    Measuring the Economic Impacts of Federal Investments in Research evaluates approaches to measuring the returns on federal research investments. This report identifies new methodologies and metrics that can be developed and used for assessing returns on research across a wide range of fields (biomedical, information technology, energy, agriculture, environment, and other biological and physical sciences, etc.), while using one or more background papers that review current methodologies as a starting point for the discussion. It focuses on tools that are able to exploit available data in the relatively near term rather than on methodologies that may require substantial new data collection. Over the last several years, there has been a growing interest in policy circles in identifying the payoffs from federal agency research investments, especially in terms of economic growth, competitiveness, and jobs. The extraordinary increase in research expenditures under the American Recovery and Reinvestment Act (ARRA) of 2009 and the President'™s commitment to science and technology (S&T) funding increases going forward have heightened the need for measuring the impacts of research investments. Without a credible analysis of their outcomes, the recent and proposed increases in S&T funding may not be sustained, especially given competing claims for federal funding and pressures to reduce projected federal budget deficits. Motivated by these needs and requirements, Measuring the Economic Impacts of Federal Investments in Research reviews and discusses the use of quantitative and qualitative data to evaluate the returns on federal research and development (R&D) investments. Despite the job-focused mandate of the current ARRA reporting requirements, the impact of S&T funding extend well beyond employment. For instance, federal funding in energy research may lead to innovations that would reduce energy costs at the household level, energy imports at the national level, and greenhouse gas emissions at the global level. In principle, these benefits can be measured as a return on research investments, with appropriate consideration of time lags to research outcomes and attribution to private as well as public expenditure. With appropriate metrics, the same could be true for benefits to public health, environmental quality, and food productivity and security. Federal funding of research leads to the development of human capital that is deployed in a variety of occupations with economic and social impacts. Research also produces information that is used in formal (e.g., regulatory and judicial) and informal (e.g., firm and consumer) decision making processes. In addition to reviewing the range of work (by academics, consultants, and research agencies themselves) that has been done in measuring research outcomes and providing a forum to discuss their methods, this report also considers the different methodologies used across fields of research (e.g., agriculture and energy research) to identifies which are applicable to a range of federal S&T funding.

    This volume contains the appendices for the ''Impact of Geothermal Technology Improvements on Royalty Collections on Federal Lands, Final Report, Volume I.'' The material in this volume supports the conclusions presented in Volume I and details each Known Geothermal Resource Area's (KGRA's) royalty estimation. Appendix A details the physical characteristics of each KGRA considered in Volume I. Appendix B supplies summary narratives on each state which has a KGRA. The information presented in Appendix C shows the geothermal power plant area proxies chosen for each KGRA considered within the report. It also provides data ranges which fit into the IMGEO model for electric energy cost estimates. Appendix D provides detailed cost information from the IMGEO model if no Geothermal Program RandD goals were completed beyond 1987 and if all the RandD goals were completed by the year 2000. This appendix gives an overall electric cost and major system costs, which add up to the overall electric cost. Appendix E supplies information for avoided cost projections for each state involved in the study that were used in the IMGEO model run to determine at what cost/kWh a 50 MWe plant could come on line. Appendix F supplies the code used in the determination of royalty income, as well as, tabled results of the royalty runs (detailed in Appendix G). The tabled results show royalty incomes, assuming a 10% discount rate, with and without RandD and with and without a $0.01/kWh transmission cost. Individual data sheets for each KGRA royalty income run are presented in Appendix G.

