    This document is the final report of the Fusion Policy Advisory Committee. The report conveys the Committee's views on the matters specified by the Secretary in his charge and subsequent letters to the Committee, and also satisfies the provisions of Section 7 of the Magnetic Fusion Energy Engineering Act of 1980, Public Law 96-386, which require a triennial review of the conduct of the national Magnetic Fusion Energy program. Three sub-Committee's were established to address the large number of topics associated with fusion research and development. One considered magnetic fusion energy, a second considered inertial fusion energy, and the third considered issues common to both. For many reasons, the promise of nuclear fusion as a safe, environmentally benign, and affordable source of energy is bright. At the present state of knowledge, however, it is uncertain that this promise will become reality. Only a vigorous, well planned and well executed program of research and development will yield the needed information. The Committee recommends that the US commit to a plan that will resolve this critically important issue. It also outlines the first steps in a development process that will lead to a fusion Demonstration Power Plant by 2025. The recommended program is aggressive, but we believe the goal is reasonable and attainable. International collaboration at a significant level is an important element in the plan.

    Democratic government requires trust: people need to know and believe that the government is telling the truth. Without information about what the government is doing and why, citizens cannot exercise democratic control over government institutions. During his first year in office, President Clinton became concerned about reports that the government had conducted unethical secret human radiation experiments during the Cold War. To address this issue, in January 1994, President Clinton established the Advisory Committee on Human Radiation Experiments (ACHRE), chaired by bioethicist Dr. Ruth Faden of Johns Hopkins University. The President also directed all Federal agencies to search for records related to human subjects radiation research and provide them to the Advisory Committee. This report presents the Administration`s actions to respond to the ACHRE`s findings and recommendations.

    The charter for the Department of Energy's Environmental Management (EM) Site-Specific Advisory Board (SSAB) was approved under the Federal Advisory Committee Act (FACA) in 1994. With a unique mandate to provide public input on issues associated with the cleanup of nuclear legacy sites in the U.S., the EM SSAB comprises eight local boards, which are based at major EM sites. While each board is unique to the community in which it is located and reflects the diversity of the local population, the boards are governed by FACA, related regulations, and DOE policies that are intended to standardize agency advisory board operations. The EM SSAB local boards are made up of a diverse group of citizens who want to understand the mission and goals of the EM program and to help EM achieve those goals for the benefit of their communities. Some are quite passionate about their mission; others need to be coaxed into active participation. Maintaining productive relationships and a supportive environment for effective board operations is the challenge of board management for DOE EM and the board members themselves. DOE draws on research findings and best practices literature from academics and practitioners in the field of public involvement in its board management practices. The EM SSAB is also evaluated annually under the law to ensure that the investment of taxpayer dollars in the board is warranted in light of the contributions of the board. Further evaluation takes place at the agency and site levels in order to identify what aspects of board functioning the agency and board members find important to its success and to address areas where improvement is needed. Board contributions, compliance factors, and measurable outcomes related to board products and process areas are key to agency commitment to ongoing support of the boards and to participant satisfaction and thus continued member involvement. In addition to evaluation of these factors in improving board effectiveness, the agency draws on the experience of members to create best practices for the EM SSAB, as a unique form of public involvement. Four areas that have been identified by local board Chairpersons as important to their local board operations are - Enhancing communication between technical and non-technical board members; - Building on common ground toward recommendations; - Public involvement in EM SSAB local board activities; - The EM SSAB annual work plan process. The first three areas are addressed below by current or former chairpersons of the EM SSAB: Ralph Phelps, former Chairperson of the Northern New Mexico Citizens' Advisory Board; Susan Leckband, former Chairperson and current Vice Chairperson of the Hanford Advisory Board; and Val Francis, Vice Chairperson of the Portsmouth (PORTS) SSAB. In addition, Eric Roberts, facilitator of the PORTS SSAB, has contributed to the section on public involvement. In a separate paper for this session, Ralph Young, Chairperson of the Paducah Citizens' Advisory Board addresses the EM SSAB annual work plan process. (authors)

