    A phone survey of 22 state regulatory commissions, which represent 84% of the interstate gas market, presents a snapshot of the attitudes of key staff during the month of November 1985. The results are indicative rather than definitive, and represent attitudes of individuals rather than state policies. The responses reflect changes within the interstate gas pipeline industry, particularly in the area of expanded voluntary carriage activity. The survey found states willing to comply with new rulings of the Federal Energy Regulatory Commission to encourage this activity. Carriage programs within consuming states are common. The major remaining problem is to establish carriage rates for the local distribution companies. Despite an expected increase in intrastate carriage activity, the commission staffs expect interstate pipelines to retain the dominant role in supply planning. 2 figures, 5 tables.

    The active solar cooling and heating system at the National Agricultural Library was designed and constructed as part of the Solar in Federal Buildings Program (SFBP). This retrofitted system is one of eight of the systems in the SFBP selected for quality monitoring. The purpose of this monitoring effort is to document the performance of quality state-of-the-art solar systems in large Federal buildings. These systems are unique prototypes. Design errors and system faults discovered during the monitoring period could not always be corrected. Therefore, the aggregated, overall performance is often considerably below what might be expected had similar systems been constructed consecutively with each repetition incorporating corrections and improvements. The National Agricultural Library is part of the US Department of Agricultural Research Center located in Beltsville, Maryland. The solar system was designed to supply 5% of the annual heating and cooling load. There are 200 Sunmaster evacuated tube panels in the collector array with a gross area of 5314 square-foot. These panels are built with six-foot evacuated tubes, model TRS-81. A drainback configuration with a water heat transfer medium is used. The 5000 gallon storage tank has 3800 gallons in it when drained back and 2800 gallons during operation. Solar energy is provided to the heating load by two heat exchangers, the 120/sup 0/F secondary system and the 180/sup 0/F radiant system. Solar cooling is provided by an ARKLA 25-ton solar heated absorption chiller. The solar heating and cooling systems are controlled by a Honeywell Excel microprocessor system. Auxiliary heating is provided by three gas-fired boilers and auxiliary cooling is provided by two large centrifugal chillers. Highlights of the performance of the National Agricultural Library solar system during the monitoring period from August 1985 through October 1985 are presented in this report.

    The findings and conclusions of the analysis of the various issues involved in the federal preemption of state regulations for the DOE no standard rule on covered appliances are summarized. The covered products are: refrigerators, refrigerator-freezers, freezers, clothes dryers, kitchen ranges and ovens, water heaters (excluding heat pump water heaters), room air conditioners, central air conditioners (excluding heat pumps), and furnaces. A detailed discussion of the rationale for the positions of groups offering comment for the record is presneted. The pertinent categories of state and local regulations and programs are explained, then detailed analysis is conducted on the covered products and regulations. Issues relating to the timing of preemption of state regulations are discussed, as well as issues relating to burden of proof, contents of petitions for exemptions from preemption, criteria for evaluating petitions, and procedural and other issues. Hot springs and five strato volcanoes existing throughout the Cascade Range, limited hot spring activity on the Olympic Peninsula, and broad reaching, low temperature geothermal resources found in the Columbia Basin comprise the extent of Washington's known geothermal resources. Determination of resource ownership is the first step in proceeding with geothermal exploration and development activities.     In any restructuring, close attention should be paid to how transactions are characterized. The approach adopted in California tends to minimize jurisdictional complications and preserve state jurisdiction over local distribution, while a retail wheeling approach may raise preemption and Commerce Clause concerns. In the United States, the wholesale electricity market and the interstate transmission of electricity have been subject to exclusive federal jurisdiction, while the retail sale and local distribution of electricity have been subject to the jurisdiction of the separate states. Until recently, the jurisdictional dividing line has been relatively clear. Indeed, Congress intended to establish a {open_quotes}bright line{close_quotes} between state and federal jurisdiction. This bright line, however, is becoming blurred by proposals to allow retail customers direct access to competitive generation markets. Regulation of transactions relating to the transmission and sale of electricity at wholesale is within the exclusive jurisdiction of the federal government. Thus, historically, {open_quotes}transmission{close_quotes} has coincided precisely with wholesale transactions, while {open_quotes}local distribution{close_quotes} has coincided precisely with retail transactions. Since 1978, Congress and the Federal Energy Regulatory Commission (FERC) have promulgated statutes and regulations to enhance the competitiveness of the wholesale generation market. As a consequence, there are many more non-utility entities competing as sellers of wholesale electricity. Now the push is on at the state level to introduce retail competition in the generation supply side of the electricity market. Introduction of retail competition has the potential to upset, if not extinguish, the traditional bright line between federal and state jurisdiction.

