    This Technical Support Document (TSD) describes the process and methodology for the development of the Advanced Energy Design Guide for K-12 School Buildings: Achieving 50% Energy Savings Toward a Net Zero Energy Building (AEDG-K12) (ASHRAE et al. 2011a). The AEDG-K12 provides recommendations for achieving 50% whole-building energy savings in K-12 schools over levels achieved by following ANSI/ASHRAE/IESNA Standard 90.1-2004, Energy Standard for Buildings Except Low-Rise Residential Buildings (Standard 90.1-2004) (ASHRAE 2004b). The AEDG-K12 was developed in collaboration with the American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE), the American Institute of Architects (AIA), the Illuminating Engineering Society of North America (IES), the U.S. Green Building Council (USGBC), and the U.S. Department of Energy (DOE).

    This fact sheet summarizes recommendations for designing elementary, middle, and high school buildings that will result in 50% less energy use than conventional new schools built to minimum code requirements. The recommendations are drawn from the Advanced Energy Design Guide for K-12 School Buildings, an ASHRAE publication that provides comprehensive recommendations for designing low-energy-use school buildings (see sidebar). Designed as a stand-alone document, this fact sheet provides key principles and a set of prescriptive design recommendations appropriate for smaller schools with insufficient budgets to fully implement best practices for integrated design and optimized performance. The recommendations have undergone a thorough analysis and review process through ASHRAE, and have been deemed the best combination of measures to achieve 50% savings in the greatest number of schools.

Instead, we emphasize actionable information, practical methodologies, diverse case studies, and unbiased evaluations of the most promising retrofit energy efficiency measures for each building type. A series of AERGs is under development, addressing key segments of the commercial building stock. K-12 schools were selected as one of the highest priority building sectors, because schools affect the lives of most Americans. They also represent approximately 8% of the energy use and 10% of the floor area in commercial buildings nationwide. U.S. K-12 school districts spend more than $8 billion each year on energy - more than they spend on computers and textbooks combined. Most occupy older buildings that often have poor operational performance - more than 30% of schools were built before 1960. The average age of a school is about 42 years - which is nearly the expected serviceable lifespan of the building. K-12 schools offer unique opportunities for deep, cost-effective energy efficiency improvements, and this guide provides convenient and practical guidance for exploiting these opportunities in the context of public, private, and parochial schools.

    This paper describes the development of energy efficiency recommendations for achieving 30% whole-building energy savings in K-12 Schools over levels achieved by following the ANSI/ASHRAE/IESNA Standard 90.1, Energy Standard for Buildings Except Low-Rise Residential Buildings (1999 and 2004 versions). Exhaustive simulations were run to create packages of energy design solutions available over a wide range of K-12 schools and climates. These design recommendations look at building envelope, fenestration, lighting systems (including electrical lights and daylighting), HVAC systems, building automation and controls, outside air treatment, and service water heating. We document and discuss the energy modeling performed to demonstrate that the recommendations will result in at least 30% energy savings over ASHRAE 90.1-1999 and ASHRAE 90.1-2004. Recommendations are evaluated based on the availability of daylighting for the school and by the type of HVAC system. Compared to the ASHRAE 90.1-1999 baseline, the recommendations result in more than 30% savings in all climate zones for both daylit and nondaylit elementary, middle, and high schools with a range of HVAC system types. These recommendations have been included in the Advanced Energy Design Guide for K-12 School Buildings. Compared to the more stringent ASHRAE 90.1-2004 baseline, the recommendations result in more than 30% savings in all climate zones, for only the daylit elementary, middle, and high schools, with a range of HVAC system types. To inform the future development of recommendations for higher level of energy savings, we analyzed a subset of recommendations to understand which energy efficiency technologies would be needed to achieve 50% energy savings.

    This report focuses on financial options developed specifically for renewable energy and energy efficiency projects in three California public school districts. Solar energy systems installed on public schools have a number of benefits that include utility bill savings, reductions in greenhouse gas emissions (GHGs) and other toxic air contaminants, job creation, demonstrating environmental leadership, and creating learning opportunities for students. In the 2011 economic environment, the ability to generate general-fund savings as a result of reducing utility bills has become a primary motivator for school districts trying to cut costs. To achieve meaningful savings, the size of the photovoltaic (PV) systems installed (both individually on any one school and collectively across a district) becomes much more important; larger systems are required to have a material impact on savings. Larger PV systems require a significant financial commitment and financing therefore becomes a critical element in the transaction. In simple terms, school districts can use two primary types of ownership models to obtain solar installations and cost savings across a school district. The PV installations can be financed and owned directly by the districts themselves. Alternatively, there are financing structures whereby another entity, such as a solar developer or its investors, actually own and operate the PV systems on behalf of the school district. This is commonly referred to as the 'third-party ownership model.' Both methods have advantages and disadvantages that should be weighed carefully.

