Four areas in Texas have been designated by the U.S. Environmental Protection Agency (EPA) as non-attainment areas because ozone levels exceed the National Ambient Air Quality Standards (NAAQS) maximum allowable limits: Beaumont-Port Arthur, El Paso, Dallas-Ft. Worth, and Houston-Galveston-Brazoria. The El Paso area also violates the NAAQS maximum allowable limits for carbon monoxide and respirable particulate matter. These areas face severe sanctions, such as loss of access to federal transportation funds, if attainment is not reached by 2007. Four additional areas in the state are also approaching national ozone limits, including: Austin, Corpus Christi, San Antonio, and the Longview-Tyler-Marshall area. Ozone is formed when oxides of nitrogen (NOx), volatile organic compounds (VOCs), and oxygen (O2) combine in the presence of strong sunlight. In response to this effort the Texas Natural Resource Conservation Commission (TNRCC) developed a strategy with the EPA that reduced VOCs from large regulated, stationary point sources by over 50 percent during the 1990 to 1996 period. Although this first strategy was very successful, levels of ozone failed to meet the national standards, and a second strategy had to be developed to achieve compliance with the ozone standard. In 2001, the Texas State Senate passed Senate Bill 5 (SB 5) to further reduce ozone levels by encouraging the reduction of emissions of NOx by sources that are currently not regulated by the TNRCC, including area sources (e.g., residential emissions), on-road mobile sources (e.g., all types of motor vehicles), and non-road mobile sources (e.g., aircraft, locomotives, etc.). This paper outlines the legislation, and responsibilities of the different government entities and the important role that private industry is being encouraged to play.

of Senate Amendment 2028, the Climate Stewardship Act of 2003 of Senate Amendment 2028, the Climate Stewardship Act of 2003 Energy Information Administration May 2004 Introduction In June 2003, the Energy Information Administration (EIA) released an analysis 1 of the Climate Stewardship Act of 2003 (S.139) as introduced by Senators McCain and Lieberman in January 2003. S.139 would establish a cap on emissions of greenhouse gases 2 from covered sources that would be implemented in two phases beginning in 2010 and 2016 respectively. More recently, in October 2003, Senators McCain and Lieberman proposed an amended version of the bill, SA.2028, that included the first phase of emissions reductions beginning in 2010 but removed references to a second phase of reductions beginning in 2016. On May 11, 2004, Senator Landrieu asked EIA to evaluate SA.2028. This paper responds to that

The testimony concerns the observed global warming that has occurred over the past 100 years. How this temperature record was obtained is summarized and the details of the record described, with particular reference to the most recent decades and to the differences between the records for Northern and Southern Hemispheres. The record is compared with the predicted warming over the same period due to the effects of increasing greenhouse gas concentrations in the atmosphere. Of immense importance to the coal industry is the announcement, on 7 June 2006 by US Senators Barack Obama (D-IL) and Jim Bunning (R-KY) of S.3325, the 'Coal-to-Liquid Fund Promotion Act of 2006'. This legislation creates tax incentives for coal-to-liquids (CTL) technologies and construction of CTL plants. If passed, this will create the infrastructure needed to make CTL a viable energy resource throughout America. The article gives comment and background to this proposed legislation. Illinois Basin coal is well suited for CTL because of its high Btu content. If Sasol constructs a proposed plant in Illinois it would increase coal production in the state by 10 mt. 1 fig.

No further action was recommended on site 13 and quarterly sampling was recommended for site 12. South Dakota Regulators have agreed to both recommendations. Decision documents will be prepared for each site.

This hearing was to investigate the problems associated with the storage and transportation of liquefied energy gases, both liquefied petroleum gas, LPG, and liquefied natural gas, LNG. LPG, consisting mainly of propane is especially important in northern New England to heat homes and commercial establishments. Much of New England's LPG is supplied through the Newington, NH, facility near Portsmouth, by truck and railroad deliveries directly to customers. A training film was shown by the National Fire Protection Association, demonstrating the potential hazard of one of the energy gases, LPG. Monte Canfield, Jr., Director, Energy and Minerals Division on Liquefied Energy Gases gave recommendations: for evaluating storage facilities; to enact legislation for proper safeguards. Other witnesses included Captain Lynn Hein, US Coast Guard Marine Safety Office; Senator Edward Kennedy; Representative Edward Markey; John McKenna, vice president, gas planning and supply, Boston Gas Company; George Paul, fire commissioner, Boston Fire Department; Jim Splaine, assistant mayor, Portsmouth, NH; and Christine Sullivan, secretary of consumer affairs, Energy Facilities Siting Council. Texas Senate Bill 5 Legislation for Reducing Pollution in Non-Attainment and Affected Areas: An Overview of Legislative Responsibilities, Code Compliance Issues and Accomplishments