    State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposed by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.

    Recent interest in combined heat and power (CHP) is providing momentum to efforts aimed at increasing the capacity of this highly-efficient technology. Factors driving this increase in interest include the need to increase the efficiency of the nation's electricity generation infrastructure, DOE Assistant Secretary Dan Reicher's challenge to double the capacity of CHP by 2010, the success of DOE's Advanced Turbine Systems Program in supporting ultra-efficient CHP technologies, and the necessity of finding cost-effective solutions to address climate change and air quality issues. The federal government is committed to increasing the penetration of CHP technologies in the US. The ultimate goal is to build a competitive market for CHP in which policies and regulations support the implementation of a full suite of technologies for multiple applications. Specific actions underway at the federal level include technology strategies to improve CHP data collection and assessment and work with industry to encourage the development of advanced CHP technologies. Policy strategies include changes to federal environmental permitting procedures including CHP-friendly strategies in federal restructuring legislation, supporting tax credits and changes to depreciation requirements as economic incentives to CHP, working with industry to leverage resources in the development of advanced CHP technologies, educating state officials about the things they can do to encourage CHP, and increasing awareness about the benefits of CHP and the barriers limiting its increased implementation.

    For over two years, The Keystone Center facilitated a dialogue on State and Federal Regulation of the Electricity Industry. The intent of this report is to assist policy-makers faced with decisions about changes to traditional utility regulation and planning and provide an overview of a diverse group`s deliberations on regulatory jurisdictional conflicts. This report is not a consensus document, rather it is a staff written summary of two years of discussion on the issues. The participants in the Keystone Dialogue believed that all affected interests could benefit from, if nothing else, a summary of their discussions of state/federal issues. The electric utility industry is one of the last remaining, heavily regulated industries in the United States. Rate and corporate regulation is split between state and federal governments and there is distinct regulatory authority at each level. For example, retail rate regulation occurs at the state level, the Federal Energy Regulatory Commission is responsible for wholesale rate regulation under the Federal Power Act, and the Securities and Exchange Commission oversees registered utility holding companies as defined under the Public Utility Holding Company Act of 1935. This jurisdictional split between state and federal regulation has evolved over many years through legislation and litigation on such matters. The creation of this allocation of regulatory responsibility was initiated in 1935 with the passage of the Public Utility Holding Company Act and the Federal Power Act when the economic and technological changes that are now occurring in the industry simply could not have been envisioned.

    Cost-share assistance programs have been an effective policy mechanism for increasing productivity on nonindustrial private forest (NIPF) lands. In light of reduced harvests from Federal lands, timber productivity on these lands has become increasingly important to ensure sufficient timber supplies in the future. Productivity of other forest resources has also been enhanced through these programs. Four Federal programs, the Forestry Incentives Program, the Agricultural Conservation Program, the Stewardship Incentives program, and the Conservation Reserve Program, provided cost-share assistance for tree planting on 467,000 acres in 1993. During the course of this study, the provisions of the individual State programs, funding levels, accomplishments, and outlook for continuation or expansion, were examined. Federal programs were reviewed as well, with respect to their interaction with State-level programs. The results of the study are presented in this paper.

