    In order to evaluate the transfer of certain Federal lands at Los Alamos National Laboratory (LANL), the US Department of Energy (DOE) determined that the proposed action had the potential to result in environmental impacts and required the preparation of an Environmental Assessment under the National Environmental Policy Act (NEPA). The specific proposed action evaluated by DOE with support from LANL was the transfer of approximately 28 contiguous acres of underutilized Federal land to the County. This tract was locally referred to as the DP Road tract. Although the land was underutilized, it functioned as part of a larger buffer area between potentially hazardous operations at LANL and the general public. The tract was covered with scrub vegetation. There were no government buildings located on the site. The tract of land had two Resource Conservation and Recovery Act (RCRA) Solid Waste Management Units (SWMUs) located within the tract boundary as well as a buried but active liquid radioactive waste pipeline that crossed the site. The tract of land was adjacent to several other DOE SWMUs as well as a public road. In addition, there were ownership issues pertaining to the transfer of the land to persons and agencies other than the County. This particular tract of land was being considered for transfer to the County at the same time DOE and LANL began evaluating another large Federal land tract for lease to the County to be developed as a private research park.

    This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    Much of the environmental and technical data useful to the oil and gas industry and regulatory agencies is now contained in disparate state and federal databases. Delays in coordinating permit approvals between federal and state agencies translate into increased operational costs and stresses for the oil and gas industry. Making federal lease stipulation and area restriction data available on state agency Web sites will streamline a potential lessors review of available leases, encourage more active bidding on unleased federal lands, and give third-party operators independent access to data who otherwise may not have access to lease restrictions and other environmental data. As a requirement of the Energy Policy Conservation Act (EPCA), the Bureau of Land Management (BLM) is in the process of inventorying oil and natural gas resources beneath onshore federal lands and the extent and nature of any stipulation, restrictions, or impediments to the development of these resources. The EPCA Phase 1 Inventory resulted in a collection of GIS coverage files organized according to numerous lease stipulation reference codes. Meanwhile, state agencies also collect millions of data elements concerning oil and gas operations. Much of the oil and gas data nationwide is catalogued in the Ground Water Protection Council's (GWPC's) successfully completed Risk Based Data Management System (RBDMS). The GWPC and the states of Colorado, New Mexico, Utah, and Montana are implementing a pilot project where BLM lease stipulation data and RBDMS data will be displayed in a GIS format on the Internet. This increased access to data will increase bid activity, help expedite permitting, and encourage exploration on federal lands. Linking environmental, lease stipulation and resource inventory assessment data and making a GIS interface for the data available to industry and other agencies via the internet represents an important step in the GWPC strategy for all oil and gas regulatory e-commerce. The next step beyond mere data sharing for facilitating the permitting process is to make it possible for industry to file those permit applications electronically. This process will involve the use of common XML schemas.

    As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the “footprint” of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections. Transmission lines and pipelines are proposed in Alaska; however there are no locations that intersect national trails. Source data did not indicate any planned transmission lines or pipelines in Hawaii. A map atlas provides more detailed mapping of the topics investigated in this study, and the accompanying GIS database provides the baseline information for further investigating locations of interest. In many cases the locations of proposed transmission lines are not accurately mapped (or a specific route may not yet be determined), and accordingly the specific crossing locations are speculative. However since both national trails and electrical transmission lines are long linear systems, the characteristics of the crossings reported in this study are expected to be similar to both observed characteristics of the existing infrastructure provided in this report, and of the new infrastructure if these proposed projects are built. More focused study of these siting challenges is expected to mitigate some of potential impacts by choosing routes that minimize or eliminate them. The current study primarily addresses a set of screening-level characterizations that provide insights into how the National Trail System may influence the siting of energy transport facilities in the states identified under Section 368(b) of the Energy Policy Act of 2005. As such, it initializes gathering and beginning analysis of the primary environmental and energy data, and maps the contextual relationships between an important national environmental asset and how this asset intersects with energy planning activities. Thus the current study sets the stage for more in-depth analyses and data development activities that begin to solve key transmission siting constraints. Our recommendations for future work incorporate two major areas: (1) database development and analytics and (2) modeling and scenario analysis for energy planning. These recommendations provide a path forward to address key issues originally developed under the Energy Policy Act of 2005 that are now being carried forward under the President’s Climate Action Plan.

