Environmental Guidance Program Reference Book: Marine Protection, Research, and Sanctuaries Act and Marine Mammal Protection Act. Revision 3  

SciTech Connect (OSTI)

Two laws governing activities in the marine environment are considered in this Reference Book. The Marine Protection, Research, and Sanctuaries Act (MPRSA, P.L. 92-532) regulates ocean dumping of waste, provides for a research program on ocean dumping, and provides for the designation and regulation of marine sanctuaries. The Marine Mammal Protection Act (MMPA, P.L. 92-522) establishes a federal program to protect and manage marine mammals. The Fishery Conservation and Management Act (FCMA, P.L. 94-265) establishes a program to regulate marine fisheries resources and commercial marine fishermen. Because the Department of Energy (DOE) is not engaged in any activities that could be classified as fishing under FCMA, this Act and its regulations have no implications for the DOE; therefore, no further consideration of this Act is given within this Reference Book. The requirements of the MPRSA and the MMPA are discussed in terms of their implications for the DOE.

Most research on the Columbia and Snake Rivers in recent years has been directed to downstream migrant salmon (Oncorhynchus spp.) losses at dams. Comparatively little attentions has been given to adult losses. Recently an estimated 378,4000 adult salmon and steelhead (O. mykiss) were unaccounted-for from Bonneville Dam to terminal areas upstream. It is now apparent that some of this loss was due to delayed mortality from wounded by marine mammals. This report reviews the recent literature to define predatory effects of marine mammals on Columbia River salmon.

The Title VI Stratospheric Ozone Protection Program of the Clean Air Act (CAA) requires promulgation of regulations to reduce and prevent damage to the earth's protective ozone layer. Regulations pursuant to Title VI of the CAA are promulgated in the Code of Federal Regulations (CFR) at Title 40 CFR, Part 822. The regulations include ambitious production phaseout schedules for ozone depleting substances (ODS) including chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), halons, carbon tetrachloride, and methyl chloroform under 40 CFR 82, Subpart A. The regulations also include requirements for recycling and emissions reduction during the servicing of refrigeration equipment and technician certification requirements under Subpart F; provisions for servicing of motor vehicle air conditioners under Subpart B; a ban on nonessential products containing Class 1 ODS under Subpart C; restrictions on Federal procurement of ODS under Subpart D; labeling of products using ODS under Subpart E; and the Significant New Alternatives Policy Program under Subpart G. This paper will provide details of initiatives undertaken at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of requirements under the Title VI Stratospheric Ozone Protection Program. The Stratospheric Ozone Protection Plans include internal DOE requirements for: (1) maintenance of ODS inventories; (2) ODS procurement practices; (3) servicing of refrigeration and air conditioning equipment; (4) required equipment modifications or replacement; (5) technician certification training; (6) labeling of products containing ODS; (7) substitution of chlorinated solvents; and (8) replacement of halon fire protection systems. The plans also require establishment of administrative control systems which assure that compliance is achieved and maintained as the regulations continue to develop and become effective.

Effect of downed woody debris on small mammal anti-predator behavior.

Anti-predator behavior can affect prey growth, reproduction, survival, and generate emergent effects in food webs. Small mammals often lower the cost of predation by altering their behavior in response to shrubs,but the importance of other microhabitat features, such as downed woody debris, for anti-predator behavior is unknown. We used givingup densities to quantify the degree to which downed woody debris alters perceived predation risk by small mammals in southeastern pineforests. We placed 14 foraging trays next to large downed woody debris,shrubs, and in open areas for 12 consecutive nights. Moon illumination, a common indicator of predation risk, led to a similar reduction in small mammal foraging in all three microhabitats (open, downed woody debris,and shrub). Small mammals perceived open microhabitats as riskier than shrub microhabitats, with downed woody debris habitats perceived as being of intermediate risk between shrub and open microhabitats. Despite the presumed benefits of the protective cover of downed woody debris, small mammals may perceive downed woody debris as a relatively risky foraging site in southeastern pine forests where the high diversity and abundance of rodent-eating snakes may provide a primary predatory threat.

