Geothermal policy development program: expediting the local geothermal permitting process

For a number of years, concerns have been raised about the length of time and the complexity involved in obtaining required permits in order to develop the geothermal resource at the Geysers. Perhaps the most important factor is jurisdiction. At the Geysers, all three levels of government - local, state, and federal - exercise significant authority over various aspects of geothermal development. In addition, several agencies within each governmental level play an active role in the permitting process. The present study is concerned primarily with the local permitting process, and the ways in which this process could be expedited. This report begins by looking at the local role in the overall permitting process, and then reviews the findings and conclusions that have been reached in other studies of the problem. This is followed by a case study evaluation of recent permitting experience in the four Geysers-Calistoga KGRA counties, and the report concludes by outlining several approaches to expediting the local permitting process.

Localized heating of electrons in ionization zones: Going beyond the Penning-Thornton paradigm in magnetron sputtering

The fundamental question of how energy is supplied to a magnetron discharge is commonly answered by the Penning-Thornton paradigm invoking secondary electrons. Huo et al. (Plasma Sources Sci. Technol. 22, 045005, (2013)) used a global discharge model to show that electron heating in the electric field of the magnetic presheath is dominant. In this contribution, this concept is applied locally taking into account the electric potential structure of ionization zones. Images of ionization zones can and should be interpreted as diagrams of the localization of electric potential and related electron energy, where certain collisions promote or dampen their formation.

The information contained and/or referenced in this Annual Hanford Site Environmental Permitting Status Report (Status Report) addresses the State Environmental Policy Act (SEPA) of 1971 and Condition II.W. of the Resource Conservation and Recovery Act (RCRA) of 1976 Permit, Dangerous Waste Portion (DW Portion). Condition II.W. of the RCRA Permit specifies the Permittees are responsible for all other applicable federal, state, and local permits for the development and operation of the Hanford Facility. Condition II.W. of the RCRA Permit specifies that the Permittees are to use their best efforts to obtain such permits. For the purposes of permit condition, `best efforts` means submittal of documentation and/or approval(s) in accordance with schedules specified in applicable regulations, or as determined through negotiations with the applicable regulatory agencies. This Status Report includes information on all existing and anticipated environmental permitting. Environmental permitting required by RCRA, the Hazardous and Solid Waste Amendments (HSWA) of 1984, and non-RCRA permitting (solid waste handling, Clean Air Act Amendments of 1990, Clean Water Act Amendments of 1987, Washington State waste discharge, and onsite sewage system) is addressed. Information on RCRA and non-RCRA is current as of July 31, 1998. For the purposes of RCRA and the State of Washington Hazardous Waste Management Act of 1976 [as administered through the Dangerous Waste Regulations, Washington Active Code (WAC) 173-303], the Hanford Facility is considered a single facility. As such, the Hanford Facility has been issued one US Environmental Protection Agency (EPA)/State Identification Number (WA7890008967). This EPA/State identification number encompasses over 60 treatment, storage, and/or disposal (TSD) units. The Washington State Department of Ecology (Ecology) has been delegated authority by the EPA to administer the RCRA, including mixed waste authority. The RCRA permitting approach for the Hanford Facility is addressed in the Hanford Federal Facility Agreement and Consent Order (Tri-Party Agreement). Pursuant to the Tri-Party Agreement, a single RCRA permit was issued by Ecology and the EPA to cover the Hanford Facility. The RCRA Permit, through the permit modification process, eventually will incorporate all TSD units.

Louisiana Title V General Permits

Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

Regulatory and Permitting Issues

As part of the West Coast Regional Carbon Sequestration Partnership (WESTCARB), Terralog Technologies USA, Inc., reviewed current state and federal regulations related to carbon dioxide capture and storage within geologic formations and enhanced carbon uptake in terrestrial ecosystems. We have evaluated and summarized the current and possible future permitting requirements for the six states that comprise the West Coast Regional Partnership. Four options exist for CO{sub 2} injection into appropriate geologic formations, including storage in: (1) oil and gas reservoirs, (2) saline formations, (3) unmineable coal beds, and (4) salt caverns. Terrestrial CO{sub 2} sequestration involves improved carbon conservation management (e.g. reduction of deforestation), carbon substitution (e.g., substitution for fossil fuel-based products, energy conservation through urban forestry, biomass for energy generation), and improved carbon storage management (e.g., expanding the storage of carbon in forest ecosystems). The primary terrestrial options for the West Coast Region include: (1) reforestation of under-producing lands (including streamside forest restoration), (2) improved forest management, (3) forest protection and conservation, and (4) fuel treatments for the reduction of risk of uncharacteristically severe fires (potentially with associated biomass energy generation). The permits and/or contracts required for any land-use changes/disturbances and biomass energy generation that may occur as part of WESTCARB's activities have been summarized for each state.