    On October 9, 2008, federal, state and local policy makers, emergency managers, and medical and public health officials convened in Seattle, Washington, for a workshop on Addressing the Federal-State-Local Interface Issues During a Catastrophic Event Such as an Anthrax Attack. The day-long symposium was aimed at generating a dialogue about recovery and restoration through a discussion of the associated challenges that impact entire communities, including people, infrastructure, and critical systems. The Principal Federal Official (PFO) provided an overview of the role of the PFO in a catastrophic event. A high-level summary of an anthrax scenario was presented. The remainder of the day was focused on interactive discussions among federal, state and local emergency management experts in the areas of: • Decision-making, prioritization, and command and control • Public health/medical services • Community resiliency and continuity of government. Key topics and issues that resulted from discussions included: • Local representation in the Joint Field Office (JFO) • JFO transition to the Long-Term Recovery Office • Process for prioritization of needs • Process for regional coordination • Prioritization - process and federal/military intervention • Allocation of limited resources • Re-entry decision and consistency • Importance of maintaining a healthy hospital system • Need for a process to establish a consensus on when it is safe to re-enter. This needs to be across all jurisdictions including the military. • Insurance coverage for both private businesses and individuals • Interaction between the government and industry. The symposium was sponsored by the Interagency Biological Restoration Demonstration, a collaborative regional program jointly funded by the U.S. Department of Homeland Security and the U.S. Department of Defense. To aid the program’s efforts and inform the development of blueprint for recovery from a biological incident, this report presents the key issues identified at the symposium.

    This work is the first comprehensive analysis of the impact of federal court decisions on the United States Environmental Protection Agency (EPA) in all seven of its major statutory areas. The work found first, that judicial intervention into disputes concerning the EPA fall into five groups: (1) cases in which the mere filing of a lawsuit, without judicial action, has evoked a changed in the EPA; (2) cases in which courts have upheld the agency's position completely without yielding changes in the agency; (3) cases in which judges, who have been passive and unwilling to intervene in the affairs of the EPA have issued decisions that nonetheless have affected the agency's policies and administration; (4) cases in which judges have legitimately used their discretionary powers to affect agency actions; and (5) cases in which judges have gone beyond the normal limits of judicial activism to evoke change in the agency. Second, the dissertation analyzed the ten ways that the EPA has responded to federal court decisions. Third, the dissertation found that the major impact of federal court decisions on the EPA has been policy related. Compliance with court orders has become the agency's top priority. Finally, the dissertation found that federal court decisions have affected the administration of the EPA in five ways.

    DOE Partnerships with States, Tribes and Other Federal Programs Help Responders Prepare for Challenges Involving Transport of Radioactive Materials Implementing adequate institutional programs and validating preparedness for emergency response to radiological transportation incidents along or near U.S. Department of Energy (DOE) shipping corridors poses unique challenges to transportation operations management. Delayed or insufficient attention to State and Tribal preparedness needs may significantly impact the transportation operations schedule and budget. The DOE Transportation Emergency Preparedness Program (TEPP) has successfully used a cooperative planning process to develop strong partnerships with States, Tribes, Federal agencies and other national programs to support responder preparedness across the United States. DOE TEPP has found that building solid partnerships with key emergency response agencies ensures responders have access to the planning, training, technical expertise and assistance necessary to safely, efficiently and effectively respond to a radiological transportation accident. Through the efforts of TEPP over the past fifteen years, partnerships have resulted in States and Tribal Nations either using significant portions of the TEPP planning resources in their programs and/or adopting the Modular Emergency Response Radiological Transportation Training (MERRTT) program into their hazardous material training curriculums to prepare their fire departments, law enforcement, hazardous materials response teams, emergency management officials, public information officers and emergency medical technicians for responding to transportation incidents involving radioactive materials. In addition, through strong partnerships with Federal Agencies and other national programs TEPP provided technical expertise to support a variety of radiological response initiatives and assisted several programs with integration of the nationally recognized MERRTT program into other training venues, thus ensuring consistency of radiological response curriculums delivered to responders. This presentation will provide an overview of the steps to achieve coordination, to avoid redundancy, and to highlight several of the successful partnerships TEPP has formed with States, Tribes, Federal agencies and other national programs. Events, accident scenarios, and training where TEPP was proven to be integral in building the radiological response capabilities for first responders to actual radiological incidents are also highlighted. Participants will gain an appreciation for the collaborative efforts States and Tribes are engaging in with the DOE to ensure that responders all along the DOE transportation corridors are adequately prepared to respond to shipments of radioactive materials through their communities.

