    This report, in fulfillment of a license requirement, presents the results of long-term surveillance and maintenance activities conducted by the U.S. Department of Energy (DOE) Office of Legacy Management in 2013 at six uranium mill tailings disposal sites reclaimed under Title II of the Uranium Mill Tailings Radiation Control Act (UMTRCA) of 1978. These activities verified that the UMTRCA Title II disposal sites remain in compliance with license requirements. DOE manages six UMTRCA Title II disposal sites under a general license granted by the U.S. Nuclear Regulatory Commission (NRC) established at Title 10 Code of Federal Regulations Part 40.28. Reclamation and site transition activities continue at other sites, and DOE ultimately expects to manage approximately 27 Title II disposal sites. Long-term surveillance and maintenance activities and services for these disposal sites include inspecting and maintaining the sites; monitoring environmental media and institutional controls; conducting any necessary corrective action; and performing administrative, records, stakeholder services, and other regulatory functions. Annual site inspections and monitoring are conducted in accordance with site-specific long-term surveillance plans (LTSPs) and procedures established by DOE to comply with license requirements. Each site inspection is performed to verify the integrity of visible features at the site; to identify changes or new conditions that may affect the long-term performance of the site; and to determine the need, if any, for maintenance, follow-up inspections, or corrective action. LTSPs and site compliance reports are available online at http://www.lm.doe.gov

    Title V of the Federal Clean Air Act Amendments of 1990 requires federal operating permits for all major sources of air pollution. In 1992, Title 40, Part 70 of the Code of Federal Regulations (40 CFR Part 70) codified the law s requirements. These federal regulations, entitled Operating Permit Program, define the minimum requirements for state administered operating permit programs. The intent of Title V is to put into one document all requirements of an operating permit. General Permits for oil and gas facilities may be preferred if the facility can comply with all permit requirements. If greater flexibility than allowed by the General Permit is required, then the facility should apply for an individual Title V permit. General Permits are designed to streamline the permitting process, shorten the time it takes to obtain approval for initial and modified permits. The advantages of the General Permit include reduced paperwork and greater consistency because the permits are standardized. There should be less uncertainty because permit requirements will be known at the time of application. Approval times for Initial and modified General Permits should be reduced. Lengthy public notice procedures (and possible hearings) will be required for only the initial approval of the General Permit and not for each applicant to the permit. A disadvantage of General Permits is reduced flexibility since the facility must comply with the requirements of a standardized permit.

    The Clean Air Act of 1990 (CAA) mandated that all facilities classified as major were to obtain a Federal Title V operating permit. In addition, any facility, either major or minor, which emits certain chemicals or compounds above a specific single quantity limit or a total aggregate limit are subject to Title III requirements and are required to obtain a Title V permit as well. The problem with obtaining a Title V permit for Title III substances is there is limited data, at least for the utilities sources, on emission factors and emission rates for many of the Title III listed chemical compounds. In addition, the emission data that exists is very conservative, and if used, would show the facilities to be significant emitters of hazardous air emissions, while actual emissions are significantly less. This could lead a facility to applying for a Title V permit unnecessarily, a time consuming process at best. In Iowa, facilities submitted the first Title V permit applications in 1994. The Iowa Department of Natural Resources is currently in the process of reviewing the submittals prior to issuing operating permits. Title III has not been addressed at all in the submittals and therefore will not be included in this round of finished permits that are to be issued. The outcome of this is that the Title V permits will have to be opened and amended to include the applicable Title III operating conditions and constraints. This paper will examine the areas where Title III and Title V collide and the potential permitting and enforcement issues that will have to be faced by the facilities that operate under these permits. This paper is based on the opinions of two of the three responsible parties (facilities and consultants) that are dealing with the potential permitting and enforcement wreckage before the collision occurs.

    This report summarizes the Nuclear Regulatory Commission staff`s observations and lessons learned from the five License Renewal Demonstration Program (LRDP) site visits performed by the staff from March 25, 1996, through August 16, 1996. The LRDP was a Nuclear Energy Institute (NEI) program intended to assess the effectiveness of the guidance provided by NEI 95-10, Revision 0, {open_quotes}Industry Guideline for Implementing the Requirements of 10 CFR Part 54 - The License Renewal Rule,{close_quotes} to implement the requirements of Title 10 of the Code of Federal Regulations, Part 54 (10 CFR Part 54), {open_quotes}Requirements for Renewal of Operating Licenses for Nuclear Power Plants.{close_quotes} In general, NEI 95-10 appeared to contain the basic guidance needed for scoping, screening, identifying aging effects, developing aging management programs, and performing time-limited aging analyses. However, inconsistent implementation of this guidance in some areas was an indication that clarification of existing guidance and/or the inclusion-of some new guidance may be needed for applicants to develop a license renewal program that is consistent with the intent of the rule.

