    This report describes legal, regulatory, and institutional considerations likely to shape the development and deployment of distributed resources. It is based on research co-sponsored by the National Renewable Energy Laboratory (NREL) and four investor-owned utilities (Central & South West Services, Cinergy Corp., Florida Power Corporation, and San Diego Gas & Electric Company). The research was performed between August 1995 and March 1996 by a team of four consulting firms experienced in energy and utility law, regulation, and economics. It is the survey phase of a project known as the Distributed Resources Institutional Analysis Project.

    The current emphasis on enforcement to achieve compliance with environmental regulations places increased demands on environmental professionals to generate legally defensible data. Since any environmental data may potentially be used in civil or criminal litigation, it must be suitable for use as admissible evidence. Although data cannot be guaranteed to be legally defensible because the proof of defensibility can only be determined in actual legal proceedings, there are steps that can be taken to enhance or increase the chances of admissibility. In order for data to be defensible and of known and documented quality, all sampling and analysis activities must meet applicable technical standards and be fully documented. Record keeping must be stressed throughout all sampling and analysis activities; failure to keep proper records is a common allegation in enforcement actions and a cause for lack of data defensibility. Though there is extensive reference documentation on the requirements for technical data quality, there is limited guidance available on data defensibility procedures. This paper provides guidance to assist field samplers, laboratory personnel, and project managers in planning for and generating legally defensible data. A example checklist that can be used in the planning and verification stages of the data generation process is provided.

    Business is booming for environmental professionals. Increasingly, environmental consultants and engineers are called upon by property owners and government agencies to clean up contaminated sites, assess environmental risk for potential purchasers and lenders, and investigate the extent of contamination prior to a real estate purchase. But these activities are not risk-free for the environmental professional. To the contrary, there are many ways for a remediation or site assessment to go awry. Risks that the remediation contractor face include the possibility that activities on the site may actually cause or contribute to further releases of the hazardous substances sought to be remediated. Because environmental professionals many times face substantial risk in performing their jobs, it is necessary that they understand and appreciate the potential liabilities when something does go wrong, and how to best protect themselves. This article describes the types of legal theories that could be brought against environmental professionals and how to best protect yourself from such liability.

    Molecular motors transport various cargos along cytoskeletal filaments, analogous to trucks on roads. In contrast to vehicles, however, molecular motors do not work alone but in small teams. We describe a simple model for the transport of a cargo by one team of motors and by two teams of motors, which walk into opposite directions. The cooperation of one team of motors generates long-range transport, which we observed experimentally in vitro. Transport by two teams of motors leads to a variety of bidirectional motility behaviour and to dynamic instabilities reminiscent of spontaneous symmetry breaking. We also discuss how cargo transport by teams of motors allows the cell to generate robust long-range bidirectional transport.

    Managing complex projects requires a capable, effective project manager to be in place, who is assisted by a team of competent assistants in various relevant disciplines. This team of assistants is known as the Integrated Project Team (IPT). he IPT is composed of a multidisciplinary group of people who are collectively responsible for delivering a defined project outcome and who plan, execute, and implement over the entire life-cycle of a project, which can be a facility being constructed or a system being acquired. An ideal IPT includes empowered representatives from all functional areas involved with a project-such as engineering design, technology, manufacturing, test and evaluation, contracts, legal, logistics, and especially, the customer. Effective IPTs are an essential element of scope, cost, and schedule control for any complex, large construction project, whether funded by DOE or another organization. By recently assessing a number of major, on-going DOE waste management projects, the characteristics of high performing IPTs have been defined as well as the reasons for potential IPT failure. Project managers should use IPTs to plan and execute projects, but the IPTs must be properly constituted and the members capable and empowered. For them to be effective, the project manager must select the right team, and provide them with the training and guidance for them to be effective. IPT members must treat their IPT assignment as a primary duty, not some ancillary function. All team members must have an understanding of the factors associated with successful IPTs, and the reasons that some IPTs fail. Integrated Project Teams should be used by both government and industry. (authors)