    Annual highway fuel taxes are collected by the Treasury Department and placed in the Highway Trust Fund (HTF). There is, however, no direct connection between the taxes collected by the Treasury Department and the gallons of on-highway fuel use, which can lead to a discrepancy between these totals. This study was conducted to determine how much of a discrepancy exists between the total fuel usages estimated based on highway revenue funds as reported by the Treasury Department and the total fuel usages used in the apportionment of the HTF to the States. The analysis was conducted using data from Highway Statistics Tables MF-27 and FE-9 for the years 1991-2001. It was found that the overall discrepancy is relatively small, mostly within 5% difference. The amount of the discrepancy varies from year to year and varies among the three fuel types (gasoline, gasohol, special fuels). Several potential explanations for these discrepancies were identified, including issues on data, tax measurement, gallon measurement, HTF receipts, and timing. Data anomalies caused by outside forces, such as deferment of tax payments from one fiscal year to the next, can skew fuel tax data. Fuel tax evasion can lead to differences between actual fuel use and fuel taxes collected. Furthermore, differences in data collection and reporting among States can impact fuel use data. Refunds, credits, and transfers from the HTF can impact the total fuel tax receipt data. Timing issues, such as calendar year vs. fiscal year, can also cause some discrepancy between the two data sources.

    On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues should receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The Agencies would consider each application by applying appropriate project-specific reviews under requirements of laws and related regulations, including, but not limited to, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, Section 7 of the Endangered Species Act (ESA), and Section 106 of the National Historic Preservation Act (NHPA). Under Section 368, Congress divided the United States into two groups of states: the 11 contiguous western states and the remaining states. Direction for energy transportation corridor analysis and selection in the 11 western states was addressed in Section 368(a) of EPAct, while direction for energy transportation corridor analysis and selection in all other states was addressed under Section 368(b) of EPAct. It was clearly the priority of Congress to conduct corridor location studies and designation first on federal lands in the western states. Under Section 368(a), the Agencies produced a programmatic environmental impact statement (EIS), Designation of Energy Corridors on Federal Land in the 11 Western States (DOE and DOI 2008), that was used in part as the basis for designating more than 6,000 mi (9,656 km) of energy transportation corridors on federal land in 11 western states. Under Section 368(a) of EPAct, Congress clearly stated the Agencies needed to (1) designate energy transportation corridors on federal land, (2) conduct the necessary environmental review of the designated corridors, and (3) incorporate the designated corridors into the appropriate land use plans. Congressional direction under Section 368(b) of EPAct differs from that provided under Section 368(a). Specifically, Section 368(b) requires the secretaries of the Agencies, in consultation with the Federal Energy Regulatory Commission (FERC), affected utility industries, and other interested persons, to jointly: (1) Identify corridors for oil, gas, and hydrogen pipelines and electricity transmission and distribution facilities on federal land in states other than the 11 western states identified under Section 368(a) of EPAct, and (2) Schedule prompt action to identify, designate, and incorporate the corridors into the applicable land use plans. While Section 368(a) clearly directs designation as a necessary first step for energy transportation corridors in the 11 western states, Section 368(b) directs the Agencies to first identify corridor

    As has been noted in many reports and publications, acquiring new or expanded rights-of-way for transmission is a challenging process, because numerous land use and land ownership constraints must be overcome to develop pathways suitable for energy transmission infrastructure. In the eastern U.S., more than twenty federally protected national trails (some of which are thousands of miles long, and cross many states) pose a potential obstacle to the development of new or expanded electricity transmission capacity. However, the scope of this potential problem is not well-documented, and there is no baseline information available that could allow all stakeholders to study routing scenarios that could mitigate impacts on national trails. This report, Electricity Transmission, Pipelines, and National Trails: An Analysis of Current and Potential Intersections on Federal Lands in the Eastern United States, was prepared by the Environmental Science Division of Argonne National Laboratory (Argonne). Argonne was tasked by DOE to analyze the “footprint” of the current network of National Historic and Scenic Trails and the electricity transmission system in the 37 eastern contiguous states, Alaska, and Hawaii; assess the extent to which national trails are affected by electrical transmission; and investigate the extent to which national trails and other sensitive land use types may be affected in the near future by planned transmission lines. Pipelines are secondary to transmission lines for analysis, but are also within the analysis scope in connection with the overall directives of Section 368 of the Energy Policy Act of 2005, and because of the potential for electrical transmission lines being collocated with pipelines. Based on Platts electrical transmission line data, a total of 101 existing intersections with national trails on federal land were found, and 20 proposed intersections. Transmission lines and pipelines are proposed in Alaska; however there are no locations that intersect national trails. Source data did not indicate any planned transmission lines or pipelines in Hawaii. A map atlas provides more detailed mapping of the topics investigated in this study, and the accompanying GIS database provides the baseline information for further investigating locations of interest. In many cases the locations of proposed transmission lines are not accurately mapped (or a specific route may not yet be determined), and accordingly the specific crossing locations are speculative. However since both national trails and electrical transmission lines are long linear systems, the characteristics of the crossings reported in this study are expected to be similar to both observed characteristics of the existing infrastructure provided in this report, and of the new infrastructure if these proposed projects are built. More focused study of these siting challenges is expected to mitigate some of potential impacts by choosing routes that minimize or eliminate them. The current study primarily addresses a set of screening-level characterizations that provide insights into how the National Trail System may influence the siting of energy transport facilities in the states identified under Section 368(b) of the Energy Policy Act of 2005. As such, it initializes gathering and beginning analysis of the primary environmental and energy data, and maps the contextual relationships between an important national environmental asset and how this asset intersects with energy planning activities. Thus the current study sets the stage for more in-depth analyses and data development activities that begin to solve key transmission siting constraints. Our recommendations for future work incorporate two major areas: (1) database development and analytics and (2) modeling and scenario analysis for energy planning. These recommendations provide a path forward to address key issues originally developed under the Energy Policy Act of 2005 that are now being carried forward under the President’s Climate Action Plan.