    With the signing of President Bush's energy bill in August of 2005, the successful application of the new energy legislation may have more to do with educational standards required in our schools than applications of research and technology in the long-term. Looking inside the new legislation, the future of that legislation's success may not just hinge on investment in technology, but ensuring that our citizens, especially our youth, are prepared and better informed to be able to understand, react, and apply the economically and national security driven intent of the law. How can our citizens make sense of change if they lack the skills to be able to understand, not only the technology, but also the science that drives the change? President Bush's passage of the 1,724-page bill emphasizes conservation, clean energy research, and new and improved technology. The legislation also provides for economic incentives toward building more nuclear power plants. This paper will use four questions as a focal point to emphasize the need for both state and federal education departments to review their current standards and respond to deficiencies regarding learning about radioactivity, radiation, and nuclear science and technology. The questions are: 1. Will America accept new nuclear power development? 2. Will waste issues be resolved concerning high- and low-level radioactive waste management and disposal? 3. Will nuclear 'anything' be politically correct when it comes to your backyard? 4. Is our youth adequately educated and informed about radioactivity, radiation, and nuclear science and technology? This paper will use Pennsylvania as a case study to better understand the implications and importance of the educational standards in our school systems. This paper will also show how the deficiency found in Pennsylvania's academic standards, and in other states, has a significant impact on the ability to fulfill the legislation's intent of realizing energy independence and

    Advances in materials science are fundamental to technological developments and have broad societal impacs. For example, a cellular phone is composed of a polymer case, liquid crystal displays, LEDs, silicon chips, Ni-Cd batteries, resistors, capacitors, speakers, microphones all of which have required advances in materials science to be compacted into a phone which is typically smaller than a deck of cards. Like many technological developments, cellular phones have become a ubiquitous part of society, and yet most people know little about the materials science associated with their manufacture. The probable condition of constrained knowledge of materials science was the motivation for developing and offering a 20 hour fourday course called 'Living in a Materials World.' In addition, materials science provides a connection between our every day experiences and the work of scientists and engineers. The course was offered as part of a larger K-12 teacher professional development project and was a component of a week-long summer institute designed specifically for upper elementary and middle school teachers which included 20 hour content strands, and 12 hours of plenary sessions, planning, and collaborative sharing. The focus of the institute was on enhancing teacher content knowledge in STEM, their capacity for teaching using inquiry, their comfort and positive attitudes toward teaching STEM, their knowledge of how people learn, and strategies for integrating STEM throughout the curriculum. In addition to the summer institute the participating teachers were provided with a kit of about $300 worth of materials and equipment to use to implement the content they learned in their classrooms. As part of this professional development project the participants were required to design and implement 5 lesson plans with their students this fall and report on the results, as part of the continuing education course associated with the project.     Business, industry, parks, nature settings, government infrastructure, and people, can be invaluable resources for connecting STEM curriculum within context which results in conditions ideal for promoting purposeful learning of authentic STEM content. Thus, community-based STEM resources offer ideal context for teaching STEM content. A benefit of focusing teacher attention on these contextual, content aligned resources is that they are in every community; making place-based STEM education a possibility, regardless of the location of STEM teaching and learning. Further, associating STEM teaching and learning with local resources addresses workforce development and the STEM pipeline by exposing students to STEM careers and applications in their local communities. The desire to align STEM teaching and learning with local STEM related resources guided the design of our week-long integrated STEM K-12 teacher professional development (PD) program, i-STEM. We have completed four years of our i-STEM PD program and have made place-based STEM a major emphasis of our curriculum. This report focuses on the data collected in the fourth year of our program. Our week-long i-STEM PD served over 425 educators last summer (2013), providing them with in depth theme-based integrated STEM short courses which were limited to an average of 15 participants and whole group plenary sessions focused around placed based integrated STEM, inquiry, engineering design, standards and practices of Common Core and 21st Century skills. This state wide PD was distributed in five Idaho community colleges and took place over two weeks. The STEM short courses included topics on engineering for sustainability, using engineering to spark interest in STEM, municipal water systems, health, agriculture, food safety, mining, forestry, energy, and others.     This report focuses on the performance of the same 31 linear LED lamps operated in a typical troffer with a K12 prismatic lens. In general, luminaire efficacy is strongly dictated by lamp efficacy, but the optical system of the luminaire substantially reduces the differences between the luminous intensity distributions of the lamps. While the distributions in the luminaire are similar, the differences remain large enough that workplane illuminance uniformity may be reduced if linear LED lamps with a narrow distribution are used. At the same time, linear LED lamps with a narrower distribution result in slightly higher luminaire efficiency.

    With the support of the Department of Energy, the National Science Teachers Association and the National Oceanic and Atmospheric Administration, Imaginary Lines Inc. (dba Sally Ride Science) delivered a highly successful 2-day conference to 165 K-12 educators on climate change. The event took place on July 23rd and 24th, 2008 at the NOAA facility in Silver Spring, MD. The conference celebrated the 25th anniversary of Dr. Sally Rides first flight into space in 1983 and examined how our understanding of Earth has changed in those 25 years. One the first day of the conference, participants heard a keynote talk delivered by Dr. Sally Ride, followed by presentations by well-known climate change scientists: Dr. Richard Somerville, Dr. Inez Fung and Dr. Susan Solomon. These sessions were concurrently webcast and made available to educators who were unable to attend the conference. On the second day of the conference, participants attended breakout sessions where they performed climate change activities (e.g. Neato Albedo!, Greenhouse in a Bottle, Shell-Shocked) that they could take back to their classrooms. Additional break-out sessions on using remote sensing images to illustrate climate change effects on Earths surface and how to address the climate change debate, were also offered. During lunch, participants attended an Educator Street Fair and had the opportunity to interact with representatives from NOAA, NASA, the EPA, NEEF and the JASON project. A follow-up evaluation survey was administered to all conference attendees immediately following the conference to evaluate its effectiveness. The results of this survey were overwhelmingly positive. The conference materials: presentation Power Points, workshop handouts and activities were available for teachers to download after the conference from the Sally Ride Science website.     In a first-of-its-kind report tracking the use of solar energy at K-12 schools in the United States, The Solar Foundation has developed the most comprehensive understanding to date of how schools are using and financing solar energy and the potential for still more schools to benefit from the technology. According to the report, there are currently 3,752 K-12 schools with solar installations, meaning nearly 2.7 million students attend schools with solar energy systems. These PV systems have a combined capacity of 490 megawatts (MW), and generate roughly 642,000 megawatt-hours (MWh) of electricity each year, equivalent to $77.8 million worth of utility bills and enough clean, renewable energy to offset 50 million gallons of gasoline. Solar potential on schools remains largely untapped. Of the 125,000 K-12 schools in the country, up to 72,000 schools (60%) can "go solar" cost-effectively. Approximately 450 individual schools districts have the potential to save more than $1 million over 30 years by installing a solar PV system.