    The Chemical Weapons Convention (CWC) offers a unique challenge to the US system of constitutional law. Its promise of eliminating what is the most purely genocidal type of weapon from the world`s arsenals as well as of destroying the facilities for producing these weapons, brings with it a set of novel legal issues. The reservations about the CWC expressed by US business people are rooted in concern about safeguarding confidential business information and protecting the constitutional right to privacy. The chief worry is that international verification inspectors will misuse their power to enter commercial property and that trade secrets or other private information will be compromised as a result. It has been charged that the Convention is probably unconstitutional. The author categorically disagrees with that view and is aware of no scholarly writing that supports it. The purpose of this presentation is to show that CWC verification activities can be implemented in the US consistently with the traditional constitutional regard for commercial and individual privacy. First, he very briefly reviews the types of verification inspections that the CWC permits, as well as some of its specific privacy protections. Second, he explains how the Fourth Amendment right to privacy works in the context of CWC verification inspections. Finally, he reviews how verification inspections can be integrated into these constitutional requirements in the SU through a federal implementing statute.

    Worker Safety and Security Teams (WSSTs) are an effective way to promote safe workplaces. While WSSTs have a variety of structures and roles, they have one thing in common - employees and management collaborate to find ways to prevent accidents, injuries, and illnesses on the job. The benefits for all concerned are obvious in that employees have a safe place to work, employers save money on lost work time and workers compensation costs, and everyone returns home safe and healthy each day. A successful WSST will have the support and wholehearted participation of management and employees. LANL has a WSST at the institutional level (IWSST) and at all directorates and many divisions. The WSSTs are part of LANL's Voluntary Protection Program (VPP). The WSSTs meet at least monthly and follow an agenda covering topics such as safety shares, behavior based safety (BBS) observations, upcoming events or activities, issues, etc. A WSST can effectively influence safety programs and provide recommendations to managers, who have the resources and authority to implement changes in the workplace. WSSTs are effective because they combine the knowledge, expertise, perspective, enthusiasm, and effort of a variety of employees with diverse backgrounds. Those with experience in a specific job or work area know what the hazards or potential hazards are, and generally have ideas how to go about controlling them. Those who are less familiar with a job or area play a vital role too, by seeing what others may have overlooked or taken for granted. This booklet will cover the structure and operations of WSSTs, what needs to be done in order to be effective and successful, and how you can help, whether you're a WSST member or not.

    Final Report for the NA22 Simulations, Algorithm and Modeling (SAM) Ontology Assessment Team's efforts from FY09-FY11. The Ontology Assessment Team began in May 2009 and concluded in September 2011. During this two-year time frame, the Ontology Assessment team had two objectives: (1) Assessing the utility of knowledge representation and semantic technologies for addressing nuclear nonproliferation challenges; and (2) Developing ontological support tools that would provide a framework for integrating across the Simulation, Algorithm and Modeling (SAM) program. The SAM Program was going through a large assessment and strategic planning effort during this time and as a result, the relative importance of these two objectives changed, altering the focus of the Ontology Assessment Team. In the end, the team conducted an assessment of the state of art, created an annotated bibliography, and developed a series of ontological support tools, demonstrations and presentations. A total of more than 35 individuals from 12 different research institutions participated in the Ontology Assessment Team. These included subject matter experts in several nuclear nonproliferation-related domains as well as experts in semantic technologies. Despite the diverse backgrounds and perspectives, the Ontology Assessment team functioned very well together and aspects could serve as a model for future inter-laboratory collaborations and working groups. While the team encountered several challenges and learned many lessons along the way, the Ontology Assessment effort was ultimately a success that led to several multi-lab research projects and opened up a new area of scientific exploration within the Office of Nuclear Nonproliferation and Verification.