Major sources as defined in Title V of the Clean Air Act Amendments of 1990 that are required to submit an operating permit application will need to: Evaluate their compliance status; Determine a strategic method of presenting the general and specific conditions of their Model Operating Permit (MOP); Maintain compliance with air quality regulations. A MOP is prepared to assist permitting agencies and affected facilities in the development of operating permits for a specific source category. This paper includes a brief discussion of example permit conditions that may be applicable to various types of Title V sources. A MOP for a generic natural gas processing plant is provided as an example. The MOP should include a general description of the production process and identify emission sources. The two primary elements that comprise a MOP are: Provisions of all existing state and/or local air permits; Identification of general and specific conditions for the Title V permit. The general provisions will include overall compliance with all Clean Air Act Titles. The specific provisions include monitoring, record keeping, and reporting. Although Title V MOPs are prepared on a case-by-case basis, this paper will provide a general guideline of the requirements for preparation of a MOP. Regulatory agencies have indicated that a MOP included in the Title V application will assist in preparation of the final permit provisions, minimize delays in securing a permit, and provide support during the public notification process.

Under Title V of the 1990 Clean Air Act Amendments (CAAA), thousands of industrial and government facilities are required to apply for a comprehensive operating permit that addresses all the emission sources at a site and the CAA regulations that apply to them. The new permitting requirements apply to major sources only--although there are several definitions of a major source under the Amended Act. Because Title V applicability is based on potential to emit (PTE) rather than actual emissions, even small and medium sources may initially be subject to this program. Unlike other regulations, Title V puts the burden of demonstrating continuous compliance on source owners and operators. Careful attention to detail is necessary during the application process because the Title V permit is inherently an enforcement fool for the EPA and the general public. Noncompliance can lead to citizen suits and fines up to $25,000 per day. Therefore, it is critical to negotiate an operating permit that does not adversely impact current operations yet provides flexibility for future modifications. Each state and local agency has its own application forms and regulatory interpretations. Areas of complexity include the classification of emission units, the approach for the PTE calculation, the separation of federal and state-enforceable requirements, and the relationship between Title V and other CAAA titles. This article summarizes some lessons learned based upon experiences in various states. (It does not attempt to resolve program uncertainties among jurisdictions.) The practical strategies presented can be used for developing (or modifying) Title V applications as well as during permit negotiations.

Refraction of shear zones in granular materials

We study strain localization in slow shear flow focusing on layered granular materials. A heretofore unknown effect is presented here. We show that shear zones are refracted at material interfaces in analogy with refraction of light beams in optics. This phenomenon can be obtained as a consequence of a recent variational model of shear zones. The predictions of the model are tested and confirmed by 3D discrete element simulations. We found that shear zones follow Snell's law of light refraction.

This Annual Hanford Site Environmental Permitting Status Report (Status Report) was prepared in response to requirements prescribed in U.S. Department of Energy (DOE) Order 5400.2A, `Environmental Compliance Issue Coordination`. This Order, canceled in April 1996, required that information on existing and anticipated environmental permitting for DOE facilities be submitted (or updated) annually by October 1 of each calendar year. Although the Order was canceled, the need for this Status Report still remains. For example, the Washington State Department of Ecology`s (Ecology) Dangerous Waste Permit Application Requirements (Publication Number 95-402, June 1996), Checklist Section J, calls for current information on existing and anticipated environmental permitting. As specified in the Hanford Facility Dangerous Waste Permit Application, General Information Portion (DOE/RL-91-28), this Status Report serves as the vehicle for meeting this requirement for the Hanford Facility. This Status Report includes information on all existing and anticipated environmental permitting. Environmental permitting required by the Resource Conservation and Recovery Act (RCRA) of 1976, the Hazardous and Solid Waste Amendments (HSWA) of 1984, and non-RCRA permitting (solid waste handling, Clean Air Act Amendments of 1990, Clean Water Act Amendments of 1987, Washington State waste discharge, and onsite sewage system) are addressed. Information on RCRA and non-RCRA permitting is included and is current as of July 31, 1996.

Now that some state regulatory agencies are reviewing Title V permit applications and issuing permits, evaluation of the process can be made in comparison with the original goals of the Title V permitting program. In addition, assessment of the terms and conditions that are being incorporated into permits, the nature of draft permits that are issued to facilities for comment, and the extent and type of negotiation that have been conducted with agencies to develop successful Title V permits, will be helpful for facilities that are currently undergoing application review. In working with a Fortune 500 surface coating company, fourteen Title V permit applications were developed and submitted for plants located in Maryland, Pennsylvania, Ohio, New Jersey, Illinois, Georgia, West Virginia, Wisconsin, Indiana and southern California. Draft permits have been issued for several of the plants, and differences in the terms and conditions, testing requirements, and permit format and structure have been noted between states. One of the issued permits required modification, and the process was one of the first for this state agency.

Integrated Title V/acid rain permits: Transitioning through initial permit issuance and reopenings

Titles IV and V of the Clean Air Act Amendments of 1990 (Act or CAA) created two new stationary source permitting programs, one specific to acid rain (Title IV), and a second for operating permits in general (Title V). The Phase 2 portion of the acid rain program was designed to be implemented through the Title V operating permit program, thereby subjecting all Phase 2 acid rain sources to the requirements of Title V. Permits issued pursuant to Phase 2 of the acid rain program will be viewed as a self-contained portion of the Title V operating permit and will be governed by regulations promulgated under both Title IV and Title V. The requirements imposed by Title IV may not always be consistent with the broader operating permit program requirements of Title V, and when inconsistency occurs, the acid rain requirements will take precedence. This nonalignment will perhaps be most apparent during two stages of initial permitting: (1) the transition period following Title V program approval when permit application, issuance, and effective dates differ between the two programs, and (2) at the point when acid rain permits must be reopened to incorporate Phase 2 NO{sub x} requirements. This paper explores strategies for streamlining implementation of the two programs with particular focus on these two coordination issues.

