    The loan guarantee program authorized in Title XVII of EPACT2005 is not included in the Annual Energy Outlook 2007, because the Federal Credit Reform Act of 1990 requires congressional authorization of loan guarantees in an appropriations act before a federal agency can make a binding loan guarantee agreement. As of October 2006, Congress had not provided the legislation necessary for the Department of Energy (DOE) to implement the loan guarantee program (see Legislation and Regulations). In August 2006, however, DOE invited firms to submit pre-applications for the first $2 billion in potential loan guarantees.

    The U.S. Department of Housing and Urban Development (HUD) recently announced the creation of a pilot loan program for home energy improvements. The PowerSaver loan program is a new, energy-focused variant of the Title I Property Improvement Loan Insurance Program (Title I Program) and is planned for introduction in early 2011. The PowerSaver pilot will provide lender insurance for secured and unsecured loans up to $25,000 to single family homeowners. These loans will specifically target residential energy efficiency and renewable energy improvements. HUD estimates the two-year pilot will fund approximately 24,000 loans worth up to $300 million; the program is not capped. The Federal Housing Administration (FHA), HUD's mortgage insurance unit, will provide up to $25 million in grants as incentives to participating lenders. FHA is seeking lenders in communities with existing programs for promoting residential energy upgrades.

    The FHFA regulates Fannie Mae, Freddie Mac, and the 12 Federal Home Loan Banks (the government-sponsored enterprises - GSEs). On June 18, 2009, James B. Lockhart III, then Director of FHFA, released a letter expressing concern about the negative impact of energy loan tax assessment programs (ELTAPs) - also known as Property Assessed Clean Energy (PACE) programs - on both the housing finance system and homeowner program participants. Subsequently, a number of PACE proponents responded to the concerns laid out in the FHFA letter. In early Fall 2009, word circulated that FHFA was planning to follow its June letter with guidance to other agencies, possibly including Fannie Mae and Freddie Mac, discouraging them from buying loans on properties subject to PACE-type assessment liens. This triggered a second round of stakeholder letters, several of which were addressed to President Obama. On October 18, 2009, the White House, in what some believe was an attempt to obviate the need for FHFA guidance, released a Policy Framework for PACE Financing Programs that outlined best practices guidance for homeowner and lender protection. As of February 2010, FHFA and the GSEs have agreed to monitor PACE programs and work with stakeholders and the Administration to consider additional guidance beyond the Policy Framework and to collect more information on PACE program efficacy and risks. A summary of the communications timeline and highlights of the communications are provided.

    Title XVII of the Energy Policy Act 2005 (EPACT) authorized the Department of Energy (DOE) to issue loan guarantees for projects involving new or improved technologies to avoid, reduce, or sequester greenhouse gases (GHGs). The law specified that the amount of the guarantee would be up to 80% of a project's cost. EPACT2005 also specified that DOE must receive funds equal to the subsidy cost either through the federal appropriations process or from the firm receiving the guarantee. As discussed in Annual Energy Outlook 2007, this program, by lowering borrowing costs, can have a major impact on the economics of capital-intensive technologies.

    In 1988 the Governor`s Energy Management Center of Texas received approval from the US Department of Energy to establish a $98.6 million state-wide retrofit demonstration revolving loan program to fund energy-conserving retrofits in state, public school, and local government buildings. As part of this program, a first-of-its-kind, statewide Monitoring and Analysis Program (MAP) was established to verify energy and dollar savings of the retrofits, reduce energy costs by identifying operational and maintenance improvements, improve retrofit selection in future rounds of the LoanSTAR program, and initiate a data base of energy use in institutional and commercial buildings located in Texas. This report discusses the LoanSTAR MAP with an emphasis on the process of acquiring and analyzing data to measure savings from energy conservation retrofits when budgets are a constraint. This report includes a discussion of the program structure, basic measurement techniques, data archiving and handling, data reporting and analysis, and includes selected examples from LoanSTAR agencies.     The goal of the U.S. Department of Energy's (DOE) Loaner Program is to increase the awareness, deployment, and use of electric vehicles (EVs) in Federal fleets. The Loaner Program accomplishes this by providing free EVs to Federal fleets on a loaner basis, generally for 1 or 2 months. The Program partners DOE with six electric utilities, with DOE providing financial support and some leads on Federal fleets interested in obtaining EVs. The utilities obtain the vehicles, identify candidate loaner fleets, loan the vehicles, provide temporary charging infrastructure, provide overall support to participating Federal fleets, and support fleets with their leasing decisions. While the utilities have not had the success initially envisioned by themselves, DOE, the Edison Electric Institute, and the Electric Vehicle Association of the Americas, the utilities can not be faulted for their efforts, as they are not the entity that makes the ultimate lease or no-lease decision. Some external groups have suggested to DOE that they direct other federal agencies to change their processes to make loaning vehicles easier; this is simply not within the power of DOE. By law, a certain percentage of all new vehicle acquisitions are supposed to be alternative fuel vehicles (AFV); however, with no enforcement, the federal agencies are not compelled to lease AFVs such as electric vehicles.

