    Various state regulatory agencies have expressed a need for networking with information gatherers/researchers to produce a concise compilation of primary information so that the basis for regulatory standards can be scientifically referenced. California has instituted several programs to retrieve primary information, generate primary information through research, and generate unique regulatory standards by integrating the primary literature and the products of research. This paper describes these programs.

  2. Reaching Site Closure for Groundwater under Multiple Regulatory Agencies

    Groundwater at the Connecticut Yankee Atomic Power Company (CYAPCO) Haddam Neck Plant (HNP) requires investigation of both radionuclides and chemical constituents in order to achieve closure. Cleanup criteria for groundwater are regulated both by federal and state agencies. These requirements vary in both numerical values as well as the duration of post remediation monitoring. The only consistent requirement is the development of a site conceptual model and an understanding of the hydrogeologic conditions that will govern contaminant transport and identify potential receptors. To successfully reach closure under each agency, it is paramount to understand the different requirements during the planning stages of the investigation. Therefore, the conceptual site model, groundwater transport mechanisms, and potential receptors must be defined. Once the hydrogeology is understood, a long term groundwater program can then be coordinated to meet each regulatory agency requirement to both terminate the NRC license and reach site closure under RCRA. Based on the different criteria, the CTDEP-LR (or RSR criteria) are not only bounding, but also requires the longest duration. As with most decommissioning efforts, regulatory attention is focused on the NRC, however, with the recent industry initiatives based on concern of tritium releases to groundwater at other plants, it is likely that the USEPA and state agencies may continue to drive site investigations. By recognizing these differences, data quality objectives can include all agency requirements, thus minimizing rework or duplicative efforts. CYAPCO intends to complete groundwater monitoring for the NRC and CTDEP-RD by July 2007. However, because shallow remediations are still being conducted, site closure under USEPA and CTDEP-LR is projected to be late 2011.

    This grant project was a major step toward completion of the Risk Based Data Management System (RBDMS) project. Additionally the project addresses the needs identified during the projects initial phases. By implementing this project, the following outcomes were sought: (1) State regulatory agencies implemented more formalized environmental risk management practices as they pertain to the production of oil and gas, and injection via Class II wells. (2) Enhancement of oil and gas production by implementing a management system supporting the saving of abandoned or idle wells located in areas with a relatively low environmental risk of endangering underground sources of drinking water (USDWs) in a particular state. (3) Verification that protection of USDWs is adequate and additional restrictions of requirements are not necessary in areas with a relatively low environmental risk. (4) Standardization of data and information maintained by state regulatory agencies and decrease the regulatory cost burden on producers operating in multiple states, and (5) Development of a system for electronic data transfer among operators and state regulatory agencies and reduction of overall operator reporting burdens.

    The development of new or the upgrade of existing physical protection systems (PPS) for nuclear facilities involves a multi-step and multidimensional process. The process consists of conceptual design, design, and commissioning stages. The activities associated with each of these stages are governed by Russian government and agency regulations. To ensure a uniform approach to development or upgrading of PPS at Russian nuclear facilities, the development of a range of regulatory and methodological documents is necessary. Some issues of PPS development are covered by the regulatory documents developed by Rosatom, as well as other Russian agencies with nuclear facilities under their control. This regulatory development has been accomplished as part of the U.S.-Russian MPC&A cooperation or independently by the Russian Federation. While regulatory coverage is extensive, there are a number of issues such as vulnerability analysis, effectiveness assessment, upgrading PPS, and protection of information systems for PPS that require additional regulations be developed. This paper reports on the status of regulatory coverage for PPS development or upgrade, and outlines a new approach to regulatory document development. It describes the evolutionary process of regulatory development through experience gained in the design, development and implementation of PPS as well as experience gained through the cooperative efforts of Russian and U.S. experts involved the development of MPC&A regulations.

    This report includes toxicological and regulatory evaluations performed in support of U.S. EPA regulation of toxic materials and hazardous wastes. The first section of the report describes evaluations which support: (a) the regulation of small-volume generators of hazardous wastes, (b) the regulation of hazardous wastes from pesticide manufacturing, and (c) the disposal of the herbicide, silvex. The second section describes the environmental fate, transport, and effect of glyphosate and dalapon. The third section deals with synthetic fuels, including evaluations of synfuel-product toxicity, uncontrolled air emissions, and particular focus on the toxicity of products from several indirect coal liquefaction processes including methanol synthesis, Fischer-Tropsch, Mobil M-Gasoline, and Lurgi gasification technologies. Three direct coal liquefaction processes were examined for product toxicity and air emissions: Solvent Refined Coal (I and II) and the Exxon Donor Solvent Process. Also described in the third section is an evaluation of environmental and health hazards associated with the use of synthetic fuels from indirect coal liquefaction, direct coal liquefaction, and shale oil. Finally, the fourth section discusses some problems associated with performing, on a contractual basis, scientific and technical evaluations in support of U.S. EPA regulatory and research decisions.