    When the Advisory Committee began work in April 1994 we were charged with determining whether the radiation experiments design and administration adequately met the ethical and scientific standards, including standards of informed consent, that prevailed at the time of the experiments and that exist today and also to determine the ethical and scientific standards and criteria by which it shall evaluate human radiation experiments. Although this charge seems straightforward, it is in fact difficult to determine what the appropriate standards should be for evaluating the conduct and policies of thirty or fifty years ago. First, we needed to determine the extent to which the standards of that time are similar to the standards of today. To the extent that there were differences we needed to determine the relative roles of each in making moral evaluations. In Chapter 1 we report what we have been able to reconstruct about government rules and policies in the 1940s and 1950s regarding human experiments. We focus primarily on the Atomic Energy Commission and the Department of Defense. In Chapter 2 we turn from a consideration of government standards to an exploration of the norms and practices of physicians and medical scientists who conducted research with human subjects during this period. Using the results of our Ethics Oral History Project, and other sources, we also examine how scientists of the time viewed their moral responsibilities to human subjects as well as how this translated into the manner in which they conducted their research.

    The US Army Corps of Engineers has retained Idaho National Laboratory (INL) to conduct a study of past INL experiences and complete a report that identifies the processes that are needed for the development of renewable energy projects on government properties. The INL has always maintained expertise in power systems and applied engineering and INLs renewable energy experiences date back to the 1980s when our engineers began performing US Air Force wind energy feasibility studies and development projects. Over the last 20+ years of working with Department of Defense and other government agencies to study, design, and build government renewable projects, INL has experienced the dos and donts for being successful with a project. These compiled guidelines for government renewable energy projects could include wind, hydro, geothermal, solar, biomass, or a variety of hybrid systems; however, for the purpose of narrowing the focus of this report, wind projects are the main topic discussed throughout this report. It is our thought that a lot of what is discussed could be applied, possibly with some modifications, to other areas of renewable energy. It is also important to note that individual projects (regardless the type) vary to some degree depending on location, size, and need but in general these concepts and directions can be carried over to the majority of government renewable energy projects. This report focuses on the initial development that needs to occur for any project to be a successful government renewable energy project.

    An assessment has been made to determine current tribology research and development work sponsored or conducted by the government. Data base surveys and discussions were conducted to isolate current projects sponsored primarily by 21 different government organizations. These projects were classified by subject, objective, energy relevance, type of research, phenomenon being investigated, variables being studied, type of motion, materials and application. An abstract of each project was prepared which included the classification, sponsor, performing organization and a project description. It was found that current work is primarily materials oriented to meet military requirements. Other than the high temperature programs very few of the tribology projects accomplish energy related objectives.

    As industry is the first line of defense in detecting and thwarting illicit trade networks, the engagement of the private sector is critical to any government effort to strengthen existing mechanisms to protect goods and services throughout the supply chain. This study builds on previous PNNL work to continue to evaluate means for greater industry engagement to complement and strengthen existing governmental efforts to detect and stem the trade of illicit goods and to protect and secure goods that could be used in making a weapon of mass destruction. Specifically, the study evaluates the concept of Industry Self Regulation, defined as a systematic voluntary program undertaken by an industry or by individual companies to anticipate, implement, supplement, or substitute for regulatory requirements in a given field, generally through the adoption of best practices. Through a series of interviews with companies with a past history of non-compliance, trade associations and NGOs, the authors identify gaps in the existing regulatory infrastructure, drivers for a self regulation approach and the form such an approach might take, as well as obstacles to be overcome. The authors conclude that it is at the intersection of industry, government, and security thatthrough collaborative meansthe effectiveness of the international nonproliferation systemcan be most effectively strengthened to the mutual benefit of both government and the private sector. Industry has a critical stake in the success of this regime, and has the potential to act as an integrating force that brings together the existing mechanisms of the global nonproliferation regime: export controls, physical protection, and safeguards. The authors conclude that industry compliance is not enough; rather, nonproliferation must become a central tenant of a companys corporate culture and be viewed as an integral component of corporate social responsibility (CSR).