In August 1985 the Environmental Engineering Committee of the Science Advisory Board was asked by the Office of Water Regulations and Standards (OWRS) to review technical documents supporting development of EPA regulations for the disposal/reuse of sewage sludge under Section 405(d) of the Clean Water Act. The Committee was also asked by the Office of Marine and Estuarine Protection (OMEP) to review technical documents supporting revisions of the EPA ocean dumping regulations. The Committee chose to review the two sets of documents together, since they both dealt with a common subject, and since they shared, in some respects, a common methodology. The report, however, covers only the review of the OWRS documents, which consist of a set of risk-assessment methodologies (1,2,3,4) for four sludge disposal/reuse options (landfilling, land application/distribution and marketing, incineration, and ocean disposal). The reviews of the OMEP documents are covered in separate Committee reports. The Committee's principal findings are outlined.

For 50 of these species, we present basic descriptions, distinguishing morphological features, distribution and habitat preferences, food habits, reproductive biology, social behavior, ecological relationships with other species, and economic importance to man. For those species that have been studied on the SRS, we summarize the results of these studies. Keys and illustrations are provided for whole body and skull identification. We also summarize the results of two major long-term SRS studies, The Forbearer Census'' and White-tailed Deer Studies''. Aging, tumor suppression and cancer: High-wire act!

Evolutionary theory holds that aging is a consequence of the declining force of natural selection with age. We discuss here the evidence that among the causes of aging in complex multicellular organisms, such as mammals, is the antagonistically pleiotropic effects of the cellular responses that protect the organism from cancer. Cancer is relatively rare in young mammals, owing in large measure to the activity of tumor suppressor mechanisms. These mechanisms either protect the genome from damage and/or mutations, or they elicit cellular responses--apoptosis or senescence--that eliminate or prevent the proliferation of somatic cells at risk for neoplastic transformation.We focus here on the senescence response, reviewing its causes, regulation and effects. In addition, we describe recent data that support the idea that both senescence and apoptosis may indeed be the double-edged swords predicted by the evolutionary hypothesis of antagonistic pleiotropy--protecting organisms from cancer early in life, but promoting aging phenotypes, including late life cancer, in older organisms.

The National Environmental Policy Act of 1969 (NEPA) sets forth national policy for the protection of the environment. The NEPA process is intended to help officials of the federal government make decisions that are based on an understanding of environmental consequences, and take actions that protect, restore, and enhance the environment. The California Environmental Quality Act of 1970 (CEQA) is similar to NEPA. The California legislature established CEQA to inform both state and local governmental decision-makers and the public about potential significant environmental effects of proposed activities, to identify ways to avoid or reduce environmental impacts, and to disclose to the public the reasons why a project is approved if significant environmental effects are involved. Lawrence Berkeley Laboratory (LBL), complies with the provisions of both NEPA and CEQA. This document defines the responsibilities and authorities for NEPA/CEQA compliance at LBL.

Small mammal study of Sandia Canyon, 1994 and 1995

A wide range of plant and wildlife species utilize water discharged from facilities at Los Alamos National Laboratory (LANL). The purpose of this study was to gather baseline data of small mammal populations and compare small mammal characteristics within three areas of Sandia Canyon, which receives outfall effluents from multiple sources. Three small mammal trapping webs were placed in the upper portion of Sandia Canyon, the first two were centered in a cattail-dominated marsh with a ponderosa pine overstory and the third web was placed in a much drier transition area with a ponderosa pine overstory. Webs 1 and 2 had the highest species diversity indices with deer mice the most commonly captured species in all webs. However, at Web 1, voles, shrews, and harvest mice, species more commonly found in moist habitats, made up a much greater overall percentage (65.6%) than did deer mice and brush mice (34.5%). The highest densities and biomass of animals were found in Web 1 with a continual decrease in density estimates in each web downstream. There is no statistical difference between the mean body weights of deer mice and brush mice between sites. Mean body length was also determined not to be statistically different between the webs (GLM [deer mouse], F = 0.89, p = 0.4117; GLM [brush mouse], F = 2.49, p = 0.0999). Furthermore, no statistical difference between webs was found for the mean lean body masses of deer and brush mice (GLM [deer mouse], F = 2.54, p = 0.0838; GLM [brush mouse], F = 1.60, p = 0.2229). Additional monitoring studies should be conducted in Sandia Canyon so comparisons over time can be made. In addition, rodent tissues should be sampled for contaminants and then compared to background or control populations elsewhere at the Laboratory or at an off-site location.