    The purpose of this study was to quantify the impact of the Solar Thermal Central Receiver (STCR) tax incentives and commercialization on the federal treasury revenues. The initial STCR market penetration was assumed to take place in California, because of favorable local conditions. The initial financing was assumed to be underwritten by intermediary partnerships under long-term avoided cost contracts with the local utility companies with subsequent sale of the plants to utilities at competitive prices. To estimate the impacts of these various tax incentives associated with the commercialization of the STCR technology, the tax revenues and costs for the STCR plants were compared with the tax revenues and costs for the displaced conventional power plants. This differential analysis takes into account the different operating expenses, as well as the different depreciation charges, financing costs, and tax credits associated with STCR and conventional plants. The study also evaluated the impact of both the previous (1983) and current (1984) proposed federal energy tax credits. The resulting total annual tax cash flows were subsequently cumulated to determine the aggregate tax revenues and costs throughout the 1985 to 2034 time period. The results of this analysis indicate that the initial federal tax revenues are negative. With increasing market penetration, the installed costs of the STCR plants decrease rapidly and the net present values of the tax revenue cash flows associated with plants constructed after 1995 are positive, and become significantly larger than those for the corresponding displaced conventional plants.

    Bonneville Power Administration (BPA) is considering action in two areas: (1) non-Federal access to the AC Intertie, and, (2) BPA Intertie marketing. BPA`s preferred alternative for non-Federal access is the Capacity Ownership alternative combined with the Increased Assured Delivery -- Access for Non-Scheduling Utilities alternative; the preferred alternative for BPA Intertie marketing is the Federal Marketing and Joint Ventures alternative. BPA considered these two areas previously in its Intertie Development and Use EIS of April 1988. The EIS resulted in BPA decisions to participate in the construction of the Third AC Intertie, to allow non-Federal access to BPA`s share of the Pacific Northwest-Pacific Southwest (PNW-PSW) Intertie (AC and DC lines) pursuant to a Long-Term Intertie Access Policy (LTIAP), and to pursue BPA`s export marketing alternative. The decision on allowing direct financial non-Federal participation in the Third AC line was deferred to a later, separate process, examined here. Also, BPA`s export marketing objectives must now be examined in view of changed operations of Columbia River hydro facilities for improved fish survival.

    In this study, the authors conducted a literature review of approaches and assumptions used by other modeling teams and consultants with respect to solar project financing; developed and incorporated an ability to model the likely financing shift away from more expensive sources of capital and toward cheaper sources as the investment tax credit declines in the ReEDS model; and used the 'before and after' versions of the ReEDS model to isolate and analyze the deployment impact of the financing shift under a range of conditions. Using ReEDS scenarios with this improved capability, we find that this 'financing' shift would soften the blow of the ITC reversion; however, the overall impacts of such a shift in capital structure are estimated to be small and near-term utility-scale PV deployment is found to be much more sensitive to other factors that might drive down utility-scale PV prices.

    Impacts of U.S. appliance and equipment standards have been described previously. Since 2000, the U.S. Department of Energy (DOE) has updated standards for clothes washers, water heaters, and residential central air conditioners and heat pumps. A revised estimate of the aggregate impacts of all the residential appliance standards in the United States shows that existing standards will reduce residential primary energy consumption and associated carbon dioxide (CO{sub 2}) emissions by 89 percent in 2020 compared to the levels expected without any standards. Studies of possible new standards are underway for residential furnaces and boilers, as well as a number of products in the commercial (tertiary) sector, such as distribution transformers and unitary air conditioners. The analysis of standards has evolved in response to critiques and in an attempt to develop more precise estimates of costs and benefits of these regulations. The newer analysis elements include: (1) valuing energy savings by using marginal (rather than average) energy prices specific to an end-use; (2) simulating the impacts of energy efficiency increases over a sample population of consumers to quantify the proportion of households having net benefits or net costs over the life of the appliance; and (3) calculating marginal markups in distribution channels to derive the incremental change in retail prices associated with increased manufacturing costs for improving energy efficiency.