    About 6% of the total coa resource was selected for assessment in the Gulf of Mexico Coastal Plain region of the NCRA project underlies federally proclaimed management areas. Of the approximately 11 billion short tons of coal in this category, approximately 37 percent are estimated to be federally owned. Much of the coal in these categories may not be available for mining, and much of it is probably not economically recoverable. The dispersed nature of Federal holdings, the complicated nature of surface and mineral estate ownership, and the existence of various legal and technological restrictions may remove a significant portion of this coal resource from consideration for development. Continuing work by USGS scientists suggests that potentially viable energy resources of coal-bed methane are present within both Federal and non-Federal areas of the Gulf of Mexico Coastal Plain coal-bearing region. 3 refs., 3 figs.

    Suits in the last 4-5 years jeopardize the title of thousands of mining claims and mineral leases. The cases presenting the most striking examples are National Wildlife Federation v. Burford, Connor v. Burford, Sierra Club V. Watt, and Bob Marshall Alliance v. Watt. From the claimants' and lessees' point of view, these decisions granted environmental groups sweeping, though somewhat ill-defined, relief. The challenges by environmental groups are based on statutes designed to bring environmental considerations before federal decision makers. The claimants and lessees are caught in the middle of the exchange between environmentalists and federal agencies. Lawsuits that indirectly challenge leases and claims are unlike environmental challenges to fixed projects such as highways or dams. Those affected often times do not know exactly what is at stake. When the challenge is indirect, unexplored, or partially explored, proper ties have only speculative value and the claimants and lessees are often unwilling or unable to engage in a fight with well-heeled environmental public interest law firms. While the federal government has defended the suits, their interests and those of the claimants and lessees may diverge. In the context of the four cases mentioned above, this paper addresses the rights and remedies of claimants and lessees before, during, and after environmental procedural suits that indirectly challenge federal mining claims and mineral leases.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation corridors in the 11 western states, Section 368(b) directs the Agencies to first identify corridors and then schedule prompt action to identify, designate, and incorporate the corridors into applicable land use plans. To comply with the congressional direction provided in Section 368(b), the Agencies investigated corridor identification issues in the Section 368(b) states; this report to Congress provides information that could be relevant to possible future designation of energy corridors. Future designations, if appropriate and necessary, would occur when the Agencies undertake revisions and/or updates to land use plans that guide management decisions on lands located within individual administrative units, such as specific National Forests, National Parks, or Wildlife Refuges. At this time, the Agencies are not proposing any actions or decisions related directly or indirectly to designating energy corridors on federal land under Section 368(b) of EPAct.

    The displacement or deferral of conventional AC transmission line installation is a key benefit associated with several technologies being developed with the support of the U.S. Department of Energy`s Office of Energy Management (OEM). Previous benefits assessments conducted within OEM have been based on significantly different assumptions for the average cost per mile of AC transmission line. In response to this uncertainty, an investigation of transmission line capital cost data was initiated. The objective of this study was to develop a database for preparing preliminary estimates of transmission line costs. An extensive search of potential data sources identified databases maintained by the Bonneville Power Administration (BPA) and the Western Area Power Administration (WAPA) as superior sources of transmission line cost data. The BPA and WAPA data were adjusted to a common basis and combined together. The composite database covers voltage levels from 13.8 to 765 W, with cost estimates for a given voltage level varying depending on conductor size, tower material type, tower frame type, and number of circuits. Reported transmission line costs vary significantly, even for a given voltage level. This can usually be explained by variation in the design factors noted above and variation in environmental and land (right-of-way) costs, which are extremely site-specific. Cost estimates prepared from the composite database were compared to cost data collected by the Federal Energy Regulatory Commission (FERC) for investor-owned utilities from across the United States. The comparison was hampered because the only design specifications included with the FERC data were voltage level and line length. Working within this limitation, the FERC data were not found to differ significantly from the composite database. Therefore, the composite database was judged to be a reasonable proxy for estimating national average costs.

    This report addresses the land use impacts of past and future energy development and summarizes the major federal and state legislation which influences the potential land use impacts of energy facilities and can thus influence the locations and timing of energy development. In addition, this report describes and presents the data which are used to measure, and in some cases, predict the potential conflicts between energy development and alternative uses of the nation's land resources. The topics section of this report is divided into three parts. The first part describes the myriad of federal, state and local legislation which have a direct or indirect impact upon the use of land for energy development. The second part addresses the potential land use impacts associated with the extraction, conversion and combustion of energy resources, as well as the disposal of wastes generated by these processes. The third part discusses the conflicts that might arise between agriculture and energy development as projected under a number of DOE mid-term (1990) energy supply and demand scenarios.