Small Mammal Sampling in Mortandad and Los Alamos Canyons, 2005

As part of an ongoing ecological field investigation at Los Alamos National Laboratory, a study was conducted that compared measured contaminant concentrations in sediment to population parameters for small mammals in the Mortandad Canyon watershed. Mortandad Canyon and its tributary canyons have received contaminants from multiple solid waste management units and areas of concern since establishment of the Laboratory in the 1940s. The study included three reaches within Effluent and Mortandad canyons (E-1W, M-2W, and M-3) that had a spread in the concentrations of metals and radionuclides and included locations where polychlorinated biphenyls and perchlorate had been detected. A reference location, reach LA-BKG in upper Los Alamos Canyon, was also included in the study for comparison purposes. A small mammal study was initiated to assess whether potential adverse effects were evident in Mortandad Canyon due to the presence of contaminants, designated as contaminants of potential ecological concern, in the terrestrial media. Study sites, including the reference site, were sampled in late July/early August. Species diversity and the mean daily capture rate were the highest for E-1W reach and the lowest for the reference site. Species composition among the three reaches in Mortandad was similar with very little overlap with the reference canyon. Differences in species composition and diversity were most likely due to differences in habitat. Sex ratios, body weights, and reproductive status of small mammals were also evaluated. However, small sample sizes of some species within some sites affected the analysis. Ratios of males to females by species of each site (n = 5) were tested using a Chi-square analysis. No differences were detected. Where there was sufficient sample size, body weights of adult small mammals were compared between sites. No differences in body weights were found. Reproductive status of species appears to be similar across sites. However, sample size prevents a detailed examination of reproduction composition. Because of small sample size of some species and differences that might occur on a seasonal basis, additional sampling would need to be conducted to further evaluate sex ratios, body weights, and reproductive characteristics.

Predation, Competition, and Abiotic Disturbance: Population Dynamics of Small Mammals

Predation and food availability have been implicated in annual non-cyclic fluctuations of vertebrate prey at mid-latitudes. The timing and magnitude of these factors are unclear due to a lack of large-scale field experiments, little attention to interactions, and a failure to closely link vertebrate predators with their prey. From October 1992 to January 1996, small mammal populations were censused on eight 0.6 ha plots at monthly intervals in a 32-ha prairie restoration at Fermi National Accelerator Laboratory, Illinois. Terrestrial vertebrate predators were excluded after July 1993 from four of the eight plots and canid diets monitored. Both terrestrial and avian vertebrate predators were excluded in March 1994. During 1993 small mammal densities (i.e., Microtus Pennsylvanicus, Peromyscus leucopus, and P. maniculatus) were relatively high. Following peak densities in late summer, Microtus numbers wer 2-3x greater on exclusion plots relative to controls due to preferential selection of Microtus by canids, as reflected in dits. Following an ice-storm and crash in small mammal numbers (particularly Microtus), vertebrate predator exclusion had no detectable effect on P. leucopus numbers, probably due to an abundance of alternative prey (i.e., Sylvilagus floridanus). Meadow vole numbers began to increase in Fall 1995, and a numerical effect of predator exclusion, similar to that in 1993, was observed. Predator exclusion had no detectable effect on the movements and spatial patterns of Microtus during 1993. There was a significant decrease in home range and a significant increase in home range overlap for P. leucopus on the predator exclusion plots. The change in spatial behavior may be due to interspecific competition with Microtus resulting from increased densities on exclusion plots. Thus, predators had an indirect effect on P. leucopus spatial patterns mediated through M. Pennsylvanicus. The role of food limitation was studied using natural and manipulative experiments. Unusually high acorn production in Fall 1994 resulted in increased P. leucopus numbers at one Fermilab site due to immigration since survivorship or reproduction were unaffected. A food supplementation experiment during October 1994-March 1995 induced a strong increase in P. leucopus numbers, due again to immigration, although reproduction also was advanced by two months.