    Catalytic oxidizers have been used to reduce VOC emissions from various industries including printing, chemical, paint, coatings, etc. A catalytic oxidizer uses a catalyst to reduce the operating temperature for combustion to approximately 600 F, which is substantially lower than thermal oxidation unit. Title V requirements have renewed the debate on the best methods to assure compliance of catalytic oxidizers, with some suggesting the need for continuous emission monitoring equipment. This paper will discuss the various aspects of catalytic oxidation and consider options such as monitoring inlet/outlet temperatures, delta T across the catalyst, periodic laboratory testing of catalyst samples, and preventive maintenance procedures as means of assuring continuous compliance.

    Pursuant to the passage of the Clean Air Act Amendments of 1990, the US Environmental Protection Agency has promulgated what are known as Title V permitting requirements for major sources of air pollutants, including pipeline operations. In contrast to most existing air permitting programs, the new Title V regulations will require periodic certification of compliance with applicable air regulations. In the same way that water dischargers report their own discharge violations to regulatory agencies pursuant to the NPDES permitting system, Title V permittees must implement an acceptable monitoring program and similarly report violations of permit conditions or applicable air regulations. Only those facilities whose potential emissions are less than or can be controlled to be less than certain regulatory limits will be exempt from standard Title V permitting. If a facility`s throughput or the concentration levels of certain volatile toxic levels in a particular crude or natural gas were to exceed corresponding regulatory limits, then the facility could be in violation. If an operator were to expand a field, then the changes in the gathering system and emission levels could constitute a violation. Constraints on operations can be avoided by careful strategizing of an operator`s Title V permit application.

    The EPRI FCODE-BETA fuel performance code is the mechanistic model portion for the SPEAR-BETA fuel reliability code, which was developed for EPRI by Entropy Limited. FCODE-BETA was assessed by Battelle, Pacific Northwest Laboratories, and Combustion Engineering, Inc., for adequacy in simulating fuel performance in fuel licensing proceedings. The assessment included a detailed review of those thermal and mechanical performance models of greatest importance to fuel licensing, including fission gas release, fuel temperatures, and cladding uniform strain. It was concluded that the code is inadequate for licensing calculations in its present form. Recommendations for modeling and usability improvements are made.

    For the past decade, the non-residential portion of California's Title-24 building energy standard has relied on DOE-2.1E as the reference computer simulation program for development as well as compliance. However, starting in 2004, the California Energy Commission has been evaluating the possible use of Energy Plus as the reference program in future revisions of Title-24. As part of this evaluation, the authors converted the Alternate Compliance Method (ACM) certification test suite of 150 DOE-2 files to Energy Plus, and made parallel DOE-2 and Energy Plus runs for this extensive set of test cases. A customized version of DOE-2.1E named doe2ep was developed to automate the conversion process. This paper describes this conversion process, including the difficulties in establishing an apples-to-apples comparison between the two programs, and summarizes how the DOE-2 and Energy Plus results compare for the ACM test cases.

    The Solid Waste Retrieval Facility--Phase 1 (Project W113) will provide the infrastructure and the facility required to retrieve from Trench 04, Burial ground 4C, contact handled (CH) drums and boxes at a rate that supports all retrieved TRU waste batching, treatment, storage, and disposal plans. This includes (1) operations related equipment and facilities, viz., a weather enclosure for the trench, retrieval equipment, weighing, venting, obtaining gas samples, overpacking, NDE, NDA, shipment of waste and (2) operations support related facilities, viz., a general office building, a retrieval staff change facility, and infrastructure upgrades such as supply and routing of water, sewer, electrical power, fire protection, roads, and telecommunication. Title I design for the operations related equipment and facilities was performed by Raytheon/BNFL, and that for the operations support related facilities including infrastructure upgrade was performed by KEH. These two scopes were combined into an integrated W113 Title II scope that was performed by Raytheon/BNFL. Volume 1 provides a comprehensive narrative description of the proposed facility and systems, the basis for each of the systems design, and the engineering assessments that were performed to support the technical basis of the Title II design. The intent of the system description presented is to provide WHC an understanding of the facilities and equipment provided and the A/E`s perspective on how these systems will operate.