    The Interstate Oil and Gas Compact Commission (IOGCC) engaged in numerous projects outlined under the scope of work discussed in the United States Department of Energy (DOE) grant number DE-FC26-04NT15456 awarded to the IOGCC. Numerous projects were completed that were extremely valuable to state oil and gas agencies as a result of work performed utilizing resources provided by the grant. There are numerous areas in which state agencies still need assistance. This additional assistance will need to be addressed under future scopes of work submitted annually to DOE's Project Officer for this grant. This report discusses the progress of the projects outlined under the grant scope of work for the 2005-2006 areas of interest, which are as follows: Area of Interest No. 1--Regulatory Streamlining and Improvement: This area of interest continues to support IOGCC's regulatory streamlining efforts that include the identification and elimination of unnecessary duplications of efforts between and among state and federal programs dealing with exploration and production on public lands. Area of Interest No. 2--Technology: This area of interest seeks to improve efficiency in states through the identification of technologies that can reduce costs. Area of Interest No. 3--Training and Education: This area of interest is vital to upgrading the skills of regulators and industry alike. Within the National Energy Policy, there are many appropriate training and education opportunities. Education was strongly endorsed by the President's National Energy Policy Development group. Acting through the governors offices, states are very effective conduits for the dissemination of energy education information. While the IOGCC favors the development of a comprehensive, long-term energy education plan, states are also supportive of immediate action on important concerns, such as energy prices, availability and conservation.     The Office for Nuclear Regulation (ONR) is an independent safety, security and transport regulator of the UK nuclear industry. ONR regulates all civil nuclear reactor power stations, fuel manufacture, enrichment, spent fuel reprocessing, most defence sites and installations that store and process legacy spent fuel and radioactive waste. The responsibility for funding and strategic direction of decommissioning and radioactive waste management of state owned legacy sites has rested solely with the Nuclear Decommissioning Authority (NDA) since 2005. A key component of NDA's mandate was to encourage new strategic approaches and innovation to dealing with the UK's waste legacy and which deliver value-for-money to the UK taxpayer. ONR, as an agency of the Health and Safety Executive, is entirely independent of NDA and regulates all prescribed activities on NDA's sites. NDA's competition of site management and closure contracts has attracted significant international interest and the formation of consortia comprised of major British, US, French and Swedish organizations bidding for those contracts. The prominence of US organizations in each of those consortia reflects the scale and breadth of existing waste management and D and D projects in the US. This paper will articulate, in broad terms, the challenges faced by international organizations seeking to employ 'off-the-shelf' technology and D and D techniques, successfully employed elsewhere, into the UK regulatory context. The predominantly 'goal-setting' regulatory framework in the UK does not generally prescribe a minimum standard to which a licensee must adhere. The legal onus on licensees in the UK is to demonstrate, whatever technology is selected, that in its applications, risks are reduced 'So Far As Is Reasonably Practicable' or 'SFAIRP'. By the nature of its role, ONR adopts a conservative approach to regulation; however ONR also recognises that in the decommissioning (and ultimately the site closure) domain

    Despite the growing inevitability of climate change and the attendant need for mitigation strategies, carbon capture and sequestration (CCS) has yet to gain much traction in the United States. Recent regulatory proposals by the U.S. Environmental Protection Agency (EPA), limited in scope to new-build power plants, represent the only significant policy initiative intended to mandate diffusion of CCS technology. Phase I of this Project assessed barriers to CCS deployment as prioritized by the CCS community. That research concluded that there were four primary barriers: (1) cost, (2) lack of a carbon price, (3) liability, and (4) lack of a comprehensive regulatory regime. Phase II of this Project, as presented in this Report, assesses potential regulatory models for CCS and examines where those models address the hurdles to diffusing CCS technology identified in Phase I. It concludes (1) that a CCS-specific but flexible standard, such as a technology performance standard or a very particular type of market-based regulation, likely will promote CCS diffusion, and (2) that these policies cannot work alone, but rather, should be combined with other measures, such as liability limits and a comprehensive CCS regulatory regime.

    With the coming liberalization of trade and industry within the European Community (EC) and a more centrally-coordinated EC external trade policy, it is timely to ask if in the 1990s there will be any significant changes in the commercial relations between the EC and non-EC companies trading in nuclear fuel. The key vehicle for implementing any change of policy would probably be the European Atomic Energy Community (EURATOM) Supply Agency in Brussels, which is charged under the EURATOM Treaty with overseeing the equitable supply of nuclear fuel to and among EC companies. The EURATOM Supply Agency (the Agency) is a signatory to almost all EC-company contracts for transactions that occur on the territory of the Community, which includes Belgium, Denmark, France, the Federal Republic of Germany (FRG), Great Britain, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, and Spain. During the 1980s, the Supply Agency has rarely tried to influence the commercial decisions of EC member companies. The nuclear fuel industry has largely perceived the Agency as an administrative office that registers contracts and maintains relations with some outside governments, particularly Australia, Canada, and the USA. However, in 1988 the Agency began to have a more direct commercial impact when it reviewed the practice-previously conducted routinely by the EURATOM Safeguards Directorate in Luxembourg at the request of EC-member companies-of swapping safeguards obligations on equivalent quantities of uranium at different locations (flag swapping). The Agency`s actions inhibiting flag swaps, as well as a related de facto policy restricting material swaps of Southern African uranium, caused it to be viewed as obstructive by some EC companies. During 1989 the discussion about flag swaps and swaps involving South African and Namibian uranium has subsided, and a far-reaching discussion has arisen about EC trade policy in general.

