To ensure participation of major U.S. oil companies, legislation provides a statutory defense against any civil or criminal suit brought under federal or state antitrust laws for some actions. This report describes efforts to expand the antitrust and breach of contract defenses for oil company supply transactions during an oil emergency and to resolve the problem of foreign blockage of information critical to U.S. antitrust review of oil transactions involving foreign affiliates of U.S. companies.

The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

The author addresses the following questions in his presentation: what is USAID; where does the money go and who makes the decisions; where does USAID fund energy programs, and especially renewable energy; who are their `partners`; what is the approach to renewable energy; what in summary, has USAID funded that is relevant to village power. USAID is the foreign aid agency of the US Government. Approximately 75 countries receive regular assistance. The fiscal year 97 budget for the agency is approximately $5.8 billion. About half of the total budget goes to Israel, Egypt, and the countries of the former Soviet Union. These budgeting decisions are geopolitical. Congress earmarks total budgets for a few sectors or subjects, such as family planning. The goal of USAID`s renewable energy programs is simple: They are interested in accelerating the market penetration of commercial technologies. They do not engage in technology R&D. Developing countries have energy needs now, and commercial technologies are available now. USAID has taken note of the interest taken by subsidiaries of US utilities in the past couple of years in bringing their expertise and resources to bear on meeting the challenge of rural energy needs in developing countries. They believe that the entry into the market of these players could be one of the most important catalysts for making the rural energy revolution happen.

With the realignment and closure of Federal facilities, especially Department of Defense installations, Federal agencies have been presented with a unique opportunity: the chance to create and dispose of air emission reduction credits (ERCs). This situation and current commitments by the Congress and EPA to expand the use of market based pollution control programs have generated interest in certain circles as to whether and how Federal agencies can dispose of ERCs and similar pollution rights and allowances. This paper will discuss ERCs, why the disposal of ERCs by Federal agencies is a pressing issue, and how Federal agencies can dispose of ERCs under existing Federal property laws and regulations.

The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

Performance requirements and testing protocols are needed to ensure that equipment used by the International Atomic Energy Agency (IAEA) is reliable. Oak Ridge National Laboratory (ORNL), through the US Support Program, tested equipment to validate performance requirements protocols used by the IAEA for the subject equipment categories. Performance protocol validation tests were performed in the Environmental Effects Laboratory in the categories for battery, DC power supply, and uninterruptible power supply (UPS). Specific test results for each piece of equipment used in the validation process are included in this report.

Implementing solar energy projects at federal facilities is a process. The project planning phase of the process includes determining goals, building a team, determining site feasibility and selecting the appropriate project funding tool. This fact sheet gives practical guidance to assist decision-makers with understanding and selecting the funding tool that would best address their site goals. Because project funding tools are complex, federal agencies should seek project assistance before making final decisions. High capital requirements combined with limits on federal agency energy contracts create challenges for funding solar projects. Solar developers typically require long-term contracts (15-20) years to spread out the initial investment and to enable payments similar to conventional utility bill payments. In the private sector, 20-year contracts have been developed, vetted, and accepted, but the General Services Administration (GSA) contract authority (federal acquisition regulation [FAR] part 41) typically limits contract terms to 10 years. Payments on shorter-term contracts make solar economically unattractive compared with conventional generation. However, in several instances, the federal sector has utilized innovative funding tools that allow long-term contracts or has created a project package that is economically attractive within a shorter contract term.
The traveler, serving as Delegate from the United States Heat Pump Center National Team, participated in the activities of the second International Energy Agency Heat Pump Center (IEA-HPC) Working Team meeting. This included a 20 minute presentation by the traveler about the Development and Activities of the IEA Heat Pump Center US National Team.'' Highlights of this meeting included development of 1991 IEA-HPC work plans including a prioritization of activities, introduction of the newly appointed IEA-HPC Advisory Board, and discussion of a new IEA Clearinghouse Network initiative. Pre-meeting discussions were held with IEA-HPC staff members which focused on US Heat Pump Center National Team contributions to the IEA-HPC Newsletter and participation in other IEA-HPC sponsored activities.
The Hanford Site has hosted similar activities, including both Hanford Summits I and II. The Hanford Summits were two-day televised events to discuss the commitment of the current Presidential administration to the environmental restoration of the Hanford Site. Public involvement and strategic issues established from Hanford Summit I include: Regulatory issues, training and education, economic development and partnership, and technology transfer. Hanford Summit II provided a summary of how Secretary of Energy O`Leary is proceeding on the above strategic issues. The DOE and Westinghouse School for Environmental Excellence frequently offers a six-week course for environmental professionals and workers. Approximately thirty to forty individuals attend the training course, which provides training in environmental regulation compliance. The Hanford Site has hosted two previous International Atomic Energy Agency training courses. The courses lasted two weeks and had approximately eight to ten participants. Nuclear Material Management and Neutron Monitoring were the courses hosted by the Hanford Site.