The 77th Texas Legislature, in 2001, established Senate Bill 5, SB-5, which addressed NOx emission reductions by establishing programs to reduce vehicle emissions and reductions due to energy efficiency and the use of renewable energy sources. The 78th Texas Legislature further expanded SB-5 into code certification for code officials and above code programs. Using data available from the Texas Commission on Environmental Quality, TCEQ, the EPA and new procedures developed by the Laboratory, the annual energy savings calculated in 2003 from energy-code compliant new residential construction in non-attainment and affected counties were 252,238 megawatt hours of electricity and 887,564 million Btu of natural gas. The resultant annual NOx reductions were 473 tons. On a peak summer day in 2003, the NOx emissions were 2.44 tons. SB-5 recognized Energy Efficiency / Renewable Energy, EE/RE, as a valid method to reduce emissions. The Energy Systems Laboratory was made responsible for achieving the following goals. 1. Quantify the NOx reductions from EE/RE by county. 2. Assist cities and counties determine the impact of code amendments that they planned to adopt. 3. Conduct training on the IRC / IECC, including ASHRAE 90.1. 4. Set up a certification program for code officials. 5. Assist cities and counties to achieve above code performance. 6. Translate the EE/RE savings into EPA acceptable emissions reductions which can be applied to the State Implementation Plan, SIP.

The hearings were conducted to focus on the effect of DOE's gasoline allocation and pricing regulations on independent gasoline marketers. Congressional concern for the health of the independent sector of the petroleum industry and the desire of the Congress to establish effective mechanisms to address the problems facing these businessmen predate the Arab oil embargo. Three main areas are addressed: (1) the sheet volume and complexity of the regulations; (2) the downward certification rule that DOE planned to put into effect on October 1, 1979 and the effect of that rule on the competitive viability of independent retailers, jobbers, and terminal operators, as well as its effect on the regional supply problems; and (3) the 15.4-cent price rule which went into effect in July 1979 for independent retailers only. Texas' Senate Bill 5 Legislation for Reducing Pollution in Non-Attainment and Affected Areas: Procedures for Measuring Electricity Savings from the Adoption of the International Energy Conservation Code (IRC/IECC 2001) in New Residences

Four areas in Texas have been designated by the EPA as non-attainment areas because ozone levels exceed the NAAQS maximum allowable limits, Beaumont-Port Arthur, El Paso, Dallas-Ft. Worth, and Houston-Galveston-Brazoria. These areas face severe sanctions if attainment is not reached by 2007. Four additional areas in the state are also approaching national ozone limits (i.e., affected areas), including: Austin, Corpus Christi, San Antonio, and the Longview-Tyler-Marshall area. In 2001, the Texas State Legislature formulated and passed Senate Bill 5 to further reduce ozone levels by encouraging the reduction of emissions of NOx by sources that are currently not regulated by the TNRCC, including area sources (e.g., residential emissions), on-road mobile sources (e.g., all types of motor vehicles), and non-road mobile sources (e.g., aircraft, locomotives, etc.). An important part of this legislation is the evaluation of the State's energy efficiency programs, which includes reductions in energy use and demand that are associated with specific energy conservation measures. This paper outlines the procedures that are being developed to report the electricity savings associated with the adoption of the International Energy Conservation Code (IECC 2001) in residential construction in non-attainment and affected counties. These electricity savings will then be converted to NOx reductions using the appropriate

The advantages of hydrogen in transportation systems, in fuel cells for electric vehicles and power plants, and in energy storage from off-peak electricity production were described. The largest barrier to using hydrogen in the transportation sector is the on-board storage of enough fuel to provide an adequate driving range in an urban environment. Production methods and costs were also discussed. The authors believe a coordinated demonstration program with US industry is needed to develop the best technologies for hydrogen-fueled vehicles.