    The CONTAIN code was developed by Sandia National Laboratories under the sponsorship of the US Nuclear Regulatory Commission (NRC) to provide integrated analyses of containment phenomena. It is used to predict nuclear reactor containment loads, radiological source terms, and associated physical phenomena for a range of accident conditions encompassing both design-basis and severe accidents. The code`s targeted applications include support for containment-related experimental programs, light water and advanced light water reactor plant analysis, and analytical support for resolution of specific technical issues such as direct containment heating. The NRC decided that a broad technical review of the code should be performed by technical experts to determine its overall technical adequacy. For this purpose, a six-member CONTAIN Peer Review Committee was organized and a peer review as conducted. While the review was in progress, the NRC issued a draft ``Revised Severe Accident Code Strategy`` that incorporated revised design objectives and targeted applications for the CONTAIN code. The committee continued its effort to develop findings relative to the original NRC statement of design objectives and targeted applications.     We compute the third order gauge invariant action for scalar-graviton interactions in the Jordan frame. We demonstrate that the gauge invariant action for scalar and tensor perturbations on one physical hypersurface only differs from that on another physical hypersurface via terms proportional to the equation of motion and boundary terms, such that the evolution of non-Gaussianity may be called unique. Moreover, we demonstrate that the gauge invariant curvature perturbation and graviton on uniform field hypersurfaces in the Jordan frame are equal to their counterparts in the Einstein frame. These frame independent perturbations are therefore particularly useful in relating results in different frames at the perturbative level. On the other hand, the field perturbation and graviton on uniform curvature hypersurfaces in the Jordan and Einstein frame are non-linearly related, as are their corresponding actions and n-point functions.

    As part of its restructuring efforts in the electric utility industry, the Federal Energy Regulatory Commission (FERC) has encouraged voluntary corporate unbundling in an effort to promote a competitive electric market, recently proposing to define the minimal and desired characteristics of a regional transmission organization (RTO). The promotion of competition requires certain features in a transmission system, which include inter alia, (1) independent operation; (2) efficient pricing of congestion; (3) congestion management; (4) provision of ancillary services; (5) elimination of pancaked transmission rates; (6) appropriate transmission pricing; and (7) price transparency. A promising type of corporate unbundling that can provide these features is an independent transmission company (ITC).

    The Regulatory and Permitting Information Desktop (RAPID) Toolkit combines the former Geothermal Regulatory Roadmap, National Environmental Policy Act (NEPA) Database, and other resources into a Web-based tool that gives the regulatory and utility-scale geothermal developer communities rapid and easy access to permitting information. RAPID currently comprises five tools - Permitting Atlas, Regulatory Roadmap, Resource Library, NEPA Database, and Best Practices. A beta release of an additional tool, the Permitting Wizard, is scheduled for late 2014. Because of the huge amount of information involved, RAPID was developed in a wiki platform to allow industry and regulatory agencies to maintain the content in the future so that it continues to provide relevant and accurate information to users. In 2014, the content was expanded to include regulatory requirements for utility-scale solar and bulk transmission development projects. Going forward, development of the RAPID Toolkit will focus on expanding the capabilities of current tools, developing additional tools, including additional technologies, and continuing to increase stakeholder involvement.

    The MITRE Corporation conducted a five-month study for the Office of Resource Applications in the Department of Energy on the regulatory requirements of low-Btu coal gasification. During this study, MITRE interviewed representatives of five current low-Btu coal gasification projects and regulatory agencies in five states. From these interviews, MITRE has sought the experience of current low-Btu coal gasification users in order to recommend actions to improve the regulatory process. This report is the third of three volumes. It contains the results of interviews conducted for each of the case studies. Volume 1 of the report contains the analysis of the case studies and recommendations to potential industrial users of low-Btu coal gasification. Volume 2 contains recommendations to regulatory agencies.

    The US Department of Energy (DOE) is charged with responsibly managing the largest volume of mixed waste in the United States. This responsibility includes managing waste in compliance with all applicable Federal and State laws and regulations, and in a cost-effective, environmentally responsible manner. Managing certain treated mixed wastes in Resource Conservation and Recovery Act (RCRA) permitted storage and disposal units (specifically those mixed wastes that pose low risks from the hazardous component) is unlikely to provide additional protection to human health and the environment beyond that afforded by managing these wastes in storage and disposal units subject to requirements for radiological control. In October, 1995, the DOE submitted a regulatory reform proposal to the Environmental Protection Agency (EPA) relating to vitrified mixed waste forms. The technical proposal supports a regulatory strategy that would allow vitrified mixed waste forms treated through a permit or other environmental compliance mechanism to be granted an exemption from RCRA hazardous waste regulation, after treatment, based upon the inherent destruction and immobilization capabilities of vitrification technology. The vitrified waste form will meet, or exceed the performance criteria of the Environmental Assessment (EA) glass that has been accepted as an international standard for immobilizing radioactive waste components and the LDR treatment standards for inorganics and metals for controlling hazardous constituents. The proposal further provides that vitrified mixed waste would be responsibly managed under the Atomic Energy Act (AEA) while reducing overall costs. Full regulatory authority by the EPA or a State would be maintained until an acceptable vitrified mixed waste form, protective of human health and the environment, is produced.