WIPP Hazardous Waste Facility Permit Update

The Waste Isolation Pilot Plant (WIPP) Hazardous Waste Facility Permit (HWFP) was issued on October 27, 1999 [1]. Since that time, the WIPP has sought modifications to clarify the permit language, provide alternative methods for meeting permit requirements and to update permit conditions. Significant advancements have been made in transuranic (TRU) waste management as the result of modifications to the HWFP. Among these advancements is a modification to obtain a drum age criteria (DAC) value to perform headspace gas sampling on drums to be super-compacted and placed in a 100-gallon overpack drum. In addition, the Section 311 permit modification request that would allow for more efficient waste characterization, and the modification to authorize the shipment and disposal of Remote-Handled (RH) TRU waste were merged together and submitted to the regulator as the Consolidated Permit Modification Request (PMR). The submittal of the Consolidated PMR came at the request of the regulator as part of responses to Notices of Deficiency (NODs) for the separate PMRs which had been submitted in previous years. Section 311 of the fiscal year 2004 Energy and Water Developments Appropriations Act (Public Law 108-137) [2] directs the Department of Energy to submit a permit modification that limits waste confirmation to radiography or visual examination of a statistical subpopulation of containers. Section 311 also specifically directs that disposal room performance standards be to be met by monitoring for volatile organic compounds in the underground disposal rooms. This statute translates into the elimination of other waste confirmation methods such as headspace gas sampling and analysis and solids sampling and analysis. These methods, as appropriate, will continue to be used by the generator sites during hazardous waste determinations or characterization activities. This modification is expected to reduce the overall cost of waste analysis by hundreds of millions of dollars [3]. Combining both the chap. 311 and RH TRU waste permit modification requests allows for both the regulator and DOE to expedite action on the modification requests. The Combined PMR reduces costs by having only one administrative process for both modification requests. (authors)

ON HYDRODYNAMIC MOTIONS IN DEAD ZONES

We investigate fluid motions near the midplane of vertically stratified accretion disks with highly resistive midplanes. In such disks, the magnetorotational instability drives turbulence in thin layers surrounding a resistive, stable dead zone. The turbulent layers in turn drive motions in the dead zone. We examine the properties of these motions using three-dimensional, stratified, local, shearing-box, non-ideal, magnetohydrodynamical simulations. Although the turbulence in the active zones provides a source of vorticity to the midplane, no evidence for coherent vortices is found in our simulations. It appears that this is because of strong vertical oscillations in the dead zone. By analyzing time series of azimuthally averaged flow quantities, we identify an axisymmetric wave mode particular to models with dead zones. This mode is reduced in amplitude, but not suppressed entirely, by changing the equation of state from isothermal to ideal. These waves are too low frequency to affect sedimentation of dust to the midplane, but may have significance for the gravitational stability of the resulting midplane dust layers.

The Clean Air Act Amendments of 1990, which amended the Federal Clean Air Act of 1977, required that the US Environmental Protection Agency develop a national Air Operating Permit Program, which in turn would require each state to develop an Air Operating Permit Program to identify all sources of ``regulated`` pollutants. Regulated pollutants include ``criteria`` pollutants (oxides of nitrogen, sulfur oxides, total suspended particulates, carbon monoxide, particulate matter greater than 10 micron, lead) plus 189 other ``Hazardous`` Air Pollutants. The Hanford Site, owned by the US Government and operated by the US Department of Energy, Richland Operations Office, is located in southcentral Washington State and covers 560 square miles of semi-arid shrub and grasslands located just north of the confluence of the Snake and Yakima Rivers with the Columbia River. This land, with restricted public access, provides a buffer for the smaller areas historically used for the production of nuclear materials, waste storage, and waste disposal. About 6 percent of the land area has been disturbed and is actively used. The Hanford Site Air Operating Permit Application consists of more than 1,100 sources and in excess of 300 emission points. Before January 1995, the maintenance and operations contractor and the environmental restoration contractor for the US Department of Energy completed an air emission inventory on the Hanford Site. The inventory has been entered into a database so that the sources and emission points can be tracked and updated information readily can be retrieved. The Hanford Site Air Operating Permit Application contains information current as of April 19, 1995.

A Vadose Zone Water Fluxmeter (WFM) or Direct Measurement WFM provides direct measurement of unsaturated water flow in the vadose zone. The fluxmeter is a cylindrical device that fits in a borehole or can be installed near the surface, or in pits, or in pile structures. The fluxmeter is primarily a combination of tensiometers and a porous element or plate in a water cell that is used for water injection or extraction under field conditions. The same water pressure measured outside and inside of the soil sheltered by the lower cylinder of the fluxmeter indicates that the water flux through the lower cylinder is similar to the water flux in the surrounding soil. The fluxmeter provides direct measurement of the water flow rate in the unsaturated soils and then determines the water flux, i.e. the water flow rate per unit area.