    Large government organizations such as the Department of Energy (DOE) are challenged with identifying and implementing best geospatial information management practices to ensure that operational needs are met and government objectives are achieved. Geographic Information System (GIS) professionals, complex wide within the Department, conduct spatial information management practices on a daily basis to complete a wide variety of science and engineering tasks. The DOE Office of the CIO recognized the wealth of geospatial information management knowledge within the DOE complex and formed the DOE GIS Core Team in 2001 as a result. The team is comprised of GIS experts-representing all major DOE labs, site facilities, and programs-who volunteer their time to address issues impacting the entire complex. These include the President's management agenda (with emphasis on the Geospatial One-Stop), homeland security, emergency response, site management, software and geospatial data licensing, and federal, national, and international standards governing the creation and dissemination of geospatial data. The strength of the DOE GIS Core Team is the wide diversity of GIS and scientific expertise represented on the team, which allows it to provide the DOE CIO's office with sound guidance on complex wide issues from a GIS practitioner's perspective. The Core Team's mission is 'to foster technical excellence and communication, to identify and advocate best business practices, and to provide sound recommendations on policy and standards.' As a first step toward identifying best practices the feam conducted a survey of all known GIS assets across the DOE complex. The survey identified each site's GIS expertise, operating systems architecture and software applications, major project areas supported, and a number of other metrics important to the operation of a GIS organization. Results of the survey will be discussed, along with the mission of the Core Team. A broad overview of best practices utilized by many of the leading GIS organizations across the complex will also be provided.

    The commercial exploitation of Liquefied Petroleum Gas (LPG) in New Zealand has occurred without a particular and comprehensive concern for any legal implications. The paper in Part I examines definitional questions, assesses in Part II the ability of courts and quasi-courts to evaluate risks associated with the product, examines in Part III the utility of common law remedies for injuries or associated with or arising from LPG, analyzes in Part IV the statutory regulation of LPG, concentrating particularly on the Dangerous Goods (Class 2 - Gases) Regulations 1980, discusses in Part V recent planning case-law concerning LPG development, and concludes that some reform is necessary to produce a more-coherent and precise regulatory regime that takes into account both the needs of developers and those affected by the development of LPG.

    The Office Special Projects within the Office of Environment, Safety, and Health (EH) has the responsibility to conduct Tiger Team Assessments for the Secretary of Energy. This report presents the assessment of the buildings, facilities, and activities under the DOE/Rockwell Contract No. DE-AM03-76SF00700 for the Energy Technology Engineering Center (ETEC) and of other DOE-owned buildings and facilities at the Santa Susana Field Laboratory (SSFL) site in southeastern Ventura County, California, not covered under Contract No. DE-AM03-76SF00700, but constructed over the years under various other contracts between DOE and Rockwell International. ETEC is an engineering development complex operated for DOE by the Rocketdyne Division of Rockwell International Corporation. ETEC is located within SSFL on land owned by Rockwell. The balance of the SSFL complex is owned and operated by Rocketdyne, with the exception of a 42-acre parcel owned by the National Aeronautics and Space Administration (NASA). The primary mission of ETEC is to provide engineering, testing, and development of components related to liquid metals technology and to conduct applied engineering development of emerging energy technologies.

    Physicists use self-written software as a tool to fulfill their tasks and often the developed software is used for several years or even decades. If a software product lives for a long time, it has to be changed and adapted to external influences. This implies that the source code has to be read, understood and modified. The same applies to the software of the Optics Measurements and Corrections (OMC) team at CERN. Their task is to track, analyze and correct the beams in the LHC and other accelerators. To solve this task, they revert to a self-written software base with more than 150,000 physical lines of code. The base is subject to continuous changes as well. Their software does its job and is effective, but runs regrettably not efficient because some parts of the source code are in a bad shape and has a low quality.     The objective of the present study is to present a computational model of the motion of a single athlete in a team and to compare the resulting trajectory with experimental data obtained in the field during competitions by match analysis software. To this purpose, some results related to a paths ensemble of a single player are discussed. Between each interaction it is assumed that he follows a straight line and his motion is characterized by viscous, pushing and pedestrian like force. A random force is supposed to influence only the trajectory direction after each interaction. Furthermore it is assumed that the time step between each interaction is a random variable belonging to a Gaussian distribution. The main criteria is a selection of a function correlated to the strategy of the player, around which, in a necessarily randomly way, a tactic function should be added.     The issue of possibly unrecoverable cost incurred by a utility, or `stranded costs,` has emerged as a major obstacle to developing a competitive generation market. Stranded or transition costs are defined as costs incurred by a utility to serve its customers that were being recovered in rates but are no longer due to availability of lower-priced alternative suppliers. The idea of `stranded cost,` and more importantly arguments for its recovery, is a concept with little basis in economic theory, legal precedence, or precedence in other deregulated industries. The main argument recovery is that the ``regulatory compact`` requires it. This is based on the misconception that the regulator compact is simply: the utility incurs costs on behalf of its customers because of the ``obligation to serve`` so, therefore, customers are obligated to pay. This is a mischaracterization of what the compact was and how it developed. Another argument is that recovery is required for economic efficiency. This presumes, however, a very narrow definition of efficiency based on preventing ``uneconomic`` bypass of the utility and that utilities minimize costs. A broader definition of efficiency and the likelihood of cost inefficiencies in the industry suggest that the cost imposed on customers from inhibiting competition could exceed the gains from preventing uneconomic bypass. Both these issues are examined in this paper.