    This case study presents the lessons learned from incorporating energy efficiency in the rebuilding and renovating of New Orleans K-12 schools after Hurricanes Katrina and Rita. Hurricane Katrina was the largest natural disaster in the United States, striking the Gulf Coast on August 29, 2005, and flooding 80% of New Orleans; to make matters worse, the city was flooded again only three weeks later by the effects of Hurricane Rita. Many of the buildings, including schools, were heavily damaged. The devastation of schools in New Orleans from the hurricanes was exacerbated by many years of deferred school maintenance. This case study presents the lessons learned from incorporating energy efficiency in the rebuilding and renovating of New Orleans K-12 schools after Hurricanes Katrina and Rita. The experiences of four new schools-Langston Hughes Elementary School, Andrew H. Wilson Elementary School (which was 50% new construction and 50% major renovation), L.B. Landry High School, and Lake Area High School-and one major renovation, Joseph A. Craig Elementary School-are described to help other school districts and design teams with their in-progress and future school building projects in hot-humid climates. Before Hurricane Katrina, New Orleans had 128 public schools. As part of the recovery planning, New Orleans Public Schools underwent an assessment and planning process to determine how many schools were needed and in what locations. Following a series of public town hall meetings and a district-wide comprehensive facility assessment, a Master Plan was developed, which outlined the renovation or construction of 85 schools throughout the city, which are expected to be completed by 2017. New Orleans Public Schools expects to build or renovate approximately eight schools each year over a 10-year period to achieve 21st century schools district-wide. Reconstruction costs are estimated at nearly $2 billion.

    The original scope of work was to obtain and analyze existing and emerging data in four states: California, Florida, New York, and Wisconsin. The goal of this data collection was to deliver a baseline database or recommendations for such a database that could possibly contain window and daylighting features and energy performance characteristics of Kindergarten through 12th grade (K-12) school buildings (or those of classrooms when available). In particular, data analyses were performed based upon the California Commercial End-Use Survey (CEUS) databases to understand school energy use, features of window glazing, and availability of daylighting in California K-12 schools. The outcomes from this baseline task can be used to assist in establishing a database of school energy performance, assessing applications of existing technologies relevant to window and daylighting design, and identifying future R&D needs. These are in line with the overall project goals as outlined in the proposal. Through the review and analysis of this data, it is clear that there are many compounding factors impacting energy use in K-12 school buildings in the U.S., and that there are various challenges in understanding the impact of K-12 classroom energy use associated with design features of window glazing and skylight. First, the energy data in the existing CEUS databases has, at most, provided the aggregated electricity and/or gas usages for the building establishments that include other school facilities on top of the classroom spaces. Although the percentage of classroom floor area in schools is often available from the databases, there is no additional information that can be used to quantitatively segregate the EUI for classroom spaces. In order to quantify the EUI for classrooms, sub-metering of energy usage by classrooms must be obtained. Second, magnitudes of energy use for electricity lighting are not attainable from the existing databases, nor are the lighting levels contributed

    The combined effect of increased energy costs, advances in digital metering techniques, and regulatory pressures is stimulating utility interest in charging smaller customers the full cost of their burden on the electric system, by metering reactive power and billing for poor power factor. Oklahoma Gas and Electric Co. adopted the Q-meter method, made practical with the advent of magnetic-tape metering. Digital metering and new techniques now being developed will add more options for utilities interested in metering power factor. There are three commonly used methods of determining power factor, all of which require the use of the standard induction watthour meter, plus at least one other meter, to obtain a second value in the power triangle. In all cases, the third value, if required, is obtained by calculation.

    The Alliance to Save Energy has responded to interest in the Green Schools concept from the New England states of Maine, New Hampshire and Vermont. The Alliance conducted a train-the-trainers workshop in Augusta, Maine March 17--18, 1999. This work is part of a Green Schools replication project leveraged by funds from another source, NORDAX, which contributed $80,000 to provide partial support to staff at the Maine Energy Education Project (MEEP), Vermont Energy Education Program (VEEP), and New Hampshire Governor's Office to develop Green Schools Projects. DOE funds were used to conduct training, develop a network of state and local government, business and school partners to support school efficiency activities in those three states.