    This paper presents estimates of the key impacts of Federal energy and water conservation standards adopted from 1987 through 2013. The standards for consumer products and commercial and industrial equipment include those set by legislation as well as standards adopted by DOE through rulemaking. In 2013, the standards saved an estimated 4.05 quads of primary energy, which is equivalent to 4% of total U.S. energy consumption. The savings in operating costs for households and businesses totaled $56 billion. The average household saved $361 in operating costs as a result of residential and plumbing product standards. The estimated reduction in CO{sub 2} emissions associated with the standards in 2013 was 218 million metric tons, which is equivalent to 4% of total U.S. CO{sub 2} emissions. The estimated cumulative energy savings over the period 1990-2090 amount to 181 quads. Accounting for the increased upfront costs of more-efficient products and the operating cost (energy and water) savings over the products’ lifetime, the standards have a past and projected cumulative net present value (NPV) of consumer benefit of between $1,271 billion and $1,487 billion, using 7 percent and 3 percent discount rates, respectively. The water conservation standards, together with energy conservation standards that also save water, reduced water use by 1.9 trillion gallons in 2013, and will achieve cumulative water savings by 2090 of 55 trillion gallons. The estimated consumer savings in 2013 from reduced water use amounted to $16 billon.

    This analysis was updated for Annual Energy Outlook 2009 (AEO): Impact of Limitations on Access to Oil and Natural Gas Resources in the Federal Outer Continental Shelf (OCS). The OCS is estimated to contain substantial resources of crude oil and natural gas; however, some areas of the OCS are subject to drilling restrictions. With energy prices rising over the past several years, there has been increased interest in the development of more domestic oil and natural gas supply, including OCS resources. In the past, federal efforts to encourage exploration and development activities in the deep waters of the OCS have been limited primarily to regulations that would reduce royalty payments by lease holders. More recently, the states of Alaska and Virginia have asked the federal government to consider leasing in areas off their coastlines that are off limits as a result of actions by the President or Congress. In response, the Minerals Management Service (MMS) of the U.S. Department of the Interior has included in its proposed 5-year leasing plan for 2007-2012 sales of one lease in the Mid-Atlantic area off the coastline of Virginia and two leases in the North Aleutian Basin area of Alaska. Development in both areas still would require lifting of the current ban on drilling.

    A project undertaken to provide the Bonneville Power Administration (BPA) with information needed to conduct environmental assessments and meet requirements of the National Environmental Policy Act (NEPA) and the Pacific Northwest Electric Power Planning and Conservation Act (Regional Act) is described. Access to information on environmental effects would help BPA fulfill its responsibilities to coordinate power generation on the Columbia River system, protect uses of the river system (e.g., irrigation, recreation, navigation), and enhance fish and wildlife production. Staff members at BPA identified the need to compile and index information resources that would help answer environmental impact questions. A computer retrieval system that would provide ready access to the information was envisioned. This project was supported by BPA to provide an initial step toward a compilation of environmental impact information. Scientists at Pacific Northwest Laboratory (PNL) identified, gathered, and evaluated information related to environmental effects of water level on uses of five study reservoirs and developed and implemented and environmental data retrieval system, which provides for automated storage and retrieval of annotated citations to published and unpublished information. The data retrieval system is operating on BPA's computer facility and includes the reservoir water-level environmental data. This project was divided into several tasks, some of which were conducted simultaneously to meet project deadlines. The tasks were to identify uses of the five study reservoirs, compile and evaluate reservoir information, develop a data entry and retrieval system, identify and analyze research needs, and document the data retrieval system and train users. Additional details of the project are described in several appendixes.

    This paper presents estimates of the key impacts of the energy and water conservation standards that have been adopted from 1987 through 2010. The standards covered include those set by legislation as well as standards adopted by DOE through rulemaking. We estimate that energy efficiency standards for consumer products and certain commercial and industrial equipment that have been adopted from 1987 through 2010 saved 3.0 quads in 2010, have had a cumulative energy savings of 25.9 quads through 2010 and will achieve cumulative energy savings of 158 quads over the period 1990-2070. Thus, the majority of the savings are still to come as products subject to standards enter the stock. Furthermore, the standards will have a cumulative net present value (NPV) of consumer benefit of between $851 billion and $1,103 billion, using 7 percent and 3 percent discount rates, respectively. In addition, we estimate the water conservation standards, together with those energy conservation standards that also save water, saved residential consumers 1.5 trillion gallons of water in 2010, have had cumulative water savings of 11.7 trillion gallons through 2010, and will achieve cumulative water savings by 2040 of 51.4 trillion gallons.