Numerous public meetings and workshops were held in two different states (covering a 200 mile radius) with stakeholder and SRS Citizens Advisory Board participation. These meetings were conducted over an eight month period as the end state decision making progressed. Information provided to the public evolved from workshop to workshop as data became available and public input from the public meetings were gathered.     This paper discusses command and control issues relating to the operation of Incident Command Posts (ICPs) and Emergency Operations Centers (EOCs) in the surrounding area jurisdictions following the detonation of an Improvised Nuclear Device (IND). Although many aspects of command and control will be similar to what is considered to be normal operations using the Incident Command System (ICS) and the National Incident Management System (NIMS), the IND response will require many new procedures and associations in order to design and implement a successful response. The scope of this white paper is to address the following questions: • Would the current command and control framework change in the face of an IND incident? • What would the management of operations look like as the event unfolded? • How do neighboring and/or affected jurisdictions coordinate with the state? • If the target area’s command and control infrastructure is destroyed or disabled, how could neighboring jurisdictions assist with command and control of the targeted jurisdiction? • How would public health and medical services fit into the command and control structure? • How can pre-planning and common policies improve coordination and response effectiveness? • Where can public health officials get federal guidance on radiation, contamination and other health and safety issues for IND response planning and operations?

    DOE facilities, if not already faced with the need, could be confronted with the necessity of or request to train civil authorities near DOE facilities. SARA Title 3 and the recent high visibility of DOE safety programs have prompted civil authorities to seek out specialized emergency response training for their community's first responders. In 1988, the states through which the DOE is scheduled to transport transuranic (TRU) waste for disposal at the Waste Isolation Pilot Plant expressed the concerns that their fire, medical, and law enforcement personnel were not prepared to handle an accident involving shipments of TRU waste. In response, the DOE authorized their contractor, Westinghouse Electric Corporation, to develop and deliver a training program to emergency responders along the transportation routes to mitigate this specific institutional concern. The lessons learned by DOE and Westinghouse in creating, coordinating, and delivering this program could be modified to apply to the concerns of governmental jurisdictions, including adjoining DOE facilities.

  4. Money crunch looms for Federal cleanup effort

    In an unprecedented acknowledgement that federal facility cleanup activities face a money crunch, a federal-state advisory panel is preparing a new strategy to avert enforcement showdowns when funding cuts prevent federal agencies from meeting legally required cleanup schedules set by states. In a draft report the panel said states must recognize that some cleanup [open quotes]milestones[close quotes] will have to be delayed due to budget pressures - a concession that will be politically difficult in some states. At the same time, the panel said federal agencies must be more forthcoming in working with states and local groups to determine how increasingly scarce resources will be distributed. As a general rule, the report recommended that federal agencies and state environmental officials agree on a [open quotes]fair share[close quotes] allocation method under which the pain of a budget cutback would be spread equally among all cleanup sites within an affected federal agency. That fair share approach would be altered only if the federal agency reached agreement with states that a funding cutback could be absorbed at selected sites without affecting any cleanup milestone.