    Our research has been aimed at (i) identifying, (ii) determining mode of regulation, and (iii) understanding how different classes of compatible solutes (also termed osmolytes) affect macromolecular stability in response to osmotic and thermal stress. For solutes we have identified (e.g., di-inositol-1,1’-phosphate (DIP)), we used NMR to elucidate biosynthetic pathways and then cloned suspected enzymes in the pathway to explore how they are regulated. Compatible solutes are thought to protect proteins from thermal and osmotic stresses by being excluded from the surface, allowing critical water molecules to interact with the protein. This implies there are no specific binding interactions between osmolytes and proteins. However, we and others have often observed very specific solute effects for proteins that suggest a more direct interaction between solute and protein is likely can occur. Measuring such a weak interaction is extremely difficult. We have developed a solution NMR method, high-resolution field cycling relaxometry, that can measure spin-lattice relaxation rates as a function of magnetic field from 11.7 (the field of a 500 MHz spectrometer) to 0.003 T. The methodology is ideal for nuclei in small molecules with moderately long relaxation times at high fields – phosphate groups (31P), enriched carbonyls (13C), or methyl groups (1H). The protein of interest is spin-labeled to introduce a large dipole on it that will dominate the relaxation of nuclei on any small molecules that bind transiently. The key is to measure relaxation below 1-2 T (and extract nuclei-spin label distances in the bound complex) where the small molecule relaxation will be dominated by dipolar mechanisms with a correlation time indicative of the large protein complex. Our explorations of an inositol monophosphatase (the last step in DIP generation) localized four discrete binding sides for the thermoprotectant α-glutamate.     An apparatus and method are provided for mapping an area of interest using polar coordinates or Cartesian coordinates. The apparatus includes a range finder, an azimuth angle measuring device to provide a heading and an inclinometer to provide an angle of inclination of the range finder as it relates to primary reference points and points of interest. A computer is provided to receive signals from the range finder, inclinometer and azimuth angle measurer to record location data and calculate relative locations between one or more points of interest and one or more primary reference points. The method includes mapping of an area of interest to locate points of interest relative to one or more primary reference points and to store the information in the desired manner. The device may optionally also include an illuminator which can be utilized to paint the area of interest to indicate both points of interest and primary points of reference during and/or after data acquisition.

    The Chan, Karolyi, Longstaff and Sanders (CKLS) model is a popular one-factor model for describing the spot interest rates. In this paper, the four parameters in the CKLS model are regarded as stochastic. The parameter vector φ{sup (j)} of four parameters at the (J+n)-th time point is estimated by the j-th window which is defined as the set consisting of the observed interest rates at the j′-th time point where j≤j′≤j+n. To model the variation of φ{sup (j)}, we assume that φ{sup (j)} depends on φ{sup (j−m)}, φ{sup (j−m+1)},…, φ{sup (j−1)} and the interest rate r{sub j+n} at the (j+n)-th time point via a four-dimensional conditional distribution which is derived from a [4(m+1)+1]-dimensional power-normal distribution. Treating the (j+n)-th time point as the present time point, we find a prediction interval for the future value r{sub j+n+1} of the interest rate at the next time point when the value r{sub j+n} of the interest rate is given. From the above four-dimensional conditional distribution, we also find a prediction interval for the future interest rate r{sub j+n+d} at the next d-th (d≥2) time point. The prediction intervals based on the CKLS model with stochastic parameters are found to have better ability of covering the observed future interest rates when compared with those based on the model with fixed parameters.

    The National Environmental Policy Act (NEPA) requires that federal agencies prepare environmental impact statements (EISs) on proposals for major Federal action significantly affecting the quality of the human environment. The Council on Environmental Quality (CEQ) regulations require that EISs be prepared directly by the lead agency or a contractor it selects. EIS contractors must execute a disclosure statement specifying that they have ``no financial or other interest`` in the outcome of the project. The intent of the ``conflict of interest`` prohibition is to ensure that the EIS is defensible, free of self-serving bias, and credible to the public. Those coming to the federal government for money, permits, or project approvals must not be placed in the position of analyzing the environmental consequences of their own proposals. This paper analyzes the conflict of interest problem faced by government contractors who maintain and operate government-owned or-controlled facilities for which EISs are required. In the US Department of Energy (DOE) system, these are referred to as ``M and O`` contractors. It also examines organizational conflicts presented by current or prospective government contractors who have a financial or other interest in the outcome of a project or program for which an EIS is prepared. In responding to these and related questions, the paper discusses and interprets the CEQ regulations and guidance on EIS preparation conflict of interest as well as leading federal court opinions. It also distinguishes ``preparers`` from ``participants`` in the EIS preparation process.

    A system includes host and learning machines in electrical communication with sensors positioned with respect to an item of interest, e.g., a weld, and memory. The host executes instructions from memory to predict a binary quality status of the item. The learning machine receives signals from the sensor(s), identifies candidate features, and extracts features from the candidates that are more predictive of the binary quality status relative to other candidate features. The learning machine maps the extracted features to a dimensional space that includes most of the items from a passing binary class and excludes all or most of the items from a failing binary class. The host also compares the received signals for a subsequent item of interest to the dimensional space to thereby predict, in real time, the binary quality status of the subsequent item of interest.

    A system includes host and learning machines. Each machine has a processor in electrical communication with at least one sensor. Instructions for predicting a binary quality status of an item of interest during a repeatable process are recorded in memory. The binary quality status includes passing and failing binary classes. The learning machine receives signals from the at least one sensor and identifies candidate features. Features are extracted from the candidate features, each more predictive of the binary quality status. The extracted features are mapped to a dimensional space having a number of dimensions proportional to the number of extracted features. The dimensional space includes most of the passing class and excludes at least 90 percent of the failing class. Received signals are compared to the boundaries of the recorded dimensional space to predict, in real time, the binary quality status of a subsequent item of interest.