Hantavirus testing in small mammal populations of northcentral New Mexico

In 1993, an outbreak of a new strain of hantavirus in the southwestern US indicated that deer mice (Peromyscus maniculatus) was the primary carrier of the virus. In 1993 and 1994, the Ecological Studies Team (EST) at Los Alamos National Laboratory surveyed small mammal populations in Los Alamos County, New Mexico, primarily for ecological risk assessment (ecorisk) studies. At the request of the Centers for Disease Control (CDC) and the School of Medicine at the University of New Mexico, EST also collected blood samples from captured animals for use in determining seroprevalence of hantavirus in this region due to the recent outbreak of this virus in the four-comers region of the Southwest. The deer mouse was the most commonly captured species during the tripping sessions. Other species sampled included harvest mice (Reithrodontomys megalotis), least chipmunk (Eutamias minimus), long-tailed vole (Microtus longicaudus), Mexican woodrat (Neotoma mexicana), and brush mouse (Peromyscus boylii). The team collected blood samples from tripped animals following CDC`s suggested guidelines. Results of the 1993 and 1994 hantavirus testing identified a total overall seroprevalence of approximately 5.5% and 4.2%, respectively. The highest seroprevalence rates were found in deer mice seri (3--6%), but results on several species were inconclusive; further studies will be necessary, to quantify seroprevalence rates in those species. Seroprevalence rates for Los Alamos County were much lower than elsewhere in the region.

Corridor effects on population densities and habitat use of 3 small mammal species were assessed in an experimentally fragmented landscape. Corridor presence did not have a statistically significant effect on population densities of cotton rats or cotton mice; however, a significant effect was observed for old-field mice. The results suggest that landscape fragmentation and habitat structure may have varying effects on population densities of different species.

The Department of Energy (DOE) is required by section 3021(b) of the Resource Conservation and Recovery Act (RCRA), as amended by the Federal Facility Compliance Act (the Act), to prepare plans describing the development of treatment capacities and technologies for treating mixed waste. The Act requires site treatment plans (STPs or plans) to be developed for each site at which DOE generates or stores mixed waste and submitted to the State or EPA for approval, approval with modification, or disapproval. The Lawrence Livermore National Laboratory (LLNL) Conceptual Site Treatment Plan (CSTP) is the preliminary version of the plan required by the Act and is being provided to California, the US Environmental Protection Agency (EPA), and others for review. A list of the other DOE sites preparing CSTPs is included in Appendix 1.1 of this document. Please note that Appendix 1.1 appears as Appendix A, pages A-1 and A-2 in this document.

EPA and the Federal Technology Transfer Act: Opportunity knocks

In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

Wind energy and the Migratory Bird Treaty Act

The Fish and Wildlife Service (Service) is charged to balance its support for clean, renewable energy such as windpower with its trust responsibilities under the Migratory Bird Treaty Act (MBTA). There are four international treaties implemented by the MBTA protecting 850 species of migratory birds. The Service is focused on managing healthy populations but must protect individuals by law. An activity cannot legally {open_quotes}take{close_quotes} one migratory bird except as provided by a hunting season or a permit. The Service does not have the authority to issue a permit to {open_quotes}take{close_quotes} a bird incidental to an otherwise legal activity. Scientific permits or special purpose permits may be appropriate. Development of incidental take regulations are being considered. More research is needed, but this should prevent some management actions. The Service will continue to work with the industry to develop broad guidelines to minimize avian mortality.

The solution is based upon the fact that the group of the automorphisms of the Heisenberg motion group H1\\timesU(1), modulo discrete sub-group Z, act isometrically on the boundary of the hyperbolic three-dimensional manifold. Closed timelike curves do not exist due to the presence of a closed Cauchy-Riemann surface for chronology protection, with two mirror symmetric sets of helicoidal self-similar modules inside. The present solution is isometrically equivalent to a cylindrical gravitational monochromatic wave front.