    Qualified Energy Conservation Bonds (QECBs) are federally-subsidized debt instruments that enable state, tribal, and local government issuers to borrow money to fund a range of qualified energy conservation projects. QECBs offer issuers very attractive borrowing rates and long terms, and can fund low-interest energy efficiency loans for home and commercial property owners. Saint Louis County, MO recently issued over $10 million of QECBs to finance the Saint Louis County SAVES residential energy efficiency loan program. The county's experience negotiating QECB regulations and restrictions can inform future issuers.

The Federal Buildings Supplemental Survey (FBSS) was conducted by EIA in conjunction with DOE`s Office of Federal Energy Management Programs (OFEMP) to gain a better understanding of how Federal buildings use energy. This report presents the data from 881 completed telephone interviews with Federal buildings in three Federal regions. These buildings were systematically selected using OFEMP`s specifications; therefore, these data do not statistically represent all Federal buildings in the country.     The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    Network-centric systems that depend on mobile wireless ad hoc networks for their information exchange require detailed analysis to support their development. In many cases, this critical analysis is best provided with high-fidelity system simulations that include the effects of network architectures and protocols. In this research, we developed a high-fidelity system simulation capability using an HLA federation. The HLA federation, consisting of the Umbra system simulator and OPNET Modeler network simulator, provides a means for the system simulator to both affect, and be affected by, events in the network simulator. Advances are also made in increasing the fidelity of the wireless communication channel and reducing simulation run-time with a dead reckoning capability. The disbursements will partially finance the development of a geothermal well field in the Imperial Valley of California to supply a 25-MW(e) (net) power plant. Activities associated with the power plant in addition to operation are excavation and construction of the facility and associated systems (such as cooling towers). Significant environmental impacts, as defined in Council on Environmental Quality regulation 40 CFR Part 1508.27, are not expected to occur as a result of this project. Minor impacts could include the following: local degradation of ambient air quality due to particulate and/or hydrogen sulfide emissions, temporarily increased ambient noise levels due to drilling and construction activities, and increased traffic. Impacts could be significant in the event of a major spill of geothermal fluid, which could contaminate groundwater and surface waters and alter or eliminate nearby habitat. Careful land use planning and engineering design, implementation of mitigation measures for pollution control, and design and implementation of an environmental monitoring program that can provide an early indication of potential problems should ensure that impacts, except for certain accidents, will be minimized.

    This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    This document was prepared at the request of the U.S. Department of Energy's (DOE's) Federal Energy Management Program (FEMP) under its Technical Guidance and Assistance and Project Financing Programs. The purpose was to provide an estimate of the national potential for combined heat and power (also known as CHP; cogeneration; or cooling, heating, and power) applications at federal facilities and the associated costs and benefits including energy and emission savings. The report provides a broad overview for the U.S. Department of Energy (DOE) and other agencies on when and where CHP systems are most likely to serve the government's best interest. FEMP's mission is to reduce the cost to and environmental impact of the federal government by advancing energy efficiency and water conservation, promoting the use of renewable energy, and improving utility management decisions at federal sites. FEMP programs are driven by its customers: federal agency sites. FEMP monitors energy efficiency and renewable energy technology developments and mounts ''technology-specific'' programs to make technologies that are in strong demand by agencies more accessible. FEMP's role is often one of helping the federal government ''lead by example'' through the use of advanced energy efficiency/renewable energy (EERE) technologies in its own buildings and facilities. CHP was highlighted in the Bush Administration's National Energy Policy Report as a commercially available technology offering extraordinary benefits in terms of energy efficiencies and emission reductions. FEMP's criteria for emphasizing a technology are that it must be commercially available; be proven but underutilized; have a strong constituency and momentum; offer large energy savings and other benefits of interest to federal sites and FEMP mission; be in demand; and carry sufficient federal market potential. As discussed in the report, CHP meets all of these criteria. Executive Order 13123 directs federal facilities to use CHP when life-cycle costs indicate energy reduction goals will be met. FEMP can assist facilities to conduct this analysis. The model developed for this report estimates the magnitude of CHP that could be implemented under various performance and economic assumptions associated with different applications. This model may be useful for other energy technologies. It can be adapted to estimate the market potential in federal buildings for any energy system based on the cost and performance parameters that a user desires to assess. The model already incorporates a standard set of parameters based on available data for federal buildings including total building space, building type, energy use intensity, fuel costs, and the performance of many prime movers commonly used in CHP applications. These and other variables can be adjusted to meet user needs or updated in the future as new data become available.

