    The business of buying and selling producing oil and gas properties has been active over the past decade. On frequently encountered difficulty is that many producing properties are subject to operating agreements containing `preferential right of purchase` PRP provisions, also referred to as rights of first refusal or preemptive rights. Under a PRP clause, a party wanting to sell its interest must first provide notice to other parties to the operating agreement and an opportunity to acquire the sellers rights and interests in the property. Determining if a PRP clause applies to a particular transaction and the extent of such application is not always easy. In addition if the PRP clause does apply and the holder elects to purchase the property, the deal for which the buyer and seller have bargained may be frustrated. Topics covered in this article include the following: scope of `sales` covered by the PRP clause; exclusion from preferential right; events triggering the PRP provision.

    This paper provides an overview of the current human and intellectual capital at Los Alamos National Laboratory, through specific research into the statistics and demographics as well as numerous personal interviews at all levels of personnel. Based on this information, a series of recommendations are provided to assist Los Alamos National Laboratory in ensuring the future of the human and intellectual capital for the nuclear deterrence mission. While the current human and intellectual capital is strong it stands on the precipice and action must be taken to ensure Los Alamos National Laboratory maintains leadership in developing and sustaining national nuclear capabilities. These recommendations may be applicable to other areas of the nuclear enterprise, including the Air Force, after further research and study.

    This report is a compilation of submitted abstracts of papers presented at the DOE-supported workshop on medical information and the right to privacy held at the National Academy of Sciences in Washington, DC, on June 9 and 10, 1994. The aim of this meeting is to provide a forum to discuss the legal, ethical and practical issues related to the computerization and use of medical data, as well as the potential impact the use of these data may have on an individual`s privacy. Topical areas include an overview of the Federal and legal requirements to collect medical data, historical experiences with worker screening programs, currently available medical surveillance technologies (both biomedical and computer technologies) and their limitations. In addition, an-depth assessment of the needs and interests of a wide spectrum of parties as they relate to the use of medical data from both a legal and privacy perspective is provided. The needs of the individual, the public (e.g., blood and tissue banks), private enterprises (e.g., industry and insurance carriers), and the government (e.g., FBI) are discussed. Finally, the practical and legal issues relating to the use of computers to carry, store and transmit this information are also examined. The abstracts are presented in the intended order of presentation as indicated in the agenda for the meeting.

    Laboratory equipment such as autoclaves, glass washers, refrigerators, and computers account for a significant portion of the energy use in laboratories. However, because of the general lack of measured equipment load data for laboratories, designers often use estimates based on 'nameplate' rated data, or design assumptions from prior projects. Consequently, peak equipment loads are frequently overestimated. This results in oversized HVAC systems, increased initial construction costs, and increased energy use due to inefficiencies at low part-load operation. This best-practice guide first presents the problem of over-sizing in typical practice, and then describes how best-practice strategies obtain better estimates of equipment loads and right-size HVAC systems, saving initial construction costs as well as life-cycle energy costs. This guide is one in a series created by the Laboratories for the 21st Century ('Labs21') program, a joint program of the U.S. Environmental Protection Agency and U.S. Department of Energy. Geared towards architects, engineers, and facilities managers, these guides provide information about technologies and practices to use in designing, constructing, and operating safe, sustainable, high-performance laboratories.

    Over the last several decades, libraries across the nation have undergone dramatic budget cuts, despite being an important resource for regional and national economic growth and innovation. Numerous studies have attempted to show that libraries increase the intellectual level of users and contribute to the economic growth of communities through surveys and customer service data. Within this study, we have attempted to develop a more analytical method for assessing library performance, using the Idaho National Laboratory Research Library as a sample subject. We have developed a mathematical model to measure the financial value of a library’s material resources as well as its intellectual value to determine if the library is a positive contributor to the wider organization and community it serves.

    Purpose: We investigated intrahepatic vascular changes in patients undergoing right portal vein ligation (PVL) or portal vein embolization (PVE) in conjunction with the ensuing hypertrophic response and function of the left liver lobe. Methods: Between December 2008 and October 2011, 7 patients underwent right PVL and 14 patients PVE. Computed tomographic (CT) volumetry to assess future remnant liver (FRL) and functional hepatobiliary scintigraphy were performed in all patients before and 3 weeks after portal vein occlusion. In 18 patients an intraoperative portography was performed to assess perfusion through the occluded portal branches. Results: In all patients after initially successful PVL, reperfused portal veins were observed on CT scan 3 weeks after portal occlusion. This was confirmed in all cases during intraoperative portography. Intrahepatic portoportal collaterals were identified in all patients in the PVL group and in one patient in the PVE group. In all other PVE patients, complete occlusion of the embolized portal branches was observed on CT scan and on intraoperative portography. The median increase of FRL volume after PVE was 41.6 % (range 10-305 %), and after PVL was only 8.1 % (range 0-102 %) (p = 0.179). There were no differences in FRL function between both groups. Conclusion: Preoperative PVE and PVL are both methods to induce hypertrophy of the FRL in anticipation of major liver resection. Compared to PVE, PVL seems less efficient in inducing hypertrophy of the nonoccluded left lobe. This could be caused by the formation of intrahepatic portoportal neocollateral vessels, through which the ligated portal branches are reperfused within 3 weeks.