    DOE has prepared the EIS to evaluate the potential environmental impacts associated with implementing a comprehensive land-use plan (CLUP) for the Hanford Site for at least the next 50 years. DOE is expected to use this land-use plan in its decision-making process to establish what is the “highest and best use” of the land (41 Code of Federal Regulations [CFR] 101-47, “Federal Property Management Regulations”). The final selection of a land-use map, land-use policies, and implementing procedures would create the working CLUP when they are adopted through the ROD for the EIS.

    Plaintiff Rocky Mountain Oil and Gas Association, a non-profit trade association, brought suit against the Secretary of the Interior, challenging land management policies of the Department of the Interior which plaintiff contended have effectively prohibited oil and gas exploration in areas proposed as wilderness under the Federal Land Policy Management Act of 1976 (FLPMA). The principal issue at trial was Interior's interpretation of the wilderness study provisions contained in Section 603 of the Act, which directed that activities on oil and gas leases in proposed wilderness areas be managed so as to prevent impairment of wilderness values. The United States Court for the District of Wyoming, Kerr, J., held that strict application of the non-impairment standard of Section 603, FLPMA, by the Department of the Interior virtually halted oil and gas exploration in proposed wilderness areas, and is therefore statutorily erroneous, clearly contrary to Congressional intent, and counter-productive to public interest. The Trial Court's decision is being appealed to the Tenth Circuit Court of Appeals under the title Rocky Mountain Oil and Gas Association v. Watt. 91 references.

    Most planners working west of the 100th meridian are aware that federal lands make up a large portion of the lands in the western states. In fact, federal lands comprise nearly 49% of the area of the fourteen states that make up the WPR family. These lands are usually under the Department of Agriculture (USFS) and the Department of Interior (BLM and NPS), but the Departments of Defense (DOD) and Energy (DOE) are also federal stewards of western lands. These federal military and energy installations play an important role in local and regional western communities and economies. They also play an important role in regional ecologies. It is a paradox that some of these sites have their share of legacy contamination from earlier missions, but they also include some of the most pristine remaining western ecosystems. In some cases, the sites are located near or surrounded by encroaching urbanization, making them particularly valuable lands both for recreation and habitat preservation.

    The Department of Energy (DOE), and the Western Area Power Administration (Western) proposes to construct and maintain a 345- kilovolt (kV) transmission line between Craig, Colorado, and Bonanza in eastern Utah. The project began in 1986 and construction is scheduled to be completed in 1989. The project, known as the Craig-Bonanza 345-kV Transmission Line Project (Project), will be located in Moffat and Rio Blanco counties in Colorado and Uintah County in Utah. Western has the lead role for project development and management, including environmental studies and construction. Cooperating federal agencies include the Bureau of Land Management (BLM), Rural Electrification Administration, US Fish and Wildlife Service, and Bureau of Indian Affairs.     Tucson Electric Power Company (TEP) has applied to the U.S. Department of Energy (DOE) for a Presidential Permit to construct and operate a double-circuit, 345,000-volt (345-kV) electric transmission line across the United States border with Mexico. Under Executive Order (EO) 10485 of September 3, 1953, as amended by EO 12038 of February 3, 1978, a Presidential Permit is required to construct, connect, operate, or maintain facilities at the U.S. international border for the transmission of electric energy between the United States and a foreign country. DOE has determined that the issuance of a Presidential Permit to TEP for the proposed project would constitute a major Federal action that may have a significant impact on the environment within the meaning of the ''National Environmental Policy Act of 1969'' (NEPA) 42 United States Code (U.S.C.) {section}4321 et seq. For this reason, DOE has prepared this Draft Environmental Impact Statement (EIS) to evaluate potential environmental impacts from the proposed Federal action (granting a Presidential Permit for the proposed transmission facilities) and reasonable alternatives, including the No Action Alternative. This EIS was prepared in accordance with Section 102(2)(c) of NEPA, Council of Environmental Quality (CEQ) regulations (40 Code of Federal Regulations [CFR] 1500-1508), and DOE NEPA Implementing Procedures (10 CFR 1021). DOE is the lead Federal Agency, as defined by 40 CFR 1501.5. The U.S. Department of Agriculture Forest Service (USFS), the Bureau of Land Management (BLM) of the U.S. Department of the Interior, and the U.S. Section of the International Boundary and Water Commission, U.S. and Mexico (USIBWC), are cooperating agencies. Each of these organizations will use the EIS for its own NEPA purposes, as described in the Federal Agencies' Purpose and Need and Authorizing Actions section of this summary. The 345-kV double-circuit transmission line would consist of twelve transmission line wires, or conductors, and two neutral ground wires that would provide both lightning protection and fiber optic communications, on a single set of support structures. The transmission line would originate at TEP's existing South Substation (which TEP would expand), in the vicinity of Sahuarita, Arizona, and interconnect with the Citizens Communications (Citizens) system at a Gateway Substation that TEP would construct west of Nogales, Arizona. The double-circuit transmission line would continue from the Gateway Substation south to cross the U.S.-Mexico border and extend approximately 60 miles (mi) (98 kilometers [km]) into the Sonoran region of Mexico, connecting with the Comision Federal de Electricidad (CFE, the national electric utility of Mexico) at CFE's Santa Ana Substation.