    The study describes the results of a survey of 547 local water supply systems serving some 31 million residents of urban areas in the states of Alabama, California, Florida, Oklahoma, Tennessee and Wyoming. While examining the legal and administrative aspects of drought management, the survey also included the assessment of the current status of drought preparedness and long-term drought protection among the responding water supply systems. The rate of legal or administrative problems encountered during drought response was surprisingly low, affecting only twenty percent of all implementing systems. The low incidence of difficulties counters a widespread assumption that the legal environment frequently restrains or constricts drought response efforts.

    The purpose of the Safety and Health (S H) Subteam assessment was to determine the effectiveness of representative safety and health programs at the Idaho National Engineering Laboratory (INEL) site. Four Technical Safety Appraisal (TSA) Teams were assembled for this purpose by the US Department of Energy (DOE), Deputy Assistant Secretary for Safety and Quality Assurance, Office of Safety Appraisals (OSA). Team No. 1 reviewed EG G Idaho, Inc. (EG G Idaho) and the Department of Energy Field Office, Idaho (ID) Fire Department. Team No. 2 reviewed Argonne National Laboratory-West (ANL-W). Team No. 3 reviewed selected contractors at the INEL; specifically, Morrison Knudsen-Ferguson of Idaho Company (MK-FIC), Protection Technology of Idaho, Inc. (PTI), Radiological and Environmental Sciences Laboratory (RESL), and Rockwell-INEL. Team No. 4 provided an Occupational Safety and Health Act (OSHA)-type compliance sitewide assessment of INEL. The S H Subteam assessment was performed concurrently with assessments conducted by Environmental and Management Subteams. The assessment was directed by the Department's Office of Environment, Safety and Health (ES H) and was conducted from June 18 to July 20, 1990. The PGDP Tiger Team Assessment is comprehensive in scope.     This report documents the results of the Department of Energy's (DOE) Tiger Team Assessment of the Argonne Illinois Site (AIS) (including the DOE Chicago Operations Office, DOE Argonne Area Office, Argonne National Laboratory-East, and New Brunswick Laboratory) and Site A and Plot M, Argonne, Illinois, conducted from September 17 through October 19, 1990. The Tiger Team Assessment was conducted by a team comprised of professionals from DOE, contractors, consultants. The purpose of the assessment was to provide the Secretary of Energy with the status of Environment, Safety, and Health (ES H) Programs at AIS. Argonne National Laboratory-East (ANL-E) is the principal tenant at AIS. ANL-E is a multiprogram laboratory operated by the University of Chicago for DOE. The mission of ANL-E is to perform basic and applied research that supports the development of energy-related technologies. There are a significant number of ES H findings and concerns identified in the report that require prompt management attention. A significant change in culture is required before ANL-E can attain consistent and verifiable compliance with statutes, regulations and DOE Orders. ES H activities are informal, fragmented, and inconsistently implemented. Communication is seriously lacking, both vertically and horizontally. Management expectations are not known or commondated adequately, support is not consistent, and oversight is not effective.

    This report documents the results of the Department of Energy's (DOE's) Tiger Team Assessment of the Lawrence Berkeley Laboratory (LBL) conducted from January 14 through February 15, 1991. The purpose of the assessment was to provide the Secretary of Energy with the status of environment, safety, and health (ES H) programs at LBL. The Tiger Team concluded that curtailment of cessation of any operations at LBL is not warranted. However, the number and breadth of findings and concerns from this assessment reflect a serious condition at this site. In spite of its late start, LBL has recently made progress in increasing ES H awareness at all staff levels and in identifying ES H deficiencies. Corrective action plans are inadequate, however, many compensatory actions are underway. Also, LBL does not have the technical expertise or training programs nor the tracking and followup to effectively direct and control sitewide guidance and oversight by DOE of ES H activities at LBL. As a result of these deficiencies, the Tiger Team has reservations about LBL's ability to implement effective actions in a timely manner and, thereby, achieve excellence in their ES H program. 4 figs., 24 tabs.