    Human rights impact assessment (HRIA) is a process for systematically identifying, predicting and responding to the potential impact on human rights of a business operation, capital project, government policy or trade agreement. Traditionally, it has been conducted as a desktop exercise to predict the effects of trade agreements and government policies on individuals and communities. In line with a growing call for multinational corporations to ensure they do not violate human rights in their activities, HRIA is increasingly incorporated into the standard suite of corporate development project impact assessments. In this context, the policy world's non-structured, desk-based approaches to HRIA are insufficient. Although a number of corporations have commissioned and conducted HRIA, no broadly accepted and validated assessment tool is currently available. The lack of standardisation has complicated efforts to evaluate the effectiveness of HRIA as a risk mitigation tool, and has caused confusion in the corporate world regarding company duties. Hence, clarification is needed. The objectives of this paper are (i) to describe an HRIA methodology, (ii) to provide a rationale for its components and design, and (iii) to illustrate implementation of HRIA using the methodology in two selected corporate development projectsa uranium mine in Malawi and a tree farm in Tanzania. We found that as a prognostic tool, HRIA could examine potential positive and negative human rights impacts and provide effective recommendations for mitigation. However, longer-term monitoring revealed that recommendations were unevenly implemented, dependent on market conditions and personnel movements. This instability in the approach to human rights suggests a need for on-going monitoring and surveillance. -- Highlights: We developed a novel methodology for corporate human rights impact assessment.     The concessionaries produce more oil in Iran because of fear of nationalization, lower oil production costs in the Middle East, and more investment opportunities around the globe. This higher discount rate means more oil production and also, more natural gas, a joint product, is produced. Produced natural gas could have been used in the Iranian market, or exported. Low oil prices and high transportation costs of natural gas resulted in the low well-head value of natural gas. The fear of nationalization kept concessionaires from utilizing natural gas in Iran's domestic market. The high transportation costs of natural gas was a negative factor in export utilization. Also, if natural gas, which can be substituted for oil in many uses, were to be utilized, concessionaires would have had to produce less oil. Because oil had a well-established market, it would have been contrary to their interest to leave a lot of oil underground while their concessions ran out. Consequently, they chose to take the oil and flare natural gas. The Iranian government must take responsibility in this matter also. The country's rulers were not concerned with maximizing the country's wealth, but maximizing the security of their regimes, and their personal wealth and pleasure.

    In 1986, the Superfund Amendments and Reauthorization Act (SARA) provided additional funding to continue and greatly expand the cleanup program begun under CERCLA. Title III of SARA contains the provisions of the Emergency Planning and Community Right-to-Know Act (EPCRA). SARA Title III may prove to be more pervasive and more demanding for industry than any of the other many rules and regulations promulgated by the Environmental Protection Agency. The Emergency Planning and Community Right-to-Know Act has four major provisions: planning for chemical emergencies; emergency notification of chemical accidents and releases; reporting of hazardous chemical inventories; and toxic chemical release reporting.

    The leading cause of incidents on transmission pipelines is damage by third-party construction equipment. A single incident can be devastating, causing death and millions of dollars of property loss. This damage would be prevented if potentially hazardous construction equipment could be detected, identified, and an alert given before the pipeline is hit. Currently there is no method for continuously monitoring a pipeline right-of-way. Instead, companies periodically walk or fly over the pipeline to find unauthorized construction activities. Gas Technology Institute (GTI) is developing a system to solve this problem by using an optical fiber buried above the pipeline as a distributed sensor. A custom optical time domain reflectometer (OTDR) is used to interrogate the fiber. Key issues in the development of this technology are the ability to detect encroachment and the ability to discriminate among potentially hazardous and benign encroachments. Advantages of the reflectometry technique are the ability to accurately pinpoint the location of the construction activity and the ability to separately monitor simultaneously occurring events. The basic concept of using OTDR with an optical fiber buried above the pipeline to detect encroachment of construction equipment into the right of way works. Sufficiently rapid time response is possible; permitting discrimination between encroachment types. Additional work is required to improve the system into a practical device.

