    The Department has issued a Final Rule revising the existing contractor regulations covering contractor legal management requirements at 10 C.F.R. 719 (Federal Register May 3, 2013; http://www.gpo.gov/fdsys/pkg/FR-2013-05-03/pdf/2013-10485.pdf). One unusual aspect of the Final Rule is that it requires Contracting Officers to attempt to execute bilateral modifications to existing affected contracts to apply the Final Rule's revisions to those contracts. We will issue an Acquisition Letter shortly with suggested contract modification language. (The Final Rule's revisions "… are designed to clarify and streamline existing requirements, improve efficiency of contractor legal management, and facilitate oversight over the expenditure of taxpayer dollars." The contract modifications will state the revisions will only apply to costs incurred from date the bilateral modifications are executed forward. The revisions are administrative in nature. Regarding costs contractors have not yet incurred, the revisions could have been communicated to contractors without using a Final Rule to incorporate them into current contracts. Consequently, the modifications do not require equitable adjustments.)

    Highlights: • We propose a reverse logistics network for MSW involving waste pickers. • A generic facility location mathematical model was validated in a Brazilian city. • The results enable to predict the capacity for screening and storage centres (SSC). • We minimise the costs for transporting MSW with screening and storage centres. • The use of SSC can be a potential source of revenue and a better use of MSW. - Abstract: This study proposes a reverse logistics network involved in the management of municipal solid waste (MSW) to solve the challenge of economically managing these wastes considering the recent legal requirements of the Brazilian Waste Management Policy. The feasibility of the allocation of MSW material recovery facilities (MRF) as intermediate points between the generators of these wastes and the options for reuse and disposal was evaluated, as well as the participation of associations and cooperatives of waste pickers. This network was mathematically modelled and validated through a scenario analysis of the municipality of São Mateus, which makes the location model more complete and applicable in practice. The mathematical model allows the determination of the number of facilities required for the reverse logistics network, their location, capacities, and product flows between these facilities. The fixed costs of installation and operation of the proposed MRF were balanced with the reduction of transport costs, allowing the inclusion of waste pickers to the reverse logistics network. The main contribution of this study lies in the proposition of a reverse logistics network for MSW simultaneously involving legal, environmental, economic and social criteria, which is a very complex goal. This study can guide practices in other countries that have realities similar to those in Brazil of accelerated urbanisation without adequate planning for solid waste management, added to the strong presence of waste pickers that, through the

    ''Legacy Management Requires Information'' describes the goal(s) of the US Department of Energy's Office of Legacy Management (LM) relative to maintaining critical records and the way those goals are being addressed at Hanford. The paper discusses the current practices for document control, as well as the use of modern databases for both storing and accessing the data to support cleanup decisions. In addition to the information goals of LM, the Hanford Federal Facility Agreement and Consent Order, known as the ''Tri-Party Agreement'' (TPA) is one of the main drivers in documentation and data management. The TPA, which specifies discrete milestones for cleaning up the Hanford Site, is a legally binding agreement among the US Department of Energy (DOE), the Washington State Department of Ecology (Ecology), and the US Environmental Protection Agency (EPA). The TPA requires that DOE provide the lead regulatory agency with the results of analytical laboratory and non-laboratory tests/readings to help guide them in making decisions. The Agreement also calls for each signatory to preserve--for at least ten years after the Agreement has ended--all of the records in its or its contractors, possession related to sampling, analysis, investigations, and monitoring conducted. The tools used at Hanford to meet TPA requirements are also the tools that can satisfy the needs of LM.

    CH2M HILL Plateau Remediation Company (CH2M HILL) is the U.S. Department of Energy (DOE) prime contractor responsible for the environmental cleanup of the Hanford Site Central Plateau. As part of this responsibility, the CH2M HILL is faced with the task of complying with thousands of environmental requirements which originate from over 200 federal, state, and local laws and regulations, DOE Orders, waste management and effluent discharge permits, Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) response and Resource Conservation and Recovery Act (RCRA) corrective action documents, and official regulatory agency correspondence. The challenge is to manage this vast number of requirements to ensure they are appropriately and effectively integrated into CH2M HILL operations. Ensuring compliance with a large number of environmental requirements relies on an organization’s ability to identify, evaluate, communicate, and verify those requirements. To ensure that compliance is maintained, all changes need to be tracked. The CH2M HILL identified that the existing system used to manage environmental requirements was difficult to maintain and that improvements should be made to increase functionality. CH2M HILL established an environmental requirements management procedure and tools to assure that all environmental requirements are effectively and efficiently managed. Having a complete and accurate set of environmental requirements applicable to CH2M HILL operations will promote a more efficient approach to: • Communicating requirements • Planning work • Maintaining work controls • Maintaining compliance