Negotiating Title V and non-Title V permits

The Title V Operating Permits program has been extended over many more years than originally anticipated when the 1990 Clean Air Act Amendments were first legislated. In fact, the regulatory program is still being refined even as facilities complete and submit their Title V permit applications. Likewise, it is clear that the agency review of the Title V permit applications will probably take considerably longer than originally anticipated. Finally, when the agency does complete the review, it is equally clear that there will need to be a significant amount of negotiating on the part of the facility to arrive at a simplified permit that is operationally feasible. This paper presents a number of suggestions for what the facility should be doing between the time the permit application is first submitted and the agency responds with a draft permit. The suggestions are designed to help simplify the permit and enhance flexibility. In addition, the paper presents permit negotiating techniques and points out the pitfalls that will be encountered if the facility does not take action prior to receiving the draft Title V permit. This paper suggests that the facility should internally evaluate how the permit application impacts facility operations prior to the agency doing so. It also suggests that the facility should contact the agency early and amend the permit application to take advantage of increasing regulatory flexibility. By taking these steps, and properly negotiating the permit terms and conditions; the facility will achieve a much better permit, and will hopefully be able to avoid the regulatory burdens and delays associated with re-opening the permit during the next 5 to 8 years (from the time of permit application submittal).

Permit Allocation in Emissions Trading using the Boltzmann Distribution

In emissions trading, the initial permit allocation is an intractable issue because it needs to be essentially fair to the participating countries. There are many ways to distribute a given total amount of emissions permits among countries, but the existing distribution methods such as auctioning and grandfathering have been debated. Here we describe a new model for permit allocation in emissions trading using the Boltzmann distribution. The Boltzmann distribution is introduced to permit allocation by combining it with concepts in emissions trading. A price determination mechanism for emission permits is then developed in relation to the {\\beta} value in the Boltzmann distribution. Finally, it is demonstrated how emissions permits can be practically allocated among participating countries in empirical results. Propagation direction reversal of ionization zones in the transition between high and low current magnetron sputtering

Past research has revealed the propagation of dense, asymmetric ionization zones in both high and low current magnetron discharges. Here we report about the direction reversal of ionization zone propagation as observed with fast cameras. At high currents, zones move in the E B direction with velocities of 103 to 104 m/s. However at lower currents, ionization zones are observed to move in the opposite, the -E B direction, with velocities ~;; 103 m/s. It is proposed that the direction reversal is associated with the local balance of ionization and supply of neutrals in the ionization zone.

Saturated Zone Colloid Transport

This scientific analysis provides retardation factors for colloids transporting in the saturated zone (SZ) and the unsaturated zone (UZ). These retardation factors represent the reversible chemical and physical filtration of colloids in the SZ. The value of the colloid retardation factor, R{sub col} is dependent on several factors, such as colloid size, colloid type, and geochemical conditions (e.g., pH, Eh, and ionic strength). These factors are folded into the distributions of R{sub col} that have been developed from field and experimental data collected under varying geochemical conditions with different colloid types and sizes. Attachment rate constants, k{sub att}, and detachment rate constants, k{sub det}, of colloids to the fracture surface have been measured for the fractured volcanics, and separate R{sub col} uncertainty distributions have been developed for attachment and detachment to clastic material and mineral grains in the alluvium. Radionuclides such as plutonium and americium sorb mostly (90 to 99 percent) irreversibly to colloids (BSC 2004 [DIRS 170025], Section 6.3.3.2). The colloid retardation factors developed in this analysis are needed to simulate the transport of radionuclides that are irreversibly sorbed onto colloids; this transport is discussed in the model report ''Site-Scale Saturated Zone Transport'' (BSC 2004 [DIRS 170036]). Although it is not exclusive to any particular radionuclide release scenario, this scientific analysis especially addresses those scenarios pertaining to evidence from waste-degradation experiments, which indicate that plutonium and americium may be irreversibly attached to colloids for the time scales of interest. A section of this report will also discuss the validity of using microspheres as analogs to colloids in some of the lab and field experiments used to obtain the colloid retardation factors. In addition, a small fraction of colloids travels with the groundwater without any significant retardation. Radionuclides irreversibly sorbed onto this fraction of colloids also transport without retardation. The transport times for these radionuclides will be the same as those for nonsorbing radionuclides. The fraction of nonretarding colloids developed in this analysis report is used in the abstraction of SZ and UZ transport models in support of the total system performance assessment (TSPA) for the license application (LA). This analysis report uses input from two Yucca Mountain Project (YMP) analysis reports. This analysis uses the assumption from ''Waste Form and In-Drift Colloids-Associated Radionuclide Concentrations: Abstraction and Summary'' that plutonium and americium are irreversibly sorbed to colloids generated by the waste degradation processes (BSC 2004 [DIRS 170025]). In addition, interpretations from RELAP analyses from ''Saturated Zone In-Situ Testing'' (BSC 2004 [DIRS 170010]) are used to develop the retardation factor distributions in this analysis.

The seal assembly combines a plate extending from the inner wall of a housing or inner enclosure that intersects with and is immersed in the fluid contained in a well formed in a tray contained within the enclosure. Optimizing operational flexibility and enforcement liability in Title V permits

Now that most states have interim or full approval of the portions of their state implementation plans (SIPs) implementing Title V (40 CFR Part 70) of the Clean Air Act Amendments (CAAA), most sources which require a Title V permit have submitted or are well on the way to submitting a Title V operating permit application. Numerous hours have been spent preparing applications to ensure the administrative completeness of the application and operational flexibility for the facility. Although much time and effort has been spent on Title V permit applications, the operating permit itself is the final goal. This paper outlines the major Federal requirements for Title V permits as given in the CAAA at 40 CFR 70.6, Permit Content. These Federal requirements and how they will effect final Title V permits and facilities will be discussed. This paper will provide information concerning the Federal requirements for Title V permits and suggestions on how to negotiate a Title V permit to maximize operational flexibility and minimize enforcement liability.