Rapid exhaust of pressurized gas from the pneumatically loaded side of the piston facilitates an extremely rapid piston stroke. A flexible selector diaphragm opens and closes an exhaust port in response to pressure differentials created by energizing and de-energizing a solenoid which controls the pneumatic input to the actuator as well as selectively providing a venting action to one side of the selector diaphragm.

The video describes how the Department of Energy and its contractors turned a nearly $2 billion investment of American Recovery and Reinvestment Act funding in 2009 into nearly $4 billion worth of environmental cleanup work over the past two years. At the same time, Hanford workers have reduced the cleanup footprint of the Hanford Site by more than half (586 square miles to 241 sq. mi. through August -- 59 percent).

A hardwired, fail-safe rack protection monitor utilizes electromechanical relays to respond to the detection by condition sensors of abnormal or alarm conditions (such as smoke, temperature, wind or water) that might adversely affect or damage equipment being protected. When the monitor is reset, the monitor is in a detection mode with first and second alarm relay coils energized. If one of the condition sensors detects an abnormal condition, the first alarm relay coil will be de-energized, but the second alarm relay coil will remain energized. This results in both a visual and an audible alarm being activated. If a second alarm condition is detected by another one of the condition sensors while the first condition sensor is still detecting the first alarm condition, both the first alarm relay coil and the second alarm relay coil will be de-energized. With both the first and second alarm relay coils de-energized, both a visual and an audible alarm will be activated. In addition, power to the protected equipment will be terminated and an alarm signal will be transmitted to an alarm central control. A microscope collision protection apparatus for a remote control microscope which protects the optical and associated components from damage in the event of an uncontrolled collision with a specimen, regardless of the specimen size or shape. In a preferred embodiment, the apparatus includes a counterbalanced slide for mounting the microscope's optical components. The ORP was established to elevate the reporting and accountability for the RPP to the DOE-Headquarters level. At Los Alamos National Laboratory, small mammals were sampled at two waste burial sites (Site 1-recently disturbed and Site 2-partially disturbed) at Area G, Technical Area 54 and a control site on Frijoles Mesa (Site 4) in 1995. Our objectives were (1) to identify radionuclides that are present within surface and subsurface soils at waste burial sites, (2) to compare the amount of radionuclide uptake by small mammals at waste burial sites to a control site, and (3) to identify if the primary mode of contamination to small mammals is by surface contact or ingestion/inhalation. Three composite samples of at least rive animals per sample were collected at each site. Pelts and carcasses of each animal were separated and analyzed independently. Samples were analyzed for {sup 241}Am, {sup 90}Sr , {sup 238}Pu, {sup 239}Pu, total U, {sup 137}Cs, and {sup 3}H. Significantly higher (parametric West at p=0.05) levels of total U, {sup 241}Am, {sup 238}Pu and {sup 239}Pu were detected in pelts than in carcasses of small mammals at TA-54. Concentrations of other measured radionuclides in carcasses were nearly equal to or exceeded the mean concentrations in the pelts. Our results show higher concentrations in pelts compared to carcasses, which is similar to what has been found at waste burial/contaminated sites outside of Los Alamos National Laboratory. Site 1 had a significantly higher (alpha=0.05, P=0.0125) mean tritium concentration in carcasses than Site 2 or Site 4. In addition Site 1 also had a significantly higher (alpha=0.05, p=0.0024) mean tritium concentration in pelts than Site 2 or Site 4. Site 2 had a significantly higher (alpha=0.05, P=0.0499) mean {sup 239}Pu concentration in carcasses than either Site 1 or Site 4.

Armored garment for protecting

A lightweight, armored protective garment for protecting an arm or leg from blast superheated gases, blast overpressure shock, shrapnel, and spall from a explosive device, such as a Rocket Propelled Grenade (RPG) or a roadside Improvised Explosive Device (IED). The garment has a ballistic sleeve made of a ballistic fabric, such as an aramid fiber (e.g., KEVLAR.RTM.) cloth, that prevents thermal burns from the blast superheated gases, while providing some protection from fragments. Additionally, the garment has two or more rigid armor inserts that cover the upper and lower arm and protect against high-velocity projectiles, shrapnel and spall. The rigid inserts can be made of multiple plies of a carbon/epoxy composite laminate. The combination of 6 layers of KEVLAR.RTM. fabric and 28 plies of carbon/epoxy laminate inserts (with the inserts being sandwiched in-between the KEVLAR.RTM. layers), can meet the level IIIA fragmentation minimum V.sub.50 requirements for the US Interceptor Outer Tactical Vest.