    Federal missions on the Oak Ridge Reservation began with the Manhattan Project, and continues today with major facilities supporting the Nation's Science and National Security missions. While most of the land area on the Oak Ridge Reservation is free of environmental impacts from these activities, significant legacy contamination is associated with specific facilities and past waste management areas. In 1989, the Oak Ridge Reservation (ORR) was placed on National Priorities List, and DOE established its Office of Environmental Management that same year. Three years later, in 1992, the Federal Facility Agreement for the reservation was signed. Three years afterward, the Oak Ridge Site Specific Advisory Board was established to augment ongoing public involvement activities related to Oak Ridge Reservation cleanup activities. One of the early and most impactful decisions the board made was to organize the End Use Working Group. This broad-based group of board members, DOE representatives, and members of the public was formed in 1997 to study future uses for contaminated areas of the reservation. The group was instrumental in building consensus in the Oak Ridge community regarding the long-term end state of reservation lands. The group's recommendations were a fundamental input into Record's of Decision subsequently developed to establish cleanup requirements across the ORR, and they continue to influence decisions being made today. In developing its recommendations on end states, the End Use Working Group came to the realization that long-term stewardship of contaminated areas of the reservation would be necessary, in some cases in perpetuity. It was from this concept that the Oak Ridge SSAB's 15-year involvement in stewardship would begin. A stewardship committee formed by the End Use Working Group wrote Volume 1 of the Stakeholder Report on Stewardship. This document-and its companion Volume 2, which was written a year later-form a crucial foundation for stewardship planning in Oak Ridge and have been referenced around the DOE complex as other sites consider stewardship planning. From these two broad-based initiatives, the board's focus has evolved to increasingly hone in on more specific, project-based recommendations and initiatives. The Oak Ridge Reservation Site Specific Advisory Board has been a highly effective forum for soliciting community input on Oak Ridge Reservation cleanup. Experience in Oak Ridge indicates that the utility of Board recommendations is far higher when the Board is asked to focus on broad programmatic issues, and less useful when the Board attempts to provide advice and recommendations on matters related to technical or project management issues. In Oak Ridge the Board has helped shape the program on many levels including definition of end-state cleanup objectives, budget development, program sequencing, waste management, and decisions concerning preservation of history related to missions implemented on the Oak Ridge Reservation.     This paper presents an analysis of how the US government responded to the concern in the 1980`s that US companies were experiencing problems of competitiveness in international markets. By the mid 1980`s there was great and growing concern throughout the US that US companies were experiencing difficulties in international competition. Pressure on Congress to take action came from constituents seeking jobs and companies that would directly benefit (this usually means receive public money) from programs that Congress might initiate. The fact that most constituent calls to Congress were about job creation was lost in the on-rush of R&D performers seeking funds for their favorite R&D project. In response, Congress created the Advanced Technology Program, the Technology Transfer Initiative, and the Technology Reinvestment Project, expanded the responsibilities of ARPA/DARPA, increased funding for the Small Business Initiative, expanded the Manufacturing Extension Partnership, funded SEMATECH, and increased NSF funding for basic research at universities. Many of these programs were later criticized for being industrial welfare and several were cut-back or stopped. Retrospective analysis shows that few of these programs addressed the root cause of competitiveness difficulties. In fact, by the time most of these programs were in place, US companies were well on their way to correcting their competitiveness problems. In addition, few were relevant to companies` often expressed concerns about workforce training, regulatory costs, and access to foreign markets. Twenty percent reductions in health care costs, regulatory costs, and education costs could annually pump $500 billion into the US economy and make companies operating in the US much more competitive in international markets.

    Governance models for the International Linear Collider Project are examined in the light of experience from similar international projects around the world. Recommendations for one path which could be followed to realize the ILC successfully are outlined. The International Linear Collider (ILC) is a unique endeavour in particle physics; fully international from the outset, it has no 'host laboratory' to provide infrastructure and support. The realization of this project therefore presents unique challenges, in scientific, technical and political arenas. This document outlines the main questions that need to be answered if the ILC is to become a reality. It describes the methodology used to harness the wisdom displayed and lessons learned from current and previous large international projects. From this basis, it suggests both general principles and outlines a specific model to realize the ILC. It recognizes that there is no unique model for such a laboratory and that there are often several solutions to a particular problem. Nevertheless it proposes concrete solutions that the authors believe are currently the best choices in order to stimulate discussion and catalyze proposals as to how to bring the ILC project to fruition. The ILC Laboratory would be set up by international treaty and be governed by a strong Council to whom a Director General and an associated Directorate would report. Council would empower the Director General to give strong management to the project. It would take its decisions in a timely manner, giving appropriate weight to the financial contributions of the member states. The ILC Laboratory would be set up for a fixed term, capable of extension by agreement of all the partners. The construction of the machine would be based on a Work Breakdown Structure and value engineering and would have a common cash fund sufficiently large to allow the management flexibility to optimize the project's construction. Appropriate contingency, clearly apportioned at both a national and global level, is essential if the project is to be realised. Finally, models for running costs and decommissioning at the conclusion of the ILC project are proposed. This document represents an interim report of the bodies and individuals studying these questions inside the structure set up and supervised by the International Committee for Future Accelerators (ICFA). It represents a request for comment to the international community in all relevant disciplines, scientific, technical and most importantly, political. Many areas require further study and some, in particular the site selection process, have not yet progressed sufficiently to be addressed in detail in this document. Discussion raised by this document will be vital in framing the final proposals due to be published in 2012 in the Technical Design Report being prepared by the Global Design Effort of the ILC.