Reflection and Exclusion of Shear Zones in Inhomogeneous Granular Materials

Shear localization in granular materials is studied experimentally and numerically. The system consists of two material layers with different effective frictions. The presence of the material interface leads to a special type of "total internal reflection" of the shear zone. In a wide range of configurations the reflection is characterized by a fixed angle which is analogous to the critical angle of refraction in optics. The zone leaves and reenters the high friction region at this critical angle and in between it stays near the interface in the low friction region. The formalism describing the geometry of the shear zones and that of refracted and reflected light beams is very similar. For the internal visualization of shear localization two independent experimental techniques were used (i) excavation and (ii) Magnetic Resonance Imaging.

A sampling apparatus is provided which comprises a sampler for sampling air in the breathing zone of a wearer of the apparatus and a support for the sampler preferably in the form of a pair of eyeglasses. The sampler comprises a sampling assembly supported on the frame of the eyeglasses and including a pair of sample transport tubes which are suspended, in use, centrally of the frame so as to be disposed on opposite sides of the nose of the wearer and which each include an inlet therein that, in use, is disposed adjacent to a respective nostril of the nose of the wearer. A filter holder connected to sample transport tubes supports a removable filter for filtering out particulate material in the air sampled by the apparatus. The sample apparatus is connected to a pump for drawing air into the apparatus through the tube inlets so that the air passes through the filter.

In general, any plant that meets the definition of a major source must either obtain a Title V Operating permit, or take actions to ``act out`` of the Title V program. As part of the Hanford Federal Facility Agreement and Consent Order negotiations, the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affects groundwater or has the potential to affect groundwater would be subject to permitting under the structure of Chapter 173-216 (or 173-218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permit Program. This document constitutes the State Waste Discharge Permit application for the 400 Area Septic System. The influent to the system is domestic waste water. Although the 400 Area Septic System is not a Public Owned Treatment Works, the Public Owned Treatment Works application is more applicable than the application for industrial waste water. Therefore, the State Waste Discharge Permit application for Public Owned Treatment Works Discharges to Land was used.

Hydrodynamic force characteristics in the splash zone

A comprehensive experimental study concerned with the hydrodynamic force characteristics of both rigid and compliant surface piercing cylinders, with a major focus on the local nature of these characteristics as realized in the splash zone and in the fully submerged zone immediately below this region, has been in progress at the University of Melbourne for the last three years. This paper concentrates on a portion of this study associated with uni-directional regular wave inputs with wave steepness (H/{lambda}) in the range 0.0005--0.1580 and Keulegan-Carpenter (KC) numbers in the range 2--15 which encompasses inertia force dominant (KC<5) to drag force significant conditions (5zone are higher and exhibit a mild frequency dependence in comparison with their corresponding counterparts for the fully submerged segments. For weakly nonlinear waves (H/{lambda}<0.1) only wave fluctuation is found to be important and any mild nonlinearities do not significantly affect the test model force response and consequently the force coefficient values. It was prepared specifically to help cogeneration developers obtain the permits, licenses and approvals necessary to construct and operate a cogeneration facility. The regulations, agencies and policies described herein are subject to change. Changes are likely to occur whenever energy or a project becomes a political issue, a state legislature meets, a preexisting popular or valuable land use is thought threatened, elected and appointed officials change, and new directions are imposed on states and local governments by the federal government. Accordingly, cogeneration developers should verify and continuously monitor the status of laws and rules that might affect their plans. Developers are cautioned that the regulations described herein may only be a starting point on the road to obtaining all the necessary permits.

The most significant changes to the Waste Isolation Pilot Plant Hazardous Waste Facility Permit to date were completed during the past year with the implementation of significant revisions to the Waste Analysis Plan and the authorization to dispose of remote-handled transuranic waste. The modified Permit removes the requirement for reporting headspace gas sampling and analysis results for every container of transuranic mixed waste and provides for the use of radiography and visual examination to confirm a statistically representative subpopulation of the waste stream in each waste shipment as well as other changes that streamline the analytical data management process. Unsaturated Zone and Saturated Zone Transport Properties (U0100)

This Analysis/Model Report (AMR) summarizes transport properties for the lower unsaturated zone hydrogeologic units and the saturated zone at Yucca Mountain and provides a summary of data from the Busted Butte Unsaturated Zone Transport Test (UZTT). The purpose of this report is to summarize the sorption and transport knowledge relevant to flow and transport in the units below Yucca Mountain and to provide backup documentation for the sorption parameters decided upon for each rock type. Because of the complexity of processes such as sorption, and because of the lack of direct data for many conditions that may be relevant for Yucca Mountain, data from systems outside of Yucca Mountain are also included. The data reported in this AMR will be used in Total System Performance Assessment (TSPA) calculations and as general scientific support for various Process Model Reports (PMRs) requiring knowledge of the transport properties of different materials. This report provides, but is not limited to, sorption coefficients and other relevant thermodynamic and transport properties for the radioisotopes of concern, especially neptunium (Np), plutonium (Pu), Uranium (U), technetium (Tc), iodine (I), and selenium (Se). The unsaturated-zone (UZ) transport properties in the vitric Calico Hills (CHv) are discussed, as are colloidal transport data based on the Busted Butte UZTT, the saturated tuff, and alluvium. These values were determined through expert elicitation, direct measurements, and data analysis. The transport parameters include information on interactions of the fractures and matrix. In addition, core matrix permeability data from the Busted Butte UZTT are summarized by both percent alteration and dispersion.

