, at least in part, because ORP had not established controls necessary to effectively administer the PAC contract. Federal procurement regulations recommended that agencies provide additional management controls over contractors whose work has the potential to influence the action of government officials. ORP, however, had not implemented the controls specifically recommended in Federal policy guidance for administering contracts, including: (1) Performing conflict of interest reviews; and (2) Separating contractor and Department employees either physically or organizationally. By not effectively administering its contract with PAC, ORP increased the risk that decisions based on work performed by the contractor may not have been made in the best interests of the Department. For example, ORP increased the risk that approved work would be unnecessary or too costly. As we also recently noted in our report on 'Management Challenges at the Department of Energy' (DOE/IG-0808, December 2008), contract administration issues such as those discussed in this report remain a significant vulnerability. Continued efforts to improve this area are vitally important since the risk that contractors receive payments for unallowable costs could also increase as the Department expands its contracting activities under the American Recovery and Reinvestment Act.