    Federal laboratories have successfully filled many roles for the public; however, as the 21st Century nears it is time to rethink and reevaluate how Federal laboratories can better support the public and identify new roles for this class of publicly-owned institutions. The productivity of the Federal laboratory system can be increased by making use of public outcome metrics, by benchmarking laboratories, by deploying innovative new governance models, by partnerships of Federal laboratories with universities and companies, and by accelerating the transition of federal laboratories and the agencies that own them into learning organizations. The authors must learn how government-owned laboratories in other countries serve their public. Taiwan`s government laboratory, Industrial Technology Research Institute, has been particularly successful in promoting economic growth. It is time to stop operating Federal laboratories as monopoly institutions; therefore, competition between Federal laboratories must be promoted. Additionally, Federal laboratories capable of addressing emerging 21st century public problems must be identified and given the challenge of serving the public in innovative new ways. Increased investment in case studies of particular programs at Federal laboratories and research on the public utility of a system of Federal laboratories could lead to increased productivity of laboratories. Elimination of risk-averse Federal laboratory and agency bureaucracies would also have dramatic impact on the productivity of the Federal laboratory system. Appropriately used, the US Federal laboratory system offers the US an innovative advantage over other nations.

    The primary objective of this study was to estimate the current life-cycle cost-effective (i.e., economic) energy savings potential in Federal buildings and the corresponding capital investment required to achieve these savings, with Federal financing. Estimates were developed for major categories of energy efficiency measures such as building envelope, heating system, cooling system, and lighting. The analysis was based on conditions (building stock and characteristics, retrofit technologies, interest rates, energy prices, etc.) existing in the late 1990s. The potential impact of changes to any of these factors in the future was not considered.

  17. Factors fragmenting the Russian Federation

    This paper examines the factors that threaten the future of the Russian Federation (RF). The observations are based on a study that focused on eight republics: Mordova, Udmurtia, Tatarstan, Mari El, Bashkortostan, Kabardino-Balkaria, Buryatia, and Altay Republic. These republics were selected for their geographic and economic significance to the RF. Tatarstan, Bashkortostan, Udmurtia, and Mari El are located on important supply routes, such as the Volga River and the trans-Siberian railroad. Some of these republics are relatively wealthy, with natural resources such as oil (e.g., Tatarstan and Bashkortostan), and all eight republics play significant roles in the military-industrial complex. The importance of these republics to the RF contrasts to the relative insignificance of the independence-minded Northern Caucasus area. The author chose not to examine the Northern Caucasus region (except Kabardino-Balkaria) because these republics may have only a minor impact on the rest of the RF if they secede. Their impact would be minimized because they lie on the frontiers of the RF. Many Russians believe that {open_quotes}it might be best to let such a troublesome area secede.{close_quotes}