The Regulatory and Permitting Information Desktop (RAPID) Toolkit combines the former Geothermal Regulatory Roadmap, National Environmental Policy Act (NEPA) Database, and other resources into a Web-based tool that gives the regulatory and utility-scale geothermal developer communities rapid and easy access to permitting information. RAPID currently comprises five tools - Permitting Atlas, Regulatory Roadmap, Resource Library, NEPA Database, and Best Practices. A beta release of an additional tool, the Permitting Wizard, is scheduled for late 2014. Because of the huge amount of information involved, RAPID was developed in a wiki platform to allow industry and regulatory agencies to maintain the content in the future so that it continues to provide relevant and accurate information to users. In 2014, the content was expanded to include regulatory requirements for utility-scale solar and bulk transmission development projects. Going forward, development of the RAPID Toolkit will focus on expanding the capabilities of current tools, developing additional tools, including additional technologies, and continuing to increase stakeholder involvement.

As part of the Hanford Federal Facility Agreement and Consent Order negotiations (Ecology et al. 1994), the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affect groundwater or have the potential to affect ground would be subject to permitting under the structure of Chapter 173-216 (or 173-218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permit Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered into Consent Order No. DE 91NM-177, (Ecology and DOE-RL 1991). The Consent Order No. DE 91NM-177 requires a series of permitting activities for liquid effluent discharges. This document presents the State Waste Discharge Permit (SWDP) application for the 200-E Chemical Drain Field. Waste water from the 272-E Building enters the process sewer line directly through a floor drain, while waste water from the 2703-E Building is collected in two floor drains, (north and south) that act as sumps and are discharged periodically. The 272-E and 2703-E Buildings constitute the only discharges to the process sewer line and the 200-E Chemical Drain Field.

As part of the Hanford Federal Facility Agreement and Consent Order negotiations (Ecology et al. 1994), the US Department of Energy, Richland Operations Office, the US Environmental Protection Agency, and the Washington State Department of Ecology agreed that liquid effluent discharges to the ground on the Hanford Site which affect groundwater or have the potential to affect groundwater would be subject to permitting under the structure of Chapter 173--216 (or 173--218 where applicable) of the Washington Administrative Code, the State Waste Discharge Permit Program. As a result of this decision, the Washington State Department of Ecology and the US Department of Energy, Richland Operations Office entered into Consent Order No. DE 91NM-177, (Ecology and DOE-RL 1991). This document constitutes the State Waste Discharge Permit application for the 100-N Sewage Lagoon. Since the influent to the sewer lagoon is domestic waste water, the State Waste Discharge Permit application for Public Owned Treatment Works Discharges to Land was used. Although the 100-N Sewage Lagoon is not a Public Owned Treatment Works, the Public Owned Treatment Works application is more applicable than the application for industrial waste water. The 100-N Sewage Lagoon serves the 100-N Area and other Hanford Site areas by receiving domestic waste from two sources. A network of sanitary sewer piping and lift stations transfers domestic waste water from the 100-N Area buildings directly to the 100-N Sewage Lagoon. Waste is also received by trucks that transport domestic waste pumped from on site septic tanks and holding tanks. Three ponds comprise the 100-N Sewage Lagoon treatment system. These include a lined aeration pond and stabilization pond, as well as an unlined infiltration pond. Both piped-in and trucked-in domestic waste is discharged directly into the aeration pond.

State Waste Discharge Permit Application: Electric resistance tomography testing

This permit application documentation is for a State Waste Discharge Permit issued in accordance with requirements of Washington Administrative Code 173-216. The activity being permitted is a technology test using electrical resistance tomography. The electrical resistance tomography technology was developed at Lawrence Livermore National Laboratory and has been used at other waste sites to track underground contamination plumes. The electrical resistance tomography technology measures soil electrical resistance between two electrodes. If a fluid contaminated with electrolytes is introduced into the soil, the soil resistance is expected to drop. By using an array of measurement electrodes in several boreholes, the areal extent of contamination can be estimated. At the Hanford Site, the purpose of the testing is to determine if the electrical resistance tomography technology can be used in the vicinity of large underground metal tanks without the metal tank interfering with the test. It is anticipated that the electrical resistance tomography technology will provide a method for accurately detecting leaks from the bottom of underground tanks, such as the Hanford Site single-shell tanks.