    The Arid Lands Ecology (ALE) facility is a 312-sq-km tract of land that lies on the western side of the Hanford Site in southcentral Washington. The US Atomic Energy Commission officially set aside this land area in 1967 to preserve shrub-steppe habitat and vegetation. The ALE facility is managed by Pacific Northwest Laboratory (PNL) for the US Department of Energy (DOE) for ecological research and education purposes. In 1971, the ALE facility was designated the Rattlesnake Hills Research Natural Area (RNA) as a result of an interagency federal cooperative agreement, and remains the largest RNA in Washington. it is also one of the few remaining large tracts of shrub-steppe vegetation in the state retaining a predominant preeuropean settlement character. This management plan provides policy and implementation methods for management of the ALE facilities consistent with both US Department of Energy Headquarters and the Richland Field Office decision (US Congress 1977) to designate and manage ALE lands as an RNA and as a component of the DOE National Environmental Research Park System.

    Reclamation has long been recognized as an essential action necessary to mitigate the degradation of land caused by mining activities. But, it is only within the past several decades that reclamation has become an integral component of the mineral extraction process. While the Metallic Mining Reclamation Act (MMRA) was passed in 1973, Wisconsin is yet to enact comprehensive state-wide reclamation requirements for mining other than metallic minerals and the code for metallic mining has yet to establish procedures and standards for reclamation success, specifically revegetation and postmining land use. This study integrates several interdisciplinary methodologies including a history of reclamation; an inventory and status report of mined lands; a critique and comparison of existing reclamation policy with previous state and current federal reclamation policies; in-field case studies of revegetation parameters, procedures, and performance standards; and an economic analysis of reclamation technology. This study makes three major recommendations: (1) The metallic mining code should be amended to establish vegetation parameters, measuring methods, and performance standards for revegetation success similar to those contained in the federal Surface Mining Control and Reclamation Act (SMCRA); (2) The metallic mining code should be amended to resolve semantic loopholes by clearly defining the endpoints of terms such as restoration, reclamation, and rehabilitation and by utilizing the reclamation continuum as a planning tool for determining acceptable postmining land use alternatives; and (3) Mandatory statewide nonmetallic legislation should be enacted to strengthen the mineral resource management program in Wisconsin by systematically and uniformly regulating the mining and reclamation of nonmetallic minerals, the state's most important mineral resource.

    The US Department of Energy`s (DOE) changing mission, coupled with the need to apply appropriate cleanup standards for current and future environmental restoration, prompted the need for a process to determine preferred Future Land Uses for DOE-owned sites. DOE began the ``Future Land Use`` initiative in 1994 to ensure that its cleanup efforts reflect the surrounding communities` interests in future land use. This plan presents the results of a study of stakeholder-preferred future land uses for the Brookhaven National Laboratory (BNL), located in central Long Island, New York. The plan gives the Laboratory`s view of its future development over the next 20 years, as well as land uses preferred by the community were BNL ever to cease operations as a national laboratory (the post-BNL scenario). The plan provides an overview of the physical features of the site including its history, topography, geology/hydrogeology, biological inventory, floodplains, wetlands, climate, and atmosphere. Utility systems and current environmental operations are described including waste management, waste water treatment, hazardous waste management, refuse disposal and ground water management. To complement the physical descriptions of the site, demographics are discussed, including overviews of the surrounding areas, laboratory population, and economic and non-economic impacts.