Originally conceived in 2000 and terminated (as a WPA activity) at the end of FY 2011, the ALP has resulted in the installation of anemometers at 90 locations.     Typically, the Federal building stock is referred to as a group of about one-half million buildings throughout the United States. Additional information beyond this level is generally limited to distribution of that total by agency and maybe distribution of the total by state. However, additional characterization of the Federal building stock is required as the Federal sector seeks ways to implement efficiency projects to reduce energy and water use intensity as mandated by legislation and Executive Order. Using a Federal facility database that was assembled for use in a geographic information system tool, additional characterization of the Federal building stock is provided including information regarding the geographical distribution of sites, building counts and percentage of total by agency, distribution of sites and building totals by agency, distribution of building count and floor space by Federal building type classification by agency, and rank ordering of sites, buildings, and floor space by state. A case study is provided regarding how the building stock has changed for the Department of Energy from 2000 through 2008.

    The Energy Policy Act of 2005 authorized the Department of Energy to guarantee loans for new or significantly improved energy production technologies that avoid, reduce, or sequester air pollutants and other greenhouse gases. As of December 2008, Congress authorized the Department to make $42.5 billion in loan guarantees to support innovative energy projects. These guarantees were authorized for up to 80% of the total project costs and were designed to promote the commercial use of innovative technologies. Under the terms of the Act, the loan guarantees are contingent upon reasonable prospect of repayment by the borrower. Consistent with the Energy Policy Act, the Department is responsible for soliciting and evaluating loan applications, approving loan guarantees, and monitoring project and loan guarantee performance. through December 2008, the Department had issued five solicitations for projects that support innovative clean coal technologies, energy efficiency, renewable energy, advanced electricity transmission and distribution, and nuclear and fossil energy projects. These solicitations were issued in three phases with the first in August 2006, and the final in September 2008. Eleven substantially complete applications requesting approximately $8.2 billion in loan guarantees had been received by the Department in response to the first solicitation. The Department had begun the review of applications and was in the process of completing due diligence procedures necessary to evaluate projects received in response to the first solicitation. Under current plans, the Department is to issue its first loan guarantees in the spring of 2009. Because of the importance of this program as part of an effort to address the Nation's most challenging and pressing energy needs; and, the potential risk of loss to the United States taxpayers should default occur, we initiated this review to evaluate the Department's progress in establishing internal and operational controls over its Loan Guarantee Program.

    Under the Clean Energy Works (CEW) program, Craft3 developed a loan product that widened access to financing for homeowners, offered long term funding, and collected repayments through the customer?s utility bill. The program?s success led Craft3 to pursue the sale of the loan portfolio to both mitigate its own risks and replenish funds for lending. This sale breaks new ground for energy efficiency finance and is notable as it was completed even with many novel program design elements. It replenished Craft3?s program capital and uncovered some valuable lessons that may facilitate future transactions. However, the lack of data history and the unproven nature of the loan portfolio meant that Craft3 had to limit the risk of losses to Self-Help, the purchaser of the portfolio. It remains to be seen whether this experience will pave the way for more sales of on-bill energy efficiency loan portfolios. This case study illustrates how certain program design decisions can sometimes both facilitate programmatic objectives and possibly present challenges for the sale of a portfolio of energy efficiency loans.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    Federal mandate (EPACT 2005) requires that federal buildings install advanced electrical meters-meters capable of providing data at least daily and measuring the consumption of electricity at least hourly. This work presents selected advanced metering implementations to understand some of the existing practices related to data capture and to understand how the data is being translated into information and knowledge that can be used to improve building energy and operational performance to meet federal energy reduction mandates. This study highlights case studies to represent some of the various actions that are being taken based on the data that are being collected to improve overall energy performance of these buildings. Some of these actions include- individualized tenant billing and energy forecasting, benchmarking, identifying energy conservation measures, measurement and verification.