    The regulation of hazardous air pollutants by Title III of the Clean Air Act Amendments of 1990 has a potential wide-ranging impact for the natural gas industry. Title III includes a list of 189 hazardous air pollutants (HAPs) which are targeted for reduction. Under Title III, HAP emissions from major sources will be reduced by the implementation of maximum achievable control technology (MACT) standards. If the source is defined as a major source, it must also comply with Title V (operating permit) and Title VII (enhanced monitoring) requirements. This presentation will review Title III`s effect on the natural gas industry by discussing the regulatory requirements and schedules associated with MACT as well as the control technology options available for affected sources.

    This paper reports that Kirkland As, Oslo, has received a geophysical survey and exploration contract (GSEC) in a sizzling exploration and development theater off the Philippines. The license covers about 6,000 sq miles of undisputed waters, with depths mostly less than 300 ft, and lies in the Reed Bank area off Northwest Palawan Island, where several major oil and gas strikes have been made recently. Kirkland has 1 year in which to carry out its seismic work commitment. The terms of the GSEC then give an option to drill one well in a 6 month period. Once the results have been analyzed, the company can either drill another well or enter into a service contract for the license. Kirkland has a 65% share in the license, with the remainder split between Philippine companies Philodrill Corp., Beguet Mining Corp. subsidiary Petrofields, and Seafront Resources Corp. The Philippines is one of Kirkland's main areas of activity, the Kirkland Commercial Manager Ralph Baxter.

    Deep geological disposal of long-lived radioactive waste is currently considered a major challenge. Until present, only three deep geological disposal facilities have worldwide been operated: the Asse experimental repository (1967-1978) and the Morsleben repository (1971-1998) in Germany as well as the Waste Isolation Pilot Plant (WIPP) in the USA (1999 to present). Recently, the licensing procedure for the fourth such facility, the German Konrad repository, ended with a positive ''Planfeststellung'' (plan approval). With its plan approval decision, the licensing authority, the Ministry of the Environment of the state of Lower Saxony, approved the single license needed pursuant to German law to construct, operate, and later close down this facility.

    Through the Atomic Energy Act, Congress made is possible for the public to get a full and fair hearing on civilian nuclear matters. Individuals who are directly affected by any licensing action involving a facility producing or utilizing nuclear materials may participate in a formal hearing, on the record, before independent judges on the Atomic Safety and Licensing Board Panel (ASLBP or Panel). Frequently, in deciding whether a license, permit, amendment, or extension should be granted to a particular applicant, the Panel members must be more than mere umpires. If appropriate, they are authorized to go beyond the issues the parties place before them in order to identify, explore, and resolve significant questions involving threats to the public health and safety that come to a board`s attention during the proceedings. This brochure explains the purpose of the panel.     The Next Generation Nuclear Plant (NGNP) will be a licensed commercial high temperature gas-cooled reactor (HTGR) plant capable of producing the electricity and high temperature process heat for industrial markets supporting a range of end-user applications. The NGNP Project has adopted the 10 CFR 52 Combined License (COL) application process, as recommended in the Report to Congress, dated August 2008, as the foundation for the NGNP licensing strategy. NRC licensing of the NGNP plant utilizing this process will demonstrate the efficacy of licensing future HTGRs for commercial industrial applications. This white paper is one in a series of submittals that will address key generic issues of the COL priority licensing topics as part of the process for establishing HTGR regulatory requirements.

