The committee's recommendation of nearly $15.4 billion is $99.6 million below the budget estimates.     Most of this hearings record is devoted to brief statements to the committee and prepared statements submitted for the record by: (1) Dr. David Kay, Deputy Leader, IAEA Action Team for Nuclear Inspections; and (2) Dr. Hans Blix, Director General, IAEA. Dr. Kay spent considerable time in Iraq during the seven IAEA inspections of Iraqi facilities between May 14-23, 1991 and October 11-21, 1991. He says (1) it is overwhelmingly clear that Iraq had a clandestine nuclear weapons program of considerable breadth; and (2) there is a very high probability that Iraq is still withholding information from the inspection effort of the IAEA. He concludes that IAEA, with firm backing of the U.N. Security Council and a minimum of constraints, has a substantial proven capacity to carry out inspections. Dr. Blix reviews briefly the history of the IAEA inspection effort, starting with the 1950s' Atoms for Peace Program. He emphasizes that the one factor that enabled IAEA inspectors to find out in 5 months in Iraq what had not been uncovered in 10 years, was intelligence information; further, IAEA will make special efforts in the future to obtain such intelligence information.

    The purpose of this hearing is to look at the challenges facing the petroleum refining industry that are a direct result of recent Federal Government policy changes. A major challenge is the form of compliance with the new Federal environmental laws. The biggest challenge will be the Clean Air Act Amendments of 1990. Compliance will require the refining industry to change both the way it operates and the motor fuels that it produces. The witnesses first address how these new laws affect refinery operations, refinery output, and the distribution of refined products. Secondly, what will it cost the refining industry to implement these laws and how will this affect the cost of refined products. Thirdly, how will these laws affect the structure and competitiveness of the refining industry. Statements of various senators and industry representatives are included in the hearing.     The hearing was called to review Senate bill S.801 which would provide Federal eminent domain authority for coal slurry pipelines to facilitate the national distribution and utilization of coal. Obtaining rights-of-way for the pipelines, particularly across railroad lands, has been a major stumbling lock to construction in the US. Testimony was heard from 9 witnesses, representing the Building and Construction Trade Department of AFL-CIO, Snamprogetti USA, Association of American Railroads, Railway Labor Executives Association, Coal and Slurry Technology Association, American Mining Congress, Edison Electric Institute, and the state of Louisiana. An attorney at law also gave testimony. Additional material was submitted by the National Association of Regulatory Utility Commissioners, the American Farm Bureau Federation, American Public Power Association, several union representatives, and the National Rural Electric Cooperative Association.

Christensen of the Office of Surface Mining Reclamation and Enforcement, Department of the Interior, was the principal witness at a hearing on S. 643, which amends the Surface Mining Control and Reclamation Act of 1977. The amendment would allow states to set aside as much as 10% from the reclamation trust fund to apply to abandoned sites. Senators speaking in favor of the bill reported problems with obtaining home loans and insurance due to subsidence from abandoned sites. Christensen supported the bill in principle, but noted possible problems with handling interest and the actual transfer of the money. He also noted a possible breakdown in regulation with the current wording of the bill.