As a result worker routine bioassays requirements may include routine whole body counting for mixed fission products, chest counting for uranium or plutonium, and/or urinalyses for plutonium, ura@u@ strontium-90, and tritium depending on work assignments. In such a situation it is easy to perform unnecessary bioassays and incur unnecessary cost. Program Implementation Fluor Daniel Hanford has been working with the Pacific Northwest National. Laboratories to reduce the number of routine bioassays in the internal dosimetry program while ensuring the program is compliant with regulatory requirements. This has been accomplished by: 1.     Figuring out an effective and efficient way to manage not only your Requirements Baseline, but also the development of all your individual requirements during a Programs/Projects Conceptual and Development Life Cycle Stages can be both daunting and difficult. This is especially so when you are dealing with a complex and large System of Systems (SoS) Program with potentially thousands and thousands of Top Level Requirements as well as an equal number of lower level System, Subsystem and Configuration Item requirements that need to be managed. This task is made even more overwhelming when you have to add in integration with multiple requirements development teams (e.g., Integrated Product Development Teams (IPTs)) and/or numerous System/Subsystem Design Teams. One solution for tackling this difficult activity on a recent large System of Systems Program was to develop and make use of a Requirements Screening Group (RSG). This group is essentially a Team made up of co-chairs from the various Stakeholders with an interest in the Program of record that are enabled and accountable for Requirements Development on the Program/Project. The RSG co-chairs, often with the help of individual support team, work together as a Program Board to monitor, make decisions on, and provide guidance on all Requirements Development activities during the Conceptual and Development Life Cycle Stages of a Program/Project. In addition, the RSG can establish and maintain the Requirements Baseline, monitor and enforce requirements traceability across the entire Program, and work with other elements of the Program/Project to ensure integration and coordination.

    The CRD addresses the requirements of Department of Energy (DOE) Order 413.3-Change 1, ''Program and Project Management for the Acquisition of Capital Assets'', by providing the Secretarial Acquisition Executive (Level 0) scope baseline and the Program-level (Level 1) technical baseline. The Secretarial Acquisition Executive approves the Office of Civilian Radioactive Waste Management's (OCRWM) critical decisions and changes against the Level 0 baseline; and in turn, the OCRWM Director approves all changes against the Level 1 baseline. This baseline establishes the top-level technical scope of the CRMWS and its three system elements, as described in section 1.3.2. The organizations responsible for design, development, and operation of system elements described in this document must therefore prepare subordinate project-level documents that are consistent with the CRD. Changes to requirements will be managed in accordance with established change and configuration control procedures. The CRD establishes requirements for the design, development, and operation of the CRWMS. It specifically addresses the top-level governing laws and regulations (e.g., ''Nuclear Waste Policy Act'' (NWPA), 10 Code of Federal Regulations (CFR) Part 63, 10 CFR Part 71, etc.) along with specific policy, performance requirements, interface requirements, and system architecture. The CRD shall be used as a vehicle to incorporate specific changes in technical scope or performance requirements that may have significant program implications. Such may include changes to the program mission, changes to operational capability, and high visibility stakeholder issues.     Transmission congestion occurs when there is insufficient transmission capacity to simultaneously accommodate all requests for transmission service within a region. Historically, vertically integrated utilities managed this condition by constraining the economic dispatch of generators with the objective of ensuring security and reliability of their own and/or neighboring systems. Electric power industry restructuring has moved generation investment and operations decisions into the competitive market but has left transmission as a communal resource in the regulated environment. This mixing of competitive generation and regulated transmission makes congestion management difficult. The difficulty is compounded by increases in the amount of congestion resulting from increased commercial transactions and the relative decline in the amount of transmission. Transmission capacity, relative to peak load, has been declining in all regions of the U.S. for over a decade. This decline is expected to continue. Congestion management schemes used today have negative impacts on energy markets, such as disruptions and monetary penalties, under some conditions. To mitigate these concerns various congestion management methods have been proposed, including redispatch and curtailment of scheduled energy transmission. In the restructured electric energy industry environment, new congestion management approaches are being developed that strive to achieve the desired degree of reliability while supporting competition in the bulk power market. This report first presents an overview and background on key issues and emerging approaches to congestion management. It goes on to identify and describe policies affecting congestion management that are favored and/or are now being considered by FERC, NERC, and one of the regional reliability councils (WSCC). It reviews the operational procedures in use or proposed by three of the leading independent system operators (ISOs) including ERCOT

    The advancement of computer technologies has led to the development of a number of emergency management information systems (e.g., EIS, CAMEO, IEMIS). The design of these systems has tended to be technologically driven rather than oriented to meeting information management needs during an emergency. Of course, emergency management needs vary depending on the characteristics of the emergency. For example, in hurricanes, onset is typically slow enough to allow emergency managers to simulate evacuations dynamically while in chemical disasters onset may be sufficiently rapid to preclude such simulation(s). This paper describes a system design process in which the analysis of widely recognized emergency management functions was used to identify information requirements and the requisite software and hardware capabilities to deal with rapid onset, low probability, high consequence events. These requirements were then implemented as a prototype emergency management system using existing hardware and software to assure feasibility. Data, hardware, and software requirements were further developed, refined, and made more concrete through an iterative prototyping effort. This approach focuses attention directly on meeting emergency management information needs while avoiding unneeded technological innovations. 10 refs., 4 figs., 1 tab.