    A sudden increase in legal activity involving the preparation or review of deeds to oil and gas interests is the result of expanded exploration and development activities in Alabama. Because of the complexities of an oil or gas transaction and the presence of title defects, there are legal problems which are unique to these cases. The author highlights some of the more common problems and defects, and recommends ways for lawyers to avoid them. The discussion touches on the mineral deed versus the royalty deed, conflicts over the mineral acre versus the fractional grant, the rule against perpetuities, roadways, and other problems.

    As the United States dramatically expands wind energy deployment, the industry is challenged with developing a skilled workforce and addressing public resistance. Wind Powering America's Wind for Schools project addresses these issues by developing Wind Application Centers (WACs) at universities; WAC students assist in implementing school wind turbines and participate in wind courses, by installing small wind turbines at community "host" schools, by implementing teacher training with interactive curricula at each host school.     The Kepler mission has revolutionized our understanding of exoplanets, but some of the planet candidates identified by Kepler may actually be astrophysical false positives or planets whose transit depths are diluted by the presence of another star. Adaptive optics images made with ARIES at the MMT of 87 Kepler Objects of Interest place limits on the presence of fainter stars in or near the Kepler aperture. We detected visual companions within 1'' for 5 stars, between 1'' and 2'' for 7 stars, and between 2'' and 4'' for 15 stars. For those systems, we estimate the brightness of companion stars in the Kepler bandpass and provide approximate corrections to the radii of associated planet candidates due to the extra light in the aperture. For all stars observed, we report detection limits on the presence of nearby stars. ARIES is typically sensitive to stars approximately 5.3 Ks magnitudes fainter than the target star within 1'' and approximately 5.7 Ks magnitudes fainter within 2'', but can detect stars as faint as ΔKs = 7.5 under ideal conditions.

    The Idaho National Engineering and Environmental Laboratory (INEEL) is dedicated to finding solutions to problems related to the environment, energy, economic competitiveness, and national security. In an effort to attract and retain the expertise needed to accomplish these challenges, the INEEL is developing a program of broad educational opportunities that makes continuing education readily available to all laboratory employees, beginning in the K–12 environment and progressing through post-graduate education and beyond. One of the most innovative educational approaches being implemented at the laboratory is the application of STELLA© dynamic learning environments, which facilitate captivating K–12 introductions to the complex energy and environmental challenges faced by global societies. These simulations are integrated into lesson plans developed by teachers in collaboration with INEEL scientists and engineers. This approach results in an enjoyable and involved learning experience, and an especially positive introduction to the application of science to emerging problems of great social and environmental consequence.

    The North Carolina Mathematics and Science Education Network, a state-wide effort funded through an act of the state legislature, links ten universities with local teachers and students in order to improve content knowledge, pedagogy, and instructional technology. The Network Centers assess the needs of K-12 teachers in their service regions and design relevant short term and long term programs to address these needs. A major advantage of locating these Centers at our state universities is the availability of university faculty as consultants and instructors. Through the coordinated efforts of the Centers at the state level, national funding has been obtained for several major curriculum projects. Statewide network initiatives include TEACH-STAT, a professional development program for elementary teachers focusing on data analysis and statistics in elementary mathematics education, and FIRST (Fund for the Improvement and Reform of Schools and Teaching), a project to improve elementary science and mathematics instruction through peer teacher training. Short courses planned for the UNCW region include animal development, computerized data acquisition, paleontology and mineralogy, DNA biotechnology, and multimedia instruction.

    In the three years since the Supreme Court decided in United States v. Swank that a coal operator mining a coal deposit under a written lease terminable without cause on 30 days notice held an economic interest in the mineral in place, tax literature began noting that this decision rejected a long-held position of the Internal Revenue Service (IRS). The author assesses the impact of Revenue Ruling 83-88, in which the IRS went beyond Swank in concluding that there is no minimum period during which a lessee must have a legal right to extract minerals as a prerequisite to an economic interest. He examines the proposition that, after Swank and Revenue Ruling 83-160, licensees who previously were considered not to have acquired an economic interest, should now be found to have an economic interest in the mineral deposit they are extracting.

  6. Special Report on "Allegations of Conflict of Interest Regarding Licensing of PROTECT by Argonne National Laboratory"

    In February 2009, the Office of Inspector General received a letter from Congressman Mark Steven Kirk of Illinois, which included constituent allegations that an exclusive technology licensing agreement by Argonne National Laboratory was tainted by inadequate competition, conflicts of interest, and other improprieties. The technology in question was for the Program for Response Options and Technology Enhancements for Chemical/Biological Terrorism, commonly referred to as PROTECT. Because of the importance of the Department of Energy's technology transfer program, especially as implementation of the American Recovery and Reinvestment Act matures, we reviewed selected aspects of the licensing process for PROTECT to determine whether the allegations had merit. In summary, under the facts developed during our review, it was understandable that interested parties concluded that there was a conflict of interest in this matter and that Argonne may have provided the successful licensee with an unfair advantage. In part, this was consistent with aspects of the complaint from Congressman Kirk's constituent.

    This article presents the results of the first large-scale mail survey of non-residential green power customers in the United States. The survey explored the motivations, attitudes, and experiences of 464 business, non-profit, and public-sector customers that have voluntarily opted to purchase - and frequently pay a premium for - renewable electricity. Results of this study should be of value to marketers interested in targeting these customer segments, to policy makers interested in fostering and understanding non-residential demand for green power, and to academics pondering the motivations for firms to engage in such voluntary environmental initiatives.