    The Generic Protocol is a supplement to earlier efforts by EPA to provide technical assistance to Federal agencies on environmental auditing. EPA`s Office of Federal Activities (OFA) issued the Federal Facility Compliance Strategy (referred to as the `Yellow Book`), prepared in 1984 and revised in 1988, as a framework for EPA`s media programs to follow to ensure that Federal facilities are fully integrated into Federal and State compliance monitoring and enforcement activities. The policy encourages Federal agencies to voluntarily develop comprehensive auditing programs to ensure environmental compliance.

    The Federal government is the largest user of energy in the United States today. The Department of Defense (DOD) uses more than 80{percent} of that energy; the Department of Energy is the second largest user. In the 15 years from 1975 to 1989, {dollar_sign}128 billion was spent for Federal energy activities. In 1989 alone, the Federal government spent a total of {dollar_sign}8.7 billion on energy, of which {dollar_sign}3.5 billion was for buildings and {dollar_sign}2.4 billion was for electricity. The Federal government, which owns or leases 500,000 buildings, provided an additional {dollar_sign}3.9 billion on energy assistance for low-income housing in 1989 (1). Executive Order 12902 (Energy Efficiency and Water Conservation at Federal Facilities) of March 8, 1994 implements and expands the Federal energy management provisions stated in the Energy Policy Act (EPAct) of 1992. The goal is to reduce energy use in Federal buildings to 30{percent} of the 1985 levels by the year 2005. The Federal Energy Management Program (FEMP) has been assigned the responsibility of implementing Executive Order 12902. Subsequently, DOE, FEMP, other Federal agencies and private industry have formed a unique partnership to develop a process and set of actions that will stimulate new opportunities for renewable energy technologies. If these Federal initiatives are successful, substantial investment in renewable and energy efficiency technologies will be stimulated, an important portion of the nation{close_quote}s energy needs will be supplied, and a significant reduction in greenhouse gas emissions will be achieved. {copyright} {ital 1996 American Institute of Physics.}

Battelle Energy Alliance, LLC contracted with Intertek Testing Services, North America (ITSNA) to collect and evaluate data on federal fleet operations as part of the Advanced Vehicle Testing Activity’s Federal Fleet Vehicle Data Logging and Characterization study. The Advanced Vehicle Testing Activity study seeks to collect and evaluate data to validate the utilization of advanced electric drive vehicle transportation. This report focuses on the Caribou-Targhee National Forest (CTNF) fleet to identify daily operational characteristics of select vehicles and report findings on vehicle and mission characterizations to support the successful introduction of plug-in electric vehicles (PEVs) into the agencies’ fleets. Individual observations of these selected vehicles provide the basis for recommendations related to electric vehicle adoption and whether a battery electric vehicle (BEV) or plug-in hybrid electric vehicle (PHEV) (collectively plug-in electric vehicles, or PEVs) can fulfill the mission requirements. ITSNA acknowledges the support of Idaho National Laboratory and CTNF for participation in the study. ITSNA is pleased to provide this report and is encouraged by enthusiasm and support from the Forest Service and CTNF personnel.

    The Federal Demonstration Project is a cooperative effort between a number of universities, a private research institute, and several federal agencies to increase research productivity by eliminating unnecessary administrative procedures and by streamlining and standardizing needed controls. The Project aims to locate responsibility for decision-making as close as possible to principal investigators while maintaining necessary institutional and agency oversight to ensure accountability. By freeing researchers from some of their paperwork burden, more efficient research administration systems will enable investigators to spend more of their time doing science and engineering. The Federal Demonstration Project is an outgrowth of an earlier activity sponsored by five major federal R D agencies at the Florida State University System and the University of Miami. In Florida, the focus was on standardizing and streamlining procedures for administering research grants after the grants had been awarded to the universities. (See Attachment 1 for descriptions of the demonstrations carried out under the Florida Demonstration Project). In May 1988, the most successful of the demonstrated procedures were approved by the US Office of Management and Budget for use in grants awarded by any federal agency to any research organization. The new procedures give agencies authority to waive requirements that grantees obtain federal approval prior to taking a number of administrative actions with respect to grant management. The FDP institutions together with the participating federal agencies are designing and demonstrating innovative research administration procedures and are assessing the impact of those new procedures.