    The purpose of this study was to examine the benefits to be gained from increased powerplant productivity and to validate and demonstrate the use of incentives within the regulatory process to promote the improvement of powerplant productivity. The system-wide costs savings to be gained from given productivity improvement scenarios are estimated in both the short and long term. Numerous reports and studies exist which indicate that productivity improvements at the powerplant level are feasible and cost effective. The efforts of this study widen this focus and relate system-wide productivity improvements with system-wide cost savings. The initial thrust of the regulatory section of this study is to validate the existence of reasonable incentive procedures which would enable regulatory agencies to better motivate electric utilities to improve productivity on both the powerplant and system levels. The voluntary incentive format developed in this study was designed to facilitate the link between profit and efficiency which is typically not clear in most regulated market environments. It is concluded that at the present time, many electric utilities in this country could significantly increase the productivity of their base load units, and the adoption of an incentive program of the general type recommended in this study would add to rate of return regulation the needed financial incentives to enable utilities to make such improvements without losing long-run profit. In light of the upcoming oil import target levels and mandatory cutbacks of oil and gas as boiler fuels for electric utilities, the use of incentive programs to encourage more efficient utilization of coal and nuclear base load capacity will become far more inviting over the next two decades.

    The Regulatory Facility Guide (RFG) has been developed for the DOE and contractor facilities located in the state of Ohio. It provides detailed compilations of international, federal, and state transportation-related regulations applicable to shipments originating at destined to Ohio facilities. This RFG was developed as an additional resource tool for use both by traffic managers who must ensure that transportation operations are in full compliance with all applicable regulatory requirements and by oversight personnel who must verify compliance activities.

    The Bonneville Power Administration (BPA) contracted with the Pacific Northwest National Laboratory (PNNL) to provide technical analytical support for system-wide fish passage information (BPA Project No. 2006-010-00). The goal of this project was to produce rigorous technical analysis products using independent analysts and anonymous peer reviewers. In the past, regional parties have interacted with a single entity, the Fish Passage Center to access the data, analyses, and coordination related to fish passage. This project provided an independent technical source for non-routine fish passage analyses while allowing routine support functions to be performed by other well-qualified entities.

    This report provides regulatory guidance for utilities consistent with the changes in the decommissioning rule, 10 CFR50.82 as revised in July 1996. The purpose of this report is to explain the new rule in the context of related industry experience and to provide practical guidance to licensees contemplating or implementing a shutdown. Because the regulatory process is still rapidly evolving, this report reflects only a current status of the acceptable methods and practices derived from a review of the current regulations, guidance documents and industry experience for decommissioning a nuclear power reactor. EPRI anticipates periodic updates of this document to incorporate various utility experiences with decommissioning, and also to reflect any regulatory changes. The report provides a summary of ongoing federal agency and industry activities and the regulatory requirements that are currently applicable, or no longer applicable, to nuclear power plants at the time of permanent shutdown through the early decommissioning stage. The report describes the major components of a typical decommissioning action plan, providing industry experience and guidance for licensees considering or implementing permanent shutdown.

    This report discusses the adequacy of the Economic Regulatory Administration's (ERA) documentation of and control over cases involving alleged petroleum pricing violations. In response to the oil embargo and price increase, Congress passed the Emergency Petroleum Allocation Act of 1973 (15 USC 751). The Government assured compliance by investigating petroleum pricing violations, recovering overcharges, and making restitution to injured parties. Between August 1973 and January 1981, when oil prices were decontrolled, ERA and predecessor federal agencies established and enforced regulations controlling the allocation and pricing of crude oil and refined petroleum products.

    Efforts to deregulate the electric utility industry are not exactly operating at the frontier of reform. The natural gas industry has scouted out the territory, and the same regulatory agency that oversaw that transition will be establishing a few boundaries for the electric utility industry as well. The agency in charge is the Federal Energy Regulatory Commission (FERC), says Elizabeth A. Moler, chair of the FERC in Washington, D.C. The electric power industry, she adds, already is responding positively to the new competitive environment. For example, {open_quotes}state regulators are taking advantage of the opportunities afforded by FERC`s new regulations to provide choice to customers at the retail level,{close_quotes} Moler says. However, potential abuses on the new open market include price fixing and other unfair practices. {open_quotes}A utility that controls all of the generation within a large geographic area may yet control prices. Regulators at the federal and state levels must guard against these problems,{close_quotes} Moler says. In the new world of deregulation, old anti-trust laws may be invoked to ensure that monopolies do not unfarily limit competition.