    We analyze the deviations of transit times from a linear ephemeris for the Kepler Objects of Interest (KOI) through Quarter six (Q6) of science data. We conduct two statistical tests for all KOIs and a related statistical test for all pairs of KOIs in multi-transiting systems. These tests identify several systems which show potentially interesting transit timing variations (TTVs). Strong TTV systems have been valuable for the confirmation of planets and their mass measurements. Many of the systems identified in this study should prove fruitful for detailed TTV studies.

    This report was prepared in response to the guidance provided by the Congress in the course of the Fiscal Year 1995 appropriations process for the Department of Energy`s (DOE) Office of Fossil Energy (FE). As described in detail below, DOE was directed to make the international dissemination of Clean Coal Technologies (CCTs) an integral part of its policy to reduce greenhouse gas emissions in developing countries. Congress directed DOE to solicit ``Statements of Interest`` in commercial projects employing CCTs in countries projected to have significant growth in greenhouse gas emissions. Additionally, DOE was asked to submit to the Congress a report that analyzes the information contained in the Statements of Interest, and that identifies the extent to which various types of Federal incentives would accelerate the commercial availability of these technologies in an international context. In response to DOE`s solicitation of 18 November 1994, 77 Statements of Interest were received from 33 companies, as well as five additional materials. The contents of these submittals, including the requested Federal incentives, the CCTs proposed, the possible host countries, and the environmental aspects of the Statements of Interest, are described and analyzed in the chapters that follow.

    We study the behavior of U.S. markets both before and after U.S. Federal Open Market Commission meetings and show that the announcement of a U.S. Federal Reserve rate change causes a financial shock, where the dynamics after the announcement is described by an analog of the Omori earthquake law. We quantify the rate n(t) of aftershocks following an interest-rate change at time T and find power-law decay which scales as n(t-T)approx(t-T){sup -O}MEGA, with OMEGA positive. Surprisingly, we find that the same law describes the rate n{sup '}(|t-T|) of 'preshocks' before the interest-rate change at time T. This study quantitatively relates the size of the market response to the news which caused the shock and uncovers the presence of quantifiable preshocks. We demonstrate that the news associated with interest-rate change is responsible for causing both the anticipation before the announcement and the surprise after the announcement. We estimate the magnitude of financial news using the relative difference between the U.S. Treasury Bill and the Federal Funds effective rate. Our results are consistent with the 'sign effect', in which 'bad news' has a larger impact than 'good news'. Furthermore, we observe significant volatility aftershocks, confirming a 'market under-reaction' that lasts at least one trading day.

    We outline an approach yielding proper motions with higher precision than exists in present catalogs for a sample of stars in the Kepler field. To increase proper-motion precision, we combine first-moment centroids of Kepler pixel data from a single season with existing catalog positions and proper motions. We use this astrometry to produce improved reduced-proper-motion diagrams, analogous to a Hertzsprung-Russell (H-R) diagram, for stars identified as Kepler objects of interest. The more precise the relative proper motions, the better the discrimination between stellar luminosity classes. Using UCAC4 and PPMXL epoch 2000 positions (and proper motions from those catalogs as quasi-Bayesian priors), astrometry for a single test Channel (21) and Season (0) spanning 2 yr yields proper motions with an average per-coordinate proper-motion error of 1.0 mas yr{sup –1}, which is over a factor of three better than existing catalogs. We apply a mapping between a reduced-proper-motion diagram and an H-R diagram, both constructed using Hubble Space Telescope parallaxes and proper motions, to estimate Kepler object of interest K-band absolute magnitudes. The techniques discussed apply to any future small-field astrometry as well as to the rest of the Kepler field.

    A method for positioning a first device utilizing a surface having a viewing translation stage, the surface being movable between a first position where the viewing stage is in operational alignment with a first device and a second position where the viewing stage is in operational alignment with a second device. The movable surface is placed in the first position and an image is produced with the first device of an identifiable characteristic of a calibration object on the viewing stage. The moveable surface is then placed in the second position and only the second device is moved until an image of the identifiable characteristic in the second device matches the image from the first device. The calibration object is then replaced on the stage of the surface with a test object, and the viewing translation stage is adjusted until the second device images the area of interest. The surface is then moved to the first position where the test object is scanned with the first device to image the area of interest. An alternative embodiment where the devices move is also disclosed.

    There has been much interest in the past in understanding the dynamic properties of phase changing materials. In this paper we begin to explore the dynamic properties of the complex material of cerium. Cerium metal is a good candidate material to explore capabilities in determining a dynamic phase diagram on account of its low dynamic phase boundaries, namely, the {gamma}-{alpha}, and {alpha}-liquid phase boundaries. Here we present a combination of experimental results with calculated results to try to understand the dynamic behavior of the material. Using the front surface impact technique, we performed a series of experiments which displayed a rarefaction shock upon release. These experiments show that the reversion shock stresses occur at different magnitudes, allowing us to plot out the {gamma}-{alpha} phase boundary. Applying a multiphase equation of state a broader understanding of the experimental results will be discussed.