    This document is a site-specific environmental impact statement (EIS) for construction and operation of a proposed depleted uranium hexafluoride (DUF{sub 6}) conversion facility at the U.S. Department of Energy (DOE) Paducah site in northwestern Kentucky (Figure S-1). The proposed facility would convert the DUF{sub 6} stored at Paducah to a more stable chemical form suitable for use or disposal. In a Notice of Intent (NOI) published in the ''Federal Register'' (FR) on September 18, 2001 (''Federal Register'', Volume 66, page 48123 [66 FR 48123]), DOE announced its intention to prepare a single EIS for a proposal to construct, operate, maintain, and decontaminate and decommission two DUF{sub 6} conversion facilities at Portsmouth, Ohio, and Paducah, Kentucky, in accordance with the National Environmental Policy Act of 1969 (NEPA) (''United States Code'', Title 42, Section 4321 et seq. [42 USC 4321 et seq.]) and DOE's NEPA implementing procedures (''Code of Federal Regulations'', Title 10, Part 1021 [10 CFR Part 1021]). Subsequent to award of a contract to Uranium Disposition Services, LLC (hereafter referred to as UDS), Oak Ridge, Tennessee, on August 29, 2002, for design, construction, and operation of DUF{sub 6} conversion facilities at Portsmouth and Paducah, DOE reevaluated its approach to the NEPA process and decided to prepare separate site-specific EISs. This change was announced in a ''Federal Register'' Notice of Change in NEPA Compliance Approach published on April 28, 2003 (68 FR 22368); the Notice is included as Attachment B to Appendix C of this EIS. This EIS addresses the potential environmental impacts from the construction, operation, maintenance, and decontamination and decommissioning (D&D) of the proposed conversion facility at three alternative locations within the Paducah site; from the transportation of depleted uranium conversion products to a disposal facility; and from the transportation, sale, use, or disposal of the fluoride-containing conversion products (hydrogen fluoride [HF] or calcium fluoride [CaF{sub 2}]). Although not part of the proposed action, an option of shipping all cylinders (DUF{sub 6}, low-enriched UF{sub 6} [LEU-UF{sub 6}], and empty) stored at the East Tennessee Technology Park (ETTP) near Oak Ridge, Tennessee, to Paducah rather than to Portsmouth is also considered. In addition, this EIS evaluates a no action alternative, which assumes continued storage of DUF{sub 6} in cylinders at the Paducah site. A separate EIS (DOE/EIS-0360) evaluates the potential environmental impacts for the proposed Portsmouth conversion facility.

Different federal agencies conduct varying degrees of hazard evaluation, and some also generate empirical data.     We study gravitomagnetic effects in the Palatini formalism of f(R) gravity. On using the Kerr-de Sitter metric, which is a solution of f(R) field equations, we calculate the impact of f(R) gravity on the gravitomagnetic precession of an orbiting gyroscope. We show that, even though an f(R) contribution is present in principle, its magnitude is negligibly small and far to be detectable in the present (like GP-B) and foreseeable space missions or observational tests around the Earth.

    This document is a site-specific environmental impact statement (EIS) for construction and operation of a proposed depleted uranium hexafluoride (DUF{sub 6}) conversion facility at the U.S. Department of Energy (DOE) Portsmouth site in Ohio (Figure S-1). The proposed facility would convert the DUF{sub 6} stored at Portsmouth to a more stable chemical form suitable for use or disposal. The facility would also convert the DUF{sub 6} from the East Tennessee Technology Park (ETTP) site near Oak Ridge, Tennessee. In a Notice of Intent (NOI) published in the Federal Register on September 18, 2001 (Federal Register, Volume 66, page 48123 [66 FR 48123]), DOE announced its intention to prepare a single EIS for a proposal to construct, operate, maintain, and decontaminate and decommission two DUF{sub 6} conversion facilities at Portsmouth, Ohio, and Paducah, Kentucky, in accordance with the National Environmental Policy Act of 1969 (NEPA) (United States Code, Title 42, Section 4321 et seq. [42 USC 4321 et seq.]) and DOE's NEPA implementing procedures (Code of Federal Regulations, Title 10, Part 1021 [10 CFR Part 1021]). Subsequent to award of a contract to Uranium Disposition Services, LLC (hereafter referred to as UDS), Oak Ridge, Tennessee, on August 29, 2002, for design, construction, and operation of DUF{sub 6} conversion facilities at Portsmouth and Paducah, DOE reevaluated its approach to the NEPA process and decided to prepare separate site-specific EISs. This change was announced in a Federal Register Notice of Change in NEPA Compliance Approach published on April 28, 2003 (68 FR 22368); the Notice is included as Attachment B to Appendix C of this EIS. This EIS addresses the potential environmental impacts from the construction, operation, maintenance, and decontamination and decommissioning (D&D) of the proposed conversion facility at three alternative locations within the Portsmouth site; from the transportation of all ETTP cylinders (DUF{sub 6}, low-enriched UF6 [LEU-UF{sub 6}], and empty) to Portsmouth; from the transportation of depleted uranium conversion products to a disposal facility; and from the transportation, sale, use, or disposal of the fluoride-containing conversion products (hydrogen fluoride [HF] or calcium fluoride [CaF{sub 2}]). An option of shipping the ETTP cylinders to Paducah is also considered. In addition, this EIS evaluates a no action alternative, which assumes continued storage of DUF{sub 6} in cylinders at the Portsmouth and ETTP sites. A separate EIS (DOE/EIS-0359) evaluates potential environmental impacts for the proposed Paducah conversion facility.