    This thesis is the culminating project for my participation in the OECD NEA International School of Nuclear Law. This paper will begin by providing a historical background to current disarmament and denuclearization treaties. This paper will discuss the current legal framework based on current and historical activities related to denuclearization and nuclear disarmament. Then, it will propose paths forward for the future efforts, and describe the necessary legal considerations. Each treaty or agreement will be examined in respect to its requirements for: 1) limitations and implementation; 2) and verification and monitoring. Then, lessons learned in each of the two areas (limitations and verification) will be used to construct a proposed path forward at the end of this paper.

  13. Disposal of oil field wastes into salt caverns: Feasibility, legality, risk, and costs

    Salt caverns can be formed through solution mining in the bedded or domal salt formations that are found in many states. Salt caverns have traditionally been used for hydrocarbon storage, but caverns have also been used to dispose of some types of wastes. This paper provides an overview of several years of research by Argonne National Laboratory on the feasibility and legality of using salt caverns for disposing of oil field wastes, the risks to human populations from this disposal method, and the cost of cavern disposal. Costs are compared between the four operating US disposal caverns and other commercial disposal options located in the same geographic area as the caverns. Argonne`s research indicates that disposal of oil field wastes into salt caverns is feasible and legal. The risk from cavern disposal of oil field wastes appears to be below accepted safe risk thresholds. Disposal caverns are economically competitive with other disposal options.

    The legal and institutional obstacles to the development of small-scale hydroelectric energy at the state level are discussed. The Federal government also exercises extensive regulatory in the area, and the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and an inquiry into the practical use of the doctrine by the FERC is examined. The initial obstacle that all developers confront in Wisconsin is obtaining the authority to utilize the bed, banks, and flowing water at a proposed dam site. This involves a determination of ownership of the stream banks and bed and the manner of obtaining either their title or use; and existing constraints with regard to the use of the water. Wisconsin follows the riparian theory of water law.

    This paper examines the legal issues involved with employer monitoring of employee e-mail. In addition to identifying pertinent legal issues, the paper provides guidelines that will help the Pacific Northwest National Laboratory (PNNL) establish a program for monitoring outgoing e-mail to insure compliance with company policies, particularly those regarding protection of trade secrets and proprietary information, and to comply with the Department of Energy`s (DOE) procedures for protecting Export Controlled Information (ECI). Electronic communication has allowed companies to enhance efficiency, responsiveness and effectiveness. E-mail allows employees to transmit all types of data to other individuals inside and outside of their companies. The ease with which information can be transmitted by e-mail has placed trade secrets, proprietary information, and other sensitive data at risk from inadvertent disclosure by employees. As employers attempt to protect their interests through measures such as monitoring e-mail, they may expose themselves to liability under federal and state laws for violating employee privacy. Business use of e-mail has proliferated so rapidly that the federal and state legal systems have not been able to adequately address the issues arising out of its use in the workplace.