    This summary describes the operations to clean up the equipment of the Nuclear Licensed Facility 57 (NLF 57). Due to the diversity of the research and development work carried out on the reprocessing of spent fuel in it, this installation is emblematic of many of the technical and organizational issues liable to be encountered in the final closure of nuclear facilities. The French atomic energy commission's center at Fontenay aux Roses (CEA-FAR) was created in 1946 to house pile ZOE. Laboratories for fuel cycle research were installed in existing buildings at the site. Work was later concentrated on spent fuel reprocessing, in a pilot workshop referred to as the 'Usine Pu'. In the early sixties, after the dismantling of these first generation facilities, a radiochemistry laboratory dedicated to research and development work on reprocessing was constructed, designated Building 18. During the same decade, more buildings were added: Building 54, storehouses and offices, Building 91, a hall and laboratories for chemical engineering research on natural and depleted uranium. Together, these three building constitute NLF 57. Building 18 architecture featured four similar modules. Each module had three levels: a sub-level consisting of technical galleries and rooms for the liquid effluent tanks, a ground floor and roof space in which the ventilation was installed. Offices, change rooms, four laboratories and a hall were situated on the ground floor. The shielded lines were installed in the laboratories and the halls. Construction of the building took place between 1959 and 1962, and its commissioning began in 1961. The research and development programs performed in NLF 57 related to studies of the reprocessing of spent fuel, including dry methods and the Purex process, techniques for the treatment of waste (vitrification, alpha waste decontamination, etc.) as well as studies and production of transuranic elements for industry and research. In addition to this work, the necessary methods of analysis for monitoring it were also developed. The research and development program finally ended on 30 June 1995. The NLF 57 cleanup program was intended to reduce the nuclear and conventional hazards and minimize the quantities of HLW and MLW during the subsequent dismantling work. To facilitate the organization of the cleanup work, it was divided into categories by type: - treatment and removal of nuclear material, - removal of radioactive sources, - treatment and removal of aqueous liquid waste, - treatment and removal of organic effluents, - treatment and removal of solid waste, - pumping out of the PETRUS tank, - flushing and decontamination of the tanks, - cleanup of Buildings 18 and 91/54. To estimate the cost of the operations and to monitor the progress of the work, an indicator system was put in place based on work units representative of the operation. The values of the work units were periodically updated on the basis of experience feedback. The cleanup progress is now 92% complete (06/12/31): - treatment and removal of nuclear material: 100%, - removal of radioactive sources: 100%, - treatment and removal of aqueous liquid waste: 64%, - treatment and removal of organic effluents: 87%, - treatment and removal of solid waste: 99%, - pumping out of the PETRUS tank: 69%, - flushing and decontamination of tank: 75%, - section cleaning of Buildings 18 and 91/: 90%. The DRSN/SAFAR is the delegated Project Owner for cleanup and dismantling operations. It is also the prime contractor for the cleanup and dismantling operations. SAFAR itself is responsible for operations relating to the CEA activity and those with technical risks (Removal of nuclear materials, Removal of radioactive sources, Pumping out plutonium and transuranic contaminated solvent and Flushing and decontamination of tanks and pipes). All other operations are sub-contracted to specialist companies.     The Next Generation Nuclear Plant (NGNP) project will provide the basis for commercialization of a new generation of advanced nuclear plants that utilize hightemperature gas-cooled reactor (HTGR) technology. The inherently safe HTGR design characteristics can be utilized to supply high-temperature process heat, co-generated electricity, and/or hydrogen for a number of industrial applications (e.g., petrochemical processes). Completion of the NGNP will result in a facility that demonstrates the safety and economics of the design, the commercial industrial potential of the technology, and the viability of the licensing strategy.

    A current sentiment within some parts of the environmental policy community is that market-based regulatory approaches such as emissions trading have proven so effective that actual costs will be only a small fraction of what ex ante cost estimation procedures would project. With this line of reasoning, some have dismissed available cost estimates for major proposed new regulations, such as the new PM and ozone NAAQS, as not meaningful for policy decisions. The most commonly used evidence in support of this position is the experience with SO{sub 2} reductions under Title IV of the 1990 Clean Air Act Amendments. In Title IV, a market for emissions allowances has been used to achieve reductions in sulfur dioxides (SO{sub 2}) to ameliorate acid rain. It is commonly asserted today that the cost of achieving the SO{sub 2} emissions reductions has been only one-tenth or less of what Title IV was originally expected to cost. This paper demonstrates that, to the contrary, actual costs for SO{sub 2} reductions remain roughly in line with original estimates associated with Title IV. Erroneous conclusions about Title IV`s costs are due to inappropriate comparisons of a variety of different measures that appear to be comparable only because they are all stated in dollars per ton. Program cost estimates include the total costs of a fully-implemented regulatory program. The very low costs of Title IV that are commonly cited today are neither directly reflective of a fully implemented Title IV, (which is still many years away) nor reflective of all the costs already incurred. Further, a careful review of history finds that the initial cost estimates that many cite were never associated with Title IV. Technically speaking, people are comparing the estimated control costs for the most-costly power plant associated with earlier acid rain regulatory proposals with prices from a market that do not directly reflect total costs.

    The coal industry has already begun to feel the affects of the acid deposition title, particularly in Illinois. Two challenges to the producers and sellers of coal; i.e., (1) Title III, Hazardous Air Pollutants and what is in store for customers, and (2) Title V, Operating Permits, which may affect production facilities are discussed. The utilities are temporarily exempted from Title III. The Great Waters report suggests that mercury will be regulated, and it looks like risk assessments will be based on coal analysis rather than on actual emission measurements. Stack sampling is difficult, expensive and slow. Coal cleaning is important in reducing trace elements. Electrostatic precipitators also remove trace elements. ESPs are less effective for mercury and selenium because they are emitted in the gas phase. FGD can remove hazardous air pollutants, but it is not well documented.