This project provided an independent technical source for non-routine fish passage analyses while allowing routine support functions to be performed by other well-qualified entities. The Independent Technical Analysis Process (ITAP) was created to provide non-routine analysis for fish and wildlife agencies and tribes in particular and the public in general on matters related to juvenile and adult salmon and steelhead passage through the mainstem hydrosystem. The process was designed to maintain the independence of analysts and reviewers from parties requesting analyses, to avoid potential bias in technical products. The objectives identified for this project were to administer a rigorous, transparent process to deliver unbiased technical assistance necessary to coordinate recommendations for storage reservoir and river operations that avoid potential conflicts between anadromous and resident fish. Seven work elements, designated by numbered categories in the Pisces project tracking system, were created to define and accomplish project goals as follows: (1) 118 Coordination - Coordinate technical analysis and review process: (a) Retain expertise for analyst/reviewer roles. (b) Draft research directives. (c) Send directive to the analyst. (d) Coordinate two independent reviews of the draft report. (e) Ensure reviewer comments are addressed within the final report.     Independent Environmental Impact Assessment (EIA) follow-up verifiers such as monitoring agencies, checkers, supervisors and control officers are active on various construction sites across the world. There are, however, differing views on the value that these verifiers add and very limited learning in EIA has been drawn from independent verifiers. This paper aims to appraise how and to what extent independent EIA follow-up verifiers add value in major construction projects in the developing country context of South Africa. A framework for appraising the role of independent verifiers was established and four South African case studies were examined through a mixture of site visits, project document analysis, and interviews. Appraisal results were documented in the performance areas of: planning, doing, checking, acting, public participating and integration with other programs. The results indicate that independent verifiers add most value to major construction projects when involved with screening EIA requirements of new projects, allocation of financial and human resources, checking legal compliance, influencing implementation, reporting conformance results, community and stakeholder engagement, integration with self-responsibility programs such as environmental management systems (EMS), and controlling records. It was apparent that verifiers could be more creatively utilized in pre-construction preparation, providing feedback of knowledge into assessment of new projects, giving input to the planning and design phase of projects, and performance evaluation. The study confirms the benefits of proponent and regulator follow-up, specifically in having independent verifiers that disclose information, facilitate discussion among stakeholders, are adaptable and proactive, aid in the integration of EIA with other programs, and instill trust in EIA enforcement by conformance evaluation.     Low dissolved oxygen (DO) concentrations are a common water quality problem downstream of hydropower facilities. At some facilities, structural improvements (e.g. installation of weir dams or aerating turbines) or operational changes (e.g., spilling water over the dam) can be made to improve DO levels. In other cases, structural and operational approaches are too costly for the project to implement or are likely to be of limited effectiveness. Despite improvements in overall water quality below dams in recent years, many hydropower projects are unable to meet state water quality standards for DO. Regulatory agencies in the U.S. are considering or implementing dramatic changes in their approach to protecting the quality of the Nations waters. New policies and initiatives have emphasized flexibility, increased collaboration and shared responsibility among all parties, and market-based, economic incentives. The use of new regulatory approaches may now be a viable option for addressing the DO problem at some hydropower facilities. This report summarizes some of the regulatory-related options available to hydropower projects, including negotiation of site-specific water quality criteria, use of biological monitoring, watershed-based strategies for the management of water quality, and watershed-based trading. Key decision points center on the health of the local biological communities and whether there are contributing impacts (i.e., other sources of low DO effluents) in the watershed. If the biological communities downstream of the hydropower project are healthy, negotiation for site-specific water quality standards or biocriteria (discharge performance criteria based on characteristics of the aquatic biota) might be pursued. If there are other effluent dischargers in the watershed that contribute to low DO problems, watershed-scale strategies and effluent trading may be effective. This report examines the value of regulatory approaches by reviewing their use in other

    Public use of nuclear byproducts, especially radioactive isotopes, will require approval by various regulatory agencies. Use of cesium-137 as an irradiation source for sterilizing medical products will require US Nuclear Regulatory Commission (NRC) approval. Two applications have been filed with NRC, and approval is expected soon. Widespread use of irradiation for food products depends on a favorable ruling by the Food and Drug Administration (FDA). A ruling is pending that would permit irradiation of fruits and vegetables up to 100 krad. NRC also controls the use of isotopes in remote power generators, but little regulatory action has been required in recent years. Recent development of radioluminescent (RL) lighting for runway lights has led to interest by commercial manufacturers. At the present time, a license has been issued to at least one manufacturer for sale of tritium-powered runway lights. 28 refs., 1 fig.

    The author addresses the following questions in his presentation: what is USAID; where does the money go and who makes the decisions; where does USAID fund energy programs, and especially renewable energy; who are their `partners`; what is the approach to renewable energy; what in summary, has USAID funded that is relevant to village power. USAID is the foreign aid agency of the US Government. Approximately 75 countries receive regular assistance. The fiscal year 97 budget for the agency is approximately $5.8 billion. About half of the total budget goes to Israel, Egypt, and the countries of the former Soviet Union. These budgeting decisions are geopolitical. Congress earmarks total budgets for a few sectors or subjects, such as family planning. The goal of USAID`s renewable energy programs is simple: They are interested in accelerating the market penetration of commercial technologies. They do not engage in technology R&D. Developing countries have energy needs now, and commercial technologies are available now. USAID has taken note of the interest taken by subsidiaries of US utilities in the past couple of years in bringing their expertise and resources to bear on meeting the challenge of rural energy needs in developing countries. They believe that the entry into the market of these players could be one of the most important catalysts for making the rural energy revolution happen.