  17. Missouri Agricultural Energy Saving Team-A Revolutionary Opportunity (MAESTRO)

    The Missouri Agricultural Energy Saving Team-A Revolutionary Opportunity (MAESTRO) program brought together a team of representatives from government, academia, and private industry to enhance the availability of energy efficiency services for small livestock producers in the State of Missouri. The Missouri Department of Agriculture (MDA) managed the project via a subcontract with the University of Missouri (MU), College of Agriculture Food and Natural Resources, MU Extension, the MU College of Human Environmental Sciences, the MU College of Engineering, and the Missouri Agricultural and Small Business Development Authority (MASBDA). MU teamed with EnSave, Inc, a nationally-recognized expert in agricultural energy efficiency to assist with marketing, outreach, provision of farm energy audits and customer service. MU also teamed with independent home contractors to facilitate energy audits of the farm buildings and homes of these livestock producers. The goals of the project were to: (1) improve the environment by reducing fossil fuel emissions and reducing the total energy used on small animal farms; (2) stimulate the economy of local and regional communities by creating or retaining jobs; and (3) improve the profitability of Missouri livestock producers by reducing their energy expenditures. Historically, Missouri scientists/engineers conducted programs on energy use in agriculture, such as in equipment, grain handling and tillage practices. The MAESTRO program was the first to focus strictly on energy efficiency associated with livestock production systems in Missouri and to investigate the applicability and potential of addressing energy efficiency in animal production from a building efficiency perspective. A. Project Objectives The goal of the MAESTRO program was to strengthen the financial viability and environmental soundness of Missouri's small animal farms by helping them implement energy efficient technologies for the production facility, farm buildings, and the homes on these farms. The expected measurable outcomes of the project were to improve the environment and stimulate the economy by: • Reducing annual fossil fuel emissions by 1,942 metric tons of carbon dioxide equivalent, reducing the total annual energy use on at least 323 small animal farms and 100 farm homes by at least 8,000 kWh and 2,343 therms per farm. • Stimulating the economy by creating or retaining at least 69 jobs, and saving small animal farmers an average of $2,071 per farm in annual energy expenditures. B. Project Scope The MAESTRO team chose the target population of small farms because while all agriculture is traditionally underserved in energy efficiency programs, small farms were particularly underserved because they lack the financial resources and access to energy efficiency technologies that larger farms deploy. The MAESTRO team reasoned that energy conservation, financial and educational programs developed while serving the agricultural community could serve as a national model for other states and their agricultural sectors. The target population was approximately 2,365 small animal farm operations in Missouri, specifically those farms that were not by definition a confined animal feeding operation (CAFO). The program was designed to create jobs by training Missouri contractors and Missouri University Extension staff how to conduct farm audits. The local economy would be stimulated by an increase in construction activity and an increasing demand for energy efficient farm equipment. Additionally, the energy savings were deemed critical in keeping Missouri farms in business. This project leveraged funds using a combination of funds from the Missouri Department of Natural Resources’ Missouri Energy Center and its Soil and Water Conservation Program, from the state's Linked Deposits, MASBDA's agricultural loan guarantee programs, and through the in-kind contribution of faculty and staff time to the project from these agencies and MU.     This document contains the findings and associated root causes identified during the Tiger Team Assessment of the Department of Energy's (DOE) Pantex Plant in Amarillo, Texas. This assessment was conducted by the Department's Office of Environment, Safety and Health between October 2 and 31, 1989. The scope of the assessment of the Pantex Plant covered all areas of environment, safety and health (ES H) activities, including compliance with federal, state, and local regulations, requirements, permits, agreements, orders and consent decrees, and DOE ES H Orders. The assessment also included an evaluation of the adequacy of DOE and site contractor ES H management programs. The draft findings were submitted to the Office of Defense Programs, the Albuquerque Operations Office, the Amarillo Area Office, and regulatory agencies at the conclusion of the on-site assessment activities for review and comment on technical accuracy. Final modifications and any other appropriate changes have been incorporated in the final report. The Tiger Team Assessment of the Pantex Plant is part of the larger Tiger Team Assessment program which will encompass over 100 DOE operating facilities. The assessment program is part of a 10-point initiative announced by Secretary of Energy James D. Watkins on June 27, 1989, to strengthen environmental protection and waste management activities in the Department. The results of the program will provide the Secretary with information on the compliance status of DOE facilities with regard to ES H requirements, root causes for noncompliance, adequacy of DOE and site contractor ES H management programs, and DOE-wide ES H compliance trends.