    This ''Site-wide Environmental Impact Statement for Continued Operation of Lawrence Livermore National Laboratory and Supplemental Stockpile Stewardship and Management Programmatic Environmental Impact Statement'' (LLNL SW/SPEIS) describes the purpose and need for agency action for the continued operation of LLNL and analyzes the environmental impacts of these operations. The primary purpose of continuing operation of LLNL is to provide support for the National Nuclear Security Administration's (NNSA's) nuclear weapons stockpile stewardship missions. LLNL, located about 40 miles east of San Francisco, California, is also needed to support other U.S. Department of Energy (DOE) programs and Federal agencies such as the U.S. Department of Defense, Nuclear Regulatory Commission, U.S. Environmental Protection Agency (EPA), and the newly established U.S. Department of Homeland Security. This LLNL SW/SPEIS analyzes the environmental impacts of reasonable alternatives for ongoing and foreseeable future operations, facilities, and activities at LLNL. The reasonable alternatives include the No Action Alternative, Proposed Action, and the Reduced Operation Alternative. The major decision to be made by DOE/NNSA is to select one of the alternatives for the continued operation of the LLNL. As part of the Proposed Action, DOE/NNSA is considering: using additional materials including plutonium on the National Ignition Facility (NIF); increasing the administrative limit for plutonium in the Superblock, which includes the Plutonium Facility, the Tritium Facility, and the Hardened Engineering Test Building; conducting the Integrated Technology Project, using laser isotope separation to provide material for Stockpile Stewardship experiments, in the Plutonium Facility; increasing the material-at-risk limit for the Plutonium Facility; and increasing the Tritium Facility material-at-risk. A discussion of these issues is presented in Section S.5.2, Proposed Action. The ''National Environmental Policy Act'' (NEPA) establishes environmental policy, sets goals, and provides means for implementing the policy. NEPA contains provisions to ensure that Federal agencies adhere to the letter and spirit of the Act. The key provision requires preparation of an environmental impact statement on ''major Federal actions significantly affecting the quality of the human environment'' (40 ''Code of Federal Regulations'' [CFR] {section}1502.3). NEPA ensures that environmental information is available to public officials and citizens before decisions are made and actions are taken (40 CFR {section}1500.1[b]). DOE has a policy to prepare sitewide environmental impact statements documents for certain large, multiple-facility sites such as LLNL (10 CFR {section}1021.330). In August 1992, DOE released the ''Final Environmental Impact Statement and Environmental Impact Report for Continued Operations of Lawrence Livermore National Laboratory and Sandia National Laboratories, Livermore'' (LLNL EIS/EIR). A Record of Decision (ROD) (58 ''Federal Register'' [FR] 6268) was issued in January 1993. With the passage of more than 10 years since the publication of the 1992 LLNL EIS/EIR (DOE/EIS-0157) and because of proposed modifications to existing projects and new programs, NNSA determined that it was appropriate to prepare a new LLNL SW/SPEIS.