    Leakage occurs whenever actions to mitigate greenhouse gas emissions in one part of the world unleash countervailing forces elsewhere in the world so that reductions in global emissions are less than emissions mitigation in the mitigating region. While many researchers have examined the concept of industrial leakage, land-use policies can also result in leakage. We show that land-use leakage is potentially as large as or larger than industrial leakage. We identify two potential land-use leakage drivers, land-use policies and bioenergy. We distinguish between these two pathways and run numerical experiments for each. We also show that the land-use policy environment exerts a powerful influence on leakage and that under some policy designs leakage can be negative. International offsets are a potential mechanism to communicate emissions mitigation beyond the borders of emissions mitigating regions, but in a stabilization regime designed to limit radiative forcing to 3.7 2/m2, this also implies greater emissions mitigation commitments on the part of mitigating regions.

    Argonne National Laboratory`s Expedited Side Characterization (ESC) methodology gives federal agencies a process for producing high-quality CERCLA and RCRA site characterizations and remedial investigations in a cost- and time-efficient manner. The ESC process has been successfully tested and applied at numerous federal facilities. Examples include expanded site investigations for the Department of Interior`s Bureau of Land Management and remedial investigations for the Commodity Credit Corporation/US Dept. of Agriculture (CCC/USDA). In particular, the CCC/USDA has been the major sponsor in the development of the ESC process at Argonne. The technical successes and the cost and time savings of the ESC process for these programs have been detailed in previous papers. The Argonne ESC is currently being implemented at a Department of Energy facility (Pantex) and is schedules for implementation in the Department of Defense base closure program in order to meet accelerated schedules for remedial actions by these agencies.

    The coal producing area of Appalachian Kentucky has a shortage of developable land. The majority of mined land in this region has been reclaimed to pastureland or hayland, while narrow interpretation of the Surface Mining Control and Reclamation Act of 1977 (SMCRA) and regulations, especially regarding bond release, has limited alternative postmining land uses which could support economic development. A study of Federal and State of Kentucky laws and regulations shows that postmining land use regulations and their implementation have focussed on preventing and minimizing environmental damage. Land use and land use planning concepts are not well understood, thus permit applications inadequately address land use needs and the {open_quotes}highest and best use{close_quotes} of a site. Required information about pre-mining conditions is not collected and analyzed in a way useful for determining appropriate postmining land use. More comprehensive, higher quality land use information, with information about regional factors such as transportation, utilities, labor market, etc., should be included in the permit application to identify sites with strong development potential. This, combined with a broader interpretation of the law recognizing the validity of a phased implementation of postmined land use, would continue environmental protection while preparing reclaimed land to meet potential future land use needs. The mining plan can be designed so that appropriate areas are prepared and laid out for future buildings or roads, yet are conducive to interim use for pasture, wildlife or recreation. Reclamation to the interim use, sufficient to protect the public and allow bond release, maintains the potential for later development. Land later can be made available in response to development demands, contributing to a more diversified economy.

    To accomplish Federal goals for renewable energy, sustainability, and energy security, large-scale renewable energy projects must be developed and constructed on Federal sites at a significant scale with significant private investment. For the purposes of this Guide, large-scale Federal renewable energy projects are defined as renewable energy facilities larger than 10 megawatts (MW) that are sited on Federal property and lands and typically financed and owned by third parties.1 The U.S. Department of Energy’s Federal Energy Management Program (FEMP) helps Federal agencies meet these goals and assists agency personnel navigate the complexities of developing such projects and attract the necessary private capital to complete them. This Guide is intended to provide a general resource that will begin to develop the Federal employee’s awareness and understanding of the project developer’s operating environment and the private sector’s awareness and understanding of the Federal environment. Because the vast majority of the investment that is required to meet the goals for large-scale renewable energy projects will come from the private sector, this Guide has been organized to match Federal processes with typical phases of commercial project development. FEMP collaborated with the National Renewable Energy Laboratory (NREL) and professional project developers on this Guide to ensure that Federal projects have key elements recognizable to private sector developers and investors. The main purpose of this Guide is to provide a project development framework to allow the Federal Government, private developers, and investors to work in a coordinated fashion on large-scale renewable energy projects. The framework includes key elements that describe a successful, financially attractive large-scale renewable energy project.     Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    Abandoned Mined Lands (AML) are lands that were mined prior to implementation of the federal Surface Mining Control and Reclamation Act (SMCRA) in 1977, but were inadequately reclaimed. Re-mining of AML is being conducted on a routine basis by coal-mining operations in eastern states such as Virginia. Re-mining is a potentially important means of reclaiming AML. However, under current policies, re-mining operations often fail to permit and reclaim priority 1, 2, and 3 AML, especially those areas which present the most severe environmental problems. This paper describes policy issues which affect the potential for AML reclamation by re-mining operations in mountainous mining areas, such as Virginia; efforts underway in Virginia which seek to resolve those issues; and progress achieved to date under that initiative.