    The goals for plutonium management have changed dramatically over the past few years. Today, the challenge is focused on isolating plutonium from the environment and preparing it for permanent disposition. In parallel, the requirements for managing plutonium are rapidly changing. For example, there is a significant increase in public awareness on how facilities operate, increased attention to environmental safety and health (ES and H) concerns, greater interest in minimizing waste, more emphasis on protecting material from theft, providing materials for international inspection, and a resurgence of interest in using plutonium as an energy source. Of highest concern, in the immediate future, is protecting plutonium from theft or diversion, while the national policy on disposition is debated. These expanded requirements are causing a broadening of responsibilities within the Department of Energy (DOE) to include at least seven organizations. An unavoidable consequence is the divergence in approach and short-term goals for managing similar materials within each organization. The technology base does exist, properly, safely, and cost effectively to extract plutonium from excess weapons, residues, waste, and contaminated equipment and facilities, and to properly stabilize it. Extracting the plutonium enables it to be easily inventoried, packaged, and managed to minimize the risk of theft and diversion. Discarding excess plutonium does not sufficiently reduce the risk of diversion, and as a result, long-term containment of plutonium from the environment may not be able to be proven to the satisfaction of the public.

    Lockheed Idaho Technologies Company (LITCO) used a systems engineering approach to develop the first formal requirements baseline for Idaho National Engineering Laboratory (INEL) Environmental Management (EM) Programs. The recently signed Settlement Agreement with the State of Idaho (Batt Agreement), along with dramatically reduced EM funding targets from Department of Energy (DOE) headquarters, drove the immediacy of this effort. Programs have linked top-level requirements to work scope to cost estimates. All EM work, grouped by decision units, was scrubbed by INEL EM programs and by an independent {open_quotes}Murder Board.{close_quotes} Direct participation of upper level management from LITCO and the DOE-Idaho Operations Office ensured best information and decisions. The result is a scrubbed down, defensible budget tied to top-level requirements for use in the upcoming DOE-Headquarters` budget workout, the Internal Review Board, the FY98 Activity Data Sheets submittal, and preparation of the FY97 control accounts and out-year plans. In addition to the remarkable accomplishments during the past eight weeks, major issues were identified and documented and follow-on tasks are underway which will lead to further improvements in INEL EM program management.

    This paper reviews the public service responsibilities of lawyers, and how they can fulfill the annual goal of performing pro bono services by serving certain public involvement groups, including organization involved in Constitutional issues and environmental protection matters. Public involvement groups should consider their needs for legal services and consider soliciting lawyers to serve on their boards or to volunteer legal services which will assist those lawyers in fulfilling their professional obligations under Rules of Professional Conduct. The group should identify specific activities and tasks that require the skills and training of a lawyer, including corporate governance issues; conflict-of-interest questions; the statutory construction of laws, regulations and ordinances; or analysis of potential liability. The addition of a lawyer to advisory boards for governmental agencies and for non-profit boards of charitable, religious, civic, community, environmental and educational organizations may provide those boards with knowledge, analytical approaches and insights that complement the abilities of other board members. Rules of Professional Conduct applicable to lawyers include admonitions for lawyers to provide 'Public Service'. Representative of many rules, the American Bar Association Model Rule 6.1, entitled 'Voluntary Pro Bono Publico Service' addresses every lawyer's professional responsibility to provide legal services to those 'unable to pay'. This Model Rule exhorts each lawyer to provide fifty (50) hours of legal services without fee or expectation of fee to persons of limited means or charitable, religious or civic, community, governmental and educational organizations or to individuals, groups or organizations seeking 'to secure or protect civil rights, civil liberties, or public rights, or charitable, religious, civic, community, governmental and educational organizations in matters in furtherance of their purposes, where the payment of

    The Occupational Safety and Health Administration promulgates and enforces regulations that govern the health and safety of workers. OSHA rules often are considered to govern what happens {open_quotes}inside the fence line,{close_quotes} or within the physical boundaries of the facility. In some ways, the U.S. Environmental Protection Agency takes over where OSHA leaves off. The U.S. EPA is responsible for environmental programs {open_quotes}outside the fence line.{close_quotes} The concept is as simple as drawing a line, or is it? Anyone developing and implementing compliance programs, whether for OSHA or EPA, will tell you nothing is that simple. EPA`s recent promulgation of rules pertaining to risk management programs is a case in point. A new EPA rule is intended to compliment OSHA requirements under the Process Safety Management (PSM) rule. Under the OSHA rule, plant operators developed programs that ensure safe measures are in use when handling certain chemicals. During the past three years, waste-to-energy facilities faced difficult decisions when complying with the PSM requirements. Earlier this year, the US EPA promulgated its 112(r)(7) rule that is intended to `complement` OSHA`s PSM requirements. This is not always the case. Unfortunately, these new Clean Air Act requirements do not always complement, but may instead confuse plant operators. For example, EPA`s 112(r) rule may force plant operators to change, once again, their decisions on the use of selected chemicals. The US EPA estimates that approximately 66,000 facilities, including the 114 waste-to-energy facilities nationwide, may be affected by the list and risk management planning rules. The facilities include chemical and many other manufacturers, cold storage facilities with ammonia refrigeration systems, public water treatment systems, wholesalers and distributors of these chemicals, propane retailers, utilities, and federal facilities.