This paper provides an overview of regulatory issues under Title III of the Clean Air Act Amendments that could affect electric utilities. Title III contains provisions relating to hazardous air pollutants (HAPs) and provides special treatment for electric utilities. Generally, this discussion documents that if utility toxic emissions are regulated, one of the chief difficulties confronting utilities will be the lack of coordination between Title III and other titles of the Act. The paper concludes that if the US Environmental Protection Agency (EPA) determines that regulation of utility HAPs is warranted under Title III, savings can be realized from flexible compliance treatment.

Comparison of small mammal species diversity near wastewater outfalls, natural streams, and dry canyons

A wide range of plant and wildlife species utilizes water discharged from facilities at Los Alamos National Laboratory (LANL). The purpose of this study was to compare nocturnal small mammal communities at wet areas created by wastewater outfalls with communities in naturally created wet and dry areas. Thirteen locations within LANL boundaries were selected for small mammal mark-recapture trapping. Three of these locations lacked surface water sources and were classified as {open_quotes}dry,{close_quotes} while seven sites were associated with wastewater outfalls ({open_quotes}outfall{close_quotes} sites), and three were located near natural sources of surface water ({open_quotes}natural{close_quotes} sites). Data was collected on site type (dry, outfall or natural), location, species trapped, and the tag number of each individual captured. This data was used to calculate mean number of species, percent capture rate, and species diversity at each type of site. When data from each type of site was pooled, there were no significant differences in these variables between dry, outfall, and natural types. However, when data from individual sites was compared, tests revealed significant differences. All sites in natural areas were significantly higher than dry areas in daily mean number of species, percent capture rate, and species diversity. Most outfall sites were significantly higher than dry areas in all three variables tested. When volume of water from each outfall site was considered, these data indicated that the number of species, percent capture rate, and species diversity of nocturnal small mammals were directly related to the volume of water at a given outfall.

Current postings of radiological hazards at the Rocky Flats Environmental Technology Site (RFETS) do not incorporate recent findings concerning effective warning presentation. Warning information should be highly visible, quickly, and easily understood. While continuing to comply with industry standards (e.g., Department of Energy (DOE) guidelines), these findings can be incorporated into existing radiological sign design, making them more effective in terms of usability and compliance. Suggestions are provided for designing more effective postings within stated guidelines.

Lawrence Livermore National Laboratory Surface Water Protection: A Watershed Approach

This surface water protection plan (plan) provides an overview of the management efforts implemented at Lawrence Livermore National Laboratory (LLNL) that support a watershed approach to protect surface water. This plan fulfills a requirement in the Department of Energy (DOE) Order 450.1A to demonstrate a watershed approach for surface water protection that protects the environment and public health. This plan describes the use of a watershed approach within which the Laboratory's current surface water management and protections efforts have been structured and coordinated. With more than 800 million acres of land in the U.S. under federal management and stewardship, a unified approach across agencies provides enhanced resource protection and cost-effectiveness. The DOE adopted, along with other federal agencies, the Unified Federal Policy for a Watershed Approach to Federal Land and Resource Management (UFP) with a goal to protect water quality and aquatic ecosystems on federal lands. This policy intends to prevent and/or reduce water pollution from federal activities while fostering a cost-effective watershed approach to federal land and resource management. The UFP also intends to enhance the implementation of existing laws (e.g., the Clean Water Act [CWA] and National Environmental Policy Act [NEPA]) and regulations. In addition, this provides an opportunity for the federal government to serve as a model for water quality stewardship using a watershed approach for federal land and resource activities that potentially impact surface water and its uses. As a federal land manager, the Laboratory is responsible for a small but important part of those 800 million acres of land. Diverse land uses are required to support the Laboratory's mission and provide an appropriate work environment for its staff. The Laboratory comprises two sites: its main site in Livermore, California, and the Experimental Test Site (Site 300), near Tracy, California. The main site is largely developed yet its surface water system encompasses two arroyos, an engineered detention basin (Lake Haussmann), storm channels, and wetlands. Conversely, the more rural Site 300 includes approximately 7,000 acres of largely undeveloped land with many natural tributaries, riparian habitats, and wetland areas. These wetlands include vernal pools, perennial seeps, and emergent wetlands. The watersheds within which the Laboratory's sites lie provide local and community ecological functions and services which require protection. These functions and services include water supply, flood attenuation, groundwater recharge, water quality improvement, wildlife and aquatic habitats, erosion control, and (downstream) recreational opportunities. The Laboratory employs a watershed approach to protect these surface water systems. The intent of this approach, presented in this document, is to provide an integrated effort to eliminate or minimize any adverse environmental impacts of the Laboratory's operations and enhance the attributes of these surface water systems, as possible and when reasonable, to protect their value to the community and watershed. The Laboratory's watershed approach to surface water protection will use the U.S. Environmental Protection Agency's Watershed Framework and guiding principles of geographic focus, scientifically based management and partnerships1 as a foundation. While the Laboratory's unique site characteristics result in objectives and priorities that may differ from other industrial sites, these underlying guiding principles provide a structure for surface water protection to ensure the Laboratory's role in environmental stewardship and as a community partner in watershed protection. The approach includes pollution prevention, continual environmental improvement, and supporting, as possible, community objectives (e.g., protection of the San Francisco Bay watershed).