    We consider the inclusive production of hadrons in lepton-nucleon scattering. For a transversely polarized nucleon this reaction shows a left-right azimuthal asymmetry, which we compute in twist-3 collinear factorization at leading order in perturbation theory. All non-perturbative parton correlators of the calculation are fixed through information from other hard processes. Our results for the left-right asymmetry agree in sign with recent data for charged pion production from the HERMES Collaboration and from Jefferson Lab. However, the magnitude of the computed asymmetries tends to be larger than the data. Potential reasons for this outcome are identified. We also give predictions formorefuture experiments and highlight in particular the unique opportunities at an Electron Ion Collider.less

    Motivated by the recently reported diboson and dijet excesses in Run 1 data at ATLAS and CMS, we explore models of mixed dark matter in left-right symmetric theories. In this study, we calculate the relic abundance and the elastic scattering cross section with nuclei for a number of dark matter candidates that appear within the fermionic multiplets of left-right symmetric models. In contrast to the case of pure multiplets, WIMP-nucleon scattering proceeds at tree-level, and hence the projected reach of future direct detection experiments such as LUX-ZEPLIN and XENON1T will cover large regions of parameter space for TeV-scale thermal darkmore » matter. Decays of the heavy charged W(') boson to particles in the dark sector can potentially shift the right-handed gauge coupling to larger values when fixed to the rate of the Run 1 excesses, moving towards the theoretically attractive scenario, gR = gL. Furthermore, this region of parameter space may be probed by future collider searches for new Higgs bosons or electroweak fermions.« less

    This report is a summary of and commentary on (a) the seven lectures that C. S. Peirce presented in 1903 on pragmatism and (b) a commentary by P. A. Turrisi, both of which are included in Pragmatism as a Principle and Method of Right Thinking: The 1903 Harvard Lectures on Pragmatism, edited by Turrisi [13]. Peirce is known as the founder of the philosophy of pragmatism and these lectures, given near the end of his life, represent his mature thoughts on the philosophy. Peirce's decomposition of thinking into abduction, deduction, and induction is among the important points in the lectures.

    On Monday, Oct. 3 at 7 p.m. in Berkeley's Repertory Theater, the Lab presented "What's Right with Kansas," an evening of conversation with the Kansas-based Climate and Energy Project's founder and board chair, Nancy Jackson, and Berkeley Lab scientist Merrian Fuller, an electricity-market, policy and consumer behavior expert. Berkeley Lab will also debut its video "Common Ground," which showcases how CEP has become a Kansas mainstay and an inspiration to environmental organizations across the country. In a state rife with climate-change skepticism, CEP has changed behavior, and some minds, by employing rural values of thrift, independence, conservation, and friendly competition to promote energy efficiency.

    Natural gas transmission companies mark the right-of-way areas where pipelines are buried with warning signs to prevent accidental third-party damage. Nevertheless, pipelines are sometimes damaged by third-party construction equipment. A single incident can be devastating, causing death and millions of dollars of property loss. This damage would be prevented if potentially hazardous construction equipment could be detected, identified, and an alert given before the pipeline was damaged. The Gas Technology Institute (GTI) is developing a system to solve this problem by using an optical fiber as a distributed sensor and interrogating the fiber with an optical time domain reflectometer. Key issues are the ability to detect encroachment and the ability to discriminate among potentially hazardous and benign encroachments. The work performed in the second quarter of the project includes design of the instrument, selection of the key components, and beginning programming of the custom optical time domain reflectometer. Work included an assessment of two other approaches to measuring strain and vibrations in an extended optical fiber sensor.

This damage would be prevented if potentially hazardous construction equipment could be detected, identified, and an alert given before the pipeline was damaged. The Gas Technology Institute (GTI) is developing a system to solve this problem by using an optical fiber as a distributed sensor and interrogating the fiber with a custom optical time domain reflectometer. Key issues are the ability to detect encroachment and the ability to discriminate among potentially hazardous and benign encroachments. The work performed in the 1st quarter of 2003 included fine-tuning and debugging of the custom Optical Time Domain Reflectometer being constructed for data collection and analysis. The detector was redesigned reducing the noise floor by over a factor of ten. While GTI's OTDR was being improved, a new, commercial OTDR was used to verify that the technique is capable of measuring one pound continuous force applied to the Hergalite. Optical fibers were installed at the ANR Pipeline test site along an operating pipeline.

Key issues are the ability to detect encroachment and the ability to discriminate among potentially hazardous and benign encroachments. The work continues on improving the signal-to-noise ratio of the technique. We are now able to detect weights sitting on the Hergalite fiber of as low as 0.2 pound. A brighter diode laser increased our sensitivity by a factor of ten. Detection of load fluctuations with frequencies greater than 5 Hertz is also possible. The next step is beginning measurements at the field site.

The work performed in the third quarter of the project (2nd quarter of 2002) includes design and construction of the diode laser driver and high-speed detector electronics. Fine-tuning of the electronics is proceeding. A new test site along an operating pipeline has been obtained.

The work continues on improving the signal-to-noise ratio of the custom OTDR. An avalanche photo-detector, was purchased. It was able to detect weights on the Hergalite fiber as low as one pound. We are also investigating a brighter laser for use with the multimode fibers.