    This report was prepared to support development of the Department of Energy Environmental Management cost infrastructure -- a new capability to independently estimate and analyze costs. Currently, the cost data are reported according to a structure that blends level of effort tasks with product and process oriented tasks. Also. the budgetary inputs are developed from prior year funding authorizations and from contractor-developed parametric estimates that have been adjusted to planned funding levels or appropriations. Consequently, it is difficult for headquarters and field-level activities to use actual cost data and technical requirements to independently assess the costs generated and identify trends, potential cost savings from process improvements, and cost reduction strategies.

    The Department of Energy has recently required its field offices, contractors, and subcontractors to implement DOE Order 5700.6C, ``Quality Assurance,`` for all work on waste management contracts. The order restructures the 18 criteria of NQA-1 and focuses on the role of management in achieving and assuring quality, performance of activities to achieve and assure quality, and management`s assessment of its performance for the purpose of identifying improvements to be made. The DOE order also introduces elements of the total quality management (TQM) philosophy, which were not present in DOE Order 5700.6B. The research community within DOE has recently issued a document entitled DOE Order 5700.6C Implementation Guide, which is more explicit about the integration of TQM principles with the implementation of DOE Order 5700.6C in research facilities. The Environmental Protection Agency is sponsoring a quality assurance standard (ANSI/ASQC E-4) to replace EPA`s QAMS 005/80. The new standard is consistent with DOE Order 5700.6C, and it also stresses the integration of TQM principles within the quality assurance process. This paper discusses the intent and philosophy of the 10 criteria of the new DOE order, the status of ANSI/ASQC E-4, and how to effectively integrate TQM principles into the quality assurance process as the conversion is made from NQA-1 to DOE Order 5700.6C. The purpose and value of DOE Order 5700.6C Implementation Guide for research will also be discussed.

    The potential impacts associated with the transportation of hazardous materials are important to shippers, carriers, and the general public. This is particularly true for shipments of radioactive material. The shippers are primarily concerned with safety, security, efficiency, and equipment requirements. The carriers are concerned with the potential impact that radioactive shipments may have on their operations--particularly if such materials are involved in an accident. The general public has also expressed concerns regarding the safety of transporting radioactive and other hazardous materials through their communities. Because transportation routes are a central concern in hazardous material transport, the prediction of likely routes is the first step toward resolution of these issues. In response to these routing needs, several models have been developed over the past fifteen years at Oak Ridge National Laboratory (ORNL). The HIGHWAY routing model is used to predict routes for truck transportation, the INTERLINE routing model is used to predict both rail and barge routes, and the AIRPORT locator model is used to determine airports with specified criteria near a specific location. As part of the ongoing improvement of the US Department of Energy`s (DOE) Environmental Management Transportation Management Division`s (EM-261) computer systems and development efforts, a Baseline Requirements Assessment Session on the HIGHWAY, INTERLINE, and AIRPORT models was held at ORNL on April 27, 1994. The purpose of this meeting was to discuss the existing capabilities of the models and data bases and to review enhancements of the models and data bases to expand their usefulness. The results of the Baseline Requirements Assessment Section will be discussed in this report. The discussions pertaining to the different models are contained in separate sections.

    Advanced small modular reactors (aSMRs), which are based on modularization of advanced reactor concepts, may provide a longer-term alternative to traditional light-water reactors and near term small modular reactors (SMRs), which are based on integral pressurized water reactor (iPWR) concepts. aSMRs are conceived for applications in remote locations and for diverse missions that include providing process or district heating, water desalination, and hydrogen production. Several challenges exist with respect to cost-effective operations and maintenance (O&M) of aSMRs, including the impacts of aggressive operating environments and modularity, and limiting these costs and staffing needs will be essential to ensuring the economic feasibility of aSMR deployment. In this regard, prognostic health management (PHM) systems have the potential to play a vital role in supporting the deployment of aSMR systems. This paper identifies requirements and technical gaps associated with implementation of PHM systems for passive aSMR components.