    The sustainability of future bioenergy production rests on more than continual improvements in its environmental, economic, and social impacts. The emergence of new biomass feedstocks, an expanding array of conversion pathways, and expected increases in overall bioenergy production are connecting diverse technical, social, and policy communities. These stakeholder groups have different and potentially conflicting values and cultures, and therefore different goals and decision making processes. Our aim is to discuss the implications of this diversity for bioenergy researchers. The paper begins with a discussion of bioenergy stakeholder groups and their varied interests, and illustrates how this diversity complicates efforts to define and promote sustainable bioenergy production. We then discuss what this diversity means for research practice. Researchers, we note, should be aware of stakeholder values, information needs, and the factors affecting stakeholder decision making if the knowledge they generate is to reach its widest potential use. We point out how stakeholder participation in research can increase the relevance of its products, and argue that stakeholder values should inform research questions and the choice of analytical assumptions. Finally, we make the case that additional natural science and technical research alone will not advance sustainable bioenergy production, and that important research gaps relate to understanding stakeholder decision making and the need, from a broader social science perspective, to develop processes to identify and accommodate different value systems. While sustainability requires more than improved scientific and technical understanding, the need to understand stakeholder values and manage diversity presents important research opportunities.

    Wood cribs have been the dominant form of supplemental support in coal mining for many years. Recently, there has been a renewed interest in prop supports as a replacement for wood cribbing due to the increasing cost of mine timber and engineering advancements in prop design to improve their stability and yield capability. Prop supports generally consume less material, can be installed in less time with less labor, and provide less restriction to mine ventilation than wood crib supports. Several prop supports are now available or under development. These include: (1) Strata Products Propsetter{trademark} Support System, (2) Heintzmann ACS and Super Prop; (3) MBK-Hydraulik MEGA prop; (4) Advanced Mining Technology Inc. (AMTI) BTS Mortar prop; (5) Dywidag Coal Post; (6) Western Support Systems YIPPI support; and (7) ``The Can`` support by Burrell Mining Products. A comparison of the performance and cost of these support systems to wood cribs is made to provide mine operators with information needed to underground installations are discussed. Included in this assessment are full scale tests of these supports conducted in the US Bureau of Mines` Mine Roof Stimulator.

  6. Detection of stars within ?0.8 in of Kepler objects of interest

    We present an algorithm to search for the faint spectrum of a second star mixed with the spectrum of a brighter star in high resolution spectra. We model optical stellar spectra as the sum of two input spectra drawn from a vast library of stars throughout the H-R diagram. From typical spectra having a resolution of R = 60,000, we are able to detect companions as faint as 1% relative to the primary star in approximately the V and R bandpasses of photometry. We are also able to find evidence for triple and quadruple systems, given that any additional companions are sufficiently bright. The precise threshold percentage depends on the signal-to-noise of the spectrum and the properties of the two stars. For cases of non-detection, we place a limit on the brightness of any potential companions. This algorithm is useful for detecting faint orbiting companions and background stars that are angularly close to a foreground target star. The size of the entrance slit to the spectrometer, 0.87 3 arcsec (typically), sets the angular domain within which the second star can be detected. We analyzed Keck-HIRES spectra of 1160 California Kepler Survey objects of interest (KOI) searching for the secondary spectra, with the two goals of alerting the community to two possible host stars of the transiting planet and to dilution of the light curve. We report 63 California KOI showing spectroscopic evidence of a secondary star.

    Purpose: Cone beam breast computed tomography (breast CT) with true three-dimensional, nearly isotropic spatial resolution has been developed and investigated over the past decade to overcome the problem of lesions overlapping with breast anatomical structures on two-dimensional mammographic images. However, the ability of breast CT to detect small objects, such as tissue structure edges and small calcifications, is limited. To resolve this problem, the authors proposed and developed a volume-of-interest (VOI) breast CT technique to image a small VOI using a higher radiation dose to improve that region’s visibility. In this study, the authors performed Monte Carlo simulations to estimate average breast dose and average glandular dose (AGD) for the VOI breast CT technique. Methods: Electron–Gamma-Shower system code-based Monte Carlo codes were used to simulate breast CT. The Monte Carlo codes estimated were validated using physical measurements of air kerma ratios and point doses in phantoms with an ion chamber and optically stimulated luminescence dosimeters. The validated full cone x-ray source was then collimated to simulate half cone beam x-rays to image digital pendant-geometry, hemi-ellipsoidal, homogeneous breast phantoms and to estimate breast doses with full field scans. 13-cm in diameter, 10-cm long hemi-ellipsoidal homogeneous phantoms were used to simulate median breasts. Breast compositions of 25% and 50% volumetric glandular fractions (VGFs) were used to investigate the influence on breast dose. The simulated half cone beam x-rays were then collimated to a narrow x-ray beam with an area of 2.5 × 2.5 cm{sup 2} field of view at the isocenter plane and to perform VOI field scans. The Monte Carlo results for the full field scans and the VOI field scans were then used to estimate the AGD for the VOI breast CT technique. Results: The ratios of air kerma ratios and dose measurement results from the Monte Carlo simulation to those from the physical