Under contract to the Office of Leasing Policy Development (LPDO), Jack Faucett Associates is currently undertaking the description and analysis of the Outer Continental Shelf (OCS) regulatory process to determine the nature of time delays that affect OCS production of oil and gas. This report represents the results of the first phase of research under this contract, the description and analysis of regulatory activity associated with exploration activities on the Federal OCS. Volume 1 contains the following three sections: (1) study results; (2) Federal regulatory activities during exploration of Federal OCS leases which involved the US Geological Survey, Environmental Protection Agency, US Coast Guard, Corps of Engineers, and National Ocean and Atmospheric Administration; and (3) state regulatory activities during exploration of Federal OCS leases of Alaska, California, Louisiana, Massachusetts, New Jersey, North Carolina and Texas. Volume II contains appendices of US Geological Survey, Environmental Protection Agency, Coast Guard, Corps of Engineers, the Coastal Zone Management Act, and Alaska. The major causes of delay in the regulatory process governing exploration was summarized in four broad categories: (1) the long and tedious process associated with the Environmental Protection Agency's implementation of the National Pollutant Discharge Elimination System Permit; (2) thelack of mandated time periods for the completion of individual activities in the permitting process; (3) the lack of overall coordination of OCS exploratory regulation; and (4) the inexperience of states, the Federal government and industry relating to the appropriate level of regulation for first-time lease sale areas.

Efficient small-scale dynamo in solar convection zone

We investigate small-scale dynamo action in the solar convection zone through a series of high resolution MHD simulations in a local Cartesian domain with 1$R_\\odot$ (solar radius) of horizontal extent and a radial extent from 0.715 to 0.96$R_\\odot$. The dependence of the solution on resolution and diffusivity is studied. For a grid spacing of less than 350 km, the root mean square magnetic field strength near the base of the convection zone reaches 95% of the equipartition field strength (i.e. magnetic and kinetic energy are comparable). For these solutions the Lorentz force feedback on the convection velocity is found to be significant. The velocity near the base of the convection zone is reduced to 50% of the hydrodynamic one. In spite of a significant decrease of the convection velocity, the reduction in the enthalpy flux is relatively small, since the magnetic field also suppresses the horizontal mixing of the entropy between up- and downflow regions. Alaska Oil and Gas Exploration, Development, and Permitting Project

This is the final technical report for Project 15446, covering the grant period of October 2002 through March 2006. This project connects three parts of the oil exploration, development, and permitting process to form the foundation for an advanced information technology infrastructure to better support resource development and resource conservation. Alaska has nearly one-quarter of the nation's supply of crude oil, at least five billion barrels of proven reserves. The American Association of Petroleum Geologists report that the 1995 National Assessment identified the North Slope as having 7.4 billion barrels of technically recoverable oil and over 63 trillion cubic feet of natural gas. From these reserves, Alaska produces roughly one-fifth of the nation's daily crude oil production, or approximately one million barrels per day from over 1,800 active wells. The broad goal of this grant is to increase domestic production from Alaska's known producing fields through the implementation of preferred upstream management practices. (PUMP). Internet publication of extensive and detailed geotechnical data is the first task, improving the permitting process is the second task, and building an advanced geographical information system to offer continuing support and public access of the first two goals is the third task. Excellent progress has been made on all three tasks; the technical objectives as defined by the approved grant sub-tasks have been met. The end date for the grant was March 31, 2006.

The current Hanford Facility Dangerous Waste Permit Application is considered to be a single application organized into a General Information Portion (this document, number DOE/RL-91-28) and a treatment, storage, and/or disposal Unit-Specific Portion, which includes documentation for individual TSD units (e.g., document numbers DOE/RL-89-03 and DOE/RL-90-01). Both portions consist of a Part A division and a Part B division. The Part B division consists of 15 chapters that address the content of the Part B checklists prepared by the Washington State Department of Ecology (Ecology 1987) and the US Environmental Protection Agency (40 Code of Federal Regulations 270), with additional information requirements mandated by the Hazardous and Solid Waste Amendments of 1984 and revisions of Washington Administrative Code 173-303. For ease of reference, the Washington State Department of Ecology checklist section numbers, in brackets, follow the chapter headings and subheadings. Documentation contained in the General Information Portion (i.e., this document, number DOE/RL-91-28) is broader in nature and applies to all treatment, storage, and/or disposal units for which final status is sought. Robert Griffiths has recently addressed, within the framework of a ‘consistent quantum theory’ (CQT) that he has developed, the issue of whether, as is often claimed, quantum mechanics entails a need for faster-than-light transfers of information over long distances. He argues, on the basis of his examination of certain arguments that claim to demonstrate the existence of such nonlocal influences, that such influences do not exist. However, his examination was restricted mainly to hidden-variable-based arguments that include in their premises some essentially classical-physics-type assumptions that are fundamentally incompatible with the precepts of quantum physics. One cannot logically prove properties of a system by attributing to the system properties alien to that system. Hence Griffiths’ rejection of hidden-variable-based proofs is logically warranted. Griffiths mentions the existence of a certain alternative proof that does not involve hidden variables, and that uses only macroscopically described observable properties. He notes that he had examined in his book proofs of this general kind, and concluded that they provide no evidence for nonlocal influences. But he did not examine the particular proof that he cites. An examination of that particular proof by the method specified by his ‘consistent quantum theory’ shows that the cited proof is valid within that restrictive framework. This necessary existence, within the ‘consistent’ framework, of long range essentially instantaneous influences refutes the claim made by Griffiths that his ‘consistent’ framework is superior to the orthodox quantum theory of von Neumann because it does not entail instantaneous influences. An added section responds to Griffiths’ reply, which cites a litany of ambiguities that seem to restrict, devastatingly, the scope of his CQT formalism, apparently to buttress his claim that my use of that formalism to validate the nonlocality theorem is flawed. But the vagaries that he cites do not upset the proof in question. It is show here in detail why the precise statement of this theorem justifies the specified application of CQT. It is also shown, in response to his challenge, why a putative proof of locality that he has proposed is not valid.