Its mission is to procure refined petroleum products to meet military service requirements worldwide and federal requirements within the United States. The procurement options analyzed are divided into two categories -- direct and indirect methods of acquiring products.     The Department of Energy (DOE) is examining alternative strategies for the long-term management of depleted uranium hexafluoride (UF{sub 6}) currently stored at the gaseous diffusion plants at Portsmouth, Ohio, and Paducah, Kentucky, and on the Oak Ridge Reservation in Oak Ridge, Tennessee. This paper describes the methodology for the comprehensive and ongoing technical analysis of the options being considered. An overview of these options, along with several of the suboptions being considered, is presented. The long-term management strategy alternatives fall into three broad categories: use, storage, or disposal. Conversion of the depleted UF6 to another form such as oxide or metal is needed to implement most of these alternatives. Likewise, transportation of materials is an integral part of constructing the complete pathway between the current storage condition and ultimate disposition. The analysis of options includes development of pre-conceptual designs; estimates of effluents, wastes, and emissions; specification of resource requirements; and preliminary hazards assessments. The results of this analysis will assist DOE in selecting a strategy by providing the engineering information necessary to evaluate the environmental impacts and costs of implementing the management strategy alternatives.

    The study describes the results of a survey of 547 local water supply systems serving some 31 million residents of urban areas in the states of Alabama, California, Florida, Oklahoma, Tennessee and Wyoming. While examining the legal and administrative aspects of drought management, the survey also included the assessment of the current status of drought preparedness and long-term drought protection among the responding water supply systems. The rate of legal or administrative problems encountered during drought response was surprisingly low, affecting only twenty percent of all implementing systems. The low incidence of difficulties counters a widespread assumption that the legal environment frequently restrains or constricts drought response efforts.

    The legal and institutional framework within which geothermal energy must develop has its origin in the early 1970s. In 1970, the Federal Geothermal Steam Act was passed into law and in 1974 the Washington State Geothermal Act was passed. The legal and institutional framework thus established by the state and federal governments differed substantially in format, content, and direction. In many instances, the legal and institutional framework established left as many questions unanswered as answered, and in some cases, the framework has proven to be more of an obstacle to development than an aid. From an examination of how the state and federal governments have addressed the varying needs of geothermal development and how the courts have interpreted some of their decisions, it is clear that in order to ensure that the legal and institutional framework is adequate to serve the needs of geothermal development, it must address, at a minimum, the following topics: (1) providing developers with access and a priority right to carry out exploration and development activities; (2) characterization of the resource so as to minimize conflicts with other natural resources; (3) establishing ownership; and (4) giving careful consideration to such lease terms as rentals and royalties, lease renewals, and diligence requirements. In addition, the framework must address groundwater law and its implications for geothermal development and how geothermal development will be considered in terms of establishing utility law. At the local level, it is imperative that geothermal be given careful consideration when decisions on resource management, zoning, and regulation are made. Local governments also have the power to establish programs which can provide substantial incentives for geothermal development and, by so doing, ensure that geothermal energy contributes to economic stability and growth.

    The social and legal framework within which bioremediation technologies must be researched, developed, and deployed in the US are discussed in this report. Discussions focus on policies, laws and regulations, intellectual property, technology transfer, and stakeholder concerns. These discussions are intended to help program managers, scientists and engineers understand the social and legal framework within which they work, and be cognizant of relevant issues that must be navigated during bioremediation technology research, development, and deployment activities. While this report focuses on the legal and social environment within which the DOE operates, the laws, regulations and social processes could apply to DoD and other sites nationwide. This report identifies specific issues related to bioremediation technologies, including those involving the use of plants; native, naturally occurring microbes; non-native, naturally occurring microbes; genetically engineered organisms; and microbial products (e.g., enzymes, surfactants, chelating compounds). It considers issues that fall within the following general categories: US biotechnology policy and the regulation of field releases of organisms; US environmental laws and waste cleanup regulations; intellectual property and patenting issues; technology transfer procedures for commercializing technology developed through government-funded research; stakeholder concerns about bioremediation proposals; and methods for assuring public involvement in technology development and deployment.

    This report presents the findings of the Interagency Requirements Review of the Department of Energy (DOE) Environmental Restoration and Waste Management (ERWM) Program. The review was requested by Admiral Watkins to help determine the FY 1993 funding levels necessary to meet all legal requirements. The review was undertaken by analysts from the Office of Management and Budget (OMB) and Army Corps of Engineers, reporting to an Interagency Group (IAG) of senior Administration officials concerned with environmental cleanup issues. The purpose of the study was to determine the level of finding needed in FY 1993 for each ERWM Field Office to comply with all Federal, State, and local government legal requirements; all DOE Orders that establish standards for environment, safety and health (ES and H) management; and for prudent investments in other discretionary and management activities such as upgrading administrative buildings, information systems, etc. The study also reviewed the cost estimates supporting the ERWM proposed budget, including direct costs (labor, equipment) and indirect costs (administrative, landlord services, contractor overhead). The study did not analyze whether the Federal/State legal requirements and DOE Orders were necessary or whether the proposed clean-up remedies represent the most cost effective alternatives available.

    This document updates and expands the report with a similar title issued in October 1980. This document examines a number of legal and regulatory issues that potentially can affect implementation of the aquifer thermal energy storage (ATES) concept. This concept involves the storage of thermal energy in an underground aquifer until a later date when it can be effectively utilized. Either heat energy or chill can be stored. Potential end uses of the energy include district space heating and cooling, industrial process applications, and use in agriculture or aquaculture. Issues are examined in four categories: regulatory requirements, property rights, potential liability, and issues related to heat or chill delivery.