    Hyperspectral imaging produces a spectrum or vector at each image pixel. These spectra can be used to identify materials present in the image. In some cases, spectral libraries representing atmospheric chemicals or ground materials are available. The challenge is to determine if any of the library chemicals or materials exist in the hyperspectral image. The number of spectra in these libraries can be very large, far exceeding the number of spectral channels collected in the ¯eld. Suppose an image pixel contains a mixture of p spectra from the library. Is it possible to uniquely identify these p spectra? We address this question in this paper and refer to it as the Large Spectral Library (LSL) problem. We show how to determine if unique identi¯cation is possible for any given library. We also show that if p is small compared to the number of spectral channels, it is very likely that unique identi¯cation is possible. We show that unique identi¯cation becomes less likely as p increases.

    Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

    The XAFS Model Compound Library contains XAFS data on model compounds. The term "model" compounds refers to compounds of homogeneous and well-known crystallographic or molecular structure. Each data file in this library has an associated atoms.inp file that can be converted to a feff.inp file using the program ATOMS. (See the related Searchable Atoms.inp Archive at http://cars9.uchicago.edu/~newville/adb/) This Library exists because XAFS data on model compounds is useful for several reasons, including comparing to unknown data for "fingerprinting" and testing calculations and analysis methods.     The Evaluated Teletherapy Source Library (ETSL) is a system of hardware and software that provides for maintenance of a library of useful phase space descriptions (PSDs) of teletherapy sources used in radiation therapy for cancer treatment. The PSDs are designed to be used by PEREGRINE, the all-particle Monte Carlo dose calculation system. ETSL also stores other relevant information such as monitor unit factors (MUFs) for use with the PSDs, results of PEREGRINE calculations using the PSDs, clinical calibration measurements, and geometry descriptions sufficient for calculational purposes. Not all of this information is directly needed by PEREGRINE. It also is capable of acting as a repository for the Monte Carlo simulation history files from which the generic PSDs are derived.

    The second full-scale field exercise of the Federal Radiological Emergency Response Plan (FRERP) was held at the Zion Nuclear Power Station, Zion, Illinois, in June 1987. The exercise incorporated the annual compliance exercise for the Zion plant and involved the operating utility, Commonwealth Edison Company, the states of Illinois and Wisconsin, local governments, volunteer groups, and representatives from 12 federal agencies. The 3-day exercise was played from many locations in the Zion area; Springfield, Illinois; Madison, Wisconsin; and Washington, DC. Approximately 1000 people participated in the exercise, which used a scenario in which an accident at the plant resulted in the release of radioactive material outside the plant boundary. The US Department of Energy (DOE) had major responsibilities during the planning, playing, and critiquing of the exercise; these functions are outlined in the report. This document describes the DOE participation in the planning and response during the exercise. During a radiological emergency, the FRERP gives DOE the responsibility for coordinating the federal radiological monitoring and assessment activities in support of the states and the cognizant federal agency. At Zion, a self-sufficient Federal Radiological Monitoring and Assessment Center was established by DOE at a nearby fairground in which over 200 people from DOE, the two states, and other federal agencies participated. Before the field exercise, a tabletop exercise and a dry run were held for training purposes. 5 refs., 6 figs.

    The Energy Information Administration (EIA) of the US Department of Energy (DOE) is mandated by Congress to be the agency that collects, analyzes, and disseminates impartial, comprehensive data about energy including the volume consumed, its customers, and the purposes for which it is used. The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country. The purpose of the FBSS was threefold: (1) to understand the characteristics of Federal buildings and their energy use; (2) to provide a baseline in these three Federal regions to measure future energy use in Federal buildings as required in EPACT; and (3) to compare building characteristics and energy use with the data collected in the CBECS.