    The most important indicator of a well-managed site cleanup effort may no longer be funding or scientific expertise. While support for federal facility cleanup has included appropriations of more than $10 billion annually, these expenditures alone are unlikely to assure progress toward environmental remediation. {open_quotes}Trust{close_quotes} is now overwhelmingly mentioned as a prerequisite for progress with site cleanup in DOE`s weapons complex. In part, federal budget deficits are forcing participants to focus on factors that build consensus and lead to cost-effective cleanup actions. In some cases, the stakeholders at cleanup sites are making efforts to work cooperatively with federal agencies. A report by 40 representatives of federal agencies, tribal and state governments, associations, and others developed recommendations to create a {open_quotes}new era of trust and consensus-building that allows all parties to get on with the job of cleaning up federal facilities in a manner that reflects the priorities and concerns of all stakeholders.{close_quotes} Changes are underway affecting how federal agencies work with federal and state regulators reflecting this concept of shared responsibility for conducting cleanup. This paper addresses these changes and provides examples of the successes and failures underway.

Over the four years covered in this document, the Alliance To Save Energy conducted liaison with the private sector through our Federal Energy Productivity Task Force.     This document reports the findings and implementation recommendations of the Price Reasonableness Working Group to the Federal ESPC Steering Committee. The working group was formed to address concerns of agencies and oversight organizations related to pricing and fair and reasonable price determination in federal energy savings performance contracts (ESPCs). This report comprises the working group's recommendations and is the proposed draft of a training curriculum on fair and reasonable price determination for users of federal ESPCs. The report includes: (1) A review of federal regulations applicable to determining price reasonableness of federal ESPCs (section 2), (2) Brief descriptions of the techniques described in Federal Acquisition Regulations (FAR) 15.404-1 and their applicability to ESPCs (section 3), and (3) Recommended strategies and procedures for cost-effectively completing price reasonableness determinations (sections 4). Agencies have struggled with fair and reasonable price determinations in their ESPCs primarily because this alternative financing vehicle is relatively new and relatively rare in the federal sector. The methods of determining price reasonableness most familiar to federal contracting officers (price competition based on the government's design and specifications, in particular) are generally not applicable to ESPCs. The regulatory requirements for determining price reasonableness in federal ESPCs have also been misunderstood, as federal procurement professionals who are inexperienced with ESPCs are further confused by multiple directives, including Executive Order 13123, which stresses life-cycle cost-effectiveness. Uncertainty about applicable regulations and inconsistent practice and documentation among agencies have fueled claims that price reasonableness determinations have not been sufficiently rigorous in federal ESPCs or that the prices paid in ESPCs are generally higher than the prices paid for similar goods and services obtained through conventional procurements. While claims of excessive prices are largely unsubstantiated and based on anecdotal evidence, the perception that there is a problem is shared by many in the ESPC community and has been noted by auditors and oversight organizations. The Price Reasonableness Working Group determined that a more formal emphasis on FAR 15.404-1 in the ESPC process could remove much of the doubt about price reasonableness determinations. The working group's recommended consensus policy on price reasonableness stresses the price analysis techniques described in the FAR that are applicable to ESPCs and includes guidance for agencies use of these techniques in determining price reasonableness for their ESPC delivery orders. The recommended policy and guidance, if communicated to federal ESPC stakeholders, can ensure that agencies will comply with the FAR in awarding ESPCs, obtain fair and reasonable prices and best value for the government, and follow procedures that provide auditable documentation of due diligence in price reasonableness determinations.

    The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. This freedom has led to abuse in the arena of environmental compliance. Recent congressional hearings concerning amendments to the Resource Conservation and Recovery Act saw a congressional feeding frenzy over what was termed the abominable mess of federal facility environmental compliance. The obvious anger and frustration directed toward federal agencies, including the Environmental Protection Agency (EPA), by representatives of the states is a clear indicator of the extent of the problem and also a catalyst for an ill-conceived and dangerous legislative fix.