This paper discusses some of the strategies that companies falling under Tier 3 of EPA`s RMP rule may use to comply with OSHA`s revalidation of PHA`s and the upcoming EPA rule. The paper also provides details on the use of other PSM elements for PHA revalidation (such as compliance audits and management of change), the development of schedules for PHA revalidation, preparation time, the revalidation process, and the documentation/identification of RMP hazard scenarios.

    In 2010, Atomic Weapons Establishment (AWE) identified a requirement to implement revised management arrangements for the generation, storage and disposal of radioactive waste. A thorough review of the current arrangements/processes was undertaken which included both legal compliance requirements and the identification of business improvement opportunities. On completion of this review a suitable project team was established and in 2011 an integrated Radioactive Waste Management process was implemented throughout the business. Initial results have shown measurable improvements within Radioactive Waste management compliance, operator understanding and increased business efficiency. Through the development and implementation of the revised working arrangements AWE has been able to continue to demonstrate both legal compliance to its regulators along with business efficiency and effectiveness improvements. Simple to follow process maps have improved employees understanding of Radioactive Waste management requirements, provided them with easily accessible information and ensured the business operates in a single coherent manner. The implementation of a modern electronic data management system has ensured all waste related information is easily retrievable and appropriately maintained. The additional functions that have been built into the system have reduced the potential for human error and increased the overall efficiency of the Waste Management department through the use of the automated report generation functionality.     Releases of various substances from DOE facilities may be subject to reporting requirements under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Emergency Planning and Community Right-to-Know Act (EPCRA), as well as DOE`s internal ``Occurrence Reporting and Processing of Operations Information`` and the ``Emergency Management System`` (EMS). CERCLA and EPCPA are Federal laws that require immediate reporting of a release of a Hazardous Substance (HS) and an Extremely Hazardous Substance (EHS), respectively, in a Reportable Quantity (RQ) or more within a 24-hour period. This guidance uses a flowchart, supplemental information, and tables to provide an overview of the process to be followed, and more detailed explanations of the actions that must be performed, when chemical releases of HSs, EHSs, pollutants, or contaminants occur at DOE facilities. This guidance should be used in conjunction with, rather than in lieu of, applicable laws, regulations, and DOE Orders.     Because the Chemical Weapons Convention (CWC) contains the best developed verification regime in multilaterial arms control history, some have raised concerns for the chemical industry that have legal implications. Chief among these are safeguarding confidential business information and protecting constitutional rights during inspections. This discussion will show how the CWC and proposed national implementing legislation work together to allay these concerns. Both concerns are legitimate. Confidential business information could be lost to a national government or the CWC governing body accidentially or purposely. The CWC regime of routine and challenge inspections are searches under the constitution and could, if abused, potentially conflict with recognized commercial privacy interests. Neither concern justifies opposition to the convention, but both need to be addressed in national implementing legislation. Proposed US legislation goes far in this direction, but can be improved.

It includes five background papers on drought, drought management, risks for public systems, and legal and institutional aspects, plus appendices on conservation and rationing plans for Los Angeles and Salt Lake County. The conclusions of the volume include: (1) there is substantial need for continued research on drought and its impact on the management of public water systems; (2) sizing of the physical facilities of a system should not be based solely on full-service requirements during the drought of record, nor should such facilities be sized by the arbitrary specification of hydrologic risk; and (3) the key to adequate drought management of public water systems lies in predrought preparation.

    Cumulative effects analysis (CEA) allows natural resource managers to understand the status of resources in historical context, learn from past management actions, and adapt future activities accordingly. U.S. federal agencies are required to complete CEA as part of environmental impact assessment under the National Environmental Policy Act (NEPA). Past research on CEA as part of NEPA has identified significant deficiencies in CEA practice, suggested methodologies for handling difficult aspects of CEA, and analyzed the rise in litigation over CEA in U.S. courts. This article provides a review of the literature and legal standards related to CEA as it is done under NEPA and then examines current practice on a U.S. National Forest, utilizing qualitative methods in order to provide a detailed understanding of current approaches to CEA. Research objectives were to understand current practice, investigate ongoing challenges, and identify impediments to improvement. Methods included a systematic review of a set of NEPA documents and semi-structured interviews with practitioners, scientists, and members of the public. Findings indicate that the primary challenges associated with CEA include: issues of both geographic and temporal scale of analysis, confusion over the purpose of the requirement, the lack of monitoring data, and problems coordinating and disseminating data. Improved monitoring strategies and programmatic analyses could support improved CEA practice.

    This thesis is the culminating project for my participation in the OECD NEA International School of Nuclear Law. This paper will begin by providing a historical background to current disarmament and denuclearization treaties. This paper will discuss the current legal framework based on current and historical activities related to denuclearization and nuclear disarmament. Then, it will propose paths forward for the future efforts, and describe the necessary legal considerations. Each treaty or agreement will be examined in respect to its requirements for: 1) limitations and implementation; 2) and verification and monitoring. Then, lessons learned in each of the two areas (limitations and verification) will be used to construct a proposed path forward at the end of this paper.