    Utility financing of energy efficient measures becomes easier to accomplish with the two new alternative financing guidance memoranda, released April 17, 1998, that address the use of utility incentives for Federal facilities. The memoranda have been approved by the Alternative Financing Guidance Committee on the Interagency Energy Management Task Force. The memoranda include: (1) Policy Statement No. 001: Authority to Sole Source Utility Service Contracts as Referenced in Section 152 of the Energy Policy Act (EPACT) of 1992; and (2) Policy Statement No. 002: Congressional Notification for Utility Projects Under the Authority of Section 152 of the Energy Policy Act (EPACT) of 1992. The purpose for developing the financing memoranda was to address specific issues within current Federal procurement regulations that require clarification or guidance. This new guidance will allow for increased use of utility incentives as a means of financing energy efficient and life cycle cost-effective projects in Federal facilities.

    The Federal Radiological Monitoring and Assessment Center (FRMAC) is a federal emergency response asset whose assistance may be requested by the Department of Homeland Security (DHS), the Department of Defense (DoD), the Environmental Protection Agency (EPA), the Nuclear Regulatory Commission (NRC), and state and local agencies to respond to a nuclear or radiological incident. It is an interagency organization with representation from the Department of Energys National Nuclear Security Administration (DOE/NNSA), the Department of Defense (DoD), the Environmental Protection Agency (EPA), the Department of Health and Human Services (HHS), the Federal Bureau of Investigation (FBI), and other federal agencies. FRMAC, in its present form, was created in 1987 when the radiological support mission was assigned to the DOEs Nevada Operations Office by DOE Headquarters. The FRMAC asset, including its predecessor entities, was created, grew, and evolved to function as a response to radiological incidents. Radiological emergency response exercises showed the need for a coordinated approach to managing federal emergency monitoring and assessment activities. The mission of FRMAC is to coordinate and manage all federal radiological environmental monitoring and assessment activities during a nuclear or radiological incident within the United States in support of state,local, tribal governments, DHS, and the federal coordinating agency. Radiological emergency response professionals with the DOEs national laboratories support the Radiological Assistance Program (RAP), National Atmospheric Release Advisory Center (NARAC), the Aerial MeasuringSystem (AMS), and the Radiation Emergency Assistance Center/Training Site (REAC/TS). These teams support the FRMAC to provide: ? Atmospheric transport modeling ? Radiation monitoring ? Radiological analysis and data assessments ? Medical advice for radiation injuries In support of field operations, the FRMAC provides geographic information systems, communications, mechanical, electrical, logistics, and administrative support. The size of the FRMAC is tailored to the incident and is comprised of emergency response professionals drawn from across the federal government. State and local emergency response teams may also integrate their operations with FRMAC, but are not required to.

    To accomplish Federal goals for renewable energy, sustainability, and energy security, large-scale renewable energy projects must be developed and constructed on Federal sites at a significant scale with significant private investment. The U.S. Department of Energy's Federal Energy Management Program (FEMP) helps Federal agencies meet these goals and assists agency personnel navigate the complexities of developing such projects and attract the necessary private capital to complete them. This guide is intended to provide a general resource that will begin to develop the Federal employee's awareness and understanding of the project developer's operating environment and the private sector's awareness and understanding of the Federal environment. Because the vast majority of the investment that is required to meet the goals for large-scale renewable energy projects will come from the private sector, this guide has been organized to match Federal processes with typical phases of commercial project development. The main purpose of this guide is to provide a project development framework to allow the Federal Government, private developers, and investors to work in a coordinated fashion on large-scale renewable energy projects. The framework includes key elements that describe a successful, financially attractive large-scale renewable energy project.