    Parsons was selected by the United States Agency for International Development (USAID) as the general contractor for construction management for the construction of 2,500 housing units within the Russian Federation. These housing units, to be occupied by Russian officers returning from the Baltic States, are under construction on 15 sites, selected from an initial list of 200, based on habitability, capability of successful final construction. Cost meeting USAID guidelines, and impacts on the environment. USAID fulfilled NEPA requirements by preparing, with assistance of Parsons Engineering Science, a Programmatic Environmental Assessment and 15 site specific Environmental Assessments for the project. The sites were scattered over the entire Russian Federation west of the Ural Mountains. The site offerors completed an environmental checklist covering a broad range of possible impacts. Significant environmental issues and concerns were further identified during scoping meetings held at the site locations. The most important issues discussed were: soil contamination; gaseous, liquid, and solid pollutants to which the site may be exposed; incompatible adjacent land uses; ready access to utilities and social services; and socioeconomic situation favorable to resettlement of Russian military officers. No major environmental issues or concerns were identified for the 15 selected sites. Certificates indicating the absence of chemical and radiological surface and subsurface contamination at the proposed sites were provided by the local environmental officers. Polynuclear aromatic hydrocarbons were found present at one of the sites considered in a preliminary selection, and later rejected due to the failure of contractual negotiations. The environmental assessments included mitigation and monitoring measures for construction and operation (occupancy) impacts.

    The Atomic Energy Act of 1954 established, and later Congressional amendments have confirmed, that except in areas which have been explicitly granted to the states, the federal government possesses preemptive authority to regulate radiation hazards associated with the development and use of atomic energy. Since the passage of the original Act, numerous decisions by the courts have reaffirmed the legitimacy of federal preemption, and have defined and redefined its scope. In this study, the aim is to explore the underlying issues involved in federal preemption of radiation-hazard regulation, and to recommend actions that the Department of Energy and other agencies and groups should consider undertaking in the near term to protect the preemption principle. Appropriate roles of the states are discussed, as well as recent state-level activities and their rationale, and several current arenas in which state-federal conflicts about regulation of hazards are being played out. The emphasis here is on four particular arenas that are now important arenas of conflict, but the issues discussed are far broader in scope. These four arenas are: state-level moratorium activity; emergency planning for reactors; conflicts arising from state financial regulation; and inroads in federal preemption through litigation under state law.

The USGS collected royalties and supervised operation and production of minerals on the Outer Continental Shelf (OCS) until the Minerals Management Service (MMS) took over these functions in 1982. Some of the highlights are: of the 329.5 million acres offered for leasing, 37.1 million acres were actually leased; total revenues for the 1954 to 1983 period were $68,173,112,563 and for 1983 $9,161,435,540; a total of 22,095 wells were drilled in federal waters and 10,145 wells were drilled in state waters; from 1954 through 1983, federal offshore areas produced 6.4 billion barrels of oil and condensate, and 62.1 trillion cubic feet of natural gas; in 1983 alone production was 340.7 million barrels of oil and condensate, and 3.9 trillion cubic feet of gas; and for the second straight year, no oil was lost in 1983 as a result of blowouts in federal waters. 8 figures, 66 tables.

    A draft environmental impact statement (EPA No. 850428D) assesses the impacts of proposed offtract disposal of waste materials associated with an open pit mine on a prototype oil shale lease tract. The offtract lease would include facilities for retorting, upgrading, power generation, and product storage. Offtract disposal and plant siting would make the mining cite more viable and cost effective. The project would require rerouting of two major country roads, and would eliminate an airport and other facilities. The site would become more isolated, which could affect future development in the area. The Federal Land Policy and Management Act of 1976 mandates the impact study.