This report is divided into five sections and three appendices. Section 1 introduces the report. Section 2 identifies and discusses the transportation regulations and requirements. The regulations and requirements are divided into Federal, state, local government, and Indian tribes subsections. This report does not identify the regulations or requirements of specific state, local government, and Indian tribes, since the storage, treatment, and disposal facility locations and transportation routes have not been specifically identified. Section 3 identifies the planning needed to ensure that all transportation activities are in compliance with the regulations and requirements. It is divided into (a) transportation packaging; (b) transportation operations; (c) system safety and risk analysis, (d) route selection; (e) emergency preparedness and response; and (f) safeguards and security.     Research highlights: {yields} Legal and economic opinions of free interstate trade of MSW in the US are reviewed. {yields} Economic theory of landfill space as the article of commerce can align opinions. {yields} Waste management policies implied by this economic theory are compared/contrasted. - Abstract: Managing municipal solid waste (MSW) within and across regions is a complex public policy problem. One challenge regards conceptualizing precisely what commodity is to be managed across space and time. The US Supreme Court view is that waste disposal is the article of commerce per se. Some justices, however, have argued that while waste disposal is the article of commerce, its interstate flow could be impeded by states on the grounds that they have the authority to regulate natural resource quality within their boundaries. The argument in this paper is that adopting the economic theory view of the article of commerce as landfill space brings the majority and dissenting US Supreme Court views-and the resulting sides of the public policy dispute-into closer alignment. We discuss waste management policy tools that emerge from this closer alignment that are more likely to both withstand judicial scrutiny and achieve economic efficiency.

    Following graduation from a college or university with a technical degree, or through years of experience, an individual's training and career development activities typically focus on enhancing technical problem-solving skills. However, as these technical professionals, herein referred to as 'Techies', advance throughout their careers, they may be required to accept and adapt to the role of being a manager, and must undergo a transition to learn and rely on new problem-solving skills. However, unless a company has a specific manager-trainee class to address this subject and develop talent from within, an employee's management style is learned and developed 'on the job'. Both positive and negative styles are nurtured by those managers having similar qualities. Unfortunately, a negative style often contributes to the deterioration of employee morale and ultimate closing of a department or company. This paper provides the core elements of an effective management training program for 'Teaching Managers How to Manage' derived from the Department of Energy's Integrated Safety Management System and the Occupational Safety and Health Administration 's Voluntary Protection Program. This paper evaluates the legality, technical feasibility, economics, and human health risk of disposing of NORM-contaminated oil field wastes in salt caverns. Cavern disposal of NORM waste is technically feasible and poses a very low human health risk. From a legal perspective, there are no fatal flaws that would prevent a state regulatory agency from approaching cavern disposal of NORM. On the basis of the costs charged by caverns currently used for disposal of nonhazardous oil field waste (NOW), NORM waste disposal caverns could be cost competitive with existing NORM waste disposal methods when regulatory agencies approve the practice.

Black-Right-Pointing-Pointer The method applied could be useful for similar establishments. - Abstract: According to the Brazilian law, implementation of a Medical Waste Management Plan (MWMP) in health-care units is mandatory, but as far as we know evaluation of such implementation has not taken place yet. The purpose of the present study is to evaluate the improvements deriving from the implementation of a MWMP in a Primary Health-care Center (PHC) located in the city of Sao Paulo, Brazil. The method proposed for evaluation compares the first situation prevailing at this PHC with the situation 1 year after implementation of the MWMP, thus allowing verification of the evolution of the PHC performance. For prior and post-diagnosis, the method was based on: (1) application of a tool (check list) which considered all legal requirements in force; (2) quantification of solid waste subdivided into three categories: infectious waste and sharp devices, recyclable materials and non-recyclable waste; and (3) identification of non-conformity practices. Lack of knowledge on the pertinent legislation by health workers has contributed to non-conformity instances. The legal requirements in force in Brazil today gave origin to a tool (check list) which was utilized in the management of medical waste at the health-care unit studied. This tool resulted into an adequate and simple instrument, required a low investment, allowed collecting data to feed indicators and also conquered the participation of the unit whole staff.     This report identifies a variety of shipping packages (also referred to as casks) and waste containers currently available or being developed that could be used for greater-than-Class C (GTCC) low-level waste (LLW). Since GTCC LLW varies greatly in size, shape, and activity levels, the casks and waste containers that could be used range in size from small, to accommodate a single sealed radiation source, to very large-capacity casks/canisters used to transport or dry-store highly radioactive spent fuel. In some cases, the waste containers may serve directly as shipping packages, while in other cases, the containers would need to be placed in a transport cask. For the purpose of this report, it is assumed that the generator is responsible for transporting the waste to a Department of Energy (DOE) storage, treatment, or disposal facility. Unless DOE establishes specific acceptance criteria, the receiving facility would need the capability to accept any of the casks and waste containers identified in this report. In identifying potential casks and waste containers, no consideration was given to their adequacy relative to handling, storage, treatment, and disposal. Those considerations must be addressed separately as the capabilities of the receiving facility and the handling requirements and operations are better understood.