This report focuses on the National Renewable Energy Laboratory's (NREL) fiscal year (FY) 2012 effort that used the NREL Optimal Vehicle Acquisition (NOVA) analysis to identify optimal vehicle acquisition recommendations for eleven diverse federal agencies. Results of the study show that by following a vehicle acquisition plan that maximizes the reduction in greenhouse gas (GHG) emissions, significant progress is also made toward the mandated complementary goals of acquiring alternative fuel vehicles, petroleum use reduction, and alternative fuel use increase.

Since 1957, the International Atomic Energy Agency (IAEA) has worked to ensure the safe and responsible promotion of nuclear technology throughout the world. The IAEA operates at the intersection of the Nuclear Nonproliferation Treaty’s (NPT) fourth and third articles, which guarantee Parties to the Treaty the right to peaceful uses of nuclear technology, provided those activities are placed under safeguards verified by the IAEA. However, while the IAEA has enjoyed substantial success and prestige in the international community, there is a concern that its resources are being stretched to a point where it may no longer be possible to execute its multifaceted mission in its entirety. As noted by the Director General (DG) in 2008, demographics suggest that every aspect of the IAEA’s operations will be in higher demand due to increasing reliance on non-carbon-based energy and the concomitant nonproliferation, safety, and security risks that growth entails. In addition to these nuclear energy concerns, the demand for technical developmental assistance in the fields of food security, resource conservation, and human health is also predicted to increase as the rest of the world develops. Even with a 100% value-for-money rating by the U.S. Office of Management and Budget (OMB) and being described as an “extraordinary bargain” by the United Nations Secretary-General’s High-level Panel on Threats, Challenges and Change, real budget growth at the Agency has been limited to zero-real growth for a better part of the last two decades. Although the 2012 regular budget (RB) received a small increase for most programs, the 2013 RB has been set at zero-real growth. The Energy Policy Act of 1992 calls for a program to further the commercialization of renewable energy and energy efficient technologies for the industrial sector.. The primary objective of the Office of Industrial Technologies Chemical Industry Team is to work in partnership with the US chemical industry to maximize economic, energy, and environmental benefits through research and development of innovative technologies. This document was developed to inventory organizations within the federal government on current chemical industry-related research and development. While an amount of funding or number of projects specifically relating to chemical industry research and development was not defined in all organizations, identified were about 60 distinct organizations representing 7 cabinet-level departments and 4 independent agencies, with research efforts exceeding $3.5 billion in fiscal year 1995. Effort were found to range from less than $500 thousand per year at the Departments of Agriculture and the Interior to over $100 million per year at the Departments of Commerce, Defense, Energy, and Health and Human Services and the National Aeronautics and Space Administration. The total number of projects in these programs exceeded 10,000. This document is complete to the extent that agencies volunteered information. This document is part of a larger, programmatic effort to assist federal agencies in taking action and changing their institutions to achieve and maintain federal sustainability goals, while meeting their mission goals. FEMP is developing guidance for federal agency efforts to enable institutional behavior change for sustainability, and for making sustainability “business as usual.” The driving requirement for this change is Executive Order (EO) 13514, Federal Leadership in Environmental, Energy, and Economic Performance. FEMP emphasizes strategies for increasing energy efficiency and renewable energy utilization as critical components of attaining sustainability, and promotes additional non-energy action pathways contained in EO 13514. This report contributes to the larger goal by laying out the conceptual and evidentiary underpinnings of guidance to federal agencies. Conceptual frameworks focus and organize the development of guidance. We outline a series of progressively refined conceptual frameworks, including a multi-layer approach, key steps in sustainability implementation, a process view of specific approaches to institutional change, the agency Strategic Sustainability Performance Plans (SSPPs), and concepts related to context-specific rules, roles and tools for sustainability. Additionally, we tap pertinent bodies of literature in drawing eight evidence-based principles for behavior change. These principles are important foundations upon which to build in selecting strategies to effect change in organizations. Taken together, this report presents a suite of components that inform the training materials, presentations, web site, and other products that provide guidance to federal agencies.