    In late 2006, the seaside community in Esperance Western Australia was alerted to thousands of native bird species dying. The source of the lead (Pb) was determined by Pb isotopes to derive from the handling of Pb carbonate concentrate through the Port, which began in July 2005. Concern was expressed for the impact of this on the community. Our objectives were to employ Pb isotope ratios to evaluate the source of Pb in environmental samples for use in legal proceedings, and for use in remediation and monitoring. Isotope measurements were undertaken of bird livers, plants, drinking water, soil, harbour sediments, air, bulk ceiling dust, gutter sludge, surface swabs and blood. The unique lead isotopic signature of the contaminating Pb carbonate enabled diagnostic apportionment of lead in samples. Apart from some soil and water samples, the proportion of contaminating Pb was >95% in the environmental samples. Lead isotopes were critical in resolving legal proceedings, are being used in the remediation of premises, were used in monitoring of workers involved in the decontamination of the storage facility, and monitoring transport of the concentrate through another port facility. Air samples show the continued presence of contaminant Pb, more than one year after shipping of concentrate ceased, probably arising from dust resuspension. Brief details of the comprehensive testing and cleanup of the Esperance community are provided along with the role of the Community. Lead isotopic analyses can provide significant benefits to regulatory agencies, interested parties, and the community where the signature is able to be characterised with a high degree of certainty. - Highlights: Black-Right-Pointing-Triangle Lead carbonate concentrate.     Our team activities are directed at improving PV module reliability by incorporating new, more effective, and less expensive packaging materials and techniques. New and existing materials or designs are evaluated before and during accelerated environmental exposure for the following properties: (1) Adhesion and cohesion: peel strength and lap shear. (2) Electrical conductivity: surface, bulk, interface and transients. (3) Water vapor transmission: solubility and diffusivity. (4) Accelerated weathering: ultraviolet, temperature, and damp heat tests. (5) Module and cell failure diagnostics: infrared imaging, individual cell shunt characterization, coring. (6) Fabrication improvements: SiOxNy barrier coatings and enhanced wet adhesion. (7) Numerical modeling: Moisture ingress/egress, module and cell performance, and cell-to-frame leakage current. (8) Rheological properties of polymer encapsulant and sheeting materials. Specific examples will be described.

    Many different types of cellular cargos are transported bidirectionally along microtubules by teams of molecular motors. The motion of this cargo-motors system has been experimentally characterized in vivo as processive with rather persistent directionality. Different theoretical approaches have been suggested in order to explore the origin of this kind of motion. An effective theoretical approach, introduced by M\\"uller et al., describes the cargo dynamics as a tug-of-war between different kinds of motors. An alternative approach has been suggested recently by Kunwar et al., who considered the coupling between motor and cargo in more detail. Based on this framework we introduce a model considering single motor positions which we propagate in continuous time. Furthermore, we analyze the possible influence of the discrete time update schemes used in previous publications on the system's dynamic.

    An aggressive, cost-cutting, team of T D employees at Arizona Public Service Co (APS) is building a new distribution substation in Phoenix for less than half the original cost that APS planners had calculated for the project's land, labor and materials. Scheduled for service in June of this year, APS analysts had originally projected land, labor and materials costs for the 20-MVA Bell substation at nearly $1.7-million-not including major equipment such as transformers, circuit breakers, and switches. However, after studying the project, an empowered APS crew was able to slash 36% off the original estimate-more than $610,000. What's more, APS spokesmen say that its new approach to substation construction and design has given its engineers and construction crews a laundry list of additional ideas to try out on future substation ventures. 4 figs., 1 tab.

    As in all vehicles of this type, low weight and aerodynamic drag must be achieved without compromising safety, and in an extremely rugged structure. This has been done by using a chrome-molybdenum steel space-frame, surrounded by a Kevlar/foam sandwich body shell. The solar panel wing, which uses a laminar flow section to obtain low drag, does not tilt except when the vehicle is stationary. A high degree of redundancy is built into the vehicle; for example there are two motors and transmissions, the solar array is divided into seven parallel sub-arrays, and the power electronics is multiply redundant. Built entirely in the garage of a suburban house, the Australian Geographic Team Marsupial car cost less than US$50,000 to construct.

    This report documents the Tiger Team Assessment of Sandia National Laboratories (SNL), Albuquerque, located in Albuquerque, New Mexico. SNL, Albuquerque, is operated by the Sandia Corporation (a wholly owned subsidiary of the American Telephone and Telegraph Company) for the US Department of Energy (DOE). The environmental assessment also included DOE tenant facilities at Ross Aviation, Albuquerque Microelectronics Operation, and the Central Training Academy. The assessment was conducted from April 15 to May 24, 1991, under the auspices of DOE's Office of Special Projects under the Assistant Secretary for Environment, Safety and Health (ES H). The assessment was comprehensive, encompassing ES H disciplines, management, self-assessments, and quality assurance; transportation; and waste management operations. Compliance with applicable federal, state, and local regulations; applicable DOE Orders; best management practices; and internal SNL, Albuquerque, requirements were assessed. In addition, an evaluation of the adequacy and effectiveness of DOE and SNL, Albuquerque management of ES H programs was conducted.