The thermodynamics of general and local anesthesia

General anesthetics are known to cause depression of the freezing point of transitions in biomembranes. This is a consequence of ideal mixing of the anesthetic drugs in the membrane fluid phase and exclusion from the solid phase. Such a generic law provides physical justification of the famous Meyer-Overton rule. We show here that general anesthetics, barbiturates and local anesthetics all display the same effect on melting transitions. Their effect is reversed by hydrostatic pressure. Thus, the thermodynamic behavior of local anesthetics is very similar to that of general anesthetics. We present a detailed thermodynamic analysis of heat capacity profiles of membranes in the presence of anesthetics. This analysis is able to describe experimentally observed calorimetric profiles and permits prediction of the anesthetic features of arbitrary molecules. In addition, we discuss the thermodynamic origin of the cutoff-effect of long-chain alcohols and the additivity of the effect of general and local anesthetics.

Carbon tax or carbon permits: The impact on generators' risks

Volatile fuel prices affect both the cost and price of electricity in a liberalized market. Generators with the price-setting technology will face less risk to their profit margins than those with costs that are not correlated with price, even if those costs are not volatile. Emissions permit prices may respond to relative fuel prices, further increasing volatility. This paper simulates the impact of this on generators' profits, comparing an emissions trading scheme and a carbon tax against predictions for the UK in 2020. The carbon tax reduces the volatility faced by nuclear generators, but raises that faced by fossil fuel stations. Optimal portfolios would contain a higher proportion of nuclear plant if a carbon tax was adopted.

We present bipartite Bell-type inequalities which allow the two partners to use some non-local resource. Such inequality can only be violated if the parties use a resource which is more non-local than the one permitted by the inequality. We introduce a family of N-inputs non-local machines, which are generalizations of the well-known PR-box. Then we construct Bell-type inequalities that cannot be violated by strategies that use one these new machines. Finally we discuss implications for the simulation of quantum states.

Vadose Zone Transport Field Study: Status Report

Studies were initiated at the Hanford Site to evaluate the process controlling the transport of fluids in the vadose zone and to develop a reliable database upon which vadose-zone transport models can be calibrated. These models are needed to evaluate contaminant migration through the vadose zone to underlying groundwaters at Hanford. A study site that had previously been extensively characterized using geophysical monitoring techniques was selected in the 200 E Area. Techniques used previously included neutron probe for water content, spectral gamma logging for radionuclide tracers, and gamma scattering for wet bulk density. Building on the characterization efforts of the past 20 years, the site was instrumented to facilitate the comparison of nine vadose-zone characterization methods: advanced tensiometers, neutron probe, electrical resistance tomography (ERT), high-resolution resistivity (HRR), electromagnetic induction imaging (EMI), cross-borehole radar (XBR), and cross-borehole seismic (XBS). Zone methods and the fermion sign problem

We review a recently proposed approach to the problem of alternating signs for fermionic many body Monte Carlo simulations in finite temperature simulations. We derive an estimate for fermion wandering lengths and introduce the notion of permutation zones, special regions of the lattice where identical fermions may interchange and outside of which they may not. Using successively larger permutation zones, one can extrapolate to obtain thermodynamic observables in regimes where direct simulation is impossible.

Treating nahcolite containing formations and saline zones

A method for treating a nahcolite containing subsurface formation includes removing water from a saline zone in or near the formation. The removed water is heated using a steam and electricity cogeneration facility. The heated water is provided to the nahcolite containing formation. A fluid is produced from the nahcolite containing formation. The fluid includes at least some dissolved nahcolite. At least some of the fluid is provided to the saline zone.

The 200 Area Effluent Treatment Facility Dangerous Waste Permit Application documentation consists of both Part A and a Part B permit application documentation. An explanation of the Part A revisions associated with this treatment and storage unit, including the current revision, is provided at the beginning of the Part A section. Once the initial Hanford Facility Dangerous Waste Permit is issued, the following process will be used. As final, certified treatment, storage, and/or disposal unit-specific documents are developed, and completeness notifications are made by the US Environmental Protection Agency and the Washington State Department of Ecology, additional unit-specific permit conditions will be incorporated into the Hanford Facility Dangerous Waste Permit through the permit modification process. All treatment, storage, and/or disposal units that are included in the Hanford Facility Dangerous Waste Permit Application will operate under interim status until final status conditions for these units are incorporated into the Hanford Facility Dangerous Waste Permit. Determining enforceability of air quality requirements for the Title V permit

The focus of this paper is two-fold: (1) Outline the importance, from the perspective of the regulated source, of the identification of state-only enforceable requirements versus federally enforceable requirements in a Title V permit; (2) Describe how to determine the enforceability of requirements as part of a Title V permitting study, including available tools. Contained also in this paper is a case study of enforceability determinations of requirements included in the Title V permit for an integrated pulp and paper mill. The case study is presented to provide an impetus for sources to thoroughly review their draft Title V permits to ensure correct determinations of enforceability.