    Researchers at Pacific Northwest National Laboratory (PNNL) have constructed a nonimmune library consisting of 109 human antibody scFv fragments, which have been cloned and expressed on the surface of yeast. Nanomolar-affinity scFvs are routinely obtained by magnetic bead screening and flow cytometric sorting. The yeast library can be amplified 1010 fold without measurable loss of clonal diversity. This allows for indefinite expansion of the library. All scFv clones can be assessed directly on the yeast cell surface by immunofluorescent labeling and flow cytometry, obviating separate subcloning, expression, and purification steps. The ability to use multiplex library screening demonstrates the utility of this approach for high-throughput antibody isolation for proteomic applications. The yeast library may be used for research projects or teaching performed for U.S. Government purposes only.     The US government has an enormous cost-saving opportunity as the largest energy user in the world. In 1994, the government spent $8 billion for its 500,000 buildings, it vehicles, and process energy. The US Department of Energy (DOE), Federal Energy Management Program (FEMP) reduces the cost of government and makes it work better through energy efficiency, use of renewable energy, and water conservation. FEMP leads Federal energy efficiency efforts and helps Federal energy managers identify and procure the best, most cost-effective energy-saving projects. It does this through proactive problem solving; an aggressive emphasis on increasing the number and quality of projects; and effective partnerships among agencies, utilities, the private sector, and states. Partnerships lead to increased motivation and education and reduced barriers to successful procurement. As the lead organization implementing legislation and Presidential direction for Federal energy efficiency, FEMP administers an interagency energy committee and task force and collaborates with the DOE national energy laboratories. FEMP works with energy service companies, energy savings product manufacturers, and utilities. This partnership will lead to a $1 billion investment by companies willing to invest in return for a share of the energy cost savings. With FEMP project financing, audits, training and technical assistance, and new technology demonstrations, agencies overcome obstacles to achieving widespread energy efficiency.

    This report is organized in a fashion that is intended to explain the legal duties imposed on officials responsible for hazardous waste at each stage of its existence. Section 2 describes federal hazardous waste laws, explaining the legal meaning of hazardous waste and the protective measures that are required to be taken by its generators, transporters, and storers. In addition, penalties for violation of the standards are summarized, and a special discussion is presented of so-called imminent hazard provisions for handling hazardous waste that immediately threatens public health and safety. Although the focus of Sec. 2 is on RCRA, which is the principal federal law regulating hazardous waste, other federal statutes are discussed as appropriate. Section 3 covers state regulation of hazardous waste. First, Sec. 3 explains the system of state enforcement of the federal RCRA requirements on hazardous waste within their borders. Second, Sec. 3 discusses two peculiar provisions of RCRA that appear to permit states to regulate federal facilities more strictly than RCRA otherwise would require.

    The Federal Radiological Monitoring and Assessment Center (FRMAC) is a federal emergency response asset whose assistance may be requested by the Department of Homeland Security (DHS), the Department of Defense (DoD), the Environmental Protection Agency (EPA), the Nuclear Regulatory Commission (NRC), and state and local agencies to respond to a nuclear or radiological incident. It is an interagency organization with representation from the Department of Energy’s National Nuclear Security Administration (DOE/NNSA), the Department of Defense (DoD), the Environmental Protection Agency (EPA), the Department of Health and Human Services (HHS), the Federal Bureau of Investigation (FBI), and other federal agencies. FRMAC, in its present form, was created in 1987 when the radiological support mission was assigned to the DOE’s Nevada Operations Office by DOE Headquarters. The FRMAC asset, including its predecessor entities, was created, grew, and evolved to function as a response to radiological incidents. Radiological emergency response exercises showed the need for a coordinated approach to managing federal emergency monitoring and assessment activities. The mission of FRMAC is to coordinate and manage all federal radiological environmental monitoring and assessment activities during a nuclear or radiological incident within the United States in support of state,local, tribal governments, DHS, and the federal coordinating agency. Radiological emergency response professionals with the DOE’s national laboratories support the Radiological Assistance Program (RAP), National Atmospheric Release Advisory Center (NARAC), the Aerial MeasuringSystem (AMS), and the Radiation Emergency Assistance Center/Training Site (REAC/TS). These teams support the FRMAC to provide: ? Atmospheric transport modeling ? Radiation monitoring ? Radiological analysis and data assessments ? Medical advice for radiation injuries In support of field operations, the FRMAC provides geographic information systems, communications, mechanical, electrical, logistics, and administrative support. The size of the FRMAC is tailored to the incident and is comprised of emergency response professionals drawn from across the federal government. State and local emergency response teams may also integrate their operations with FRMAC, but are not required to.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.