    The Committee on Interior and Insular Affairs recommends passage of H.R.1531 as amended by the committee. The purpose of H.R.1531 is to facilitate the development of interstate coal slurry pipelines within the framework of state water law and interstate water allocations. The amendment establishes a procedure through which the Secretary of the Interior may grant the federal power of eminent domain to obtain rights-of-way over private lands to coal pipelines determined to be in the national interest. The Secretary may also grant certified pipelines rights-of-way over federal lands. The pipelines must first obtain any water use permits from the necessary states. The amendment also includes pipelines that would use another media in place of water, such as carbon dioxide. The major issues discussed in this report are certification, employment, state water rights, environment, eminent domain, access over Federal land, and antitrust review.

    The data transmission in coherent fiber-optical communication lines using solitons with a variable phase is studied. It is shown that nonlinear coherent structures (solitons) can be applied for effective signal transmission over a long distance using amplitude and optical-phase keying of information. The optimum ratio of the pulse width to the bit slot at which the spectral efficiency (transmitted bits per second and hertz) is maximal is determined. It is shown that soliton fiber-optical communication lines can ensure data transmission at a higher spectral efficiency as compared to traditional communication lines and at a high signal-to-noise ratio.

    Since the implementation of the federal Surface Mining Control and Reclamation Act of 1977 (SMCRA) in May of 1978, many opportunities have been lost for the reforestation of surface mines in the eastern United States. Research has shown that excessive compaction of spoil material in the backfilling and grading process is the biggest impediment to the establishment of productive forests as a post-mining land use (Ashby, 1998, Burger et al., 1994, Graves et al., 2000). Stability of mine sites was a prominent concern among regulators and mine operators in the years immediately following the implementation of SMCRA. These concerns resulted in the highly compacted, flatly graded, and consequently unproductive spoils of the early post-SMCRA era. However, there is nothing in the regulations that requires mine sites to be overly compacted as long as stability is achieved. It has been cultural barriers and not regulatory barriers that have contributed to the failure of reforestation efforts under the federal law over the past 27 years. Efforts to change the perception that the federal law and regulations impede effective reforestation techniques and interfere with bond release must be implemented. Demonstration of techniques that lead to the successful reforestation of surface mines is one such method that can be used to change perceptions and protect the forest ecosystems that were indigenous to these areas prior to mining. The University of Kentucky initiated a large-scale reforestation effort to address regulatory and cultural impediments to forest reclamation in 2003. During the three years of this project 383,000 trees were planted on over 556 acres in different physiographic areas of Kentucky (Table 1, Figure 1). Species used for the project were similar to those that existed on the sites before mining was initiated (Table 2). A monitoring program was undertaken to evaluate growth and survival of the planted species as a function of spoil characteristics and reclamation practice. In addition, experiments were integrated within the reforestation effort to address specific questions pertaining to sequestration of carbon (C) on these sites.

    This paper examines the factors that threaten the future of the Russian Federation (RF). The observations are based on a study that focused on eight republics: Mordova, Udmurtia, Tatarstan, Mari El, Bashkortostan, Kabardino-Balkaria, Buryatia, and Altay Republic. These republics were selected for their geographic and economic significance to the RF. Tatarstan, Bashkortostan, Udmurtia, and Mari El are located on important supply routes, such as the Volga River and the trans-Siberian railroad. Some of these republics are relatively wealthy, with natural resources such as oil (e.g., Tatarstan and Bashkortostan), and all eight republics play significant roles in the military-industrial complex. The importance of these republics to the RF contrasts to the relative insignificance of the independence-minded Northern Caucasus area. The author chose not to examine the Northern Caucasus region (except Kabardino-Balkaria) because these republics may have only a minor impact on the rest of the RF if they secede. Their impact would be minimized because they lie on the frontiers of the RF. Many Russians believe that {open_quotes}it might be best to let such a troublesome area secede.{close_quotes}