Dispatchers would use current pricing models to calibrate the costs of various plants, so that cheaper units equal cleaner units. Working within current rules avoids the complexity of EPA regulation and the disruption of enacting new dispatch rules. It offers a more comprehensive solution than state-by-state permit proceedings. Hearings on Public Works appropriations for fiscal year 1978 were conducted. On February 21, 1977, statements were heard from representatives of the Army Corps of Engineers in support of funds requested for water resources development projects in the Lower Mississippi Valley. On that same date, representatives from the North Central Division of the Corps of Engineers spoke in behalf of their request for funds for 1978. The area covers the north central U.S., from Montana to the St. Lawrence River, and from Canada to within 50 miles of St. Louis. On February 23, 1977, statements were heard from representatives of the South Pacific Division. This area encompasses the states of California, Nevada, Utah, Arizona, and portions of the five adjoining states. The Pacific Ocean Division representatives appeared on that same date before the Senate subcommittee. That area extends over the Pacific Ocean from Hawaii to territories of American Samoa and Guam and the Division is responsible for certain regulatory functions in the navigable waters of the Trust Territory of the Pacific Islands. On February 24, 1977, the subcommittee of the Committee on Appropriations heard representatives of the Southwestern Division covering portions of 8 states. Also on that date, representatives of the Missouri River Division (Nebraska and parts of 9 other states) presented statements concerning the operation of that system in order to justify that request for funds. The gasoline-allocation program was a failure in 1979 and may have actually contributed to gasoline lines. It failed to address adequately the competitive concerns of the oil industry, particularly with respect to retail-gasoline dealers. DOE failed to coordinate its efforts with State and local authorities, and failed to prevent fraud and abuse within the program. The federal government failed to reassure the public during a period of uncertainty. Two major causes for the failure were a lack of departmental planning and preparedness before 1979 and inherent flaws in the structure of the program. The key flaws were the use of an historical base period and, perhaps, an overly broad congressional mandate which required the program to address conflicting priorities. DOE is only slightly more prepared for an oil-supply disruption now than before 1979. The report recommends developing sound contingency plans for a supply disruption, increasing the levels of priority and attention given such plans, and revamping the structure and procedures of the exceptions process. 232 references.

The Design Team continues to conference this quarter albeit not as often. Primary focus this quarter is the continued procurement of material, receiving, and construction/installation. Phase 1 extension recommendation, and subsequent new project estimate. Forms 424 and 4600 were submitted to Ms. Zysk. The NETL technology team subsequently agreed that the increase is justified and made their recommendation to DOE HQ. All major mechanical equipment was delivered this quarter. Three hot water in-bed coils are all that remains for delivery. Two of the five are installed above the dryer air distribution bed. The dryer, baghouse, bucket elevator, control room, exhaust fan, process ductwork, and piping have all been installed. The mezzanine level over the inlet ductwork for access to the dryer was installed. Instrumentation was delivered and locations were identified. Cable is being pulled and connections made from the Control Room to the Motor Control Center. ''Emergency Stop'' equipment logic conditions were discussed and finalized. The functional description was competed and reviewed with Honeywell Controls. Piping & Instrument diagrams are completed. Some electrical schematics have been delivered for equipment south of Q-line. Dry & Wet coal conveyors are not completed. The exhaust chimney was installed. An Open House and ribbon cutting took place on August 9th. GRE project manager gave a presentation of the technology. Joe Strakey, NETL, also spoke. The Open House was attended by Governor Hoevon and Senator Conrad who also spoke about Clean Coal and helped kick-off Blue Flint ethanol and a potential Liquefaction plant. The deign team met the following day to discuss test plan and progress update. Headwaters Energy Incorporated also attended the Open House. A meeting was conducted with them to begin planning for the marketing and finalize our memorandum of understanding. Headwaters still plans to contact all US lignite plants and all bituminous plants who have switched to PRB. Major pieces of equipment received this quarter included the Dryer, Exhaust Fan, additional duct work, and control cabinets.

The plant produces 142 billion standard cubic feet of synthetic natural gas per day from lignite coal plus several byproducts which are marketed. The hearing examines the bids of the finalists, the composition of the trust funds, the status of the siting permits, questions of air quality, employee retirement funds and employee benefits, and the ability of the successful bidder to pursue byproduct development and marketing.