    The Hanford Site has hosted similar activities, including both Hanford Summits I and II. The Hanford Summits were two-day televised events to discuss the commitment of the current Presidential administration to the environmental restoration of the Hanford Site. Public involvement and strategic issues established from Hanford Summit I include: Regulatory issues, training and education, economic development and partnership, and technology transfer. Hanford Summit II provided a summary of how Secretary of Energy O`Leary is proceeding on the above strategic issues. The DOE and Westinghouse School for Environmental Excellence frequently offers a six-week course for environmental professionals and workers. Approximately thirty to forty individuals attend the training course, which provides training in environmental regulation compliance. The Hanford Site has hosted two previous International Atomic Energy Agency training courses. The courses lasted two weeks and had approximately eight to ten participants. Nuclear Material Management and Neutron Monitoring were the courses hosted by the Hanford Site.

    This review was performed to evaluate the Economic Regulatory Administrations's (ERA) documentation of and control over cases involving alleged petroleum pricing violations. In response to the oil embargo and price increase, the Congress passed the Emergency Petroleum Allocation Act of 1973 (Act). The Government assured compliance by investigating petroleum pricing violations, recovering overcharges, and making restitution to injured parties. Between August 1973 and January 1981, ERA and predecessor Federal agencies established and enforced regulations controlling the allocation and pricing of crude oil and refined petroleum products. The purpose of this review was to determine whether adequate internal controls were in place to assure that overcharge cases were being resolved in accordance with established guidelines. Specific objectives were to determine whether ERA's internal controls assured that (1) the bases for resolving cases were documented, (2) case settlements were approved by more than one person, and (3) cases were tracked until all overcharge issues were resolved.

    Industry experience and studies conducted by the U.S. Nuclear Regulatory Commission (NRC) have shown that plants are susceptible to a variety of events that can challenge safety during shutdowns. While these events have neither posed nor indicated an undue risk to public health and safety, they do serve to underscore the importance of effective outage planning and control. The NUMARC 91-06 guidelines suggest that proper planning and execution of outage activities can reduce the likelihood and consequences of events, which ultimately enhances safety during shutdown. The Fermi 2, Independent Safety Engineering Group (ISEG) is charged with the independent safety review of the refueling outage plan and its implementation. The ISEG is responsible for performing a detailed and critical review of proposed outage plan prior to the start of the outage, maintaining surveillance of the adequacy and consistency of the {open_quotes}defense-in-depth{close_quotes} provided during the outage, reviewing the outage plan changes for potential vulnerabilities that could affect safety functions, and investigating selected events that emerge during the course of the outage.

    Under the Atomic Energy Act of 1954, as amended, the US Department of Energy (DOE) is obligated to regulate its own activities so as to provide radiation protection for both workers and the public.'' Presidential Executive Order 12088, Federal Compliance with Pollution Control Standards,'' further requires the heads of executive agencies to ensure that all Federal facilities and activities comply with applicable pollution control standards and to take all actions necessary for the prevention, control, and abatement of environmental pollution. This regulatory guide describes the elements of an acceptable effluent monitoring and environmental surveillance program for DOE sites involving radioactive materials. These elements are applicable to all DOE and contractor activities for which the DOE exercises environmental, safety, and health responsibilities, and are intended to be applicable over the broad range of DOE facilities and sites. In situations where the high-priority elements may not provide sufficient coverage of a specific monitoring or surveillance topic, the document provides additional guidance. The high-priority elements are written as procedures and activities that should'' be performed, and the guidance is written as procedures and activities that should'' be performed.     As of 2012, 23 units of nuclear power plants are in operation, but there is no experience of permanent shutdown and decommissioning of nuclear power plant in Korea. It is realized that, since late 1990's, improvement of the regulatory framework for decommissioning has been emphasized constantly from the point of view of International Atomic Energy Agency (IAEA)'s safety standards. And it is known that now IAEA prepare the safety requirement on decommissioning of facilities, its title is the Safe Decommissioning of Facilities, General Safety Requirement Part 6. According to the result of IAEA's Integrated Regulatory Review Service (IRRS) mission to Korea in 2011, it was recommended that the regulatory framework for decommissioning should require decommissioning plans for nuclear installations to be constructed and operated and these plans should be updated periodically. In addition, after the Fukushima nuclear disaster in Japan in March of 2011, preparedness for early decommissioning caused by an unexpected severe accident became also important issues and concerns. In this respect, it is acknowledged that the regulatory framework for decommissioning of nuclear facilities in Korea need to be improved. First of all, we identify the current status and relevant issues of regulatory framework for decommissioning of nuclear power plants compared to the IAEA's safety standards in order to achieve our goal. And then the plan is to be established for improvement of regulatory framework for decommissioning of nuclear power plants in Korea. After dealing with it, it is expected that the revised regulatory framework for decommissioning could enhance the safety regime on the decommissioning of nuclear power plants in Korea in light of international standards.     The purpose of this Handbook is to provide guidance to the regulatory analyst to promote preparation of quality regulatory analysis documents and to implement the policies of the Regulatory Analysis Guidelines of the US Nuclear Regulatory Commission (NUREG/BR-0058 Rev. 2). This Handbook expands upon policy concepts included in the NRC Guidelines and translates the six steps in preparing regulatory analyses into implementable methodologies for the analyst. It provides standardized methods of preparation and presentation of regulatory analyses, with the inclusion of input that will satisfy all backfit requirements and requirements of NRC`s Committee to Review Generic Requirements. Information on the objectives of the safety goal evaluation process and potential data sources for preparing a safety goal evaluation is also included. Consistent application of the methods provided here will result in more directly comparable analyses, thus aiding decision-makers in evaluating and comparing various regulatory actions. The handbook is being issued in loose-leaf format to facilitate revisions. NRC intends to periodically revise the handbook as new and improved guidance, data, and methods become available.