The International Energy Program Agreement, which created the International Energy Agency (IEA) in November 1974, establishes a system for the mandatory sharing of petroleum during severe oil supply disruptions. Development of the agreement was initiated by then Secretary of State Henry Kissinger during the attempted embargo of oil shipments to the US and The Netherlands by the Organization of Arab Petroleum Exporting Countries in 1973. Kissinger feared that the scramble for oil supplies would strain the Western alliance and contribute to a Western European ''tilt'' toward the Arab position in the Mideast. A new framework for international cooperation in the sharing of oil during oil embargoes and other supply disruptions seemed desirable; ensuring everyone their ''fair share'' would help blunt the oil weapon. Twenty-one countries, including the United States, Japan, and all the countries of Western Europe except France, affirmed this view through their membership in the IEA. The mechanism intended to achieve ''fair'' distribution of petroleum during severe disruptions is the Emergency Sharing System (ESS). Our evaluation of the ESS attempts to answer three questions: First, what would be the economic consequences for the US and other IEA members if sharing were to be implemented. Second, how do limitations in information and market control hinder implementation. Third, in light of such impediments, what are likely to be the actual economic consequences of attempted implementation.

The Chairman of the Senate Committee on Govermental Affairs asked the United States General Accounting Office (GAO) to review the safeguards and nuclear power plant safety programs of the International Atomic Energy Agency (IAEA). This report examines (1) the effectiveness of IAEA`s safeguards program and the adequacy of program funding, (2) the management of U.S. technical assistance to the IAEA`s safeguards program, and (3) the effectiveness of IAEA`s program for advising United Nations (UN) member states about nuclear power plant safety and the adequacy of program funding. Under its statute and the Treaty on the Non-Proliferation of Nuclear Weapons, IAEA is mandated to administer safeguards to detect diversions of significant quantities of nuclear material from peaceful uses. Because of limits on budget growth and unpaid contributions, IAEA has had difficulty funding the safeguards program. IAEA also conducts inspections of facilities or locations containing declared nuclear material, and manages a program for reviewing the operational safety of designated nuclear power plants. The U.S. technical assistance program for IAEA safeguards, overseen by an interagency coordinating committee, has enhanced the agency`s inspection capabilities, however, some weaknesses still exist. Despite financial limitations, IAEA is meeting its basic safety advisory responsibilities for advising UN member states on nuclear safety and providing requested safety services. However, IAEA`s program for reviewing the operational safety of nuclear power plants has not been fully effective because the program is voluntary and UN member states have not requested IAEA`s review of all nuclear reactors with serious problems. GAO believes that IAEA should have more discretion in selecting reactors for review.
US national energy policy recognizes that the continued development of commercial nuclear power in the United States is vital to US national security and energy stability since it is a significant domestic energy resource that is relatively free from international pressures. As of this writing (August 1989) the United States had 108 nuclear power reactors in commercial status. In January 1989 nuclear energy produced 46 billion KwH or 20% of total US electricity generated in contrast to 45 billion KwH (18.8%) produced in January 1988. The US Federal Government has been engaged in a variety of activities to ensure that nuclear energy remains a safe, economically competitive and environmentally acceptable option. Much of the federal effort in recent months has been devoted to developing initiatives designed to remove institutional and regulatory obstacles to the continued use of nuclear power as part of the US energy system. Within this context, the following paragraphs summarize the major features of the current status of the US nuclear energy program and policies.