    The Preston Geothermal prospect is located in northern Cache Valley approximately 8 kilometers north of the city of Preston, in southeast Idaho. The Cache Valley is a structural graben of the northern portion of the Basin and Range Province, just south of the border with the Eastern Snake River Plain (ESRP). This is a known geothermal resource area (KGRA) that was evaluated in the 1970's by the State of Idaho Department of Water Resources (IDWR) and by exploratory wells drilled by Sunedco Energy Development. The resource is poorly defined but current interpretations suggest that it is associated with the Cache Valley structural graben. Thermal waters moving upward along steeply dipping northwest trending basin and range faults emanate in numerous hot springs in the area. Springs reach temperatures as hot as 84 C. Traditional geothermometry models estimated reservoir temperatures of approximately 125 C in the 1970s study. In January of 2014, interest was renewed in the areas when a water well drilled to 79 m (260 ft) yielded a bottom hole temperature of 104 C (217 F). The well was sampled in June of 2014 to investigate the chemical composition of the water for modeling geothermometry reservoir temperature. Traditional magnesium corrected Na-K-Ca geothermometry estimates this new well to be tapping water from a thermal reservoir of 227 C (440 F). Even without the application of improved predictive methods, the results indicate much higher temperatures present at much shallower depths than previously thought. This new data provides strong support for further investigation and sampling of wells and springs in the Northern Cache Valley, proposed for the summer of 2015. The results of the water will be analyzed utilizing a new multicomponent equilibrium geothermometry (MEG) tool called Reservoir Temperature Estimate (RTEst) to obtain an improved estimate of the reservoir temperature.     Purpose: A novel method has been developed for volume of interest (VOI) cone-beam CT (CBCT) imaging using a 2.35 MV/Carbon target linac imaging beam line combined with dynamic multileaf collimator sequences. Methods: The authors demonstrate the concept of acquisition of multiple, separate imaging volumes, where volumes can be either completely separated or nested, and are associated with predetermined imaging dose and contrast-to-noise ratio (CNR) characteristics. Two individual MLC sequences were established in the planning system (Eclipse, Varian Medical) to collimate the beam according to a defined inner VOI (e.g., containing a target volume under image guidance) and an outer VOI (e.g., including surrounding landmarks or organs-at-risk). MLC sequences were interleaved as a function of gantry angle to produce a reconstructed CBCT image with nested VOIs. By controlling the ratio of inner-to-outer ratio of MLC segments (and thus Monitor Units) during acquisition, the relative dose and CNR in the two volumes can be controlled. Inner-to-outer ratios of 2:1 to 6:1 were examined. Results: The concept was explored using an anatomical head phantom to assess image quality. A geometric phantom was used to quantify absolute dose and CNR values for the various sequences. The authors found that the dose in the outer VOI decreased by a functional relationship dependent on the inner-to-outer sequence ratio, while the CNR varied by the square root of dose, as expected. Conclusions: In this study the authors demonstrate flexibility in VOI CBCT by tailoring the imaging dose and CNR distribution in separate volumes within the patient anatomy. This would allow for high quality imaging of a target volume for alignment purposes, with simultaneous low dose imaging of the surrounding anatomy (e.g., for coregistration)

    The IRIS (International Reactor Innovative and Secure) reactor design is being developed by an international consortium of 21 organizations from ten countries, including three members from Brazil and one from Mexico. This reflects the interest that Latin America has for a project which addresses the energy needs of the region. Presented here are some of the most recent developments in the IRIS project. The project's highest priority is the current pre-application licensing with the US NRC, which has required an investigation of the major accident sequences and a preliminary probabilistic risk assessment (PRA). The results of the accident analyses confirmed the outstanding inherent safety of the IRIS configuration and the PRA analyses indicated a core damage frequency due to internal events of the order of 2E-8. This not only highlights the enhanced safety characteristic of IRIS which should enhance its public acceptance, but it has also prompted IRIS to consider the possibility of being licensed without the need for off-site emergency response planning which would have a very positive economic implication. The modular IRIS, with each module rated at {approx} 335 MWe, is of course an ideal size for developing countries as it allows to easily introduce a moderate amount of power on limited electric grids. IRIS can be deployed in single modules in regions only requiring a few hundred MWs or in multiple modules deployed successively at time intervals in large urban areas requiring a larger amount of power increasing with time. IRIS is designed to operate ''hands-off'' as much as possible, with a small crew, having in mind deployment in areas with limited infrastructure. Thus IRIS has a 48-months maintenance interval, long refueling cycles in excess of three years, and is designed to increase as much as possible operational reliability.     We report on intriguing photometric properties of Galactic stars observed in the Galaxy Evolution Explorer (GALEX) satellite's far-UV (FUV) and near-UV (NUV) bandpasses, as well as from the ground-based Sloan Digital Sky Survey (SDSS) and the Kepler Input Catalog. The first property is that the (FUV NUV) color distribution of stars in the Kepler field consists of two well-separated peaks. A second and more perplexing property is that for stars with spectral types G or later the mean (FUV NUV) color becomes much bluer, contrary to expectation. Investigating this tendency further, we found in two samples of mid-F through K type stars that 17%-22% of them exhibit FUV excesses relative to their NUV fluxes and spectral types. A correction for FUV incompleteness of the FUV magnitude-limited star sample brings this ratio to 14%-18%. Nearly the same fractions are also discovered among members of the Kepler Eclipsing Binary Catalog and in the published list of Kepler Objects of Interest. These UV-excess ('UVe') colors are confirmed by the negative UV continuum slopes in GALEX spectra of members of the population. The SDSS spectra of some UVe stars exhibit metallic line weakening, especially in the blue. This suggests an enhanced contribution of UV flux relative to photospheric flux of a solar-type single star. We consider the possibility that the UV excesses originate from various types of hot stars, including white dwarf DA and sdB stars, binaries, and strong chromosphere stars that are young or in active binaries. The space density of compact stars is too low to explain the observed frequency of the UVe stars. Our model atmosphere-derived simulations of colors for binaries with main-sequence pairs with a hot secondary demonstrate that the color loci conflict with the observed sequence. As a preferred alternative we are left with the active chromospheres explanation, whether in active close binaries or young single stars, despite the expected paucity of young