    Livestock grazing is the post-mining use for reclaimed land at Navajo Mine, a large surface coal mine on the Navajo Nation in northwest New Mexico. The Navajo Mine Grazing Management Program (GMP) uses holistic management on approximately 2,083 ha of reclaimed land to plan for final liability release and return of the land to the Navajo Nation, and to minimize the potential for post-release liability. The GMP began in 1991 to establish that livestock grazing on the reclaimed land is sustainable. Assuming that sustainability requires alternatives to conventional land management practices, the GMP created a Management Team consisting of company staff, local, Navajo Nation, and Federal government officials, and technical advisors. Community members contributed to the formation of a holistic goal for the GMP that articulates their values and their desire for sustainable grazing. Major decisions (e.g., artificial insemination, water supply, supplemental feed) are tested against the goal. Biological changes in the land and the grazing animals are monitored daily to provide early feedback to managers, and annually to document the results of grazing. To date, the land has shown resilience to grazing and the animals have generally prospered. Community participation in the GMP and public statements of support by local officials indicate that the GMP`s strategy is likely to succeed.

    Gathering and compiling information on the features and uses of the land within a proposed corridor provides the basis for selecting a route, obtaining easements, and designing and constructing a transmission line. Traditionally, gathering this information involved searches of existing maps and records to obtain the available information, which would then be supplemented with aerial photography to record current conditions. Ground surveys were performed to collect topographic data for design purposes. This information was manually transferred to drawings and other documents to show the terrain, environmentally sensitive areas, property ownership, and existing facilities. These drawing served as the base to which the transmission line right-of-way, structures, and other design information were added. As the design was completed, these drawings became the source of information for constructing the line and ultimately, the record of the facility. New technologies and the every growing need for instantly accessible information have resulted in changes in almost every step of gathering, storing and using information. Electronic data collection, global positioning systems (GPS), digitized terrain models, computerized design techniques, development of drawings using CAD, and graphical information systems (GIS) have individually resulted in significant advancements in this process. Combining these components into an integrated system, however, is truly revolutionizing transmission line engineering. This paper gives an overview of the survey and mapping information that is required for transmission line projects, review the traditional techniques that have been employed to obtain and utilize this information, and discuss the recent advances in the technology. Additionally, a system is presented that integrates the components in this process to achieve efficiency, minimize chances of errors, and provide improved access to project information.

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

A jolting table is used to compact this charge of liner material ln place, and after thls has been done, the preliminary form is removed and the flnal form or plug is lnserted without disturbing the partially completed lining. The remainder of the lining charge is then introduced and compacted by jolting, after which the form is removed.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

  2. Wind Development on Tribal Lands

    Background: The Rosebud Sioux Tribe (RST) is located in south central South Dakota near the Nebraska border. The nearest community of size is Valentine, Nebraska. The RST is a recipient of several Department of Energy grants, written by Distributed Generation Systems, Inc. (Disgen), for the purposes of assessing the feasibility of its wind resource and subsequently to fund the development of the project. Disgen, as the contracting entity to the RST for this project, has completed all the pre-construction activities, with the exception of the power purchase agreement and interconnection agreement, to commence financing and construction of the project. The focus of this financing is to maximize the economic benefits to the RST while achieving commercially reasonable rates of return and fees for the other parties involved. Each of the development activities required and its status is discussed below. Land Resource: The Owl Feather War Bonnet 30 MW Wind Project is located on RST Tribal Trust Land of approximately 680 acres adjacent to the community of St. Francis, South Dakota. The RST Tribal Council has voted on several occasions for the development of this land for wind energy purposes, as has the District of St. Francis. Actual footprint of wind farm will be approx. 50 acres. Wind Resource Assessment: The wind data has been collected from the site since May 1, 2001 and continues to be collected and analyzed. The latest projections indicate a net capacity factor of 42% at a hub height of 80 meters. The data has been collected utilizing an NRG 9300 Data logger System with instrumentation installed at 30, 40 and 65 meters on an existing KINI radio tower. The long-term annual average wind speed at 65-meters above ground level is 18.2 mph (8.1 mps) and 18.7 mph (8.4 mps) at 80-meters agl. The wind resource is excellent and supports project financing.