    The legal and institutional obstacles to the development of small-scale hydroelectric in West Virginia at the state level are described. The Federal government also exercises extensive regulatory authority in the area. The introductory section examines the dual regulatory system from the standpoint of the appropriate legal doctrine, the law of pre-emption, application of the law to the case of hydroelectric development, and concludes with an inquiry into the practical use of the doctrine by FERC. The development of small-scale hydroelectric energy depends on the selection of a site which will produce sufficient water power capacity to make the project economically attractive to a developer. In West Virginia, the right to use the flowing waters of a stream, creek, or river is appurtenant to the ownership of the lands bordering the watercourse. The lands are known as riparian lands. The water rights are known as riparian rights. Thus, the first obstacle a developer faces involves the acquisition of riparian lands and the subsequent right to the use of the water. The water law in West Virginia is discussed in detail followed by discussions on direct and indirect regulations; continuing obligations; financial considerations; and interstate organizations.

    A strong structural regularity of classes is found in soccer teams ranked by the Union of European Football Associations (UEFA) for the time interval 2009-2014. It concerns 424 to 453 teams according to the 5 competition seasons. The analysis is based on the rank-size theory considerations, the size being the UEFA coefficient at the end of a season. Three classes emerge: (i) the few "top" teams, (ii) 300 teams, (iii) the rest of the involved teams (about 150) in the tail of the distribution. There are marked empirical laws describing each class. A 3-parameter Lavalette function is used to describe the concave curving as the rank increases, and to distinguish the the tail from the central behavior.

    Research involves analysis and field direction of AmeriFlux operations, and the PI provides scientific leadership of the AmeriFlux network. Activities include the coordination and quality assurance of measurements across AmeriFlux network sites, synthesis of results across the network, organizing and supporting the annual Science Team Meeting, and communicating AmeriFlux results to the scientific community and other users. Objectives of measurement research include (i) coordination of flux and biometric measurement protocols (ii) timely data delivery to the Carbon Dioxide Information and Analysis Center (CDIAC); and (iii) assurance of data quality of flux and ecosystem measurements contributed by AmeriFlux sites. Objectives of integration and synthesis activities include (i) integration of site data into network-wide synthesis products; and (ii) participation in the analysis, modeling and interpretation of network data products. Communications objectives include (i) organizing an annual meeting of AmeriFlux investigators for reporting annual flux measurements and exchanging scientific information on ecosystem carbon budgets; (ii) developing focused topics for analysis and publication; and (iii) developing data reporting protocols in support of AmeriFlux network goals.

    Many existing proposals either lack sufficient concreteness to make carbon capture and geological sequestration (CCGS) operational or fail to focus on a comprehensive, long term framework for its regulation, thus failing to account adequately for the urgency of the issue, the need to develop immediate experience with large scale demonstration projects, or the financial and other incentives required to launch early demonstration projects. We aim to help fill this void by proposing a roadmap to commercial deployment of CCGS in the United States.This roadmap focuses on the legal and financial incentives necessary for rapid demonstration of geological sequestration in the absence of national restrictions on CO2 emissions. It weaves together existing federal programs and financing opportunities into a set of recommendations for achieving commercial viability of geological sequestration.

    The Consequence Management Home Team is a U.S. Department of Energy/National Nuclear Security Administration asset. It assists a variety of response organizations with modeling; radiological operations planning; field monitoring techniques; and the analysis, interpretation, and distribution of radiological data. These reach-back capabilities are activated quickly to support public safety and minimize the social and economic impact of a nuclear or radiological incident. In the Fukushima Daiichi response, the Consequence Management Home Team grew to include a more broad range of support than was historically planned. From the early days of the response to the continuing involvement in supporting late phase efforts, each stage of the Consequence Management Home Team support had distinct characteristics in terms of management of incoming data streams as well as creation of products. Regardless of stage, the Consequence Management Home Team played a critical role in the Fukushima Daiichi response effort.