This report provides relevant information and analysis to the Department of Homeland Security (DHS) that will assist DHS in determining how to meet the requirements of federal technology transfer legislation. These legal requirements are grouped into five categories: (1) establishing an Office of Research and Technology Applications, or providing the functions thereof; (2) information management; (3) enabling agreements with non-federal partners; (4) royalty sharing; and (5) invention ownership/obligations. These five categories provide the organizing framework for this study, which benchmarks other federal agencies/laboratories engaged in technology transfer/transition Four key agencies--the Department of Health & Human Services (HHS), the U.S. Department of Agriculture (USDA), the Department of Energy (DOE), and the Department of Defense (DoD)--and several of their laboratories have been surveyed. An analysis of DHS's mission needs for commercializing R&D compared to those agencies/laboratories is presented with implications and next steps for DHS's consideration. Federal technology transfer legislation, requirements, and practices have evolved over the decades as agencies and laboratories have grown more knowledgeable and sophisticated in their efforts to conduct technology transfer and as needs and opinions in the federal sector have changed with regards to what is appropriate. The need to address requirements in a fairly thorough manner has, therefore, resulted in a lengthy paper. There are two ways to find summary information. Destructive analysis is used by the International Atomic Energy Agency (IAEA) through its Safeguards Analytical Laboratory (SAL) to verify, in part, the inventory of nuclear materials at nuclear facilities. The reliability and quality of these meassurements must be assured in a systematic manner. The Division of Safeguards Evaluation, IAEA, required assistance in developing and implementing the quality assurance measures for the analytical procedures used in the destructive analysis of these safeguards samples. To meet these needs an ISPO POTAS Task D.53 was instituted in which consultants would review with IAEA staff the procedures used (or proposed) at SAL for the destructive analysis of safeguards samples and the statistical evaluation of the resulting measurement data at Headquarters. The procedures included analytical methods, qualtiy control measures, and the treatment of data from these activities. Based on this review, modifications to the system, if required, would be recommended which would provide routine assurance to management that these procedures are functioning properly to achieve safeguards objectives. In the course of this review, the sample handling procedures, measurement control activities, analytical methods, reference materials, calibration procedures, statistical analysis of data, and data management system were studied and evaluated. The degree to which SAL (as a total system) achieved laboratory quality assurance was assessed by comparison to accepted standards of quality assurance. 22 refs., 1 fig.
This document is meant to describe the status of the International Energy Agency (IEA), Annex 11 (Integrated Systems), Subtask B (Analytical Tools) effort being carried out by the Member Nations. This includes Canada, Japan, Italy (inactive at this time), the Netherlands, Spain, Switzerland, and the United States. The Subtask status is taken as of the end of September 1997, following the Fall Experts Meeting. This was held in Toronto, September 23--26. The goal of this Annex is to identify, compile, and integrate models of hydrogen technology components into system models that will describe overall pathways. Examples would include: PV/electrolysis/pipeline transport/hydride storage/PEM fuel cell utilization or natural gas steam reforming/liquefaction/truck transport/hydrogen refueling station. Component models are developed by the Member Nations and integrated into the desired overall system. Subtask B is concerned with identifying and compiling existing component models from Member Nations, or developing these models from data supplied by the Member Nations via Subtask A.
The Vault at the Plutonium Finishing Plan (PFP) became subject to the International Atomic Energy Agency (IAEA) safeguards beginning in 1994 as part of the US excess fissile material program. The inventory needed to be stabilized and repackaged for long-term storage to comply with Defense Nuclear Facility Safety Board Recommendation 94-1. In 1998, the United States began negotiations with IAEA to develop methods to maintain safeguards during stabilization and repackaging of this material. The Design Information Questionnaire was revised and submitted to the IAEA in 2002 describing modification to the facility to accommodate the stabilization process line. The operation plan for 2003 was submitted describing the proposed schedules for removing materials for stabilization. Stabilization and repackaging activities for the safeguarded plutonium began in January 2003 and were completed in December 2003. The stabilization was completed in five phases. IAEA containment and surveillance measures were maintained until the material was removed by phase for stabilization and repackaging. Following placement of the repackaged material into the storage vault, the IAEA conducted inventory change verification measurements, and re-established containment and surveillance. Plant activities and the impacts on operations are described.

This report presents results from a program evaluation of the U.S. Department of Energy?s Buildings Technologies Program (BTP) participation in collaborative international technology implementing agreements. The evaluation was conducted by researchers from the Pacific Northwest National Laboratory and the Lawrence Berkeley National Laboratory in the fall of 2007 and winter 2008 and was carried out via interviews with stakeholders in four implementing agreements in which BTP participates, reviews of relevant program reports, websites and other published materials. The objective of the International Atomic Energy Agency (IAEA) Guidelines on Quality Assurance for R&D is to provide guidance for developing quality assurance (QA) programs for R&D work on items, services, and processes important to safety, and to support the siting, design, construction, commissioning, operation, and decommissioning of nuclear facilities. The standard approach to writing papers describing new quality guidelines documents is to present a descriptive overview of the contents of the document. I will depart from this approach. Instead, I will first discuss a conceptual framework of metrics for evaluating and improving basic and applied experimental science as well as the associated role that quality management should play in understanding and implementing these metrics. I will conclude by evaluating how well the IAEA document addresses the metrics from this conceptual framework and the broader principles of quality management.