    There is growing interest in energy efficiency (EE) among state policymakers as a result of increasing environmental concerns, rising electricity and natural gas prices, and lean economic times that motivate states to look more aggressively for cost-saving opportunities in public sector buildings. One logical place for state policymakers to demonstrate their commitment to energy efficiency is to 'lead by example' by developing and implementing strategies to reduce the energy consumption of state government facilities through investments in energy efficient technologies. Traditionally, energy efficiency improvements at state government facilities are viewed as a subset in the general category of building maintenance and construction. These projects are typically funded through direct appropriations. However, energy efficiency projects are often delayed or reduced in scope whereby not all cost-effective measures are implemented because many states have tight capital budgets. Energy Savings Performance Contracting (ESPC) offers a potentially useful strategy for state program and facility managers to proactively finance and develop energy efficiency projects. In an ESPC project, Energy Service Companies (ESCOs) typically guarantee that the energy and cost savings produced by the project will equal or exceed all costs associated with implementing the project over the term of the contract. ESCOs typically provide turnkey design, installation, and maintenance services and also help arrange project financing. Between 1990 and 2006, U.S. ESCOs reported market activity of {approx}$28 Billion, with about {approx}75-80% of that activity concentrated in the institutional markets (K-12 schools, colleges/universities, state/local/federal government and hospitals). In this study, we review the magnitude of energy efficiency investment in state facilities and identify 'best practices' while employing performance contracting in the state government sector. The state government market is defined to include state offices, state universities, correctional facilities, and other state facilities. This study is part of a series of reports prepared by Lawrence Berkeley National Laboratory (LBNL) and the National Association of Energy Services Companies (NAESCO) on the ESCO market and industry trends. The scope of previous reports was much broader: Goldman et al. (2002) analyzed ESCO project costs and savings in public and private sector facilities, Hopper et al. (2005) focused on ESCO project activity in all public and institutional sectors, while Hopper et al (2007) provided aggregate results of a comprehensive survey of ESCOs on current industry activity and future prospects. We decided to focus the current study on ESCO and energy efficiency activity and potential market barriers in the state government market because previous studies suggested that this institutional sector has significant remaining energy efficiency opportunities. Moreover, ESCO activity in the state government market has lagged behind other institutional markets (e.g., K-12 schools, local governments, and the federal market). Our primary objectives were as follows: (1) Assess existing state agency energy information and data sources that could be utilized to develop performance metrics to assess progress among ESPC programs in states; (2) Conduct a comparative review of the performance of selected state ESPC programs in reducing energy usage and costs in state government buildings; and (3) Delineate the extent to which state government sector facilities are implementing energy efficiency projects apart from ESPC programs using other strategies (e.g. utility ratepayer-funded energy efficiency programs, loan funds).