HANFORD SITE RIVER PROTECTION PROJECT (RPP) TANK FARM CLOSURE

The U. S. Department of Energy, Office of River Protection and the CH2M HILL Hanford Group, Inc. are responsible for the operations, cleanup, and closure activities at the Hanford Tank Farms. There are 177 tanks overall in the tank farms, 149 single-shell tanks (see Figure 1), and 28 double-shell tanks (see Figure 2). The single-shell tanks were constructed 40 to 60 years ago and all have exceeded their design life. The single-shell tanks do not meet Resource Conservation and Recovery Act of 1976 [1] requirements. Accordingly, radioactive waste is being retrieved from the single-shell tanks and transferred to double-shell tanks for storage prior to treatment through vitrification and disposal. Following retrieval of as much waste as is technically possible from the single-shell tanks, the Office of River Protection plans to close the single-shell tanks in accordance with the Hanford Federal Facility Agreement and Consent Order [2] and the Atomic Energy Act of 1954 [3] requirements. The double-shell tanks will remain in operation through much of the cleanup mission until sufficient waste has been treated such that the Office of River Protection can commence closing the double-shell tanks. At the current time, however, the focus is on retrieving waste and closing the single-shell tanks. The single-shell tanks are being managed and will be closed in accordance with the pertinent requirements in: Resource Conservation and Recovery Act of 1976 and its Washington State-authorized Dangerous Waste Regulations [4], US DOE Order 435.1 Radioactive Waste Management [5], the National Environmental Policy Act of 1969 [6], and the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 [7]. The Hanford Federal Facility Agreement and Consent Order, which is commonly referred to as the Tri-Party Agreement or TPA, was originally signed by Department of Energy, the State of Washington, and the U. S. Environmental Protection Agency in 1989. Meanwhile, the retrieval of the waste is under way and is being conducted to achieve the completion criteria established in the Hanford Federal Facility Agreement and Consent Order.

The US Department of Energy (DOE) has guided the Uranium Mill Tailings Remedial Action (UMTRA) Project through its first 10 years of successful remediation. The Uranium Mill Tailings Radiation Control Act (UMTRCA), passed in 1978, identified 24 uranium mill tailings sites in need of remediation to protect human health and the environment from the residual contamination resulting from the processing of uranium ore. The UMTRCA was promulgated in two titles: Title 1 and Title 2. This paper describes the regulatory structure, required documentation, and some of the technical approaches used to meet the Act`s requirements for managing and executing the $1.4 billion project under Title 1. Remedial actions undertaken by private industry under Title 2 of the Act are not addressed in this paper. Some of the lessons learned over the course of the project`s history are presented so that other countries conducting similar remedial action activities may benefit.