Annex XIII on 'Fuel Cell Vehicles' of the Implementing Agreement Hybrid and Electric Vehicles of the International Energy Agency has been operating since 2006, complementing the ongoing activities on battery and hybrid electric vehicles within this group. This paper provides an overview of the Annex XIII final report for 2010, compiling an up-to-date, neutral, and comprehensive assessment of current trends in fuel cell vehicle technology and related policy. The technological description includes trends in system configuration as well as a review of the most relevant components including the fuel cell stack, batteries, and hydrogen storage. Results from fuel cell vehicle demonstration projects around the world and an overview of the successful implementation of fuel cells in specific transport niche markets will also be discussed. The final section of this report provides a detailed description of national research, development, and demonstration (RD&D) efforts worldwide.

In his September 1993 address to the United Nations General Assembly, President Clinton proposed several initiatives to promote nuclear nonproliferation. One element is of these initiatives was that the United States offered to place excess fissile material under International Atomic Energy Agency @A) safeguards. Three Department of Energy (DOE) facilities were identified as part of a phased approach for initial implementation. This paper describes the planning process used to provide information to assist the DOE in making decisions for the initial offer, outlines tasks to be performed, and develops a budget request. The process consisted of: (1) Characterizing the Hanford Site from the perspective of IAEA safeguards; (2) identify key issues to be resolved; (3) developing budget estimates and schedules; (4) interfacing with other DOE components and the IAEA to clarify expected activities; and (5) initiating additional data collection and preparatory activities to reduce planning uncertainties.

Fuelwood shortages and potential shortages are widespread throughout the developing world, and are becoming increasingly more prevalent because of the clearing of land for subsistence and plantation agriculture, excessive and inefficient commercial timber harvesting for domestic and export construction, and charcoal production to meet rising urban demands. Further, the environmental and socioeconomic consequences of the resulting deforestation are both pervasive and complex. This report focuses on the substitution of coal briquettes for fuelwood. Although substantial adverse health effects could be expected from burning non-anthracite coal or coal briquettes, a well-developed technique, carbonization, exists to convert coal to a safer form for combustion. The costs associated with briquetting and carbonizing coal indicate that ''smokeless'' coal briquettes can be produced at costs competitive with fuelwood and charcoal. The US Agency for International Development (USAID) is working on implementing this energy option in Haiti and Pakistan by (1) evaluating resources, (2) assessing markets, (3) analyzing technologies, (4) studying government policy and planning, and (5) packaging the idea for the private sector to implement. 26 refs., 2 figs., 12 tabs.

In the Department of Energy (DOE) Implementation Plan (IP) for Defense Nuclear Facilities Safety Board's Recommendation 2009-1, the DOE committed to studying the use of quantitative risk assessment methodologies at government agencies and industry. This study consisted of document reviews and interviews of senior management and risk assessment staff at six organizations. Data were collected and analyzed on risk assessment applications, risk assessment tools, and controls and infrastructure supporting the correct usage of risk assessment and risk management tools. The study found that the agencies were in different degrees of maturity in the use of risk assessment to support the analysis of high hazard operations and to support decisions related to these operations. Agencies did not share a simple, 'one size fits all' approach to tools, controls, and infrastructure needs. The agencies recognized that flexibility was warranted to allow use of risk assessment tools in a manner that is commensurate with the complexity of the application. The study also found that, even with the lack of some data, agencies application of the risk analysis structured approach could provide useful insights such as potential system vulnerabilities. This study, in combination with a companion study of risk assessment programs in the DOE Offices involved in high hazard operations, is being used to determine the nature and type of controls and infrastructure needed to support risk assessments at the DOE.

Low-slope roof systems are common on commercial and industrial buildings and, to a lesser extent, on residential buildings. Although insulating materials have nearly always been a component of low-slope roofs, the amount of insulation used has increased in the past two decades because of escalation of heating and cooling costs and increased awareness of the need for energy conservation. As the amount of insulation has increased, the demand has intensified for design, installation, and maintenance information specifically for well-insulated roofs. Existing practices for design, installation, and maintenance of insulated roofs have evolved from experience. Typically, these practices feature compromises due to the different properties of materials making up a given roof system. Therefore, they should be examined from time to time to ensure that they are appropriate as new materials continue to enter the market and as the data base on existing systems expands. A primary purpose of this International Energy Agency (IEA) study is to assess current roofing insulation practices in the context of an accumulating data base on performance.