    This volume and its appendixes supplement the Advisory Committee`s final report by reporting how we went about looking for information concerning human radiation experiments and intentional releases, a description of what we found and where we found it, and a finding aid for the information that we collected. This volume begins with an overview of federal records, including general descriptions of the types of records that have been useful and how the federal government handles these records. This is followed by an agency-by-agency account of the discovery process and descriptions of the records reviewed, together with instructions on how to obtain further information from those agencies. There is also a description of other sources of information that have been important, including institutional records, print resources, and nonprint media and interviews. The third part contains brief accounts of ACHRE`s two major contemporary survey projects (these are described in greater detail in the final report and another supplemental volume) and other research activities. The final section describes how the ACHRE information-nation collections were managed and the records that ACHRE created in the course of its work; this constitutes a general finding aid for the materials deposited with the National Archives. The appendices provide brief references to federal records reviewed, descriptions of the accessions that comprise the ACHRE Research Document Collection, and descriptions of the documents selected for individual treatment. In particular, we consider the TOPHITS model, based on the PARAFAC tensor decomposition, to show that tensor techniques can be successfully applied in this context.     In response to public concern about the cleanup of the Three Mile Island, Unit 2 (TMI-2) facility after an accident on March 28, 1979 involving a loss of reactor coolant and subsequent damage to the reactor fuel, twelve citizens were asked to serve on an independent Advisory Panel to consult with the Nuclear Regulatory Commission (NRC) on the decontamination and cleanup of the facility. The panel met 78 times over a period of thirteen years, holding public meetings in the vicinity of TMI-2 and meeting regularly with NRC Commissioners in Washington, DC. This report describes the results of a project designed to identify and describe the lessons learned from the Advisory Panel and place those lessons in the context of what we generally know about citizen advisory groups. A summary of the empirical literature on citizen advisory panels is followed by a brief history of the TMI-2 Advisory Panel. The body of the report contains the analysis of the lessons learned, preliminary conclusions about the effectiveness of the Panel, and implications for the NRC in the use of advisory panels. Data for the report include meeting transcripts and interviews with past and present Panel participants.

    The current international energy trade governance system is fragmented and multi-layered. Streamlining it for greater legal cohesiveness and international political and economic cooperation would promote global energy security. The current article explores three levels of energy trade governance: multilateral, regional and bilateral. Most energy-rich countries are part of the multilateral trading system, which is institutionalized by the World Trade Organization (WTO). The article analyzes the multilateral energy trade governance system by focusing on the WTO and energy transportation issues. Regionally, the article focuses on five major regional agreements and their energy-related aspects and examines the various causes that explain the proliferation of regional trade agreements, their compatibility with WTO law, and then provides several examples of regional energy trade governance throughout the world. When it comes to bilateral energy trade governance, this article only addresses the European Unions (EU) bilateral energy trade relations. The article explores ways in which gaps could be filled and overlaps eliminated whilst remaining true to the high-level normative framework, concentrating on those measures that would enhance EU energy security.

The program`s goal is to provide financial relief to local governments that conduct emergency measures in response to releases or threats of releases of hazardous substances, pollutants, or contaminants. The intent of this program is to supply reimbursements of up to $25,000 per incident to the most deserving applicants, specifically local governments, for responses that exceed funds normally available for temporary emergency measures. These monies provide greatly needed support when potentially responsible party (PRP) searches and other cost recovery efforts fail. The standards and the approach for this program are set forth in 40 CFR Part 310, and are consistent with the overall policies and goals of the Superfund program. The maximum amount allocated to the reimbursement program is equal to 0.1 percent of the total amount appropriated for the Superfund, or approximately $1.7 million per year. A major focus of this program is to make known the availability of these funds for reimbursement to local governments in need of financial assistance. This paper highlights the features of this program, illustrates the types of incidents that have been awarded reimbursement, and describes common mistakes to be avoided when applying for reimbursement.

The project is being carried out in three separate phases, each focused on a specific approach to solving the problems identified by the industrial participants. These participants are selected through competitive procurements. Furthermore, the PVMaT project has been specifically structured to ensure that these PV manufacturing R&D subcontract awards are selected with no intention of either directing funding toward specific PV technologies (e.g., amorphous silicon, polycrystalline thin films, etc.), or spreading the awards among a number of technologies (e.g., one subcontract in each area). Each associated subcontract under any phase of this project is, and will continue to be, selected for funding on its own technical and cost merits. Phase 1, the problem identification phase, was completed early in 1991. Phase 2 is now under way. This is the solution phase of the project and addresses problems of specific manufacturers. The envisioned subcontracts under Phase 2 may be up to three years in duration and will be highly cost-shared between the US government and US industrial participants. Phase 3, is also under way. General issues related to PV module development will be studied through various teaming arrangements. 25 refs.