    Since 1939, U.S. utility companies have been required to obtain a Presidential Permit to construct electric transmission lines that cross a U.S. border and connect with a foreign utility. The purpose of this document is to provide Presidential Permit applicants with two types of guidance: (1) on the type of environmental and project descriptive information needed to assess the potential impacts of the proposed and alternative actions and (2) on compliance with applicable federal and state regulations. The main three chapters present information on the purpose and content of this document (Chapter 1); legislative, regulatory, and consultation requirements for transmission line interconnect projects (Chapter 2); and identification of basic transmission system design parameters and environmental data requirements for analysis of potential impacts of the proposed action (Chapter 3). BPA`s preferred alternative for non-Federal access is the Capacity Ownership alternative combined with the Increased Assured Delivery -- Access for Non-Scheduling Utilities alternative; the preferred alternative for BPA Intertie marketing is the Federal Marketing and Joint Ventures alternative. BPA considered these two areas previously in its Intertie Development and Use EIS of April 1988. The EIS resulted in BPA decisions to participate in the construction of the Third AC Intertie, to allow non-Federal access to BPA`s share of the Pacific Northwest-Pacific Southwest (PNW-PSW) Intertie (AC and DC lines) pursuant to a Long-Term Intertie Access Policy (LTIAP), and to pursue BPA`s export marketing alternative. The decision on allowing direct financial non-Federal participation in the Third AC line was deferred to a later, separate process, examined here. Also, BPA`s export marketing objectives must now be examined in view of changed operations of Columbia River hydro facilities for improved fish survival.

  7. Wireless Sensor Network for Electric Transmission Line Monitoring

    Generally, federal agencies tasked to oversee power grid reliability are dependent on data from grid infrastructure owners and operators in order to obtain a basic level of situational awareness. Since there are many owners and operators involved in the day-to-day functioning of the power grid, the task of accessing, aggregating and analyzing grid information from these sources is not a trivial one. Seemingly basic tasks such as synchronizing data timestamps between many different data providers and sources can be difficult as evidenced during the post-event analysis of the August 2003 blackout. In this project we investigate the efficacy and cost effectiveness of deploying a network of wireless power line monitoring devices as a method of independently monitoring key parts of the power grid as a complement to the data which is currently available to federal agencies from grid system operators. Such a network is modeled on proprietary power line monitoring technologies and networks invented, developed and deployed by Genscape, a Louisville, Kentucky based real-time energy information provider. Genscape measures transmission line power flow using measurements of electromagnetic fields under overhead high voltage transmission power lines in the United States and Europe. Opportunities for optimization of the commercial power line monitoring technology were investigated in this project to enable lower power consumption, lower cost and improvements to measurement methodologies. These optimizations were performed in order to better enable the use of wireless transmission line monitors in large network deployments (perhaps covering several thousand power lines) for federal situational awareness needs. Power consumption and cost reduction were addressed by developing a power line monitor using a low power, low cost wireless telemetry platform known as the ''Mote''. Motes were first developed as smart sensor nodes in wireless mesh networking applications. On such a platform, it has been demonstrated in this project that wireless monitoring units can effectively deliver real-time transmission line power flow information for less than $500 per monitor. The data delivered by such a monitor has during the course of the project been integrated with a national grid situational awareness visualization platform developed by Oak Ridge National Laboratory. Novel vibration energy scavenging methods based on piezoelectric cantilevers were also developed as a proposed method to power such monitors, with a goal of further cost reduction and large-scale deployment. Scavenging methods developed during the project resulted in 50% greater power output than conventional cantilever-based vibrational energy scavenging devices typically used to power smart sensor nodes. Lastly, enhanced and new methods for electromagnetic field sensing using multi-axis magnetometers and infrared reflectometry were investigated for potential monitoring applications in situations with a high density of power lines or high levels of background 60 Hz noise in order to isolate power lines of interest from other power lines in close proximity. The goal of this project was to investigate and demonstrate the feasibility of using small form factor, highly optimized, low cost, low power, non-contact, wireless electric transmission line monitors for delivery of real-time, independent power line monitoring for the US power grid. The project was divided into three main types of activity as follows; (1) Research into expanding the range of applications for non-contact power line monitoring to enable large scale low cost sensor network deployments (Tasks 1, 2); (2) Optimization of individual sensor hardware components to reduce size, cost and power consumption and testing in a pilot field study (Tasks 3,5); and (3) Demonstration of the feasibility of using the data from the network of power line monitors via a range of custom developed alerting and data visualization applications to deliver real-time information to federal agencies and others tasked with grid reliability (Tasks 6,8).