    Department of Energy (DOE) Order (O) 440.1, Worker Protection Management For DOE Federal and Contractors Employees, [7] sets forth requirements for DOE and its contractors to implement suspect and counterfeit items (S/CI) controls as part of the quality assurance (QA) programs required by 10 Code of Federal Regulations (CFR) 830.120 [8] or DOE 5700.6C, Quality Assurance [9]. DOE G-830.120, Implementation Guide for Use with 10 CFR Part 830.120, Quality Assurance, [10] provides additional guidance on establishing and implementing effective QA processes to control S/CIs. DOE O 232.1, Occurrence Reporting and Processing of Operations, [11] specifies requirements for reporting S/CIs under the DOE Occurrence Reporting and Processing System (ORPS). DOE promulgated the requirements and guidance to control or eliminate the hazards posed by S/CIs, which can lead to unexpected equipment failures and undue risks to the DOE mission, the environment, and personnel. This Guide is a compendium of information contained in the referenced DOE directives and other documents concerning S/CI controls. It incorporates, updates, and supersedes earlier guidance issued in Plan for the Suspect/Counterfeit Products Issue in the Department of Energy, dated October 1993, [4] and in memoranda issued by Defense Programs (DP) [12-16] and other DOE program offices. This guidance was developed to strengthen the procurement process, identify and eliminate S/CIs, and improve the reporting of S/CIs. The information in this Guide, when implemented by DOE and its contractors, will satisfy the S/CI requirements contained in the referenced DOE directives.

    This volume of the final report is a compilation of the estimated capital and operating costs for the project. Using the definitive design as a basis, capital and operating costs were developed by obtaining quotations for equipment delivered to the site. Tables 1.1 and 1.2 provide a summary of the capital and operating costs estimated for the PGW Coal Gasification Project. In the course of its Phase I Feasibility Study of a medium-Btu coal-gas facility, Philadelphia Gas Works (PGW) identified the financing mechanism as having great impact on gas cost. Consequently, PGW formed a Financial/Legal Task Force composed of legal, financial, and project analysis specialists to study various ownership/management options. In seeking an acceptable ownership, management, and financing arrangement, certain ownership forms were initially identified and classified. Several public ownership, private ownership, and third party ownership options for the coal-gas plant are presented. The ownership and financing forms classified as base alternatives involved tax-exempt and taxable financing arrangements and are discussed in Section 3. Project implementation would be initiated by effectively planning the methodology by which commercial operation will be realized. Areas covered in this report are sale of gas to customers, arrangements for feedstock supply and by-product disposal, a schedule of major events leading to commercialization, and a plan for managing the implementation.

    Radioactive sources are used widely throughout the world in a variety of medical, industrial, research and military applications. When such radioactive sources are no longer used and are not intended to be used for the practice for which an authorization was granted, they are designated as 'disused sources'. Whether appropriate controls are in place during the useful life of a source or not, the end of this useful life is often a turning point after which it is more difficult to ensure the safety and security of the source over time. For various reasons, many disused sources cannot be returned to the manufacturer or the supplier for reuse or recycling. When these attempts fail, disused sources should be declared as radioactive waste and should be managed as such, in compliance with relevant international legal instruments and safety standards. However, disposal remains an unresolved issue in many counties, due to in part to limited public acceptance, insufficient funding, and a lack of practical examples of strategies for determining suitable disposal options. As a result, disused sources are often stored indefinitely at the facilities where they were once used. In order to prevent disused sources from becoming orphan sources, each country must develop and implement a comprehensive waste management strategy that includes disposal of disused sources. The International Atomic Energy Agency (IAEA) fosters international cooperation between countries and encourages the development of a harmonized 'cradle to grave' approach to managing sources consistent with international legal instruments, IAEA safety standards, and international good practices. This 'cradle to grave' approach requires the development of a national policy and implementing strategy, an adequate legal and regulatory framework, and adequate resources and infrastructure that cover the entire life cycle, from production and use of radioactive sources to disposal.     There has been some interest lately in the need for ``authenticated signalling``, and the development of signalling specifications by the ATM Forum that support this need. The purpose of this contribution is to show that if authenticated signalling is required, then supporting signalling facilities for directory services (i.e. key management) are also required. Furthermore, this contribution identifies other security related mechanisms that may also benefit from ATM-level signalling accommodations. For each of these mechanisms outlined here, an overview of the signalling issues and a rough cut at the required fields for supporting Information Elements are provided. Finally, since each of these security mechanisms are specified by a number of different standards, issues pertaining to the selection of a particular security mechanism at connection setup time (i.e. specification of a required ``Security Quality of Service``) are also discussed.