    The U.S. Nuclear Regulatory Commission (NRC) was established in 1974 with the mission to license and regulate the civilian use of nuclear materials for commercial, industrial, academic, and medical uses in order to protect public health and safety, and the environment, and promote the common defense and security. Currently, approximately half (∼49%) of the workforce at the NRC has been with the Agency for less than six years. As part of the Agency's mission, the NRC has partial responsibility for the oversight of the transportation and storage of radioactive materials. The NRC has experienced a significant level of expertise leaving the Agency due to staff attrition. Factors that contribute to this attrition include retirement of the experienced nuclear workforce and mobility of staff within or outside the Agency. Several knowledge management (KM) initiatives have been implemented within the Agency, with one of them including the formation of a Division of Spent Fuel Storage and Transportation (SFST) KM team. The team, which was formed in the fall of 2008, facilitates capturing, transferring, and documenting regulatory knowledge for staff to effectively perform their safety oversight of transportation and storage of radioactive materials, regulated under Title 10 of the Code of Federal Regulations (10 CFR) Part 71 and Part 72. In terms of KM, the SFST goal is to share critical information among the staff to reduce the impact from staff's mobility and attrition. KM strategies in place to achieve this goal are: (1) development of communities of practice (CoP) (SFST Qualification Journal and the Packaging and Storing Radioactive Material) in the on-line NRC Knowledge Center (NKC); (2) implementation of a SFST seminar program where the seminars are recorded and placed in the Agency's repository, Agency-wide Documents Access and Management System (ADAMS); (3) meeting of technical discipline group programs to share knowledge within specialty areas; (4) development of

    On August 29, 1988, the US Nuclear Regulatory Commission (NRC) issued an Advance Notice of Proposed Rulemaking on nuclear plant license renewal and solicited public comments on NUREG-1317, ''Regulatory Options for Nuclear Plant License Renewal.'' NUREG-1317 presents a discussion of fifteen topics involving technical, environmental, and procedural issues and poses a set of related questions. As part of its ongoing task for the NRC, The MITRE Corporation has summarized and analyzed the public comments received. Fifty-three written comments were received. Of these, 83 percent were from nuclear industry representatives; the remaining comments represented federal and state agencies, public interest groups, and a private citizen.

    Purpose: The monitoring and management of radio frequency (RF) exposure is critical for ensuring magnetic resonance imaging (MRI) safety. Commercial MRI scanners can overestimate specific absorption rates (SAR) and improperly restrict clinical MRI scans or the application of new MRI sequences, while underestimation of SAR can lead to tissue heating and thermal injury. Accurate scanner-independent RF dosimetry is essential for measuring actual exposure when SAR is critical for ensuring regulatory compliance and MRI safety, for establishing RF exposure while evaluating interventional leads and devices, and for routine MRI quality assessment by medical physicists. However, at present there are no scanner-independent SAR dosimeters. Methods: An SAR dosimeter with an RF transducer comprises two orthogonal, rectangular copper loops and a spherical MRI phantom. The transducer is placed in the magnet bore and calibrated to approximate the resistive loading of the scanner's whole-body birdcage RF coil for human subjects in Philips, GE and Siemens 3 tesla (3T) MRI scanners. The transducer loop reactances are adjusted to minimize interference with the transmit RF field (B{sub 1}) at the MRI frequency. Power from the RF transducer is sampled with a high dynamic range power monitor and recorded on a computer. The deposited power is calibrated and tested on eight different MRI scanners. Whole-body absorbed power vs weight and body mass index (BMI) is measured directly on 26 subjects. Results: A single linear calibration curve sufficed for RF dosimetry at 127.8 MHz on three different Philips and three GE 3T MRI scanners. An RF dosimeter operating at 123.2 MHz on two Siemens 3T scanners required a separate transducer and a slightly different calibration curve. Measurement accuracy was ?3%. With the torso landmarked at the xiphoid, human adult whole?body absorbed power varied approximately linearly with patient weight and BMI. This indicates that whole-body torso SAR is on average

    This paper describes the strategies and process used by the U.S. Department of Energy’s (DOE) nuclear Material Protection, Control and Accounting (MPC&A) Regulatory Development Project (RDP) to restructure its support for MPC&A regulations in the Russian Federation. The RDP adopted a project management approach to defining, implementing, and managing an effective nuclear regulatory structure. This approach included defining and developing the regulatory documents necessary to provide the Russian Federation with a comprehensive regulatory structure that supports an effective and sustainable MPC&A Program in Russia. This effort began in February 2005, included a series of three multi-agency meetings in April, June, and July, and culminated in August 2005 in a mutually agreed-upon plan to define and populate the nuclear regulatory system in the Russian Federation for non-military, weapons-usable material. This nuclear regulatory system will address all non-military Category I and II nuclear material at the Russian Federal Atomic Energy Agency (Rosatom), the Russian Agency for Industry (Rosprom), and the Federal Agency for Marine and River Transport (FAMRT) facilities; nuclear material in transport and storage; and nuclear material under the oversight of the Federal Environmental, Industrial and Nuclear Supervisory Service of Russia (Rostechnadzor). The Russian and U.S. MPC&A management teams approved the plan, and the DOE National Nuclear Security Administration’s (NNSA) NA-255, Office of Infrastructure and Sustainability (ONIS), is providing funding. The Regulatory Development Project is managed by the Pacific Northwest National Laboratory (PNNL) for the U.S. Department of Energy’s (DOE) NNSA.

    With the constant implementation of complex and restrictive state and federal clean air laws, a facility must have a comprehensive understanding of the types and amount of emissions associated with the facility`s operations. Knowledge of the facility`s emissions is essential to assess the operational impacts of current and upcoming legislation. Lawrence Livermore National Laboratory (LLNL), located in California, is regulated by federal, state, and local air quality agencies. Of most concern to the facility is California`s Assembly Bill 2588 (also known as the {open_quotes}Air Toxics Hot Spots{close_quotes} program) and the federal Title III, Title V, and Title VI provisions of the Clean Air Act as amended in 1990. Because of the complex regulatory requirements, LLNL needed a system to calculate and classify air emissions by each applicable regulatory program. This paper outlines the development of LLNL`s comprehensive emissions inventory known as the Emissions Measurement and Information Tracking System (EMITS).

    The major objective of this report is to help the US Nuclear Regulatory Commission (NRC) in its regulatory mission, particularly with respect to improving the use of cost-benefit analysis and the economic evaluation of resources within the NRC. The objectives of this effort are: (1) to identify current and future NRC requirements (e.g., licensing) for valuing nonmarket goods; (2) to identify, highlight, and present the relevant efforts of selected federal agencies, some with over two decades of experience in valuing nonmarket goods, in this area; and (3) to review methods for valuing nonmarket impacts and to provide estimats of their magnitudes. Recently proposed legislation may result in a requirement for not only more sophisticated valuation analyses, but more extensive applications of these techniques to issues of concern to the NRC. This paper is intended to provide the NRC with information to more efficiently meet such requirements.

    This report is a legal study prepared to provide a review of the substantive and procedural laws of each regulatory jurisdiction that may affect implementation of the PURPA standards, and to summarize the current state of consideration and implementation of policies and rate designs similar or identical to the PURPA standards by state regulatory agencies and nonregulated utilities. This report is divided into three sections. The first section, the Introduction, summarizes the standards promulgated by PURPA and the results of the legal study. The second section, State Regulatory Law and Procedure, summarizes for each state or other ratemaking jurisdiction: (1) general constitutional and statutory provisions affecting utility rates and conditions of service; (2) specific laws or decisions affecting policy or rate design issues covered by PURPA standards; and (3) statutes and decisions governing administrative procedures, including judicial review. A chart showing actions taken on the policy and rate design issues addressed by PURPA is also included for each jurisdiction, and citations to relevant authorities are presented for each standard. State statutes or decisions that specifically define a state standard similar or identical to a PURPA standard, or that refer to one of the three PURPA objectives, are noted. The third section, Nonregulated Electric Utilities, summarizes information available on nonregulated utilities, i.e., publicly or cooperatively owned utilities which are specifically exempted from state regulation by state law.

    This paper reviews calculation tools available for quantifying the greenhouse gas emissions associated with different types of public transit service, and their usefulness in helping a transit agency to reduce its carbon footprint through informed vehicle and fuel procurement decisions. Available calculators fall into two categories: registry/inventory based calculators most suitable for standardized voluntary reporting, carbon trading, and regulatory compliance; and multi-modal life cycle analysis calculators that seek comprehensive coverage of all direct and indirect emissions. Despite significant progress in calculator development, no single calculator as yet contains all of the information needed by transit agencies to develop a truly comprehensive, life cycle analysis-based accounting of the emissions produced by its vehicle fleet operations, and for a wide range of vehicle/fuel technology options.

    This imperfect analogy likens the history and current status of public utility regulation to a military campaign. Clearly, the relationship between regulators and utilities has not always been combative, but intermittent conflict has necessarily characterized the relationship. Nonetheless, this military analogy describes some of the elements of the history of regulation and may have implications for regulatory policy in the near term. The scene is a battlefield headquarters not far from the heat of the conflict. The commanders of regulatory units are gathered. In the distance, the low rumble of troop movements can be heard. Ladies and gentlemen, please take your seats. As you are aware, recent developments have placed regulatory forces in extreme jeopardy. Our forces are under stress, and though they continue to fight, the confusion of the current situation is beginning to take its toll. In most cases, reinforcements have been denied and our lines of logistical support have been weakened. Without effective and rapid action on our part, the regulatory battle will be lost and we will be driven from the field. Until consumers are well-enough armed to protect themselves, a process that is certainly suspect and potentially time-consuming, they will be powerless and undoubtedly victimized.
